“Cheer up – things are getting worse!” This phrase is from an advisor to Margaret Thatcher when things looked bleak in the “winter of discontent” in the United Kingdom (circa 1978-79). The unions had a stranglehold on the economy of England, shutting down everything from garbage collection to grave digging. The government was trying to hold down an inflation rate of 26% with public sector laws controlling everything from prices to pay increases. None of the socialist government policies were working.

This scenario reminds me of New Mexico’s current situation. I guess I feel some sort of relief that it can’t get much worse. That we can’t be placed further at the bottom of any more lists. My hope is that we have hit bottom and will not continue to slide deeper. Cheer up!

My recent trip to Washington DC was less than encouraging. We talked to our elected officials, or in most cases their assistants, about the healthcare situation and our inability to raise prices enough to cover the costs of insuring our employees. They didn’t want to deal with the real, common-sense solutions we were offering them to deflect this horrible calamity we are about to experience when the healthcare law goes into full effect. Cheer up!

I am accused of being Chicken Little (the sky is falling) about issues affecting our industry, but I am actually the canary in the coalmine (providing advanced warning of danger). When you hear from me that the business climate is bad and getting worse, it’s time to stop and listen. My members are the small local businesses that are hurt every time someone wants to control the corporate big wigs on Wall Street. We are Main Street. Just look, there are more restaurants than any other business on Main Street and most are owned locally. You do not hurt Wall Street with your ill-advised social control systems, you hurt locally owned businesses on Main Street. Cheer up!

Hello Everyone!I hope that you have survived the winter doldrums and are gearing up for a wonderful spring and summer time. For many of us, we are about to enter our busy season and we need to think about new marketing and promotion ideas to remain profitable.

I believe that before looking at new marketing and promotion ideas, we need to look at our own operations. We need to look at all processes and the way we do business and make sure that our operations are as streamlined and efficient as possible. Restaurateurs are the best at adapting and changing our ways to survive. Also, besides the wonderful product you may produce, all of us, due to the current economic situation, must concentrate, improve on and provide great customer service. This is a challenge considering our skyrocketing labor costs. However, you must remember, no matter how good your product is, the customer will not return if your customer service is poor.

As far as new marketing and promotion ideas, you should look at the NMRA and the wonderful loyalty and endorsed programs that Carol and the staff have compiled. Please contact the staff at the NMRA and use the Southwest Restaurateur magazine to see what programs are available and which programs will be the most beneficial to you. These programs are effective and beneficial for everyone, but I truly believe that they can be most beneficial to those of you that are independent operators. This is another way for you to maximize your membership in the NMRA.

THE NEED FOR COMPREHENSIVE IMMIGRATION REFORM

As of this writing, several of your Board Members along with our CEO, Carol Wight, just returned from the National Restaurant Association (NRA) Public Affairs Conference in Washington DC. We once again had the opportunity to visit with our Senators, Representatives, and /or senior staff to discuss issues important to our industry. Of course, at the top of the list was Healthcare followed by Immigration Reform, Tax Issues and Minimum Wage. At the time of our visit, our leadership seemed preoccupied with gun control legislation being debated in both houses. But another issue near and dear to our industry, Comprehensive Immigration Reform, seemed to be developing bipartisan momentum, especially in the Senate, toward agreement on a variety of necessary reform elements.

The NRA has long been engaged in promoting and supporting Comprehensive Immigration Reform. We are encouraged by the current bipartisan effort and apparent commitment to fix our broke immigration system. However, there are elements of Immigration Reform we continue to insist are part of the final package.

They include:

■ Border security and efficient border enforcement that gives consideration to national border security protection while still promoting and facilitating business and tourism travel

■ Earned legalization for some of the 11 million undocumented workers currently contributing to our economy

■ An accurate and reliable federal employment verification system that replaces the state and local enforcement patchwork currently in place

■ A robust legal visa system that meets the needs of the U.S. economy by giving employers, who have made every reasonable effort to hire Americans, a workable system for hiring legal foreign workers at all skills

With the need to employ over 1.3 million new workers in our industry over the next decade, it is extremely important our national leadership achieves reasonable and common sense solutions to this issue. We can be thankful our NRA leadership has had and continues to have a prominent seat at the table throughout the Immigration Reform debate.

