Dearcolleagues!Human intellect and creative work have always been an essential condition

of the progress on the way of innovative development of the world community.Radicalstructuralchangesineconomy,rapidadvanceofcompetitivehi-techfieldsin thewholeworlddirect toward themaximumuseof intellectualproperty rights.Our country cannot stand aside of this process. It is intellectual property rightsthat gradually but steady becomeone of themost costly elements of the socialproduct; they need, therefore, constant improvement of the legislative protectionandgovernmentsupport.Intherecentyearstheactivityofthedomesticinventors,scientists,innovators,authors,andcreatorshasbeenconstantlyincreasing.

Ukraineconfidentlygainstheauthorityofastatewithahighintellectualpotentialandmodernstatesystemoflegalprotectionofintellectualproperty.Wetakevigilantcareoftheleveloflegalprotectionofintellectualproperty,refineourworkforthesakeofonegoal:thecreativecommunityinUkrainehastobesurethatourstate’sdevelopmentlevelinintellectualspherecorrespondstotheEuropeanstandards.

To support this direction of its activities, in 2009 the State Department ofIntellectualPropertyensuredthemaintenanceofthedraftlawonamendmentstotheLawofUkraine«OnDistributionofCopiesofAudiovisualWorks,Phonograms,Videograms, Computer Programs, Databases» developed according to thepropositionsoftheEuropeanBusinessAssociationandprovidingthatthesubjectsofcopyrightandrelatedrightswillbeinvolvedintheprocessofissuingcontrolmarksforthementionedcopies.Theseinnovationswillserveasadditionalmechanismsinfightingpiracy.

During the year under report works connected with accession of Ukraine tointernationalagreementsinthefieldofintellectualpropertycontinued.OnFebruary18, 2009, theVerkhovnaRadaofUkraine adopted the LawofUkraine «On theAccession of Ukraine to the Vienna Agreement Establishing an InternationalClassificationof theFigurativeElementsofMarks»,andonApril15of thesameyear–theLawofUkraine«OntheRatificationoftheSingaporeTreatyontheLawofTrademarks».

The support of a set of works connected with Ukraine’s integration to theEuropeanUnionisoneofimportantdirectionsoftheSDIPactivities.

In2009weachievedthemostfruitfulcooperationwithinternationalorganizations–World Intellectual Property Organisation, World Trade Organisation, as well asthe European Union. Co-work with regional international intellectual propertyorganisations–EuropeanPatentOfficeandEuropeanFreeTradeAssociation–wasactivated.

SDIP specialists took part in TRIPS Council meetings. On professional leveltheyrepresentedUkraine,reportedonthestateoflegislationimplementationintheintellectualpropertysphere,receivedfavourableresponsesof thememberstatesof theWorld TradeOrganisation, in particular EuropeanUnion, Switzerland andCanada.

During 2009 SDIP continued cooperation with the Embassy of the USA inUkraine.WejoinedoureffortstoholdanumberofmeetingsofUkrainian-AmericanIntellectual Property Enforcement Cooperation Group, as well as negotiationsconcerningproblematicissuesconnectedwithUkraine’sremovalfromtheSpecial301WatchList.

Within the framework of the measures on preparing and holding the finaltournament of the 2012 UEFA European Football Championship, with theparticipation of the specialists of the state system of intellectual property rightsprotection, a number of practical seminars on acquisition and enforcement ofintellectualpropertyrightsoftheUnionofEuropeanFootballAssociationsanditscommercialpartnerstookplaceinhostcities–Kyiv,Lviv,DonetskandKharkiv.

In2010SDIPwillpayspecialattentiontoamendingthelegislationinthesphereof intellectual property rights protection. Detailed information on any direction ofactivitiesofthestatesystemofintellectualpropertyrightsprotectioncanbefoundonthepagesofthepresentReport.

Ihopeeveryonesharesmycertainty thatUkrainemustbeahighlydevelopedstatewithsublimespiritualityandthelifeleveldeservedbyitstalentedpeople.Wearedeterminedtocontinueworkingforthesakeofcreativepeople!

1.1. Industrial Property Legislation Improvement

Improvementofthecurrentintellectualpropertylegislationhasalwaysbeenand isan importantkind of the State Department of IntellectualProperty(SDIP)activity.

One of the tasks assigned for SDIP in thelawmaking sphere in 2009was legal support ofthe draft Law of Ukraine «On Amendments toCertainLegislativeActsofUkraineonIntellectualProperty Rights Protection», drafted in 2008,at the Cabinet of Ministers of Ukraine and theVerkhovnaRada of Ukraine. The draft lawwasapproved by the Government, submitted to theVerkhovna Rada of Ukraine, and on November18, 2009 approved by the Verkhovna RadaCommitteeonEuropeanIntegration.

The purpose of the draft law is bringing thelegislation of Ukraine into compliance with therequirements of theEuropeanUnion legislation,introducingintotheintellectualpropertylegislationthelatestinternationallawchanges,bringingthespecialintellectualpropertylegislationofUkraineinto full compliance with the requirements ofinternational treaties concluded byUkraine, andimplementationoftheproposalsonimprovementof Ukrainian investment climate submitted byinvestors and participants of the Authority andBusinessPartnershipForum.

But for some new regulations correspondingto the European Union legislation the draft lawincludes the number of interesting novationsaimed at providing favourable conditions foracquisition and fair use of intellectual propertyrights. They are the following: possibility to filean application both on paper carrier and inelectronicform;extensionofadesignpatenttermto25years;possibilitytofileamultipleapplication

containingupto100industrialdesigns;publicationof data on a trademark application and designapplication after completing formal examinationat the official SDIP web-site and provision oftheinterestedpartieswiththepossibilitytofileamotivatedopposition to the registrationof rightswithin3monthsfromthepublicationdateofsuchapplications.Moreover,thedraftlawprovidesforapossibilitytoopposeadecisiononatrademarkor design application at the Appeals Chamberboth to an applicant and a person opposingthis application. It is essential that the draft lawcontains such provisions as the specification oftheindicationdeemedcontrarytothepublicorderandmoralprinciples, thepossibility to registeramark by consent of the earlier right holder, andregulationsontheconditionsofregisteredandnon-registered geographical indications compatibilityareintroduced.Thedraftlawprovidesanaccess

totheinformationonthedecisionsoftheAppealsChamberthatcameintoforce.

Moreover, in 2009 the Verkhovna Rada ofUkraine adopted two laws of Ukraine on theaccessionto internationalagreementsdraftedbySDIP:onFebruary,18–the lawofUkraine«OntheAccessionofUkrainetotheViennaAgreementEstablishingan InternationalClassificationof theFigurative Elements of Marks», on April, 15–the law of Ukraine «On the Ratification of theSingaporeTreatyontheLawofTrademarks».

The International Classification of the Figu-rativeElementsofMarks is aunifiedmeans forclassifying documents at international level andisaneffectivetoolforsearchingforidenticalandsimilar marks. Joining the Vienna Agreementprovided the functioning of the state intellectualproperty protection system on the level ofdevelopedcountriesandimprovedtheprocessoftrademarkapplicationsexamination.

Provisions of the Singapore Treaty cover alltypesofmarksincludinghologram,position,motionmarks,andsimplifyformalitiesintheregistrationprocedure, extend forms of communication, inparticularbyelectronicmeans,set requirementsto registration of licenses to use trademarks,changesandcancellationsoflicenseregistrations,specify consequences of violating terms of alicense etc. Implementation of these provisionsin Ukraine will help to make the trademarkregistration process quicker and simpler, willreduceexpensesandprovideadditionalbenefitsforapplicantsandtrademarkholders.

Thedraft lawofUkraine«OnAmendmentstoCertainLegislativeActsofUkraineonOrganizationand Conducting of the Final Tournament ofthe European Football Championship 2012 inUkraine»wasdevelopedandonDecember,16,

2009 submitted to the Cabinet of Ministers ofUkraine to regulate issues on UEFA intellectualproperty rightsenforcementandperformanceofthePlanofhigh-priorityactivitiesoncompletingin2009aSpecialStateProgrammeofPreparingandConductingtheFinalTournamentoftheEuropeanFootballChampionship2012inUkraine.

The draft law provides for preventing andstopping UEFA and its commercial partnersintellectual property rights infringement, ambushmarketing and other measures for executionof guarantees given to UEFA and appropriateconductingofthechampionship.

ThedraftlawinparticulardefinesUEFArightssubjectmatter,procedureof intellectualpropertyrights acquisition by UEFA in Ukraine, UEFAintellectual property rights holders, procedure ofusing intellectual property rights for informationpurposes,waysofusingUEFAandchampionshipreputation for commercial purposes, the orderof championship tickets circulation, authorityof governmental bodies on UEFA intellectualproperty rights protection, provision of safety atofficialplacesandprotectionofpublicorder.

The draft law also defines that the centralexecutiveauthorityon intellectualpropertyrightsprotection in the interestsof thestatecomplainsto the court about UEFA intellectual propertyrightsenforcementandstopofambushmarketingaswellastakesactionsprovidedbyotherlawstoprotecttheserights.

According to the preliminary conclusion ofUEFAthedraftlawmeetstherequirementsinthepartofenforcementofUEFAanditscommercialpartnersintellectualpropertyrights.

Another task set before SDIP in legislationsphere is to bring subordinate legislation intomorefullcompliancewithcurrentlawsofUkraine.Anactivity ondevelopmentof a revised versionof regulations for drawing, filing and examiningindustrialpropertyrightsapplicationswasstartedin2009tothateffect.

Intheyearunderreviewtheeffectofchangesin legal regulation of relations concerning thepayment of fees for the activities connectedwith intellectual property rights protection wasfelt. That was due to Ukraine’s acquisition oftheWTO-member statusandcoming intoeffectof the Resolution of the Cabinet ofMinisters ofUkraine of September 19, 2007 No. 1148 «OnAmendmentstotheOrderofPaymentofFeesfortheActivitiesConnectedwithIntellectualPropertyRightsProtection».

Theseamendmentsprovide for determinationoftheamountoffeesforapplicantsfromdifferentcountriesirrespectivelyofthegrossnationalincomeperpersonandcomplywithrequirementsofArticle4 of the TRIPS Agreement on most-favoured-nation treatment that excludes discriminativesystemoffeespayment.Thepracticalapplicationofthisresolutionwasmonitoredin2009.

InMarch2010two-yearperiodofoperationoftheresolutionpasses.Monitoringtheeffectivenessoftheresolutionwithinthisperiodwillprovideanopportunitytotakemeasuresfortheimprovementof its provisions in order to meet the needs ofapplicants, to create favourable conditions forintellectual property rights acquisition and toprovide functioning of the state system of theintellectualpropertyrightsprotection.

1.2. Copyright Legislation Improvement

In2009SDIPtooksignificantmeasuresrelatedtotheimprovementofthecopyrightlegislation.

In execution of the instruction of the Cabinetof Ministers of Ukraine on the proposals of theEuropean Business Association SDIP providedlegal support of the draft law of Ukraine «OnAmendments toArticle 5 of the Law ofUkraineOn the Distribution of Copies of AudiovisualWorks, Phonograms, Videograms, ComputerPrograms,Databases»intheVerkhovnaRadaofUkraine.Accordingtothementionedamendmentscopyrightandrelatedrightsholdersare involvedin the procedure of control marks distribution.Thisisgoingtobeanadditionaltoolinanti-piracycampaign.

There were considerable improvements inlegal regulation of collecting remuneration forcommercialuseofrelatedrightsinpublicdomain,creationandfunctioningofcollectivemanagementorganizations.

InApril2009 theResolutionof theCabinetofMinistersofUkraineofApril2,2009No.450«OnAmendmentstotheResolutionoftheCabinetofMinistersofUkraineofJanuary4,2003No.71»wasapproved.Accordingtothisacttheprocedureof paying remuneration by economic entitiesfor the use of phonograms, videograms andperformances they contain which are publishedforcommercialpurposesisimproved.

Accordingtothechangesintroduced:– afulllistofcommercialusesubjectsobliged

topayremunerationforpublicuseofphonograms,videograms and performances they contain

whicharepublished for commercialpurposes isdefined;

– thereisaspecificationaboutacompulsoryconclusionofacontractonremunerationpaymentbetween authorized collective managementorganizationsandthementionedsubjects;

– essential terms of the contract defined bythepartiesarestated;

– provisions concerning performing thecontrolbytheauthorizedcollectivemanagementorganizationsoverthelegaluseofphonograms,videograms and performances they containwhicharepublishedforcommercialpurposesareprovidedfor.

Moreover, in January 2009 the Order of theMinistryofEducationandScienceofUkraineofDecember22,2008No.1175«OnApprovaloftheProcedure for Appointing Authorized CollectiveManagement Organizations Responsible forCollecting and Distributing Remuneration(Royalties) for the Use of Phonograms andVideogramsPublishedforCommercialPurposes,andAmendmentstotheProcedureforCollectiveManagement Organizations Registration andtheirActivitiesSupervision»wasregisteredintheMinistryofJusticeofUkraine.

This order provides for improvement of theactingcollectivemanagementsystem,inparticularestablishesadistinctandcleararrangementsfor:

– registration of collective managementorganizations;

– appointing authorized collective manage-mentorganizationsonthebasisofcorrespondingcriteria;

– statemonitoringoftheiractivitiesbasedonreportinginformationbythisorganizations;

– removal of authorized organizations fromtheregister,cancellationofcollectivemanagementorganizationregistration(invalidationofcertificate)

in caseof copyright and related right legislationinfringement;

– payingtocopyrightandrelatedrightholderscollectedremunerationleftontheaccountsofanorganization as of the date when the decisionto remove it from the register of authorizedorganizationsortocanceltheregistration(cancelthecertificate)wasmade;

– giving back the original certificate to thestateauthorityincaseofitsinvalidation.

Taking into account a special status ofauthorizedorganizationsthatenablestocollectanddistributeremunerationtoperformers,phonogram

and videogram producers the mentioned orderconsiderably strengthens requirements tocollectivemanagementorganizationswhichclaimto become authorized and essentially improvesprovisionsontheirresponsibilities.

Theamendmentsofthementionedlegalactsin2009makeitpossibletosubstantiallyimprovethelegislationinthesphereofcollectivemanagementofeconomicrightsofcopyrightandrelatedrightsholders and to establish a distinct and clearmechanism of appointment, registration andremoval from register of collectivemanagementorganizationsetc.

Actions have also been taken to introduceprovisions on responsibility for camcording inUkrainian cinemas. In particular, argumentationofthenecessityandobligatorinessofintroducingthisprovision to the legislationwassubmitted tothe Cabinet of Ministers of Ukraine and to theVerkhovnaRadaofUkraine.

Copyright and related rights issues, includingthose on collectivemanagement, where speciallytreatedatthestatelevel.Theseissueswheresubjectto discussions at hearings on the Effectivenessof Copyright and Related Rights LegislationImplementation held in the Verkhovna Rada ofUkraine Committee on Science and Education inJune 2009. Recommendations to these hearingsaretakenintoaccountandputtouse.

2.1. Examination and Registration of Industrial Property Rights

The global economic crisis that has negativeinfluenceontheeconomicdevelopmentindicatorsinUkrainewasstronglyfeltintheareaofindustrialpropertyrightsprotectionaswell.

