DELIGHTFUL DOCTORS DAY - 2014

Doctors Day is being celebrated in our India July 1st in fond memory of Dr. B. C. Roy ,who was born on July 1st,1882 and died on July 1st,1962 after serving as Chief Minister of West Bengal continuously for fourteen years and receiving Bharat Ratna award. Government of India has been giving Dr. B. C. Roy award on July 1st since 1976 to outstanding medical luminaries which is unfortunately not happening for the past few years,

But our Hon'ble Chief Minister of Taminadu Puratchi Thalaivi AMMA was extremely kind enough to institute Best Performing Doctors Award for 10 doctors(DME side-2,DMS side-2,DPH side-2,AYUSH side-1 and Private Allopathic side-3)for the first time from any State Government all over India. Awards for 2012 was given in last February and as per request awards of 2013 was given on Doctors Day this year in the beautifully arranged meeting in the wonderful venue at the new Omandurar Super Multy Specialty Hospital at Anna Salai, Chennai. Hon'ble Minister for Health Dr.C.Vijaya Baskar and Health Secretary Dr. J. Radhakrishnan IAS participated along with other administrative heads..IMA,TNGDA and TNMC were given due representation on the dais and speech.IMA TNSB arranged to release Special Postal Cover on Dr. B. C. Roy by Director of Postal Services .Chennai Region which was received by Hon'ble Health Minister in the same occasion and dais.

Our IMA National President Dr.J itendra Patel and Secretary General Dr.Narendra Saini requested all State IMA to organise Blood Donation Camps at all local branches.IMA state office and Blood Donation Committee Chairman Dr. S.S .Sukumar, who donated his blood more than 150 times, motivated and guided all local branches. Our sincere thanks to all branch office bearers who responded to our call and DME,DMS & IRCS for rendering their excellent cooperation to make this exercise a grand success.

IMA Head Quarters also organized Achievers Award Function at New Delhi on July 1st.Our local branches are in the process of celebrating Doctors Day function through July and early weeks of August, Nothing can be more heartening than to witness and participate with delight in the State Government organised Doctors Day function precluded by State wide Blood Donation Camps. Inauguration by His Excellency Governor of Tamilnadu Dr. K. Rosaiah.

We earnestly hope that people recognise our selfless service and join hands to participate in our Doctors Day celebration next year.

Thanking his Excellency Dr. K. Rosaiah Governor of Tamil Nadu for inaugurating the Blood Donation Camps in Chennai at Red Cross Building on 23rd June 2014. Blood Donation Camps were conducted in most of the branches. Indian Medical Association Tamil Nadu State Branch joined hands with Indian Red Cross Society Tamil Nadu State Branch made elaborate arrangements for the Blood Donation Camps throughout the State. I Thank Dr.A.Muruganathan Hony. Vice President Indian Red Cross Society Tamil Nadu State Branch and Other Office Bearers of Indian Red Cross Society for their help, Co-ordination and Cooperation in this project. Good response from all over Tamil Nadu, Blood Donation Camps validatory function was conducted on 29th June 2014 at Coimbatore. I appreciate and Congratulate the Branches who conducted the Blood Donation Camps and totally we have collected more than 5,500 units of Blood all over the Tamil Nadu. Well done Tamil Nadu!

279th State Council Meet

On June 15th we had our 279th State Council Meet at Tirunelveli, IMA Tirunelveli Branch inaugurated the IMA Mini Hall and Conducted Medical Exhibition. We had a Press meet at Tirunelveli. We appreciate IMA Tirunelveli for their commitment and elaborate arrangements and hospitality.

Paramedical Seminar and Workshop-New Logo.

On June 21st we have conducted Paramedical Workshop at Cuddalore. Nearly 800 students and nurse participated in this seminar and Workshop. Paramedical Wing has done a good job. New Logo was released by our President.

Nursing Home Board Meet

On June 22nd we have conducted 101th Nursing Home Board meeting at Cuddalore. I appreciate the IMA Cuddalore branch for the excellent arrangement and hospitality on 21st and 22nd June 2014. Good Planning done by Dr.C.Anbarasu NHB Chairman and Dr.B.Sridhar NHB Secretary.

