My dear fellow exporters,

Friends, the Government has announced that the Finance Ministry is working with the Commerce &Industry to finalize on the notification with regard to the exemption of service tax levied on the post-production services for exports, as was announced by the Hon’ble Commerce & Industry Minister onApril 19th while presenting the Annual Supplement to the Foreign Trade Policy for the current year. Whilethis is, indeed, a relief from the uncertainty that had gripped the exporting community, the Council hasexpressed to the Commerce Minister the need to ensure that all the service tax levied on all services forpost-production export of goods is included for exemption in the notification that will be announced by theFinance Ministry.

The Council has also requested for a meeting the Prime Minister where it will make a presentation on theproblems facing the engineering exporting community that has led to the stoppage of shipments bymany of our fellow member exporters. This apart, the Council has also taken up a number of anomaliesthat have cropped up in the Annual Supplement to the FTP for the current year in the Trade Facilitationmeeting with the DGFT. We have also submitted a Concept Note to the Competition Commission ofIndia, on their request, on the need for strengthening the Shipping Corporation of India as also the possiblerole of a Shipping Regulator to make freight rates competitive and user friendly.

The Council has also lined up a series of promotional events abroad and will hold its trademark IndianEngineering Exhibition-INDEE in Johannesburg from October 23 to 26, 2007. The Council will also participatein GIFA-NEWCAST in Düsseldorf, Germany from June 12 to 16, 2007 and this will give further exposureto our member exporters to meet existing as well as new buyers and promote their goods in majormarkets of the world. The success of these events lie solely on your participation and it is hoped that youall will continue to make these promotional events a grand success as in the past. I may add that at therecent Hannover Fair held in mid-April 2007, a number of our member exporters benefited immenselyand some exporters have booked good orders.

While the current economic scenario in the country is not terribly conducive for exports, the Councilbelieves that such challenging times are a critical period for its members who have to find legitimateinnovative ways of doing business, cutting costs and staying competitive in world markets. The Councilwill always continue to push for all the legitimate demands of the exporters and the need for creating alevel playing field both internally as well as externally. Issues pertaining to an adverse exchange rate,high cost of export credit and high prices of raw material are essential elements of our competitivenessand the Council will continue to press these issues with the powers that be ad nauseum, till remedialaction is taken.

Preamble

It has always been EEPC’s endeavour to foster exports of India’s state-of-the-art Engineering Industry into world market.

In line with above EEPC is pleased to announce one of its major events – INDEE, Johannesburg – to be held in South

Africa at Expo Centre, Nasrec, Johannesburg during 23-26 October, 2007. This is a major step forward to enter into the

South African market.

About South Africa

South Africa is the economic powerhouse of Africa with a Gross Domestic Product (GDP) four times that of its Southern

African neighbours and comprising around 25% of the entire continent's GDP. The country leads the continent in industrial

output (40% of the total output) and mineral production (45%) and generates most of Africa's electricity (over 50%). Its major

strengths include its physical and economic infrastructure, natural mineral and metal resources, a growing manufacturing

sector, strong growth potential in the tourism, high value-added manufacturing and service industries. The financial and

industrial sectors are concentrated in Gauteng Province which on its on accounts for over 30% of the country (GDP).

South African economy has been showing an upward trend since September-1999 and the annual economic growth rate

from September-1999 through June-2005 has averaged at 3.5%. Gross Domestic Product (GDP) was running at an

annualized 4.8% at the second half of 2005 (compared to 3.7% in 2004 and 2.8% in 2003).

India-South Africa Trade Relations

Since 1994 India South Africa relation has shown smooth development with signing of a number of bilateral agreementsin diverse areas ranging from Defence, Culture, Science and economic cooperation.

Total trade between the two countries has grown significantly since 2001 with surge in both export and import, but Indiahas remained a net Importer. But in the engineering sector, India’s export to South Africa has maintained a steady growth89.5% in 2005-06 and 94% in 2004-05 on year on year basis.

Potential growth areas for Indian exports to South Africa are – Vehicle and vehicle components, Transport equipments,

Castings, Forgings, Hand Tools, Agricultural equipments, Two wheelers etc. There are also good potential for exports in the

service industry like Software expertise, technical man-power training.

