Florida’s closed seasonsfor spotted sea trout are end-ing, but not quite yet.Catchers can’t be keepersuntil next year.

Fish and WildlifeConservation Commissionersvoted in November to openthat fishery year-around,based on stock assessments

indicating statewide abundance of the popular species. The new rules take effect next Feb. 1, formerly the

first day of North Florida’s one-month closed season. Inthe larger southern region — south of the Fred HowardCauseway at Tarpon Springs on the Gulf coast and theVolusia-Flagler county line on the Atlantic — the currentNovember-December closed season stays in effect for therest of this year.

That might explain why sea trout were so easy tocatch last month and presumably will be easy again thismonth, provided that you find them first.

They’re one of our most accommodating fish, usual-ly indifferent to extremes of cold and heat, lunar phases, wind speed, even tidal stage.

An active school will rush almost anything youoffer: live or dead bait, plugs, spoons, jigs, jig-and-tailcombinations or flies resembling live bait.

The plain old-fashioned popping cork (now styro-foam) rig, sold for pocket change in plain old-fashionedbait stores, is still great. Even more so are modern ver-sions with bigger bobbers and clicking beads, sold inserious tackle shops for the price of a decent lunch.

Our favorite trout locations are grass flats and any-where a current whips around a point of land or man-groves. In very shallow water, use skimmer jigs with

weed guards and hooks that ride up to reduce snaggingon sea grass.

Size limits are staying the same. Keepers have to beat least 15 to 20 inches total length, except that you cankeep one longer than 20 inches.

The northeast region bag limit will increase fromfive fish to six. Anywhere else, it will still be four troutper day per person.

If you don’t know a manatee from a man o’ war, it’stime to learn. We get lots of both in wintertime, and it’simportant for fishing-doers and boaters to know the dif-ference and watch out for both, for different reasons.

The manatee is the official marine mammal of thestate of Florida. The man o’war could qualify as officialnuisance of the beaches, but it hasn’t the organization, marketing savvy or political influence to achieve that sta-tus, uh, officially.

If you touch a man o’ war it stings, sometimes verypainfully. If your jetski or powerboat hits one, you’re notlikely to notice or feel guilty. You can’t do that to a man-atee. They’re protected by law, which is why the FWC isreminding us to watch but don’t touch.

One way to avoid harm is to obey speed zone signs— lots of new ones along the Intracoastal Waterway andplenty of older ones along channels that lead to marinasand inland canals.

Slowing down doesn’t relieve us of the responsibili-ty of watching where we’re going. Manatees have a fewways to signal their presence. When they wag their large, flat tails they make a flat spot on the water’s surface.Sometimes it’s a line of swirls, a mud trail, a snout or atail breaking the surface.

Other times you’ll see a brownish mass that lookslike a big, long rock just beneath the surface. That’s nota rock, it’s a manatee. If you see only one, there’s prob-ably another close by or a little deeper.

Here is R. Kipp Frohlich, the FWC’s man in chargeof managing imperiled species:

“If you think you see a manatee, please slowdown and give the animal plenty of room because itmay not be alone. It may have a calf or be travelingwith other manatees.”

If you’re on the water on a cold day—air tempera-ture 50 degrees, water temps 68 or lower — that’s when

ARE YOU

you’re most likely to see manatees moving into uplandcanals. Like snook and some other cold-sensitive fish, they’ll continue inland until they find comfortable tem-peratures, often gathering at a lock and dam becausethat’s as far as they can go.

From land, it’s also the best kind of place to seethem close up, this side of Sarasota. In Sarasota you canwatch them eating enormous amounts of romaine lettucein the aquarium of Mote Marine Laboratory at 1600 KenThompson Parkway.

What must we do if we see a distressed or injuredmanatee? This: Phone the Wildlife Alert hotline, 888-404-FWCC (3922) or send a text to [email protected] Youcan also use a cell phone to call #FWC or *FWC, depend-ing on your service provider’s method.