In 2009 the total number of applications forindustrialpropertyrightsprotectionfiledwithSDIPamountedtoover42thousand(table2.1).Atotalof over 14 thousand applications for inventionsandutilitymodels,over1.6thousandapplicationsfor industrial designs and nearly 26.5 thousandapplications for trademarks and service marks(including17.9thousandthoseunderthenationalprocedure)werefiled.

Inventions

In 2009 a total of 4,815 applications forinventionswerefiled(table2.2,fig.2.1).

The activity of domestic applicants in theyear under review has decreased by 13% ascomparedwiththepreviousyear.TheactivityofforeignapplicantsunderthePCTprocedurehasdecreasedby16%.Theshareofapplicationsfiledbyforeignapplicantsin2009amountedto49%oftotalfilings(asagainst51%in2008).ThenumberofapplicationsfiledwithSDIPasreceivingofficeby domestic applicants for patenting inventionsunder the PCT procedure in foreign statesamountedto72in2009.

The largest number of foreign filings camefrom theUSA(647applications),Germany (417applications), Switzerland (211 applications),France(158applications),theRussianFederation(99 applications), Japan (93 applications), theUnited Kingdom (81 applications), Sweden(74 applications), Belgium (72 applications),the Netherlands (60 applications) and Italy (56applications)(Annex1).

The distribution of applications for inventionsfiled under the PCT procedure by countries oforiginisshowninfig2.2.

The priorities of distribution of applicationsfor inventions according to the IPC classes areshownintable2.3.

The total number of decisions taken onapplications for inventions in 2009 amounted to4,221, including 4,171 decisions on grant of apatent and 50 decisions on refusal of a patent.Thetotalnumberofdisposalsin2009amountedto5,836(fig.2.1).

In 2009 4,002 patents for inventions weregranted. Patents granted to foreign applicantsamountedto1,607(table2.2,fig.2.1).

Themost patentswere granted to applicantsfrom the USA – 357 (22.2%), Germany – 347(21.6%),France–122(7.6%),Switzerland–105

In 2009 the number of applications for utilitymodelsdecreasedby4%.Atotalof9,203appli-cations, including 9,065 (98.5%) applications

from domestic applicants, were filed (table 2.6,fig.2.3).

The Russian Federation remains the majorforeign source of applications (the share of appli-

Industrial designs

In 2009, 1,669 applications for industrialdesigns were filed, including 1,413 those fromdomestic applicants (table 2.8, fig. 2.5). Thenumber of applications from foreign applicantshas decreased, and share of those in the totalnumberofapplicationsamountednearly to15%asinthepreviousyear.

In the year under review the most activewereapplicantsfromtheRussianFederation(41applications, 16.0%), Poland (34 applications,13.3%),theUSA(19applications,7.4%),Belarus(17applications,6.6%), theCzechRepublic (13applications, 5.1%), the United Kingdom andTurkey(by12applications,4.7%).

In 2009, 1,563 decisions on grant and 4decisionsonrefusalofapatentweretaken,182applicationswerewithdrawn.Thetotalnumberofdisposalsin2009amountedto1,749(fig.2.5).

A total of 1,754patents for industrial designswere granted, including 1,425 – to domesticapplicants(table2.8).

Themost applications for utilitymodels werefiled in classes: A61 (Medical or veterinaryscience; hygiene) – 1,735 applications, 461 ofwhich belong to subclass A61K (Preparationsfor medical, dental or hygienic purposes); G01(Measuring; testing) – 735 applications, A01(Agriculture; forestry) – 599, A23 (Foods orfoodstuffs, their treatment)–306,E21 (Earthorrock drilling; mining) – 198, F16 (Engineeringelementsorunits)–185andB01(Basicelectricelements)–153applications.

In 2009, 8,572 decisions concerning utilitymodels were taken, including 8,548 those on

grantofapatentand24–onrefusalofapatent.In2009,8,876applicationsforutilitymodelswereprocessed(fig.2.3).

In the year under review 8,391 patents forutilitymodelswere granted including 8,270– todomestic applicants. 121 patents were grantedto foreign applicants, including 54 grants toapplicants from the Russian Federation, by 10grants toapplicants fromCiprusandPoland,by5 – to applicants from Germany and the USA,4–theCzechRepublic,3– India.Theshareofpatentsgrantedtoapplicantsfromthosecountriesamountsto72.0%.

AsofJanuary1,2010,46,713patentsforutilitymodelswereenteredtotheStateregister,including33,575patentsbeinginforce(table2.7).

The largest number of patents was grantedin classes: 19 (Stationeryandofficeequipment,artist’s and teaching materials) – 403 (22.9%),09(Packagesandcontainersforthetransportorhandlingofgoods)–303(17.9%),06(Furnishing–133 (7.6%), 25 (Building units and constructionelements)–118 (6.7%),12 (Meansof transportor hoisting) – 103 (5.9%) and 11 (Articles ofadornment)–102(5.8%).

As of January 1, 2010, 19,850 patents forindustrial designs were entered to the Stateregister,including10,375patentsbeinginforce.

In 2009, the effect of 440 internationalregistrations under the Hague AgreementConcerning the International Registration ofIndustrialDesignswasextendedtotheterritoryofUkraine(fig.2.6).

Trademarks and service marks

National procedure

In 2009 a total of 17,866 applications fortrademarks and service marks were filed. Theactivityofdomesticapplicantshasdecreasedby20%as comparedwith the previous year (table2.9, fig. 2.7). A total of 3,115 applicationswerefiled by foreign applicants, these amounted to17.4% of the total number of applications filedunderthenationalprocedure.

The most active were applicants from theUSA – (711 applications, 22.8%), the RussianFederation (285 applications, 9.1%), Germany(173 applications, 5,6%), Switzerland (159

applications, 5.1%), the United Kingdom (152applications, 4.9%), Belarus (146 applications,4.7%),Japan(134applications,4.3%),India(125applications,4,0%)andCyprus(103applications,3.3%).

In 2009 most of the marks filed under thenationalprocedurewereclassifiedinclasses35,41,05,33,29,16,09,03,43,38,32,and25oftheNiceClassification.Thedomesticapplicantspreferredclasses35,41,33,05,29,16,43,38,09,32and03,and foreignapplicants–05,35,03, 09, 33 and 16. The priorities of distributionof domestic and foreign filings according to theclasses of the Nice Classification are shown intable2.10.

International procedure

Foreign applicantsmaintained their activity infilingapplicationsformarksundertheinternationalprocedure (fig. 2.8, table 2.12). In 2009, 8,613international applications were received fromthe WIPO International Bureau, including 7,230(84.0%)applicationsundertheMadridAgreementand1,383–undertheMadridProtocol.

The largest users of theMadrid systemwereGermany (1,744 applications), France (789applications),Switzerland(676applications),Italy(655 applications), theRussian Federation (602applications), China (425 applications), Poland(327 applications), Austria (268 applications),the Czech Republic (241 applications), the

Netherlands (231 applications), Hungary (182applications), Belgium (162 applications), Spain(160applications)andSlovenia(113applications).The share of applications from these countriesamounted to76.0%of the total filingsunder theinternationalprocedurein2009(fig.2.9).

In 2009 the most active among the memberstatesoftheProtocoltotheMadridAgreementinfilingapplicationswiththeextensiontotheterritoryof Ukraine were Turkey – 309 applications, theUSA–276,theUnitedKingdom–213applications,Denmark–96applications,Japan–93applicationsandSweden–82applications(fig.2.9).

In 2009, the legal protection was granted to9,664internationalmarks(table2.12,fig.2.8).

2.2. Entering the Data Concerning Contracts on Disposition of Economic Industrial Property Rights to the State Registers

In 2009 the total number of registrationsof the contracts on disposition of economicindustrial property rights amounted to 1,927,thatis3.8%lessthaninpreviousyear,amongthem1,530registrationsconcerningtransferofexclusive economic industrial property rights(79.4%);178registrationsconcerningissuanceof licenses on exploitation of the industrialproperty rights (9.2%); 219 licenses of rightto use inventions, utilitymodels and industrialdesigns(11.4%).

According to the abovementioned data thenumber of registered data on the assignmentof exclusive economic industrial property rightssufficientlyexceedsthenumberofentries to thestateregistersontheissuanceoflicenses.

AsofJanuary1,2010,dataconcerning13,304contracts on disposition of economic industrialpropertyrightswereenteredtothestateregisters,including2,890contractsconcerning inventions,642 – utility models, 9,029 – trademarks andservicemarks,743–industrialdesigns.

Informationonenteringthedataondisposition

of economic industrial property rights to therelevantregistersisshowninthetable2.13andfig.2.10.

Thedatapresentedinthetable2.13showsthatin2009thenumberofregisteredlicensecontractsonexploitationofinventionsandtrademarksandservicemarksaswellasthenumberofrecordsinstateregistersontheassignmentofrightsinutilitymodels, industrial designs and trademarks andservice marks decreased slightly as comparedwiththepreviousyear.

The total number of industrial property rightsin respect of which data on assignment ofexclusive economic rights andgranting licenseswere entered in respective state registers hasincreased by 6.5% and amounted to 3,320 (asagainst3,188 in2008) including374 inventions,177 utility models, 145 industrial designs and2,624trademarksandservicemarks.

Thenumberofpublicationsconcerninglicensesofrightforinventionshasincreasedby12.5%,ascomparedwith2008.

Data shown in table 2.14 testify that theaveragenumberoftrademarksandservicemarkstherightsinwhicharetransferredinonecontractforUkrainianownersis2.0andforforeigners3.0marksinonecontract.

2.3. Registration of Author’s Right

In 2009 the State Department of IntellectualProperty continued the state registration ofauthor’s right and contracts concerning author’sright in a work in accordance with the Law ofUkraine“OnCopyrightandRelatedRights».

A total of 4,286 applications for registrationof author’s rightwere filed in 2009. Thereweretaken 4,499 decisions on registration and 3

decisions on refusal for registration. The totalnumberofregistrationsofauthor’srightinaworkamounted to4,458 (fig.2.11).The trends in theregistration testify that the state registration ofauthor’srightgainsin importanceandpopularityamongauthorsandotherpersonswithtime.

Over the reporting period the total numberof registrations of author’s economic right inemployee’sworksamountedto484.Asin2008,

In 2009, 165 contracts on author’s right in awork were registered with SDIP and 1 decisionon refusal to register a contract was taken(fig.2.12).

3.1. Industrial Property Rights Enforcement in an Administrative Procedure

IntheyearunderreviewtheAppealsChamberconsideredatotalof133oppositionsincluding128oppositions lodgedin 2009 and 40those entertainedin2008.

Oppositions lod-ged in 2009 brokeup by the industrialproperty categoriesas follows: inven-tions– 20, utilitymodels – 3, indu-strial designs – 1,trademarksandser-vicemarks–69.

Therewereheld233 sessions ofthe boards of theAppeals Chamberwhere 22 oppo-sitions to theSDIPdecisionsonpatentapplications, twooppositionstoutilitymodelapplications,80 oppositions to trademark and service markapplicationswereconsidered.

In2009thetotalof90decisionsoftheAppealsChamber were sent to appellants including 41decisionsoncompletesatisfactionofopposition,10 on partial satisfaction of opposition and 39decisions on dismissal of opposition. Sevenoppositionswerenotacceptedforconsideration,theappellantswithdrewoneopposition.

In 2009 the Appeals Chamber got 8 claimsfor recognition of trademarks to be well-knowninUkraine.Therewereheld12meetingsof theAppealsChamber.

Eight decisions of the Appeals Chamberwere sent to applicants,all of them on recognitionof trademarks to be well-known in Ukraine. Oneapplication on recognitionof trademarks to be well-knownwaswithdrawn.

3.2. Industrial Property Rights Enforcement in a Judicial Procedure

In2009proceedingswerecommenced on 229 casesrelatedtoindustrialpropertyrightsenforcementincludingthosein:

• administrative courts(40cases);

• economic courts (98cases);

• courtsofgeneraljuris-diction(91cases).

TheMinistryofEducationand Science of Ukraine and/or the StateDepartmentofIntellectualPropertywerelitigantsinthosecases.

Proceedingson515caseswereconductedincourtsofprimaryjurisdiction,courtsofappealandcourtsof review(6casesofyear2003,4casesofyear2004,20casesofyear2005,27casesofyear2006,66casesofyear2007,163casesofyear2008,and229casesofyear2009).

Casesindisputesconcerningindustrialpropertyrights enforcement were considered in courtsof general jurisdiction (178 cases), economiccourts(208cases)andadministrativecourts(115cases).Therewereheld1,206courtsessionsonthesecases.

Theanalysisofcourtcasesshowsthatthemostofthemdealwithtrademarksandservicemarks.

Theinvalidationoftrademarkandservicemarkcertificatesandinternationalregistrationofmark,the cancellation of SDIP decisions as well aspremature termination of trademark and servicemarkcertificatesand international registrationofmarkwerethemattersofsuchdisputes.

3.3. Enforcement of Copyright and Related Rights

In 2009 SDIP took part in consideration ofthree cases concerning collective managementorganizations,21–concerningstate registrationofauthor’sright.

During2009theStateEnterprise«TheUkrainianAgency of Copyright and Related Rights»(UACRR) took part in 36 court proceedings inactions against copyright users on infringementof exclusive economic author’s rights, collectionofreceivables,non-compliancewiththetermsoflicenseagreementsetc.

In2009UACRRbrought14complaints topro-gramserviceproviders,televisionandradiobroad-casting companies and other users. In addition,38claimsweresenttoinfringersonthemattersofdebtsreceivable,non-compliancewiththetermsoflicenseagreements,unlicenseduseofworksetc.

Subsequent to the results of the mentionedactivities more than 688,000 UAH entered toUACRRaccountsasofJanuary1,2010.

3.4. Collective Management Organizations Activities

InaccordancewiththelegislationinthesphereofcopyrightandrelatedrightsSDIPperformsthefollowingfunctions:

keeps a register of collective managementorganizations;

appoints authorized collective managementorganizations;

monitorscollectivemanagementorganizationsactivity and provides their methodologicalsupport;

acts as a mediator in negotiations and inresolution of conflicts between organizations aswellasbetweentheseorganizationsandcopyrightandrelatedrightsholders;

promotescollectivemanagementorganizationsactivity.

Currently, 11 collective management orga-nizations have been registered. Among themthe State Enterprise «The Ukrainian Agency ofCopyright and Related Rights», private organi-zation «The Ukrainian Agency of Copyright»,five public organizations established by naturalpersonsascopyrightand related rightsholders,four consolidated enterprises – associationsestablishedbylegalentities.

Within actions aimed at monitoring collectivemanagement organizations activities to executetheorder of theCabinet ofMinisters ofUkraineSDIPcarriedouttheirauditin2009.

