of Sale acknowledged before notary public Godofredo M. Duremdes IIIand entered in his notarial register as Doc. No. 51, Page No. 11, BookIII, series of 2001;

3. When I had the Deed of Sale presented before the Bureau ofInternal Revenue (BIR) for purposes of payment of capital gains andtax clearance so that the property will be registered and transferredunder my name, I was required to contact the previous owner forthem to sign the Capital Gains Tax Return (BIR Form No. 1706);

4. I do not know the exact address of the Spouses LIMSIACO

except the fact that they are staying somewhere at New SIR Matina,Davao City. Our only means of communication is their PLDT telephoneline with no.2981663; However, the telephone line service was alreadycut off as evidenced and can be heard from a voice message NOTYET IN SERVICE;

5. Despite diligent efforts to locate the said spouses LIMSIACO,the same proved to be a futile exercise;

6. That I attest to the truth of the foregoing statements and I amexecuting this affidavit for whatever legal purpose it may serve.

The above-mentioned cost includes the concreting/masonry,steel works, Carpentry works, Tinsmithry works, hardware, Tiling,Plumbing, Electrical and Formworks, the last of which I understand tobe for the necessary papers, construction permits and otherdocumentations relative to the construction of the said house;

4. As of this date, I already gave Engr. Eric S. Villaflor theamount of Three Hundred Thousand Pesos (P300,000.00) as advancepayment and he assured to me that the construction will go onsmoothly;

5. On January 28, 1999, the construction of the said two (2)storey residential house started;

6. However, as months go by, we noticed that the constructionwas moving on a slow phase. In fact, as of this date, only the basicfoundation of the house was finished;

7. In the later part of the year 1999, I received a notice of illegalconstruction from the Office of the Building Official, City EngineeringsOffice, Davao City;

8. I consulted Engr. Eric S. Villaflor about the matter and headvised me to get a certification that my husband, Prudencio Bulseco,is the registered owner of the lot;

9. I went to the Insular Development Corp. at Manila to get whatEngr. Villaflor needed and I was given the title and lot no. of the parcelof land owned by my husband;

10. I gave the said title and lot no. to Engr. Villaflor and heassured me that the same were already sufficient in order to have aconstruction permit for the two (2) storey residential lot ;

11. On January 31, 2000, I was surprised when I received aFINAL NOTICE of illegal construction from the Office of the BuildingOfficial, City Engineerings Office, Davao City since I thought thatwith the huge amount I have already given to Engr. Eric S. Villaflor, all

the necessary papers, building and construction permits, and otherdocumentations relative to the construction of two (2) storeyresidential house were already in order;

12. Because of the above-mentioned reason, coupled with thefact that the construction was moving on a slow phase, I decided tostop the construction and terminate the services of Engr. Eric Villaflor;

13. I have no intention to violate any law or ordinance imposedby the Government, local or national, but the lack of the necessarybuilding permit was due to the reasons stated above;

14. I hereby attest to the truthfulness of the foregoingstatements and I am executing this affidavit for whatever legalpurpose it may serve.

6. That my daughter, Catherine P. Librero, immediately made a decision andrequested the pilot of the aircraft to bring his brother, 2LT Emmanuel P. Librero, to theDavao Doctors Hospital ;

7. That Catherine P. Librero decided to bring his brother at the Davao Doctors

Hospital instead to a Military Hospital or the Davao Medical Center because she wasalready panicky that time and as a non-resident of Davao City, she only knew of oneHospital - and that is the Davao Doctors Hospital;

8. That on October 18, 1999, my son, 2LT Emmanuel P. Librero was transferredfrom the Davao Doctors Hospital and was admitted at San Pedro Hospital and there, hewas diagnosed of Multiple Fractures, Zygoma & Temporal Fossa; Epidural Hematoma,Temporal Area; Subgaleal Hematoma Sec to V/A S/P Craniectomy, Evacuation ofHematoma;

9. That all medicines and laboratory examinations incurred during the confinementof my son at the hospital amounted to THREE HUNDRED THREE THOUSANDPESOS (Php 303,000.00) more or less.
