January saw the sentenc- ing of a Buchanan woman who embezzled money from the Berrien County Sheriff’s Department where she worked as the jail popu- lation manager. JoAnn Roberts, 66, of Bu- chanan pleaded guilty to a felony count of embezzle- ment over $20,000 and less than $50,000 and was sen- tenced in Berrien County Trial Court to five years pro- bation, 270 days in jail and 500 hours of community ser- vice. The last 90 days of the jail term can be served on tether. Roberts must pay $1,858 in fines and costs as well as $79,000 in restitution. Roberts was ordered not to enter any casino during her term of probation. She embezzled the money from the sheriff’s department after losing mon- ey gambling at area casinos. The embezzlement occurred over a period of more than a year starting in August, 2014. Roberts had been em- ployed at the sheriff’s de- partment since 1998 as a jail population manager. She resigned from that job in November, 2015. In her job, she would prepare tether collections for deposit with the county treasurer. She re- moved cash from the tether collection envelopes and deposited the money to her own account. A Dowagiac area devel- oper was sentenced in Feb- ruary in Cass Circuit Court for defrauding the city of Dowagiac. City officials esti- mated their loss from having to pay back a state blight elimination grant to be over $160,000. Kenneth Mack Allen, 73, of Leach Road in Dowagiac, pleaded guilty to attempted larceny in a building and was sentenced in Cass Circuit Court to five years probation, $1,858 in fines and costs and $80,000 in restitution. He has credit for one day in jail al- ready served. The incident occurred over several months in 2014 during which time Allen promised to transform an abandoned storefront, the former Mr. K’s Wearhouse at 115 S. Front St., in downtown Dowagiac into a single-screen movie the- ater with apartments on the upper floor. An area couple who robbed two area convenience stores were sentenced to prison in the spring and early summer. Ralph David Fink II, 39, of U.S. 12 in Niles, pleaded guilty to 13 robbery and assault re- lated charges as a third time habitual offender and was sentenced in June to a prison term of 23 years to 50 years. Fink’s past record included prior convictions for aggra- vated robbery and in Ohio in 2002 and for home invasion in Cass County in 2000. The armed robberies in Cass County occurred between Sept. 29 and Oct. 20, 2015 at Sunrise Liquor on Huntly Road in Howard Township and at Lenny’s Marathon Station in Milton Township. Fink was armed with a knife in one in- stance and with a gun in an- other. His co-defendant, April Marie Dawson, 30, of Long Lake Road in Berrien Springs, was sentenced in May to two concurrent prison terms of three to 20 years for armed robbery and conspiracy to commit armed robbery. She served as the getaway driv- er during the robberies. A Dowagiac man who killed his wife after an argu- ment in 2015 was sentenced to prison in late July. Terry Stineback, 45, of Flan- ders Street in Dowagiac, was convicted June 10 of sec- ond-degree murder, assault with intent to commit mur- der and use of a firearm in the commission of a felony. He shot and killed his wife, Laura, May 12, 2015 inside their Dowagiac area home with their young daughter a short distance away. Stineback was sentenced to prison terms of 20 to 40 years for second-degree murder, five to 20 years for assault with intent to murder and two years for use of a firearm in the commission of a felony. The two murder sentences are concurrent, while the felony firearm sen- tence is consecutive. LANSING, Mich. — Sen. John Proos recently met with representatives from Michigan’s up-and-com-ing spirit producers as well as state government of-ficials to discuss legislation that seeks to remedy issues facing the industry in the state.

Senate Bill 448, sponsored by Proos, would provide a tax cut for distillers on the first 60,000 gallons of spirits manufactured in a calen-dar year, with each bottle beyond 60,000 gallons be-ing subject to the current requirements.

“The law would operate in a similar fashion to the tax credit currently available to eligible brewers and brew-pubs,” said Proos, R-St. Jo-seph. “Under current state law, small-volume or mi-crodistillers are burdened with regulations and a tax system that treats them the same as massive, multina-tional corporations.”

Proos is hoping to find a solution that would use new revenue brought in by the blossoming industry to pro-vide tax relief for distillers.

Other states have updat-ed their craft distilling laws to allow for on-site retail sales and a much friendlier tax system. Traverse City Whiskey Company co-owner Jared Rapp said, “Senator Proos’ bill will provide badly need-ed relief that distillers require to support the growth and success of an industry still in its infancy. We appreci-ate the hard work and long hours invested by the Leg-islature and the Michigan Liquor Control Commission to help these small busi-nesses thrive throughout the state.”

Proos has been working closely for some time with industry representatives and the Liquor Control Commis-sion to mediate an agree-able solution that would even the field and help the small distillery industry flour-ish in Michigan.

Journeyman Distillery owner and operator Bill Wel-ter testified earlier this year before the Senate Commit-

tee on Regulatory Reform on this matter.

“While Michigan had a clear competitive advan-tage, it has since evapo-rated as Indiana and other states have updated their craft distilling laws to allow for on-site retail sales while also having much lower taxes,” Welter said. “Michi-gan’s tax has an incredible impact on us. We pay the state a tax of more than $15 per bottle on our best-

selling product in Michigan. That same bottle sold in In-diana is taxed at 53 cents per bottle. Michigan’s rate is 28 times higher.”

“This is about helping an up-and-coming and lucrative industry thrive in Michigan while remaining revenue neutral,” Proos said. “That means more jobs, economic growth, in-creased tax revenues and more made-in-Michigan products.”

