T he Native Nations Institute (NNI), under the auspices of NNI TV/Radio, is launching a new ten-part radio series, “Native Nation Building,” on January 24, 2006, via the AIROS Native Radio Network and its tribal and public radio affiliates across the United States and Canada. “‘Native Nation Building’ is designed to share with Native people and the general public the lessons about indigenous self-gov- ernance and economic develop- ment that NNI has learned through more than two decades of community-based research with Native nations,” said NNI direc- tor Manley A. Begay, Jr., a citizen of the Navajo Nation. Featuring a notable group of guests that ranges from govern- mental, business, and community leaders to scholars and educators, the roundtable interview program chronicles the growing number of nation-building success stories cur- rently taking hold across Indian Country and explores the roots of those successes. “The ten program segments examine different aspects of where, how, and why indigenous nation building is taking place, as well as fundamental issues that affect Native nations’ efforts to exercise sovereignty, restore eco- nomic vitality, and shape their own futures,” said Ian Record, NNI’s curriculum development manager and producer of NNI TV/Radio. sidebar), the Udall Center inaugurates anew format for its public-policy mono-graphs: books.

Under the imprint, Udall Center Pub-lications, the books will support the Cen-ter’s mission of research and outreachrelated to environmental policy, immigra-tion policy, and indigenous nations policy.

In addition, Udall Center Publicationswill solicit manuscripts from collaborat-ing faculty and researchers at the Univer-sity of Arizona, particularly Udall CenterFellows, and collegues at other institu-tions.

The books will be published as small-format, library-quality paperback edi-tions (ranging in lengths of 50 to 100pages) and also will be offered as PDFfiles on the Center’s Web site.

The scarcity of water in the American West and theincreased demands for the resource have created

much tension of late between tribes, endangeredspecies advocates, and the holders of water rightsgranted by the states for non-Native consumptiveuses.

As tribes actively quantify their water rights andpursue development projects that enable them to usethe water, they are faced with a seemingly insur-mountable problem: how can tribes ensure the protec-tion of critical habitats for endangered and threat-ened species under the Endangered Species Act and atthe same time avoid impacts to future tribal econom-

ic development in the face of federal consumptive-water-use restrictions?Lester provides a general overview of tribal water rights followed by a description of

the Endangered Species Act, specifically the requirements imposed by the act that providefor the protection of habitat for listed species. Next, she offers a discussion about the inter-section of critical habitat designation and the development of consumptive water use onreservation lands and presents a case study of the critical habitat designation of the silveryminnow in the Middle Rio Grande River, N.M. She concludes with an evaluation of tribal andagency recommendations regarding critical habitat designation in Indian Country and setsout further recommendations for protecting both species habitat and tribal sovereignty.

Joan Timeche, NNI's assistantdirector, serves as principal investigator for the project.

UUdall FFoundationThe Udall Center received $296,000 from the Morris K.Udall Foundation to support an annual workplan of activitiesrelated to indigenous nations policy, environmental policy andconflict resolution, publications, a policy workshop, andmaintenance of the Udall Archives and related library pro-

grams at the University of Arizona Library. Udall Centerdirector Stephen Cornell and deputy director Robert Varadyserve as co-principal investigators for the workplan activities.

W. KK. KKellogg FFoundationThe W. K. Kellogg Foundation has awarded the NativeNations Institute $75,000 to support a preliminary projectthat explores conceptions of governance among indigenouspeoples in the United States, Canada, and Australia. The proj-ect includes a set of conversations between indigenous leadersfrom the three continents about what governance means tothem and the forms governance takes in their communities.Udall Center director Stephen Cornell is principal investiga-tor on the project.

To encourage faculty, independentresearchers, and students to use thesematerials, the Udall Archives ResearchTravel Grant awards up to two $1,000research travel grants per year. Prefer-ence is given to projects relating toissues addressed by Morris K. Udalland Stewart L. Udall during their longcareers of public service: environment,natural resources, Native Americanpolicy, conservation, nuclear energy,

public policy theory, and environmen-tal conflict resolution.

