SECTION I. GENERAL PROVISIONS

1.1. The Autonomous Nonprofit Institution of higher vocational training «Belgorod University of Cooperation, Economics and Law» hereinafter referred to as «the University») is a non-membership nonprofit training educational institution established in accordance with the Russian Federation legislation in order to provide educational and other services stipulated in the present By-Laws.

The University has the Federal Supervision Service license for implementing educational and scientific activities due to different training programs of professional education, different specialties, additional training programs; it provides services in professional training as well as training and retraining and/or further training of highly-qualified employees, scientific and educational-research staff; implements fundamental and applied researches in different scientific fields; acts as a leading and methodical centre in the field of its activities; it is accredited as a higher educational establishment – the University – and awards public standard documents with the official national symbols of the Russian Federation.

1.2. The University is a broad based (absolute) assignee of the higher vocational training institution «Belgorod University of Consumer Cooperatives» created as Belgorod Cooperative Institute on the ground of Ministers of the USSR Decree of the August 21, 1980, № 714 «On Foundation of the Institute of Consumer Cooperatives in Belgorod» on the basis of the Belgorod branch of Poltava Institute of Consumer Cooperatives, opened in June 20, 1978.

The institution of higher vocational training «Belgorod University of Consumer Cooperatives» had the following names:

– the Belgorod Institute of Consumer Cooperatives; – the Belgorod Commercial Academy of Consumer Cooperatives; – the Belgorod University of Consumer Cooperatives; – the higher vocational training educational institution of Centrosoyuz of

the Russian Federation «Belgorod University of Consumer Cooperatives».

1.3. The complete official naming of the University is: the Autonomous Nonprofit Institution of Higher Vocational Education «Belgorod University of Cooperation, Economics and Law».

The abbreviated official names are: – АНО ВПО «Белгородский университет кооперации, экономики и права» (ANN HPE «Belgorod University of Cooperation, Economics and Law».

– «Белгородский университет кооперации, экономики и права» («Belgorod University of Cooperation, Economics and Law»)

– БУКЭП (BUCEL). The title in English is – Belgorod University of Cooperation, Economics and

Law.

After registration the complete and the abbreviated official names, the emblem, the trade mark placed on the blank forms and documents are preserved against the legislation of the Russian Federation.

1.4. The University location address is: 308023, Belgorod, Sadovaya street, 116а.

1.5. The University is a legal body with a legal form «Autonomous Nonprofit Institution»; it has separate property which can be used for incurring liabilities, it has the right to acquire and execute property and personal non-property rights on its own behalf; to bear responsibilities; to act as a plaintiff or a defendant in court.

The Founders are not liable for the University obligations and the University

is not liable for the Founders obligations. In accordance with the Russian Federation legislation the University has

settlement and other accounts in credit organizations, an independent balance, a seal with the State Emblem of the Russian Federation printing and the full University name in the Russian language; other seals, stamps and blank forms with the essential elements.

1.6. Founders of the University: 1.6.1. The Belgorod regional union of consumer societies 1.6.2. The consumer society "Sodruzhestvo". 1.6.3. Inter-regional co-operative union "Nauka". 1.7. The right of the University to carry out financial and economical

activity, stipulated in the Bylaws, originates from the moment of the public registration of the University.

1.8. The University bares educational activities according to the license permitting training activity.

1.9. The university awards public standard deeds stating the appropriate educational level and (or) qualification on the basis of public accreditation certificate.

1.10. In its activity the University follows the Constitution of the Russian Federation, the Civil Code of the Russian Federation, the Federal acts on education in the Russian Federation, other statutory legal acts of the Russian Federation, laws and other statutory legal acts of the Russian Federation actors and municipal legal acts, the present Bylaws.

1.11. The university forms its structure independently in accordance with

the legislation of the Russian Federation. Structural University subdivision is not a legal body.

Legal status and functions of structural University subdivision are determined by the present Bylaw and local acts of the University. The University structure consists of chairs, departments and otherк structural subdivisions. As a part of the University structure the following structural subdivisions can be created: branches, representative offices, institutes, research institutes, centers, postgraduate courses; doctoral candidacy; construction departments;

structural subdivisions of extra vocational training; and other structures executing educational, scientific or research and development activity within the frames of authorized activity; structural subdivisions of educational, methodical, extracurricular, industrial, sport and social infrastructure facilities: libraries, hostels, printing works, editorial and publication department, hotels, hospital and clinical, advertising, publishing, public catering, transport, maintenance, administrative and other structural subdivisions facilitating the University activity.

1.11.2. The standalone structural subdivisions located away from the University, are its branches or agencies, implementing their activity according to the rules approved by the Rector of the University. The university is entitled to have branches and agencies both in the Russian Federation and abroad.

The University branches and agencies are founded, renamed and eliminated in accordance with the legislation of the Russian Federation.

1.11.3. The University branch executes on its own behalf all the functions of the University or just their part, including representative functions. Per power of attorney delegated by the Rector of the University to the chief of the branch, in accordance with the legislation of the Russian Federation, the latter has the right to represent the University in relations with regulatory bodies, institutions of local government, public associations, with personal and legal bodies and also to commit bargains in the scope of authorities specified in the power of attorney.

1.11.4. The agency represents and protects University interest, but does not execute educational activity on its own behalf.

Per power of attorney delegated by the Rector of the University to the chief of the agency, in accordance with the legislation of the Russian Federation, the latter has the right to represent the University in relations with regulatory bodies, institutions of local government, public associations, with personal and legal bodies and also to commit bargains in the scope of authorities specified in the power of attorney.

1.11.5. The list of branches of the University is fixed in the appendix to the present Bylaws and appears to be its integral part.

1.12. To achieve the purposes stipulated in the present Bylaws the University has the right to create other organizations and join associations (unions) on the voluntary basis in accordance with the legislation of the Russian Federation; these structures can have the rights of the legal entities and act in accordance with their bylaws or not being legal entities they can act in accordance with the treaties on mutual actions.

1.13. Trade-union and other public associations, the activity of which is regulated both by their Rules (provisions) and the legislation of the Russian Federation can be created and function in the University.

1.14. Creation and activity of political parties, political and religious movements and the organizations (unions) in the University are not admitted.

1.15. The university is autonomous and bears responsibility for its activity to every student, society and the state.

The university has the right: - to carry out educational, scientific, financial, economical and other

activities in accordance with the legislation of the Russian Federation and the present Bylaws;

- to provide material and technical supplies for educational process and classroom equipment;

- to attract additional monetary and tangible asset, including banking loans for implementation statutory activities; - to carry out employment, selection and placement of the personnel, including the faculty;

- to use and master educational methods and technologies, including the distant ones;

- to define the university managing structure, manning table in accordance with the demands and financial situation; to define the number of employees in structural subdivisions; to distribute staff functions;

- to define method, system, conditions and procedure of work payment, including the amount of post salaries, the amount of surcharges, extra charges, premiums and other kinds of material stimulation, and also the amount of employees’ remuneration (fees) (without stating limiting amounts of official salaries (fees);

- to work out and adopt the university Bylaws, to provide it for approval; to work out inside order regulations and other local acts which define the university activity;

- to form student body, i.e. to enroll, to expel, to transfer in accordance with the legislation of the Russian Federation;

- to choose estimation criteria, forms, orders and periodicity of students’ personnel appraisal, to execute final state personnel appraisal of the students, to carry out State Final Certification;

- to define the content of the educational process of each specialty, terms of study of educational programs in accordance with the educational legislation of the Russian Federation, proper federal educational standards or federal state requirements;

- to work out and approve educational programs, curriculums, subjects (modules), time-tables;

-to promote system of inner monitoring of the education quality in the university;

- to conclude contracts on providing educational services, to make bargains and settle other questions which do not contradict legislation of the Russian Federation and the present contract;

- to define the amount of payment for all kinds of educational services, including the ones provided in frames of federal educational standards or federal state requirements, as well as for other kinds of work and services, performed by the University in accordance with the present Bylaws,

- to define the procedure of monetary and other means distribution , including the share of work payment and other incentives of the University staff;

- to dispose of the University property, to rent it to other legal persons and individuals on the contract basis; to use on the contract basis property, which belongs to other legal persons and individuals.

- to provide heads of stand-alone structural divisions the power of attorney to realize fully or partially authority of the legal body, including the right to have accounts in banks and other credit organizations;

- to participate in the international cooperation and foreign economic activity in accordance with the legislation of the Russian Federation and the present Bylaws;

- to create and take part in the activity of other institutions in accordance with the legislation of the Russian Federation and the present Bylaws;

- to address to any organizations of the Russian Federation and international institutions including public unions for getting public estimation of the University;

- to create and monitor the official university site in the Internet; -to implement other activity in accordance with the legislation of the

Russian Federation.

