NOTICES DEPARTMENT OF AGRICULTURE Order; Training and Certification for Certified Park- ing Meter Inspectors Section 1. Purpose; Authority; Duration. This Order is a temporary order establishing training and certification requirements and procedures for persons seeking to become Certified Parking Meter Inspectors, and is authorized under the Consolidated Weights and Measures Act, at 3 Pa.C.S. § 4115(b). This Order is effective as of March 8, 2019 and shall remain in effect until March 9, 2020—one year from date of issuance. Section 2. Definitions. The following word and terms, when used in this order, have the following meanings, unless the context clearly indicates otherwise: Act—The Consolidated Weights and Measures Act, 3 Pa.C.S. §§ 4101—4194. Certified parking meter inspector or CPMI—An indi- vidual who is certified by the Department of Agriculture to inspect and certify the accuracy of parking meters. Department—The Department of Agriculture of the Commonwealth. Section 3. Certified parking meter inspector. (a) General. A person may apply to the Department to be designated a certified parking meter inspector (‘‘CPMI’’) for purposes of the Act and this order. (b) Authority. A CPMI may inspect and certify the accuracy of parking meters as required by the Act. (c) Fees. A CPMI may charge a fee for inspection and testing services. Section 4. Certification standards. A person seeking a CPMI certificate from the Depart- ment shall do the following: (1) Successfully complete an approved training course as described in Section 5 (relating to training courses). (2) Pass a Department-administered or Department- approved written test by a score of at least 70%. (3) Possess or have access to field standards and test equipment as necessary to inspect, determine and certify the accuracy of parking meters, as required under the Act. (4) Comply with the application requirements described in Section 7 (relating to applying for certification) and other requirements of this order. (5) Be at least 18 years of age. Section 5. Training courses. (a) Department-administered courses and Department- approved courses. The Department-administered parking meter certification training course meets the require- ments of subsection (b) and is an approved training course. The Department will approve additional parking meter certification training courses that meet the applica- tion and course-content requirements of this Section. (b) Training course; hours and content. A Department- approved parking meter certification training course shall consist of a minimum of four (4) hours of instruction, with at least two (2) hours of classroom training and at least two (2) hours of hands-on training. The training course shall cover the following topics: (1) Basic operation of mechanical and digital parking meters. (2) Determination and use of appropriate field stan- dards. (3) Familiarization with documentation requirements. (4) Inspection and testing procedures. (5) Noting deficiencies and reporting results. (c) Application for approval by Department. A person seeking the Department’s approval of a parking meter certification training course shall apply in writing to the Department and provide the following: (1) A course outline. (2) A description of the subject matter to be addressed in each component of the course, addressing all of the course topic requirements set forth in subsection (a). (3) The name and background information of each course instructor, a description of the subject matter to be addressed by that instructor and information to demon- strate the familiarity of the instructor with that subject matter. (4) A list of the dates, times and locations at which the training course is to be presented. (5) A copy of the proposed written test, together with a copy of the answer key. (6) Verification that the person conducting the course shall issue a certificate of completion to any person who successfully completes the course, and shall promptly report the results of the testing required under Section 4, Paragraph (2) (relating to certification standards), above, in writing to the Department. (7) Such other information as the Department may reasonably require. (d) Obtaining the list of current approved training courses. The Department will provide a current list of approved training courses upon request, and will main- tain a copy of the current list on its internet website: www.agriculture.state.pa.us. (e) Effect of addition of a course to list of courses. If a training course is added to the list described in subsection (d), a person who has successfully completed that course within six (6) months preceding the date the Department approved the course will be deemed to have successfully completed an approved training course as described in Section 4, Paragraph 1 (relating to certification stan- dards). That person must also meet the requirements of Section 4, Paragraphs (2), (3), (4) and (5) in order to be designated a CPMI. Section 6. Audit by Department. The Department may attend and audit an approved training course to ascertain whether the course is con- ducted in accordance with the Act and this order. Order; Training and Certification for Certified Park-ing Meter Inspectors

Section 1. Purpose; Authority; Duration.

