K.4.6. 2.8 Seat belts shall always be used in all City vehicles. 2.9 Any City personnel taking off more than one week shall leave the assigned vehicle in the department I s use or shall park it at an approved location or at the City Motor Pool. 3.0 MUNICIPAL VEHICLES INVOLVED IN ACCIDENTS Any municipal employee involved in an accident while operating a City vehicle or any type of motorized equipment of the City of Mobile shall notify his or her supervisor immediately and complete a City of Mobile Police Department Accident Report and City of Mobile Motor Vehicle Accident form. 3.1 It is the responsibility of the driver to fill out a SR-13 Accident Report if required. Assistance will be provided to the employee in filling out this report by the City of Mobile Legal Department upon the employee's request. 3.2 Any person operating a City vehicle involved in a serious accident under circumstances indicating that the driver of the City vehicle may have been at fault must submit to a drug and alcohol test as required. (See Drug and Alcohol Abuse Policy) . 3.3 City employees shall be held responsible for the cost of damages and repairs to any municipal vehicle involved in an accident during unau t horized use of the vehicle by the employee. 3.4 While operating City vehicles, all traffic, parking, and speed laws shall be obeyed. The driver of a City vehicle shall be responsible for payment of any fine assessed. 4.0 ADMINISTRATION OF POLICY In order to facilitate this policy, a VEHICLE USE COMMITTEE shall be created and shall be composed of Executi ve Directors A representative from the City Council may provide advice to the Committee on vehicle use concerns of the Council but shall not be asked to make day-to-day operating decisions.

4.1 Adjunct members shall be the Safety Manager,Equipment Service Manager, Motor Pool Manager, and aFinance Officer. Adjunct members shall providetechnical advice only to the Committee when requested.

4.2 The purpose of the Committee shall be to approveor deny vehicle assignments, to evaluate possibleviola tions of the overall policy, and to determine ifappropriate action for violations of the policy hasbeen taken.4.3 A copy of the Vehicle Use Policy shall be placedin all City vehicles, and each City employee who isassigned a vehicle must read this policy and sign astatement that he .or she has read and understands theprovisions of this policy.

4.4 Department Heads shall be held responsible fordisseminating the information in the overall policy topersonnel within their respective departments.

5.0 ASSIGNMENT OF MUNICIPAL VEHICLES ON A REGULAR AND CONTINUOUSBASIS

For the purpose of this policy, assignment of a vehicleon a regular and continuous basis shall mean that aspecific City vehicle is to be utilized by a specificemployee or group of employees on a regular andcontinuous basis for the performance of his or her ortheir official municipal duties.

5.1 Municipal vehicles so assigned on a regular andcontinuous basis to a municipal employee shall be usedstrictly and solely for the conduct of- officialbusiness and shall not be utilized by the employee fortraveling to and from work to his or her residence.Municipal vehicles regularly assigned to an employeeshall not be driven to any residence or home of saidemployee unless the person to whom the vehicle isassigned is on twenty-four (24) hour callout status inconnection with his or her duties and has receivedappropriate approvals. No City passenger vehicles maybe driven out of the Police Jurisdiction.

Supervisor Responsibilities:

1. Take photographs of scene: Take distance photographs to show the entire accidentor incident scene; take medium distance photographs showing the relationship ofvehicles, equipment, and personnel; and take close up photographs showingdetails of the damage or injury site.

2. Complete the appropriate part of the Incident/Injury Investigation Form (Form046 SA 003 June 2004).

3. Make arrangements to obtain post accident or post injury drug and alcohol tests asappropriate. Refer to City of Mobile Substance Abuse Policy to determinecriteria and procedures.

4. Complete your report, sign it, and give it to your department head.

Department Head Responsibilities:

1. Ensure the First Report of Injury is completed in accordance with existingpolicies.

2. Ensure that substance abuse tests were completed within specified deadlines.3. Review the report for completeness and accuracy.4. If a police report was completed, obtain a copy of the Police Department's

Accident Report by calling Police Records Department at 208-1991 and askingthem to fax you a copy of the report. .

5. Assign a supervisor to investigate the cause of the accident or injury, andcomplete the investigation part of the Incident/Injury Report Form.

7. Convene your Safety Committee or Accident Review Committee (ARC) toreview the incident and make recommendations to prevent recurrences. (Youmay use the existing ARC as provided in the Vehicle Operations Policy or yourSafety Committee for this purpose.) Include recommendations for preventing theaccident from recurring.

8. Send the original completed form with the investigation findings and ARC/SafetyCommittee recommendations, along with photographs, statements and allsupporting documentation to the City Clerk, within five (5) working days oftheincident, with copy to the Safety Manager. If additional time is needed tocomplete the investigation and review by the ARC/Safety Committee, forward thecompleted portions within 5 days and follow up with the complete report as soonas practicable.

9. For Incident Reports where no lost time injuries occur, damage is minor, and it isunlikely that claims will be made against the City, complete the investigationform, keep the original in department file, and send a copy to the Safety Manager.

City Clerk Responsibilities:

1. Log in the report. Make copies for files and distribute as required.2. Forward the original report to the Legal Department.3. Forward copies to the Safety Manager.

Legal Department Responsibilities:

1. Log in the report and make copies as necessary.2. Submit appropriate reports to South Alabama Claims Services.3. Assist as necessary in the processing of any legal claims.

Safety Manager Responsibilities:

1. Enter appropriate information in the Accident/Incident database.2. Ensure that the reports are complete and accurate.3. Investigate accidents and injuries as needed.4. Identify "flagrant violations" and report these to the City Safety Council.5. Coordinate corrective actions with the department head and distribute

recommendations to other departments if the recommendations are relevant tohelping reduce accidents or injuries City-wide.

6. Follow up with departments to evaluate effectiveness of corrective actions.
