STALL APPLICATIONS ARE DUE MARCH 11, 2019

Ruidoso Downs Race Track (The Track) is the private licensed prop-erty of All-American Ruidoso Downs, LLC (AARD), and stalls at The Track are issued as a privilege to participants and not a right. Approved stalls are provided free of rent or other charge. Stalls thus are not issued as a lease of space but merely a revocable permit based on the terms outlined in the stall application and the Ruidoso Downs Condition Book. Participants agree and understand that All-American Ruidoso Downs, LLC (AARD) strives to further the pur-poses of the New Mexico Horse Racing Act and New Mexico Racing Commission (NMRC) rules and regulations that call for horse racing in New Mexico to be conducted safely and fairly “and that partici-pants and patrons are protected against illegal practices on the racing grounds.” (NMSA 1978, §60-1A-4; 15.2.1.6 NMAC). In accordance therewith, participant agrees to the terms and conditions of the appli-cation for stabling any or all of the horses at The Track for the 2019 racing season.

All-American Ruidoso Downs, LLC (AARD) reserves the right to cancel any application for stable space in whole or in part, to refuse the acceptance of any entry in any race at any time for any reason or cause, and without notice to the participant. Stalls will be allocated to qualified and approved applicants based on the totality of the appli-cation and an examination of the quality of past performances which are supplied with the application.

Participants are subject to exclusion and/or ejectment by AARD for any lawful reason pursuant to 15.2.2.8(V)(2) NMAC and to prohi-bition from entry into any race(s) for any such reason, including, but not limited to, any violations of the New Mexico Horse Racing Act and associated rules and regulations of the New Mexico Racing Commission, in particular, those provisions relating to safety and the welfare of all participants, including equine participants, and those prohibiting the presence of banned substances in race horses and/or the presence of medications in excess of approved amounts in race horses. Any individual subject to such action will be granted an op-portunity to request reconsideration upon receipt of notice of said action from AARD, but acknowledges and agrees that the granting of any reconsideration is solely at the discretion of AARD and AARD is under no obligation to grant reprieve upon request. Transfer of any horse(s) following such exclusion, ejectment or prohibition by All-American Ruidoso Downs, LLC must be approved by AARD before said horse(s) shall be permitted to be housed in stalls at AARD’s property and/or entered into any race(s) at The Track. Participant agree to abide by all rules and regulations of AARD per-taining to the stabling, occupancy and the use of the Track, including all provisions of the New Mexico Horse Racing Act (NMSA 1978, §60-1A-1 et seq.), all rules and regulations of the New Mexico Rac-ing Commission (Title 15, Chapter 2 and Title 16, Chapter 47 of the New Mexico Administrative Code), and all provisions contained in the Ruidoso Downs Condition Book.

2019 RUIDOSO DOWNS ELIGIBILITY &SCREENING RULES

QUARTER HORSES

1. Two year olds not nominated to a futurity or stakes at Ruidoso Downs and are not New Mexico Bred will receive least preference.

2. Horses that started for $2,500 claiming or less must have placed 1st, 2nd, 3rd or 4th in at least one of their last five starts (Once eligible for the race meet, cannot become ineligible during that meet). No maidens older than five years old.

3. Any horse placed on the poor performance list twice during the meet will be ineligible to start and must be removed from the grounds.Minimum Claiming Price: $5,000 for Quarter Horses.

THOROUGHBREDS

1. Two year olds not nominated to a futurity or stakes at Ruidoso Downs and are not New Mexico Bred will receive least preference.

ELIGIBILITY DOES NOT MEAN APPROVAL. THE DAILY RACING FORM AND AQHA SHALL BE THE DETERMIN-ING FACTORS IN ESTABLISHING ELIGIBILITY. PAST PERFORMANCE LINES MUST ACCOMPANY ALL STALL APPLICATIONS, NO EXCEPTIONS. APPLICATIONS WHICH DO NOT INCLUDE PAST PERFORMANCES WILL HAVE LAST CONSIDERATION. NEW MEXICO BREDS WHICH MEET ELIGIBILITY WILL HAVE PREFERENCE.

IN GRANTING STALLS TO A STABLE, CONSIDERATION WILL BE GIVEN TO STABLES WITH A BALANCED AP-PLICATION. ALL-AMERICAN RUIDOSO DOWNS, LLC RESERVES THE RIGHT TO APPROVE ALL HORSES, AND THE ALLOCATION OF STALLS TO HORSES AT THEIR DISCRETION AT ANY TIME THROUGHOUT THE MEET.