Three collective management organizationswere deregistered because of infringement ofcopyright and related rights legislation (the All-UkrainianPublicOrganization«UkrainianAuthorsUnion»,thePublicOrganization«TheAssociationof Right Holders in the Sphere of Fine Art and

In 2009 SDIP also performed the followingactions to execute the order of the Ministry ofEducationandScienceofUkraineofDecember22,2008No.1175:

1)appointed the following organizations asauthorizedcollectivemanagementorganizations:theAssociationofEnterprises«UkrainianMusicAlliance» (in the sphere of public broadcastingof phonograms, videograms, and performancestheycontainwhicharepublishedforcommercialpurposes); the Association of Enterprises«Ukrainian League of Music Rights» (in thesphere of public performance of phonograms,videograms, and performances they containwhicharepublishedforcommercialpurposes);

2)cancelledcertificatesonappointmentofcol-lectivemanagementorganizationsasauthorizedorganizationsgranted to theAll-UkrainianAsso-ciationofCopyrightandRelatedRightsHolders«Oberih», the All-Ukrainian Public Organization«The All-Ukrainian Agency of Copyright andRelatedRights».

Toincreaseamountsofthecollectedremune-ration in thesphereofpublicbroadcastingSDIPtogetherwiththeMinistryofFinanceofUkraineandtheStateTreasuryofUkrainedefinedthesourcesof remuneration to be paid by state televisionand radio broadcasting companies to collectivemanagement organizations. Corresponding offi-cial lettersweresent to theStateCommittee forTelevisionandRadioBroadcastingofUkraineandtheNational Television andRadioBroadcastingCouncil of Ukraine for further informing of statetelevisionandradiobroadcastingcompanies.

Themechanismof payment and collectionofremunerationfortheuseofrelatedrightsobjects

in thespheresofpublicperformanceandpublicbroadcastingbymeansofregulatorydesignationofthelistofusersthathavetopayremuneration,including program service providers, wasdeveloped.Compulsoryconclusionofagreementsonpaymentofremunerationbetweenauthorizedcollectivemanagement organizations and userswasalsoprovidedfor.

In order to provide practical assistance totelevision and radio organizations and programserviceprovidersaswellastoeconomicentitiesperforming public use of copyright and relatedrights objects and use of these objects via theInternet corresponding recommendations weredeveloped,thoseareavailableattheSDIPweb-portal.

In the sphere of collection and distribution ofroyaltiesforhomeuseofworksandperformances,recorded in phonograms, videograms and theircopies(virginmediaandequipmentforrecording)theAssociationofEnterprises«UkrainianMusicAlliance» acts as an authorized organization.SDIPdevelopedrecommendationsforproducersand importers of equipment and virgin mediaon payment of remuneration to copyright andrelated rights holders. These recommendationsare available at the SDIP web-portal for theuse by the mentioned economic entities intheir activity. Moreover, the recommendationswere sent to the authorized organization andinterested governmental authorities, namely totheStateCustomsServiceofUkraine,theStateCommitteeofUkraine forRegulatoryPolicyandEntrepreneurship, the State Tax AdministrationofUkraine.

According to the legislation SDIP supervisescollective management organizations activities.Everyhalf-yearperiod theorganizationsprovidereports according to which trends in collection,distribution and payment of remunerationare monitored. In particular, the amount ofremuneration collected by all organizations in2009wasmorethan31millionUAH.Theamountof paid remuneration to copyright and relatedrights holders was over 25 million UAH (31%moreascomparedtothepreviousyear).

According to copyright and related rightslegislation SDIP performs mediation in conflictresolutionsbetween:

• collectivemanagementorganizations;• these organizations and copyright and

relatedrightsholders.In order to consolidate activities of collective

management organizations the CoordinationCouncilonCopyrightandRelatedRightsfunctionsat SDIP. The Council includes representativesfrom all organizations and aims its activity atconsidering and solving problematic issues.Moreover, section on copyright and relatedrights issuesattached to theSDIPPublicBoardwoks. It includes representatives from collectivemanagementorganizations, creativeunionsandotherassociations.

So SDIP systematically performs activitiesaimedatinvolvementofgeneralpublicinsolvingproblematicissues.

SDIP fulfils a function of promoting collectivemanagementorganizationstoexerciseauthoritiesprovidedbylegislation.Supportisprovidedinthefollowingareas:

1)methodological support of collectivemanagement organizations in the form ofrecommendations and explanations of legalrequirements on conclusion of agreements andpayment of remuneration by economic entities.In particular, these recommendations andexplanations are available at the SDIP web-portal. The Official Bulletin «Copyright andRelatedRights»ispublishedonregularbasisandcontainsnormativeactsoncopyrightandrelatedrights,informationaboutorganizationsetc.;

2)popularization of collective managementorganizationsactivity inUkraine. In recentyearsgreat educational work has been performed toincrease public legal culture level in mattersof copyright and related rights objects use,familiarization of economic entities with legalrequirements in this sphere (conferences,including international ones with the assistanceof internationalexpertsoncopyrightand relatedrightsmatters, roundtablediscussions,seminarsandothereventswereheld);

3)cooperation with corresponding stateinstitutionsandcoordinationofactivities thereof.Taking intoaccountdifficulties in theprocessofremuneration payments by television and radioorganizations SDIP sent written notifications totheNational Television andRadioBroadcastingCouncilofUkraine,theStateTelevisionandRadioBroadcasting Committee of Ukraine for furtherforwardingofthesenotificationstostatetelevisionand radio organizations. The notifications arebased on explanations given by the Ministry ofFinanceofUkraine,theStateTreasuryofUkraineon the use of budgetary financing by statetelevisionandradioorganizations.

In order to organize the collection ofremuneration for resale of artistic works (artistsresaleright)arrangementsforclosercooperationwith fine art market participants were effectedduringtheyear.SDIPspecifiedthelistofgalleries,exhibitions, auctions, involved in organizationof exhibition arrangements where artistic worksare sold. SDIP sent letters to these institutionsof art with a notification about the necessityto conclude agreements and pay remunerationvia collective management organizations. Atpresent a collective management organizationacting in the sphereof fineart theAll-UkrainianPublic Organization «The All-Ukrainian Agencyof Copyright» is conducting negotiations withtheseorganizationsonconcludingcorrespondingagreements.

TocreateconditionsforfineartmarketentitiestoactwithinthelegislationconcerningpaymentofremunerationforartistsresalerightsSDIPdraftedrecommendations on collecting, distribution andpaymentof remuneration forartists resalerightsand forwarded thereof to the Ukrainian ArtistsSociety, the Ukrainian Galleries Association forpracticaluse.

UACRR, subordinate to SDIP, acting as acollective management organization, collected20.07 million UAH of authors’ remuneration in2009.It’salmost0.77millionUAHmorethanwascollectedin2008(19,3millionUAH).

InthereportyearUACRRpaidtonationalandforeign authors about 14,4 million UAH. To thestate budget 2.7 million UAH were transferred.The rest of the collected remuneration will bepaidwithinnextperiods inviewof thenecessitytoidentifyauthors.

The bulk of amount of collected author’sremuneration covers the sphere of publicperformance that is a so-called «tradition» forthe period of UACRR activity. The majority ofincomewasprovidedby«grandrights»(royaltiesfortheuseofworksinthedramaticperformancesphere)– over 9.8 million UAH that is almost56.3%oftotalroyaltiescollectedinUkraine.

Incomesfor«small rights»(royaltiescollectedfor the use of works on TV, radio stations,in cafes, restaurants, night clubs, concerts)constitutedalmost3.9millionUAHthatisalmost23% of total royalties collected in Ukraine (in2008 for «small rights»6.2millionUAHor33%of total amount of royalties in Ukraine wascollected). It is worth mentioning that declineof amounts of collected authors’ remuneration

from«small rights»categoryusers in2009wascaused by the effect of world financial crisis.Reduction of incomes of TV-channels, radiobroadcasters, cafes, restaurants, night clubsand other entertainment establishments causedreductionofroyaltiesforauthors.

Almost 2.7 million UAH was received for theuseofUkrainianauthors’worksfromabroad.Thisfact witnesses a growing interest in Ukrainianartists’worksall over theworld. In2008 foreignincomesconstitutedalmost2millionUAH.

The lowest amounts of royalties were for«mechanical recording» (royalties for the useof copyright objects on mechanical media –CD, DVD disks, magnetic tapes etc.). In 2009«mechanical recording» incomes shortenedalmostbyfourtimesandamountedto0.45millionUAHascomparedwith2008.Butthereasonsofsuch a recession are objective and correspondto worldwide trends. Due to modern technicalmeansand first of all due to Internet expansionmechanical media are becoming less popularall over the world. Besides, it is impossible notto take into account a considerable influenceof«music piracy» on the remuneration collectionrateinthissphere.

Nevertheless UACRR forges ahead andcarefullystudiesnewtrendsandappliesmaximumeffortstodevelopnewmarketsofauthors’worksuse.In2009significantadvancewasmadeinthesphere of mobile communications (royalties forthe use of copyright objects inmobile phones).In 2009 incomes from payers of this type ofremuneration were 0.9 million UAH that is 0.3millionUAHmorethanin2008.

Like before, UACRR pays considerableattention to the work with international partnersandorganizationsworkingforcopyrightprotectionpurpose.

3.5. Control over the Observance of Legislation in the Sphere of Intellectual Property

In 2009 a number ofmeasures aimed at thecoordination of efforts of law-enforcement andcontrolling authorities to provide control overthe observance of legislation in the sphere ofintellectualpropertywasimplemented.Jointorderof the Ministry of Education and Science, theMinistry of InternalAffairs, theSecurityService,the State Customs Service, the State TaxAdministrationandtheMinistryofCulturalAffairsofUkraineofNovember24,2009No.1055/491/753/1120/656/52«OntheApprovaloftheProgramofCoordinatedActionsofLaw-EnforcementandControlling Authorities to Provide Control Overthe Illegal Production, Distribution and Sale ofAudio and Video Products, Compact Disks andOther IntellectualPropertySubjectMatters andto Provide UEFA Intellectual Property RightsEnforcement»wasdevelopedandsigned.

TheCoordinationCouncil on the control overlaw infringements in the sphere of intellectualpropertywasestablishedinKyiv.Itsmembersandregulations on its activitywere approved by theOrderof theKyivStateMunicipalAdministrationofOctober14,2009No.1182.

In the report year the state intellectual pro-perty inspectors carried out 738 inspectionsof economic entities. The result is that 427administrative offence reports were drawn upand sent to courts. The counterfeit products totheamount ofmore than5.7millionUAHwereexpropriated(Fig.3.1,3.2).

Basedonthe inspectionscarriedout togetherwith theMinistry of Internal Affairs, theSecurityService of Ukraine and tax police 138 criminalcaseswereinitiated.

The state intellectual property inspectorsgive constant attention to the inspection ofmanufacturersofdisksforlaser-readingsystemsand stampers. In 2009, 63 inspections of thementioned enterprises and 10 inspections ofeconomic entities performing compact disksexportandimportwerecarriedout.

One of the priorities in intellectual propertyinspectors’ activity is educative and explanatorywork aimed at prevention of law infringementsin thesphereof intellectualproperty.During theperiodunderreviewthestateinspectorsheld269seminars and round-table discussions on legaluseofintellectualpropertyrightsinUkraine.More

than 50 publications and presentations weremadeinmassmedia.

Recovery of conclusion of agreements onpaymentofauthors’remunerationwasobservedasaresultofthementionedactivities.Considerablepart of intellectual property right users addressstate inspectors to takecontrollingmeasuresonlegaluseoftheserights.

AccordingtotheParagraph14oftheProcedureofComputerProgramsUseinExecutiveBodies,

approved by the Resolution of the Cabinet ofMinisters of Ukraine of September 10, 2003No.1433,SDIPintroducedmeasurestoincreasethe level of legal computer programs use inexecutivebodies.Inparticular,thecorrespondinginventorywasconducted,thenumberofcomputerprogramstobelegalizedwasdetermined,issueson including by executive bodies amounts offinancing for programs legalization to budgetdemands for 2010 and following years were

settled with ministries and other executivedepartments. Results of the inventory showedthat 1,451,055 items of computer programs areusedinexecutivebodies,772,220ofthembeingwithoutacorrespondinglicense(53.2%).

To ensure support of economic entities onthe improvement of the system of computerprogramslegaluseinternalcontrolcorrespondingletters were sent, and recommendations on theprovisionof legaluseofsoftwareintheiractivitywereprovided.

Copies of legalization contracts with suchcompaniesastheAdobeSystems,CorelCorp.,EmbaracaderoTechnologies,ABBYYandNeroAG, the Limited Liability Company «PROMT»,the Close Joint-Stock Company «KasperskyLaboratory», the Limited Liability Company«Doctor Web» concluded by the Ministry ofEducationandScienceofUkrainetogetherwithterms of supply of the corresponding computerprograms were sent to executive bodies forfurther conclusion of contracts on computerprograms legalization with the mentioned rightholders.

In 2009 the Register of Software Producersand Distributors was supplemented with theinformation on economic entities distributingcomputerprograms.Informationintheregisterisopenandavailabletopublic,thisprovidesuserswith an opportunity to get data about licensedsoftware providers (http://www.sdip.gov.ua/ukr/help/registers/register/).

There were 229 claims on registration in theRegisterofSoftwareProducersandDistributors.Within the period under review 200 claimswere considered, 137 economic entities wereregistered.

The inquiry system on legal distribution anduse of computer programs was in operation.Any interestedperson is able toget informationby electronicmeans on legal foundations,waysand means of legalization (http://www.sdip.gov.ua/ukr/help/licence/).

SDIPhasdevelopedrecommendationsontheprovisionoflegaluseoffreecomputerprogramswith due consideration of economic aspects offreesoftware.Therecommendationsareofferedto authors, distributors, free software users forpracticaluse.

In accordance with the Law of Ukraine «Onthe Distribution of Copies of AudiovisualWorks,Phonograms, Videograms, Computer Programs,Databases» the State Enterprise «Intelzahyst»issued23,011,520controlmarks,538,734ofthembeing type«A»,1,749– type«В»,22,471,037–type«К».

There is a reducing trend in the number ofissuedcontrolmarks.Thereasonisinextensivedevelopment of high technologies causingcopyrightandrelatedrightsobjectstransferintoadigitalareaandtheirdistributionviatheInternet.

Topreventtheuseofcounterfeitcontrolmarkstheir automatic checkhasbeen introduced. It isperformedwhiledistributingcopiesofaudiovisualworks, phonograms, videograms, computerprograms,databases.

In 2009 according to the Law of Ukraine«OnthePeculiaritiesof theGovernmentControlof the Activity of Economic Entities Relatedto the Production, Exportation, Importation ofDisks for Laser-Reading Systems» SDIP as alicensing body issued 3 licenses for productionofdisksforlaser-readingsystemsandstampers.Four licenses were re-issued, one license wascancelled.Atpresenteightlicensesareissuedtoeconomicentitiesintotal.

4.1. Information Support of Examination of Applications for Industrial Property Rights. Patent Documentation File Updating

Informationsupportoftheexaminationprocessincludes updating the Patent Information Base(PIB) and providing access of examiners tospecifiedelectronicinformationresourcesviatheInternet.

Throughout the report year the PIB contentsremainedthesameasinthepreviousyears.Thecollectionwasupdatedbycurrentacquisitionsofnational and foreign patent documentation andby the end of 2009 comprised 12.97 thousandopticaldiscs,535ofwhichwere received in thereportyear.

TheReferenceandInformationCollection(RIC)isapartofthePIBusedbytheexaminersduringthe examination of applications for industrialproperty rights (IPRs), by specialists of otherdivisions of the examination body which is theState Enterprise «Ukrainian Industrial PropertyInstitute» (UIPI), as well as specialists of theStateDepartmentofIntellectualProperty.Duringthe report period the RIC was replenished by28.7 thousand copies of the Ukrainian patentspecifications, books, booklets and periodicalsandasofJanuary1,2010numberednearly293.0thousanditems.

