the West Berkeley Plan goal 2B. “Create a mixed manufacturing district as a general industrial

district, where both heavy and light manufacturing can function along with “biotech” industries

and office users which can recycle the upper stories of the building”. The second floor of

Premier Nutrition Headquarters meets the-is recycling criteria.

The building location, covering the entire block, will provide Premier Nutrition with access to

existing public transit services, bicycle (parking and storage) and pedestrian infrastructure that

includes the Greenway to the west linking Emeryville. The building also provides adequate

transportation alternates including AC Transit, shuttles and BART to and from the site as

documented and certified in the 2017 BayHealth Traffic study by Fehr & Peers. That traffic

Study anticipated the mix of uses that Premier Nutrition is proposing. The existing building is a

legal non-conforming use that will not increase in size, lot coverage or height with the addition of

Premier Nutrition’s occupancy.

There are clear and appropriate mixed use distinctions from adjacent medical and fitness

facilities located on the second floor facing San Pablo Ave. and 67th St as well as the tower

portion of the building. These separations are consistent with City of Berkeley Planning Code

23E.80.090.

Unique to the building and relevant to the Premier Nutrition project is Berkeley’s role as lead

agency and administrator of land use approval under the Memorandum of Understanding

(MOU) between Berkeley Oakland and Emeryville. Pursuant to the lead agency position the City

of Berkeley will process the Premier Nutrition Headquarters project in the MU-LI Zone taking

into account the City of Oakland’s similar Zoning for the building.

Premier Nutrition Applicant Statement

The applicant proposes an adaptive reuse at 3100 San Pablo for Premier Nutrition Corporation

(PNC) a manufacturer and distributor of nutritional food products. The location of the adaptive

re-use is the second floor space of approximately 39,000 USF or 49,000 RSF in the 403,000

square foot mixed use building known as Foundry 31(Formerly “Marchant on the Greenway”).

The PNC tenant improvements for their headquarters will be on the second floor of the building

96% in the City of Oakland part of the building and 6% in the Emeryville part of the building.

The last occupant of that space was Marchant Calculator Inc. (City of Berkeley Use Permit

resolution no. 3729, dated September 6, 1956). Operations were discontinued in the early

1990’s and the space has been vacant since.

Premier Nutrition Corporation proposes to relocate their existing operations from Emeryville

where they have been since 1997 to larger expandable space in the building. The large

contiguous floorplate will be used as PNC’s corporate headquarters to produce, market and sell

products such as PowerBar, Premier Protein Shakes, Supreme Bars and Joint Juice and other

glucosamine supplement drinks and concentrates. The proposed facility will be comprised of

management and administrative operations as well as research & development. There will be

no retail sales or public access at the site. The move- in population is approximately 110-120

employees scheduled for June of 2018. The number of employees at this site is expected to

grow to 150-200 over a number of years..

There project will allocate up to 150 parking spaces for this use, and will be accommodated

within existing parking areas and supply at the site.

Typical operations will be from 8 am to 5 pm Monday through Friday with reduced operation

after 5 pm.. PNC encourages flex hours and telecommuting.

Timeline

If the project receives the necessary entitlements in a timely manner, construction could begin

first quarter of 2018 with the facility open the end of the second quarter 2018. Premier desires

to move into the space by June 1, 2018.

Project Consistency with West Berkeley Area Plan, the Berkeley Zoning Ordinance and the North American Industry Classification System( NAICS) 2007 adopted by the City Council 2009.