As a final note, several of us were on hand at our NRA Awards Dinner in Washington DC to witness our own Steve Paternoster, Scalo Northern Italian Grill in Albuquerque, receive the Cornerstone

Humanitarian Restaurant Neighbor Award. The Restaurant Neighbor Awards, sponsored by American Express, honors restaurants and individuals in the field of outstanding community service and involvement. Steve was selected from over 150 nominees nationally. With this recognition, Steve was awarded $5000 from American Express to continue his charitable work.

A BIG Congratulations, Steve, from all of us in New Mexico, for all you do for your community and our industry. Well deserved!

My article in the last edition of Southwest Restaurateur magazine was about the Health Insurance Exchange in New Mexico. While all of the information was accurate at the time I wrote the piece, much has changed since then, so I thought it would be wise to revisit the issue.

In the last article I reported that the Health Insurance Alliance was the quasi-governmental entity responsible for implementing the exchange. After that was printed, Attorney General Gary King determined that the Alliance did not have legal authority to qualify health plans. So, during the 2013 legislative session several proposals to enact a state based exchange were introduced, all different in how to approach the issue.

The bill that was successful in passing the legislature was a measure sponsored by Senator Benny Shendo (Jemez). Senator Shendo along with Senator Gerald Ortiz y Pino (Albuquerque) and Representative Tom Taylor (Farmington) worked to pass legislation to create a separate Health Insurance Exchange Board to implement a state based exchange, or marketplace for purchasing insurance.

It was my honor to work with the legislators, the Governor’s office and the leadership of the House and Senate, to negotiate a bill that would ensure that New Mexico had a state based exchange instead of relying upon the federal government to implement an exchange for New Mexico. I was very pleased to see people from both parties work together toward the goal of a state

based exchange. While the legislation is not perfect, and we know we will be back in Santa Fe making necessary changes, it was the perfect collaboration and compromise that is essential to making government work.

The board is comprised of thirteen members appointed by the Governor, the President Pro Tempore of the Senate and the Speaker of the House of Representatives and includes the Superintendent of Insurance. The legislation gave authority to the board to develop the policies that will guide the exchange. The legislation includes designating a Native American liaison, opening a walk in service center and creating a statewide consumer assistance program.

The exchange board had its first meeting April 29-30 where they elected a chair, Dr. JR Damron of Santa Fe, and vice chair, Jason Sandel of Farmington. The board is jumping into the monumental task of having the exchange operational by October 2013. I am sure by the time you are reading this article they will have had more meetings and will be well on their way to achieving the goals set forth in the legislation.

So you’ve got your restaurant design done, menu prepared, food cost set and staff hired. Now you need to get people in your restaurant and that’s going to take some marketing. It would take many more pages than this publication offers to tell you all the ins and outs of restaurant marketing, but we’ve assembled a few important ones here for you to consider.

▼ Be The soluTion To The MealTiMe dileMMa

Just because the economy is down doesn’t mean people have all the time in the world to cook at home and they will still celebrate special occasions. In your marketing messages, focus on what you can offer your customers – they don’t have to cook tonight, birthday patrons get a special dessert, they can escape from the drudgery of the day, etc.

▼ Be a coMMuniTy supporTer 52% of adults say they are more like to

patronize restaurants that support charities. Use your establishment to host fundraisers and sponsor community groups. The more you give to the community, the more they will give back.

▼ don’T ignore your weBsiTe The majority of your patrons are checking

you out on the internet before they even set foot in your door. Your website needs to be your calling card and should tell someone everything they need to know about why they should eat at your place. Suprisingly, many restaurant websites don’t even have their menu or location and phone number on their site. How are people going to find you without an address?

▼ don’T ForgeT social Media. Like it or not, social media outlets like

Facebook, Twitter, Yelp and others are here to stay. Your restaurant is being discussed on the web and you need to be a part

of it. Consider hiring a dedicated person to manage social media for you if you don’t have the time or knowledge to do it yourself. ▼ Focus on loyal cusToMers and repeaT Business

Loyalty programs don’t have to be complicated and can be an effective way to get repeat customers. Don’t make it hard for the customer to earn and give them a reason to come back often.

business community in to your place. Make sure your service and food is up to par so they will be encouraged to bring in their contacts and return. If you provide a great experience them for them, they will do your marketing for you.

▼ MainTain your Brand Your brand should encompass your whole

restaurant persona. All your advertising materials, menu, signage, etc should be a consistent reflection of your brand and what customers should expect from your establishment.

