Employee Code of Conduct Attestation Form 1006, Revision Date December 1, 2016

The “Vision” of the Mississippi State Department of Health (MSDH) is to strive for excellence in

government, cultural competence in carrying out its mission to promote and protect the health of all

Mississippians, and to deliver local solutions to local problems. In support of our vision, all MSDH

employees must meet public expectations for excellence by providing high quality public health

services, demonstrating sound stewardship of resources, acting with integrity, displaying fair treatment

and respect for all, and ensuring that employment and service opportunities are inclusive of diverse

communities.

Those acting on behalf of the MSDH have a general duty to conduct themselves with integrity, honesty

and trustworthiness, with efficiency and effectiveness, and to demonstrate accountability and

compliance with state and federal laws, and the policies and procedures of the Mississippi State

Personnel Board (MSPB) and the Mississippi Board of Health.

Contract workers are also subject to abide by the general and professional standards of conduct for

employees and are expected to meet any ethical requirements applicable to their discipline. This

includes protecting the confidentiality of patients/clients and employees records and any other protected

data.

The MSDH Employee Code of Conduct summarizes and serves as a quick reference guide to existing

statutes, policies and procedures. Employees should consult the actual statute, policies and procedures to

fully understand their obligations. If the Code of Conduct is determined to be inconsistent with terms of

the statute, policies or procedures, the State of Mississippi statute, policies or procedures governs.

Questions regarding application of the Employee Code of Conduct should be directed to the employee’s

supervisor or Office of Human Resources.

Employee Ethics

Employee ethics are important in every organization, and all MSDH employees are expected to comply

with high ethical standards in every aspect of their employment. Failure to comply with ethical

requirements may subject employees to disciplinary actions, up to and including termination of

employment, and under certain circumstances, criminal or civil legal actions. Under state and federal

law, employees must comply with legally established standards.

The MSDH Code of Ethics is summarized below. Employees should consult the actual language of the

statute, policies or procedures to clarify ethical obligations. The MSDH Intranet contains links to the

most current electronic version of the MSDH and the Mississippi State Personnel Board’s Policies and

Procedures, and the Mississippi State Employee Handbook.

MSDH Code of Ethics

1. Employees must maintain high standards of personal conduct and professional integrity.

2. Employees must uphold the constitution, laws, and regulations of the state and federal

government.

3. Employees must not reveal confidential information or use confidential information for personal

gain, profit, or the detriment of others.

4. Employees must not accept gifts, gratuities, or favors that could be construed as biasing

decisions made on the job.

5. Employees must continually seek to gain knowledge as related to the performance of duties.

6. Employees must treat the public and colleagues with good faith, courtesy, respect and honesty.

7. Employees must be dedicated to serving the public with competent service, as well as

compassion and respect for human dignity.

8. Employees must use public resources for public good and must not convert such resources to

personal use or gain.

9. Employees must report unethical conduct of others to upper management or an appropriate

agency official.

10. Employees who are members of or officers of non-governmental associations, organizations, or

boards should remove or recuse themselves from any decisions or activities that are in conflict

with their official state position or the agency mission.

Personal Confidentiality Commitment

Ensuring the confidentiality of all health reports, records, and files containing patient or client names,

and other individually identifying information is of critical importance to the Mississippi State

Department of Health. Breaches of confidentiality could undermine public trust in the MSDH and

thereby hinder efforts to prevent and control morbidity and mortality and to protect the public from

disease and injury.

Federal and state laws, including the Health Insurance Portability and Accountability Act (HIPAA)

Privacy Rule and the MSDH privacy and security policies, provide for the protection, privacy, and

security of individual health information and all other forms protected personal data.

The laws and policies provide requirements for ensuring that the protection of certain individually

identifiable health and/or personal information that is created, received, and maintained in any form or

medium by the MSDH is safeguarded and protected.

All MSDH Employees, Contractual Workers, Independent Contractors or other agents may only use and

disclose individually identifiable health or personal information as provided by and subject to all of the

limitations and requirements specified in the MSDH Privacy and Security Policies and Procedures.

