. . .And while we do concede.o.one potential #roblem, I

think there is support for the bill. This bill removes

the...200,000 population...limit relative to the use of

the.q.farm ro'll back, assessment procedure on farmland.

It's particularly important in.o.vast developing areas,

such as, my district where an agriculkural area suddenly

finds itself where land is...becoming extremely valuable

and...very impossible to.e.successfully Jarm on a tax

base: tax rate base on a true market value. .. .On the

other hand, this would allow the roll back concept which

would.oogive the local taxpayer a fair shake so that when

the farm is sold for development, there is a three-year

roll back. ...At that time, which makes up some of the

lost revenue. Quite frankly, there was a Constitutional

question on this.oothe experts are somewhat split but...

think that We do need a little guidance in this area

and, think, perhaps the bill willo..stimulate it. I'd

appreciate a favorable roll call.

that is the attempt to distinguish between what is an act

of classification...with respect to the real property tax.

And that, of course, can be done only by counties of over

assessed valuation of property. ...We have virtually no

case law on the matter. Dale Yung had ealled my atten-

tion to one case which...is perhaps gives some hints about

where we may be going but certainly doesn't solve it in

terms of the nev Constitutional language. My own feeling

is, that at least it is arguable and defensible that the

basic objective of this Act, that isy'the roil back device...

could be called an act of defining what is the value of

that property and on that basis it would not have to be

confined to counties of 200,000 population or over.

this particular bill is using the farmer as a camouflage to

protect the land speculators. It was a bad bill and it is a

bad bill and if it's introduced againp it'd still be a bad

bill. The land if it's held for more than three yearsy local

goverfments will lose tax revenues. If the land speculator

farms the land, his holding cdsts are .reduced so he can make

himself out to be a farmer andk..and have his taxes reduced.

And for the same amount of moneye he can hold more land and

Well, IIm just wondering...when you go in an area and

purchase property and pay what those living there generally

assum- is kwice what it's actually worth and the man is

speculating in his own mind that there's going to be future

development in that area. Itls just exactly what he's doing.Now, he in turn is putting a penalty on every property

owner in that whole township and county because he is

proving to the supervisor of assessments that that land

âs èorth more than what any Dan next to it locally is

Willing to pay. Now, you say you want to be sure and

not penalize the farmer. Well, 1et me tell you in a case

like this you're penalizing everyone of theh around this

man who individually has a speculative mind.

If I might point out that that doesnlt have a whole

lot to do with the bill. But, I agree with you, we've

had cases Where people have come in and paid unbelievable

prices for individual pieces of property or for that

matter individual homes. Hopefully, your supervisor of

assessment and your local assessor ls intelligent enough

to realize that one sale does not make Ehe basis for

assessing the whole are. Now: quite franklye wefve had

some assessors up in the northern part of the State that

have had gone, 1et the productivity-w-basis of assessment

go by' the wayside and started assessing farmland for

what it would sell for if it kere ownpd by a developer.

Now, I'm not concerned. I could care' less about a developer.

They can pay the taxes, they should pay the taxes. But we've

got some peopleg I'm not talking about one or two, I#m

26. to continue to hold the land. We are thereby forcing the

the merits of the bill. I think it is i'mportant to notice

that this bill really does not either create or destroy

the basic eoncept that was adopted, I gather two years

ago r and that is .'... -; . the m ll b'ack p rincip le . All i tdoes is say that the roll back principle, if it ever was

valid, is now made available to a11 counties. ...And

seems to me, if indeed it is validz then if there is good

reason to make it available in a1l of the counties. I

would like to say, and this point was made by several

people at the hearing of the Revenue Commz'ttee that there

does seem to be some considerable doubt as to whether or

not the roll back principle has achie'ved the purpose for

whfch it was originally adopted. And that is to slow down

the speculative process... Some felt that it had, others

felt that it had not. It seems to me thak the Senake

ought to reexamine...certainly next Session, whether that

device has workedy whether it is indeed sound. In the

me antime though, it seems ko me that it is perfectly de-

fensible to allow the same thing to be available to a1l

counties until the whole principle is reexnmined.

passed. If it is not Passed: I think they will abandon

the productivity approach and assessment whichvl think,

will cause an awful lo% of hardship, I donlt think it#

know it. Itdll put an awful 1ot of small farmers, some

pretty decent human beings that have been paying taxes on

their farms for generations out of business. It will put

an awful 1ot of land in the hands of the developers and

into the gravel pit interest up in my neck of the woods.

I would appreciate a favorable roll call. This is an

important piece of legislation both to my area of the

state and to me personally.

not meet physical standards cf the municipality. Is that

4. I'm not at a1.1 sure Ehat that isn't an accurate assessment

5. of the situation. ...HB 371 raises the maximum salaries

6. for county superintendents ofo. .assessments. It brings

them in line with the county officials. It does not touch

8. the minimum. It does not force the county board to raise

9. the salary. It gives them th+ leeway if they choose to.

qualïv.aqualified people. We weren't in a pcsition to

resulk of five yejrs effort. And the field of the sponsor

of the bill, Representative Romie Palmer. It provides

that no Yailroad shall block a railroad highway grade cross-

ing for more than ten minutes except where the train

cannot be moved by reason of circumstances over which it

has no control. It's a good bill. As I said, it'K a

result of five years study by the Joint Study Commission

and I'd ippreciate à favorable roll call.

quires the State Department of Transportation prepare or

cause to be prepared and maintaip a schedule of priority of

needs in the selection of railroad highway grade crossings.

Mr. President, this is a simple bill. I can probably

explain ik best by citing an example. Where the State,

for example, goes into a community and...owns propertyy

acquired property say for the...lstate hospital or a State

institution and a year or so later..otherefs a sewer assess-

ment that every properky owner has to pay or a street aasessment,

street paving, special assessment that every other properky

owner has to pay. This bill says that where ahy unit

of local government makes a local improvement by special

assessment or special tax which benêfits State property,

the State shall pay for the benefit so conferred on

khe same basis as any other property owner benefitted

by the improvement. ...The bill also provides and

where a special assessment proceeding is instituted

in the courtsg khe State becomes a party to a11 procqedings,

be given all the proper

and object or consent. And, also, notices shall be sent

by Registered or CerEified mail and tho--kkYorney Ggneral

certify the amount. This is a good bill. It's been long

khe persons who suffer most compensation. I think we ought

to qive people who suffer crime, as a result of crime, money

first and then we could get around to giving people money

who try to help to prevent them from..vsuffering crime. So,

it's a qood idea but I don't think it's time has come. I

think it comes...prematurely.

Well, Mr. President, Members of the Senate, 704 and

705 are.p.could be classified as companion bills. 704 has

to do with the movement of over-width...vehicles especially

those that are transportinqo..over-width materials, such as,

bulldozers and So forth are to use strictly in the soil

conservation work. The radius, I think this was has the .

radius, yes, the radius is 75 miles instead of 50 miles.

That's the sole change in it, the ch ange in the radius

from 50 to 75 miles radius. Generally speaking, this was

put in for the purpose of being able to take them to khe

point where they are to be repaired. There was some

question that...there wanted to be an amendment placed

on this...to use primarily for this particular purpose

and...the Secretary of State.a.found this objectionable

and 1, too, find i: objectionable. I think when we get

them a special privilege license that's what they ought

to live under. I appreciate a favorable roll call.
