1 BE IT ENACTED BY THE PEOPLE OF GUAM:

Retirement System participants, receive a benefit from unused sick leave via
service credits or lump sum pavment, but that the lump sum payment for
participants in the Dtiined Contribution Retirement System shall be made by
the participant's eniplciver pursuant to statutorj. personnel leave policies, and

2 Retirement Svstem.
3 Section 2. Section 8219 of Article 2, Chapitlr 8 of Title 4 of the Guam
4 Code A~uiotated, as adiird bv 5 12 of Public Law Number 25-157, is hereby
5 repealed.
6 Section 3. Section 4108(h) of Article 1, Chapter 4 of Title 4 of the Guam
7 Code Annotated is hereL3~- icpi~nicd lind reer~ncted to read as follows:
8 "(h) Lump sum Payment Prohibited. No person who leaves the
9 government service, for anv reason mav rerc'~ve a cash payment for sick
10 leave accrued at the time that person lea1.o~ such service, except for
11 pa)7ments upon dcc?th as provided in Chaptt-r 7 of this Title, and except
12 for lump sum p,~\.mcnts to participants in the Defined Contribution
13 Retirement System upon retirement.
14 Lump sum pavments described he]-vin shall be calculated by

This legislation gives a henelit lo thosc who retire under the 1)cfmcd Contribution Plan of the Government of Guam Rctirement Fund.
By way of background, the "old" retlrcment system, the Defied Benefit Plan, provides that thosc who retire from government 5ervice rcccivc a benefit in the folm of crediting their unused sick leave for time served in compur~ng their retirement lxnclit.
In the case of the Defined Contribut~on Plan, the benefit is a lump sum paymcnt equal to % of thi. average of the highest 3 an~iunl salaries c a r ~ ~ c d by the employee The benefit, howcver, will not come liom the retirement sy\(em, hut instead will he absorbed by the "employee's agency ol employment".
The legislation taxes the hudgcts of the agencies Crom which the individual employee is retiring by inandating that the agency pay thc lump sum unuscd sick leave benefit to thc retiring employee. There is no appropriation for these payments in the annual hudfct, and no appropriation contained in this legislation to provide l'or the lump sum payments. It is cstirnated that up to $15 Million would nccd to he set aside to pay this henclit, and thc amount would grow at a rate of about $2- 1/2 Million additional per ycnr. This increases the dclicit in our government.
As a final note, with the policy now of leavc sharing. which is commonly done, it will be difficult for sick leavc to he allocatcci properly as a lump sum henetit paid upon retircment. It is also possible for employees to quit a go\rcrtlmcnt job, work in the PI-ivate sector or perhaps leavc

island for a period, then reach i-c~ircment age and apply for their ~.ctuement. The former employee may have been gone for many years from thc department or agency in which they formerly worked.

for lump sum payments to participants in the Defined Contribution
Retirement System upon retirement.
Lump sum payments described hercin shall be calculated by
multiplying: (i) the employee's hourly rate b a e d on the average of the
three (3) highest salaries received by an employee during that person's
years of credited service, by (ii) one-half (1/2) of the employee's unused
accumulated sick Icave hours. Payment of the lump sum for unused
sick leave shall be the responsibility of the employee's agency of
employment."
Section 4. Severability. I f any of the prcwisions of this Act or the
application thereof to any person or circumstances are held invalid, such
invalidity shall tlot affect any other provision or application of this Act, which
can be given effect without the invalid provisions or application, and to this
end the provisions of this Act are severable.

transfer to the Defined Contribution Retirement System, did not specifically address
the treatment of unused sick leave upon retirement by participants in the Defined
Contribution Retirement System. In contrast, members of the Defined Benefit I'lan
are allowed to convert unused sick leave to senice credits upon retirement, in
accordance with $81 16 of Article 1, Chapter 8 of Title 4 of the Guam Code
Annotatcd.

Section 2. Repeal. Section 8219 of Article 2, Chapter 8 of Title 4 of the
Guam Code Annotated, as added by Public Law No. 25-157:12, is hereby repealeti in
its entirety.
Section 3. Repeal and reenactment. Section 4108(h) of Article 1,
Chapter 4 of Title 4 of the Guam Code Annotated is liereby vepealed and reenacted
to read as follows:
"(h) Lump Sum Payment Prohibited. No person who leaves the
government service for any reason may receive a cash payment for sick leave
accrued at the time he leaves such service, except for payments upon death as
provided in Chapter 7 of this Title, and except for lump sum payments to
participants in the Defined Contribution Retirement System upon retirement.
Lump sum payments described herein shall be calculated by multiplying: (i) the
employee's hourly rate based on the average of the three (3) highest salaries
received by an employee during his years of credited service, by (ii) one-half
(112) of the emplo? ee's unused accumulated sick leave hours. Payment of the
lump sum for unu~ed sick leave shall be the responsibility of the employec's
agency of employment."
Section 4. Severability. If any of the provisions of this Act or the
application thereof to an? person or circumstances are held invalid, such invalidity

members of the Defined Benefit Plan may either claim a credit for unused sick
leave or may elect to receive a lump sum payment upon retirement or
disability, in accordance with section 8116 of Title 4, Guam Code Annotated.