▼ Be unique Try to differentiate your business from

all the other choices your patrons have. Revamp your menu, go green, or add a new chef. Show your customers how your food quality, ambiance or customer service is different than the other guy.

▼ geT creaTive Think out of the box and do some

original promotions that are unique to your establishment. Themed dinners, special wine or beer tasting events and celebrations of unusual holidays or events can bring people in during a normally slow period.

▼ don’T do iT all Strategize your marketing and advertising

efforts in the mediums that bring you the best ROI. Focus on those so you can do them well and pass up the ones that aren’t effective for you.

We recently had the pleasure of talking with Rocky Durham, Executive Chef and Tanya Story, Executive Pastry Chef, both co-founders of the beautiful new Santa Fe Culinary Academy (SFCA) in central Santa Fe. Located in the Plaza Mercado Building in Santa Fe, SFCA has a mission to “provide excellence in culinary education for students seeking futures in the food service industry. Our program provides students with professional engagement and solid, real-world skills to achieve success in the culinary field.”

The two chefs started thinking about the academy over a year ago imagining something that was more than just a business. They are motivated by the local community and the potential that a vital culinary industry provides. Both are well aware of how much a vibrant and successful culinary industry can contribute to tourism as well as the community as a whole. According to Durham, they “wanted to repopulate the restaurant community with excellence”. They felt it was time for their community to have a professional culinary academy.

The undertaking was huge in scope and they are still putting finishing touches on some of their plans while waiting to be fully accredited. The academy has been designed into a beautiful workspace that includes two demonstration kitchens, three lab kitchens, a student run restaurant, and an events venue including the only private top floor portal in the city. The facility is specifically tailored to be a professional academy rather than just a cooking space.

For cooking professionals, they have a one-year program that encompasses all aspects of culinary education and restaurant management. The program begins in September with a five week intensive boot camp. Food safety certification and alcohol server training is completed in this phase as well as basic cooking methods, product identification and proficiency in using professional kitchen equipment. Culinary history and guest lecturers will also be part of the curriculum during this time.

After boot camp, the first rotation begins where students learn the fundamentals of pastry, garde manger and à la carte cookery as well as some front-of-the-house management skills. The program is designed so that students are exposed to all areas of running a restaurant. Durham points out that their academy is not “a chef school but rather it is designed to produce well-rounded restaurateurs who can do it all”.

Following the first rotation, the second rotation focuses on running the student restaurant. Each cohort runs through four departments: À la Carte, Garde Manger, Pastry and Dining Room. They are responsible for all aspects of the restaurant’s operations and daily lunch service. During the second rotation, students also begin externships and elective courses. SFCA has partnered with several hotels, bakeries, restaurants and farms in and around Santa Fe to provide opportunities for students to have real-world experience in their culinary pursuits. Electives allow for focus on specialized topics of interest.

The third rotation involves a more complicated dinner service with true front-of-the-house management concepts, service keys and advanced instruction in the modules.

The fourth and final rotation involves professional development in restaurant concepts of accounting, management, marketing and human resources. The final project involves complete development of a restaurant concept including everything from design and menu to budget, food cost, and marketing plans. The final project plans are presented to a panel of professionals from the community who will then select the winners to install their restaurant into the students’ restaurant modular facility. The team then runs that restaurant for the remainder of the program.

The academy offers community classes as well as opportunities for professionals looking to further their education. Weeklong intensives are offered and one-on-one instructional opportunities are available as well for specific needs. The chef-founders are excited that people see culinary education as a viable career path. They feel that industry professionals should be spending time with the next generation regardless of the industry, giving back to the community. They see their academy as a place to foster future generations of well-trained culinary professionals to enhance the culinary landscape.

The National Restaurant Association Educational Foundation (NRAEF) honored its 2013 “Cornerstone Humanitarian” award winner at an April 17 gala during the National Restaurant Association’s Public Affairs Conference in Washington, D.C.

The Foundation’s “Cornerstone Humanitarian Award,” founded in partnership with American Express, celebrates the outstanding charitable service performed by restaurant operators.

“The recipient of the 2013 ‘Cornerstone Humanitarian’ award exemplifies a level of spirit for service and giving that is so uniquely prevalent in the restaurant industry. This award shines the spotlight on the important role the industry plays helping others achieve success and fulfill their dreams,” said Rob Gifford, executive vice president of philanthropic initiatives for the National Restaurant Association Educational Foundation. “Their stories

are inspiring and highlight the very best of what the industry has to offer. We applaud their commitment and are proud to recognize their achievements.”

