FCC FORM 620
Introduction
The NT Submission Packet is to be completed by or on behalf of Applicants to construct new antenna support structures by or for the use of licensees of the Federal Communications Commission (“FCC”). The Packet (including Form 620 and attachments) is to be submitted to the State Historic Preservation Office (“SHPO”) or to the Tribal Historic Preservation Office (“THPO”), as appropriate, before any construction or other installation activities on the site begin. Failure to provide the Submission Packet and complete the review process under Section 106 of the National Historic Preservation Act (“NHPA”)1 prior to beginning construction may violate Section 110(k) of the NHPA and the Commission’s rules.
The instructions below should be read in conjunction with, and not as a substitute for, the “Nationwide Programmatic Agreement for Review of Effects on Historic Properties for Certain Undertakings Approved by the Federal Communications Commission,” dated September 2004, (“Nationwide Agreement”) and the relevant rules of the FCC (47 C.F.R. §§ 1.1301-1.1319) and the Advisory Council on Historic Preservation (“ACHP”) (36 C.F.R. Part 800).2
Exclusions and Scope of Use
The NT Submission Packet should not be submitted for undertakings that are excluded from Section 106 Review. The categories of new tower construction that are excluded from historic preservation review under Section 106 of the NHPA are described in Section III of the Nationwide Agreement.
Where an undertaking is to be completed but no submission will be made to a SHPO or THPO due to the applicability of one or more exclusions, the Applicant should retain in its files documentation of the basis for each exclusion should a question arise as to the Applicant’s compliance with Section 106.

The NT Submission Packet is to be used only for the construction of new antenna support structures. Antenna collocations that are subject to Section 106 review should be submitted using the Collocation (“CO”) Submission Packet (FCC Form 621).

Michael A. Arbuthnot/Senior Archaeologist & Senior Project Manager
PROFESSIONAL EXPERIENCE SUMMARY ESI Archaeologist, Michael Arbuthnot, holds a Master of Science degree in Anthropology from Florida State University where he specialized in archaeological research. Mr. Arbuthnot has worked on archaeology projects in Florida, Georgia, North Carolina, California, the North Atlantic, and the Caribbean since 1997. He has surveyed, mapped, excavated, interpreted and analyzed artifacts, and published reports on a variety of diverse archaeological sites. Mr. Arbuthnot has experience assessing and evaluating sites, and has overseen numerous terrestrial and underwater projects and tasks. In 2005, Mr. Arbuthnot became the only archaeologist to have conducted a systematic survey of R.M.S. Titanic’s interior bow structure.
Mr. Arbuthnot’s research has been presented at several conferences, including the annual meeting of the Society of American Archaeology, the Southeastern Archaeological Conference, the Florida Anthropological Society, and at Rutgers University. Michael Arbuthnot is well established in the archaeological community and he has an understanding of the pertinent laws and procedures necessary for compliance with various Federal and state regulatory agencies. Mr. Arbuthnot uses this knowledge to help clients satisfy their project goals while maintaining a high professional and ethical standard. RESPONSIBILITIES WITH ENVIRONMENTAL SERVICES, INC. Responsibilities include the creation of research designs and budgets, remote sensing and terrestrial cultural resource reconnaissance and assessment surveys, diver investigations, site excavations at the Phase II and III levels, analysis, and report production. TRIBAL AND NHO INVOLVEMENT At an early stage in the planning process, the Nationwide Agreement requires the Applicant to gather information from appropriate Indian tribes or Native Hawaiian Organizations (“NHOs) to assist in the identification of historic properties of religious and cultural significance to them. Describe measures taken to identify Indian tribes and NHOs that may attach religious and cultural significance to historic properties that may be affected by the undertaking within the Areas of Potential Effects (“APE”) for direct and visual effects. If such Indian tribes of NHOs were identified, list them and provide a summary of contacts by either the FCC, the Applicant, or the Applicant’s representative. Provide copies of relevant documents, including correspondence. If no such Indian tribes or NHOs were identified, please explain. The Miccosukee Tribe, the Seminole Tribe of Florida, and the Seminole Nation of Oklahoma, were sent a letter on April 25, 2007 with information concerning the details of the proposed cellular tower project and to inquire if any group had concerns about the project. These groups were also sent communications by electronic mail and regular mail through the Federal Communications Commission's Tower Construction Notification System. At the time of this report, the Seminole Nation of Oklahoma (April 25, 2007 letter-see attached) and the Miccosukee Tribe have replied (April 30, 2007). It is likely that no further response will be issued because no archaeological sites, previously recorded historic structures, or tribal lands occur within the APE.