18 Section 2. Section 8129, Article 2, Chapter 8 of Title 4 of the Guam Code
19 Annotated, as added bv Public Law No. 25-157:12, is hereby repealed.
20 Section 3. Subsection (h) of Section 4108, Chapter 1 of Title 4 of the
21 Guam Code Annotated, as added by Public Law No. 17-57:1, is hereby
22 amended to read:

Dear Mr. Chairman:
The current law under the Defined Benefit Retirement Plan allows for members to convert unused sick leave hours to be claimed for service credit only. There is no provision, however, for payment of unused sick leave as mentioned in the Legislative findinss and intent. Although the intent of Bill 154 is to clarify the financial obligation for payment of the unused sick leave under the Defined Contribution Retirement S j stem (DCRS) to be the responsibility of the employing agency, the actual provision of the bill does not address this intent. The Government of Guam Retirement Fund is in favor of this bill provided the above recommendations are incorporated therein.

BE IT ENACTED BY THE PEOPLE OF GUAM:
Section 1. Legislative Findings and Intent. 1 Liheslnfuvnn Gualzan finds
that the incentives created under Public Law No. 25-19, which were designed
to encourage government emplovees who were members of the Defined
Benefit Plan to transfel. to the Defined Contribution Retirement System, did
not specifically address the treatment of unused sick leave upon retirement bv
participants in the Defined Contribution Retirement System. In contrast,
members of the Defined Benefit Plan may either claim a credit for unused sick
leave or mav elect to receive a lump sum payment upon retirement or
disabilitv, in accorclance ~vi th section 8116 of Title 4, Guam Code Annotated.

Defined Contribution IZetirement System wit11 the right to receive lump sum
payments for unused sick leave upon retirement 01. disability, Public Law No.
25-157:12 was enacted to add a new section 8214 to Title 4 to clarify that,
similar to members of the Defined Benefit Plan, p,irticipants in the Defined
Contribution Retirement System shall be entitled to a lump sum payment for
unused sick leave upon tlieir retirement from government employment.
However, 1 Li11cslntlii.iii.1 G~lnl~nri finds that unilsed sick leave is not a
retirement or pre-retireil~ent ancillary benefit of the Defined Contribution
l<etirement System, but is a wage and hour matter Inore properly covered ill
statutes related to personnel policies applicable to public officers and
employees.
Therefore, I Liheslntt1iiii.1 Gilnhizn intends to cl'irify that all government
employees, both Definccl Benefit Plan members ,ind Defined Contribution
Retirement System participants, shall be entitled to receive a lump sum
payment for unused sick leave upon disability or retirement, but that the
lump sum payment for participants in the Defined Contribution Retirement
System sl~all be made h\: the participant's emplo~,er pursuant to statutory
personnel leave policies, ;lnd therefore should not constitute a benefit under
the Defined Cor~tributiori Retirement System.
Section 2. Section 8'129, Article 2, Chapter 8 ot Title 4 of the Guam Code
Annotated, as added by I'ublic Law No. 25-157:12, is hereby repealed.
Section 3. Subsection (h) of Section 4108, Chapter 1 of Title 4 of the
Guam Code Annotated, as added by Public LClw No. 17-57:1, is hereby
amended to read:
(11) Lump Sum Payment Prohibited. 7 in Gkteptw
1, 7 LC , , n- No person who leaves the Go\,ernment service for any
reason may receive a cC~sh payment for sick 1eal.e accrued at the time he
leaves such service, e x c e ~ ~ t for pavments upon death as provided in Chapter 7
of this Title, and except A for lump A sum pavments to participants in the Defined
Contribution Retirement Svstein upon disability or retirement. Lump sum
kmvments described herein shall be calculated bv multiplying: (i) the
employee's hourlv rate hased on the aTTerage of the three (3) highest salaries
received bv an emulovet. ilurinr his years of credited service, bv (ii) one-half
(1 /2) of the emulovee's mused accumulated sick leave hours.
Section 4. Severability. If any provision of this Act, including, but not
limited to, anv subsection contained within this Act, or its application to any
person or circulnstances is held invalid, the invalidity does not affect othi,r
provisions, sections or ;ipplications of this Act ~vhich can be given effect
nrithout the in~falid pro\-ision or application, and to this end the provisions ot
this Act are severable.
