หลกประกนภายในระยะเวลาทกำหนด

๒. การขอปลอยชวคราวเปนเรองยงยากหรอไม?

ไมยงยากศาลยตธรรมไดจดเจาหนาทประชาสมพนธไวทำหนาทให

ความชวยเหลอตงแตใหคำแนะนำในขนตอนการขอประกนตวและแนะนำวธ

การเขยนคำรองขอประกนตว๑ผขอประกน๒ตดตอขอคำแนะนำและทำคำขอ

ประกนตวผตองหาหรอจำเลยดวยตนเองไดทกขนตอนทงน เจาหนาท

คำพพากษาศาลชนตนศาลอทธรณหรอศาลอทธรณภาคจะขอปลอยชวคราวกอน

ญาตพนองผบงคบบญชานายจางบคคลทเกยวพนโดยทางสมรสบคคลทศาล

เหนวามความสมพนธใกลชดเสมอนเปนญาตพนองหรอมความสมพนธในทางอน

ทศาลเหนสมควรใหประกนได)หรอนตบคคล(เชนบรษทหางหนสวนจำกด)

สำหรบกรณผตองหาหรอจำเลยเปนกรรมการผแทนตวแทนหนสวนพนกงาน

หรอลกจางของนตบคคลนน

๕.๔ กรณชอเจาของหลกทรพยไมตรงกบทปรากฏในหลกทรพยจะตอง

แสดงเอกสารเพมเตมไดแก

ใชตำแหนงเปนหลกประกนเฉพาะตนเองหรอญาตใกลชดโดยสามารถทำสญญา

ประกนไดในวงเงนไมเกน๑๐เทาของอตราเงนเดอนหรอรายไดเฉลยตอเดอน

๖.๖ ผประกอบวชาชพเชนแพทยเภสชกรพยาบาลวศวกรสถาปนก

ผสอบบญชครผประกอบวชาชพดานสอสารมวลชนฯลฯเมอตกเปนผตองหา

หรอจำเลยอาจใชตนเองเปนหลกประกนไดสำหรบกรณความผดทถกกลาวหา

เกดจากการปฏบตหนาทหรอการปฏบตงานในการประกอบวชาชพโดยสามารถ

ทำสญญาประกนไดในวงเงนไมเกน๑๕เทาของอตราเงนเดอนหรอรายไดเฉลย

ตอเดอน

๗. การนำหลกประกนมาใชในการขอประกนตวจะตองทำอยางไร?

๗.๑กรณใชโฉนดทดนน.ส.๓หรอน.ส.๓ก.ตองมหนงสอรบรองประเมน

ราคาทดนจากสำนกงานทดนจงหวดหรอจากทวาการอำเภอในเขตททดนตงอย

แลวแตกรณซงออกใหภายในระยะเวลาไมเกน๖เดอนรบรองโดยเจาพนกงาน

ทดนจงหวดหรอผปฏบตราชการแทนหรอผทำการแทนกรณรบรองโดยสำนกงาน

ทดนอำเภอผรบรองราคาประเมนจะตองเปนนายอำเภอหรอปลดอำเภอ

ผทำการแทนหรอเจาหนาทบรหารงานทดนอำเภอ

๗.๒กรณใชสมดเงนฝากธนาคารตองมหนงสอรบรองยอดเงนฝาก

คงเหลอปจจบนจากสาขาธนาคารทเปดบญชพรอมระบขอความวาธนาคาร

จะไมใหถอนเงนจำนวนดงกลาวไปจนกวาจะไดรบคำสงเปลยนแปลงจากศาล

๗.๓กรณใชบคคลตามขอ๖.๕เปนหลกประกนตองมหนงสอรบรอง

จากตนสงกดแสดงสถานะตำแหนงระดบอตราเงนเดอนและควรระบใหชดเจนวา

จะนำไปประกนใครหากมภาระผกพนในการทำสญญาประกนหรอใชตนเองเปน

หลกประกนผอนไวกใหแสดงภาระผกพนนนดวย

๗.๔กรณใชทะเบยนรถยนตหรอทะเบยนรถจกรยานยนตผประกนตอง

นำรถมาใหเจาหนาทประชาสมพนธศาลตรวจดสภาพและประเมนราคา

6.6 Whentheprofessionalpractitionersuchasmedicaldoctor,pharmacist,nurse,engineer,architect,auditor,teacher,massmediaandcommunicationpractitionerisanaccusedordefendantforthechargeresultingfromtheperformanceofsuchdutyorpractice,he/shemayusepersonalpledgeforbailbondnotmorethan15timesofcurrentsalaryoraveragemonthlyincome.

