Thank you and farewell; for now.What an amazing year of ups and downs it has been. Here we are at the end, with the final Master Builder magazine for the year. Incidentally, this will also be my final edition as editor, for the next year at least. I’ll be leaving Master Builders for a year of maternity leave, but I am sure the team will continue the good work on this magazine I’ve become so proud of.

I want to take this opportunity to say thank you to all of the staff and members of Master Builders for providing such a wonderful working environment over the past four years. It’s been a pleasure to work with you all and a privilege to keep you, as members, informed.

In this edition of Master Builder, CEO Radley de Silva will address the policy issues that we are focused on as we head into the State Election p.21 See more about what we’ve been doing during the election campaign at our campaign website www.buildingourfuture.com.au.

The last of our major awards nights were held in October with Armadillo Homes named Master Builder of the Year. The Excellence in Housing Awards are always a highlight of the Master Builders calendar and this year was no exception. Congratulations to all of the winners. The year ahead and looking back on my Presidency

As this year draws to a close we can reflect on 2014 as a year that started out with a new Federal Government. This government promised industrial relations reform and prudent economic management, including renewed prosperity for our industry that would be underpinned by Prime Minister Tony Abbott’s promise to be our ‘infrastructure

Prime Minister’ while declaring Australia to be; “under new management and open for business”. We had developed an uncommon expectation for sensible, rational and stable governance, and the prospects for our country and our industry looked strangely promising.

Since then; a tough Federal Budget, an obstructive Senate and a volatile market have dampened that initial confidence. Here in Victoria (at the time of writing) we’re contemplating the possibility of a new Labor State Government that will abolish the Construction Code Compliance Unit (CCCU) with consequent reinvigoration of union delinquency. In this State Election year, Master Builders, through its Building our Future campaign has promoted the needs of those in our industry who build the homes, schools, hospitals, sporting grounds, transport connections, offices and workplaces that allow our community to thrive.

The Royal Commission into union misconduct has exposed a culture of union coercion, bullying and intimidation within our industry. This inquiry has now been extended to the end of next year. It seems incongruous that as Australians, we generally consider ourselves to be an egalitarian, tolerant and multicultural society built upon generations of immigration from Europe and, more recently from Asia and the Middle East; yet, in contrast our industrial relations

landscape appears to be beset by class and cultural divide – a culture that is propagated and driven by misguided elements within unions and politics for their own purposes. It’s this iniquitous culture that is now threatening the viability of our commercial construction industry, including the development of our natural resources. Boral CEO, Mike Kane, has shown our industry the way by his courage in standing up for his convictions. The next 12 months, and the Federal Government’s response to the Royal Commission, will be a watershed not only for our industry, but ultimately for our country’s future prosperity.

Our residential construction industry recently showcased Victoria’s best builders at the Master Builders Excellence in Housing Awards. An outstanding range of innovative renovations, contemporary apartments and new homes was a testament to the quality and dedication of our residential builders. I congratulate all of the entrants and especially, the winners.

Lastly, my tenure as President has now come to an end. It has been an honour and a privilege to represent you for the past two years. I’ve had great support from a talented, hard working Board, including our CEO Radley de Silva, his management team and all of the Master Builders staff. Your Master Builders is the most professional, the most forward thinking and the most customer-focussed organisation in the country. It is not only financially strong, it is also run and staffed by people who are truly professional and who genuinely care about our industry and who care about our members. Master Builders is well placed to service your needs and to best represent our industry to all levels of government. I’m proud to be a part of it.

The challenge to Australia’s economyWhile the CFMEU has been allowed to wield extraordinary power, let’s be clear, the cultural hurdles to productivity, and the unlawful practices, are in place because we as an industry have for far too long gone along with the union’s demands.

In my view, no industry participant should be able to reach an agreement or understanding with the union to give effect to an illegal ban or assist the CFMEU to affect an illegal ban. However, that is exactly what’s happening.

Law reform needs to provide effective sanctions for secondary boycott conduct (applying to all industry participants as well as unions), effective enforcement of secondary boycott laws and improve union governance.

As Master Builders members you can help accelerate change. It’s time to use our public voice to support change – to assist the ACCC with its investigation and to support the Federal Government’s move to make legislative changes.

We all have a right to operate our businesses freely within the boundaries of the law. We also have a duty to ensure our industry is productive and prosperous for the future.