Indian investments in South Africa have grown significantly both in quantity as well as diversity. Major investors includes

UB Group of India, Tatas, Mahindras, Ranbaxy, Cipla, Godrej, Ashok Leyland etc.

Participation Charge

One side open booth : Rs. 17,000/- per sq. mtrs.

Two side open booth : Rs. 18,700/- per sq. mtrs.

Due to limited availability of 2 side open booths, allocation will be done on first-come-first-served basis subject to receiving

full payment.

Payment

Full payment should be made along with Application Form, duly filled in latest by 1st June, 2007. The payment should

be made by way of Demand Draft drawn in favour of “Engineering Export Promotion Council” payable at New Delhi.

Reservation requests will be considered only on receipt of full payment.

Acceptance of application and allocation of stall will be at the sole discretion of the Council.

Cancellation

Any request for cancellation received on or after 15th June, 2007 shall result in forfeiture of the amount paid on this account.

Shipment of Exhibits

In order to facilitate shipment of exhibits, Council will appoint a Shipping Agent.

Selection Criteria

Final selection of the participants will be done by a Commi-ttee based on the criteria such as Accreditation to the Inter-

national Standards (like ISO, QS, etc.) foreign collaboration, annual export, and exports to South Africa.

Travel and Hotel Accommodation

Council will assist participants in locating suitable air lines and hotels at Johannesburg at negotiated rates through

accredited Travel Agents. However, participants are free to stay and travel through their own agencies.

MDA Grant

All eligible participants will be entitled to MDA grant under Focus Africa Programme of Ministry of Commerce, Government

of India as per the MDA Guidelines effective from April 01, 2006.

Assistance would be permissible on travel expenses by Air in Economy Excursion Class fare and/or charges of built up

furnished stall subject to an upper ceiling of Rs. 1,50,000/- (Rupees One Lakh Fifty Thousand only).

Further, eligibility for MDA grant is subject to exporting companies having FOB value of exports up to Rs. 15 crores in the

preceding year, having complete 12 months membership with EEPC with regular filing of returns and fulfilling other

conditions, details of which can be obtained from respective Regional Offices of EEPC.

EEPC is taking part in the 22nd International Exhibition for Machine Tools & Machineries to be held in Buenos Aires,

Argentina during 13-18 July, 2007.

Focus-LAC

The Latin American Region is one of the fast growing regions in the world accounting for nearly 5% of world trade and

emerged as an important business destination for Indian engineering exports. Argentina is one of the largest trading partners

of India among the Latin American Countries. The export of engineering goods from India to Argentina has reached a

level of US$ 52.84 Million in 2005-06 as against of US$ 26.11 during 2004-05 thereby registering a growth of 102%.

About EMAQH

EMAQH is an International Exhibition for Machine Tools and Machineries which is one of the leading international exhibitions

in LAC Region being organized by two Chambers of Commerce - CAIFHEM-Argentina Chamber of Manufacturers of Tools

and Measure Instruments and AAFMHA-Argentina Association of Manufacturers of Machine Tool and Acce-ssories, since

MDA Entitlement

Participants are entitled to get MDA grant to the extent of Rs.1,80,000/- under Focus LAC programme of Ministry of

guidelines, eligibility for MDA grant is subject to exporting companies having FOB value of exports up to Rs.15 crores

in the preceding year and having complete 12 months membership with the EEPC with regular filing of monthly export

returns.