7. ตามจำนวนเงนเอาประกนภยบคคลดงกลาวสามารถนำหนงสอรบรองนนไปใช

อสรภาพไดทกขอหาความผดเวนแตความผดทเกยวกบการจำหนายยาเสพตด

บรษทประกนภยจะคนเบยประกนภยใหแกผเอาประกนภยในกรณ

ดงน

(๑) กรมธรรมประกนภยอสรภาพกอนกระทำความผดคนเบยประกนภย

กรณเดยวคอเมอผเอาประกนภยเสยชวตและในระยะเวลาระหวางเอาประกนภย

ไมมการเรยกรองใหประกนตว

แตถาผเอาประกนภยใชหนงสอรบรองเพอประกนตวไปแลวแตยงไมเตม

วงเงนทระบไวหนาตารางกรมธรรมผเอาประกนภยสามารถขอหนงสอรบรอง

ฉบบใหมตามวงเงนสวนทเหลอโดยแจงเปนหนงสอไปยงบรษทประกนภยได

(๒) กรมธรรมประกนภยอสรภาพหลงกระทำความผดคนเบยประกนภย

ก. หากศาลไมอนญาตใหปลอยชวคราวบรษทประกนภยจะคน

เบยประกนภยใหแกผเอาประกนภยโดยหกคาใชจายในการดำเนนการไว๕๐๐บาท


ในกรณไมแน ใจวาศาลจะอนญาตใหปลอยชวคราวหรอไม

ผขอประกนควรยนคำรองขอประกนตวตอศาลเพอใหมคำสงกอนเมอศาลมคำสง

อนญาตใหปลอยชวคราวแลวจงไปตดตอขอซอประกนภยอสรภาพ

Thereisalsoanothertypeofinsurancesocalledthebailinsurance forvehicledriverwhichtheinsurancecompanyprovidesadditional protectioninadditiontothevoluntarycarinsurance.Thecertificateof thistypeofinsurancecanbeusedassecurityforbailofthedriveraswell.