Col. Jim Brown, director of the FWC's Division ofLaw Enforcement, announced that FWC’s Wildlife Alertpeople are taking text messages, the best way to reportviolations in real time. You don’t have to wait for some-one to answer the phone. You don’t have to worry aboutbeing overheard.

The text address is [email protected], same as forinjured manatees.

“The text-messaging option makes it more conven-ient for the public,” Brown said. “We also hope it will

That depends on someone providing useful details, which he can do by texting without fear of the lowlifesoverhearing him as he describes them. For all they know,he’s checking football scores on his phone, or trying toborrow money.

FWC spokesman Bob Wattendorf said the first textmessage should report the specific violation and the loca-tion as accurately as possible, then describe the violatorsand their vehicles. Wildlife Alert dispatchers, who are onduty all the time, will text back for other details.

It’s bad enough that Biscayne National Park’s long-term plans include a 10,522-acre no-fishing zone overreefs on the ocean side of Elliott Key, or maybe one twicethat size. It’s worse that those plans, introduced at pub-lic hearings in mid-September, were made without con-sulting the state of Florida.

The Biscayne and National Park Service people whocarefully wrote and colorfully mapped four alternativeGeneral Management Plans, three of them with offshore“marine reserves,” intended to solve problems causedby overfishing.

Too bad they didn’t tell FWC what they were up to.Excluding the state from the management plan’s prepa-ration was no mere protocol error, easily overcome by anexpedient apology.

The state and the park have a long-standing deal, due for renewal next September, for the state’s activeinvolvement in Biscayne’s fishing rules. Roughly half ofthe park’s territory was given by the state in 1970.

The agreement, called a “Memo of Understanding”or MOU, says the Fish and Wildlife ConservationCommission and the park will consult with each other. The state “will play a crucial role” in new regulations andother fishery management actions in the national park.

It also acknowledges the state’s opposition to no-fishing zones, and it specifies that no marine reserveswill be established unless FWC and the park agree that’sabsolutely necessary, a last resort.

The state doesn’t agree it’s necessary. Maybe itwould, but Biscayne hasn’t asked it to, or provided datato prove it, FWC executive director Nick Wiley com-plained in a letter objecting to the management plan.

He cites nine other potential violations of theMOU—park management proposals that would directlyor indirectly restrict fishing, all written without consult-ing the state.

Mark Lewis, superintendent of Biscayne, points tothat same MOU where it says FWC recognizes that thepark intends to consider marine reserves “for purposes

breeders, they fill the marine reserve with large numbersof fish that then swim out of the reserve and lead togreater catches adjacent to the zones, a process knownas spillover...large fish often swim right up to snorkelersand divers, providing an experience unmatched through-out the rest of our coastal waters.”

That’s what you ought to see in a tropical marinepark, he wrote: “This plan, and this proposed MRZ arethe only ways we know to fulfill that mission.”

That doesn’t justify cutting the state out of the plan-ning, does it?

One rationale for it is that the no-fishing zones areproposed for the park’s original 1968 territory when itwas begun as a national monument. Quoting theCongressional act that created it, the plan asserts thatBiscayne can impose fishing restrictions there “after con-sultation with appropriate officials of said state.”

Uh-oh. Appropriate officials of said state say therehasn’t been any consultation, and they object.

More of the park’s excuse for ducking state partici-pation is that the proposed no-fishing zone is a conserva-tion and visitor experience issue, not a fishing issue. Itsays state involvement in fishing issues applies only to aseparate fishery plan, not the general management plan.

Hmmm, so a no-fishing zone is not a fishing issue? What nonsense! That’s the sort of trick lawyers

come up with, an argument using semantic hair-splittingto duck requirements and justify doing the wrong thing.

It doesn’t fool the FWC. Nick Wiley’s 9-page com-plaint affirms the state agency won’t take it lying down:

“The proposed regulatory actions, combined withthe lack of agency coordination, make it abundantly clearthat the park’s regulatory strategy is to address fisheriesmanagement issues within the context of the GeneralManagement Plan and outside of the framework of theMemo of Understanding and the Fisheries ManagementPlan,” his complaint says.

