I, DATUCAN D. MASTURA, of legal age, married and a resident of Kalamansig, Sultan Kudarat after having been duly sworn to in accordance with law, depose and say:

That I am a member of the Bureau of Fire Protection with rank of FO1 with Station assignment at Kalamansig Fire Office, Kalamansig, Sultan Kudarat;

That as FO1 of Kalamansig Fire Office, I am also designated as Assessor and Collecting Officer for the Municipality of Palimbang, Sultan Kudarat, and as such Collecting Officer I was issued one (1) stub of Official Receipt (O.R) bearing series number 0347551-0347600 and Order of Payment Slip (OPS) with series number 0919201-0347600 on October 5, 2010, by the Provl LOG/SAO, and which accountable forms were kept by the undersigned in a sealed envelope, placed inside a closet in our house at Kalamansig, as the same is intended for collection in Palimbang Municipality;

That in compliance to RAD MSG CN: OPFML-0608-001-2011, undersigned affiant turned over the above-mentioned Accountable Forms to his superior officer, INSP. Raul E. Tuga, BFP, Actg. Municipal Fire Marshal, Kalamansig, Sultan Kudarat who in turn submitted the same to the ACTG. Provl Fire Marshal, BFP, SK Provincial Command 12, Tacurong City, Attn: C, Provl LOG/SAO in a transmittal letter dated 14 June 2011;

That surprisingly the attention of the undersigned was invited in a Memoramdum to Actg MFM, Kalamansig Fire, Office stating that the original Official Receipt Number 0347551 is missing while the duplicate and triplicate is intact on said stub without any written collection and the whole stub of the O.R. Nos. 0347551-0347600 was returned to the undersigned to give me a chance to recover the original of the O.R. No. 0347551; and that I am given 15 days to recover the missing original O.R. and submit the complete series of O.R. to OPFM Sultan Kudarat Province personally on 30 June 2011 ATTN Chief Provl Log/SAO;

That I wish to state that without examining the stub of O.R Nos. 0347551-0347600 upon receipt of the same from the Chief, Provl Log/SAO on October 5, 2010 I placed the same inside a medium brown envelope and upon arrival home in Kalamansig I placed it inside a locked closet.

That the two (2) STUBS of Accountable Forms never been brought out from where I placed the same until I turned it over through my superior officer INSP. Raul E. Tuga BFP because it has never been brought to Palimbang and never been used for the purpose as there was no collection at Palimbang from the time I received the accountable forms up to the present;

That with all candidness and honesty I have NO knowledge where was the original of O.R. No. 0347551 detached from the stub because the closet in our house where I place the same was always locked and I am the one keeping the key;

That my only lapses was that I was not able to examine upon receipt of the stub and when I turned it over to my superior in compliance with the RAD MSG CN: OPFML-0608-001-2011, as to whether the same is complete;

That I am executing this Affidavit to clarify my position on the missing O.R. NO. 0347551 and for whatever legal intents and purposes it may serve the undersigned under the premises.

I, ANGELO M. JAMIN, of legal age, married and a resident of Poblacion, Sen. Ninoy Aquion, Sultan Kudarat, after having been duly sworn to in accordance with law, depose and say:

That I am the same Angelo M. Jasmin who is an employee of the municipal government of Sen. Ninoy Aquion as driver and assigned as Official driver of an ISUZU FORWARD six wheeler dump truck with Plate No. AG-890 and while travelling from Sen. Ninoy Aquino to Isulan on April 27, 2009 and at about 11:30 oclock in the evening I was intercepted and apprehended by elements of DENR, CENRO XII-5A at CPAC Checkpoint, Barangay Kalawag III, Isulan, Sultan Kudarat, the dump truck I was driving having been found loaded with 115 pcs. with equivalent volume of 1,530 Bdft of Igem Lumber covered with canvass, and now, being administratively charge for violation of Sec.68 of PD705 as amended by Executive Order No. 277, Series of 1987;

That I vehemently deny personal knowledge of the presence of the above-mentioned lumber on board of the dump truck I was then driving, the truth of the matter being that my purpose of travel was to fetch medicine from President Quirino to be brought back to Sen. Ninoy Aquino, but when I passed by a friend at Barangay Lagubang, Ninoy Aquino, whose house is about 50 meters away from the National highway, parked the dump truck along the National highway and proceeded to the house of my friend who offered some drinks and it took me about 30 minutes in the house of my friend;

That when I left the house of my friend proceeded to the dump truck, mounted the same immediately and drove the truck proceeded to Isulan, and noticed that somebody hitched ride with me who informed that they loaded some sacks of corn grains, but I did not mind;

That I discovered only that lumber was loaded on the dump truck I was driving at Lagubang when I was flagged down by elements of DENR at Kalawag III, Isulan, Sultan Kudarat who conducted inspection on the truck and found the said lumbers underneath thick canvass;

That I am innocent of the charge against me, having no personal knowledge of having violated any law;

That I am executing this affidavit to attest to the truth of my foregoing declaration and do hereby pray unto the Hearing Officer of the DENR-CENRO XII-5A to dropped and/or dismissed the case filed against me for lack of intent to commit a crime and, therefore, with out merit. AFFIDAVIT OF WAIVER

We, MUCALNA SIMPAL alias NONG, SAMBAIN SIMPAL alias RACMA, NORAISA SIMPAL CADO, TANOMBAY SIMPAL and MAMOT SIMPAL, of legal ages, all married and residents of Bual, Isulan, Sultan Kudarat, after having been duly sworn in accordance with law, deposes and says;

That we are the children of the late Pangandigan Simpal, the registered owner of a parcel of land identified as Lot No. 1911, Pls-208-D-17 (VOS), containing an area of 79,980 Square Meters, situated at Daguma, Bagumbayan, Sultan Kudarat;

That for and in consideration of the total sum of SIX HUNDRED THOUSAND (P600,000.00) PESOS, Philippine Currency, to us in hand paid in full to our entire satisfaction, by JOEL DELGADO, of legal age, married and a resident of Linapawan, Daguma, Bagumbayan, Sultan Kudarat, have WAIVED, as we do hereby WAIVE, whatever rights, interest and participation we have, if any, over a portion of two (2) hectares (20,000.00 Square Meters) of the above-mentioned parcel of land unto the said Joel Delgado, his heirs, assign and successors-in-interest, NOW AND FOREVER.