SECTION II

SUBJECT, PURPOSES AND TASKS OF THE UNIVERSITY ACTIVITY

2.1. Subject of the University activity is actions in

the sphere of education and science, as well as activity oriented to the implementation of the University purposes and objectives. It includes:

2.1.1. implementation of elementary, comprehensive, higher, post-graduate and extended vocational training educational programs on a wide range of specialties (trades);

2.1.2. providing vocational training; 2.1.3. providing pre-higher education, rendering of diverse services in the

sphere of education (additional educational services), not specified in the main educational programs and the federal state educational standards, including instruction on additional educational programs, special courses and subjects, advanced study of subjects in the University etc.

2.1.4. execution of fundamental and applied research activities and scientific developments in the field of engineering, natural, public, humanitarian and diverse sciences, other technological, design projects;

2.1.5. carrying out of international and foreign economic activity connected with implementation of educational process and scientific activity of the University;

2.1.6. implementation of educational, industrial, financial, economic, advertising and other activities, not forbidden by the legislation of the Russian Federation Including:

- disposal of goods, work and the services, including products , produced by the University structural subdivisions;

- provide the University students, as far as possible, with residence, meals, and health services, organizes cultural and sport events;

- provide dental and other medical services for the employees and University students (medical practice, dental practice and other medical services);

- leasing or uncompensated use of the University premises; - rendering services in providing the University premises for temporal

dwelling as well as hostel services; - rendering services in public catering, household and social life; - activity in the field of recreation and entertaining services, as well as

other services in the field of culture and sport; - activity connected with computing machinery and information technologies usage; - render telecommunication services; maintenance of technical services and the University Internet network; implementation of packages for applied educational, scientific and technical purposes by investing profit gained, from commercial and other activity; - render services in textbooks, monographs and other educational and scientific literature examination; - activity in the field of law, accounting and audit, providing consultations concerning commercial activity and business management, various kinds of business objects monitoring; - render services in carrying out mediation procedures; - rendering intermediary, consulting, engineering, information, marketing services in the established field of activity; - carry out publishing and printing activities, including the ones, connected with the University magazines and newspapers edition; render multiple copying services; - share in capital from other organization activity; - acquisition of actions, bonds, other securities and getting income (dividends, percent) on them; - carry out capital and operating repairs of buildings and constructions, which are used by the University; construction of new building; - carry out technical testing, researches and certification;

- creation, acquisition and disposal of the title to intellectual activity and individualization results; - carry out other work and render other services for archiving the authorized purposes and objectives of the University; ensure educational process, scientific, educational and other University activity;

2.2. Main objectives and problems of the University are: - satisfaction of a person’s requirements in the intellectual, cultural and

moral development by means of reception elementary, comprehensive, higher, post-graduate and extended vocational training on the basis of indissoluble unity of educational process and scientific researches;

- satisfaction of the society requirements in the qualified specialists with elementary, comprehensive, higher, post-graduate and extended vocational training, which combine deep professional knowledge with the high level of culture and civil activity, by means of realisation elementary, comprehensive, higher, post-graduate and extended vocational training educational programs.

- development of sciences and arts by means of scientific investigations and creativity of research and educational personnel and students; implementation of the received results in the educational process;

- vocational training, retraining and improvement of professional skills of employees with higher / secondary education and research / educational personnel of higher qualification;

- formation of the University students’ citizenship, ability to work and live in the modern democratic environment;

- preservation and augmentation of moral, cultural and scientific society values, spread of knowledge among the population and rise of its educational and cultural level;

- promotion to social relations harmonization and partner relationship development; formation of business ethics;

- strengthening and promotion of cooperative ideas, its democratic principles and values; rendering assistance to consumer societies and their unions, other co-operative organizations in professional training, working out and implementation in practice of new forms and methods of work oriented to increase of efficiency of social and economic activity, perfection of management structure, satisfaction of material and other requirements of shareholders;

- rendering assistance to development, expansion and improvement of co-operative movement, co-operative science and education, participation in actions under the schemes of organizations, which activity is directed to the development of co-operative movement, co-operative science and education.

- the University educational problems, steaming from the Humanistic character of education and universal moral values priority, are realized in mutual educational, scientific, industrial, public and other activities of the Faculty and students.

ENROLMENT OF STUDENTS

3.1. Annually the University independently develops and approves enrolment university and branches regulations which do not contradict the legislation of the Russian Federation, the enrollment procedure set by the authorized federal body in the sphere of education and the University Founders, stated in the present Bylaws.

3.2. The University declares enrolment for training under the educational programs where there is the educational activity licence. The university acquaints the entrant with the specified licence, and with the certificate on the state accreditation concerning each field of training, granting the right to deliver document of the state sample, with the present Bylaws and other documents regulating the organisation of educational process at the University.

3.3. The number of citizens admitted to the first course and post-graduate courses, and the reception structure are defined by the estimated figures annually established by the University Academic Council.

The university has the right to enroll first-year students, as well as second and advanced students in accordance with the Russian Federation legislation and local University legislation.

The university has the right to carry out extra enrolment over the established estimated figures provided that the total of the students trained at the University, should not exceed the number of the student population limit defined by the license for implementation of educational activity.

The university is entitled to provide goal-oriented places for students enrollment in accordance with the Russian Federation legislation and local University legislation.

3.4. In the frame of the estimated figures the University can allocate places for a target enrolment of citizens on the basis of the results of the Unified State Examination and/or by the results of the entrance testing, exercised by the University in accordance with the enrolment regulations of the university.

The procedure of students enrolment should guarantee observance of applicants rights to education and enroll the most capable citizens prepared for mastering of educational programs of the corresponding level.

3.5. Terms and procedure of acceptance of enrollees documents are established by the University admission regulations.

3.6. The University admission examinations are set in Russian. 3.7. The enrolment in the University is exercised by the Admission

Committee. The body, obligation, authorities of the Admission Committee are defined by the Statement, approved by the University Rector.

The Executive Secretary, who is appointed by the Rector of the University, arranges operation of the Admission Committee and office-work, personal reception of entrants and their parents (legitimate representatives).

3.8. For carrying out of entrance examinations and enrolment in the University, there formed selection, subject examination, attestation, appeal and

other commissions, which procedure of creation, structure, powers and activities are regulated by local acts approved by the University Rector.

3.9. University enrolment procedure in affiliates is carried out in accordance with the legislation of the Russian Federation in the field of education, the present Bylaws and other local certificates of the University.

3.10. Postgraduate courses of the University enroll persons possessing higher vocational education, proved by the diploma of a specialist or diploma of a bachelor in the order, determined by the legislation on education in the Russian Federation and local act of the University.

3.11. Doctorate courses of the University enroll persons possessing scientific degree of a candidate of science in the order, determined by the legislation on education in the Russian Federation and local act of the University.

3.12. Enrolment of foreign citizens and persons without citizenship to the University is carried out in accordance with the legislation of the Russian Federation in the field of education and local acts of the University

3.13. Each University student possesses a personal file in accordance with the legislation of the Russian Federation in the field of education and local acts of the University.

SECTION IV

EDUCATIONAL UNIVERSITY ACTIVITIES

4.1. Training at the University is conducted in the Russian language. 4.2. The contents of education for definite levels and/or specializations is

determined according to an educational program (educational programs), which is developed, adopted and implemented by the University independently on the basis of the respective Federal State Educational Standard and sample core educational programs.

In accordance with the license the University implements major educational programs in the field of elementary, secondary, higher (Bachelor degree programs, specialist training programs and Master degree programs) professional education and post-graduate education.

The University is authorized to implement vocational training programs and to provide additional vocational training and supplementary educational services beyond the educational programs which determine its status.

4.3. The educational programs for elementary vocational education, secondary and higher professional education provide the implementation of the Federal State Educational Standards, satisfy students’ educational needs and requirements and include the educational curriculum, work programs of training courses, subjects, disciplines (modules) and other materials ensuring quality of students training, as well as programs on learning and practice classes, academics schedules and teaching aids ensuring the implementation of the appropriate educational technology.

The federal government requirements are applied to the contents of postgraduate professional education (except doctoral programs).

Supplementary educational program include work programs of training courses, subjects, disciplines (modules).

4.4. Under the legislation of the Russian Federation students can choose educational programs of full-time, part-time and extra-mural (evening) and external courses according to their needs and capabilities.