“There is no doubt the draft General ManagementPlan (GMP) proposes significant restrictions on fishingopportunities that should be addressed through the pro-visions of the MOU and the FMP.”

He wants the National Park Service to withdraw fish-ing and related provisions from the plan and work close-ly with FWC on proposals “that reflect a better balancebetween resource protection and the public interest.”

Lisa Gregg, a marine fisheries staff member whocompiled the objections and drafted the letter, said FWCis ready to fight back through another federal process, the Coastal Zone Management Act (CZMA). Thatrequires federal actions to be consistent with a state’sfederally approved coastal management program.

Florida has one of those. The Wiley letter argues thatfederal actions proposed in the Biscayne plan are incon-sistent with it. Lewis said the Park Service believes itsplan is consistent with the still-active Memo ofUnderstanding.

other than sound fisheries management.”What purposes?“Such as appropriate visitor experience in a nation-

al park,” Lewis says, citing the belief that a no-fishingzone would allow fish and corals to grow to impressivesizes. That in turn would enhance enjoyment of Biscaynefor snorkelers and divers.

Nice, but the memo of understanding doesn’t saymaking a no-fishing zone for that reason would be noneof the state’s business. If it did, the state wouldn’t haveagreed.

“We certainly cannot support a marine reserve thatcloses large areas for fishing within BNP until less restric-tive fisheries management measures have been consid-ered and tried,” the FWC letter says.

FWC knows very well that fishing quality in the parkhas declined over the years, with fewer and smaller fishreported by each annual survey. Corals have been dam-aged and destroyed by careless anchoring.

That might require drastic solutions but, as we’veoften argued here, solutions less drastic than no-fishingzones should be tested first. It’s just good sense, evenwithout that MOU requiring it.

The rationale for marine reserves is that theywork. Lewis reiterated it in a recent internal newslet-ter for park staff:

“As fish become larger and become more prolific

December 2011 Waterfront Times

BY MARK ERCOLINWaterfront Times Columnist

Good grief! Is it the holiday seasonagain?

It seems like August was just yester-day when all the stores started puttingup those festive decorations.

As so aptly pointed out by Peanuts’Charlie Brown, commercialism canruin the holidays.

But a good time can be had if wekeep our perspective and thoughts tothe people and things that really mat-ter to us.

This remains good advice even forboaters. Sure, we can just as easily bewhisked away by the glitz, lighting, parades and parties that the holiday sea-son has to offer. But when you own aboat, you are strapped with an extralayer of responsibility.

Possibly, holiday boat trips withfriends and family are among themost memorable times you can haveduring the year. These excursionsshould be done safely and legally, sothey do not become memorable forthe wrong reasons.

Seaworthiness is both a legal termand a term of art. Generally, a seawor-thy vessel is defined as being reason-ably fit for its intended purpose. Thismay sound rather broad (and depend-ing on the circumstances, it can be),but for most recreational purposes itmeans that a boat should be kept ingood working order, have sufficientand well maintained safety equipmentand be manned by a competent andproperly trained crew.

While this is obvious to most goodboaters, the holiday season can createspecific scenarios requiring extra pre-cautions. With that in mind, here are afew extra points to consider regardingseaworthiness during the holidays:

● Lighting: Sure, we all know that

you should use your boat’s navigationlights from dusk to dawn while under-way. But during the holidays, many ofus adorn our boats with seasonal deco-rations and festive lighting — maybeeven installing an animatronic Snoopy,Rudolph, or Grinch. These lights andtoys look great while we’re docked orin a properly supervised parade, butcan be a potential safety concern ifyou’re otherwise running your boat inthe darkness.

Think about it — your navigationlights are installed at specific locationsand shine in certain colors and arcs fora reason. If you’re traveling on the waterwith holiday lights blinking, oncomingtraffic can claim they couldn’t tell if youwere coming, going, or at anchor.

