Greetings to the Land Commissioners:

I have the right to a lot at Waikapu called Kaaikanaka, being the lot

of Alona Pake Chinese/.1. This is my thought -- let my lot be returned. The agreement made

previously between us two was that Alona would completely fence the

lot and also plant cane on the dry land inside of this enclosure,

and after five years his occupation would end and the land would be

returned to me—-that was our oral agreement in 1837.Afterwards, Aiona leased this 1otfti the aIl’I and Hoapili wahine.

However, the lot was not yet completely only some acres.

I forget the year, /40 perhaps, or 49 LsicJ when this lot was

leased.2. He completely took the water source for his cultivation only

and did not return it for us both. Therefore, my portion of culti

vation, which is the place entitled to the water source, is damaged.

Letter telling of the basis of right to the taro patches and the right

at this ‘iii of Wal.luku.

There are 49 of these patches, irrigated and dry, 8 taro patches;

there is a little kula there. The sides are as follows: On the

north, Imieu, on the east, Keahuplo and PuakeeO, on the south

the patches of Naleipuleho and the stream, on the west, Imieu. This

is my kuleana at this place. No one has hindered me until this day.

Haa sworn by the Word of God:

I have seen the place Kaai is claiming. It has within the enclosed

property, two patches named Kaaikao and Kaaiopelu is the name of the other

Lpatch]. I had these three patches built by hired laborers, also there is an

extra dry land taro patch. Kurnuhonua was leased for fish; Maluae was a patch

which his father had built; still another patch was leased for clothes, and

one patch which was a moo named Aiopelu, I had it leased myself and that is

Kaai’s right to the present time and no one has objected to him.

Keaicini sworn by the Bible

I have seen Kaaikao’s three patches. I have seen also some other

patches which Kaai has now and he has lived there since a long time ago He

had received this [right] from his parents, but

there has been objections to his occupation Aiopelu and Maluae have been

taken by the government. The officer and Kekauluohi’s attendant made a

division and some of those patches became paahao patds Cont’d pg 201, Vol. 10

No. 461 - Aipuli

The konohiki Mahuku had approved in favor of Kahakumakaai. Objections

were raised on this decision, and it was left to the tax assessors to make

the right decision.

No. 458 - Kapawa

Kawailiilii sworn by the Word of God:

I have seen Kapavia’s patches, 54 of them, at Puhakaeo which were from his

parent Nuhi. Auwae had been the heritage seeker and when he died he bequested

to Kapawa for he had raised Kapawa. Kapawa has taken good care of all of those

patches there, and there is also a pasture land at Kepuhakaeo and his boundaries

are on the north is Keahupio; on the east, Mokuhau; on the south, Puako; on the

west are Puako and the distant path and no one has objected to this land. There

has been standing there a house too, to this time.

Kuihe1an. sworn by the Bible:

I have seen that place for it was from our parents. It was his old interest 41there, and

since then I had known [about it] and when IKaiakahi died he bequested this land

to Kapawa, the patches, the pasture and the house site and since that time he

has been living there to the present without any objections.

The 4ili of Loaloa was mine from Moo, and Ioo had it from J. Puupahoe—hoe. Mine is an ancient right from my makuas.

Furthermore, in my own kuleana, of which I am telling, I used ny ownrevenues and I hired L1orkmen!/ and made two new taro patches forl5.50. However, an edge of this kuleana was objected to by thekonohiki. At this time, there are 51 taro patches remaining as mime.

Furthermore, the place which is objected to, is my kuleana. It hasbeen taken by another man, and therefore I think it should be mademine. The year it was taken was the year of our Lord 1841.My witnesses are Kekua and Kaili. Farewell to you two.

Manu sworn: I know this house lot parcel in Pualinapau, an ‘Iliin Waikapu. This true right was from Pika. Pika lived there from1837 in peace, until 1846. Pika died in 1847 and at this timeLthe claim! was opposed by Kimo Lutera flames Louzada/, who wasliving in Waimea on Hawaii; his reason bing that an edge of hisland entered into this house lot of Pika. The heirs of Pika areLuukia, Naehu and Ihuula. The boundaries are: mauka and Waiheethe land of James Louzada, Kula by Government Lot, Maalaea, the‘Ill of Kaaa.

Keliiolelo sworn: I know that place was for Pika and I and myson—in—law, James Louzada, hired /the workmen! to fence the lotand at that time no one opposed us. At the time my son—in1sw’and I measured, we measured the entire lot. We never heard thatanyone objected at that time, that is what I know.

Because of this dispute, the Land Commissioners made the followingdecision: “Let this claim of Pika, for which Naehu petitions forthem, be sold,” And Luukia, the widow of Pika, agreed to sellthat place for *17,50. James Louzada was to give this said sum.That was the decision by the Land Commissioners.

Furthermore, I have 2 lo’i at Kaloapelu which I received from Ku,and /2/ io’is at Kaopala, a total of 4.

There is also a kula which is planted with a row of hala trees,a row of sugar cane clumps, a mala of bananas, and other things.

There is also a kula enclosure for pigs and two houses of anarea of perhaps one and a half acres, and another acre, whose size,however, is not known. A:Lso I have 1 lo’ i at Kapaiaalaea which I received from Puhele and I{ainoa. All these claims combined total 8.

Greetings to the Land. Commissioners: I hereby state my claim forland at Hamalcuapoko. There is a, kula, named Nokuol which is onlya kula -- there are no peop:Le there and it is uncultivated. Since Iwanted it I asked the konohik whose land this was.

Here are some other claims, for some cultivating lots at Paia.There are :14 and 1 cattLe enclosure and three drinking water springs.I have tio lands inherited from my father—in—law. I also have someku:Las there.

Here is another claim for 3 taro lo’i at Haiku in Hamakuaioawhich I received from Kahaieahu, however, it was I who dug and madethem into lo’is. Kekuaiwahia is an eyewitness and some other peopleliving there; and also a pli planted with potatoes.

Furthermore, I believe that I may or may not have a claim atHamakuapopko, the reasonfor which I will explain to you.