It wasn’t the best of years for the Berrien County Sher-iff’s Department after July’s courthouse shooting that left two bailiffs dead and a deputy wounded in an inci-dent that drew national at-tention, but county officials ended the year knowing that they had the support and prayers of many area residents.

Veteran court bailiffs Joseph Zangaro, 61, and Ronald Kienzle, 63, were the men killed July 11 by Coloma resident Larry Gordon, 45. Gordon, who was in custody on several felony charges, first shot and injured Berrien County

Sheriff’s Deputy James At-terberry, Jr., 41, an 18 year veteran of the department, before killing the bailiffs.

The incident caused county officials to take a new look at courthouse se-curity which was evidenced in early August when Berrien County Commissioners vot-ed to hire two more depu-ties to escort prisoners in the courthouse. Manpower concerns had been raised since Atterberry was alone when he escorted Gordon from the courtroom.

Other security issues raised and ultimately act-ed on included purchas-ing new safety equipment for officers as well as more shackles and handcuffs for

In addition to funding designated by the county board, community mem-bers came together during the summer and fall to raise money for the sheriff’s de-partment. County officials were joined by representa-tives of the Berrien Com-munity Foundation in late November to announce the community donations.

Foundation President Lisa Cripps-Downey reported that the foundation was able to raise over $52,000 to purchase needed safety equipment for officers.

Cripps-Downey said the fundraising effort began as a response to the July 11 shoot-ings at the Berrien County Courthouse that ended in the deaths of two Berrien County Court Security Of-ficers and left one Deputy wounded. “The community was stunned and wanting to do something – anything – to make it better,” she said.

She and others from the foundation met with Sher-iff Paul Bailey to determine department needs that could help prevent some-

thing similar in the future. They then decided to issue a $5,000 challenge grant to the community to help fund the purchase of plate carrier bullet proof vests, Level III se-curity holsters and weapon mounted flashlights.

“This community is so gen-erous,” Cripps-Downey said. “People gave in so many ways. The gifts ranged from $5 to $6,000. People sent in not just checks, but letters of condolence to the Sheriff’s Office and thank you notes for what they do for Berrien County.”

Fundraising events includ-ed a community run hosted by the SWMI Racers that raised over $6,000 for the cause. Restaurants hosted give back nights and high school students from the In-teract Clubs at St. Joseph and Lake Michigan Catholic sold ice cream bars to raise dollars.

The Upton Foundation made a $5,000 grant to the effort. Corporations kicked in as well. LECO Corpora-tion, Whirlpool Corporation and Michiana Land Services each made significant do-nations of $5,000 or more,

she added.“We are just overwhelmed

with the generosity,” Bailey said. “We lost two great men who were also our close friends when we lost Court Security Officers Joe Zangaro and Ron Kienzle. We want to protect our of-ficers and do what we can to make sure a tragedy like this never happens again.”

It wasn’t only area resi-dents remembering the two bailiffs this year. They were among the law enforce-ment officers honored at a Dec. 15 Detroit Red Wings hockey game in Detroit. The event was sponsored by the Red Wings in con-junction with the National Law Enforcement Officers Memorial Fund to honor those who had died in the line of duty.

This was the sixth consecutive year for the Red Wings to hold the event and honor Michigan law enforcement officers. The event also served to raise awareness and funding for the National Law Enforcement Museum under construction in Washington, D.C.

Fall brought the sentenc-ing of a Granger man who drove recklessly in February and caused the death of a Galien woman, LuAnne Woodrick.

Jeffrey Norman, 51, of County Road 10 in Granger, pleaded no contest to reck-less driving causing death and was sentenced in Oc-tober to a prison term of 23 months to 15 years. He was ordered to pay over $12,400 in restitution to Woodrick’s family for the cost of her fu-neral and other expenses.

The accident occurred Feb. 11 on U.S. 12 east of Galien in Bertrand Town-ship. Norman was driving west on the highway near Sage Road and crossed the center line and hit Woo-drick head on.

Woodrick, 55, was a Galien resident and a clini-cal assistant professor in the School of Nursing at Indiana University at South Bend at the time of her death. She was conscious right after the crash but died on route to the hospital from blunt

force trauma.At year end, a suspect in

a 2006 cold case was sen-tenced in Cass Circuit Court as was the man who tried to burn down his girlfriend’s home.

Wisconsin resident Trevin Deshon Safford, 28, plead-ed no contest to four counts associated with the Dec. 18, 2006 armed rob-bery of the Family Dollar store in Edwardsburg; one count of safe breaking, one count of armed robbery, one count of conspiracy to commit safe breaking and one count of conspiracy to commit armed robbery.

Safford received four con-current terms of five years in prison. He has credit for 493 days served and must pay $962 in fines and costs.

The Family Dollar armed robbery occurred Dec. 18, 2006 in Edwardsburg with more than $1,000 taken from the store safe. Two men wearing bandanas and masks forced their way into the store at closing time. They tied up the two clerks and fled with money from the safe.

Daniel Eugene Thornton, 40, of Huntly Road, pleaded

guilty to six felony charges and was sentenced in Cass Circuit Court to six concur-rent prison terms including two terms of 10 years in pris-on for second degree arson and unlawful imprisonment.

He was also sentenced to one term of five years in prison for assault by strangu-

lation and three terms of two years in prison for two counts assault with a dangerous weapon and one count of resisting police causing inju-ry. All terms are concurrent.

The incident occurred March 1 at a home on Hunt-ly Road in Howard Township near Niles when Thornton

got into an argument with his girlfriend, assaulted her and then barricaded her and two other people in a bedroom while he set fires in and around the house. He later got into an alter-cation with a police officer and chipped the officer’s tooth.