Bharath Ratna Dr.B.C.Roy - the illustrious son of Bharath Matha whose birth and death anniversary falls on July 1st which is celebrated as Doctors Day throughout India - is our guiding force beacon light.

Past National President - Past President of Medical Council of India - Mayor of Calcutta - Chief Minister of West Bengal from 1948 - To 1962 are few of the Jewels in the crown of that great human being who became the leader of the masses because of his untiring sprit to up - hold the freedom of Indian Masses - Freedom of the medical Profession!

On this day we have a duty to protect our professional freedom - freedom of single doctor practice - small and medium hospitals. Because National governments coming out with - Laws and Acts which Jeopardize the interests of small time players in all sectors including medical sector - Because National Governments are pressurized by ‘World Trade Organization’ which resists even food subsidies for our people!! World Trade Organization of which most of curtailing the growth of the so called - substandard - population which exists in developing countries as reported in American Foreign relations sub committee white paper on population. But we as protectors of our people on this day Vow to protect our people by cautiously guarding our profession from falling prey to corporate interests and Insurance Companies. That will be the fitting tribute.

Dear colleagues,

It gives us great pleasure in addressing you through this letter. I am writing this to you after very successful 101st NHB meet. The Cuddalore IMA deserves fullest appreciation for their wonderful arrangement and organization. The seniors of the branch have blended well with the juniors and the result has been a roaring success.

We had more than 400participants. Over 6 topics were discussed and the audience had the opportunity to listen to the doyens of health care industry. They were told secrets of hospital construction in a very economical way, the legal way of having pharmacy and how to manage critical events. There was a panel discussion regarding clinical establishment act. All the leaders of IMA tried to convey the essence of this act to the audience. On the hilarious side we had debate on use of electronic medical records. The audience stayed until the end.

Nursing Home Board thanks the president and all the office bearers for their help and co-operation. NHB is also actively engaged in bringing out the norms of accreditation suitable to our hospitals. We shall be informing you soon on this. We intend to discuss accreditation in detail in the next NHB meet at Marthandam. The dates shall be announced later.

I also was part of the governing council and accreditation committee that met discussed & took decisions. The endoscopy course conducted by us, received good appreciation.

I adorned the golden robes for the colorful convocation held to award the ‘Fiams’ fellowships & Hony. Fellowships. Many received but since attendance at the convocation had been made mandatory, our members who could not attend have to receive them only at the next probably at the South Zone Conference, which is to follow.

Dear Members,Greetings from F.S.S. We sincerely thank all the FSS Members for their prompt settlement of the dues. After we taking over the FSS we have collected One Crore and Forty Lakh Rupees upto 16th dues. It is unfortunate that first time we have deleted 77 members permanently from FSS. They cannot join in FSS in future. We have circulated all the defaulters list to all the branch of IMA and we are thankful to the branches within 10 days 30 laks Rupees were then collected. Hence General Body of the FSS has decided to give 5% as incentive from the Entry fees to all the branches of IMA and also some awards and rewards for the branches which collect the maximum money. Dear members everybody knew that our FSS Scheme is much beneficial than any other Insurance schemes and we have attractive concession for the youngster to join FSS. The entry fees for below thirty years is only 3000/- while entry fees from 40 to 50 is enhanced to 50,000/-. I appeal to all the young doctors to join FSS before 40 years. Dear members the General Body has decided to delete the chronic defaulters permanently to save the scheme. We have 9504 members and members are regular in payment will be around 7000/- unless all the members are made regular it is very difficult to sustain the scheme. Dear Friends we are paying Rs.190/- per death is not for our Family Security, alone it is only for our poor colleague's family also. Last year total no of deaths are 50 and till date (upto may 2014 it is 24 deaths). We have decided to collect the money for the actual deaths and for last year's due to collect money for extra 20 deaths. Hence all the members are requested to pay the dues Rs.3800/- before July 30TH any excess money will be adjusted in the next year dues. Dear members when we started the scheme no of death is from 30 to 40 per year now increased to 50 and more and hence enrolling more and more members is a must for the viability of the scheme.