Ethiopia

Power Sector

To meet the rapidly rising demand for electricity, Ethiopian Electric Power Corporation (EEPCO) plans a massive boost

to power generation capacity in the next five years, from about 790 MW to 3,500–4,000 MW, mainly through the construction

of new hydroelectric dams, supplemented by thermal and geothermal sources. EEPCO’s five-year plan is based on nine

key projects, which are in varying stages of development. The most advanced are the Gilgel Gibe II Dam (430 MW),

which is being built by M/s. Salini of Italy with funding from the Italian government, and the Tekeze Dam (300 MW), which

is being built by M/s. Sinohydro of China and local partners; both are due to come on-stream by 2009. In other developments,

Salini won a contract in 2005 to build the Beles Dam (435 MW), costing US$ 628 m, and another contract in 2006 to

build the massive Gilgel Gibe III (1,870 MW), costing US$ 2 billion, which is planned to be the largest plant in the country

when it comes on-stream in 2011. Looking further ahead, Ethiopia has the potential to generate up to 45,000 MW as

hydropower, which is being described as Ethiopia’s “white oil”. In line with the ongoing rise in power generation capacity,

Ethiopia is undertaking a massive expansion in the power distribution network under the government’s Universal

Electrification Access Programme (UEAP). The World Bank proposes funding of US$ 100 m for the first phase of the

UEAP in 2005, with the remaining US$ 77 m coming from the government. The full UEAP has a more ambitious aim

of raising electricity network coverage to 50% of the country within ten years, at a cost of US$ 1.3 billion, although funding

is not yet in place.

G.S.R. 331(E) - In exercise of the powers conferred by Sub-Section (1) of Section 156 of the Customs Act,1962(52 of 1962),

read with clauses (n) and (u) of Sub-Section (2) of Section 11 of the said Act, the Central Government hereby makes the

following rules, namely :-

1. Short title, commencement and application -

(i) These may be called the Intellectual Property Rights (Imported Goods) Enforcement Rules, 2007.

(ii) They shall come into force on the date of their publication in the Official Gazette.

(iii) They shall apply to imported goods.

2. Definitions -

(a) “goods infringing intellectual property rights" means any goods which are made, reproduced, put into circulation or

otherwise used in breach of the intellectual property laws in India or outside India and without the consent of the

right holder or a person duly authorized to do so by the right holder;

(b) "intellectual property" means a copyright as defined in the Copyright Act, 1957, trade mark as defined in the Trade Marks

Act,1999, patent as defined in the Patents Act, 1970, design as defined in the Designs Act, 2000 and geographical

indications as defined in the Geographical Indications of Goods (Registration and Protection) Act, 1999;

(c) “ Intellectual property law” means the Copyright Act, 1957, the Trade Marks Act,1999, the Patents Act, 1970, the Designs

Act, 2000 or the Geographical Indications of Goods (Registration and Protection) Act, 1999 ;

(d) "right holder" means a natural person or a legal entity, which according to the laws in force is to be regarded as the

owner of protected intellectual property right, its successors in title, or its duly authorized exclusive licensee as well

as an individual, a corporation or an association authorized by any of the aforesaid persons to protect its rights.

3. Notice by the right holder -

(1) A right holder may give notice in writing to the Commissioner of Customs or any Customs officer authorised in this

behalf by the Commissioner, at the port of import of goods infringing intellectual property rights in accordance with

the procedures and under the conditions as set out in these Rules, requesting for suspension of clearance of goods

suspected to be infringing intellectual property right.

(2) The notice in respect of goods infringing intellectual property rights shall be given in the format prescribed in the

Annexure to these Rules.

(3) Every such notice shall be accompanied by a document as specified by the Commissioner, evidencing payment of

application fee of Rs. 2000 (two thousand rupees only).

(4) If any of the information as required in the format under sub-rule (2) is not provided, the Deputy Commissioner of

Customs or Assistant Commissioner of Customs may, as the case may be, ask the right holder or his authorised

representative to provide the same within 15 days, which may be extended on sufficient reasons being shown.

(5) The right holder shall inform customs authority when his intellectual property ceases to be valid or if he ceases to

be the owner of such intellectual property right.

4. Registration of notice by the Commissioner -

(1) Within 30 working days from the date of receipt of the notice under sub-rule(1) of Rule 3, or from the date of expiry

of the extended time as contemplated in sub-rule (4) of Rule3, as the case may be, the Commissioner shall notify

the applicant whether the notice has been registered or rejected.

(2) In a case where the notice has been registered, the Commissioner shall indicate the validity period of the registration

during which assistance by Customs shall be rendered. The minimum validity period shall be one year unless the

noticee or right holder requests for a shorter period for customs assistance or action.