โดยมไดมการผดสญญาประกนตวบรษทประกนภยจะคนเบยประกนภยกงหนงให

กบทายาทของผเอาประกนภย

ง.หากผเอาประกนภยไมผดสญญาประกนตวจนสนสดระยะเวลา

ประกนภยบรษทประกนภยจะคนเบยประกนภยใหแกผเอาประกนภยรอยละ๒๐

ของเบยประกนภย

จ.หากกรณทผเอาประกนภยไดใชหนงสอรบรองเพอประกนตว

ไปแลวแตยงไมเตมวงเงนทระบไวในหนาตารางกรมธรรมบรษทประกนภยจะคน

เบยประกนภยสวนทเกนจำนวนเงนทจะตองรบผดตามสญญาประกนตวให

จะขอปลอยชวคราวตอไปสามารถยนคำรองตอศาลขอใหถอเอาเงนสดหรอ

หลกทรพยนนเปนหลกประกนตอไปได

๑๐.๒ กรณใชบคคลเปนหลกประกน

บคคลทเปนหลกประกนอาจรองขอใหศาลอาจถอเอาบคคลนน

เปนหลกประกนในการประกนตอไปได

๑๙.๑ ผขอประกนมสทธอทธรณหรอขอปลอยชวคราวใหมกได

18. Is there a case where the provisional release has been granted without bailor or an applicant? TheapplicationforprovisionalreleaseduringtheproceedingsoftheSupremeCourtcanbefiledincasewheretheCourtofAppealor aregionalcourtofappealsentencesfordeathpenalty,imprisonment,confinement,ordetentionfortraininginthetraininginstitution,dismissesthechargebutdetainsduringtheproceedingsoftheSupremeCourtor thedefendantisunderconfinementinlieuoffine. 21.1 TheeligiblepersonstoapplyforprovisionalreleaseduringtheproceedingsoftheSupremeCourtare: 21.1.1thedefendant; 21.1.2anyinterestedperson(e.g.parents,descendant,husband,wife,relatives,personofsuperiorrank,employer,related personbywayofmarriage,persontowhomthecourtdeemsasproximate relationshipasrelativesorhavinganyotherrelationshipwhichthecourtdeemsexpedienttoapplyforbail)orjuristicperson(e.g.company, limitedregisteredpartnership)incasetheaccusedordefendantisadirector,representative,agent,partner,stafforemployeeofsuchjuristicperson. 21.2 Wheretolodgeanapplicationforprovisionalrelease duringtheproceedingsoftheSupremeCourt 21.2.1Incasewherethecourtoffirstinstancehas pronouncedthejudgment,nomatteranappealtotheSupremeCourthasnotbeenlodgedoranappealhasalreadybeenlodgedbutthecasefile hasnotbeensenttotheSupremeCourt,theapplicationforprovisionalreleaseshallbelodgedatthecourtoffirstinstancewherejudgmentisgiven.Inthiscase,ifthecourtoffirstinstancedeemsexpedienttograntaprovisionalreleaseduringtheproceedingsoftheSupremeCourt, thecourtoffirstinstanceshallhaveapowertograntaprovisionalrelease.Incontrast,ifthecourtoffirstinstancedeemsitisnotappropriatetograntaprovisionalrelease,thecourtshall,withoutdelay,sendtheapplicationwiththecasefiletotheSupremeCourtforconsideration.Thecourtoffirstinstancecannotdenyaprovisionalreleasebyitself.

21.2.2Ifthecourtoffirstinstancehasalreadysent thecasefiletotheSupremeCourt,theapplicationmaybelodgedatsuch courtoffirstinstanceordirectlytotheSupremeCourt.Ifitislodgedat thecourtoffirstinstance,thecourtshallsendtheapplicationto theSupremeCourtforfurtherconsideration. 21.3Whentolodgeandhowmanytimescantheapplicationbelodged? AslongastheSupremeCourthasnotpronounced thejudgment,theapplicationcanbelodgedatanytime.Inaddition,if theSupremeCourtdoesnotgrantprovisionalrelease,theapplication maybereappliedwithoutlimit.Itshould,however,containreasonable groundstoamendthepreviousSupremeCourtorder. 21.4 ThepronouncementoftheSupremeCourtorder WhentheSupremeCourtissuesanorder,suchordershallbeforwardedtothecourtoffirstinstanceforpronouncementto theappellant.Inthiscase,thecourtoffirstinstanceshallnotify theaccusedorthedefendantandtheapplicantwithoutdelay.

22. What are the duties of the bailor? Thebailormustbringtheaccusedorthedefendanttoappearbeforethecourtonthescheduleddate.Thebailormaydelegateanyone tobringsuchpersontoappearbeforethecourtaswell.Inthiscase, thebailormustusetheproxyformobtainingfromthepublicrelations officer.Iftheaccusedorthedefendantappearsbeforethecourt withoutthebailor,itisnotdeemedasbreachofprovisionalreleasebut itisdeemedthatthebailoracknowledgesthecourtorderandthenextdate ofanappearance. Ifthebailisgrantedwithconditions,e.g.theaccusedor thedefendantmustreporthimself/herselftotheinquiryofficialor thecourtofficial,theaccusedorthedefendantandthebailormustcomplywithsuchconditions.

๒๑.๒.๒ หากศาลชนตนสงสำนวนคดไปยงศาลฎกาแลว

จะยนทศาลชนตนทพพากษาคดนน หรอจะยนโดยตรงทศาลฎกาก ได

ในกรณทยนทศาลชนตนศาลชนตนจะรบสงคำรองไปยงศาลฎกาเพอพจารณา

สงตอไป

๒๑.๓ ยนไดตงแตเมอใดและยนไดกครง?