(3) Possess or have access to field standards and testequipment as necessary to inspect, determine and certifythe accuracy of parking meters, as required under theAct.

(4) Comply with the application requirements describedin Section 7 (relating to applying for certification) andother requirements of this order.

(5) Be at least 18 years of age.

Section 5. Training courses.

(a) Department-administered courses and Department-approved courses. The Department-administered parkingmeter certification training course meets the require-ments of subsection (b) and is an approved trainingcourse. The Department will approve additional parkingmeter certification training courses that meet the applica-tion and course-content requirements of this Section.

(b) Training course; hours and content. A Department-approved parking meter certification training course shallconsist of a minimum of four (4) hours of instruction, withat least two (2) hours of classroom training and at leasttwo (2) hours of hands-on training. The training courseshall cover the following topics:

(1) Basic operation of mechanical and digital parkingmeters.

(2) Determination and use of appropriate field stan-dards.

(3) Familiarization with documentation requirements.(4) Inspection and testing procedures.(5) Noting deficiencies and reporting results.(c) Application for approval by Department. A person

the date, time and location of the training course. Aperson offering or conducting an approved training courseshall allow the Department’s auditors entry to the pro-gram and provide copies of course materials.

Section 7. Applying for CPMI certification.

(a) Application required. A person who has successfullycompleted a Department-administered or Department-approved parking meter certification training course mayapply to the Department for a CPMI certificate. Certifica-tion is granted through issuance of the certificate de-scribed in Section 8 (relating to CPMI certificate).

(b) Form of application. A person seeking certificationunder the Act may obtain an application form from theDepartment using the contact information provided inSection 14 (relating to contacting the Department). Theapplicant shall complete the form and return it to thatsame address. The application form shall require thefollowing information:

(1) The name, mailing address and birth date of theperson seeking a certificate.

(2) The name, location and date of completion of anyapproved training course completed by the person seekinga certificate.

(3) A copy of any certificate of completion with respectto the approved training course.

(4) A detailed description of the equipment the personseeking the CPMI certificate will use in conductingparking meter inspections, including applicable verifica-tions of accuracy, inspection records and other documenta-tion demonstrating the equipment is accurate and inworking order.

(5) The date of the application.

(6) Other information the Department might reason-ably require.

(c) Departmental action on application. The Depart-ment will, within 30 days of receiving an application,mail the applicant a certificate, a disapproval notice or arequest for additional clarification or documentation. Ifthe Department requests additional clarification or docu-mentation, its review and consideration of the applicationwill cease until the requested material is received, fromwhich time the 30-day review period shall begin again.

Section 8. CPMI certificate.

(a) CPMI certificate. The Department will provide aCPMI a CPMI certificate.

(b) Contents of CPMI certificate. A CPMI certificate willbear the following information:

(1) The name of the person to whom it is issued.

(2) The date of issuance.

(3) A unique identification number.

(4) A statement that the Department has determinedthe person identified on the certificate to be a ‘‘CPMI’’with respect to parking meters.

(5) Other information the Department might reason-ably include.

(c) Ownership of CPMI certificate. A CPMI certificateissued by the Department will remain the property of theDepartment. A CPMI or other person having physicalpossession of a certified parking meter certificate shall,upon written notice from the Department, surrender andreturn the certificate to the Department.

(d) Obligation to produce CPMI certificate for inspec-tion. A CPMI shall produce the CPMI certificate forinspection upon demand by the Department or anyperson on whose behalf the CPMI is performing theinspection or test.Section 9. Expiration of CPMI certificate.

A CPMI certificate will remain valid unless or until five(5) years or more elapse between consecutive parkingmeter inspections by the CPMI to whom the CPMIcertificate is issued, or unless the CPMI certificate issuspended or revoked in accordance with the proceduresin Section 12 (relating to suspension or revocation ofcertification).Section 10. Obtaining a new CPMI certificate.