Should an accident occur, youcould be looking at liability problemsbecause someone says they couldn’t tellthe difference between your port lightand Rudolph’s nose. So while under-way, in most circumstances holidaylighting should be kept to a minimum.

● Allowing a young person to useyour boat: That’s right, during the holi-days visiting friends and family mem-bers just might want to borrow yourboat or personal watercraft.

While anyone using your boat cancreate liability issues, a recent Floridastatute makes young boat operators ofparticular concern. Anyone operating avessel in Florida waters born Jan. 1,1988 or after is required to have a boat-ing safety education ID card — unlessthey’re under the supervision of some-one with a card or is exempt to age. Thisstatute also includes the use of personalwatercraft, so generally no exemptionwould apply in that case anyway.

Now, you could look at this statuteas a ready-made excuse for not givingthe boat keys to a young relative. But if

The Fort Lauderdale Boat Showended on Halloween. If you didn’t go,I’m sure you witch you had.

My wife thought it would be toodepressing, so she stayed home. Thegood news is I was able to sell my extratickets, which covered parking for twodays and one beer.

On Thursday I parked at WarMemorial Auditorium and took the busto the Broward Convention Centersince it was the first one that camealong. There was a long line at theentrance. A busload of boaters drovedown from North Carolina without pic-ture ID. Even with ID I was held up, asthe attendant had to verify my compli-mentary guest ticket.

I moved through the ConventionCenter quickly. Since I can’t afford anew boat of any size, there’s no senselooking at the small ones. A short busride took me to Bahia Mar to see the bigyachts I can’t afford.

I even ran into Dan Marino. I sawhim last at the Miami-Denver presea-son game on Aug. 25, 1990. He didn’tremember me.

Judging from the crowds and all thenew models, you wouldn’t think theeconomy was in bad shape. There were165 boat manufacturers displaying mod-els from 9 to 245 feet.

I dropped business cards in everyfish bowl I came across. Thanks to LXRLuxury Marinas, I spent three days inbed after I threw my back out while run-ning around my house taking pictures ofMolly the Manatee for a photo contest. Now under heavy medication, I wait bythe phone for the call to pick up the iPadthat I expect to win.

Aside from free tickets, the otherreason I went to the show was to attendtwo receptions I was invited to.

Thursday’s event took place aboard theM/V DREAmer, sponsored by BoatingWriters International. DREAmer is a136-foot Hargrave yacht built in Turkey.

The hors d’oeuvres were excellent, better than the pizza rolls and cocktailwieners I’m used to. As a dreamer, parexcellence, I began rethinking my planto share the Powerball with 21 relatives.I’m sure they would be just as happyvisiting me on my yacht as receiving$250,000 a year.

While waiting for the party to beginon DREAmer, I boarded the Empress, a58-foot 1947 Consolidated motor yacht,a bargain at $495,000 considering the $1million refit in 2000.

I immediately lapsed into one of mydaydreams where I was docked atMystic Seaport sitting in the cockpit sip-ping a cold Yuengling. The broker wokeme up and asked if I had any questions. It seems he had some real customerswho wanted to look around.

It’s amazing the number of youngladies walking on floating docks in highheels or pushing baby strollers. I wasalso surprised at the amount of peoplewho brought dogs. I know dogs lovejazz and art festivals but didn’t knowthey liked boat shows.

Show Management’s website clear-ly states “pets should be left at home”unless they are “licensed workingdogs.” None of the dogs I saw werewearing a service dog ID vest. Fidocould have also been a search and res-cue dog trained to find its owner whohas caught her high heels on the float-ing dock and fallen overboard.

I returned home Friday night towait for the calls for my free gifts and thePowerball drawing Saturday. I still hadtwo days to run back to the show andbuy a new yacht but it didn’t happen.Maybe at the next boat show.

marine program in 2008 with just 20students. The program now has over50 attending three sessions. The pro-gram is also accredited by theAmerican Boat & Yacht Council(ABYC). Graduates earn not only adiploma but also ABYC-certification,which allows them to go to workimmediately in the industry.