Dear members, Greetings and Doctors Day wishes from FSS of IMA – TNSB. We have dispatched the 19th premium advance amount notice to all the members. It is been posted at the respective city / town with the help of District coordinators or local branch office bearers. This is done to ensure that the demand notice reach the members. Because quite often we get the complaint that they have not received the demand notice. We also propose to send a copy of the receipt for the amount paid to the local branch office. The members can get the copy in case they do not receive it by post. We humbly request the local branch office bearers to motivate the members to pay the advance amount promptly. We have paid incentive for branches who have taken efforts to recover the old dues. We shall pay incentive for branches if all the members pay the 19th advance amount before September 30th 2014. As July is Doctor's day month the revised entry fee will be enforced from August 1st 2014 to encourage membership growth in FSS. We need more members for long time viability of the scheme. We now have 9500 odd member in FSS. If the membership increases to 15,000 in three months more incentives and benefits are propose for the members, by way of increasing the death pay and reducting the yearly premium. It is possible only if the membership raises to 15,000 with prompt payment by the members. We hope the local branch office bearers motive their branch members to join the scheme and help us to help our members family. Expecting your co-operation at all times. We have already 29 death in this calendar year. Please pay the 19th advance amount, for early and prompt settlement for our members family.FSS is aimed to help the IMA member's family in the event of death of an IMA doctor who is a member of this scheme. Non – refundable deposit Less than 30 years - Rs.2000/- 31 – 40 years - Rs.3500/- 41 – 50 years - Rs.6000/- 51 – 60 years - Rs.11,000/- And Rs.7600/- (Seven thousand Six hundred Only) as ADVANCE AMOUNT FOR 40 DEATHS SHOULD ALSO BE SENT with the Non refundable deposit amount as noted above. Dear colleagues!Greetings! IMA CGP certificate courses for the various faculties for the year 2013-14 were completed in the month of March 2014. Examinations were also conducted in the month of April 2014 and the results were intimated to the candidates individually in the month of June. Convocation will be held on 16th August 2014 at 2 P.M. at Hotel Green Park, Chennai. The successful candidates should attend the convocation and receive the certificate in person. They are informed to register themselves for the South Asia Regional Conference – 2014 which is to be held incidentally on 16th and 17th August 2014 at Hotel Green Park, Chennai. We are very happy to inform that admission for the various courses is on progress. So far 175 candidates have opted for admission in various courses. We anticipate that some more join and probably total may exceed 200. It is heartening to note that all the candidates are very keen to know the details of the curriculum and show much enthusiasm in joining these courses. This indicates the popularity of the courses gained in the recent past.

· Give authenticity to the certificate – issue it on a letterhead [though it can also be issued on plain paper] having name, address, qualification, registration number and name of the state medical council that has issued the registration number.

· Certificates must have the following:

- Your name, address, qualifications, registration number along with the name of the state medical council that has issued the registration number

- Name and address of the patient

- Exact nature of illness

- Thumb impression or signature of the person to whom it refers

- Identification marks of the person to whom it refers

- Date of issuing

- Legible signature.

· Take specific consent for disclosing illness in medical certificate [unfortunately not at all followed in India].

· Keep a duplicate copy of each and every certificate issued.

· Maintain a 'register of medical certificates, with full details of the certificates issued.

· Affix legible signature.

· Give Permanent Disability certificate only when improvement in the patients condition stops or the limb is amputed.

· State only those facts that are within your personal knowledge.

· Limit the certificate to the period during which the patient was actually under your observation.

Don't charge fees for giving certificates.

Don't issue a certificates for inadequate or extraneous reasons or based on history of illness supplied by some other person.

Don't give false medical certificates.

Don't issue certificates of competency in modern medicine to unqualified or non-medical persons.