It is allowed to combine various forms of getting education, as well as to combine studies and work under an employment contract.

4.5. The contents of the teaching/learning process and terms of studying educational programs for elementary, secondary, higher professional education, post-graduate education, supplementary vocational training are determined by the University in accordance to the Federal state educational standards or federal government requirements.

4.6. In accordance with the legislation of the Russian Federation, Federal state educational standards or federal government requirements, terms of training at the University can be changed (increased or decreased) by the decision of the University Academic Council.

Undergraduates who have secondary professional education according to appropriate specialization, and those possessing certain educational levels or capabilities sufficient for getting higher vocational training on reduced or accelerated bachelor programs under the decision of the University Academic Council, are enrolled in these courses. Getting higher professional education on reduced specialists or master programs is not provided.

The academics are organized in accordance to educational programs for each form of education and a time-table approved by the Rector of the University.

A module-rating student’s knowledge appraisal system can be applied in accordance to the Federal state educational standards or federal government requirements.

4.8. For the University students enrolled in full-time and extra-mural (evening) courses the academic year begins on September 1st, if there are no other terms stipulated by the curriculum, and finishes according to the curriculum of a certain faculty (speciality).

The University Academic Council has the right to postpone the beginning of the academic year, but not more than for 2 months.

4.9. The total duration of academic year vacations for students of full-time and extra-mural (evening) courses is established in accordance to the legislation of the Russian Federation in the field of education.

9.10. The University academic studies are organized in the form of lectures, seminars, practical classes, laboratory works, tests, colloquia, self-directed learning, consultations, scientific and research work, work experience, coursework (term paper). The university is entitled to establish other kinds of studies.

The form of academic studies for external course students is determined by their individual curricular.

9.11. Duration of a class for all kinds of class hours is forty-five minutes. 9.12. Work, field, pregraduation and other kinds of practice which are

stipulated by the Federal State Educational Standards are implemented under the agreements between the University and organizations, according to which the mentioned organizations, regardless of their organizational and legal form, provide the University student a possibility to do work experience.

The students, who have employment agreements with certain enterprises, do work experience and take pregraduation internship in the mentioned organizations, as a rule.

4.13. By means of functional context of the educational process, selection of forms, methods and educative means, usage of distance learning the University creates necessary educational conditions for mastering the vocational educational programs of a certain level and specialization. Usage and carrying out of inhuman, life-threatening and dangerous to health educational methods is forbidden.

4.14. The University students have the right to master both majors on the selected fields of training (specialties) and any other subjects, which are taught in the University on the basis of providing additional reimbursable educational services, under the supplementary contract.

4.15. The University estimates quality of educational programs mastering by means of progress study monitoring, students intermediate estimation, Final State Certification of graduates, and various forms of academic progress monitoring in accordance to the legislation of the Russian Federation in the field of education and local University acts.

4.16. The following rating system is applied in the educational process: "excellent”, “good", “satisfactorily”, "unsatisfactorily", "pass», "not pass".

The marks "unsatisfactorily" and "not pass" are not filled into the student’s credit book.

The student’s knowledge appraisal by numerous points system as well as a module-rating student’s knowledge appraisal system can be applied under the decision of the University Academic Council.

4.17. Ongoing progress monitoring and intermediate estimations are held each term. In case a University student has valid reasons, pre-term intermediate estimation is permitted by the Rector (Vice-chancellors) and the Dean of the Faculty.

The Legislation the Russian Federation in the field of education and local acts of the University appoint such forms of intermediate estimation as credits, examinations, course project (term paper) defense, and (or) others.

The credits which the University students get taking part in the programs of bilateral and multilateral exchange (in other educational institutions, as well as foreign educational institutions) are recognized according to the procedure determined by the University Academic Council.

The regulations on ongoing progress monitoring and intermediate estimations are approved by the University Academic Council.

4.18. The transfer of advanced students from one course to another is exercised in accordance to the legislation of the Russian Federation in the field of education and local acts of the University.

4.19. In accordance to the legislation of the Russian Federation in the field of education, the present By-laws and local acts of the University, the State Final Certification of the University graduate is obligatory and is implemented after mastering the educational program in full force and effect.

The Requirements for the State Final Certification (final qualifying papers, state exams, thesis) are determined by the Federal state educational standards and (or) the federal government requirements.

The final certification on accredited educational programs, implemented in the University, is exercised by the State Certification Commission

The final certification on non-accredited educational programs, implemented in the University, is exercised by the final certification commission

The University graduates are considered to complete their course of instruction under the University Rector’s order of their dismissal.

4.20. The persons graduating from the University and having passed the Final State Certification are awarded state standard diploma with the proper educational level and (or) qualification, certified by an official seal of the University.

The persons having passed the Final Certification on the non-accredited educational programs are awarded diploma with the proper educational level and (or) qualification, which form is determined by the University itself. An official seal of the University certifies the documents mentioned above.

The persons who neither finished apprenticeship of the proper level nor passed the State Final Certification or who received unsatisfactory marks at the State Final Certification are given a special reference stating the fact of studying at the University.

The learners having taken pre-higher education courses are awarded the certificate.

The persons, having taken the post graduate course and defended his/her qualifying work (thesis, all the scientific researches accumulated) are ranked the scientific degree and the proper document is given.

4.21. The University graduate or the student who left the University before the appointed time, is given a certificate of the educational level, which had served as a reason for his/her enrolment in the University and was kept in his/her personnel file. All other documents (statements from the orders of the University enrolment, University graduation or University study termination, student record book, student identification card etc.) are left in the student’s personnel file.

4.22. The transfer and reintegration of students for education continuation can be accompanied by transferring from one basic educational program to another and is executed in accordance with the procedure and terms foreseen by local acts of the University.

4.23. All the University educational services, including the ones provided in the frame of Federal State Educational Standards and Federal State Requirements

are provided on the basis of complete recovery of educational expenditures under the written contract with legal and (or) personal bodies conclusion or at the expense of proper working balances means of the Russian Federation budgetary system.

The University takes decisions on concluding the enumerated agreements independently, defining the parties’ obligations, which do not contradict the legislation of the Russian Federation and the present Bylaws.

SECTION V

SCIENTIFIC UNIVERSITY ACTIVITY

5.1. The main objectives of the University in the field of scientific activity consist in execution of fundamental and applied research activities; implementing of technological activity, including education problems; usage of the latest scientific achievements and technologies for training students and post-graduate students; developing creative activity of the faculty and students; training of scientific and pedagogical staff of high qualification.

5.2. Scientific activity of the University is based on the following principles: 5.2.1. preserving and developing of the University scientific schools; 5.2.2. supply of natural connection between research activity and

teaching/learning process; 5.2.3. Support and encouragement of fundamental and applied researches

on priority development trends of science in the field of engineering, natural, public, humanitarian and other researches;

5.2.4. creation and execution of scientific programs in the fields, ensuring acceleration of social and economic country development, in conjunction with other high schools and scientific institutions;

5.2.5. contributing to international scientific cooperation development; 5.3. While implementing scientific activity the University has the right: 5.3.1. to carry out fundamental and applied research activities, and

experimental investigations in the field of engineering, natural, social, humanitarian and other sciences under:

- the order of the Board of Founders, and orders made by public authorities and local government concerning R&D products development;

- the order of the of legal bodies, including co-operative organizations, and physical bodies on the basis of civil-law agreements;

- the results of grant competitions of various levels; - the scientific and technological programmes of different levels (federal,

regional, district etc) including innovative ones; - the participation in various funds of science support (international and

Russian, including governmental and public);

- the chairs initiative research area, in payment on the basic teachers salaries according to the plan of the research work;

5.3.2. to form temporary creative groups (consisting of members of permanent staff, students, post-graduate students etc.), including specialists from other high schools on the basis of civil-law agreements. To enlist the services of other organizations in the status of associate contractors where applicable;

5.3.3. to organize various competitions of scientific researches of the teaching staff, Ph.D. candidates, post-graduate students and students;

5.3.4. to organize and held scientific congresses, workshops, conferences, seminars, etc.;

5.3.5. to render technological, scientific, informational, patent and licensing and other services;

5.3.6. to organize and a carry out practical work on trials and certification of food stuffs and food staples of the home production and the goods imported from abroad;

5.3.7. to participate in work of councils, expert councils, dissertation and other councils created outside the University;

5.3.8. to ensure integration of scientific and educational activities; 5.3.9. to render appropriate scientific and methodological assistance to

federal enforcement authorities, government power bodies of the Russian Federation constituents, local self-management bodies, structures of all patterns of ownership for practical application of the University research outcomes and developments;

5.3.10. to issue research studies and scholarly works, scientific journals, scientific conference papers, study materials, methodical literature, etc.

