AN ACT CREATING THREE (3) ADDITIONAL BRANCHES OFTHE REGIONAL TRIAL COURT IN THE CITIES OF

ALAMINOS, DAGUPAN, AND SAN CARLOS, ALLSITUATED IN THE PROVINCE OF PANGASINAN, INTHE FIRST JUDICIAL REGION, AMENDING FORTHEPURPOSE SECTION 14, PARAGRAPH (A) OF BATASPAMBANSABLG. 129, OTHERWISE lUSTOWN AS "THEJUDICIARY REORGANIZATION ACT OF 1980",AS AMENDED, AND APPROPRIATING FUNDSTHEREFOR

Be it enacted by the Senate and House of Representatives of thePhilippines in Congress assembled:

Section l. Three (3) additional branches of the RegionalTrial Court in the cities of Alaminos, Dagupan, and San Carlosare hereby created in the First Judicial Region.

Sec. 2. The Supreme Court shall assign the respectivebranch numbers of the newly created court branches in the FirstJudicial Region.

Sec. 3. The Chief Justice of the Supreme Court, incoordination with the Secretary of the Department of Justice,

shall immediately include in the Court's program theoperationahzation of the three (3) additional branches of theRegional Trial Courtin the citiesofAlaminos, Dagupan, and SanCarlos, all situated in the Province ofPangasinan, the fundingofwhich shall be includedin the AnnualGeneralAppropriationsAct. The funds necessary for the operation of the courts hereincreated shall be appropriated and released only upon the actualorganization of the courts and the appointment ofits personnel.

Sec. 4. Section 14(a) ofBatasPambansaBig. 129, otherwiseknown as"The Judiciary ReorganizationAct of1980", asamended,and all other laws, executiveorders, and rules and regulationswhich are inconsistent with this Act are hereby amended,repealed, or modified accordingly.

Sec. 5. This Act shall take effect fifteen (15)days after itscomplete publication in two (2)newspapers of general circulation.

Sec. 2. The Supreme Court shall assign the branchnumber for the newly created branch of the RegionalTrial Court in the Fifth Judicial Region.

Sec. 3. The Chief Justice of the Supreme Court,in coordination with the Secretary of the Departmentof Justice, shall immediately include in the Court'sprogram the operationalization of the additional branchofthe Regional Trial Court in the City of Sorsogon, thefunding of which shall be included in the AnnualGeneral Appropriations Act. The funds necessary forthe operation of the court herein created shall beappropriated and released only upon the actualorganization of the court and the appointment of itspersonnel.

AN ACT CREATINGTHREE (3)ADDITIONAL BRANCHESOF THE REGIONAL TRIAL COURT TO BESTATIONED IN THE CITY OF BACOLOD,SITUATED IN THE PROVINCE OF NEGROSOCCIDENTAL, IN THE SIXTHJUDICIAL REGION,AMENDING FOR THE PURPOSE SECTION 14,PARAGRAPH (G) OF BATAS PAMBANSA BLG. 129,

, OTHERWISE KNOWN AS "THE JUDICIARYREORGANIZATIONACT OF 1980", AS AMENDED,AND APPROPRIATING FUNDS THEREFOR

Be it enacted by the Senate and House of Representatives of thePhilippines in Congress assembled: ,V

Section l. Three (3) additional branches of theRegional Trial Court to be stationed in the City ofBacolod,situated in the Province of Negros Occidental, are herebycreated in the Sixth Judicial Region.

Sec. 2. The Supreme Court shall assign the branchnumbers ofthenewly created Regional Trial Court branchesin the Sixth Judicial Region.

Sec. 3. The Chief Justice of the Supreme Court, incoorâtion with the Secretary of the Department ofJustice,shall immediately include in the Court's program theoperationalization of the additional Regional Trial Courtbranches to be stationed inthe City of Bacolod, Province ofNegros Occidental, the funding ofwhich shall be includedin the Annual General Appropriations Act. The fundsnecessary forthe operationofthe courtsherein created shallbe appropriated and released only upon the actualorganization of the courts and the appointment of itspersonnel.

Sec. 4. Section 14(g) of Batas Pambansa Big. 129,known as "The Judiciary ReorganizationAct of .

1980 , as amended, and allother laws, executive orders, andrules andregulations which are inconsistent with this Actare hereby amended, repealed or modified accordingly.

Sec. 5. ThisActshalltakeeff8ct£ifteen(15) days afterits complete publication in two (2) newspapers ofgeneralcirculation.

MEMORANDUM CIRCULAR NO.^

IMPLEMENTATION AND INSTITUTIONALIZATION OF THE NATIONAL ANTIDRUG PLAN OF ACTION

WHEREAS, Republic Act (RA) No. 9165, otherwise known as the"Comprehensive Dangerous Drugs Act of 2002," mandates the Dangerous DrugsBoard (DDB), to develop and adopt a comprehensive, unified, integrated andbalanced national drug abuse and prevention control strategy;

WHEREAS, the DDB formulated the National Anti-Drug Plan of Action(NADPA) which outlines the efforts of the government to strengthen its campaignagainst drugs and contribute to international efforts to counter the world drugproblem;

WHEREAS, the 2009 Political Declaration and Plan of Action adopted by theCommission on Narcotic Drugs provides that the Member States of the UnitedNations are fully aware that the drug problem remains a common and sharedresponsibility that requires effective and increased international cooperation; and

WHEREAS, in the Philippines, the drug problem is not merely a security orhealth issue, but also encompasses social, economic, psychological and economicinterests, requiring the unified involvement of various government agencies.