ตราบใดทศาลฎกายงไมมคำพพากษาจะยนเมอใดกไดและหาก

ศาลฎกายงไมมคำสงอนญาตใหปลอยชวคราวจะยนกครงกไดแตการยนครงใหม

ควรมเหตผลอนสมควรทจะทำใหศาลฎกาเปลยนแปลงคำสงเดมดวย

๒๑.๔ การอานคำสงศาลฎกา

เมอศาลฎกาทำคำสงเสรจแลวจะสงคำสงไปใหศาลชนตน

อานคำสงใหผอทธรณคำสงทราบศาลชนตนจะแจงใหผตองหาหรอจำเลยและ

ผขอประกนทราบโดยเรว

๒๒. หนาทของผขอประกนมอยางใดบาง?

ผขอประกนตองสงตวผตองหาหรอจำเลยตอศาลตามนดหรอมอบอำนาจ

ใหผอนสงแทนกไดโดยขอแบบฟอรมไดทเจาหนาทประชาสมพนธหากผตองหา

หรอจำเลยมาศาลแตผขอประกนไมมาศาลไมถอวาผดสญญาประกนแตถอวา

ผขอประกนทราบคำสงของศาลและวนนดสงตวคราวตอไปแลว

กรณศาลอนญาตใหประกนโดยมเงอนไขเชนใหผตองหาหรอจำเลย

ไปรายงานตวตอพนกงานสอบสวนหรอเจาหนาทศาลผตองหาหรอจำเลยและ

ผขอประกนกตองปฏบตตามเงอนไขดงกลาว

23. If the accused or the defendant absconds or is likely to abscond, what should the bailor do? Thepersonenforcedbythebailconditions6mayseektheassistance fromthenearestadministrativeofficerorpolicetoarresttheaccusedorthedefendant.Incasewherethereisnosuchassistance,suchpersonshallhaveapowertoarresttheaccusedorthedefendant.Afterarresting, suchpersonshallsendtheaccusedorthedefendanttothenearest administrativeofficerorpolice.

24. What is the consequence if the bailor fails to bring the accused or the defendant to appear before the court? Thefailuretobringtheaccusedorthedefendanttoappearbefore thecourtwithoutreasonablegroundsisabreachofbailconditions. Thecourt,then,shallorderthebailor,enforcedbythebailconditions,forfinepaymentandseizethesecuritiestoauctionifthefineisnotpaid. Remark Ifbailor,enforcedbythebailconditions,canbringtheaccusedorthedefendanttoappearbeforethecourtwithoutdelay,thecourtshalladjustthefinepaymentattheamountasitdeemsappropriate.

25. How can bailor appeal the fine payment order? Incasewherethereisanybreachofbailconditionandthecourtoffirstinstancehasanordertoenforcethebailconditions,thepersonwhoisenforcedorthepublicprosecutorcanappealsuchcourtordertotheCourtofAppealoraregionalcourtofappealwithinonemonthfromthedateonwhichhe/sheacknowledgessuchcourtorder.Thisappealisfreeofchargeandthereisnorestrictiononappeal.Thejudgment oftheCourtofAppealoraregionalcourtofappealisfinalandunable tobeappealedtotheSupremeCourt.

๒๓. หากผตองหาหรอจำเลยหลบหนหรอจะหลบหน ผขอประกน

จะทำอยางไร?

ผถกบงคบตามสญญาประกน๖อาจขอใหเจาพนกงานฝายปกครองหรอ

ตำรวจทใกลทสดจบผตองหาหรอจำเลยหรอถาไมอาจขอความชวยเหลอได

กมอำนาจจบผตองหาหรอจำเลยนนไดเองแลวสงไปยงพนกงานฝายปกครอง

หรอตำรวจทใกลทสด

๒๔. หากไมสามารถสงตวผตองหาหรอจำเลยมผลอยางไร?

กรณไมสามารถสงตวผตองหาหรอจำเลยโดยไมมเหตสมควรถอวา

ผดสญญาประกนศาลจะสงปรบผถกบงคบตามสญญาประกนและยดหลกประกน

ขายทอดตลาดหากไมชำระคาปรบ


หากผถกบงคบตามสญญาประกนสามารถนำตวผตองหาหรอจำเลยมาสง

ศาลไดโดยเรวศาลอาจพจารณาลดคาปรบลงใหตามทเหนสมควร

๒๕. การอทธรณคำสงปรบผถกบงคบตามสญญาประกนทำไดอยางไร?