Recent recipients of travel grantsinclude Douglas Harris, a professor ofpolitical science at Loyola College, whoinvestigated Morris Udall's influence incrafting liberal coalitions to secureleadership positions in the U.S. Houseof Representatives, and Daniel Cobb, aprofessor of history at Miami Universi-ty of Ohio, who used the papers ofStewart Udall and other materials tohelp analyze how the notion of tribalself-determination moved from theperiphery to the center of U.S. politicsduring the 1960s.

Eligibility: The grants are open toscholars, students, and independentresearchers.

Awards: The $1,000 research grantssupport only travel (and relatedexpenses) to Tucson, Ariz.

Application procedures: Applicationsare accepted and reviewed throughoutthe year. Mail a completed applicationform with three sets of the followingmaterials: (1) a brief essay (2-4 pages)describing your research interests andspecific goals of your proposed project,and (2) a resume or curriculum vitae(2-3 pages).

Research Travel Grants Available to Study Udall Archives

In 1998, Indian housing entered a new era. The Departmentof Housing and Urban Development (HUD) ended its prac-tice of channeling funds for Washington-designed Indianhousing programs to HUD-sponsored local Indian HousingAuthorities (IHAs) and converted programmatic funds intoblock grants to tribal housing agencies, which were allowedto design and implement their own programs.

“The hope was that increased tribal control would great-ly improve the quantity and quality of housing available inIndian Country,” said Miriam Jorgensen, NNI’s associatedirector of research. Jorgensen is author of a 2004 reportrecently made available in the Joint Occasional Papers onNative Affairs series, co-published by NNI and the HarvardProject on American Indian Economic Development.

In this paper, Jorgensen analyzes the differential successof the IHAs and provides important information about theconditions under which the new tribal efforts will be suc-cessful. Her results suggest that unless the new approachaddresses core issues of tribal governance, it will be inade-quate for real reform of Indian housing.

“IHAs that have access to capable judicial, political,bureaucratic, and socio-cultural governance mechanisms arebetter able to enforce rent payment, deter vandals, and con-strain official opportunism,” said Jorgensen, “and these arefactors that negatively affect IHA performance.”

And according to Jorgensen, IHAs located in environ-ments that lacked such governance institutions are less ableto develop and maintain the community’s housing resources.

“Thus, unless tribal housing program development pro-ceeds hand-in-hand with tribal institutional development,the promise of new, tribally controlled programs may gounfulfilled,” she concludes.

On a recent, cold November morn-ing, students and teachers from

Pima Vocational High School dippedtheir nets and test tubes into the SanPedro River and, amid the streamsidevegetation and birdsong, discovered thesurprising beauty of a desert river.

Under the auspices of theECOSTART program, the group, fromnearby Sierra Vista, Ariz., began theirday’s venture with a stop at San PedroHouse, the point of access into the SanPedro Riparian National ConservationArea, a 40-mile riparian corridor, run-ning from the U.S.-Mexico bordernorthward into Arizona. The corridor ismanaged by the Bureau of Land Man-agement.

At San Pedro House, the grouplearned to “read the land” from a largetopographic map of the San Pedrowatershed, then trekked to the river tobegin their foray into environmentaleducation. Before this visit, none of thestudents had seen a flowing river in Ari-zona.

ECOSTART – now moving into itsthird phase with support from ArizonaProject WET, the Morris K. Udall

Foundation, and the University of Ari-zona Foundation – aims to educateteachers and students about the SanPedro River and how citizens and com-munities can help the survival of theriver’s ecosystem.

The San Pedro River and its associat-ed habitat represent a premier wildlifecorridor in an otherwise harsh andsemiarid landscape. The delicate bal-ance of the river’s flow, arising fromsurface and groundwater sources, isnow subject to significate alteration dueto the combination of the region’s cli-mate and the increasing consumptiveneeds of the area’s booming economy.

The group from Pima VocationalHigh School participated inECOSTART through the school’s“Poetry, Spirit and Water: Saving aThreatened River Project.”

Another group of teachers fromnearby Buena High School visited theSan Pedro as part of a two-day, contin-uing-education workshop, also inNovember. The teachers aspired toimprove their understanding of thegeography and ecological processesassociated with the river and to develop

curriculum content through which theycould use the river as a natural laborato-ry for teaching their students.

The teachers learned how publicpolicy and planning, ranging from thelocal to the international level, can playa strong role in water quality and in thequantity of the river’s flow.