HEEL NERVED HORSES All heel-nerved horses must be reported to the Racing Secretary by the trainer when registered for racing. After registration, approval by the Track Veterinarian is required.

CLAIMING RULEIf a horse is claimed, it shall not be sold or transferred wholly or in part, except in a claiming race for a period of thirty (30) days from the date of the claim, nor shall it, unless reclaimed, remain in the same stable under the control or management of its former owner or trainer for a like period.

Once a horse is claimed it may race back for any claiming price.

IMPORTANT RULES FOR FUTURITY &DERBY ENTRIES IMPLEMENTED

All horses entered in the Ruidoso Triple Crown Series (Ruidoso, Rainbow & All American) Futurities and Der-bies must be on the grounds in the Ruidoso Downs barn area 10 days prior to the trials and must remain on the grounds throughout the trials.All qualifiers must stay on the grounds throughout the finals.All horses entered in the above mentioned races will be sub-ject to “roll call” and possible “out-of-competition” testing.Any horse not in compliance may be scratched.

ALL HORSES ARE SUBJECT TO PRE-RACEEXAMINATIONS BY A VETERINARIAN

APPROVED BY THE NEW MEXICO RACING COMMISSIONSCRATCH RULES

Scratch time will be 8:30 AM the day before the race day. All Scratches must be approved by the Board of Stewards. The Scratch of a horse after closing shall be made by the owner, trainer or their licensed designee, with permission from the stewards.A horse may be scratched from a stakes race for any reason at any time up until 45 minutes prior to post time for that race.No horse may be scratched from an overnight race without approval of the stewards.In overnight races, horses that are physically disabled or sick shall be permitted to be scratched first. Should horses representing more than eight betting interests in the daily double or exotic wagering races, or horses representing more than eight betting interest in any other overnight race, remain in after horses with physical excuses have been scratched, then owners or trainers may be permitted at scratch time to scratch horses without physical excuses down to such respective minimum numbers for such races. This privilege shall be determined by lot if an excessive number of owners or trainers wish to scratch their horses. NMRC RULE 15.2.5.9Entry of any horse which has been scratched, or excused from starting by the Stewards, because of a physical disability or sicknes may not be accepted until the expiration of seven calendar days after such horse was scratched or excused and the horse has been removed from the veterinarian’s list.Procedures for scratching horses not stabled on the grounds:1. Verification in writing from a veterinarian that he/she has treated or attended to the horse will be required before the horse will be scratched. The horse will automatically go on the Track Vet List.2. To be taken off the Vet’s List, the horse must be re-examined by the attending veterinarian with written recommendation to the Track Veterinarian of when the horse will be able to race.3. The Track Veterinarian may have additional requirements prior to removal from the Vet List. The horse will remain on the list pending completion of these requirements. Failure to comply may result in a penalty by the Stewards.

NAMING OF RIDERS1. All horses must have a rider named by the time of the draw.2. An apprentice allowance may only be claimed before entries have closed.3. It is the trainer’s responsibility to engage and name a jockey before the draw of the race. Should a rider remain unnamed at the time of the drawing of entries, the Stewards or their appointee shall select one. Once named, the Stewards shall not change a rider, except for good cause.