The activities on updating the RIC andservicing specialists in the reading room andin the modes of lending library and selectivedisseminationofinformationhavebeenoptimisedandcarriedoutonasufficientlyhighlevelwithinthe current years. Considering multidisciplinaryqueries of examiners, the inter-library exchangesystemisthemostcalled-forandefficientkindof

service. Given the significant number of ordersfor information sources (above 2.7 thousand)concerning analogues of inventions claimedin application materials, the figures of lendingoriginalsourcesin2009amountedto77%,whichis5%higherthanin2008.Thehighpercentageofworkefficacyisachievedthankstointensiveuseofmoderninformationtechnologies.Inparticular,to provide the examination of applications forinventions with full texts of the articles fromforeignperiodicals,anagreementwithELSEVIERpublishingcompany(theNetherlands)concerningprovidingtheUIPIwithfee-basedon-lineaccessto thedatabase(DB)of thearticlespublished inscientificand technicalmagazinesandbooksofthispublisherwassignedin2009.

The growth of the number of fulfilled ordersfor information sources activated the works onformingtheknowledgebasewhicharecarriedoutbywayof scanning theoriginal sources.During2009thebasewassupplementedby641articlesand by the end of December comprised 2082articles.

The servicing of the structural departmentsof UIPI and SDIP in the mode of selectivedissemination of information continued duringthe report period.To form the information tobeincluded in thematic bibliographic lists, analysisandselectionofthemostsignificantarticlesfrommagazines and collected books on intellectualpropertymatterswerecarriedout.During2009atotalof143addressees received61 informationnoticesaboutnewacquisitionsofbooksand58thematicbibliographiclistsofarticles.

Throughouttheyearacomplexoforganizationaland coordination works aimed at providingexaminers with access to commercial DBs andforeign information products on the basis ofsignedagreementswascarriedout.Asaresult,theexaminersgainedaccessto:

– theEPOsearchsystemwithintheframeworkoftheEPOQUENetcommercialserviceaccordingtotheatwo-yearAgreementsignedbythisOfficeon22.09.08;

– thespecializedDBs in the fieldoforganicchemistry according to the agreement signedin 2007 with the European service of STNInternational(FIZKarlsuhe);

– the GenomeQuest search system ofGenomeQuestInc.(USA)forsearchingbiologicalsequences;

– the information product of the «Twincom»company (Russia) «All Encyclopaedias ofRubricon»,anewagreementfortheuseofwhichwassignedintheIVquarterof2009fortheperiodofthenextyearfor22users;

– VINITIdatabank(Russia),theuseofwhichis ensured by a permanent agreement in forcesince2005.

The term of agreement for the use of Geno-meQuestsearchsystemexpiredintheIIIquarterof 2009 and, considering the relatively highcost of searches in this system,adecisionwasmade not to continue using it. Free-of-chargeInternetDBswillbeusedforbiotechnologysear-ches in the nearest period as an alternative toGenomeQuest.

Alltheabove-mentionedinformationresourceswere used by examiners together with the PIB

collectionandfree-of-chargeDBsprovidedontheweb-sitesoftheleadingpatentoffices.

International exchange of patent docu-mentation with foreign offices has remainedthemain source of updating the foreign patentdocumentationfilesbothforexaminationneeds(PIB)and for theneedsof theUkrainianpublic(the Public Patent Documentation Collection,PPDC) for over 15 years.Over a period since1993 until today, international cooperation inthis area enabled Ukraine to collect significantamounts of foreign patent documentation onpaper carrier and optical discs which can, bytheircontent,basicallysatisfytheusers’needs.However, during the last years, internationalexchangeof patent documentationmoved toanew level connected with the widespread useof the Internet forofficialpublicationsand,asaconsequence, offices’ gradual discontinuanceoftraditionalpublicationsonpaper,CD-ROMorDVD.Theexchangeofpublicationsonmaterialcarriers progressively turns into the exchangeof electronic information via the Internet. Thistechnological process results in constantdecreasing of the amounts of data receivedon different carriers within the framework ofinternational exchange, which makes it impo-ssibletoupdatethePIBandPPDCwithcurrentpatentdocumentationofanevergrowingnumberof countries. So, in the foreseeable future theaccumulatedpatentcollectionswillturnintobackfilecollectionscoveringcertainyearsandwillbeusable only jointly with the Internet-resourceswhosesignificancehasbeengrowingandwhichinprospectwillreplacetraditionalcollections.

In2009,within theabove-mentionedprocess,the following publications stopped coming toUkraine: official bulletinsof thepatent officesofEstonia, Latvia, Lithuania, Poland, Croatia (onpaper),Romania(onCD-ROM),fullspecificationstopatentsofSwitzerlandonCD-ROM(ESPACE-CH), WIPO publication «WIPO Gazette ofInternationalMarks»(onpaper).

Inspiteof thesetendencies,during thereportyear the PPDCwas updated by a considerableamount of foreign patent documentation, inparticular on optical discs. In 2009, the officialbulletinsofAzerbaijan,BulgariaandKyrgyzstanstarted coming on optical discs (CD, DVD)insteadofpapercarrier.By theendof2009thePPDC comprised nearly 20.0 thousand officialbulletins of patent offices on paper carriers and15.28 thousandopticaldiscs,amongwhich455

bulletins and 1.17 thousand optical discs werereceivedwithinthereportyear.ThecollectionofspecificationstoUkrainianpatentsfor inventionswasalsoupdated:morethan26.1thousanditemswerereceivedbythePPDCin2009andthetotalvolumereached310.36thousanditems.

The composition of the PPDC and noticesabout its quarterly updates are published in the«Information Resources» section of the SDIPweb-portal(http://www.sdip.gov.ua),aswellasonthe web-sites of UIPI (http://www.ukrpatent.org)and its branch «Ukrainian Centre for InnovaticsandPatentInformationServices(UkrCIPIS,http://www.ip-centr.kiev.ua).

Availability of patent documentation fromthe countries with which Ukraine maintainsinternational scientific and technical, includingmilitaryand technical,cooperation, in thePPDCis constantly monitored – to date, the PPDCcomprises patent documentation of 50 suchcountries.Besidesthis,theSDIPweb-portalandthe UIPI web-site provide updated lists of theaddressesoffree-of-chargeforeigndatabasesofintellectualpropertyrights,aswellasscientificandtechnicaldatabasesandreferenceresources.

In its capacity as the centre of internationalexchange of patent documentation, UIPI sends,andplanstosendin2010,Ukrainianpatentdocu-mentationonopticalcarrieswithintheframeworkofexchangetoallpartnerofficesexcludingthosewhich from their side initiated discontinuanceof the mutual exchange. Within the processof rationalisation of the international exchangeof patent documentation, the official bulletin«PromyslovaVlasnist»onCD-ROMisnolongersent to11officessince2009,while thenationalCD-ROM«InventionsinUkraine»wassentto19officesasinthepreviousyear.

In total, the following products were sent in2009 within the framework of the internationalexchange:

– 36copiesoftheofficialbulletin«PromyslovaVlastnist»onCD-ROM(to32offices);

– 21copiesofthenationalCD-ROM«Inven-tionsinUkraine»(to19offices).

According to the notifications of the partnerofficesaboutdiscontinuationfrom2010of issuingthepublicationsusedforexchange,furtherdecre-ase of the amounts of incoming foreign patentdocumentationreceivedbyexchangeisexpected.

In 2009, considering the important place ofpatent information in the set of measures forpromotion of innovative activities in Ukraine, ahandbook was prepared for patent informationusers. The publication, entitled «Patent Docu-mentation.AcquisitionandAccessibilityinUkrai-ne.UserHandbook»,will be printed for free-of-chargedisseminationinUkrainein2010.

Similartothepreviousyears,withtheaimtobuildupthenationalpatentdocumentationcollections,the SDIP official publications were sent free ofchargetocertainorganisationsofUkraine,namely,onpapercarrier:theofficialbulletin«PromyslovaVlasnist»– to29organisations,specifications topatents– to 23organisations; onoptical carrier:the official bulletin– to 32 organisations andspecifications – to 26 organisations of Ukraine,including the bodies of the national system ofscientific and technical information: UkrainianInstitute for Scientific, Technical and EconomicInformation (only the official bulletin), StateScientific and Technical Library and 19 centresofscientific, technicalandeconomic information.TheregistersoffreedistributionoftheSDIPofficialpublicationsonpaperandelectroniccarriershavebeenupdatedfortheyear2010.

Taking into account the world tendencies intransformationofinformationresourcesandrapidadvance of information technologies, as wellas the urgent need to create national electronicinformation resources in Ukraine, at the end of2008theSDIPCollegiummadeadecisionaboutcreatingaDigitalPatentLibrary(DPL).Accordingto the respective SDIP Order and the UIPIRegulation, a jointWorkingGroup of SDIP andUIPI was created with the aim to organise andcarryoutanalyticalresearchesoncreatingaDPLinUkraineandtodevelopadraftConceptionandanActionPlanforitsrealisation.Theseworksareconceptually grounded and are relevant in thecontextofprovisionsoflegislativeandregulatoryand legalacts,defining, inparticular, thebasicsof the development of information society inUkraine, the fundamentalprinciplesof formingasystemofpublicallyavailablenationalelectronicinformationresources,aswellasprovidingforthewaysofdevelopingtheinformationinfrastructureofUkraine.

IntheI-IIquartersof2009theWorkingGroupprepared an «Analytical report concerningpossiblevariantsandthemostadvisablevariantof creating a Digital patent library in Ukraine»,approved by the SDIP Chairman in May 2009.During the III-IV quarters the Working groupcontinued forming the principles of drafting theConception, analysing the conceptual decisionsontheDPLgeneralstructureandthestructureofitsseparatecomponents.

4.2. Industrial Property International Classifications

2009becametheyearofUkraine’saccessiontomostoftheinternationalagreementsconcerninginternational classifications of industrial propertyrights.InApril2009WIPOobtainedlegalgroundsforaccessionofUkraineto:

– Strasbourg Agreement concerningInternational PatentClassification ratified by theLawofUkraineofDecember17,2008No.683-VI.ThedateoftheentryintoforcefortheAgreementinrespectofUkraineisApril7,2010;

– Locarno Agreement Establishing anInternationalClassification for IndustrialDesignsratified by the Law ofUkraine ofDecember 17,2008 No. 684-VI. This Agreement entered intoforceinrespectofUkraineonJuly7,2009;

– ViennaAgreementEstablishinganInterna-tionalClassificationoftheFigurativeElementsof

MarksratifiedbytheLawofUkraineofFebruary18, 2009 No. 1000-VI. This Agreement enteredintoforceinrespectofUkraineonJuly29,2009.

ItisworthmentioningthattheNiceAgreementConcerning the International Classification ofGoods and Services for the Purposes of theRegistrationofMarkswasratifiedmuchearlierbytheLawofUkraineofJune1,2000No.1762-ІІІ.The Agreement entered into force in respect ofUkraineonDecember29,2000.

Ukraine’s accession to the above-mentionedinternational agreements enables our countrynot only to use the international classifications,butalsototakeactivepartintheprocessoftheirimprovement.

ThesetofworksonactualisationoftheUkrainiantranslations of international classifications ofindustrial property rights is implemented on aconstantbasis. Inconnectionwith theentry intoforce of the new versions of the IPC advancedlevel (2009.01) and core level (2009) as ofJanuary1,2009thefollowingworkswerecarriedoutintheIquarterof2009:

– the publication of the Ukrainian editionof the new version of the IPC core level (2009)as a supplement to the current issues of theofficial bulletin«PromyslovaVlasnist»onpaper,fromBulletinNo.23/2008toBulletinNo.4/2009inclusively;

– free distribution of the Ukrainian edition«InternationalPatentClassification.NinthEdition(2009).CoreLevel»(9volumes)toallrecipientsof the Official Bulletin on paper within the Freedistributionregister.

Accordingtothecurrentpractice,onecopyoftheprinted version of theUkrainian translation of theIPCCore Level (2009)was sent toWIPO.WIPOQuestionnaireontheforeseensimplificationofthereformedIPCwasfilledinandsenttoWIPO.

Inorder tomake theuseof theelectronic IPC(2009) resources – core level and Ukrainianversion– convenient, the works on creating asingle IRS (Information and Reference System)«International Patent Classification. Core Level(2009). Ukrainian Version (2009.01)» were com-pletedinIquarterof2009.TheIRSisfunctionallyandstructurallysimilartotheWIPOsearchsystem:it enables the use of the necessary text of theClassification (core level or Ukrainian version),freelynavigatefromthecoreleveltexttothetextoftheUkrainianversionandviceversa, jumptothetextsoftheearliereditionsoftheUkrainianversionand theearliereditionof thecore level.The free

In the secondhalf of 2009, in connectionwiththeentry intoforceof thenewversionof the IPCadvanced level (2010.01) on January 1, 2010,UIPIcarriedoutworksonupdating theUkrainianversionof the IPCcreatedby theSDIPOrder ofOctober 3, 2007 No. 122: comparing the officialEnglish-language text of the new IPC version(2010.01) to the previous IPC version (2009.01),identifying the changes to be brought into theUkrainianversion,theirtranslationformEnglishintoUkrainianandcreationoftheUkrainianversionoftheIPC(2010.01)byinsertingthesechangestotheUkrainianversionoftheIPC(2009.01).AccordingtotheSDIPOrderofDecember21,2009No.272,the Ukrainian version of the IPC (2010.01) willbe used in thework of the state systemof legalprotectionofintellectualpropertyasofJanuary1,2010.Inthisconnection,updatingoftherespectiveIRSwasperformedintheIVquarterof2009–asof January 1, 2010 access will be provided tothe IRS«InternationalPatentClassification.CoreLevel(2009).UkrainianVersion(2010.01)».

4.3. Official and Information Publications

Publishing of the State Department’s officialbulletin«PromyslovaVlasnist»andspecificationsto patents for inventions (utility models) onpaper and electronic carriers continued during2009.Withinthereportperiodtheofficialbulletin«Promyslova Vlasnist» was published twice amonth with circulation of 90 copies; 24 issuesof the official bulletin with the total amount of1852.96 publisher’s signatures and the 2008AnnualIndextothebulletinswiththetotalamountof203.83publisher’ssignatureswithcirculationof65copieswerepublishedduringtheyear.

Table 4.1 demonstrates the total amount ofinformation concerning the industrial propertyrightspublishedin2009.

Theofficial bulletin«PromyslovaVlasnist»onCD-ROMandthenationalCD-ROM«InventionsinUkraine»,meant,inparticular,fortheinternationalexchangeofpatentdocumentation,were issuedregularly.

Within the framework of international coope-rationwiththeleadingworld intellectualpropertyorganisations – EPO and WIPO, the followingdata were prepared and sent in the course of2009:

– informationconcerningthepracticeofusingthe(23)INIDcodewhenpublishingtheinvention(utilitymodel)data;

– answers to the questionnaire concerningtheprocedureofcorrecting,alternatingandsup-plementing published patent information andthe state of affairs on implementation of WIPOStandardST.50provisionsinUkraine;

– samples of respective publications con-cerningcorrections,amendmentsand/orsupple-ments to the published patent information inUkraine in order to include them in Part 7.4 oftheWIPOHandbook«Examplesof corrections,alterations and supplements relating to patentinformation».