5.3.11. to maintain and develop its own research, information-computer, material and technical base.

5.4. Scientific activity in the University is carried out in all chairs, scientific subdivisions, laboratories and other structural subdivisions, created in the University in order to fulfill all specific targets.

Teaching staff, Ph.D. candidates, post-graduate students and students of the University and proper specialists of other institutions are attracted for execution of research work in the University.

During the education process all the University students master methods of implementing research work. The students showing capabilities and concern in the field of scientific work, can be involved in research work of the University structural subdivisions in their extracurricular time.

5.5. To promote and contribute to the University scientific work development there can be formed:

- additional structural subdivisions for creation and promotion of research activities, technological information, standardization and metrology, intellectual property securiry etc;

- dissertation councils on doctoral and master's theses defence, approved by Higher Attestation Commission of the Russian Federation;

- technological, scientific and methodical council; - editorial boards of scientific journals; - councils on expertise of scientific publications, expert council and others. 5.6. Financing of the University research activity can

be realized from the following sources: - various levels of budget (federal, regional, local) by the orders of

government authority bodies and institutions of autonomous local authorities, grant competitions and government funds of support of science, technological programs and projects;

- funds of personal and legal bodies (organizations of various forms of ownership) and social funds of science support; - philanthropist and the sponsor's help; - the University own means; - other sources which do not contradict the legislation of the Russian Federation.

5.7. Research activity grant beneficiaries can administer the funds in accordance with the legislation of the Russian Federation or due to the order established by legal or personal body, which provides grants.

SECTION VI

MANAGEMENT OF THE UNIVERSITY

6.1. University Management is exercised in accordance with the legislation of the Russian Federation and the present Bylaws on the principles combining one-man management, collective approach and autonomy.

6.2. The Powers of the University founders in accordance with the legislation of the Russian Federation, the present Bylaws and other local acts of the University are carried out by the Board of University Founders, which is composed of two representatives from each founder.

Representatives of the state authorities, local authorities, representatives of the cooperative and other organizations, as well as representatives of the University may participate at meetings of the Board of University Founders being at voting authority.

6.2.1. The Board of University Founders operates on the present Bylaws basis and the Board of University Founders Provisions, approved by the founders. The Board of University Founders has its own printed form and seal with the details.

6.2.2. The exclusive competence of the founders of the University includes: 1) approval of the University Bylaws, its changes and additions; 2) identification of priority activities of the University, the principles of

formation and use of its property; 3) the election of the University Rector, his labor contract conclusion, early

termination of the Rector’s authorities;

4) the creation, liquidation and branch and University representative offices renaming;

5) the formation of the University Trustees Board, the election the Chairman and the Secretary of the University Trustees Board, early termination of the University Trustees Board members’ authorities;

6) the approval of the University Trustees Board Provisions; 7) the approval of the University admission plan (the number of persons

enrolled in the first year course, as well as in the post-graduate course); 8) the University of reorganization and liquidation. 6.2.3. The meeting of the Board of University Founders is valid if more than

half of its members attended it. The decisions of the Board of University Founders are made by a majority of votes of the members participating in the meeting; on the issues of exclusive competence – by qualified majority, namely 2/3 votes of the members of the Board of University Founders.

6.3. The University Bylaws, its amendments and provisions are adopted by the General Meeting (the Conference) of pedagogical and scientific workers, representatives of other staff categories and students of the University (further – the University Conference), and being approved by the Board of University Founders is subject to the state registration in accordance with the procedure envisioned by the legislation of the Russian Federation.

The compliance with the University Bylaws Provisions is obligatory for all the categories of the University staff and students.

The procedure of the University Conference delegates’ election, the quota of structural subdivisions representatives, meeting and voting procedures of the University Conference are specified by the University Conference Provision approved by the University Academic Council.

In addition to the adoption of the University Bylaws, its changes and additions, the authority of the University Conference includes:

1) the approval of the University Academic Council Provisions; 2) other issues stipulated by the legislation of the Russian Federation, the

Bylaws and Provisions of the University Conference. 6.4. For contributing to the solution of current and actual problems of the

University development, engaging of additional financial resources with the purpose of supporting the University activity in the sphere of priority development trends and verification of adequate usage of means, the protection of legal rights and private interests, the Trustees Board can be established in the University.

The procedure of the University Trustees Board establishment, terms of its authorities, competence and operating procedures are determined by the University Trustees Board Regulations approved by the University Academic Council.

6.4.2. The University Trustees Board is established by the Board of University Founders.

The persons, who are the members of the University staff, cannot make up more than 1/3 of the general members’ number of the Board of University Founders.

The University Rector and the University President participate in the Board of University Founders meetings at voting authority.

6.4.3. The term of authorities of the Board of University Founders is five years. The Board of University Founders has the right to change the staff of the University Trustees Board ahead of time.

The Meeting of the University Trustees Board is valid if more than half of its members attended it. The University Trustees Board meeting decisions are made by majority votes of the members participating in the meeting.

6.5. The general management of the University is implemented by the elective representative body – the University Academic Council.

6.5.1. The number of the University Academic Council members is determined by the University Academic Council Provision, approved by the University Conference.

The University Academic Council consists of the University Rector who exercises the functions of the University Academic Council Chairman, the University President, the Chairman of the Board of University Founders, vice-rectors, heads of the University branches, and Faculty Deans. The other members of the University Academic Council are elected at the University Conference.

The structure of the University Academic Council is approved by the University Rector’s order.

In the case of the University Academic Council member retiring (dismissal), he /she is automatically excluded from the University Academic Council.

The University Academic Council composition partial changes are adopted by the University Academic Council on the ground of the assignments to a position of vice-rectors, deans, etc. and are accomplished by the Rector’s order.

6.5.2. The University Academic Council term of authority is five years. 6.4.2. The University Academic Council meetings are spent not less than

once in two months. The University Academic Council members have the right to make

proposals concerning the schedule and the contents of the University Academic Council operation.

The University Academic Council meetings are valid if more than 50 percent of the University Academic Council members are present.

A simple majority of voices makes the University Academic Council decisions come into force immediately after being signed by the University Academic Council Chairman.

The solutions of the University Academic Council are brought to the notice of the University staff and students.

6.5.4. The University Academic Council: 1) solve the urgent problems of the University development, its academic,

scientific, innovative, educational, international and other kinds of activities; 2) contribute suggestions concerning the present Bylaws modification and

additions ; 3) approves the University development program, including the priority

areas;

4) considers problems of restructuring and elimination of the University and its branches;

5) approves the annual report and annual balance sheet; 6) takes decisions on the other organizations by the University and its

involvement in other activities; 7) determines the University structure , creates and eliminates its structural

subdivisions, its branches including, except of those stipulated by the present Bylaws;

8) make suggestions on creation, elimination and the University branches renaming;

9) approves the University Conference Provision; 10) elects the University President, approves the Provision on the University

President; 11) determines the order of scientific and methodical faculty councils

establishment; the procedure of scientific, methodical and other special kinds of activity managing councils creation;

12) approves the Provisions on faculty and branch academic councils; 13) approves the University internal order regulations and the hostel

accommodation instruction; 14) approves the University local standard acts on the problems of

educational process organization, including the rules of students dismissal, reintegration and transfer; the University Rules of State Final Certification of graduates, etc.;

15) makes decisions concerning all problems of educational process organization, including increasing and cutting back of the training length period; approves curricula and training programs in accordance with the federal state educational standards and federal state requirements, determines the displacement of academic year beginning terms, etc.