GENERAL RULES AND INFORMATIONHorsemen are reminded that the final entry payment for trials must be on deposit with the Horsemen’s Bookkeeper or made at the time of entry in order for eligible horses to be included in the draw.Any horse in a race may not be sold or transferred until that obligation is com-pleted, except with permission of the Stewards.Entries will only be accepted with the express purpose of racing in the race entered. A trainer will be allowed only one (1) entry per overnight race/overnight stake un-less otherwise permitted by the Racing Secretary. When allowed two entries in a single race, the horse with the best date must be preferred.Trainers are advised that horses which are claimed and are back in on another race day may be required to fulfill that engagement despite the change of ownership. A horse’s engagements follow the horse.It shall be the responsibility of the trainer to have all win records attached to a horse’s registration certificate. The Racing Secretary may refuse entry to any horse whose win record is missing, until such time proper determination is made.All-American Ruidoso Downs, LLC shall have the right to declare off any adver-tised stake or feature race that fails to satisfactory fill. In such cases, all fees paid will be promptly refunded.The Stewards, Track Veterinarian or Racing Secretary shall have the right to bar from racing, or exclude from the grounds, any horse which they deem unsafe or incapable of respectable performance.Owners, Trainers and/or their agents are responsible for their horses’ eligibility, must claim all weight allowances at time of entry. While the racing office will make every effort to insure preferences are given, it is the owner, trainer or their agents responsibility to declare any preference at time of entry. The Racing Secretary will provide any information requested, but the final responsibility rest strictly with the Owner and Trainer.The Racing Secretary shall have the right to choose from each day’s entries the races that allows for the best card for the public.Trainers are responsible for the correct information (name of horse) being properly filled out for all horses shipping in and out of the stable gate.Trainers are required to have all stable employees licensed properly.Trainers are responsible for their guests at all times in the stable area.Children are not permitted to ride pony horses at any time in the stable area.Smoking is prohibited anywhere within the confines of barn or horse shelter.No dogs, fowl, or exotic animals will be permitted in the stable area or on the grounds.The Track Outriders are on duty every morning and are there for the protection of everyone. They will enforce all rules on the racetrack, and any foul or abusive lan-guage towards them will result in a fine and/or removal of horses from the grounds.All grooms should be clean and neatly dressed when taking horses to the paddock.All stalls must be cleaned of all muck and bedding prior to receiving registration papers upon leaving Ruidoso Down Race Track and Casino. A $50 Fee will be charged for all stalls not cleaned.All faucets located in the stable area must have an automatic shut-off nozzle and shall be turned off when not in use.

IMPORTANT-TRAINERS PLEASE NOTE:EQUIPMENT RULES

All horses with a jockey or exercise rider mounted that are racing, parading or warming up prior to racing; or jogging or exercising at any time must be equipped with a type of safety reins approved by the commission. Reins to be approved must originally be designed and constructed to provide secure secondary attachment to the bit that is secured to a reinforcement material to prevent failure due to the breakage of the rein, or breakage or inadvertent loss of the primary connection to the bit.

Toe grabs for Thoroughbreds with a greater than two millimeters in height worn on the front shoes of horses while racing are pro-hibited.

HELMET AND SAFETY VESTSAny licensed assistant starter and any licensee mounted on a horse or stable pony on Ruidoso Downs Race Track must wear a properly fas-tened New Mexico Racing Commission approved protective helmet and safety vest. (a) The approved protective helmet and safety vest shall be worn when: (i) racing, parading or warming up a horse prior to racing; or (ii) jogging, training or exercising a horse at any time. (b) The helmet worn must comply with one of the following minimum safety standards or later revisions: (i) American society for testing materials (ASTM 1163); or, (ii) UK standards (EN-1384 and PAS-015); or, (iii) Australian/New Zealand standard (AS/NZ 3838). (c) The safety vest worn by a jockey shall weigh no more than two pounds and must comply with one of the following minimum standards or later revisions: (i) British equestrian trade association (BETA): 2000 level 1; or, (ii) euro norm (EN) 13158:2000 1; or, (iii) American society for testing and materials (ASTM) F2681-08 or F1937; or, (iv) shoe and allied trade research association (SATRA) jockey vests document M6 Issue 3; or, (v) Australian racing board (ARB) standard 1.1998. (d) A safety helmet or safety vest shall not be altered in any manner nor shall the product marking be removed or defaced.

SOFT JOCKEY RIDING CROPS OR CUSHION CROPSAARD will require all jockeys riding in thoroughbred races to use only the approved soft jockey riding crops. AARD will provide approved soft jockey riding crops for any rider in the races that do not own an approved soft jockey riding crop.

ADDITIONAL TESTINGFor any horse entered as a participant in a competition to be held by AARD, said association reserve the right to set the appearance and ar-rival time for said horse. AARD further reserved the right to do ad-ditional testing on all horses at any time while they are on the grounds of AARD, as well as any other rights said association has as a private property owner.

ALL HEALTH PAPERS AND HEALTH INSPECTIONSMUST BE PERFORMED BY A VETERINARIAN ATPOINT OF ORIGIN (WHERE HORSES ARE BEING

SHIPPED FROM).COGGINS

Coggins:All Coggins must be updated after expiration according to NMRC rules. If a certificate has expired the horse will not be allowed to race until a new certificate is presented to the racing office.

All horses entering a New Mexico Race Track will be required to have a current non-expired negative coggin test certificate, (12 months from date of issuance) no exceptions.

All ship-in horses must have a current negative coggins certificate either on file with the racing office or a current negative non-ex-pired coggins certificate must accompany the horse, no exceptions.