(a) No renewals: new certificate required. The Depart-ment will not renew a CPMI certificate or extend theexpiration date of a certificate. A person shall, instead,apply for and obtain a new CPMI certificate in accordancewith Section 7 (relating to applying for certification) to beissued a successor CPMI certificate.

(b) Training course. A person who is applying for aCPMI certificate shall have successfully completed atraining course as described in Section 5 (relating totraining courses) within six (6) months of the date of theapplication form.Section 11. Inspection and testing by the Depart-

ment.(a) Random inspection and testing. The Department

may conduct random inspection and testing of parkingmeters that have been inspected and tested by a CPMI todetermine whether the CPMI conducted the inspectionand testing in accordance with the Act and this order.

(b) Inspections generally. In addition to the randominspection and testing described in subsection (a), theDepartment may conduct inspection and testing of anyparking meter that has been inspected and tested by aCPMI.

(c) Time lapse affecting results. In evaluating the in-spection and testing performed by the CPMI, the Depart-ment will take into account any lapse of time between aninspection performed by the Department and the inspec-tion performed by the CPMI.

(d) Reporting of results. Within 30 days following arandom inspection, the Department will mail the CPMIwritten notice of the inspection and the results of thatinspection.

(e) Use of results. The Department may use the resultsof its inspection and testing to suspend or revoke thecertificate of a CPMI in accordance with Section 12(relating to suspension or revocation of certification), oras the basis for a warning or instruction directed to theCPMI.Section 12. Suspension or revocation of certifica-

tion.

(a) Basis for action. The Department may suspend orrevoke a CPMI certificate if the CPMI does one or more ofthe following:

(1) Violates a provision of this order.

(2) Violates a provision of the Act.

(3) Intentionally or fraudulently reports inaccurate in-formation on an inspection report form.

(4) Is found, following inspection and testing by theDepartment in accordance with Section 11 (relating to

inspection and testing by the Department), to haveinaccurately, improperly or incompetently performed test-ing and inspections of parking meters issued.

(b) Notice. The Department will provide a CPMI withwritten notice of its intention to suspend or revokecertification, which will afford the CPMI notice andopportunity for an administrative hearing before theDepartment prior to the effective date of the suspensionor revocation.

(c) Delivery of notice. The Department will deliver thenotice described in subsection (b) to the affected CPMI bypersonal service or by regular mail to the address pro-vided by the CPMI on his application for a certificateunder Section 7 (relating to applying for certification), orto the address most recently provided to the Departmentin writing by the CPMI as the address to which noticesshould be sent.

Section 13. CPMI list.

(a) CPMI list to be maintained. The Department willmaintain a current CPMI list containing the followinginformation with respect to each CPMI:

(1) Name and address.(2) Telephone number.(3) Fax number (if available).(4) The unique identification number of the CPMI’s

certificate.(b) Distribution of copies. The Department will provide

a copy of the current CPMI list upon request.Section 14. Contacting the Department.

Manufactured Home Community Rights Act; Maxi-mum Relocation Fees Payable in the Event ofCommunity Closure

Section 11.2(c) of the Manufactured Home CommunityRights Act (act) (68 P.S. § 398.11.2(c)) requires that theDepartment of Community and Economic Developmentannually adjust relocation fees that may be owed tomanufactured home owners in the event that the commu-nity closes. The fees are adjusted based on an increase onthe Consumer Price Index.

The base amount of this fee in effect for calendar year2013 was $4,000 for single section manufactured homesand $6,000 for multisection manufactured homes. TheConsumer Price Index Inflation Calculator as provided bythe United States Department of Labor adjusts the feesfor calendar year 2019 as follows:

—$4,312.11 for single section manufactured homes

—$6,468.16 for multisection manufactured homes

APPLICATIONS FOR NATIONAL POLLUTANT DISCHARGE ELIMINATIONSYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM)

PERMITSThis notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM

permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under aGeneral Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewagewaste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwaterassociated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided inaccordance with 25 Pa. For NPDES renewal applications in Section I, the Department of Environmental Protection (Department) has made atentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reportingrequirements in their current permits, with appropriate and necessary updated requirements to reflect new and changedregulations and other requirements.

