Public Input No. 2-NFPA 307-2013 [ Section No. 4.1 ]

4.1 General.

Design, materials, and workmanship of pier and wharf construction shall conform to standards NFPA5000, as well as other standards and construction practices that ensure a durable and safe structure thatcan withstand the forces of nature to which piers and wharves are likely to be exposed, including thedeteriorating influences of the environment and the expected wear and tear of operation and use, so that asafe place is provided for all occupants .

Statement of Problem and Substantiation for Public Input

NFPA 5000, Building Construction and Safety Code not only provides specific provisions for construction but addresses egress (31.8) flood plain construction (39.2.12) and Accessibility (12.6.2.10, 12.6.2.14, 12.35.3, 12.45.9.2 & 12.45.9.3). NFPA 307 section 1.3.1 already requires “special consideration” and this change would lead the standard to those considerations.

Additionally, NFPA 307, Chapter 5 specifically references Terminal Buildings as being constructed to the requirements of NFPA 5000, Building Construction and Safety Code, why wouldn’t the pier upon which the terminal building is proposed to be located also require compliance with NFPA 5000, Building Construction and Safety Code?

The last clause of section 4.1, which states “so that a safe place is provided for all occupants”, is redundant as the general purpose of all NFPA Standards is to accomplish this goal. In addition, if this clause remains, and someone would happen to become injured or deceased on a pier or wharf, that result would show a general violation of NFPA 307 regardless of compliance to the specifics contained within the Standard.

4.2.2 Protection Against Mechanical Physical Damage.

4.2.2.1

Concrete or other portions of pier or wharf structures that are exposed to impact or abrasion by vessels, orare subject to damage by floating ice or debris, shall be protected by an open-fender system constructed ofwood or other material approved by the authority having jurisdiction.

4.2.2.2

Provisions shall be made to reduce the impact force exerted on the pier with details of construction thatprevent excessive damage from ordinary operations.

Statement of Problem and Substantiation for Public Input

This revision simply changes the term from "mechanical damage" to "physical damage." It clarifies that the equipment is to be protected from any physical damage, regardless of whether that damage comes from a “mechanical” system. The intent of this provision is to protect against physical damage to the equipment. Consideration should be given to making similar changes wherever the term “mechanical damage” is used in this document.

5.3.4 Passenger Terminals. Passenger terminals located on piers or wharves shall be consideredAssembly Occupancies and shall meet all applicable requirements of NFPA 5000, BuildingConstruction and Safety Code, Chapter 16.

Statement of Problem and Substantiation for Public Input

Section 5.3 seems to only be considering terminal buildings that handle cargo or freight. Many coastal cities have large terminals either specifically constructed to accommodate the cruise industry or older freight terminals that have been modified to accommodate the new passenger use. The addition of a new 5.3.4 would mandate consideration for the health and safety of our cruising population.

5.4.1 General.

Buildings used for the handling or storage of combustible cargo , including warehouses and lockers rentedas secured spaces and not directly controlled by the terminal operator, shall or passenger terminalslocated on piers or wharves shall be protected in accordance with the requirements of NFPA 13, Standardfor the Installation of Sprinkler Systems.

Statement of Problem and Substantiation for Public Input

Omitting the additional phrase would leave open the possibility of a misunderstanding considering the need to install fire sprinklers in a passenger terminal building. The deletion would eliminate unnecessary text regarding contractual arrangements between occupants or tenants – regardless buildings used for handling or storage of combustible cargo must be provided with sprinklers.

6.7 Other Uses

Other uses such as hotels, office buildings, or shipping facilities may occupy terminal yards. Theconstruction and use of these buildings or structures shall comply with NFPA 5000.

This provides clarity that other uses may be permitted within a terminal yard other than preparation for cargo shipping and storage. It eliminates a possibility of noncompliance for different uses other than cargo handling uses.
