Studying the admiralty field — the field of marine casualties and transactions —ne-cessitates inquiry into issues ranging across much of the basic law school curriculum,including civil procedure, comparative law, conflicts of laws, constitutional law, con-tracts, creditors’ rights, environmental law, federal courts, insurance, international law,legislation, products liability, property, remedies, torts, and workers’ compensation.

We do not claim that our book provides the opportunity to teach all of these sub-jects. But we have tried to select cases with an eye to maximizing the admiralty course’spotential for integrating the knowledge the students will have gained from their othercourses. In Section I-F’s Thornsteinsson opinion, for example, U.S. law’s commitment tothe requirement of physical arrest of the vessel in in rem proceedings as an essential ele-ment of due process came into sharp conflict with our country’s strong regard for thenecessity and wisdom of recognizing the judgments of other countries’ courts. For an-other example, see United Rope in Section I-G-10, a cargo-damage case in which JudgeEasterbrook provides a keenly analytical look into the murkiest part of the pervasiveissue of personal jurisdiction. A third good example of what we think of as cross-cutting cases is Section II-A’s Brotherhood opinion, in which Judge Posner gives a luciddemonstration of the usefulness of the Learned Hand negligence formula (the B<PL?inquiry) in the context of a widely-publicized accident in Milwaukee’s harbor. The Supreme Court here presents a colorfulpicture of the life of lower Mississippi River pilots in the course of a demonstration thatstate-supported nepotism does not necessarily violate the equal protection clause.

In editing the cases and supplementing them with textual material, we have used thefollowing signals: Omitted text is signaled by three asterisks. (An ellipsis thus indicatesthe courts’ omissions in the original opinion.) Inserted text is enclosed in brackets.Omitted citations are signaled by empty brackets. Our own editorial footnotes to theopinions are signaled by putting the footnote number in brackets. (Otherwise, footnotenumbers in opinions are the courts’ original numbers.) Cross-references within thebook refer to the chapter number, the section number, and the sub-section (if any).Thus “Section II-A” means chapter II, section A, and “Section I-G-10” means chapter I,section G, sub-section 10.

Because this is a teaching book and not a case reporter, we have made some changesto the opinions without providing any signal. These include minor changes to thecourts’ punctuation and typography, correction of obvious spelling errors, and correc-tion of citations and citation form. Unsignaled omissions include the courts’ citationsto the record, citations to the opinions below, and the courts’ footnotes. Occasionally,we found that our editing of an opinion required moving one of the court’s footnotes.When we did that, we left the footnote number intact but did not signal the change ofposition.