Steve Paternoster, owner of Scalo Northern Italian Grill, an Albuquerque institution for over 20 years and YMCA of Central New Mexico President/CEO, recipient of the 2013 “Cornerstone Humanitarian Award” will receive a $5,000 contribution to continue supporting their charitable initiatives, which Mr. Paternoster will be donating to the YMCA of Central New Mexico.

Paternoster was honored for his significant support of and contributions to non-profits and his local community. Paternoster has founded several charitable organizations, including Youth Matters, in memory of his daughter, to help teens in the children’s court system, and Haley’s Haven, a home to provide counseling, self-esteem classes and employment training for girls,

which includes a culinary component. “Right now”, says Paternoster, “besides maintaining Scalo as Albuquerque’s finest restaurant, my most important mission is helping make our YMCA locations the best in the nation.”

Celebrity chef Maneet Chauhan, judge on the Food Network’s Chopped, made a stop on her book tour in Albuquerque at the end of April. She held a special dinner at Artichoke Cafe and partnered with Sandia High ProStart students in The Cutting Edge Tour – a competition for ProStart students. Rebecca Ruiz won the competition and received a knife kit and signed cookbook. Steve Paternoster, National Restaurant Association Cornerstone Humanitarian and owner of Scalo Northern Italian Grill in Albuquerque, was also a judge. The overall national winner will be flown to Washington, D.C. to spend a day cooking in the Vice President’s home!

Makes Book Tour Stop in Albuquerque and Judges ProStart Students in Cooking Competition

As many of you already know, the City of Albuquerque Environmental Health Department adopted the 2009 FDA Food Code in October 2010. The City’s Food Sanitation Ordinance reflects the most current food science which aims to ensure public health and safety.

After 2 years of a “soft transition” the City has also updated its Food Inspection Form to more closely correspond with the adopted code. A copy of the form is available on our website in the “Resources for Restaurateurs” section. For the most part, the updated form is very similar to the previous form, but the updated form requires the inspector to be more thorough while documenting his/her observations. The most noticeable change deals with supervision and employee health. The Person In Charge is required to be present at the facility and to demonstrate appropriate knowledge of all safe food handling for their particular facility. There are 3 ways to demonstrate this knowledge – but you only need one! Attend a certified training (such as ServSafe by NMRA); receive an inspection without any “critical” or “priority” violations; OR talk with the inspector and provide them with sufficient

information to indicate your knowledge of food safety and illness prevention.

The inspector will also be documenting that the facility has a plan in place which shows that each employee is aware of the 5 reportable illnesses (Norovirus, Salmonella, E. coli, Shigella, and Hepatitis A virus) – all known to cause foodborne illnesses, and that each employee agrees to notify their Person In Charge if they are experiencing any of these illnesses.

The City of Albuquerque has information and sample FDA forms available to help the industry fulfill these requirements and maintain compliance with the 2009 FDA Food Code. The information can be obtained from both NMRA and City of Albuquerque websites or by calling your City food inspector at 505-768-2638.

The Hospitality Industry Education Foundation was pleased to send a culinary team from Gadsden High and a management team from Cloudcroft High to compete in the 12th Annual National ProStart Invitational in April. The teams competed against 40 other qualifying teams from across the country for a chance to win the national title in Baltimore, Maryland. At the national competition, hosted by the National Restaurant Association Educational Foundation, the top five teams from both the culinary and management competitions were awarded scholarships to pursue a college education.

To qualify for the national competition, students first had to win the New Mexico ProStart Invitational. The event was hosted by Ben E. Keith during their annual food show on March 27, 2013. Over $550,000 in scholarships were awarded to the first, second, and third place winning teams by The International Culinary Schools at The Art Institutes, Johnson and Wales University, Louisiana Culinary Institute, New England Culinary Institute, and Sullivan University. Sandia High and Clovis High took second and third in the culinary competition. Silver High and Taos High took second and third in the management competition.

NEW LAWS FOR ALCOHOL SERVICE

Alcohol and Gaming has issued a new memo outlining the new rules for Sunday Sales, Alcohol Server Training and Frequency and more. Here are the highlights.

SB 154 - Sunday Sales before Noon [effective June 14, 2013]: Allows alcohol to be served by the drink for on premises consumption beginning at 11:00 a.m. on Sundays, but only in local option districts that have voted to approve Sunday sales by the drink. Package sales still begin at noon on Sundays.