ABYC president Skip Burdon saidthe marine industry is hurting for quali-fied marine technicians and engineers, especially in South Florida.

“While new marine production def-initely dropped in 2007 with the crash ofthe economy, the yards in South Floridaare still seeing a shortage of certifiedtechnicians,” he said. “That’s because inBroward County, and in Miami, thereare quite a few outstanding boatyardsthat do refitting of older vessels.”

Burdon said that in the present econ-omy many boat owners are refitting olderboats and yachts because it’s cheaperthan buying new. He said many brandsare good candidates for restoration.

“Bertrams especially are well-constructed, quality boats that arebuilt to last many years. It’s notunusual to see 40 and 50-year-oldBertams on the water, still lookinggood. But that also takes proficienttechnicians to work on them andkeep them up to standard.”

The donation came about afterCathy Petowsky, LMC compliance andsafety officer, learned that the Lundswere planning to dispose of the boat, which had aged and been vandalized. She suggested they instead donate it tothe college program.

Mark Pratt, LMC general manag-er, offered to provide dry dock, work-space and services to Broward

College’s program at their yard.Burdon said Broward College cur-

rently produces the most graduates ofthe Marine League.

“They are definitely taking the

lead,” he said. “And that’s good forthe industry, especially in SouthFlorida, where it’s most needed. And what we get for the industryare safe and reliable boats.”

NOAH ROSENBERG ● The New York Times Syndicate

Quebec is a city of delightfully stark, yet virtuallyseamless contrasts; centuries-old fortification walls leadto chic open-kitchen restaurants, and cobblestone streetsgive way to bike paths and innovative art institutions.

The enchanting Francophone capital of Quebecprovince, and one of the oldest cities in North America,Quebec City received a major facelift before its 400thanniversary in 2008.

Perhaps more significant than the new boutiquehotels, revitalized parks and gleaming cultural centerswas the overdue attention the city finally received, whichcontinues to propel it forward. Quebec City, a historic, cultural and culinary center beside the St. LawrenceRiver, has emerged from the long shadow cast by its ever-popular neighbor, Montreal.

Classics done rightWhen it comes to cuisine, Quebec City might as well

be Paris West, with its no-holds-barred amalgam of tradi-tional French, native Quebecois and innovative farm-to-table offerings.

Best to start with the basics. On a narrow windingstreet in Old Quebec, Cafe Chez Temporel (25, rueCouillard; 418-694-1813) is a deliciously classic Frenchcafe, with windows made for people-watching.

The 36-year-old spot plays a gentle mix of folk andFrench music – a lovely soundtrack for eating the perfectcroissant (about $2 U.S. dollars) or a slice of quicheLorraine with a salad ($8.75) and a cafe au lait ($2.75)among the locals.

Head up the staircase at the corner of Rue St.-Louis and Côte de la Citadelle and climb onto thewide, grassy fortification wall that rings the old city.Walk north on the wall (one of the most intact defen-sive city walls in North America) among the cannonsand the sunbathing, dog-walking, hand-holding resi-dents. Dinner for two, including wine, is about $120. For a down-homey alternative, head to La Cuisine

(205, rue St.-Vallier Est; 418-523-3387; barlacuisine.com),a restaurant and bar outfitted like a retro university stu-dent’s apartment. The vintage furniture is for sale andthe kitchen is open, with a decades-old stove and a pairof microwaves churning out Quebecois comfort food likecroque monsieur and casseroles. Dinner for two, withlocal beer, is about $30, live D.J., hip crowd, Nintendoand other diversions included.

Quebecois cabaretFor an artistically inspired night out, there’s Le

It offers live indie, rock, dance and folk music, and films, comedy shows and theater. (Admission rangesfrom free to $25.) The spot also features local art and

where urban decay has yielded to a gentrifying blendof government investment and pioneering artists andentrepreneurs.