NOTICE: Equine PiroplasmosisEquine Piroplasmosis: All quarter horses entering Ruidoso Downs Race Track, including pony horses, must have a negative Equine Piroplasmosis test. Horses arriving from out of state or out of the area will be allowed to obtain a test and be cleared on a pending test. Test information will be supplied by the attending veterinar-ian. At this time the test is for Babesia equi (Theileria equi).

AVISO - Equine PiroplasmosisTodos los caballos de cuarto de milla que lleguen a Ruidoso Downs incluyendo ponis, deberan presentar un resultado negativo del exa-men Piroplasmosis Equina. RACING OFFICE — SPECIAL RULESAll registration certificates must be on file with the Racing Sec-retary within seven (7) days after arrival. Registration certificates will not be accepted during entry hours, nor will transfers, bill of sales, etc., all these activities must be handled after the draw has concluded.

Registration Certificates will not be accepted if horses have not been tattooed. No AQHA Registration Certificates will be accepted at any New Mexico Racing Association with more than Two (2) transfers of ownership, except horses that were claimed at another racing association within the last sixty (60) days.The purchase, claim or transfer of any horse stabled on the grounds, whether by private sale, public sale or public auction, does not guarantee the new owner a stall for such horse.

Attention Horsemen:Albuterol

The New Mexico Racing Commission is engaged in a rule making process that will place Albuterol on the pro-hibited substances list. The process is expected to be complete by early May 2019. When the rule is enacted any positive test for Albuterol from out-of-competition testing (OOCT) or post-race testing will result in severe penalties for the horse (stewards’ list for 60 days) and/or the owner/trainer (loss of purse, fines, suspension of li-cense).

In addition, Ruidoso Downs has deemed Albuterol to be a substance that, if detected in post-race or OOCT tests, will cause expulsion from Ruido-so Downs participation for the remain-der of the race meeting. It is highly advisable that any horse intended to run at Ruidoso Downs from 2019 for-ward not be administered Albuterol in any form within 6 months of racing.

QH Jockey Weights

The New Mexico Racing Commission is engaged in a rule making process that will change the weights that Quarter Horse will carry in NM races. Following the direction for the Jockey’s Guild, the AQHAS, and the ARCI, the weights for QH racing in NM will be as follows:

2 year olds will carry a base weightof 124 pounds

3 year olds will carry a base weightof 126 pounds

4 year old and older horses will carry abase weight of 128 pounds

Each age class and corresponding base weight may be subject to weight allowances (deductions), at the racing secretary’s dis-cretion. Further, the overweight limit of 7 pounds may also be reduced to a maximum 5 pounds overweight.

Ruidoso Downs is in support of these chang-es and expects them both to be implemented prior to the Ruidoso Downs 2019 race meet-ing opening on May 10th.

TRANSFER OF QUARTER HORSE PAPERSAll transfers that come when papers are turned into the Race Of-fice at Ruidoso Downs before the meet starts, or before a horse has started at Ruidoso Downs, will be assessed a $5.00 service fee per transfer. (Payable before the papers will be accepted, or be-fore the transfers will be processed.) Once a horse has started, or any transfers done on horses participating at the current meet, (i.e. Claims, etc.), the transfer will be processed at no charge.

PARTICIPATION AGREEMENT REGARDINGPRIVATE BARNS AND/OR ADJOINING PROPERTY

Definition: “Private Barn Subject to Jurisdiction of the New Mexico Racing Commission” is a barn and real property owned or leased by a trainer in which stalls are provided for races at a licensed New Mexico racetrack and who have direct access to a New Mexico racetrack.

NMRC Policy Regarding Private Barn/Stables:An owner or lessee of a private barn/stable adjacent to or within a rea-sonable distance of a New Mexico racing facility governed by the New Mexico Racing Commission may have direct access to that racetrack provided they consent to the jurisdiction of the New Mexico Racing Commission and agree, in writing, to comply with all the rules and regulations of the New Mexico Racing Commission. Direct access sim-ply means they may enter the licensed racetrack without having to go through the general public or the horseman’s gate, but they must do so only after consenting in writing to jurisdiction of and complying with the New Mexico Racing Commission and its rules and regulations.In order to have this direct access, such barn owner/lessee must agree to indemnify and hold harmless the adjoining racetrack facility, the state of New Mexico and the New Mexico Racing Commission and its members from and all claims lawsuits, causes of action whatsoever arising from the maintenance and/or operation of the barn and the private property in question. Furthermore, such private barn/stable shall maintain liability insurance coverage with policy limits of at least $1 million and shall name the adjoining racetrack, the state of New Mexico and the New Mexico Racing Commission as additional insured’s under the policy. Proof of such insurance shall be provided to the New Mexico Racing Commission and the racetrack prior to granting direct access each racing meet.