กรณมการผดสญญาประกนตอศาล เมอศาลชนตนสงประการใดแลว

ผถกบงคบตามสญญาประกนหรอพนกงานอยการมอำนาจยนอทธรณคำสง

ศาลชนตนนนโดยยนอทธรณภายใน๑เดอนนบแตวนทราบคำสงโดยตองยน

อทธรณตอศาลอทธรณหรอศาลอทธรณภาคการอทธรณไมตองเสยคาธรรมเนยม

และไมตองหามเรองทนทรพยคำพพากษาของศาลอทธรณหรอศาลอทธรณภาค

เปนทสดจะฎกาอกไมได

๒๖. การถอนประกนตอศาลตองทำอยางไร?

ผขอประกนอาจขอถอนสญญาประกนหรอขอถอนหลกประกนตอศาล

ไดเสมอโดยตองสงตวผตองหาหรอจำเลยตอศาลเมอศาลอนญาตความรบผดชอบ

ตามสญญาประกนเปนอนสนสดลง

๒๗. นอกจากคำรองขอประกนตวแลว ผขอประกนสามารถยนคำรอง

อนๆ เกยวกบการขอปลอยชวคราวไดอกหรอไม?

ผขอประกนอาจยนคำรองขอใหศาลมคำสงในกรณอนๆไดเชนในกรณ

ทพฤตการณแหงคดเปลยนแปลงไปผขอประกนอาจขอลดวงเงนประกนหรอ

ผขอประกนอาจยนคำรองวาไมประสงคจะประกนตวตอและขอหลกทรพยคน

เปนตน

๒๘. การขอรบหลกทรพยหรอเงนสดคนจากศาลตองปฏบตอยางไร?

เมอคดถงทสดหรอศาลมคำสงอนญาตใหถอนประกนหรอสญญาประกน

สนสดลงดวยเหตอนความรบผดตามสญญาประกนสนสดลงผขอประกนสามารถ

ขอรบหลกประกนคนไดทนทโดยยนคำรองตอศาลและแนบหลกฐานคอใบรบ

หลกฐานและใบรบเงนทศาลออกใหเมอครงยนขอประกนตวหากใบรบหลกฐาน

หรอใบรบเงนสญหายตองแจงความตอเจาหนาทตำรวจและนำใบรบแจงความ

มาแสดงตอศาลโดยปกตแลวผขอประกนจะตองยนคำรองดวยตนเองหาก

ไมสามารถมารบไดดวยตนเองสามารถมอบฉนทะใหผอนมารบหลกทรพยหรอ

เงนสดแทนไดโดยใบมอบฉนทะขอไดทเจาหนาทประชาสมพนธของศาล

26. How to revoke the bail in the court? Thebailormayrevokethebailorretrievethebailsecurity atanytimebybringingtheaccusedorthedefendanttothecourt. Theliabilityunderbailisceasedwhentheapplicationtorevokethebailorretrievethebailsecurityhasbeengranted.

27. In addition to the application for provisional release, is there any application in relation to provisional release which the bailor can lodge? Thebailormaylodgeanapplicationtothecourtrequesting ordersinvariousmatters.Forexample,whenthecircumstanceincaseischanged,thebailormayapplyforthedecreaseofrequiredamountforbail,dischargeofbail,orretrievalofbailsecurity.

28. How to retrieve the bail security or deposit from the court? Wheneverthecaseisfinalorthecourtgrantsanordertorevoke thebailorthebailconditionsendbyanyevent,theliabilityunderbailconditionsisalsoceased.Thebailorisabletodemandtheretrievalofsuchsecuritypromptlybylodginganapplicationtothecourtenclosing withtheregistrationslipandthepaymentreceiptasissuedonthe submissionofbailapplication.Incaseoflossofregistrationsliporthepaymentreceipt,itisneededtoreporttothepoliceandbringalong thepolicereporttothecourt.Ingeneral,thebailorshouldsubmitan applicationbyhimself/herself.Ifthebailorcannotappeartoretrievebailsecurityorcash,thebailormaydelegateanyotherpersontoretrievesuchbailsecurityorcashbyfillingtheproxyformwhichcanbeobtainedfromthepublicrelationsofficerofthecourt.