Conflict of Interest

Employees are obligated to avoid situations that involve a potential conflict of interest with the

Mississippi State Department of Health. Questions regarding these provisions should be directed to the

employee’s supervisor or Office of Human Resources. A conflict exists when the employee:

1. Uses their MSDH position to secure an advantage for one’s self, immediate family or an

organization with which the employee is associated that is not available to the general public;

2. Accepts employment or a contractual obligation which would affect independence of

judgment in the employee’s MSDH job;

3. Performs other work subject to direct or indirect control, review or enforcement by the

employee in their MSDH job;

4. Uses state time, facilities, equipment, supplies, badge, uniform, influence of office, or

confidential information for personal gain;

5. Receives payment from non-state sources for work the employee is expected to do during

regular state employment; or

6. Competes with MSDH for services that it provides.

Compensation, Benefits or Gifts from Other Sources

Except as noted below or otherwise provided by law, employees are not allowed to accept payment of

expenses, gifts, compensation, rewards, or other benefits in connection with their employment from a

source other than the state.

1. Acceptance of certain gifts is not prohibited. Allowable gifts are:

Gifts of nominal value. Nominal value means an item of little or no marketable value.

Examples are a keychain with a vendor’s name on it, a cup of coffee, or other trinket-

type items.

Plaques or similar items recognizing individual services in a field of specialty or to a

charitable cause.

Honoraria or expenses paid for papers, talks, demonstrations or appearances made by

employees on their own time, for which they are not compensated by the state, and

which are not impermissible conflicts of interest with MSDH.

2. Travel or meals from another source. An employee may not accept travel or meals or

reimbursement related to the employee’s work assignment with MSDH from a source other

than the state, unless it is:

Approved in advance via the Agency’s Travel/Training Approval Process;

For no more than actual expenses incurred; and

Not reimbursed by the state.

Use of State Property

All MSDH property is also state property. With limited exceptions, state property is not to be applied

for personal or private use except as specifically authorized. State long distance service, business cell

phones, computers, office equipment, supplies or state-owned motor vehicles may not be used for

personal or private purposes.

Political Influence

Employees may not use their position or state resources to advance a political party or candidate.

Purchasing State Property

Employees involved in purchasing or contract decisions for MSDH may not have any personal financial

interest in the purchase or contract and may not accept any gift (other than one of nominal value) or

other contribution of value directly or indirectly from a vendor.

Other Policies and Procedures of Importance

Nondiscrimination

MSDH strives to provide a collegial work environment that is free of unlawful discrimination or

harassment based on race, color, sex, religious creed, age, national origin, religion, handicap,

disability, genetic information, marital status, political affiliation, status with regard to public

assistance and sexual identity or orientation. The MSDH General & Administrative Policy

Manuals explain equal employment and nondiscrimination policies, and inform employees or

others how to seek assistance or submit complaints, as may be appropriate.

Work-Related Romantic Relationships

Employees may not enter into a romantic or sexual relationship with a patient or another

employee over whom the employee has direct supervisory responsibility or other significant

authority.

Sexual Harassment Prohibited

All employees deserve to work in an atmosphere free from sexual harassment. MSDH policy

prohibits sexual harassment and provides a procedure through which individuals may pursue a

complaint. Whenever possible, the agency’s intent is to protect the rights and privacy of both the

complainant and respondent and any other involved individuals, as well as the prevention of

retaliation and reprisal.

Fraud and Other Dishonest Acts

To ensure effective use of resources and compliance with the law, fraudulent and dishonest acts

are not tolerated. Employees are required to report fraud and dishonest acts when the employee

has a reasonable basis to believe such an act has occurred. Such reports should be made to the

employee’s supervisor or manager, unless the employee believes that the supervisor or manager

participated in or condoned the act. In that case, the employee should report the matter to the

next highest level of supervision or management or directly to the Director of Internal Audit or

the Director of Human Resources.

Managers and supervisors are responsible for educating employees about proper conduct,

creating an environment that deters dishonesty, and maintaining internal controls that reasonably

assure achievement of management objectives, including the detection of dishonest acts.

Examples of fraudulent or dishonest acts include taking cash or other property, submitting false

time reports or reimbursement claims, forgery or alteration of documents or reports, improper

handling or reporting of financial transactions or audit information, and incurring contractual or

other obligations that exceed appropriations.

Nepotism

To avoid any perception that state employment is based on favoritism rather than individual

merit, MSDH has a policy controlling nepotism. Under this policy, employees may not

participate in the hiring, supervision, performance review, or compensation decisions for any

person who is a member of their immediate family or household. In very limited cases where this

is not possible without discriminating against the family member, one or more of these activities

may be permitted under strict procedures, if approved by the State Health Officer in advance.