OWNER REQUIREMENTSAll Owners are required to be licensed prior to entering a horse.All Owners are required to furnish the Horsemen’s Bookkeeper with their mailing addresses and social security numbers.Prior to entry, the owner of a horse is required to have all funds deposit-ed with the Horsemen’s Bookkeeper to cover the expense of starting that horse. No horse will be allowed to start unless this requirement is met.

OWNER SILKSAll-American Ruidoso Downs, LLC will provide colors for all owners who wish to use them. Any owner wishing to use stable colors must register them with the Racing Office prior to their use. No colors will be used that do not appear on the official program.

OPTIONAL CLAIMING/ALLOWANCEA horse, when entering an Optional Claiming/Allowance has the option of being entered for the allowance conditions stated (if eligible) or the claim-ing price listed in the conditions.A winner of an Optional Claiming/Allowance if entered for a claiming price, shall be considered a winner of a claiming race.A winner of an Optional Claiming/Allowance race, if entered for the al-lowance conditions (not to be claimed), shall be considered a winner of an allowance race.

WORKOUT RULESA horse’s registration papers must be on file with the racing office before a horse will receive an official work.REQUIREMENTS:(1) A non-starter must have had within sixty (60) days of entry one (1) ap-proved official schooling race or at least two (2) workouts recorded at a pari mutuel or commission recognized facility and posted with the racing secre-tary prior to time of race, one (1) of the two (2) workouts shall be from the starting gate, and be gate approved. It shall be the trainer’s responsibility to establish validity as to workouts and gate approvals.(2) Any horse which has started, but not within six (6) months, must have one (1) official workout from the starting gate or must have proof of stand-ing the horse at least one (1) time within a sixty (60) day period. Any horse which has started, but not within sixty (60) days, must have at least one (1) workout within sixty (60) days prior to time of race. Horses that have not started within six (6) months of entry must have at least two (2) approved workouts within the sixty (60) days.(3) Horses that have never raced around the turn will be required to have within thirty (30) days prior to time of race, at least one (1) workout at 660 yards or farther. Horses that have previously started in a race around the turn, but not within sixty (60) days, will be required to have at least one (1) workout at 660 yards or farther prior to time of race.(4) Gate approvals at a licensed facility must be made by a licensed starter on a commission approved form.

PROCEDURES FOR REPORTING WORKOUTSNo horse shall work without proper notification to the Clockers.All horses entering the track to work must be reported by name, type of work (turn and go or from the gate), and distance to work to the gap atten-dant at the 3/8 gap or by phone at the 550-yard chute. Those who fail to do so will be reported to the Stewards.Workout slips: (if needed) will be available from the Clockers or Racing Office for any trainer who may have exercise riders who aren’t fluent in English. Please list trainer, horse, type of work & distance and give to the gap attendant.All-American Ruidoso Downs, LLC reserves the right to allot stalls. All horses must be completely qualified in all respects before being entered in any race. Non-compliance will result in the horse(s) being denied entry and the trainer will be subject to a fine.

HORSEMEN’S BOOKKEEPERThe office will be open daily, except for Tuesdays & Wednesdays.

The office will open at 8:00 am. The office will close after the last race each race day.

All owners are required to be licensed. In order to transact business properly owners must have their correct names, addresses, social se-curity numbers and tax identification numbers on file to receive check withdrawals.

HORSEMEN’S CHECKSInternal Revenue Service regulations require submission of a signed W-8 or W-9 form with Federal ID number or Social Security number in order for checks to be issued. Failure to file these forms will require 31% withholding of all funds. Please contact the Horsemen’s Book-keeper for further information.

CELLULAR PHONE USAGEBeginning one hour before post time, the use of cellular telephones will be prohibited by non-racing officials in the paddock and on the racetrack surface until the last race is official. Cellular telephone use will also be prohibited behind the starting gate during racing hours by non-racing officials.