AREAS OF POTENTIAL EFFECTS
a. Describe the APE for direct effects and explain how this APE was determined. The APE for direct effects includes the construction site for the tower facility. The tower facility will be placed within an already existing waste water plant facility operated by JEA. The access easement approaching the site is currently paved and is part of the water treatment facility and will not be impacted by the proposed project. The APE was determined through examination of the plan maps provided by JEA, by noting the location of staked boundaries in the field, and by a JEA employee showing the boundaries in the field. Construction methods will involve placement of a monopole tower installation with a ten-foot-diameter base. The overall area to be impacted is 80 square feet (7.5 square meters) in size.
b. Describe the APE for visual effects and explain how this APE was determined. The APE for visual effects includes the geographic area around the proposed tower installation area within which the proposed tower may be seen, thus having an effect through the introduction of visual elements that might diminish or alter the setting of any historic property listed on or eligible for listing on the National Register of Historic Places. This is only the case if the setting is a character-defining feature of the property, which has contributed to NR eligibility. If the tower is visible from such a property it may also function to diminish the integrity of the property’s relationship to surrounding features and open space, thus compromising its historic significance. In accordance with the Nationwide Programmatic Agreement of March 2005, it is presumed that a one-half mile APE for visual effects is appropriate for this project, in that the proposed tower will be 198 feet tall. After visiting the site, it is our recommendation that the one-half mile diameter APE is sufficient.

c. Describe the techniques and the methodology, including any field survey, used to identify historic properties within the APE for direct effects. If no archaeological field survey was performed, provide a report substantiating that: i) the depth of previous disturbance exceeds the proposed construction depth (excluding footings and other anchoring mechanisms) by at least 2 feet; or, ii) geomorphological evidence indicates that cultural resource-bearing soils do not occur within the project area or may occur but at depths that exceed 2 feet below the proposed construction depth.
Prior to fieldwork, background research was conducted at the Florida Master Site File to determine if any historic sites or structures had been previously recorded within the area of direct effect. None were found. Shovel testing was then conducted within the area of direct effect to determine whether any cultural remains were present. One shovel test was excavated at the central installation location. The shovel test was excavated in accordance with Florida state regulations and requirements. The test was 50 centimeters in diameter and was excavated to a depth of 100 centimeters below surface. Disturbed soils were encountered from 0-80 centimeters below surface, below which was light gray sand. The contents of the shovel test were screened through quarter inch mesh mounted on a portable shaker mechanism. An inspection of the surface in the area was also completed. No cultural resources were encountered in the shovel test. The attached figure illustrates its location.

EFFECTS ON IDENTIFIED PROPERTIES

The proposed undertaking will have no effect on any archaeological or historical resources, because none are present in the area of direct effect or within the larger Area of Potential Effect. Specifically, there are no previously recorded sites or historic structures located within the APE, and no cultural remains were encountered as a result of subsurface testing within the area of direct effect.
b. Provide copies of any correspondence and summaries of any oral communications with the SHPO/THPO.
No correspondence or oral communications have occurred between the Applicant or their representatives and the SHPO/THPO regarding this project.
c. Describe any alternatives that have been considered that might avoid, minimize, or mitigate any adverse effects. Explain the Applicant’s conclusion regarding the feasibility of each alternative.
There will be no adverse effects from this project. Therefore, mitigation alternatives are not necessary.