Workplace Violence Prevention

To create a safe working environment for employees and MSDH patients/clients, the MSDH

Workplace Violence Prevention policy prohibits the presence of weapons or use of harassment in

all MSDH facilities and adjacent properties. It promotes a workplace that is free from violence,

harassing threats, intimidation, or other disruptive behavior.

Under the policy, employees and the public are generally prohibited from having firearms,

except in their locked vehicles in MSDH designated parking areas.

Acceptable Use of Computers and Technology

Computer and information technology resources are essential tools in accomplishing the MSDH

mission. As with all public resources, employees are to use these resources responsibly in order

to ensure availability for the competing demands of administrative and mission-related uses.

Responsible management includes not sharing passwords, not allowing access by unauthorized

users, and not using the resources for unauthorized purposes.

Information Security and Privacy

State employees are entrusted with public and private data in completing assigned work.

Employees are responsible for protecting privacy and security, as well as assuring appropriate

retention, and disposal of the government records, and data under their control or to which they

have access, in accordance with applicable state and federal laws, and MSDH policy.

Alcohol and Drug Use

Employees are expected to perform their job efficiently, safely and in a professional, business-

like manner. An employee’s ability to perform effectively may be hampered by alcohol or other

drug use. Under state policy, employees may not report to work or operate machinery, vehicles

or equipment while under the influence. Recognizing that alcoholism and other drug

dependencies are a significant societal and person problem, the state’s health insurance program

is available to assist employees who may have an alcohol or drug abuse problem.

The state’s policy on work-related substance abuse is non-discriminatory in intent and

application.

Dress Code

MSDH employees represent the Agency as they carry out their daily job duties. Since MSDH is

a professional organization that serves the public, the appearance of public health employees is a

direct reflection on the Agency. All employees are expected to dress in a neat, clean, professional

manner. (See detailed policy of definition of “professional dress”.)

Public’s Expectations of Excellence

An essential expectation of every MSDH employee, regardless of title, function, location or status is that

they demonstrate an unwavering commitment to consistent, courteous and professional interactions with

each MSDH patient or client they are called upon to serve. Every MSDH patient or client should expect

a welcoming disposition, kindness, respect, and a prompt and professional delivery of public health

services each and every time they interact with an employee representing MSDH whether that

interaction is in-person, via telephone, video conference or via the written word; anything less,

represents a failure to meet the public’s expectations of excellence.

The above listed policy references, the Mississippi State Employee Handbook and the Mississippi State

Personnel Board’s Policies and Procedures provide more detailed information on these and other

policies, and govern employee expectations and behavior.

The purpose of this form is to document employee receipt of these statutes, policies and

procedures in writing and signature attests to a commitment to remain in compliance.

INSTRUCTIONS

Supervisory staff should assure that all direct reports have read and signed this attestation

at least annually. Supervisory staff should assure that all direct reports understand and are

able to follow the summarized policies, procedures and statutes presented.

OFFICE MECHANICS AND FILING

This acknowledgement form will be filed in the employee’s permanent personnel file.

The employee may be presented with updated versions of the MSDH Employee Code of

RE: MSDH Employee Code of Conduct: Updated Version December 1, 2016

The Office of Human Resources is requesting all employees to access the MSDH Employee Code of Conduct latest Version online at the Agency's Learning Management System (LMS). We are requiring all employees and contract workers to review, print and sign the acknowledge receipt by January 25,2017. This will be done annually. Once you have signed and dated the form, please forward it to the Office of Human Resources so it may be placed in your Personnel File/attached to contract agreement.

The MSDH Employee Code of Conduct includes the Personal Confidentiality Commitment (beginning on page two of the document) which stresses the important of each employee safeguarding all forms of personal identifying or private information and data they may come into contact with as employees, contractors or agents of MSDH. There is also an additional reference to sexual identity in the Nondiscrimination section.

We are asking all Offices and Districts to request all "employees" to access the LMS to download, read and sign the required document before January 25,2017. Please collect the signed Acknowledgements of Receipt sheets from each employee, and forward them to HR for filing in employees' respective personnel files. For contract workers, we will ask that each !!£l! contract or renewed contracts to include a signed acknowledgement sheet of the latest Version II, as well.
