A RESOLUTION I n t r u d i n g the Choctaw Commissioners who meet the Chickasaw Commissioners in Atoka on the 28th inst.

Be it resolved by the General Council of the Choctaw Nation assembled: That the Choctaw National authorities are supreme and sovereign within the limits of the Choctaw Nation; that the Chickasaw National authorities are supreme and sovereign within the limits of the Chickasaw Nation; that neither Nation is limited by the consent or concurrence of the other except as to the sale of any part of their common country; that whatever advancement and development is made in the Choctaw Nation in pursuance of its laws, the Choctaw Nation is entitled to all of its benefits, and no law in reference to ihe fame or contract made in pursuance thereto shall be dependent for its validity upon the s.mction or approval of the Chickasaw National authorities, and vice versa. If the d i sh ing opinion is to be taken ami accepted as a sound exposition of the treaty rights of Choctaw* living in the Chickasaw Nation or district, then it shall also apply to Chickasaws living in the Choctaw Nation. The principles and policy herein enunciated shall govern the Choctaw commissioners in their discussions with the Chickasaw commissioners on the date aforesaid, and this resolution shall take effect and be in force from and after its passage.

To the General Council:

Your Committee on Schools, to whom was referred the report of W . J . B. Lloyd, the superintendent of the Armstrong Academy, would beg leave to report that there are some important vouchers which are not before the committee; also that the said superintendent's report is of such a complicated nature that your committee cannot fully investigate it now, hence offer the following resolution :

A RESOLUTION Providing for the examination of the report of W . J . B. Lloyd, Superintendent of Armstrong Academy for the last scholastic year.

Be it resolved by the General Council of the Choctaw Nation assembled: That the Principal Chief of the Choctaw Nation is hereby authorized to employ one competent accountant, and instruct the district trustee of the Third district to accompany and investigate all vouchers that may be produced by the said superintendent, and make a statement of his standing on account with the Choctaw Nation, for the fiscal year ending July 31, 1886 ; also ascertain theamouut of property and produce that may be on hand, and report fully to the next General Council, and for his services the said acoountant shall be allowed five dollars ($5.00) per day, upon the certificate of the Principal Chief of the Choctaw Nation, and that this resolution shall take effect and be in force from and after its passage.

W H E R E A S , Much annoyance and expense to the Choctaw Na. tion in consequence of the claims of persons claiming to be entitled to the rights of Choctaws in the Choctaw Nation; and

W H E R E VS, The rights of such persons are often so doubtful and remote to the present stock of Choctaw blood that the adjudication becomes under the most favorable circumstances a questionable one, and

W H E R E A S , The Choctaws are and have ever been disposed to accord to people of their blood any right they may have ; they feel bound to adhere to the long and recognized usages of their Nation and t • exclude from those rights all claimants whose blood is so remote and uncertain that the appellation of Indian to such persons would be a misnomer. I t is not now and never was considered obligatory upon the Choctaw Nation to admit into their tribal organization any people that might claim or perchance have in their veins small quantities of Choctaw blood. The policy adopted by ^his Nation for many years previous to the war and treaty of 1866, was to allow all white persons from beyond the limits of the Nation, who married according to existing laws on the subject, the rights <>f citizenship. These rights of citizenship were courtesies extended to the marriage relation, and the rights conceded by the Nation were matters of grace lather than matters of right under any law or treaty stipulation. The rights thus conceded were deemed by the Nation steps in its civilization and the upbuilding of their nationality. Now the necessity for legislation upon this subject has been brought to the attention of the Nation by the large number of persons pressing their claims for citizenship upon the General Council at its yeaily sessions. These claimants claim rights upon every conceivable ground imaginable. The admission of these claimants, actuated largely by fhe inducement held out to them by what they may be entitled to when admitted, (the amount thus acquired by admission in round numbers being twenty-five hundred dollars,) is so great that it becomes the duty of the Nation to prescribe by legislation some preserving principle, by declaring that the applicant should have in his veins Choctaw blood to the extent of at least one-eighth Choctaw. And it should further be understood and declared that the rights thus conceded to persons from the outside to the inside, with the riuhts a«ked for or claimed, are matters of grace on the part of the N'ation rather than rights demandable of the Choctaw Nation and enforceable by the government of the United State*. In \ icw of the premises, it is therefore asked that the following bill be enacted by the General Council now in session, to-wit:

AN ACT entitled an act defiuing the quantity of blood necessary for citizenship.