Grab a bite at Bistrot Le Clocher Penche (203 rueSt.-Joseph Est, 418-640-0597, clocherpenche.ca), abistro whose name is a homage to “the leaningsteeple” across the street.

The blood sausage, soft-boiled egg and poachedpear over a puff pastry ($17; coffee and yogurt parfaitincluded) is excellent. Then wander into the nearbyBoutique Lucia F (422, rue Caron; 418-648-9785), a vin-tage clothing shop, with nary an item over $100.

Just down the Rue St.-Joseph is Morgan Bridge (367,rue du Pont; 418-529-1682, morganbridge.ca), a galleryof Quebec City and Montreal street and comic art thatsells locally made T-shirts, music and books. For a high-brow alternative, visit La Chambre Blanche (185, rueChristophe-Colomb Est; 418-529-2715; chambre-blanche.qc.ca), an art collective that features the work ofits current international resident artists and displays theportfolios of those it has hosted since 1982.

Hyperlocal beerLa Barberie (310, rue St.-Roch; 418-522-4373; labar-

The cooperative brews 30 to 50 beers a year, ranging from a tasty India Pale Ale to sangria, chardon-nay and tea-flavored varieties. For the full experience, order a $16 carousel with five ounces of each of the eightdifferent beers on tap.

A hot ticketBistro B (1144 Avenue Cartier; 418-614-5444;

bistrob.ca), the elegantly modern yet cheerfully com-munal new restaurant from François Blais – the rock-star chef who opened Panache, one of the city’s mostrenowned dining spots – has superb food, design andservice. The menu changes daily, but you can’t gowrong ordering the tartare du jour and the duckbreast, which on a recent night was served in a whitewine sauce with a butternut squash puree and purplebroccoli. For dessert, try the cheesecake, heavy inchocolate, with an accent of raspberry sorbet. Dinnerfor two, with wine, is roughly $130. Reservations rec-ommended.

the Old Port neighborhood. But those worlds collidequite cleverly in Machin Chouette (225, rue St.-Paul; 418-525-9898; machinchouette.com), French for “CuteMachine.” The design shop sells handmade pieces, like alamp made from an antique tricycle ($620). For culinarycreativity, cross the street to Le Marche du Vieux-Port(160, Quai St.-Andre; 418-692-2517;marchevieuxport.com), a sprawling market where chefsand tourists browse stands of local seafood, meats, cheeses, produce and pastries.

Francophile Quebec City offers food that rivals Paris

State view may differ from park staffCiting the CZMA is a reluctant choice for the FWC. “We just don’t prefer to use it because it is usually our

tool of last resort,” Gregg said. “There could have beenample coordination on these issues ahead of time thatwould have prevented us from having to go this route.”

The CZMA also can work as a backstop for the statein case the Park Service decides let the Memo ofUnderstanding expire, unrenewed, next September, shut-ting the state out altogether.

The Park Service might also use that prospect asleverage to obtain a new agreement giving itself morecontrol of fishing.

By resorting further to the CZMA, the state woulddelay the management plan’s implementation, nowtimetabled tentatively for next fall. It’s been in the workssince 2003, while the park continues operating under anoutdated general management plan enacted in 1983.

Then we would have two governments staring eachother down, waiting to see who blinks. None of that

would be good. Why did the National Park Service, or Biscayne’s

own staff — we don’t know whose idea it was or whoapproved it — choose to bypass the state?

Impatience is our only guess right now. It’s easy toimagine someone deciding that something drastic had tobe done about overfishing pretty quickly and that con-sulting the state would take too long.

Lisa Gregg said a conference call, the first attemptto negotiate the dispute, was scheduled for Nov. 30.Wiley’s letter was dated Oct. 10 — addressed to SallyMann, the state’s director of environmental protection, not to Lewis and the Park Service, but they know allabout it by now.

We can infer that Lewis and National Park Servicepeople up the chain of command know Biscayne’s coop-erative relationship with Florida is bobbing betweenshallow reefs at low tide.

Let’s see how much they think it matters.Do you want to praise this column? Denounce it?