(3) The Commissioner granting the registration of the notice under sub-rule (2) shall inform, immediately through a letter

by speed post or through electronic mode, all Custom offices covered by the notice of the details of the notice.

5. Conditions for registration - The grant of registration under rule 4 shall be subject to following conditions, namely : -

(a) the right holder or his authorised representative shall execute a bond with the Commissioner of Customs for such

amount with such surety and security as deemed appropriate by the Commissioner, undertaking to protect the

importer, consignee and the owner of the goods and the competent authorities against all liabilities and to bear the

costs towards destruction, demurrage and detention charges incurred till the time of destruction or disposal, as the

case may be;

(b) the right holder shall execute an indemnity bond with the Commissioner of Customs indemnifying the Customs

authorities against all liabilities and expenses on account of suspension of the release of allegedly infringing goods.

6. Prohibition for import of goods infringing intellectual property rights - After the grant of the registration of the

notice by the Commissioner on due examination, the import of allegedly infringing goods into India shall be deemed as

prohibited within the meaning of Section 11 of the Customs Act, 1962.

7. Suspension of clearance of imported goods -

(1) (a) Where the Deputy Commissioner of Customs or Assistant Commissioner of Customs, as the case may be,

based on the notice given by the right holder has a reason to believe that the imported goods are suspected to

be goods infringing intellectual property rights, he shall suspend the clearance of the goods.

(b) The Deputy Commissioner of Customs or Assistant Commissioner of Customs, as the case may be, may, on

his own initiative, suspend the clearance of goods , in respect of which he has prima-facie evidence or reasonable

grounds to believe that the imported goods are goods infringing intellectual property rights.

(2) The Deputy Commissioner of Customs or Assistant Commissioner of Customs, as the case may be, shall immediately

inform the importer and the right holder or their respective authorised representatives through a letter issued by

speed post or through electronic mode of the suspension of clearance of the goods and shall state the reasons for

such suspension.

(3) Where clearance of the goods suspected to be infringing intellectual property has been suspended and the right

holder or his authorised representative does not join the proceedings within a period of ten working days from the

date of suspension of clearance leading to a decision on the merits of the case, the goods shall be released provided

that all other conditions of import of such goods under the Customs Act, 1962, have been complied with :

Provided that the above time-limit of ten working days may be extended by another ten days in appropriate cases

by the Commissioner or an officer authorized by him in this behalf.

(4) Where the Deputy Commissioner of Customs or Assistant Commissioner of Customs, as the case may be, has suspen-

ded clearance of goods on his own initiative and right holder does not give notice under rule 3 of the Rules or does not

fulfill the obligation under Rule 5, within five days from the date of suspension of clearance, the goods shall be released

provided that all other conditions of import of such goods under the Customs Act, 1962, have been complied with.

(5) Where the clearance of goods has been suspended, customs may, where it acts on its own initiative, seek from the

right holder any information or assistance, including technical expertise and facilities for the purpose of determining

whether the suspect goods are counterfeit or pirated or otherwise infringe an intellectual property right.

(6) Where the Deputy Commissioner of Customs or Assistant Commissioner of Customs, as the case may be, has suspended

clearance of goods on his own initiative and right holder has given notice under rule 3 of the Rules and fulfilled the

obligations under Rule 5, but, the right holder or his authorised representative does not join the proceedings within

a period of ten working days from the date of suspension of clearance leading to a decision on the merits of the

case, the goods shall be released provided that all other conditions of their import under the Customs Act, 1962,

have been complied with :

Provided that the above time- limit of ten working days may be extended by another ten working days in appropriate

cases by the Commissioner or an officer authorized by him in this behalf.

(7) In the case of perishable goods suspected of infringing intellectual property rights, the period of suspension of release

shall be three working days which may be extended by another four days subject to the satisfaction of the Commissioner

or the officer authorized by him in this behalf that such extension shall not affect the goods.