16) considers the University organizational capacity in the field of training and retraining on the major and additional educational programs, programs of professional subject to licensing;

17) makes decisions on opening new educational directions, specialties, specializations, profiles and eliminating of unclaimed ones;

18) recommends nominees for doctoral department enrolment, annually considers their scientific records; approves topics of doctor's degree theses; solves the matters on copies of textbooks, scientific methodical works, articles depositing, etc.;

19) makes decisions on recommendation of scientific and methodical researches for competitions participation, state and other award nomination;

20) approves Provisions on Stuff Substitution Position Order; 21) makes decisions on faculty deans’ and chair heads’ position

appointment, brings up the claimants for professor and teacher staff positions to be filled through discussion and competition;

22) considers accreditation cases on professor and associate professor academic statuses nomination, and in accordance with the stated procedure submits the cases for assertion;

23) nominates the University staff candidate and supports other educational and scientific institutions for their election as members of the Academy of Sciences, honorary members of scientific societies, for state honorary titles awards and submission to awards of the Russian Federation;

24) makes decisions on introducing and awarding the University bonuses and scholarships;

25) makes the decision on the University Rector’s bonus payment; 26) recommends staff’s or students’ candidates for personal scholarship

granting; 27) awards the titles of «Honored Professor of Belgorod University of

cooperation, economy and law», «Honored Lecturer of Belgorod University of cooperation, economy and law », «Honored worker of Belgorod University of cooperation, economy and law »; awards a badge pin «For the contribution in the University development», initiates other forms of encouragement;

28) listens to the University Rector’s and structural subdivisions chiefs’ reports on the results of the accounting period and the main (priority) activity trends for the forthcoming period;

29) approves regulations on compensation, material incentive of different University staff categories, the University Rector including;

30) discusses the issues on spiritual, moral, ethical and physical students’ education, as well as measures aimed at their health improvement;

31) considers other problems of a basic priority for educational, scientific, organizational, personnel, financial, economic and other profitable University activities organization and conduction which, by definition of the Rector or the majority of the University Academic Council, are socially significant and demand consideration at the Council meetings, including the problems raised by the University structural subdivisions workforce;

32) executes other authorities stipulated by the legislation of the Russian Federation, the present Bylaws and other local acts of the University.

The University Academic Council has the right to pass a part of its authorities to the academic councils of faculties and branches.

6.6. Direct management of the University activity is executed by the Rector, who on the one-man leadership principles bears the complete responsibility for the status and operating results of the University.

6.6.1. The University Rector is elected at the Board of University Founders Meeting for a five-year term.

A person from teaching staff who has not less than a ten-year leadership experience in the higher educational institution and a scientific degree of Doctor of Science and an academic title of a Professor on the training directions of the University can participate in the University Rector’s election.

The age limit which restrain taking the post of Rector in the state and municipal higher educational institutions, does not concern the University Rector in accordance with the legislation of the Russian Federation.

The Chairman of the Board of University Founders concludes a five-year labor agreement with the University Rector after his /her election by the Board of University Founders.

6.6.2. The University Rector solves all the problems of the University activities independently, except the ones attributed to the exclusive competence of the University Conference and the Academic Council.

Annually the Rector reports on his activity at the expanded Meeting of the University Academic Council or Conference, to which all faculties, scientific officers and representatives of other categories of University staff and students are invited.

6.6.3. Within his competence the University Rector: 1) manages academic, scientific, educational, administrative, organizational

financial, economic, international and other activities of the University; 2) represents the University without power of attorney in relations with

public authorities, including judicial ones, bodies of local self government, legal and personal bodies, social societies, international organizations;

3) ensures the decision fulfillment of the Board of University Founders, the University Trustees Board, the University Conference and the University Academic Council;

4) organizes the work of the University and its structural subdivisions, executes checking of the University structural subdivisions activity either personally or by the assigned commissions;

5) approves the regulations concerning all the University structural subdivisions;

6) forms the University administration, organizes its work and the work of other University administrative bodies;

7) executes personnel selection policy, approves the University staff list, including its branches; employs, dismisses and brings the University staff, students, learners, post-graduate students and other categories of undergraduates to discipline and other kinds of responsibility;

8) approves rules concerning all the structural subdivisions of the University in accordance with Legislation of the Russian Federation at the present Bylaws.;

9) enrolls and dismisses students, learners, post-graduate students, Ph.D. candidates and degree-seeking students of the University;

10) ratifies the estimate of revenues and expenditures of the University and makes amendments in it;

11) disposes of the University property and means in accordance with the legislation of the Russian Federation and the present Bylaws;

12) concludes contracts and agreements, other bargains, issues powers of attorney, opens the University accounts in banks and other credit institutions;

13) within the frames of the authorities approves the rules, instruction, issues orders, regulation, directions and other order documents, obligatory for all the University employees and undergraduates;

14) executes other authorities determined by the legislation of the Russian Federation, the present Bylaws, local acts of the University and the employment contract.

6.6.4. Interference in operational and regulatory activity of the University Rector is not admitted, if it does not contradict to the legislation of the Russian Federation and the present Bylaws.

6.6.5. The University Rector can delegate part of his /her authorities to vice-rectors and other University executives.

6.6.6. Social, including material warranties and incentives of the University Rector activity are ensured in accordance with the standard legal acts defining his /her status in a higher educational institution of the Russian Federation of federal subordination, by local acts of the University and the employment contract.

6.7. The post of the University President can be instituted by the decision of the University Academic Council.

6.7.1. All the problems bound to the University President status, election procedure, rights and duties, material and technical support, autho\rities extinction are regulated by the present Bylaws and the University President Rules, accepted by the University Academic Council.

6.7.2. The University President is elected by a simple majority vote in the result of a secret voting for a five-year term. After the President’s election the University concludes with him/her a five-year employment contract. The extinction of the employment contract with the President is subjected to the labour legislation of the Russian Federation, including on the bases of an extinction of the employment contract with the chief of the institution.

6.7.3. The nominee to the University President post is introduced to the Academic Council by Council of Founders.

6.7.4. The nominee to the University President post is nominated from among candidates who actively contributed to the high school development, have a scientific degree and an academic status, practical experience at the Rector post for not less than ten years.

6.7.5.. On agreement with the University Rector the University President executes the following authorities:

1) participates in the activity of Founders Council, Administrators Council, University Conference, the University Academic Council, self-government University bodies;

2) participates in the development of the University Progress Concept; 3) represents the University without powers of attorney in relations with the

University founders, public authorities, bodies of local self-government, public and other organizations, including international and personal bodies;

4) executes the University Rector authorities in the absence of the latter;

5) participates in discussion and solution of problems concerning mastering of educational, scientific, financial-economic, organizational and administrative University activities;

6) executes personal supervision and the supervisory control of educational process quality and its correspondence to state standards requirements;

7) executes other authorities in accordance with the present Bylaws, the University Academic Council decisions and other local acts of University.

6.7.6. The University provides the University President with necessary premises, material equipments, transport, and communication means at the expense of the University.

6.7.7. The University President is provided with social warranties envisioned by local acts of the University, employee contract and legal acts of the Russian Federation for the high schools heads.

6.8. The operational management of the current University activity problems during inter-session periods of the University Academic Council is executed by the University administration, which work under the Rector’s guidance.

The structure and authorities of the University administration are determined by the University Administration Rules approved by the University Rector.

6.9. Vice-rectors execute a direct administration of certain kinds of the University activity in accordance with the orders, regulations and instructions of the University Rector and approved by him/her official administrative responsibilities.

The University Rector defines the quantity of vice-rectors. Allocation of responsibilities between the vice-rectors and other executives

who directly report to the University Rector are specified by the University Rector. University Vice-rectors are appointed by University Rector from among

candidates with scientific degree or/and an academic title and experience of administrative, guiding (or) scientific academic work in higher education institutions. Vice-rectors are employed against the employment contract which expiration date coincides with the termination date of the University Rector authorities.

6.10. For keeping accounting records and tax reporting in the University there is an Accounting and Financial Control Department. The head of the Accounting and Financial Control Department - the chief accountant of the University - should have higher education and five-year experience in the field of finance and accounting, and is appointed by the Rector. The chief accountant is employed against the employment contract which expiration date coincides with the termination date of the University Rector authorities.

Chief accountants of the standalone structural subdivisions of the University are assigned by the University Rector order on submission from the chief of the given structural subdivision, and approved by the University chief accountant.

6.11. A department is a structural University subdivision, executes its activity on the basis of the present Bylaws, the Department Rules and other local acts of the University.

6.11.1. The head of the department is a dean. In the University deanship is a full-time job; dean’s functions are determined by the duty regulations approved by the University Rector.

6.11.2. The department dean belongs to the teaching staff has the status of the chief of a structural subdivision and heads University Academic Council.

6.11.3. The department dean is elected by secret voting at the University Academic Council for a five-year term from among the most qualified and authoritative specialists of an appropriate profile, as a rule, who has a scientific degree and (or) the academic status.

6.11.4. The department dean on the one-man leadership principles bears the complete responsibility for the department activities to the University Rector and the University Academic Council. The dean reports back to the University Academic Council, the Department Academic Council, and under the Rector’s solution to the University administration.