The fact that SDIP and UIPI specialists takeactive part in the works carried out within thescope of activities of the SCIT SDWG dealingwith the WIPO Standards revision, contributesto harmonization of patent information activitiesin Ukraine with the world community’s modernpolicy in the field of patent documentation andstandardisation. In particular, in 2009 Ukrainianspecialists tookactivepart in theworkofWIPOTargetGrouponrevisionof theWIPOStandardST.50 «Guidelines for Issuing Corrections,Alterations and Supplements Relating to PatentInformation», where they brought forward anumber of substantive propositions on updatingthisstandardanddraftingitsnewversion.Besidethis, in order to inform the public on WIPOstandards revision, alterations and supplementsbrought to them, the SDIP web-portal and the

– information concerning the versionsof WIPO standards currently in force wassystematically updated (hyperlinks to the officialtexts of the Standards in English and Russianwereprovided);

Thepatent officeswhicharemembersof theStandingCommitteeonInformationTechnologies(SCIT) yearly prepare annual technical reportsin order to inform other offices and generalpublic on the development of their informationactivities. Annual technical reports cover threeareasofinformationactivities,namelyconcerninginventions, industrial designs and trademarks.WIPO pays special attention to improvementsin the offices’ working methods, in particularconnected with automation of proceeding ofapplications for industrial property rights andchangeover to paperless technologies. As inthe previous years, according toSCITCircularsNos 2664, 2665, 2666 of April 1, 2009, SDIPannual technical reports for 2008, disclosingthe above-mentioned areas of activities, wereprepared and sent toWIPO in the III quarter of2009. In thesameyear, inorder to improve thewaysofinformingusersandcreateanewsourceof information for wide circles of scientific and

technical community of Ukraine concerning theSDIP information activities, the referred annualtechnicalreportswereforthefirsttimeplacedonitsweb-portal in«PlansandReports»section. ItisforeseenthattheywillbemadepublicthroughtheInternetyearly.

During2009:– a significant amount of new materials,

including 6 information notices on patentinformation matters, was prepared and madeaccessible on the UIPI web-site and the SDIPweb-portal;

– sections «For Patent Information Users»and«IndustrialPropertyClassificationSystems»wereupdated.

In2009,7publicationsonpatent information,documentation and standardisation matterswere prepared; reporting materials on patentinformation supportwere continuouslydisclosedin quarterly issues of the statistical publication«Industrial Property in Figures: Performance ofthe State Department of Intellectual Propertyand the State Enterprise «Ukrainian IndustrialPropertyInstitute».

4.4. Automation of Office Procedures on Applications for IPRs. Information Technologies Implementation

During the report year automation of thetechnologicalprocessesofapplicationproceedingandinformationtechnologiesimplementationintheexaminationbodywerecarriedoutaccordingtotheacceptedconceptionofautomationdevelopmentand information technologies implementation,whichdefinesthreemaindirectionsofautomationdevelopment:

2.Automationoftheproceduresandfunctionscarried out by the structural divisions of theexamination body (accounting division, analysisand economic planning department, economicanalysisandstatisticsdepartmentandothers).

3.Automation of the processes aimedto provide patent information support to theexamination body and external users, namely:creatingtheReferenceandInformationCollectionof examination, modernisation of the searchportal and active patent informationwarehouse,overhaulingof theexisting interactivedatabasesandinformationandreferencesystemsaccessiblethrough the Internet and patent informationproductsonopticalcarriers(CD-ROMandDVD)aswellascreatingnewones.

Automation of the Principal (Basic) Procedures and Functions

The planned measures on automationdevelopment and information technologiesimplementation taken in 2009 were intendedfor improving the examination body’s computersystems. In this connection the ultimate goal isto implement technological electronic documentcirculation in the examination body and providethe changeover to the paperless technology ofproceedingstheapplicationsforIPRs.

Due to the planned measures carried outto improve the automatized systems (AS)«Inventions», «Trademarks andServiceMarks»and «Industrial Designs» the following resultswereachieved:

1.InAS«Inventions»thefunctionsofcontrollingtheproceedingofapplicationsforinventionsandutilitymodels,selectingapplicationsforinventionsandutilitymodels,useradministrationwithin thedepartments of the Division of examination ofapplications for inventions, utility models andintegratedcircuittopographiesweredeveloped.

2.Means for identifying and recordingtechnological working time within the Divisionof examination of applications for inventions,utilitymodelsandintegratedcircuit topographieswere developed and integrated into the AS«Inventions».

3.A subsystem of automatic generation ofnumbers for incoming and outgoing documentsandmeansof interactionof the subsystemwiththe technological automated systems of theexaminationbodywasdeveloped.

4.With the aim to automate the process ofpreparation of supplementary documents andcarry out the full-text search by the tools of AS«Inventions», an information block was createdcontainingdataonapplicationanalogues.

5.Software enabling to select files ofapplicationsforinventionsandutilitymodelswasdevelopedinordertoconstantlystoretheminthedepository.

6.Software modules were embedded inthe medium of the AS «Inventions» to ensuremodification of automated procedures ofgeneratingclaims,abstractsandspecificationstopatentsforinventionsandutilitymodels.

7.Software was developed and implementedensuringautomatedcarryingoutof thefollowingfunctions:

•interaction of the AS «Inventions», AS«Industrial Designs» and AS «Trademarks andServiceMarks»withthesystemofdocumentkindclassificationandidentification;

•general electronic proceeding performed bythe specialists of theDivision of examination ofapplications for inventions, utility models andintegrated circuit topographies and the StateRegistrationDivision.

8.Testoperationofthemeansofcomputer-aidedpreparation of supplements to the technologicaldocuments of the Division of examination ofapplications for inventions, utility models andintegrated circuit topographies was performed;

thereafter the above-mentioned meanswas handed over to start the operationandmaintenancephase.

9.Design solutions for utilisation ofa single document classifier within thesystem of registration of incoming dataflowforIPRapplicationsweredeveloped.To improve the technologyofelectronicfiling of application materials, softwarewas developed enabling to performregistrationofsecondary(supplementary)

10.Design documentation on creation of asoftwarepackageforautomationoftheproductionprocessesoftheexaminationbody’sAdministra-tive Support Department and implementation ofthe electronic document circulation technologyin the technological AS «Industrial Designs»and AS «Trademarks and Service Marks» wasdeveloped.

11.AS «Industrial Designs» and AS «Trade-marks and Service Marks» were updated withregardtoincomingdocumentsprocessing

12.For AS «Trademarks andServiceMarks»,supplementary tools were developed forautomation of proceeding of applications filedby national applicants for registration to theWIPOInternationalBureau,aswellasasoftwaresystemforautomationofthefunctionsofcontrolofpaymentsandreceiptsoffeesfortheactivitiesconnected with acquisition and maintenance ofrights for internationally registered marks wascreated.

13.Mechanisms and interface designs weredevelopedandimplemented,enablingcollection,processingandreal-timedisplayofthestatisticalinformation concerning international registrationofmarks.

14.Installation and adjustment of themecha-nisms of image searching and recognitionaccordingtothespecifiedcriteriawereperformed;the referred mechanisms were integrated intothe system of electronic catalogues used inthe process of examination of applications fortrademarksandservicemarks.

15.A module «Usage Statistics» and themechanism of intelligent analysis of searchstrategies for the examination body’s searchportalweredeveloped.

Automation of the Procedures and Functions Carried Out by the Structural Divisions of the Examination Body not Directly Involved in the Procedure of Examination of IPR Applications

In2009asetofworksaimedatdevelopmentand modernisation of the automatized system«Payment Accounting» was carried out inorder to implement up-to-date technologies andplatforms. In particular, the current changes intheprocessesof thegivenareawereanalysed;specificationsfordevelopmentandmodernisationoftheAS«PaymentAccounting»weredeveloped;

a package of client-oriented services wasdesigned.

In order to perform periodical reporting onthe kinds of investments and kinds of fixedassets, the «System of forming the regimentedaccountingandreferenceforms»wasdevelopedandimplemented.

To enhance the efficiency of the examinationbodyperformance,in2009changeswerebroughtinto the software of the AS «Performances»to improve the procedures of calculation ofstatistical indicators concerning proceeding ofapplicationsforIPRs.Duetothesechanges,theAS«Performances»makesitpossibletomonitorthequalityoftheproceedingandefficiencyofthedivisions’workaccordingtothefollowingcriteria:

•the number of applications processed byanexaminerwith theaccount of theapplicationcomplexity;

•thenumberoftheopposedconclusionsmadebyparticularexaminers;

•the number of decisions of the AppealsChamber in favour of applicants despiteexaminers’conclusions;

•the number of court decisions in favour ofapplicantsdespiteexaminers’conclusions;

•thenumberofdecisionsongranting titlesofprotection;

•thenumberofrefusalsoftitlesofprotection;•the average term of pendency of an appli-

cation;•theaveragenumberofdocumentexchanges

betweenanexaminerandanapplicantduringtheexaminationofapplication.

Automation of the Processes Aimed at Patent Information Support of the Examination Body and External Users

entities with the information concerning IPRs isamongtheessentialtasks.

In order to fulfil this task, the followinginformationresourcesandproductswerecreatedinthecourseofpreviousyears:

•interactive electronic databases andinformation and reference systems placed onserversconnectedtotheInternet;

•databasesonoptical data carriersCD-ROMandDVD;

•technological and auxiliary databasesfor internal use by the examination body’sexaminers;

•thesearchportaloftheexaminationbody,aswellasanumberofinformationretrievalsystems.

These information resources and productshave been available for use since 2003. Theirlist is updated and supplemented yearly, users’feedbackbeingthemainconditionforenhancingthefunctionalityofthesearchengines,interfacesanddatastructure.

Significant demand for patent informationresources requires their constant updating,assuringthecorrectfunctioningofsearchenginesandusabilityofthemeansofinteractionbetweenusersandsearchsystems.

Inordertosatisfytheseneeds,newprocedureswere developed in 2009 for updating theinformation and reference systems «Informationon Pending Applications for Trademarks andServiceMarks» and «Industrial Design PendingApplications», as well as interactive databases«Trademarks and Service Marks Registered inUkraine» and «Industrial Designs Registered inUkraine»

Amodule of full-text searchwith the functionof word form search was developed and putinto test operation for the specialised database«Inventions(UtilityModels)inUkraine».

The collective access database «Informationon Invention Applications Allowed to Proceed»

was restructured, this makes it possible promptupdatingoftheinformationcontainedinit.

Aninformationandreferencesystem«Interna-tionalClassificationofIndustrialDesigns(LocarnoClassification).NinthEdition»accessiblethroughtheInternetwascreatedandsetinoperation.

To monitor the user activity and take offstatisticaldataconcerning theuseofdatabasesand information and reference systems, a newadministration subsystem was created andimplementedin2009.

With a view to satisfy the examinationinformationneeds,thefirststageoftheintegratedsystem«ReferenceandInformationCollectionforExamination»wasdevelopedandsetinoperation,in particular: a database was developed; asoftware for automatic formingofUkrainianandRussian characteristic thesauri of scientific andtechnicaltermsonthefivelevelsofIPCsymbols(section, class, subclass, group, subgroup)wascreated.

TofollowtheWIPOrecommendationsconcer-ning the use of data formats in creating patentinformation products in the examination body,a software was developed in 2009 enabling topresent all information arrays concerning titlesof protection for inventions, industrial designsandmarks for goods and services registered inUkraineintheMIMOSAauthoringtoolformat.

Inorder tounify theproceduresofautomateddrawingupof thesectionsof theofficialbulletin«Promyslova Vlasnist», a set of measures wastakento:

•create gateways for receiving informationfromtheexistingautomatizedsystems;

•develop the procedures of presentation ofdata arriving from the AS «Inventions» and AS«TrademarksandServiceMarks»intheformatoftheofficialbulletin«PromyslovaVlasnist»;

•buildaninformationconsolidationmoduleetc.In 2009 measures were taken to allow for

creatingasystemofbuilding, storing,periodicalupdating and real-time access to bibliographicdata and abstracts for inventions registered inforeign countries. This database is already inoperation and available on the UIPI website atwww.ukrpatent.org.

Themodulesprovidingformachinetranslationofabstractsofpatentsforinventionsregisteredinforeign countries into Ukrainian operating in thedecisionsupportsystemusedbyexaminerswereupdated.

4.5 Internet Resources of the State System of Intellectual Property Rights Protection

ThestatesystemofintellectualpropertyrightsprotectioninUkraineispresentedintheInternetby the following resources: www.sdip.gov.ua,www.ukrpatent.org, www.ip-centr.kiev.ua, www.uacrr.kiev.ua, www.iipl.ukrpatent.org, www.intelvlas.com.ua,www.fabrikaidei.kiev.ua.

ThemostpowerfulamongthoseistheofficialSDIPweb-portal –www.sdip.gov.ua. In 2009, aconsiderableamountofworkswascarriedouttoimprovetheusabilityoftheresourceandprovidethe web-portal visitors with quick access to theinformationstoredthere.

Duringtheyear,over500newsannouncementswereplacedintheUkrainianandEnglishversionsoftheweb-portal,itsstaticanddynamicsectionswere updated by topical information concerningtheeventswhich tookplace in thestatesystemof the legal protection of intellectual property in2009; over 200 photo-reports from seminars,conferences, meetings etc. were published; anumber of columns intended for the specialistsworking in the system aswell as for applicantsandpublicrepresentativesinterestedinthetopicwascreated.

Timelycoveragewasgiventotheeventstakingplaceintheintellectualpropertysphere,suchasseminars, conferences, meetings, round tables,visits of IP specialists from foreign countries,presentations, exhibitions, press-conferencesetc. Visitors to the web-portal could also studyinformationmaterialsrelatedtotheseevents.Forexample,besidesannouncements,programmes,participants’ reports, slide-shows, photo-reportsand participants’ and guests’ comments andopinions were also made available. All thisinformation was published during the time theevent took place and was complemented afterit had been finished. Moreover, in the archive

sections the previously published information isstoredforthevisitorstotheportalwhowerenotable to study it in due time or wish to browsethroughitanduseitlater.

Onthewhole,animpressiveinformationarrayofmaterialsonvarioustopicswasplacedontheofficial web-portal in 2009: coverage of currentevents and activities, updating and structuringof static patent informationmaterials,which arecontinuously updated and supplemented withnew data, improvement of navigation with theaimofprovidingaquickeraccesstoinformation,ensuring thecontactwithusersbycreatingnewheadingsandupdatingtheexistingones.

In order to search for information easily andquickly, the web-portal visitors used a powerfulsearchmodule enabling them to apply a singlequery tosearch fornecessarydata in thewholeinformation base of the resource, in separatetopical sections, use logic connectors, as wellastoviewsearchresultsbyrelevanceorbythedateofpublication.Inthenextyearit isplannedto connect theweb-portal towell-known searchsystems operating in the Internet to widen itsrangeofsearchfacilities.