For applications for new NPDES permits and renewal applications with major changes in Section II, as well asapplications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, theDepartment, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations andother terms and conditions for the permit applications. In accordance with 25 Pa. Code § 92a.32(d), the proposeddischarge of stormwater associated with construction activities will be managed in accordance with the requirements of25 Pa. Code Chapter 102. These determinations are published as proposed actions for comments prior to taking finalactions.

Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator haswaived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).

Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted beforethe application within 30 days from the date of this public notice. Persons wishing to comment on WQM permitapplications are invited to submit statements to the office noted before the application within 15 days from the date ofthis public notice. Comments received within the respective comment periods will be considered in the finaldeterminations regarding the applications. A comment submittal should include the name, address and telephone numberof the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant factsupon which it is based.

Sections 302—305 of the Land Recycling and Environ-mental Remediation Standards Act (act) (35 P.S.§§ 6026.302—6026.305) require the Department to pub-lish in the Pennsylvania Bulletin an acknowledgmentnoting receipt of Notices of Intent to Remediate. Anacknowledgment of the receipt of a Notice of Intent toRemediate is used to identify a site where a personproposes to, or has been required to, respond to a releaseof a regulated substance at a site. A person intending touse the background standard, Statewide health standard,the site-specific standard or intend to remediate a site asa special industrial area shall file a Notice of Intent toRemediate with the Department. A Notice of Intent toRemediate filed with the Department provides a briefdescription of the location of the site, a list of known orsuspected contaminants at the site, the proposed remedia-tion measures for the site and a description of theintended future use of the site. A person who demon-strates attainment of one or a combination of cleanupstandards or receives approval of a special industrial arearemediation identified under the act will be relieved offurther liability for the remediation of the site for con-tamination identified in reports submitted to and ap-proved by the Department. Furthermore, the person shallnot be subject to citizen suits or other contributionactions brought by responsible persons not participatingin the remediation.

Under sections 304(n)(1)(ii) and 305(c)(2) of the act,there is a 30-day public and municipal comment periodfor sites proposed for remediation using a site-specificstandard, in whole or in part, and for sites remediated asa special industrial area. This period begins when asummary of the Notice of Intent to Remediate is pub-lished in a newspaper of general circulation in the area ofthe site. PERMIT APPLICATIONSThe Department has developed an ‘‘integrated’’ plan

approval, State Operating Permit and Title V OperatingPermit program. This integrated approach is designed tomake the permitting process more efficient for the De-partment, the regulated community and the generalpublic. This approach allows the owner or operator of afacility to submit permitting documents relevant to itsapplication for all sources related to a facility or aproposed project, affords an opportunity for public input,and provides for a decision on the issuance of thenecessary permits.

The Department received applications for Plan Approv-als or Operating Permits from the following facilities.

The Department of Environmental Protection’s (Depart-ment’s) review of the information submitted by the com-pany indicates that the air contamination sources willcomply with all regulatory requirements, including moni-toring, recordkeeping, and reporting requirements, andpertaining to air contamination sources and the emissionof air contaminants including the National EmissionStandards for Hazardous Air Pollutants for StationaryReciprocating Internal Combustion Engines, 40 CFR63.6580—63.6675, the Standards of Performance for Sta-tionary Spark Ignition Internal Combustion Engines, 40CFR 60.4230—60.4248, 25 Pa. Code Chapter 123 and thebest available technology requirement (BAT) of 25Pa. Code §§ 127.1 and 127.12. Based on this finding, theDepartment proposes to issue a plan approval for theproposed construction.