As an American calling Australia home, I can see why Australia is the ‘lucky country’.

However, Australia is also very challenged. It’s the least cost-competitive economy in terms of manufacturing relative to the world’s top 25 industrial countries1. High input costs, the high Australian dollar, and declining productivity, along with our industrial

relations frameworks and union corruption, all contributing.

In response to these challenges, at Boral, we’ve been exiting cement manufacturing in favour of lower cost imports, consolidating timber operations, selling masonry and windows assets, and seeking a structural solution for the challenged brick business.

As a construction materials supplier, we have also been wearing the additional cost of union corruption in the Melbourne construction market.

Since February 2013, Boral has been at the front end of the CFMEU’s efforts to use the ‘intravenous drug’ of concrete as a choke point to punish ‘disobedient’ contractors. We refused to agree to the union’s demands to stop supplying one of our customers and as punishment; an illegal secondary boycott was imposed against Boral. To date, the bans have cost us well in excess of $10 million in lost earnings and legal fees.

Change is desperately needed. The national conversation that’s taking place about our industry cannot stop until there is an end to the illegality, the stand-over tactics, the manipulation and anti-competitive conduct.

Environmental assessments streamlinedThe Federal Government has fulfilled its election commitment to streamline environmental assessments by removing duplication across jurisdictions, with the release of a draft assessment bilateral agreement.

The new agreement will replace the assessment bilateral agreement currently in place, establishing a ‘One-Stop Shop’ single assessment and approval process aimed at increasing the number of eligible projects in Victoria.

The Federal Office of Best Practice Regulation has estimated this reform would save Australian businesses around $420 million each year and delivers on an election commitment secured last year from the Federal Coalition.

“This will reduce the regulatory burden on business by streamlining the environmental assessment and approvals process, while still maintaining high environmental standards,” said Federal Environment Minister Greg Hunt.

“It’s about removing duplication across jurisdictions and creating a more efficient process.”

Master Builders has welcomed the move as a positive step that will help reduce green tape involved in environmental approvals for the construction industry.

Housing Sector Group CommitteeClosing out our series on Master Builders Sector Group Committees for 2014, in this issue we would like to introduce our Housing Sector Committee.

Our Housing Committee members work to ensure that the interests of residential builders are represented. The group is composed of 12 members, ranging from volume builders, boutique and custom home builders, small home builders and alterations and additions specialists. The Housing Committee is chaired by Jarrod Sanfilippo from Burbank and holds four Council of Management positions.

The Committee provides feedback on a number of key policy issues including land supply, planning, land clearance, property taxation, training, insurance, sustainability and housing affordability. They also meet with the Country Sector and Materials Manufacturing and Supply Sector Committees periodically to address common issues.

SJ Weir celebrates 100 years of building excellence

Member company SJ Weir is celebrating 100 years of building in Ballarat and beyond.

This year also marks the 70th year of

Master Builders Association of Victoria membership for the Ballarat based company which had humble beginnings when Sydney John Weir began operations in 1914.

“Building companies like SJ Weir are rare and valued by Master Builders,” Master Builders CEO Radley de Silva said.

“We look forward to honouring SJ Weir at the upcoming President’s Inauguration for their 70 years of membership.”

The company started out doing cottage building and repair work but soon expanded to larger jobs like factory building. In 1919 Sydney Weir paid 1 Pound as his first annual subscription fee to the Master Builders Association of Ballarat. He was elected president of the Ballarat sector in 1923 and 1932. SJ Weir joined Master Builders Association of Victoria in 1944.

Sydney’s oldest son Jack joined the business in 1928 and his second son Forbes joined in 1939. In 1961, Jack’s son

Ian joined the business in Ballarat and both of Forbes’ sons joined the business in Adelaide, Robert in 1966 and John in 1972.

Throughout the years, SJ Weir has worked on a number of iconic buildings in and around Ballarat. Among them are the five storey St John of God Hospital, opened in 1952; repair works to Ballarat Railway Station in 1982 and the Wendouree Centre for Performing Arts in 2006.

During the Second World War, permit records show that SJ Weir won the majority of Commonwealth and State public works contracts in the Ballarat region including radar stations on Wedge Island and RAAF bases at Mt Gambier, Mildura, Nhill and Shepparton. In 1953, SJ Weir Pty Ltd was established to meet the demands of the post-war period.