6.11.5. If necessary, the Rector has the right to submit to the University Academic Council a reasoned offer on pre-schedule dean’s re-election. The problem on dean’s post release is put to secret vote if its discussing at the University Academic Council and its open voting got support of not less than on 1/2 of voices of the University Academic Council members. The decision is considered accepted if during secret vote it was supported by not less than 1/2 voices of the University Academic Council members.

6.12. A chair is a structural University subdivision, executes its activity on the basis of the present Bylaws, the Chair Rules and other local acts of the University.

6.12.1. The Chair is managed by a chief of the chair elected by secret voting at the University Academic Council for a five-year term from among specialists with higher education and pedagogical experience, as a rule, for not less than 5 years, who has a scientific degree and (or) the academic status.

6.12.2. In the University the post of a holder of a chair is a full-time job; a chair chief’s functions are determined by the duty regulations approved by the University Rector.

6.12.3. The chair chief belongs to the teaching staff and has the status of the chief of a structural subdivision.

6.12.4. The chair chief on the one-man leadership principles bears the complete responsibility for the chair activities, quality of specialists training on the proper disciplines, employees execution of their employment duties, office regulations, safety arrangement and precautions.

The chair chief reports back to the chair, the University Academic Council, the Department Academic Council, and under the Rector’s solution to the University administration.

6.12.5. A pre-schedule extinction of chair chief authorities is executed similar to the order described in item 6.11.5 of the present Bylaws.

6.13. The procedure of candidates nomination to the department dean and chair chief posts, their discussion, voting procedure and other problems are determined by local acts of the University.

6.14. Heads (directors) of branches and representations should have a scientific degree and (or) the academic status, and (or) the leadership experience in the higher (specialized secondary school) educational institution. The University concludes a fixed term employment contract with the head (directors) of the branch for a 5-year period.

6.15. To certificate the Faculty of higher classification in the University can be created Dissertation Councils in accordance with the legislation of the Russian Federations.

6.16. In the University can be created scientific and methodical department councils, methodological and other councils to manage separate kinds of activity, cyclical and other commissions academic and methodical boards of the faculty.

6.17. The University undergraduates can participate in the University management through the conference, the offices of the faculty academic councils and other operating bodies, and through the offices of public undergraduates incorporating bodies, trade-unions and other public organizations which execute their activity in accordance with the legislation of the Russian Federation.

SECTION VII

UNIVERSITY TRAINEES AND THE FACULTY

7.1. The term “University trainees” shall include students, learners, post-graduate students, Ph.D. candidates, degree-seeking students and other categories of trainees.

7.2. The University students are the persons enrolled in the University in the prescribed procedure. The students are given student’s identity cards and student's record books.

7.2.1. The University students have the right: 1) to obtain education in accordance with the federal state educational

standards, federal state requirements; 2) study in the frameworks of federal state educational standards on

individual curricula as well as on the shortened or accelerated course of study; 3) to choose optional (optional to the given specialty (a trade)) and elective

(elected in the obligatory order) courses, recommended by the corresponding departments and chairs;

4) to participate in the process of educational content formation provided it corresponds to federal state educational standards. The said right can be restricted by terms of the contract, signed between the University student and the private or legal body, supporting him /her in getting education and subsequent employment;

5) to master, besides subjects on the selected educational fields (trades), any other subject, taught at the University, in the procedure envisaged by the present Bylaws, as well as the subjects taught at other higher educational institutions (on the agreement between their heads);

6) to participate in discussion and decision making on the major problems concerning the University activities, including through public organizations and the University governance bodies;

7) for respect of his/her human dignity, for freedom of consciousness, information, for free expression of his/her opinions and beliefs;

8) to use libraries, information funds, services of educational, scientific, medical, health-improving, cultural and other University facilities; to participate in all kinds of research work, conferences, workshops, etc.;

9) to introduce their works for publication inclusive of the University editions;

10) to appeal against the University administrative orders and decrees in accordance with the procedure, established in the legislation of the Russian Federation;

11) to get information from the University authorities concerning the situation in the Russian Federation sector of employment;

12) set up students’ building teams and participate in their activities. 7.2.2. University graduates have equal rights with graduates of other

educational institutions regardless of their organizational and legal forms when entering the said institutions to obtain the education of the further level;

7.2.3. The student can study alongside employment and use the warranties and indemnifications in accordance with the legislation of the Russian Federation.

7.2.3. The student has a guaranteed right to exchange into another higher educational institution at the consent of this higher educational institution and after being successfully certified.

The exchange from other educational institution into the University and from the University into another educational institution is executed in accordance with the legislation of the Russian Federation and local acts of the University.

7.2.5. The student has the right to change one specialty, even in case it is not nationally accredited, into another one nationally accredited in accordance with the legislation of the Russian Federation and local acts of the University.

7.2.6. Тhe student has the right in the procedure envisaged by the legislation of the Russian Federation and local acts of the University to be restored at the University after expulsion from the latter.

7.2.7. On medical indications and in other extraordinary cases the students are given the academic leave in accordance with the legislation of the Russian Federation and local acts of the University.

7.2.8. Students of the full-time course of study, who need accommodation, are provided with a place in a hostel if the appropriate housing is available. A living accommodation rent agreement is signed with the students who live in a hostel.

7.2.9. For special achievements in study and active involvement in the research work and social activities of the University students can receive moral and financial incentives in accordance with the present Bylaws, local acts of the University; students can be recommended for getting the President and the Government of the Russian Federation and other scholarships.

7.2.10. To the extent of available finance means, the University has the right to work out and implement social support measures; to pay out scholarships, training aids and other social payments depending on the students’ financial position and academic success.

7.2.11 The University students are obliged to: 1) gain knowledge, study in good faith, attend classes; 2) meet requirements of the appropriate level of the vocational training

program in accordance with the selected specialty (trade); 3) execute duly all kinds of tasks envisioned by the appropriate curricula and

educational programs on vocational training; 4) respect honor and dignity of other University students and employees; 5) be ready and willing to rise one’s own cultural level; 6) treat with due care the University property; 7) observe the present Bylaws, office regulations, residing regulations in a

hostel, fire safety regulations, other local acts of the University and the agreement for rendering educational remunerated service.

7.2.12. Provided that without a valid excuse a student fails to comply with the curriculum of a given specialty (trade) in due terms; violates the responsibilities envisioned by the present Bylaws, regulations of the University internal regulations and residing hostel regulations, other local acts of the University, he/she can be imposed to appropriate disciplinary measures, including expulsion from the University.

The procedure of imposing appropriate disciplinary measures is determined by local acts of the University in accordance with the legislation of the Russian Federation.

7.2.13. Student is subject for the expulsion from the University due to the obtaining of the education (completion of studies at the University), which proved by the issuance of the document on the corresponding level of education and/or qualifications.

7.2.14. The student comes under expulsion from the University: 1) at student’s own initiative (his/her legal representatives): - at one's own will; - due to exchange into other educational institutions; 2) due to circumstances not depending on the student’s will (his/her legal

representatives) and the University: - for health reasons; - due to induction into military service or alternative civil service replacing military one; - conviction excluding continuation of studies, in accordance with the court rule entering into force;

- student’s death; - occurrence of force major preventing from the continuation of education

in accordance with the legislation of the Russian Federation; - other circumstances envisaged by the legislation of the Russian

Federation; 3) at the initiative of the University: - for failing to comply with the curriculum of a given specialty (trade) in

due terms; - for loss of connection with higher school (missing classes for a long

time); - violation of the present Bylaws, University office regulations, residing

regulations in a hostel, other local acts of the University; - absenteeism from the academic leave; - committed crimes hindering vocation training at the University; - submitting of the forged documents connected with the education process

at the University; - breach of contract terms concerning rendering of remunerated educational

services, including the ones connected with default or violation of payment expiry dates envisaged by the contract;

- other circumstances envisaged by the legislation of the Russian Federation;

The procedure of expulsion from the University and its affiliates is determined by local acts of University in accordance with the legislation of the Russian Federation.

7.2.15. The rights, social guarantees and privileges, as well as responsibilities of students, except the ones stipulated in the present Bylaws, can be established by other local acts of the University.

7.3. The University learners. 7.3.1 The University learners are the persons who study at the preparatory

department, in structural subdivisions of pre-entry training, professional skills improvement courses and as well as those who get the second higher vocational education and who are the students of the University or any other higher school.

7.3.2. Applicants get the status of learners based on the University Rector’s order.

7.3.3. The learners legal status to the extent it relates to getting educational services matches the status of the University student of the appropriate form of training.

7.4. The University Ph.D. candidates, post-graduate students, and degree-seeking students.

7.4.1. A Ph.D. candidate is a person who has a scientific degree of the candidate of sciences, is enrolled in the Centre for Doctoral Training and writes thesis in candidacy for a scientific degree of the doctor of sciences.