SB 259 - Increased Server Training Frequency/Decreased Criminal Penalty [effective June 14, 2013]: Increases the frequency of alcohol server training from 5 years to 3 years. Decreases the criminal penalty for selling alcohol to a minor from a 4th degree felony to a misdemeanor for the first offense – each subsequent offense remains a 4th degree felony.

Approved Server Training - many servers have participated or are participating in an on-line server training course called Seller Server that is NOT an approved server training provider under New Mexico law. Please warn any current or future employees not to take the server training available at www.sellerserver.com for the purpose of getting a New Mexico server permit. NMRA offers the only training for the industry by the industry.

Duplicate Permits - As of May 1, 2013 AGD no longer accepts the alcohol server permit duplicate request form via mail without a $10 money order or cashier’s check AND a copy of the server’s government issued, valid picture ID.

Firearms Signs - As of July 1, 2013 AGD will require that one of two posters be posted on your licensed premises. The first sign prohibits firearms of any kind, whether open carry or concealed, on the licensed premises and must be posted on all licensed premises that are licensed to sell beer, wine or spirits for on-premises consumption AND any establishment that has elected to prohibit firearms of any kind whether open or concealed, on its licensed premises. The second sign prohibits open carry of firearms, but informs the public of the concealed carry exception. The second sign is required to be posted on all licensed premises that do not fall into the category described previously in this paragraph.

ARE YOU NM TRUE

This summer the NM Tourism Department will be asking travelers “Are You New Mexico True?” and offering a $5000 prize to one of the best answers. The department is requesting support in gathering these New Mexico True Stories from industry partners. The winners will earn a spot in the New Mexico True Insiders Guide either online or in the 600,000 printed copies.

They have a variety of materials to help get the word out about the contest, and to encourage travelers to submit their True Stories and they need your help distributing and displaying these promotional materials. The benefit is that contestants will be submitting stories and photos of their NM travels which ideally will include your business. It’s free publicity. The promotional materials are just the start. You are also encouraged to create “NM True” experiences by naming a special item (ie. NM True Burrito) or give a free item to anyone mentioning you in their story or enter your own NM True story. BERNALILLO COUNTY TO SEE MINIMUM WAGE INCREASE

As expected, the Bernalillo County Commission voted to approve an ordinance that would raise the minimum wage from $7.50 per hour to $8.50 per hour. The minimum wage will increase by $.50 to $8.00 an hour on July 1, 2013 and another $.50 to $8.50 an hour on January 1, 2014. Then it will increase annually based on inflation with no correction for a recession. The tipped wage remains at $2.13. We will send more details on the regulations as they are implemented.

BOBBY LEE LAWRENCE WINE ACADEMY NOW OPEN

New Mexico State University hosted a grand opening for the Bobby Lee Lawrence Academy of Wine Saturday, April 20. The facility is part of the university’s School of Hotel, Restaurant and Tourism Management.

The Bobby Lee Lawrence Academy of Wine is a beverage management laboratory completed late last year inside NMSU’s Gerald Thomas Hall. Lawrence, known throughout the area as the “Southwest Wine Guy,” passed away in 2010. Marion Lawrence established the academy with a $250,000 gift to the university.

“This facility expands our ability to offer more wine education courses in the future,” said Janet Green, head of NMSU’s School of Hotel, Restaurant and Tourism Management. “More than anyone, students will get the most use out of the academy as part of their courses of study.”

NEW I-9 FORM EFFECTIVE MAY 7

The grace period for incorporating the newly revised I-9 Employment Eligibility Verification forms into the hiring process is ended. U.S. Citizenship and Immigration Services said employers could use either the old and revised versions until May 7. After that, the revised forms must be used. Employers who do not use the revised form for employees hired on or after May 8 may be subject to penalties.

Part of the delivery fleet for Ben E. Keith’s new Transportation Manager Steven Mesa has an updated look on the food distributor’s 36-foot trailer.

The company recently partnered with the New Mexico Tourism Department in wrapping the trailer with a scenic mountain vista, part of the

department’s “New Mexico True” campaign.

“Our customers love the new design on the trailer,” said Mesa. “When we’re making a delivery, some customers say it attracts business to them

because people are excited about the campaign.”

Mesa has been with Ben E. Keith for nine years, starting as a night selector. After several promotions,

he now oversees our professional driving force and the fleet of trucks, including the first “New Mexico True” unit.