With support from the W. K. Kellogg Foundation,the Native Nations Institute hosted representativesfrom Reconciliation Australia – Jason Glanville, pol-icy and partnerships director; Tanya Hosch, projectmanager for the Australian Indigenous LeadershipCentre meeting; and Rowena Withers, IndigenousGovernance Awards project coordinator – on atwo-week fact-finding trip to meet with indigenousleaders from across the United States.

Reconciliation Australia is an independent, non-government foundation, based in Canberra, estab-lished by Australia’s Council for Aboriginal Recon-ciliation to provide national leadership on reconcil-iation (see www.reconciliationaustralia.org).

The visit was part of an ongoing collaborativepartnership, commencing in 2002, between NNI,Reconciliation Australia, and other institutions inAustralia interested in indigenous goverance.

“The visit showed persuasively that a dialoguebetween aboriginal Australian and Americanindigenous leaders about the nature of indigenousgovernance could produce insights and learning onboth sides,” said Stephen Cornell, director of theUdall Center and coordinator of the exchangeprogram.

The Good Neighbor Environmental Board - com-prising representatives from federal agencies,state and local governments, nongovernmentalorganizations, and the private sector - is an inde-pendent committee that advises the U.S. presidentand Congress on "good-neighbor" practices andpolicies related to environmental issues and infra-structural needs along the U.S.-Mexico border.

In October 2005, hosted by the Tohono O'od-ham Nation, the board met in Tucson, Ariz., to dis-cuss topics related to border security and the envi-ronment.

The Native Nations Institute for Leadership,Management, and Policy (NNI) - founded by theMorris K. Udall Foundation and the University ofArizona, and housed at the Udall Center - servesas a self-determination, self-governance, anddevelopment resource for indigenous nations inthe United States, Canada, and elsewhere.nni.arizona.edu

Under the auspices of the University ofArizona’s Indigenous Peoples Law andPolicy Program in the John E. Rogers Col-lege of Law, Stephen CCornell and JoanTimeche conducted an executive educa-tion session in October for the membersof the council of the Cold Lake FirstNation from Alberta, Canada.

In November, Cornell, Timeche, andMiriam JJorgensen attended the 62ndannual session of the National Congress ofAmerican Indians, held in Tulsa, Okla.Accompanying the trio were representa-tives from Reconciliation Australia visitingthe United States through the KelloggFoundation-funded program, “ExploringIndigenous Governance” (see related arti-cle on page 5).

And in December, Cornell spent twoweeks in Australia as part of an ongoingexchange between the Udall Center/NNIand Reconciliation Australia and Aus-tralian National University’s Centre forAboriginal Economic Policy Research.Cornell serves as a member of the adviso-ry committee for the two organizations’Indigenous Community Governance Pro-ject. In Darwin, he met with the commit-tee and then facilitated a panel and work-shop on indigenous governance capacitybuilding. Later, Cornell met with officialsof the Northern Territories government inDarwin, and then with national govern-ment officials in Canberra, to discussindigenous policy issues.

Anne BBrowning-AAikken contributed tothree posters presented at the Fifth Annu-al Meeting of the Center for Sustainabilityof semi-Arid Hydrology and RiparianAreas (SAHRA) at the University of Ari-zona held in October: “ECOSTART: Bina-tional Environmental Education in theUpper San Pedro River Basin, Arizona andSonora” (with Denisse FFisher, a graduate

research assistant at the Udall Center, andother ECOSTART co-authors), “IncludingClimate Change into Water ResourcesManagement Decisionmaking: Applicationin the Upper San Pedro Basin” (with AleixSerrat-CCapdevila, a graduate researchassociate at the Udall Center, and otherSAHRA co-authors), and “SAHRA andUdall Center Internship: Applying Bina-tional Experiences and Technology toImprove Brazilian Water Management in aSocial Context” (with other SAHRA co-authors).

Robert VVarady attended the FourthConference of the International WaterHistory Association (IWHA) in Decemberheld at UNESCO headquarters in Paris,France. The theme of the conference was“Water and Civilization.” Varady, theIWHA’s secretary, delivered a keynoteaddress on “The International Hydrologi-cal Programme and the ‘World of Water.’”