SALIX (LASIX) RULES AND REQUIREMENTSThe use of furosemide (Salix) shall be permitted under the follow-ing circumstances on association grounds where a detention barn is utilized: furosemide (Salix) shall be administered no less than four hours prior to post in which the horse is entered.See Subsection D of 15.2.6.9 NMAC for complete rules.

PREFERENCE DATE SYSTEM

1. Horses will not be eligible to receive a date nor will regis-tration certificates be accepted if, there is not a current nega-tive Coggins attached to the registration certificate or the horse has not been tattooed. No AQHA Registration Certificates will be accepted at any New Mexico Racing Association with more than Two (2) transfers of ownership, except horses that were claimed at another racing association within the last sixty (60) days.

2. All registration certificates received on or prior to May 18, 2019 at 4:30 PM will receive an zero (0) date.

3. All horses registered or entered after May 18th, will receive an entry or race date respectively, corresponding to that actual date.

4. Preference dates will not supersede the conditions of the race (winners preferred, derby preferred, etc.).

5. Winners are preferred in all winner races.

6. Entry dates will have preference over a running date of the same date.

7. Once a horse runs, it will keep that date and lose any date previously held.

8. Horses which have established a date at the current meeting will lose that preference date should they race elsewhere, and will receive a date when their papers are received back in the office.

9. In no way does claiming, owner transfer, trainer transfer of a horse affect the preference date.

10. Foal papers removed from the racing office by the owner or trainer will cause a horse to lose its date, unless for good cause (correction, breeder’s stamp, etc. and approved by the Racing Secretary).

11. Trainers are allowed to enter no more than one horse in a single overnight race without the approval of the Racing Secre-tary. If allowed two entries in a single race, the horse with the best date must be preferred.

12. “In-today” horses may not enter another overnight race without approval from the Racing Secretary.

13. In all matters, the Steward’s ruling is final.

NEW MEXICO BRED INCENTIVE FUND

This program will permit a New Mexico Bred horse entering an open overnight race and finishing first, second or third to receive a 20% increase of the original purse. The money gen-erated from this program will come from the gaming portion of the overnight purses. The money also is excluded from the 10% Breeders Awards monies.

The incentive money will be distributed as follows:

• First place will get 63% of the incentive money and the original first place purse.

• Second place will get 24% of the incentive money and the original second place purse.

• Third place will get 13% of the incentive money plus the original third place purse.

Money will be wired on a bi-weekly basis and this sched-ule may be adjusted if necessary. All undistributed incentive money will be carried over to the next meet, if applicable.

This program will be monitored by the New Mexico Horse Breeders Association and track management to ensure that this is beneficial to the New Mexico Bred Program. Reports on this program will be given at the monthly Commission meetings and any changes to the program must be approved by the Racing Commission.

NEW MEXICO HORSEMEN’S ASSOCIATION“Representing Horsemen Racing Across New Mexico”

An incorporated non-profit organization, the New Mexico Horsemen’s Association was formed in 1966 for the purpose of promoting the welfare and health of licensed owners, trainers and grooms connected with horse racing in New Mexico.

NMHA FUNDING:The NMHA receives one percent of all purse moneys except for

monies from nominations fees which are owner generated and a $5.00 starter fee.

NEW MEXICO is the only state which has 50% of net retainage going to purse structure as mandated by state statute. The Associa-tion keeps daily records of handle and amounts to be distributed to purses at each track.

GAMING MONIES are all kept in separate bank accounts for each track with Breeders portion wire transferred to them weekly and the balance going back to track purses as needed. Complete records are kept and furnished to the Racing Commission. Money from gaming has increased purses significantly.

ACTIVITIES AND ACCOMPLISHMENTS:The NMHA was successful in getting legislation mandated

where 1/2 of one percent wagered on simulcasting goes to the as-sociation for distribution; Half of this amount goes back to purses (ITW money) at the track where it was generated — the other half goes to the medical fund of the association.

The NMHA was instrumental in getting law exempting owners and trainers from gross receipts tax. Each year the NMHA lobbyist in Santa Fe tracks all legislative bills which could impact racing.

The NMHA assisted in getting the gaming bill passed in the 1997 legislative session.

The NMHA through mediation has agreed with track manage-ments that they will no longer take a 5% simulcast expense adjust-ment fee, but will settle on a flat cash fee for their expenses on out of state simulcast wagering which means less money taken away from purses.

The NMHA has representatives at all New Mexico State Racing Commission meetings to address the concerns of horsemen. We act as liaison with track management and work with them regarding any problems affecting horsemen.