Communication of the specialists of the IPspherewith theweb-portal users (entrepreneurs,specialists, patent attorneys, students and otherinterestedpersons)isofgreatsignificance.Forthisreason, close attentionwas paid to the separateblock«Communication»comprisingsuchheadingsas «Electronic Reception Rooms», «Questions/Answers»,«Forum»,«Blog»,«ServiceCatalogue».Each of these headings serves a separate goal.Forexample,youcanuseoneof the«ElectronicReceptionRooms»toputaquestionto theSDIPChairmanandeachofhisdeputies.Theanswersto the questions are placed by the order theywere received under the «Questions/Answers»heading. This section is very serviceable as itoffersanswerstosituationalquestions interestingfor a significant audience active in IP sphere.«Forum» enables the users to communicate intheoff-linemode,and«Blog»isdesignedtogiveregisteredusersthepossibilitytokeepanInternet-diary, publishing their opinions, references andreflections of certain topics. Under the «Servicecatalogue» heading, comprehensive informationabout the services offered by SDIP to naturalpersons, legal entities, government employeesandinternationalcommunityispublished.

One of the most important and popular sub-sections is «Databases and Information and

Reference Systems» comprising 12 databasesand9informationandreferencesystems.

Statisticaldatarevealtheusers’interesttothementioned resources. For example, the Internetdatabase«Inventions(UtilityModels)inUkraine»hasbeenusedbyover20thousandusers.Thetotal amount of the viewed documents monthlyreaches almost 100 thousand. The database«Trademarks and Service Marks Registered inUkraine»alsoenjoysgreatpopularity.Duringonlythelasttwomonthsof2009theuserscarriedout36963 searches, viewed 698,626 bibliographicdatatocertificatesofUkraineformarksforgoodsandservicesand702,587imagesofmarks.

Over200letterswerereceivedontheaddressoftheSDIPweb-resourceadministrationin2009.The majority of the questions concerned thematters of copyright and related rights. Userswerealso interested in theamountsof feesandstate due, the rules of drawing up and filingapplications for granting titles of protection forintellectualpropertyrightsetc.Consultationsweregivenorallybytelephoneandbye-mail.

On the average, over 9 thousand users visitthe web-portal monthly; in the course of 2009,over100thousandusersviewedthepagesoftheweb-portal.

TheUIPIweb-site(http://www.ukrpatent.org)alsounderwentamendmentsandupdates in2009. Inparticular,thesection«DatabasesandInformationandReferenceSystems»wasreconstructedandupdated, over 300 news announcements wereplaced,almostallstaticsectionswereupdated,thebannerblockofpatentattorneysandcommercialorganisations was reconstructed. Almost 100letters from users was received by the websiteadministrationin2009.Thedominanttopicswerethose concerning the procedure of drawing updocuments for filing applications for industrialproperty rights, the

coverage of the databases and information andreferencesystemsavailableonthewebsiteetc.

In2009,thedesignoftheofficialwebsiteoftheStateEnterprise«UkrainianAgencyofCopyrightandRelatedRights»was renovated.Apart fromvisualelements,thefunctionalpartofthewebsitewas improved, namely, the list of sections wasenlarged, the version in a third language wasadded (the Ukrainian-, Russian-, and English-language versions of the website are now inoperation),aninformationblocktitled«UkrainianAgency of Copyright and Related Rights isLookingforAuthors»isplacedonthehomepageofthewebsite.Theaveragenumberofvisitorsofthe website amounted to approximately 80-100users per day. In 2009, a significant number ofpublications were placed in the news section.Besides,thematerialsinalmostallsectionswereupdated;SDIPquarterlyreportswerepublished.

In order to keep the public informed aboutthe activities of the state system of intellectualpropertyrightsprotection,activecooperationwiththemassmediawasmaintainedduring2009.

Around 300 printed materials (comments,interviews, articles by themanagement and thespecialists of the state system) were placed inthemedia.

The following topics were among thosecovered in themediabyapplicants’ request: thecriteria of evaluation of the examination body’sperformance, the peculiarities of the processof drawing up and prosecution of applications,the main principles of examination in particularfieldsof technology, theworldexperienceof taxregulation in the innovation field; assessmentofintellectualpropertyrightsinUkraine;patentinginforeigncountries:theadvantagesoftheprocedureunderthePatentCooperationTreaty,thecriteriafor patent granting; digital libraries; parasitic

marketingandanumberofotherissues.

5.1. Cooperation with the World Intellectual Property Organization

During the report year SDIPcontinued the work intendedto provide efficient and mutuallybeneficialcooperationwiththeWorldIntellectual Property Organization.SDIP’seffortswerehighlyappraisedbyWIPODirectorGeneral FrancisGurry in the letter addressed tothePrimeMinisterofUkraineYuliaTymoshenko. Specifically, he hasnoted that assignation of SDIPas the national coordinator forimplementation of the CooperationProgramme in the framework oftheAgreementbetweenWIPOandtheCabinetofMinistersofUkraine,signed in Kyiv on May 28, 2002, created thereliable and effective basis for initiation of theannualcooperationplans.

A number of important events were held in2009. Particularly, Ukraine has joined severalinternationalagreements,administeredbyWIPO:LocarnoAgreementEstablishinganInternationalClassificationfor IndustrialDesigns(enteredintoforce on July 7, 2009), Strasbourg AgreementConcerningtheInternationalPatentClassification(will enter into force on April 7, 2010), ViennaAgreement Establishing an InternationalClassificationoftheFigurativeElementsofMarks(entered intoforceonJuly29,2009),SingaporeTreatyontheLawofTrademarks.

WIPO and the Ukrainian Industrial PropertyInstitute signed the Cooperation Programme

within the framework of the Patent CooperationTreaty. The Program is intended to improveoccupationallevelofUkrainianexaminersdealingwithinternationalapplicationsforinventionsunderthePCT,andalsothe levelofawarenessof theusersoftheinternationalsystemfortheprotectionof inventions,furtherdevelopmentof informationsystemsandtechnologiesinthestateintellectualpropertysystem.

In view of adoption of the Conception ofdevelopmentof thenational intellectualpropertysystemin2009–2014,anumberoftutorialswithWIPO, concerning themost efficientwaysof itsimplementation,wereheld.

SDIP has initiated a number of importantinternational events, in particular, seminars onthe«Managementof IntellectualPropertyRights

inInstitutionsofHigherEducationandResearch-and-Development Centres» and «Protectionof the Audiovisual Works and Performances»,which were held in June, 2009. WIPO DirectorGeneralFrancisGurryhashighlyappreciatedtheorganizationallevelofthoseseminars.

During the report year SDIP initiated the firstinternational WIPO-Ukraine Summer School inOdessa,whichhashad favourable reports fromthe world community and drawn the attentionof participants worldwide. Taking into accountits positive results, WIPO administration hassupported the initiativeof theUkrainianparty toholdthiseventontheannualbasis.

SDIPhascontinuedtheworkaimedatsolutionof the problematic issue of representation ofUkraine in the WIPO Secretariat. Specifically,UkrainehasruncandidatesforthepostofWIPODeputy Director General and WIPO AssistantDirectorGeneral.ThisgivesconcretechancesforemploymentofoneofthecandidatesintheWIPOSecretariattoaratherhigherpost(P4).

Ontheresultsofthe47thsessionofAssembliesof the WIPO member states it was decidedto arrange the visit of WIPO Director Generalto Ukraine. WIPO Secretariat gave preliminaryapprovaltoarrangeit.

UkraineconcedetherightofparticipationintheExecutiveCommitteesofBerneandParisUnions,andalso,respectively,intheWIPOCoordinationCommittee, taking into account the participationofUkraine in theWIPOCoordinationCommitteeduringthelasttwoyears,andinviewofrotationinaregionalgroupofseveralcountriesinEuropeandAsia.AtthesametimeUkrainehasreservedtherighttoparticipateintheWIPOProgramandBudgetCommittee.

In December of the reportyear SDIP together withWIPO held regional seminar«Recommendations Concer-ning the Emerging Role ofSmallandMedium-SizedEnter-prisesinCISCountries»,whichbecame the final stage in thesurvey of situation, carriedout by WIPO, concerningthe promotion of innovationsin small and medium-sizedenterprises(SMEs).Therecom-mendationsare theattempt tosummarise and present themostacceptableorganizational,

institutional,tax,financialandcreditmechanismsof influence, which can be used to enhancethe innovative component of SMEs. They weredeveloped with due account for the achievedlevel of development of innovative activities ofSMEsonthebasisofsurveyandcomparisonofthe regulatory framework of CIS countries, theapprovedstrategiesofeconomicand innovativedevelopment,SMEssupportprograms,presenceofinnovativeandintellectualpotential.

5.2. Cooperation with European Patent Office

A number of activities aimed at improvementof thestatesystemof intellectualpropertyrightsprotection in Ukraine, were held during thereportyearwithin the frameworkofCooperationProgramme in 2008–2010, signed bySDIP andEPO.

As is known, EPO considers Ukraine as aprospective member of European PatentOrganization, taking into account occupationallevel of Ukrainian examiners and potential oftheexaminationbodyofUkraineintheindustrialpropertyfield.

In respect that Republic of Croatia recentlybecame a member of the European PatentOrganization, and Montenegro signed theAgreement with European Patent Organizationon extension of the effect of European patenton its territory,UkrainedelegationvisitedpatentofficesofthoseStatesinApril,2009.Intheresultoftutorials,heldwithadministrationsoftheabovementionedoffices,useful informationconcerningthe conditions, advantages and consequencesof the membership in the European PatentOrganization,wasobtained.

During the year, within theframeworkof implementationofthe Cooperation Programme,examiners of the UkrainianIndustrial Property Institutetook part in several workshopsessions and trainings of theEPO Patent Academy, whichgave the opportunity to learnabout new trends in the areaof examination of applicationsfor industrial property rights,and share the experience withspecialists from other countries. Such trainingseminarsand tutorialsare theperfectpossibilityfor our specialists to improve their occupationallevel, that will eventually assist in improvementand acceleration of examination of applicationsforindustrialpropertyrightsofUkraine.

EPO specialists have provided expertassistance on the implementation of electronicsystem of filing of applications for industrialproperty rights in Ukraine. Experience of theEuropeancolleagueshelpedtoforwardtheworkinthisdirectionsignificantly,andit isexpectablethatthesystemofelectronicfilingofapplicationswilloperateinUkrainesoon.

One of the directions of the CooperationProgramme between SDIP and the EuropeanPatentOffice is closer cooperation between theState Institute of Intellectual Property and EPOPatentAcademy. In2009 representativesof theState Institute of Intellectual Property took partin the Symposium of managers of the highereducation institutions, which provide educationin the intellectual property field. Within theSymposiumUkrainiandelegationhadameetingwithadministrationoftheEPOPatentAcademy,duringwhichtheagreementoncarryingoutajointseminar, aimed at familiarization with Europeansystem of education in the intellectual propertyfield,in2010wasreached.

In September of the report year UkrainiandelegationvisitedEPOheadquarterstomeettheadministration of this organization and discussthe results obtained during the year within theframeworkof implementationof theCooperationProgramme,andalsotodefineprioritylinesofthebilateralcooperationin2010.

Duringthevisitthestatesystemofintellectualproperty rights protection was presented; theEuropean party has acquainted with Ukrainianlegislation on the issues relating to intellectual

property and structure of the state bodies,involved in the field of legal protection andenforcement of intellectual property rights. Theprimary objective of the visit– to show ourEuropean partners that efficient system of thelegal protection and preservation of intellectualproperty rights was created and now operatesin Ukraine – was achieved. This, certainly, willpromote intensification of bilateral cooperation,formation of the positive investment climatein Ukraine, arrival of the greater amount ofapplicationsforindustrialpropertyobjects.

5.3. Participation of Ukraine in the World Trade Organization (WTO)

In March and October of 2009 in Geneva(Swiss Confederation) meetings of the regularandspecialsessionsoftheCouncilontheTrade-Related Aspects of Intellectual Property Rights(TRIPSCouncil)tookplace.

Within the regular meetings of the TRIPSCouncilWTOmembers discussed the followingissues:thestatusofnotificationsundertheTRIPSAgreement; implementation of the provisionsof the TRIPS Agreement by WTO members;revisionoftheprovisionsoftheArticle27.3(b)ofthe TRIPS Agreement; connection between theTRIPSAgreementandConventiononBiologicalDiversity;protectionoftraditionalknowledgeandfolklore; application of the provisions of theTRIPS Agreement relating to the protection ofgeographicalindications,etc.Withintheframeworkof special sessions of TRIPS Council issuesconcerning multilateral system of notificationsandregistrationofgeographicalindicationswereconsidered.

affairs in the implementationof legislation in theareaofintellectualpropertyandachievedpositivefeedbackoftheWTOmemberstates,particularlyEU,SwissConfederationandCanada.

On the resultsofparticipation in thesessionsof theTRIPSCouncil aSDIPposition regardingthe issues of the Agenda of Doha Round ofnegotiations of the WTO development wasprepared, specifically concerning amendmentsof the TRIPS Agreement, relation of the TRIPSAgreement and Convention on BiologicalDiversity, establishment of multilateral systemof registration and notifications of geographicalindications,etc.

To fulfil Ukraine’s commitments under theArticle63.2oftheTRIPSAgreementin2009SDIPsubmitted notifications regarding legislative actsandpracticeofapplicationofnational legislationin the intellectual property field, responded therequestsoftheWTOmemberstates,specificallyArgentina,concerningUkrainianlegislationintheintellectual property field. Respective Ukrainiannotifications can be found on theWTOwebsitewww.wto.org.

5.4. Implementation of Measures Aimed at EU Integration

In 2009 the following measures aimed atthe formation of the free trade area betweenUkraineandEuropeanUnionwereimplemented:participation of SDIP representatives in fourregular stages of negotiations, two videoconferences, interdepartmental consultationsregarding the creation of the free trade areabetween Ukraine and EU and signing of theappropriateAgreement,ontheresultsofwhichanumberofprovisionsof thesection«Intellectualproperty» in the draft Agreement concerningcopyrightandrelatedrights,trademarks,industrial

designs,patents,topographiesofintegralcircuitsandgeneralaspectsofintellectualpropertyrightsenforcementwereagreed.An agreement on the exchange of thelists of geographical indications withEU was reached. SDIP representativestookpart in three trainingsandmeetingswith the leading manufacturers, roundtable and seminar to prepare position ofUkraine regarding settlement of issueson the protection andmutual recognitionofgeographicalindicationswithinthefreetrade area, taking into account national

interestsofUkraine.In December of the report year in Kyiv,

within the frameworkof IXstageofnegotiationson establishing the free trade area betweenUkraine and EU, expert trainings concerninggeographical indications with representatives ofEuropean party took place. During the trainingsparticipants discussed the list of geographicalindications registered inEuropeanUnion,whichwassubmittedtoUkrainianpartythedaybeforethetrainingwasheld,andalsopracticalaspectsof conduction of the public trainings concerningfuturegeographicalindications.

In2009SDIPcontinuedcooperationwithEUinthe intellectualproperty fieldwithin theDialogueon intellectual property rights enforcementbetweenEuropeanCommissionandUkraine,theCommitteeonCooperationbetweenUkraineandEC,Sub-committeeNo.1«TradeandInvestment»and Sub-committee No. 3 «Enterprise Policy,Competition,CooperationinRegulatoryField».