(8) Notwithstanding anything contained in these Rules, in the case of suspension of clearance of perishable goods on

the basis of notice of the right holder or his authorized representative, the right holder or his authorized representative

shall join the proceedings as required under these Rules within three working days or the extended period as

provided in sub-rule (7) and in case of suspension of clearance of perishable good by the Deputy Commissioner of

Customs or Assistant Commissioner of Customs, as the case may be, on his own initiative, the right holder shall

give notice, execute a bond and join the proceedings as required under these Rules within three working days or the

extended period as provided in sub-rule (7), as the case may be, failing which the goods shall be released.

(9) If within ten working days or the extended period under sub-rule (6), as the case may be, and within three working

days or the extended period as provided in sub-rule (7) of this rule in the case of perishable goods, the right-holder

or his authorized representative joins the proceedings, the Deputy Commissioner of Customs or Assistant

Commissioner of Customs, as the case may be, having reasons to believe that the goods are goods infringing

intellectual property rights and liable to confiscation under Section 111 (d) of the Customs Act, may seize the same

under Section 110 of the Customs Act.

8. Examination of goods by right holder - The Commissioner or the officer duly authorized in this behalf shall allow aright holder and the importer or their duly authorized representatives to examine the goods, the clearance of which hasbeen suspended, and may provide representative samples for examination, testing and analysis to assist in determiningwhether the goods are pirated, counterfeit or otherwise infringe an intellectual property right, without prejudice to theprotection of confidential information.

9. Supply of information to the right holder - At the request of the right holder, the Deputy Commissioner of Customsor Assistant Commissioner of Customs, as the case may be, shall inform the name and address of the importer andwithout prejudice to the protection of confidential information the Deputy Commissioner of Customs or AssistantCommissioner of Customs, as the case may be, may also provide additional relevant information relating to theconsignment which has been suspended from clearance.

10. Supply of information to the importer - At the request of the importer or his duly authorized representative, DeputyCommissioner of Customs or Assistant Commissioner of Customs, as the case may be, shall inform the name andaddress of the right holder and without prejudice to the protection of confidential information the Deputy Commissionerof Customs or Assistant Commissioner of Customs, as the case may be, may also provide additional relevant informationrelating to the consignment which has been suspended from clearance.

11. Disposal of infringing goods - (1) Where upon determination by the Deputy Commissioner of Customs or AssistantCommissioner of Customs, as the case may be, it is found that the goods detained or seized have infringed intellectualproperty rights, and have been confiscated under Section 111 (d) of the Customs Act, 1962 and no legal proceedings arepending in relation to such determination, the Deputy Commissioner of Customs or Assistant Commissioner of Customs,as the case may be, shall, destroy the goods under official supervision or dispose them outside the normal channels ofcommerce after obtaining 'no objection' or concurrence of the right holder or his authorized representative :

Provided that if the right holder or his authorized representative does not oppose or react to the mode of disposal asproposed by the Deputy Commissioner of Customs or Assistant Commissioner of Customs, as the case may be, withintwenty working days after having been informed, or within such extended period as may have been granted by theCommissioner at the request of the right holder, not exceeding another twenty working days, he shall be deemed tohave concurred with the mode of disposal as proposed by the Deputy Commissioner of Customs or AssistantCommissioner of Customs, as the case may be :

Provided further that the costs toward destruction, demurrage and detention charges incurred till the time of destructionor disposal, as the case may be, shall be borne by the right holder.

(2) There shall not be allowed the re-exportation of the goods infringing intellectual property rights in an unaltered state.

(3) The Deputy Commissioner of Customs or Assistant Commissioner of Customs, as the case may be, may on hisown, or at the request of the right holder, retain samples of goods infringing intellectual property rights prior to theirdestruction or disposal and provide the same to the right holder or importer if such samples are needed as evidencein pending or future litigations.

12. Exclusion of baggage and De-minimis Imports - Goods of a non-commercial nature contained in personal baggageor sent in small consignments intended for personal use of the importer are not subject to the above Rules.

13. Protection of action taken under the Rules - Customs officers when acting in good faith and having followed theprocedures set out in these Rules shall not be liable for :

(a) any failure to detect goods infringing intellectual property rights,

(b) the inadvertent release of such goods, and

(c) any other action in respect of such goods.