NOW, THEREFORE, the concerned agencies are directed as follows:

Section 1. Implementing Agencies. All government offices, departments,bureaus, agencies, offices and government-owned or -controlled corporations(GOCCs), shall implement the NADPA. The DDB shall serve as the lead agency inits implementation.

Section 2. Formulation of the Implementing Plan and Operations Plan forthe NADPA. The NADPA shall be implemented for a period of five (5) years. Allgovernment offices are required to formulate and submit their respective Five (5)Year Implementing and Operational Plans for the NADPA to the DDB within sixty(60) days after the effectivity of this Circular.

Section 3. Review. The DDB shall continuously improve and upgrade theimplementation of the NADPA, until the vision of a drug-resistant and eventually adrug-free country has been achieved and consistently sustained. In consultation withthe implementing government offices, the DDB shall develop a performancestandard measure to determine the accomplishment status of the implementation ofthe NADPA.

In order to evaluate the NADPA, the DDB, \with the assistance of thePhilippine Statistical Authority (PSA), shall conduct a nationwide survey of drugprevalence In the country every three (3) years, the results of which shall be utilizedfor policy formulation on drug prevention and control.

Section 4. Implementation of a Drug-Free Workplace Program andAuthorized Drug Testing. All government offices shall formulate and adopt theirown drug-free workplace programs and conduct authorized drug testing amongofficials and personnel pursuant to DDB Resolution No. 2 (s. 2004) and Civil ServiceCommission Memorandum Circular No. 13 (s. 2010). The Department of Labor andEmployment (DOLE) shall ensure the implementation of drug free-workplace policyand programs in the private sector, pursuant to DOLE Department Order No 53 (s2003). ^ •

Section 5. Submission of Reports and Reviews to the DDB. To assist theDDB in its review of the NADPA within the five (5) year target implementation, allgovernment offices shall submit the following reports to the DDB, relative to theirrespective accomplishments in relation to their NADPA tasks, undertakings,programs and projects:

a. Annual reports, to be submitted in the month of February of the succeedingyear being reported;

b. Final review, to be submitted in the month of February on the fifth year of thefive (5) year target implementation.

All submissions by government offices shall include an evaluation in relationto the performance standard measure, as mentioned in Section 3 of this Circular.

Section 6. Role of Local Government Units (LGUs). In the implementationof their respective anti-drug programs, LGUs are enjoined to actively assist in theimplementation and institutionallzation ofthe NADPA by ensuring that their programsare parallel or in support of the programs of implementing agencies.

Section 7. Role of the Private Sector. Non-government organizations, civilsociety organizations and private institutions are enjoined to actively participate inthe implementation and institutionallzation of the NADPA, by conducting programswith the end of achieving a drug free workplace in the private sector.

Secdon 8. Funding. All implementing agencies are authorized to chargeagainst their current appropriations such amounts as may be necessary to carry outthe provisions of this Circular, subject to the applicable laws and budgetary,accounting, and auditing rules and regulations. For succeeding years, all agenciesare directed to program such amounts, as may be necessary for the implementationof the NADPA orany other similar plan of action, in their respective budgets.

Section 9. Repeal. All orders, issuances, or parts thereof, which areinconsistent with the provisions of this Circular, are hereby repealed or modifiedaccordingly.

Section 10. Separability. If any provision of this Circular is declared invalid orunconstitutional, the other provisions not affected thereby shall remain valid andsubsisting.

Section 11. Effectivity. This Circular shall take effect immediately.

DECLARING A STATE OF NATIONAL CALAMITY

WHEREAS, Typhoon Nona (international codename: Melor) caused widespreaddestruction, substantial damage, and deaths in several areas, including the provinces of Albay,Northern Samar, Oriental Mindoro, Romblon and Sorsogon.

WHEREAS, pursuant to Republic Act No. 10121, or the Philippine Disaster Risk Reductionand Management Act of 2010, the National Disaster Risk Reduction and Management Council(NDRRMG) has recommended the declaration of a State of National Calamity;

WHEREAS, the declaration of a State of National Calamity will hasten the rescue,recovery, relief, and rehabilitation efforts of the government and the private sector, including anyinternational humanitarian assistance; and

WHEREAS, this declaration will, among others, effectively control the prices of basic goodsand commodities for the affected areas and afford the government ample latitude to utilizeappropriate funds for rescue, recovery, relief, and rehabilitation efforts of, and to continue toprovide basic services to, affected populations, in accordance with law.

fNOW, THEREFORE, I, BENIGNO S. AQUINO III, President of the Republic of the

Philippines, by virtue of the powers vested In me by the Constitution and by law, do hereby declarea State of National Calamity.

All departments and other concerned government agencies are hereby directed toimplement and execute rescue, recovery, relief, and rehabilitation work in accordance withpertinent operational plans and directives.

All departments and other concerned government agencies are also hereby directed tocoordinate with, and provide or augment the basic services and facilities of, affected localgovernment units.

Law enforcement agencies, with support from the Armed Forces of the Philippines, arehereby directed to undertake all necessary measures to ensure peace and order in affected areas,as may be necessary.

The State of National Calamity shall remain in force and effect until lifted by the President.i