RegularmeetingsofSubcommitteesNo.1andNo.3,duringwhichissuesconcerningintellectualproperty rights protection, internal aspects andregulatory matters of intellectual property rightswerediscussed,wereheldin2009inKyiv;SDIPrepresentativesontheUkrainiandelegationtookpartinthosemeetings.AccordingtotheresultsofthemeetingsEuropeanpartystatedtheprogressin the improvement of legislation on intellectualpropertyrightsenforcementinUkraineandinthefieldofcombatingcounterfeitingandpiracy,andalso expressed hope for the furtherwork of theWorkinggroupontheimprovementofintellectualproperty rights enforcement. EU representativealso has pointed out that thisWorking group isoneofthemostefficientandactive.

enforcement in Ukraine was held. During themeetings the following issues were considered:legislationdevelopmentintheintellectualpropertyfield, activities of the collective managementorganizations, combating counterfeiting andpiracy,arrangementofTAIEXseminarsregardingInternet piracy, author’s remuneration paymentbythebroadcasters,collectionofroyaltiesfortheprivatecopying,usingof theholographicmarks,destroyingofthecounterfeitpesticides,etc.Intheresult of the meetings active dialogue betweenEuropeanCommissionandUkraineismaintainedand also actual state of affairs in legislation intheintellectualpropertyfieldandimplementationof this legislation isdiscussed.According to theresults of these meetings participants achievedtheagreementonthearrangementofthenumberof seminars concerning issues of intellectualproperty for judges, representatives of publicprosecutor’s office and the Ministry of InternalAffairsofUkraineusingTAIEXinstrument.

In 2009 SDIP prepared the application onimplementationoftheprojectoftechnicalsupportcalled TWINNING in Ukraine, which is aimedat conducting the number of seminars for therepresentativesofthestatebodiesinvolvedinthefieldofprotectionandenforcementofintellectualpropertyrights,whichwillbeaimedatsolutionofactualproblematicissuesinthisfield,consultativeassistance for the Ukrainian Industrial PropertyInstitute to improve examination of applicationsforindustrialpropertyrights,andalsofortheStateInstituteof IntellectualPropertywith thepurposeofimprovementofthequalityofeducationintheintellectualpropertyfield.

5.5. Formation of the Free Trade Area between Ukraine and European Free Trade Association

In January, 2009Secretariat of theEuropeanFreeTradeAssociation(EFTA),whichcomprisesthe Republic of Island, the Principality ofLiechtenstein, the Kingdom of Norway and theSwiss Confederation, officially informed theUkrainian party about the readiness to startnegotiations concerning the formation of thefree trade area. Draft Agreement on formationof the free trade area between Ukraine andEFTAcontainstheseparatechapter«IntellectualProperty».

Inthereportyearthreeroundsofnegotiationson the formationof the free tradeareabetween

Ukraine and EFTA were held, during which,specifically, some articles of the chapter«IntellectualProperty»ofthedraftAgreementonformationofthefreetradeareabetweenUkraineand EFTA were agreed. Detailed considerationof the articles concerning the protection ofgeographical indications, measures on theborder, inventions and confidential informationwasstarted.

5.6. Bilateral Cooperation

In 2009 one of the components of SDIPactivities was active implementation of bilateralcooperationofUkrainewith foreignstates in thefieldofintellectualpropertyrightsprotection.

SDIP took part in processing and adjustmentofthefollowing:

• draft Agreement between the Cabinet ofMinisters of Ukraine and the Government ofUnitedArabEmirates on the cooperation in thefieldofmilitarydefence;

• draftAgreementbetween thegovernmentsof GUAM member states on certain issues ofintellectualpropertyrightsenforcement;

• draft Agreement between the Cabinet ofMinistersofUkraineand theGovernmentof theRepublic of Serbia on the cooperation in theintellectualpropertyfield;

• draftresolutionoftheCabinetofMinistersofUkraineon«ApprovaloftheFrameworkAgreementbetweentheCabinetofMinistersofUkraineandthe Government of the Republic of Belarus onCooperationintheFieldofInvestigationsandUseofSpaceforPeacefulPurposes»;

• draftresolutionoftheCabinetofMinistersofUkraineon«ApprovaloftheFrameworkAgreementbetween the Cabinet of Ministers of Ukraineand the Government of Azerbaijan Republic on

According to bilateral agreements Action planon implementation of cooperation in the field ofintellectual property rights protection betweenSDIP and State Agency on Intellectual Propertyof the Republic of Moldova in 2009–2010 wassigned. Currently the possibility of conductingthemeeting of examiners from Ukraine and theRepublicofMoldovaconcerningelectronicfilingofdocumentsandelectronicsignatureisdiscussed.

SDIPrepresentativestookpartintheinterstateUkrainian-Swiss Commission on Trade andEconomic Cooperation, during which modernsystemforintellectualpropertyrightsenforcementwas presented, and also matters of intellectualproperty rights enforcement, specifically, use ofindicationsconnectedwith thenameofStateofthe Swiss Confederation, in the composition oftrademarks,wereconsidered.

In 2009 an active cooperation between SDIPand the Government of the United States ofAmericacontinued.

SDIPrepresentativestookpartinthemeetingsofUkrainianpartyoftheUkrainian-AmericanCom-mitteeonTradeandInvestments,andalsointhework of the second joint meeting of Ukrainian-AmericanCommitteeonTradeand Investmentsheld on October 14–15 of the report year inWashington(USA).

Ukrainian party presented measures imple-mented by theGovernment of Ukraine with thepurpose of adjustment of problematic issues ofintellectualpropertyrightsenforcement.

After the meeting of the Ukrainian-AmericanCommittee on Trade and Investments Action

planwassigned,thisprovidestransferofexperiencebyAmericanpartyconcerningsolution of the issues on intellectualproperty rights enforcement, and alsodisposalofthereportdataontheprovisionofintellectualpropertyrightsenforcementto the USA Government to estimate theobtainedresults.

During the report year two meetingsof the Ukrainian-American IntellectualPropertyEnforcementCooperationGroupwereheld.

During the 9th meeting of the CooperationGroup, held on February 10, 2009, issues ondestroying of infringing and pirate goods wereconsidered.MinutesofthesessionoftheGroup,and also draft amendments to the existinglegislation, provided by the European BusinessAssociation within above mentioned meeting,were sent by SDIP to relevant ministries forprocessing.

On December 3, 2009, 10th meeting of theCooperation Group, during which issues oflegalization of software in the executive bodieswere considered, was held. Representatives ofthe relevant ministries and offices, companies-rightsholders,andalsoof theEmbassyofUSAinUkrainetookpartinthesession.Itwasdecidedthat participants of the session would prepareproposalsonthe improvementof regulatoryandlegal framework, implementation of educationaland organizational measures for enhancing thesituationwithlegalizationofsoftware.

Representative of the Embassy of USA inUkraine has outlined positive shifts in the fieldof intellectual property rights enforcement inUkraine, which is proved by the increase ofUkraine’sratinginthe«Special301»list.

5.7. Cooperation with the CIS Countries

Being the CIS member, Ukraine fulfils itsobligations concerning a number of multilateralagreements with the CIS member states. WithintheframeworkofmultilateralcooperationwiththeCIS countries in the field of intellectual propertyrightsprotection, inorder to fulfilcommitments inthe bounds of the Agreement on cooperation interminationoflawinfringementsintheintellectualproperty field and the Agreement on industrialproperty rights protection, SDIP representativesparticipatedin2009inmeetingsoftheJointWor-kingCommissionofMemberStatesoftheAgree-

On April 14–15, 2009, in Minsk (Republic ofBelarus) the 18th meeting of the Commissiondealingwithanumberoftopicalissues,concerningtheenforcementof intellectual property rights intheCISmemberstates,washeld.

Main issueof themeetingwasthediscussionof a draft of the Action plan, necessary toaccompanystagesofimplementationofEconomicadvancement strategy of CIS for the period till2020,whichconcernspreventionofinfringementsin the intellectual property field (Action plan).In order to solve this matter participants of themeetingdecidedtoperformdomesticproceduresineachCISmemberstate.Inturn,SDIPtogetherwith Ministry of Internal Affairs of Ukraine,Security Service of Ukraine,Ministry of ForeignAffairsofUkraineandStateCustomsServiceofUkraineprocessedtheActionplanandsubmittedcommentsandproposals.

On September 9–10 of the report year inYerevan (Republic of Armenia) Ukrainiandelegation participated in joint meeting of ICIPP and the Commission, during which theconception of establishing of the InterstateCouncil on Legal Protection and Enforcementof IntellectualPropertyRightsandconsiderationof the draft Agreement «On Cooperation in the

FieldofProtectionandEnforcementofIntellectualProperty Rights and Establishing of InterstateCouncilonLegalProtectionandEnforcementofIntellectual Property», and also regulation «Onthe Interstate Council on Legal Protection andEnforcementofIntellectualPropertyRights»wasdiscussed. The conception of establishing theInterstate Council provides for consolidation ofthefunctionsofICIPPandtheCommission,andwideningthescopeoftheiractivitiestowardsthefieldofcopyrightandrelatedrights.

During the joint meeting of IC IPP and theCommissionproposalsconcerningimplementationby the CIS member states of joint educationalprograms in the field of intellectual propertywere considered. Presently, State Institute ofIntellectual Property continues cooperationwithin CIS in the field of education, developingeducationalprogramsaimedatthestudentsfromCIScountries.

Participants of the meeting summed up theresultsoftheprojectofregionalpatentinformationproduct ofCIS countries onCD-ROM,andalsocoordinated results of investigation «On theDevelopmentofInventiveActivityandAssistanceto the Small and Medium-Sized InnovativeBusinesstoUseMechanismsofLegalProtectionand Enforcement of Intellectual Property», heldbyICIPPtogetherwithWIPO.

6.1. Specialist Training and Skill Upgrading

Oneoftheessentialelementsoftheinnovativeinfrastructure is its educational component.Training and upgrading of skills of specialistscapableofmanagingtheprocessesofacquisitionofprotection,useandenforcementofintellectualproperty isoneof thevehicles transferringthe national economyto the innovativedevelopmentmodel.

In 2009, 16 highereducationalinstitutionsof Ukraine trainedstudentsforspecialist’sand master’s degreesin the specialty «Intel-lectual Property».Altogether during thereport period, 507such specialists weretrained: 248 mastersand 259 specialists.Thestateorderforpersonneltraininginintellectualproperty field in the report year amounted to194 persons, including 117 persons formaster’sdegreeand77personsforspecialist’sdegree.

A significant contribution to the training ofsuchspecialistswasmadebytheStateInstituteof IntellectualProperty (Institute) responsible forthe scientific andmethodological support of theeducational specialty «Intellectual Property».Studentsofthefull-timeandextra-muralcoursesdefended their written qualifying papers for

master’s and specialist’s degrees in specialty«Intellectual Property» in the period betweenJune9andJune30,2009.Basedontheresultsof the papers defence, 43 masters and 119specialists got state-recognised diplomas. TheStateExaminationBoardrecommended10worksfor practical application in the state system of

intellectualproperty.The dynamics of

the specialist andmaster graduationin the Institute in2001–2009isshowninfig.6.1.

In view of thefact that the Lawof Ukraine «On theState Regulationof Activity in theSphereofTransferofTechnologies» provi-des for creation ofdivisionsdealingwithinnovative activities,

technologytransferandintellectualpropertyinthestate run public authorities, and considering thegrowing number of productions before the courton intellectual property rights infringement, SDIPtogetherwiththeInstitutepaidspecialattentiontothe training of intellectual property specialists forexecutive bodies and judicial power authorities.Thus, 73 state employees and 11 judges wereenrolled to the Institute in 2009, whichmade up42%ofthetotalnumberofthepersonsenrolledforthestudy(200persons).

bytheintergovernmentalorganization«UkrainianScientific and Technological Centre» developedatrainingprogramme«Commercialisationof theResultsofScientificResearch».Itisintendedfor160 academic hours, includes two audiovisualmodules for distance learning, three businessgames (cases) for interactive learning, twoindividual tasks and computerised tests for thecontrolofknowledge level.Theprogrammewastested in the Institute of Radio Physics andElectronicsoftheNationalAcademyofSciencesofUkraine(Kharkiv)inthegroupconsistingof23scientificworkers.

In2009theInstitutetogetherwithSDIPensuredskills upgrading for teachers of institutions ofgeneraleducation,academicteachingstaffactiveinthefieldsofintellectualpropertyandinnovativeactivity,specialistsintechnologytransfer,namelycandidatestotechnologicbrokers–allinallover700persons.

In the course of 2009, in order to providescientific andmethodological support of trainingthespecialistsinspecialty«IntellectualProperty»theCentreofSmallOffsetPrintingoftheInstitutepublished nine titles of textbooks and teachingaids with the total number of printed copiesreachingaround2500.

To improve the international image of thestate system of the protection of intellectual

property rightsandenable the Institute toenterthe international structures carrying out trainingand skills upgrading of intellectual propertyspecialists, the creation of an Internationaltraining and scientific centre was initiated. TheaimofthisCentre’sactivitiesistherealisationofinternational master’s programmes for trainingspecialists in the field of intellectual property,technology transfer and innovative activities,as well as training of specialists from CIScountries in specialties «Intellectual Property»,«Consolidated Information» and «InnovativeActivity Management». The Institute’s initiativewas approved by the Decision of the SDIPCollegiumofNovember14,2008andsupportedby the Ministry of Education and Science ofUkraine, which on July 16, 2009 gave theeducational institution a licence for carrying outeducationalactivitiesintrainingforeigncitizensinbasicaccreditedareas(specialties).

Training of patent attorneys and professionalintellectual property rights appraisers remainedan important task throughout the report period.Duringtheyear7professionalintellectualpropertyrightsappraisersand28candidatestointellectualproperty representatives (patentattorneys)weretrained.

SDIP also carried out qualifying evaluationof intellectual property representatives (patent

attorneys), administered complaints about theactions of patent attorneys connected withundue performance of their professional duties,controlledtheobservanceoftherequirementsofthe existing legislation on the IP field by patentattorneys,maintainedtheStateRegisterofPatentAttorneys.

In2009,theSDIPExaminationBoardcertified20candidatestointellectualpropertyrepresentatives(patentattorneys).AsofJanuary1,2010,thetotalnumberofregisteredpatentattorneysinUkraineamounted to 360 persons providing services inthefieldofintellectualpropertyrightsprotectionin37citiesandtownsof19regionsofUkraineandtheAutonomousRepublicofCrimea.

6.2. Scientific and Practical Conferences and Seminars

In2009SDIPorganisedandheld5conferences,including 2 international, and 14 seminars,including3internationaland3regional,concerningtopicalissuesofacquisition,useandenforcementofintellectualpropertyrights(Annex2).

In particular, within the framework of theWorld Intellectual Property Day celebration, ascientific and practical conference «SituationandProspects for theDevelopmentof theStateSystemof IntellectualPropertyRightsProtectioninUkraine»washeldonApril24.