SECTION 1. Be it enacted by the General Council of the Choctaw Nation assembled : That hereafter all persons non-citizens of the Choctaw Nation, making or presenting to the General Council petitions for rights of a Choctaw in the Nation, shall be required to have one-eighth Choctaw blood, and shall be required to prove ihe same by competent testimony.

SEC. 2. Be it further enacted, that all applicants for lights in this Nation shall prove their mixture of blood to be of white and Indian.

SEC. 3. Be it further enacted, that no person convicted of any felony or high crime shall be admitted to rights of citizenship within this Nation.

SEC. 4. Be it further enacted, that this act shall not be construed to affect persons within the limits of the Choctaw Nation now enjoying the right of citizenship.

SEC. 5. Be it further enacted, that this act bike effect and be in force from and after its passage.

BILL NO. 70.

Your Committee on Schools, to whom was referred the report of W. B. Robe, Superintendent of Wheelock Seminary, have examined it carefully, and inform you that since he made his report to the General Council he has received $1,445 from the National Treasurer for the last scholastic year of 1885 and 1886, appropriation of last Council in full of $5,500. He also received from boarding the mail rider and teacher the sum of $66.15, making a total of $5,566.15. Your committee also find that he has omitted to report $669.84, the balance on hand as per report of 1884 and 1885, which makes a total of $6,235.99. The expenditures on his report show the sum of $6,597.29. Your committee find that the Wheelock Seminary is indebted to the amount of £361.30, and your committee would respectfully ask that the following resolution be adopted :

Be it resolved by the General Council of the Choctaw Nation assembled : That the sum of $361.30 be appropriated to cover the

indebtedness of Wheelock Seminary, and the National Auditor is hereby authorized to issue a warrant to W . B. Robe, Superintendent of Wheelock Seminary, and the National Treasurer shall pay the same, and that the report of W. B. Robe be accepted as true and correct, and this resolution take effect and be in force from and after its passage.

The joint commission composed of commissioners from the Choctaw and Chickasaw Nations, viz.: C. E. Nelson, A. R. Durant and J . S. Standley, Choctaws, and Josiah Brown, C. A. Burris» Itotubby and William Hawkins, Chickasaws, having been convened at Atoka, Choctaw Nation, on the 28th day of October, 1886, to try aud agree upon a plan for the sett'ement of the differences between said Nations, would most respectfully submit the following and recommend its adoption by their respective National authorities:

First—The Choctaw National authorities shall be supreme and sovereign within the limits of the Choctaw Nation.

Second. The Chckasaw National authorities shall be supreme and sovereign within the limits of the Chickasaw Nation.

Third. Neither Nation shall be limited in its powers of legislation or other authority, in its own limits, by the consent or concurrence of the other, except as to a sale of all or any part of their common country, it being understood that the tenure of their lands remains as before.

lourth. Whatever advancement and development of the natural resources is or may be made in the Choctaw Nation in pursuance of its laws, the Choctaw Nation shall be entitled to all of its benefits; and no law in reference to the same, or contract made in pursuance thereto, shall be dependent for its" validity upon the sanction or approval of tbe Chickasaw National authorities, and vice versa.

Fifth. The Choctaw Nation appreciates the delicate and embarrassing position of the Chickasaw Nation with reserence to its freedmen, and in obedience to the desire of the Chickasaw Nation wonld assist in every honorable means of relief not involving the expenditure of Choctaw funds.

Sixth. It being earnestly contended by the Chieksaws that the opinion of the Hon. Caleb Cushing, attorney of the United States» in reference to Choctaws resident in the Chickasaw Nation, be held to be a final settlement of that question, it is accepted by the Choctaws, with this condition: That if Chickasaws resident in the Choctaw Nation continue to enjoy all rights, political and otherwise, of Choctaw citizens, it shall be regarded as a matter of sufferance of the Choctaw Nation, and not as of treaty right, and a subject of which and over which the Choctaw Nation shall have complete jurisdiction.

The joint commission also recommend that both Nations take such steps as may be necessary to have the above plan of settlement approved by the proper authorities of the United States government.