A close study of the testimony of PW2 Dr. Sebastian would make it clear that there was no negligence or deficiency of service on the part of second opposite party Dr. P. V. George, Surgeon who conducted the first surgery on the complainant. It is to be noted that PW2 Dr. K. T. Sebastian had the opportunity to conduct a second surgery on the complainant at general Hospital, Pathanamthitta. It is further to be noted that the complainant was referred from the first opposite party hospital for further treatment at General Hospital, Pathanamthitta. The complainant was referred to General Hospital, Pathanamthitta at the request of the complainant. The complainant was operated by PW2 on 30.10.2000. Ext.P7 is the discharge card issued from General Hospital, Pathanamthitta with respect to the treatment of the complainant at that hospital. It would show that the complainant was admitted in General Hospital, Pathanamthitta on 28.9.2000 and discharged on 30.10.2000. It would further show that she was treated at that hospital for incisional hernia on right side and ovarian cyst left side. It would also show that during the said surgery PW2 had also removed appendix as the patient had appendicitis on an earlier occasion. It is also recorded in P7 discharge card that the patient was opened up on earlier occasion for appendectomy, locating appendix failed. P7 discharge card would also show that PW2 Dr. Sebastian had done appendicectomy, ovarian cyst was removed and incisional hernia was repaired. There is nothing indicative of medical negligence or deficiency of service on the part of the second opposite party doctor in doing the first surgery.16. PW2 Dr. Sebastian in his examination in-chief itself deposed about P5 medical certificate issued by him. It is deposed that by the statement in P5 certificate that during the previous surgery of appendicectomy the doctor failed to locate the appendix cannot be treated as failure of surgery. He clarified that the doctor only failed in locating the appendix during the previous surgery. In cross examination PW2 admitted the fact that

there may arise occasion of failure to locate the appendix due to infection and adhesions. It is also admitted by PW2 that in such a situation it is better to avoid further exploration for appendix as further attempt to locate the appendix may lead to complication. PW2 during his cross examination deposed in categorical on the part of the doctor who conducted the previous surgery on the complainant. No where PW2 has deposed about any negligence on the part of the second opposite party Dr. P. V. George in doing the first surgery. According to PW2, the procedure adopted by the second opposite party Dr. P. V. George can be considered as proper procedure and there was no negligence in adopting such a procedure or method by the second opposite party. Thus, the expert witness examined on the side of the complainant has only supported the case of the opposite party doctor had done all the best possible treatment and procedure and there was no negligence or deficiency of service on the part of the opposite parties.In the result, the appeal is allowed.

In continuation of the Kunal Saha Vs Kolkatta Doctors and AMRI case details, let us see about the compensation awarded by the Hon. Supreme Court of India.

I. Under the head, loss of income of the deceased, it had awarded Rs 5,72,00,550/- compensation, assuming the deceased Mrs. Anuradha would have lived upto 70yrs of age and so income for 30yrs (she was 36 at that time of demise) was calculated.

It is an established fact the she was suffering form TEN- TOXIC EPIDERMO NECROLYSIS.

What are chances for the patient to live up to 70 years?

(That disease as not caused by doctors. Only defects in management of the case were made out.)

Questions are:

1. What is the mortality rate in patients suffering from TEN? Court itself agrees it is high. Was it taken into account?

2. What is the morbidity following TEN? Will, in case of recovery, she be able to work as a normal person?

3. Court has enhanced the compensation for the delay of 15 yrs in awarding compensation and the value of rupee going down. Is the delay of 15yrs is due to the doctors &AMRI or the court process? If it is due to the court processing the case, how is it that the defendents are punished for the delay? In one of my personal case, Court awarded the same compensation I asked for 14 yrs ago.

II. The Court has awarded compensation Rs. 7,00,000 for treatment for the patient. If there were no defects in the treatment she would have spent considerable amount in the treatment of the serious disease TEN; that has not been deducted or considered.

III. Under the head loss of consortium Rs 1,00,000 was awarded. In similar cases dealing with Indian citizens, it is only between Rs 3000 to 15,000/-

IV. Under the head, pain and suffering by the patient, award was for 10,00,000/- (for all 18 days from admission to demise); will the disease TEN cause pain or not? (It is an agreed fact that the disease is not caused by the doctors.)

From the various judgement quoted in the verdict, it seems to me, that court has dealt this case as a Road Traffic Accident death case, where a normal healthy person dies due to the fault of others. Has the medical professional caused her disease TEN? No. Since the mortality rate is high, she might have died, due to disease, even with correct treatment.

But this award of compensation has a great impact on the whole of medical community. Lawyer notices received after the above verdict, use the same words in the above Judgment and the compensation claimed of late in the notices are around Rs.50, 00,000/-. So, IMA HQs has to take up the matter and rectify the situation and bring the sky high claims to the realistic, actual ground level!