Jointly with the State Institute of IntellectualPropertytheIXAll-Ukrainianscientificandpracticalconference «Problems of Training, RetrainingandProfessionalImprovementofSpecialistsonIntellectual Property, Research-and-Informationand Innovation Activities in Ukraine» waspreparedandheld, hosting 83participants fromall regions of Ukraine, representing 32 highereducationalinstitutions,aswellasrepresentativesoftheVerkhovnaRadaofUkraine,theCabinetofMinisters of Ukraine, the Ministry of Educationand Science of Ukraine and SDIP. This provesthe great interest the scientific and pedagogicalcommunity of Ukraine takes in the mattersof training specialists in intellectual property,informationandanalyticalandinnovativeactivities.Duringtheconferencearoundtablemeetingwasheldonthemattersofdrawinguptextbooksandteaching aids to supply the academic activity inspecialties«IntellectualProperty»,«ConsolidatedInformation»,«InnovativeActivityManagement»;ageneraldiscussiononthetopicoftheconferencetookplace.

InJuly20–30,atwo-weekWIPOInternationalIntellectual Property Summer School was heldon the basis of Odessa National Academy ofLaw. Its holding was initiated by SDIP jointlywith WIPO within the framework professionaldevelopment programme. The Summer schooloffersauniqueeducationalprogrammecoveringallaspectsof intellectualproperty. Itsmission isto provide opportunity for senior students andyoungprofessionals to refine their knowledge inthe field of intellectual property which is a toolof economic, social, cultural and technologicaldevelopmentofthesociety,andtodisplayWIPO’srole in the global administration of intellectualproperty.Todatesuch trainingprogrammesarerealised inanumberofcountries,Ukrainebeingthe seventh among them. It is substantial thatthe working language of the Summer schoolwas English, whichmade it possible to engagestudents and teachers from 11 countries of theworldinparticipatinginit.SDIPChairmanMykolaPalaliy expressed his hope that the IntellectualPropertySummerSchoolwouldbecomeayearlyeventinUkraine.

The traditional ХІV International Scientificand Practical Conference «Actual Problems ofIntellectualProperty»(August31–September4,Yalta)organisedbySDIPjointlywithWIPO,EPOand theCouncilofMinistersof theAutonomousRepublicofCrimeawelcomedtherepresentativesof the state authorities and state governingbodies, industrial enterprises, judicial system,research-and-development institutions, highereducational institutions, public organizations,lawyers and patent attorneys of Ukraine andforeign countries, as well as representativesof international organisations and businesses,intellectual property specialists and managersfrom Latvia, the Republic of Poland, RussianFederation, Czech Republic, Ukraine, nationalintellectual property offices of the Republic ofKazakhstan and the Republic of Slovenia, theEmbassy of the USA in Ukraine, internationalorganizations – WIPO and the EuropeanAlliance for Copyright (Budapest, Hungary) – atotal of 209 persons. The focus was on suchimportant issuesas thestrategyofdevelopmentof the state system of protection of intellectualpropertyrights;amendmentstothe legislation inintellectual property field; the use of intellectualpotential for the development of business,industry and enhancing competitiveness of theproductsmanufacturedbydomesticenterprises;

acquisition of protection, use and enforcementof rights for trademarks and servicemarks andother designations; international registration ofintellectual property rights and rising the exportcapacity of Ukrainian enterprises; the problemsof technology transfer in the modern economy;the roleand functionsofcollectivemanagementorganisationsinregulationoftheuseofcopyrightand related rights objects; intellectual propertyspecialisttraining.

On September 16, Scientific and PracticalConference «Problems of Development ofInventiveandRationalizationActivitiesinUkraine»tookplaceontheoccasionoftheDayofInventorandInnovator.ItwasorganisedbySDIPtogetherwiththeNationalTechnicalUniversityofUkraine«Kyiv Polytechnic Institute». The participantsof the event examined the exhibition of thedevelopmentsofthe«KyivPolytechnics»SciencePark and the display of the State PolytechnicMuseum of Ukraine. During the ceremonialmeeting,theinventorswereawardedwithWIPOgoldmedals.

Throughout the year, round tables, councilsand meetings were held regularly. In particular,theroundtableswerededicatedto thefollowingtopics: «Interpreting the notions «misleading»and «able to mislead». Practical application ofthese criteria during examination of applicationsfor trademarks and service marks and legalexpertise», «Essential features of industrialdesigns and analysis of their use in case ofdisputes», «Use of intellectual property rightsfor thedevelopmentof theUkrainianbusiness»,«Discussion of the problems of the activitiesof regional representative offices of collectivemanagement organisations», «Novelties in the

legislationinthefieldofindustrialproperty»,«Enforcement of intellectual propertyrights in case of technology transfer»,«Peculiarities of realisation of copyrightin the areas of architecture, design andvisualart»,«Mattersofpreparationtothestateregistrationofauthor’srightinaworkandregistrationofagreementsconcerningauthor’s rights in a work; jointly with theNational Writers’ Union of Ukraine andtheNationalJournalists’UnionofUkrainethe problematic issues were consideredwith theaim to findsolutions for relevantdirections;fortheareasofuseofcopyrightand related rights objects, the necessityof remuneration was discussed with the

users of these objects (the National League ofUkrainianComposers, theNationalAll-UkrainianMusicUnion, theNationalComposers’UnionofUkraine)etc.Also,anumberofconsultationswereheldconcerningthedevelopmentofmechanismsofrealisationoflegislativeamendmentsregardingcreationand functioningof the informationbaseof names of copies, the list of titles of creativeworksforwhichrequestsforcontrolmarkswerefiled, in order to engage right owners in theprocessofdistributionofcontrolmarks;anumberof problematic issues were discussed with theMinistry of Culture and Tourism of Ukraine, theNational Union of Film-Makers of Ukraine, theNational Union of Theatre Workers of Ukrainein order to improve the activities of collectivemanagement organisations and authorisedcollective management organisations; togetherwiththeStateCommitteeforInformatization,theissueofexpediencyandpossibleutilisationofthefree (open) software in the bodies of executivepower in order to ensure efficient application ofbudgetfundswasdiscussed.

Besides this, a meeting of the SDIP PublicBoard took place on February 23, where thedraftConceptionofthedevelopmentofthestatesystemofprotectionofintellectualpropertyrightsfor2009-2014wasdiscussed.

On February 28 a meeting of the studentsof the Pryazovskyi State Technical Universitywith the SDIP specialists was held, which wasdedicated to the matters of legislation in thearea of legal protection of intellectual property,copyrightandrelatedrightsandtheirregistration.The studentswere interested in such questionsasprotectionofcomputersoftwarebyaseparatelegislativeact;protectionofinnovationproposals;

Within the framework of the Statepurpose-orientedprogrammeofpreparationand conducting of the final part of theEuropean Football Championship 2012in Ukraine, SDIP organised and held atrainingworkshopforthespecialistsoftheDivisionofExaminationofDesignationsandIndustrialDesignsentitled«PeculiaritiesoftheExaminationofApplicationsforTrade-marks and Service Marks and IndustrialDesigns Considering the Requirements of theLawofUkraine«OnOrganizationandConductingoftheFinalTournamentoftheEuropeanFootballChampionship2012inUkraine»

The Programme also foresees organisationandholdingofseminars,conferencesandothereventsonthemattersofacquisitionandenforce-mentofintellectualpropertyrightsofUEFAanditscommercialpartners.In2009,indifferentUkrainiancities–Kyiv,Donetsk,KharkivandLviv–anumberofregionalscientificandpracticalseminarswereheldunderthecommontopic,namely«AcquisitionandEnforcementofIntellectualPropertyRightsoftheUnionofEuropeanFootballAssociationsanditsCommercialPartners».

Thespecialistsofthestatesystemofprotectionof intellectual property rights took active partin nearly 20 seminars, conferences, workingmeetingsandothereventsheldbyotherUkrainianorganisations.

6.3. Creative Activity Stimulation

Inordertopromoteintellectualproperty-relatedknowledgeand to raiseawarenessof the youthin the intellectual property fundamentals, workson translation, editing and publishing of theWIPO series «Learn from the Past, Create theFuture»were continuedwithin the frameworkofinternationalcooperationwithWIPO.Theseriesisintendedfor8–14year-oldchildrenandconsistsoffourworkbooks.Thefirstworkbook–«InventionsandPatents»waspublished in2008. In the firsthalf of the report year the second workbookof this series – «The Arts and Copyright» wastranslated into Ukrainian and edited; its dummy

layoutwascreated,andintheIIIquarterof2009itwaspublishedwiththecirculationof2thousandcopies. According to the signed agreement, 10copiesweresenttoWIPO.700copiesofeachofthetwoworkbooksweresentto112organisationsofUkrainefreeofcharge.

Yearly,SDIPtakespartandprovidesassistanceinholdingtheweekofall-Ukrainianandinternationalscientific and educational projects «Ukraine–Europe–World».OnFebruary10–12,2009,withinthe framework of this event, the all-Ukrainiancontestofyounginnovatorsandinventorsentitled«Nature–Man–Industry–Ecology»wasorganisedbytheMinistryofEducationandScience(MES)togetherwiththeNationalEco-NaturalisticStudentCentreinKyiv.Onthebasisoftheresultsofthiscontest,50pupils,studentsofvocationalschoolsand universities from 15 regions of Ukraine,the Autonomous Republic of Crimea and Kyivwere awarded with SDIP diplomas for creativeachievements in biology, medicine, ecology,chemistry, agricultural research and physics.Amongthose,9personswereawardedwith the«Author»honorarybadges.

In order to evolve gifted youth and set upconditions for creative development and stirringup scientific and research activities in highereducationalinstitutions,adecisionwasmadebytheMESOrder№992of30.10.2008toholdanall-Ukrainian contest of student scientific worksinintellectualproperty.TherighttoholdtheIAll-UkrainiancontestofstudentscientificworkswasgiventothePryazovskyiStateTechnicalUniversity(Mariupol). The announcement of the contestresults took place in March 2009. 31 studentsfrom18educationalinstitutionsfromallregionsof

Ukraineparticipated in thecontest.TheContestcommittee declared the students of the StateInstituteofIntellectualProperty,PryazovskyiStateTechnical University and National MetallurgicalAcademyofUkraine(Dnipropetrovsk)thewinnersof the contest. The contest diplomas were alsoawarded to the students of the University ofEconomics and Law «Krok» (Kyiv), TernopilNationalEconomicUniversity,NationalTechnicalUniversity «Kharkiv Polytechnic Institute» andDonetskStateUniversityofManagement.

Apart from this, an all-Ukrainian studentintellectualpropertycompetitionwasestablishedin the report year, its organisation being theresponsibility of theState Instituteof IntellectualProperty.

Since2000SDIPholdsayearlyAll-UkrainianContest «Invention of the Year». On March18,2009 the results of the Contest «Invention2008» were announced and the winners werenamed. The Contest began on August 1, 2008in all regions of Ukraine and was open forinventors,enterprises,institutions,organisations,researchgroupsirrespectiveoftheirdepartmentalaffiliation,formofownershipandlocation.Atotalof 188 works were submitted for the Contest.The largest proportion of works was presentedin the following nominations: machine buildingand instrument engineering (34), medicine andpharmacology(30),environmentprotection(22).Among the regions the leaders were Kharkivregion (31), Kyiv region together with Kyiv (30)andTranscarpathianregion(22).

Thefirstplaceintheabsolutenomination«BestInventionoftheYear»wasawardedtopatentNo.25600«Front-operatedtunnellingmachineFTM»,thesecond–topatentNo.30840«Rectifierforarcwelding and submerged-arc build-up welding».Thethirdplacewasawardedtothework«Methodof selective insulation of cones of inflow ofmineralisedstratalwatersofcalciumchlorideandmagnesiumchloridetype».Awinnerwaschosenineveryregionalandbranchnomination.

A development entitled «A disposable plasticcupholder»(patent№31798)woninthe«BestYouth Invention» nomination. One of the threeco-authors of the invention is a 13-year-oldschoolboy Vladislav Lebedkin, a student of theSmallAcademyofSciences(SAS)oftheCrimeaandajointownerofeighttitlesofprotection.

ThespecialprizesoftheContestwereawardedto «Inmaisters» limited liability company for thehigh social value and humanistic orientation of

thesetofworkson rehabilitationofpeoplewithdisabilities,andUzhgorodNationalUniversityforitsfruitfulworkwithcreativeyouth.

The SDIP diplomas were awarded to theContestwinnersin34nominations.

The closing of the Contest was, as in thepreviousyears,dedicatedtotheWorldIntellectualPropertyDaycelebrationwhichwasheldonApril24,2009.

OnthebasisoftheContestresults,inthereportyeartheWIPOgoldmedalswereawarded:

• in the nomination «Women Inventors» –to Svitlana Nedelska, Head of the PediatricsDepartmentoftheZaporizhzhiaMedicalUniversity,and Tamila Shumna, assistant lecturer of thesame Department – the winners of «Invention-2008» contest in Zaporizhzhia region for theinvention «Method of prognostication of allergicdiseasesinchildren»(patentNo.83971);

• in the nomination «Best Inventor» – toVladimir Liulko, the author of the inventionand patent owner, the winner of «Invention-2008»contest inSumyregion–for theworkonenvironmentprotection,namely for the invention«Method, device and system of collectingrecyclable materials from population» (patentNo. 84293) for his achievements in improvingthe existing technical means for collection, pre-treatmentandutilisationofrecyclablewasteandimplementationofthenewones.

Foroutstandingachievementsindevelopmentandimplementationofhighlyeffectivetechnologyoftreatingpatientswithinfantilecerebralparalysis,osteochondrosis, consequences of injuriesand organic lesion of the nervous system, the«Outstanding Inventor» award was presentedto the Hero of Ukraine, Honoured worker ofscience and technology of Ukraine, laureate ofstate prizes of Ukraine, Director General of theInternational clinic of rehabilitation treatment,Doctor of Medicine, professor VolodymyrKoziavkin(Truskavets,Lvivregion).

InAugust, the nextContest «Invention of theyear – 2009» was announced. At the WIPOinitiative, 2009 was declared the year of greeninnovations. It is innovationsdesignedtoprotectenvironment and prevent climatic changes thatwillbeapriorityinthisContest.

Mykola Paladii,SDIPChairman,handedtheprizesfromSDIPandtheSASBoard ofGuardians to the contestantswho won in the departments of computer andtechnicalsciences.

OnSeptember24–27theVInternationalSalonofInventionsandNewTechnologies«NewTimewas held in Sevastopol. The co-organisers ofthe Salon were SDIP, the Ukrainian IndustrialPropertyInstituteanditsbranchUkrainianCentrefor Innovatics and Patent Information Services.The leading inventor organisations, companiesand enterprises from 26 countries of the worldparticipated in theV InternationalSalon,namelyfromArgentina,Armenia,Azerbaijan,BosniaandHerzegovina,Canada,Croatia,Estonia, France,Germany, India, Iran, Italy, Japan, Kazakhstan,Kyrgyzstan,Moldova,Poland,Romania,RussianFederation, Serbia, Spain, Ukraine, USA andTurkmenistan. Around 250 developments (50%ofthembeingforeign)presentedontheVSalonwere judged by the international jury headedby professor Pierre Fumier (Belgium) and bythe national jury headed by Anton Karlov, therepresentative ofUkraine in theEuropeanTRIZAssociation. The representatives of SDIP andUkrainian Industrial Property Institute were alsoamongthejury.TheworkinthejuryoftheSalonenabled our specialists to study the inventionsandcutting-edgetechnologiesoftheparticipatingcountries and to appoint the best among them.