In 1985, Jack and Ian Weir retired and Daryl Elford was appointed Manager of the Ballarat operations. A new entity, SJ Weir (Ballarat) was established in 2006 with Daryl Elford, Robert and John Weir as directors. The company is now under the directorship of Brian Barnes and Craig Jenkins and continues its proud history of building a brighter future for Ballarat and regional Victoria.

BLAB adjournment a win for buildersIn a positive sign for the building and construction industry, Victorian Parliament has adjourned for 2014 without debating the Building Legislation Amendment Bill (BLAB).

This is a significant win for the building and construction industry. While the current Government has promised that if elected, outstanding legislation will be reintroduced, this provides Master Builders with the opportunity to negotiate with both of the major parties ahead of the election. The outcome also means that Master Builders will be able to consult with the incoming government to ensure the best outcome for members and the broader building and construction industry.

Earlier this year, Master Builders provided advice to members on proposed reforms to the building industry by the State Government.

The Building Legislation Amendment Bill set out a range of changes to builder registration processes, domestic building insurance and consumer disputes.

Master Builders’ main concerns about the legislation were around increased red tape and added project costs and delays. Master Builders met with the State Government and Opposition to strongly advocate for further consideration of the key reforms, and won a reprieve, delaying Parliamentary consideration of The Bill which was originally intended to pass by 1 July.

The Building Legislation Amendment Bill was not debated by the end of the last sitting day of Victorian Parliament on 16 October, which has now adjourned ahead of the State Election on 29 November.

EoIs open for Federation Square EastExpressions of Interest are open for the Federation Square East development in Melbourne. The 3.3 hectare project site was labelled as the “new jewel in Melbourne’s crown” by Deputy Premier Peter Ryan.

“We are looking for a great design and exciting, active spaces to create a new destination that is the very essence of Melbourne,” said Mr Ryan.

“Federation Square East is part of the Victorian Coalition Government’s policy to unlock under-utilised land along the rail corridor such as E Gate, Flinders Street Station and Richmond Station.

“Together, this suite of projects represents opportunities for billions of dollars in development, the creation of thousands of jobs, and a project pipeline stretching out for decades.

“The possibilities for this site are limited only by the imagination.”

The mixed-use development would not only provide an iconic Melbourne landmark, but would also enhance

links with neighbouring Birrarung Marr, sporting and cultural attractions like the MCG, Melbourne Park and the Arts Centre, the Yarra River and transport services. Major Projects Minister David Hodgett said that in addition to an exceptional design, the project’s objectives include balancing financial returns with public outcomes.

“The successful proponent will secure the best development opportunity currently available in Melbourne in terms of location, flexibility, amenity, infrastructure and marketability,” Mr Hodgett said.

“We have an excellent site in the heart of a prosperous city with a strong property market and I am looking forward to seeing what the innovation and creativity of industry can deliver for Melbourne.”

Federation Square East is a project Master Builders has lobbied for on behalf of the non-residential sector to help spark new building and construction opportunities.

East West Link to provide building jobs boostAbout 150 trainees and apprentices will form part of the 3,700 strong workforce on the East West Link.

Premier Denis Napthine joined Treasurer Michael O’Brien and Roads Minister Terry Mulder at the Master Builders Building Leadership Simulation Centre to announce the key role apprentices would play in the project. The requirements to hire a minimum number of apprentices forms part of the East West Connect jobs program.

“Not only will East West Link improve the daily lives of people from a transport perspective, it will also provide people with new life skills that they can carry on to future projects,” Dr Napthine said.

Master Builders CEO, Radley de Silva, supported the apprenticeships announcement as a positive step for up skilling young, local trade apprentices.

“Any project that creates jobs for young, Victorian tradespeople is good for the building industry and good for the Victorian economy,” Mr de Silva said.

“Through our ALink program for apprentices, Master Builders has been working hard to guide young tradespeople towards successful careers but all the guidance in the world is useless without apprenticeships actually being available.

“The East West Link project will go a long way towards creating opportunities for both apprentices and the building industry as a whole.”

East West Connect has also formed a partnership with the University of Melbourne Faculty of Engineering to inspire future engineers. Funding has been provided for four PhD applied research scholarships, opportunities for work experience, guest speakers and site visits.

The government this month reached financial agreement with East West Connect to construct the $6.8 billion eastern section of the East West Link project.