7.4.2 A post-graduate student is a person who has a higher vocational education, studies in the postgraduate studentship and writes thesis in candidacy for a scientific degree of the candidate of sciences.

7.4.3. A degree-seeking student is a person possessing higher vocational education, attached to the University for preparing the dissertation of the candidate of science without study at the post-graduate courses or a person possessing the degree of as candidate of science for preparing the dissertation of the doctor of science.

Attachment to the University is exercised by the order of the University Rector in the procedure envisaged by the legislation on education in the Russian Federation and local acts of the University.

7.4.4. A post-graduate student (Ph.D. candidate) works on an individual plan of instruction approved by the order of the University Rector.

7.4.5. The University post-graduate students and Ph.D. candidates have the right to:

1) participate in discussing and decision making on the major problems concerning the University activities, through public organizations and the University governance bodies;

2) use libraries, information funds, services of educational, scientific, medical, educational, and other University facilities to carry out research work on the topic of research investigations;

3) participate in all kinds of research work, conferences, workshops, etc., to introduce their works for publication inclusive of the University editions;

4) to appeal against the University administrative orders and decrees in accordance with the procedure, envisaged by the legislation of the Russian Federation;

5) other rights in accordance with the legislation of the Russian Federations, the present Bylaws and other local acts of the University.

7.4.5. Post-graduate students training in postgraduate studentship at extra-mural courses, have all the rights and privileges in accordance with the legislation of the Russian Federation.

7.4.6. During the course of instruction the University post-graduate students are obliged to: 1) fulfill the requirements of the present Bylaws, to keep to internal

regulations, the residing rules in a hostel, other local acts of the University; 2) gain deep professional knowledge, skills of self-guided research work,

undertake teaching practice; 3) fulfill the individual plan of research activities, annually report on

execution of the individual plan of research activities and pass certification at the chair meeting;

4) pass candidate examinations; 5) submit the completed thesis to the chair for obtaining corresponding

conclusion; 6) to execute other responsibilities according to the legislation of the

Russian Federation, the present Bylaws and other local acts of the University.

7.4.7. During the course of instruction the University Ph.D. candidates are obliged to: 1) to fulfill the requirements of the present Bylaws, to keep to internal

regulations and other local acts of the University; 2) entirely fulfill individual plan of research activities, annually report on

execution of the individual plan of research activities and pass certification at the University Academic Council meeting;

3) to submit the completed thesis to the chair for obtaining corresponding conclusion;

4) execute other responsibilities according to the legislation of the Russian Federation, the present Bylaws and other local acts University.

7.4.8. Post-graduate student, Ph.D. candidate, degree-seeking student are subject for expulsion from the University by the order of the University Rector due to the completion of the education or due to successful defense of the dissertation.

Post-graduate student, Ph.D. candidate, degree-seeking student can be expelled from the University by the order of the University Rector for failing to comply with the individual plan of research activities in due terms; and on other grounds envisaged by point 7.2.14 of the present Bylaws.

7.4.9. The procedure of enrolment, training and expulsion from the postgraduate studentship and Centre for Doctoral Training (doctorate) is determined by local acts of University in accordance with the legislation of the Russian Federation.

7.5. The University Staff 7.5.1. In the University there are posts for academic and teaching staff (the

faculty, scholars), engineering and technical, administrative, industrial, auxiliary educational and other staff.

The academic and teaching staff includes posts of faculty deans, chair heads, full professors, associate professors, assistant professors, lectures and assistance lecturers.

Scientific office includes posts of the director of the Research Institute the head of a laboratory (department), the chief research associate, leading research associate , senior research associate, research associate, junior research associate.

7.5.2. In the University competitive election for all academic teaching positions is executed in accordance with the employment contract. The employment contract conditions can be changed or added, that is accomplished by the supplementary agreement to the employment contract. The employment contract can be concluded both for an unspecified term or for the term determined by the employment contract parties, but not more, than for five years.

Concluding contract on competitive election for an academic teaching position or exchange from another teaching position in the University, is preceded by election which is carried out on a competitive basis in accordance with the legislation of the Russian Federation and local acts of the University.

Competitive election for an academic teaching position, occupied by the employee with whom the employment contract is concluded for an unspecified term, takes place once in five years.

With the purposes of supporting continuous training process it is permitted to conclude the competitive election contract for an academic teaching position without a competitive election for a person with a dual activity who is employed for not more than a year; without a competitive election it is possible to fill the office of a temporarily absent person, the position is kept warm for in accordance with the law till his / her returning to work. Competitive election for an academic teaching position does not take place in cases envisioned by the labor legislation of the Russian Federation.

Before the completion of the term of the competitive election or during the term of limited labor contract in order to prove the correspondence of the employee to occupied by him/her position of academic worker there can be held attestation.

7.5.3. The procedure of the extinction of the employment contract with а teaching employee is regulated by the legislation of the Russian Federations and the present Rules.

Dismissal of teaching staff on the administration initiative in connection with the staff reduction is admitted only upon the academic year termination.

7.5.4. In accordance with the legislation of the Russian Federation the weekly working time of the Faculty constitutes 36 working hours during 6 working days; the annual paid holiday constitutes 56 calendar days.

The academic workload for the faculty is determined by the University depending on the staff proficiency and the chair profile in the amount up to 900 hours per academic year.

7.5.5. The University Faculty have the right to: 1) in accordance with the procedure elect and be elected in the University

Academic Council, Faculty Academic Councils; 2) participate in discussing and deciding issues relating to the University

activity; 3) use free of charge services of libraries, information funds, training and

scientific subdivisions, social and other structural subdivisions of the University in accordance with the present Bylaws and (or) the collective agreement;

4) determine the content of the educational courses, subjects, modules (units) in accordance with the legislation of the Russian Federation in the field of education;

5) choose methods and teaching techniques, which are best suited to individual peculiarities of personality and ensure a quality of educational process;

6) to appeal against the University orders and administrative decrees in accordance with the legislation of the Russian Federation;

7) obtain organizational, material and technical support in their professional activities;

8) participate in the research activities ensuring high scientific level of the education content and obtaining of new fundamental knowledge;

The University researchers have the right to select methods and techniques of carrying out the research activity, corresponding to safety measures, which are best suited for individual peculiarities of personality and ensure a quality of research process;

7.5.6. The University academic and teaching staff are obliged to: 1) ensure high efficiency of pedagogical and scientific processes; 2) observe the present Bylaws, office regulations, other local acts of the

University; 3) develop students’ professional qualities in the field of the chosen

specialty (trade), civil position, capability for work and life under present-day democracy and modern civilization conditions;

4) take an active part in educational activities, develop students’ independence, initiative, creative abilities;

5) carry out educational and methodological activities; 6) carry out research ensuring high scientific level of a education content,

actively involve students in research activities; 7) systematically develop their own professional competence; 8) handle the University material and intellectual property with care; 9) not to divulge the state secret and confidential information. 7.5.7. The University academic and teaching staff also have other rights and

the responsibilities determined by the legislation of the Russian Federation, the present Rules, local acts of the University, the employment contract.

7.5.8. The rights and responsibilities of the administrative, engineering and technical, industrial, auxiliary educational and other University staff are determined by the labor legislation of the Russian Federation, the present Bylaws, office regulations of the University, labor contract and the bylaws approved by the University Rector or the person, authorized by the University Rector.

7.5.9. All University employees are obliged to follow the present Bylaws, office regulations of the University, other local acts of the University.

7.5.10. For the achievements in the field of educational, methodical, scientific, and other activities envisioned by the present Bylaws, the University employees can get moral and financial incentives.

7.5.11. For breach of obligations envisioned by the present Bylaws, the University employees can be subject to discipline sanctions, material and civil responsibility in accordance with the legislation of the Russian Federation, the present Bylaws and other local acts of the University.

7.5.14. The consideration procedure of structural subdivision petitions concerning decoration with industry and state awards and awarding on a scientific or honorary degree of the employees for their achievements in the field of educational, research and other activities is determined by local acts of the University.