Kimberly AAbraham is now an adminis-trative associate working with Udall Cen-ter Steve Cornell.

Emily DDellinger joined the Udall Cen-ter this January as a research and editorialassociate, working with researchers in theCenter's Environmental Policy Programsand with Udall Center Publications staff.

Katherine MMeehan, a doctoral studentin geography and regional development,has joined the Center's EnvironmentalPolicy Programs team this semester asgraduate research associate. Law studentMark BBlair began work this semester asgraduate research assistant for NNI andSuzanne SSombrero, a master’s student inpublic administration and policy alsobegan work for NNI as a graduate researchassistant.

Keith LLarrimore, a pre-computer sci-ence junior, joined the Center in Decem-ber as an undergraduate assistant.

Dr. MManuka HHenare, from the Universityof Auckland in New Zealand, was a visitingscholar at the Udall Center for two weeksin October and November. Henare isassociate dean of Mâori and Pacific devel-opment, founding director of the MiraSzászy Research Centre for Mâori andPacific Economic Development. While atthe Center, Henare worked on research

and book projects having to do with Mâorinatural resources and governance, includ-ing one on fisheries management, withManley Begay and Ian Record. His visitputs into practice an agreement reachedbetween the Udall Center and the MiraSzászy Research Centre to foster researchand scholarly exchange and cooperation.

For more than twenty years, Robert Varady,deputy director of the Udall Center, haspursued the academic’s approach to U.S.-Mexico border environmental policy –through an active research agenda.

But, it turns out that his work, in addi-tion to producing a body of research pub-lications, has helped advance, along withthe work of other scholars, public partici-pation and dialogue related to environ-mental issues and decisionmaking in theregion.

His research began in the mid 1980swith a study of the impacts of coppersmelters on air quality in the borderregion. The effort pulled together panelsof scientists and other stakeholders to dis-cuss in an open forum the scientific,social, and policy dimensions of the issue.

The success of that model in providingthe space, or forum, in which to holdpublic dialogue on contentious environ-mental issues became the basis for manysubsequent efforts.

By 1989, Varady had become associatedirector of the Udall Center, and with theCenter’s director, Helen Ingram, and thelate Albert Utton, professor of law at theUniversity of New Mexico, initiated whatwould become a decade-long relationshipwith the Ford Foundation.

The relationship fostered the estab-lishment of binational venues in whichkey individuals from academia, govern-ment agencies, and nongovernmental

organizations met to present and shareknowledge and perspectives on borderenvironmental policy.

“When we held our first gathering in1991, there was virtually no infrastruc-ture in Mexico to support nongovern-mental environmental organizations,”said Varady, “because financial and humanresources were very limited.”

But it was at one of the Ford Founda-tion-sponsored workshops, held in 1996,that the notion was hatched on conven-ing a regular border meeting, or encuen-tro fronterizo, to encourage the growthand maturation of nongovernmentalorganizations on both sides of the border.

The first Encuentro Fronterizo washeld in Ciudad Juárez in 1998, and it andsubsequent meetings have attracted hun-dreds of individuals and NGOs.

The gatherings, organized by a bina-tional partnership of universities and

nonprofit organizations, have provided aconvergence of interests, ideas, and fund-ing to support NGOs working on envi-ronmental issues in the border region.

In 1994, the C. S. Mott Foundationjoined the Ford Foundation in fundingthe Udall Center to recommend strength-ening public participation within theemerging NAFTA-related border envi-ronmental institutions – the Commissionfor Environmental Cooperation (CEC),Border Environment Cooperation Com-mission (BECC), and the North Ameri-can Development Bank (NADBank).

One lasting outcome has been BECC-net, the Udall Center’s 11-year-old elec-tronic discussion group.

More recently, Varady has participatedas a member of the Good Neighbor Envi-ronmental Board (GNEB), an advisorybody that calls attention to particularissues related to the border environmentand advises the president and Congress.

The GNEB experience also taps intoVarady's experience as a researcher sincethe board considers issues of specialinterest and prepares explanatory andanalytical reports.

“As a researcher, I didn’t really getinvolved in this to change the world,” saidVarady, “but it is satisfying to see that realworld changes can be addressed throughscholarship – and to have had a hand inthe progress.”
