A BNHS REVIEW OF THE AVIFAUNAL LIST OF THEWILDLIFE (PROTECTION) ACT, 1972

India has a centuries’ long tradition in theconservation of nature. Many animals and plants aresacred to Indians, and many other species are unharmedor afforded protection due to various other reasons. Thebirth and spread of Buddhism and Jainism in India furtherstrengthened the Indian compassion for all forms of life.The earliest codified law to protect nature can be tracedto the third century BC, when Emperor Ashoka enacted alaw towards the preservation of wildlife and theenvironment. He declared that forests must not be burnt,and listed a wide variety of animals that were not to bekilled, which interestingly included bats, queen ants andboneless fish (quoted by Raj Panjwani in The Wildlife(Protection) Act, 1972 – 4th Edn). Thus, it may be said thatthe ethics and ethos of conservation was inherent inIndian culture.

In modern India, the protection of wildlife throughenactment started in 1873 through the Madras Act toprevent the indiscriminate destruction of wild elephantsduring British rule. This was followed by the promulgationof the Wild Birds Protection Act in 1887, primarily intendedto put a check on the hunting of game birds during thebreeding season in specified areas of the former BritishIndia. Subsequent to this came the Wild Birds and Animals(Protection) Act, 1912, to extend the scope of theprotection to other wildlife (besides birds) and madeapplicable throughout British India.

In the post Independence scenario, the landmark innature conservation was the enactment of The IndianWildlife (Protection) Act by the Government of India in1972. This was the first comprehensive legislation forcontrol and management of wildlife including their habitats.The framework of this Act, termed as the Wildlife(Protection) Act, 1972 [WL (P) A] was adopted from theBombay Wild Birds and Animals (Protection) Act of 1950,framed by the late ornithologist Humayun Abdulali of theBombay Natural History Society. The WPA was firstbrought out as a book in 1990, and this was followed bythe second, third and fourth editions in 1992, 1994 and1997 respectively, with amendments to the Act. In an effortto promote its effective implementation, the Act is broughtout as a priced publication and is available with manyoffices and libraries.

The WPA, 1972 is very comprehensive in its scope,and provides clear-cut definitions and guidelinesregarding various aspects of the Act, such as listing theresponsibilities and duties of those implementing the Act;procedures to be followed in the appointment of wildlifeofficers and creation of the various types of protectedareas; rules regarding the issue of firearm licenses; mattersregarding the trade in wildlife; and punishments to bemeted out under the Act.

Regarding the flora and fauna listed in the Act,these are grouped into six categories, termed Schedulesof the Act. Various animals are grouped under SchedulesI to V, and Schedule VI, which lists endangered plants.Schedule V species are classed as vermin, and can bekilled if declared so, and among birds, only the HouseCrow Corvus splendens finds a place in this Schedule(Table 3). With regard to the other bird species listedunder the Act, they have been grouped under Schedule Iand Schedule IV (Table 1 & 2).

However, there are certain lacunae or deficiencieswhich require clarification or rectification. Some of theseare:1) Does the system of giving the group name (e.g.

avocet and stilts) followed by family name (e.g.,Recurvirostridae) suggest that only these groupsof the family come under the Schedule? Does itmean for example that, the Ibisbill (which also comesunder the same family) does not come under thesame family) Schedule? Similar is the case of familyRallidae (which include coots and rails), withoutlisting the crakes and moorhens. If the mention ofthe family name is actually intended to mean allspecies under it, then only the family name onlyneed be given, otherwise, all the groups of a familymust find a place in the list. For the same reasonsone wonders whether warblers, wagtails, cuckoo-shrikes, flycatcher-shrikes and woodshrikes figurein the Schedule?

2) Shrikes (Lanidae), Swifts (Apodidae) and Bee-eaters(Meropidae) do not find a place in the lists. Doesthis mean that the species can be killed? Similarly,as per the list, only the Brown-headed Gull Larusbrunnicephalus comes under the Schedule. Does

this mean that the other gulls are not protected?3) Why is the Comb duck Sarkidiornis melanotos

placed separately, and not under its family Anatidae,which is also in the list.To fill up these gaps we have given the list ofprotected bird species that actually come under thelisted families.

4) Does the Blue Rock Pigeon Columba livia deservea place in the Act as wild, semi-wild and ‘domestic’populations of the species are present throughoutthe country?.

5) The scientific names of many species haveundergone change, and these changes need to beincorporated in the future reviews of the Act. Forexample, the scientific name of the Great IndianBustard Choriotis nigriceps is now Ardeotisnigriceps.

6) Recent taxonomic changes (e.g. Ciconia ciconiaboyciana is now treated as a distinct speciesOriental White stork C. boyciana) are also to beincluded in the future amendments.

7) The status of many species has changed in therecent past based on BirdLife International’s criteria.These changes are to be included in the Actaccordingly, eg. the Spot-billed Pelican Pelecanusphilippensis, currently placed under Schedule IV

of the Act, deserves Schedule I status.The ambiguities and drawbacks have made itpossible for poachers or wildlife traders to escape,or to get off with lighter sentences. Due to thesereasons, we bring out this issue of Buceros in aneffort to update and fill in the existing lacunae inthe avifaunal list of the Wildlife (Protection) Act,1972. Some of the changes are:

1. We give the complete list of species of groups offamilies that are mentioned in the Act.

2. We have added the ‘missing’ groups (and thespecies under them) for families listed in the Act.

3. We have also added a list of families (and speciesunder them) that are not listed in the Act (AppendixI).

4. We have included the list of bird species that havebeen identified by the BirdLife International asthreatened, endangered, critically endangered,vulnerable and near threatened, so that, whilereviewing the Act, more attention will be given bythe authorities to include them under the respectiveSchedules of the Act.

5. We have given the local trade names for birdsinvolved in the bird trade. This will be a boost forenforcement authorities, as the trade names tendto differ from the English or local names.

Please note that ours is not a legal document and certainly not a substitute to the Wildlife (Protection) Act, 1972.

The avifaunal list under Schedule IV, Part III of the Act lists ‘bird groups’ (e.g., Geese) and the familiesunder them (e.g., Anatidae), without listing of individual species.
