COMMISSION DECISION
of 07/08/2012
on the adoption of a special measure in favour of the Republic of Namibia, to be
financed from the 10th European Development Fund
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard tothe Partnership Agreement between the members of the African, Caribbean
and Pacific Group of States of the one part, and the European Community and its Member
States of the other part, signed in Cotonou on 23 June 20001, as revised at Ouagadougou,
Burkina Faso on 22 June 20102(hereinafter referred to as the "Cotonou Agreement"), and in
particular its Article 73,
Having regard to Council Regulation (EC) No 617/2007 of 14 May 2007 on the
implementation of the 10th European Development Fund under the ACP-EC Partnership
Agreement3, and in particular Articles 5 (4) and 8(1) thereof,
Having regard to Council Regulation (EC) No 215/2008 of 18 February 2008 on the Financial
Regulation applicable to the 10th European Development Fund4 and in particular Articles
21(a)22 and 23 thereof,Whereas
(1) The Namibian government is committed to providing safe, secure and effectiveinfrastructure and services which are responsive to the socio-economic needs of the
population and within the framework of regional integration in the Southern African
Development Community (SADC) region. The vision 2030 target is: 100% of all
roads to be in a good or at least fair condition. Despite the Government of the
Republic of Namibia's holistic approach to roads development and maintenance,
torrential rains, especially in southern Angola and the northern central and eastern part
of Namibia, have made these efforts of roads rehabilitation very challenging due to
recurrent floods. The impact of the 2011 floods in northern Namibia has been
cumulative, with more devastation and human suffering due to the prolonged nature of
the disaster.

(2) In May 2011, the Government of Namibia requested the mobilisation of funds forunforeseen needs under the 10th EDF for repair of the road infrastructure in the
Omusati, Oshana, Oshikoto and Kunene regions, in view of a serious threat to the
socio-economic situation in these regions. The proposed emergency intervention is
aimed at restoring access to services for the local population and contributing to socio-
economic recovery. The objective pursued by the project is to add, repair and improve
drainage infrastructures (culverts) in affected areas while following a labour intensiveapproach to create employment following the devastating flood of 2011 in northern
Namibia.
(3) The measure covered by this Decision is in conformity with the objectives of Articles55 and 72 (3) of the Cotonou Agreement.
(4) This Decision constitutes a Financing Decision within the meaning of Article 16 ofAnnex IV to the Cotonou Agreement and Article 67 of the Financial Regulation
applicable to the 10th European Development Fund.

It is appropriate to define the term substantial change within the meaning of Article7 of Regulation (EC) N 617/2007 to ensure that any substantial change in this
Decision shall follow the same procedure as the initial Decision.
(6) The measure provided for in this Decision does not enter into the category ofproposals subject to an opinion of the European Development Fund Committee as
provided by Article 8 of the Internal Agreement on the financing of the 10thEDF5. In
accordance with Article 8.3 of the Council Regulation on the implementation of the
10th European Development Fund, the EDF Committee shall be informed of this
Decision within one month following its adoption.
HAS DECIDED AS FOLLOWS:
Article 1
The special measure "Post flood rehabilitation of rural roads in northern Namibia" in favour
of the Republic of Namibia, described in the Annex to this decision, is hereby approved.
Article 2
The maximum contribution of the European Union to this measure is set at EUR 1 600 000 to
be financed from the 10th European Development Fund.
Article 3
Cumulated changes of the allocations to specific actions not exceeding 20% of the maximum
contribution authorised by this Decision shall not be considered substantial provided that they
do not significantly affect the nature and objectives of the special measure. This may include
an increase of the maximum contribution authorised by this Decision up to 20%.

The relevant authorising officer may amend the present Decision to introduce non-substantial
changes in accordance with the principles of sound financial management.