SECTION VIII

TRAINING AND REFRESHER TRAINING

OF THE ACADEMIC AND TEACHING STAFF

8.1. Training of the academic and teaching staff is implemented by: 8.1.1. studying at the University Centre for Doctoral Training and

postgraduate studentship; 8.1.2. sending to the Centre for Doctoral Training and postgraduate

studentship in other higher schools, which have the state accreditation; educational institutions of additional vocational training; scientific institutions or centers, which have the license for implementing educational activities in the sphere of postgraduate vocational training as well as for registration of degree-seeking students in the stated above organizations;

8.1.3. transferring the Faculty members to the positions of research scholars for writing thesis;

8.1.4. granting sabbatical to complete thesis. 8.2. Training in the postgraduate studentship can be carried out in the form

of full-time education or at extra-mural courses. The duration of education at post-graduate courses of the University and at the Centre of Doctoral Training is determined by the legislation of the Russian Federation.

8.4. Improvement of professional skills of the University academic and teaching staff is carried out not less than once in 5 years in the University premises as well as in the educational institutions of the career development system, in higher educational establishments, in public authority bodies and institutions of local government, in Russian and foreign scientific, industrial, cooperative and other organizations by means of training, undertaking an internship, writing and completing thesis, participating in seminars, and other means and forms of professional skill improvement.

SECTION IX

UNIVERSITY ECONOMICS ACTIVITY

9.1. The property used for supporting the University activity, including its branches (buildings, facilities, housing, equipment, inventory, funds in rubles and foreign currency, securities and other objects of civil rights), belongs to the University on an ownership basis, leasing, free usage or another right under the legislation of the Russian Federation.

9.2. For supporting the University educational, scientific and other activities oriented to implementation of actual educational targets stipulated by the present Rules, the University founders are entitled to transfer into University ownership real estate (buildings, facilities, property complexes, land parcels), machinery, funds and other property of consumer, social, cultural and other demand. The property transferred to the University by its founders is owned by the University. University founders do not retain the rights to the property transferred into the ownership of the University.

9.3. The University has the right to possess land parcels in property, or on another right under the legislation of the Russian Federation.

9.4. The University executes reimbursable activity in the field of education and in other spheres stipulated by the present Rules.

Reimbursable educational activity of the University is not considered as income generating activity, as the income gained from it covers expenditures, connected with providing educational services (including salary), their development and improvement.

9.5. The University has the right to carry on income generating and other profitable activity stipulated by the present Rules, under the legislation of the Russian Federation.

9.6. The University has the right to gain tangible, intangible and other property by means of permanent buildings and facilities construction, participatory interest (investments) in construction, to commit purchase and sale transactions, barter, donation and other bargains in accordance with the legislation of the Russian Federation and the present Rules.

9.7. The University solves on its own authority the problems concerning contract conclusion, definition of obligations and other conditions in accordance with the legislation of the Russian Federation, the present Rules and local acts of the University.

9.7.1. Tuition fees at the University, including its branches, as well as the amount of payment for other services offered by the University, including branches, are determined by the University Rector.

The University Rector is entitled the right to provide educational charge benefits and benefits in the provision of other services in accordance with the local acts of the University.

9.7.2. The procedure of making a property bargain by the University depends on its value: - Up to 10 million rubles – by the Rector himself; - over 10 million rubles - under the solution of the University Academic Council.

The value of alienated by the University property is determined by accounting data and (or) of an independent estimation, and value of the acquired by the University property is determined by the asking price.

9.8. The University has the right to act as a lessor and (or) a lessee of property.

Monetary resources received by the University as rental charges are used for support of the University activity stipulated by the present Rules.

9.9. The University sources of revenue are: - non-recurrent receipt of funds from the founders; - monetary resources received by the University as tuition charge under the contracts with legal entities and individuals; - monetary resources received by the University while carrying on income generating and other profitable activity, including the usage of the University’s right to intellectual activity outcomes and means of individualization in accordance with the legislation of the Russian Federation; - revenue from the sale of goods, works and services; - income received from the property of the University;

- dividends (incomes, interests) yield on shares, bonds and other securities; - credits of banks and other institutions; - incomes received from depositing of temporarily free cash; - voluntary contributions and donations, property transferred by will; - other sources of income which do not run counter the legislation of the Russian Federation.

SECTION X

UNIVERSITY ACCOUNTING AND REPORTING

10.1. The University maintains accounting, law and statistic reporting in accordance with standard legal acts of the Russian Federation.

10.2. The University presents the information about its activity to state statistic and tax bodies, founders and other bodies in accordance with standard legal acts of the Russian Federation and by the present By-Laws as well as sets the standard legal information in the Internet.

10. 3. The supervisory control of the University financial and economic activity enforcement is carried out by appropriate federal government bodies within their authorities.

SECTION XI

UNIVERSITY INTERNATIONAL AND FOREIGN ECONOMIC ACTIVITIES

11.1. The university has the right to maintain international cooperation in the sphere of academic, scientific and (or) scientific and technological, educational and other activities in accordance with the Russian Federation legislation and international treaties of the Russian Federation by the following means:

11.1.1. participation in international projects and programs including in-service professional programs; 11.1.2. participation in work of international cooperative and other

organizations; 11.1.3. participation in programs of two-way and multilateral interchange of

students, post-graduate students, PhD candidates, academic and teaching staff; 11.1.4. invitation of foreign scientists and qualified specialists for carrying

out of educational process, trainings and business games; 11.1.5. organization and (or) carryings out of joint research activities with

foreign partners, as well as conferences, international competitions and other events;

11.1.6. carryings out of fundamental and applied research including experiment and design activities through the request of foreign legal bodies and international organizations;

11.1.7. sending abroad teaching staff, university students to internship, getting training, taking part in conferences, workshops, meetings, congresses, etc.;

11.1.7. the University activity advertising.

11.2. The University training, retraining and improvement of foreign citizen’s professional skills is carried out on the basis of the complete tuition reimbursement or in accordance with the contracts conditions, concluded between the University and foreign legal bodies, including educational institutions. Outside the country educational and research activity of the University Faculty is carried out in accordance with the Russian Federation legislation on the basis of international treaties, as well as under direct contracts concluded by the University with foreign legal bodies, including educational establishments, or with foreign citizens.

11.3. For the purposes of being involved in the international activity of the Russian Federation the University has the right:

11.3.1. to join non-governmental international organizations; 11.3.2. to conclude foreign partners joint activity agreements which cannot

be considered as international treaties of the Russian Federation; 11.3.3. to organize structural subdivisions (chairs, centers, laboratories,

techno parks and other subdivisions) involving foreign partners; 11.3.4. carry out other activities in accordance with the Russian Federation

legislation and by the present By-Laws. 11.4. In accordance with the legislation of the Russian Federation the

University has the right to be engaged in foreign economic activities, which are oriented to solve the problems fixed by the present By-Laws as well as development of the University international contacts.

SECTION XII

ENUMERATION OF THE LOCAL ACTS,

REGULATING THE UNIVERSITY ACTIVITY

12.1. The local acts regulating the University activity are: the present By-Laws; minutes and other acts of the University Council of Founders; minutes and other acts of the University Trustee Council; minutes of the University conferences; regulations, rules, instructions approved by the University Academic Council; resolutions (acts) of the University Academic Council; bylaws, regulations, instructions approved by the University Rector; orders, instructions of the University Rector; orders, instructions of the University President; minutes and other acts of the University administration decisions, other local acts.

SECTION XIII

PROCEDURE OF THE UNIVERSITY

REORGANIZATION AND LIQUIDATION

13.1. The University reorganization is carried out by the decision of the Council of Founders with the approval of the University Academic Council or in accordance with the University Academic Council decisions and the legislation of the Russian Federation and the present By-Laws.

13.2. The University liquidation can be carried out on the bases, foreseen by the legislation of the Russian Federation:

13.2.1. by decision of the Council of Founders with the approval of the University Academic Council or in accordance with the University Academic Council decisions and the legislation of the Russian Federation and the present By-Laws; .

13.2.2. by decision of the Court if the University operates without a proper license, or conducts forbidden by the law activity, or the activity which doesn’t meet the goals fixed in the By-Laws.

13.3. The University Council of Founders or the Court carried out by decision about the University liquidation, appoints the liquidation commission (liquidator) and fixes the order and time of the University liquidation.

From the moment of the liquidation commission assignment it is empowered to manage the University activity.

13.4 In case of the University liquidation the property remained after fulfillment of all the obligatory payouts, if the other property is not determined by the legislation of the Russian Federation, is sent in accordance with the present By-Laws for the purposes of the University and (or) for charity.

13.5. The university is considered liquidated from the moment of its exclusion from the Uniform State Register of Legal Bodies.

13.6. In accordance with the legislation of the Russian Federation during the University reorganization procedure, a complete package of documents of the University activity, including personnel records, is to be transferred for keeping to the assignee; and during liquidation procedure, the documents should be transferred in the appropriate archive.