The emissions from each proposed VOX system in-cluded in this project will not exceed the following limits:0.0028 grain per dry standard cubic foot and 8.41 TPYPM (filterable and condensable), 2.7 TPY VOCs for allthree VOX units combined; no visible emissions equal toor greater than 10% for a period or periods aggregatingmore than three minutes in any 1 hour and equal to orgreater than 30% at any time.

In addition to the emission limitations, the following isa brief description of the types of conditions the Depart-ment intends to place in the plan approval in order toensure compliance with all applicable air quality regula-tory requirements: restrict the VOX systems’ burners andgenerator engines to natural gas firing only; performancetesting requirement for one of the VOX systems to verifycompliance with the particulate matter emissions limita-tion; require periodic monitoring of the Phoenix C WellPad water; restrict the VOX systems to processing onlywaters generated at the Phoenix C Well Pad; prohibit theVOX systems from processing waters that contain metha-nol unless prior Department approval is obtained.

The facility is a State Only facility. If the Departmentdetermines that the sources are constructed and operatedin compliance with the plan approval conditions and thespecifications of the application for Plan Approval 59-00038A, the applicants will subsequently apply for aState Only Operating Permit in accordance with 25Pa. Code Subchapter F.

The potential to emit calculations associated with op-eration of the proposed source based on USEPA AP-42data 3,640 hours of operation per year are, as follows: 0.5ton per year (tpy) for NOx (expressed as NO2), 0.4 tpy forCO, 0.3 tpy for SOx (expressed as SO2), 0.6 tpy for PMand PM10, 0.04 tpy for total organic compounds.

The proposed construction will include a MatthewsEnvironmental Solutions model No. IE43-PP1 (PowerPak I) that is equipped with primary and secondarycombustion chambers. The company proposes to installinstrumentation to monitor the opacity of the stack to theabove cremation unit. In addition, the unit is to beequipped with instrumentation to monitor and record thesecondary combustion chamber temperature.

The proposed construction is subject to the Best Avail-able Technology (BAT) requirements of 25 Pa. Code§§ 127.1 and 127.12. PA DEP’s review of the informationsubmitted by the facility indicates that the proposedconstruction will comply with all applicable air qualityregulatory requirements, including the applicable BATrequirements. The following is a summary of the condi-tions that the Department proposes to place in the planapproval to be issued to ensure compliance with allapplicable air quality regulatory requirements.

The plan approval includes emission restrictions forSOx, PM and opacity. The PM standard established at0.08 gr/dscf, corrected to 7% pursuant to BAT will assurecompliance with the applicable Statewide standard asspecified in 25 Pa. Code § 123.12. The opacity standardsis established to be equal to or greater 10% for period orperiods aggregating more than 3 minutes in any one houror no more than 30% at any time. The facility is requiredto continuously monitor opacity and secondary chamberstemperature to verify that the source is operated andmaintained in accordance with good air pollution controlpractices and BAT. Records of results from the requiredmonitoring are required to be generated and kept by thecompany.

Based on the findings presented above, the Departmentproposes to issue a plan approval for the proposedconstruction. If the Department determines that thesource is constructed and operated in compliance with theplan approval conditions including the specifications inthe application, the plan approval will be incorporatedinto a State-Only operating permit which will be requiredto be filed no later than 120 days upon request by theDepartment.

MINING ACTIVITY NPDES DRAFT PERMITS

This notice provides information about applications for a new, amended or renewed NPDES permits associated withmining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface waterand discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Effluent Limits for Coal Mining Activities

For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent oftechnology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are asfollows:

Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, dischargesand drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code§§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292,89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters theDepartment may require.

Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additionalwater quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with anoncoal mining permit, then the permit description specifies the parameters.

In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form ofimplemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, theReclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associatedpollutants from being discharged into surface waters in this Commonwealth.

More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that mayoccur are incorporated into an NPDES permit when necessary for compliance with water quality standards andantidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

The procedures for determining the final effluent limits, using a mass-balance equation or model, are found inTechnical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES)Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum DailyLoad(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed dischargesassociated with underground mining are noted in the permit description.

Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at theaddress of the district mining office indicated before each draft permit within 30 days of this public notice. Commentsreceived within the comment period will be considered in the final determinations regarding the NPDES permitapplications. Comments must include the name, address and telephone number of the writer and a concise statement toinform the Department of the exact basis of a comment and the relevant facts upon which it is based.

The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as providedin 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public noticeand contain the name, address, telephone number and the interest of the party filing the request, and state the reasonswhy a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If ahearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the PennsylvaniaBulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, theDepartment will consider comments from the public hearing in the final determination on the NPDES permit application.

Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater,and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII containsnotices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverageunder these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements andother conditions in each General Permit. The approval of coverage for land application of sewage sludge or residentialseptage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reductionrequirements, operational standards, general requirements, management practices and other conditions in the respectivepermit. The permits and related documents, effluent limitations, permitting requirements and other information are onfile and may be inspected and arrangements made for copying at the contact office noted before the action.

Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 ofthe Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating toAdministrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, RachelCarson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD usersmay contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Availability of Grants through the Driving PA For-ward Fiscal Year 2018 Pennsylvania State CleanDiesel Grant Program

The Department of Environmental Protection (Depart-ment) announces an opportunity to apply for $2,672,298in grants offered through the Fiscal Year 2018 Pennsylva-nia State Clean Diesel Grant Program (Grant Program).Funding has been made available through the UnitedStates Environmental Protection Agency (EPA) and theFederal Diesel Emission Reduction Act (DERA) of 2010(Pub.L. No. 111-364). Most of this funding, approximately$2.15 million, is from the settlement of a lawsuit withVolkswagen and its subsidiaries, relating to diesel vehicleemission violations, and is being used as the Common-wealth’s voluntary match funding under the DERA pro-gram. Funding is available for eligible diesel emissionreduction projects that will improve air quality andprotect public health and the environment by reducingemissions from diesel-powered vehicles and engines.

The Head Injury Program (HIP), administered in theBureau of Family Health (BFH), through the EmergencyMedical Services Act of 1985 (35 Pa.C.S. §§ 8101—8157),funds short-term intensive brain injury rehabilitation forresidents in this Commonwealth who have sustained atraumatic brain injury. See 35 Pa.C.S. § 8153(d). TheBFH’s regulations establish requirements for those whoare eligible for those services. See 28 Pa. Code § 4.6(relating to assessment).

To provide these services, the HIP contracts withspecialized brain injury providers who offer therapiessuch as physical, occupational, speech and cognitivetherapies along with assistive community integration andpsychological services. Rehabilitation services can be re-ceived in a residential setting as outpatient services or ashome-based and community-based services depending onthe need of the individual.

Effective immediately, the Department of Health willnow be accepting applications to the HIP for individuals18 years of age and older. The Department of Human Services (Department) isproviding final notice of its funding allocation for inpa-tient disproportionate share hospital (DSH) payments toqualifying inpatient acute care general, psychiatric andrehabilitation hospitals and qualifying psychiatric andrehabilitation units of acute care general hospitals, outpa-tient supplemental payments to qualifying inpatientacute care general hospitals, direct medical educationpayments to qualifying inpatient acute care general hos-pitals and certain DSH and supplemental payments tonew hospitals for Fiscal Year (FY) 2018-2019. The Depart-ment is also providing final notice of modifications to theeligibility criteria, payment methodology and fundingallocation for new and existing hospitals that receive theMedical Assistance Dependency supplemental payment.

The Department published notice of its intent to allo-cate funding for these payments at 48 Pa.B. 5926 (Sep-tember 22, 2018). The Department received no publiccomments during the 30-day comment period and willimplement the changes as described in its notice ofintent.

Fiscal Impact

The FY 2018-2019 impact, as a result of the fundingallocation for these payments, is $296.190 million($141.431 million in State general funds and $154.759million in Federal funds).
