3 HR Compliance Changes Effective January 1st That
You May Have Missed

Keeping your business compliant each year can be tricky with the constantly changing
regulations. 2020 is no exception. Here are just a few of the recent changes that should already
have been addressed by your HR department or professional in order to keep your company out
of potential legal trouble.

New Salary Thresholds for Exempt Employees under the Fair Labor Standards Act
WHAT CHANGED?
On Sep. 24, 2019, the U.S. Department of Labor (DOL) issued
a final rule that sets a new salary threshold of $684 a week
($35,568 annualized) for the Fair Labor Standard Act’s
(FLSA’s) white-collar exemption from overtime pay, effective
Jan. 1, 2020. To find more information visit the following

WHAT STEPS SHOULD I TAKE?
Your HR department should have identified impacted
employees and made the necessary adjustments by
January 1st. If you haven’t done so already, these changes
should be made as soon as possible. Your HR team should
also note that some states have higher salary thresholds
and/or different tests for exempt employees.

W-4 2020 Adjustments
WHAT CHANGED?
Effective January 1, 2020 employers must use the newly
designed W-4 for all new hires and current employees
looking to change their federal deductions. Most payroll
platforms will prompt the payroll administrator to verify that
the new 2020 form has been completed.
WHAT STEPS SHOULD I TAKE?
Employers should make sure that new hires and current
employees that would like to make changes to their
deductions fill out the new W-4. Employers and their
staff should refrain from “advising” employee’s on how to
complete their W-4. Employee’s, instead, should be referred
to their accounting or tax professional or various IRS help
tools online.

Employment Eligibility Verification Form (I-9)
WHAT STEPS SHOULD I TAKE?
Employers should begin using this updated form as of
Jan. 31, 2020. The notice provides employers additional
time to make necessary updates and adjust their business
processes. Employers may continue using the prior
version of the form (Rev. 07/17/2017 N) until April 30, 2020.
After that date, they can only use the new form with the
10/21/2019 version date.
I-9 Compliance can be a huge liability issue for many
Employers. There are very specific IRS requirements when
it comes to the completion and retention of the I-9 form.

proper completion and retention of your Employee’s I-9
forms. If you are selected for an audit by the IRS, monetary
fines can be imposed for each violation found.
WHAT CHANGED?
On Jan. 31, 2020, USCIS published the Form I-9 Federal
Register notice announcing a new version of Form I-9,
Employment Eligibility Verification Form. This form is used
to verify the identity and employment authorization of
individuals hired to work in the United States. The new
version contains minor administrative changes to the form
and its instructions. The list of changes to the form can be