Equity in the project will be provided by East West Connect consortium members Capella Capital, Lend Lease, Bouygues, Acciona, John Laing and QIC.

The financial close marks the commencement of the contract awarded to East West Connect by the Coalition Government to finance, design, construct, operate and maintain East West Link for 30 years.

The Federal Government has contributed $1.5 billion to the eastern section of the East West Link.

Construction will begin later this year with the project due for completion in 2019.

A jobs portal will be established for the project where you can express interest in gaining employment on the East West Link project.

Building industry confidence soars before electionA pre-election surge in builders’ confidence and business conditions was recorded in Master Builders’ latest sentiment study.

With politicians splashing cash on building and construction projects to woo over Victorian voters, there are some strong opportunities for members to win work.

Expectations for growth in the industry are now at a five year high while the industry is also feeling more confident about our economy’s future too.

Master Builders’ Industry Expectations Index climbed 4.4 points in the latest survey to reach 59.2 points, the highest results achieved since the September 2009 quarter. It has surged 11.2 points in the past year.

In a trend that has now taken place in 23 of the past 26 quarters, Victorian builders are more positive about their industry’s opportunities than builders elsewhere in Australia.

In other pleasing news, some 33.5 per cent of Victorian builders are now reporting to have at least six months of work on their books, compared to just 25.0 per cent three months earlier.

At the same time, the number of builders with less than a month of work has dropped from one in six to one in eight.

WHAT DO WE WANT TO COME OUT OF THIS STATE ELECTION?

Master Builders represents the gamut of builders, construction companies, tradespeople, manufacturers and suppliers in the building industry. Leading up to the State Election, our policy requests have covered a range of issues that we believe best represent the interests of the Victorian building industry and you as members.

Our priorities include:• Tackling housing affordability • Requiring tradespeople to be registered• Toughening owner builder/unregistered builder requirements• Cutting building red tape• Investing in a strong package of infrastructure projects• Upholding the rule of law in our industry• Working with the government on matters raised in the

Housing affordabilityMaster Builders research shows that housing affordability is a growing issue in many communities across the state. Over the past decade, the affordability of Victorian homes has declined by 20 per cent. New solutions are required to help more local families to fulfil the great Australian dream of owning their own home and building their nest eggs. We are calling for an independent review into housing affordability and for more support for first home buyers. We’d also like to see councils encouraged to make more efficient decisions and for more developable land to be available.

Trade registrationUnlike builders, plumbers and electricians, tradespeople are not required to be registered in Victoria. You’ve told us that registering tradespeople would boost productivity and improve the quality of housing stock. We are seeking action on this issue.

Owner buildersHardworking registered builders are forced to compete with unregistered builders and tradespeople for work, often being undercut in the process. This is another issue that is jeopardising the quality of Victorian housing stock. We seek a strong enforcement campaign to weed out unregistered practitioners and tradespeople doing the wrong thing, and the tightening of requirements on owner builders.

Red tape cutsUnnecessary red tape is the enemy of hard working builders and tradespeople. A 2010 report showed that the costs of complying with planning and building regulations in Victoria is between $500 million and $875 million per year. This includes a cost of $180 million every year because of unexpected delays in planning decisions. These costs are driving up the price of new homes and building projects.

We’d like to see a number of actions taken to reduce the red tape burden including the introduction of a private planning certification system, more as-of-right or code assessed building opportunities and incentives for local councils who deal with planning matters efficiently.

InfrastructurePublicly funded infrastructure projects stimulate investment and generate jobs in our sector, while also delivering on the needs of the community for the long term. Projects that Master Builders support include :• East West Link• A new cross-city rail tunnel• A rail link to Melbourne Airport• Level crossing removals and road upgrades• Upgraded schools and hospitals in our suburbs and

regional Victoria• Enhanced sporting ground facilities, regardless of whether

you are an elite athlete or local amateur • Transformations to Flinders Street Station, the Federation

Master Builders sees these projects as creating a host of jobs and investment in our sector. We would like to see an independent infrastructure umpire appointed to identify future projects and procurement methods. We’d like the winner of this election to support and progress all of these projects, and identify underutilised land for further investment.

The rule of lawThe Royal Commission into trade union governance has cast a light on the coercion, intimidation and corruption in our industry. This needs to be weeded out by a government willing to uphold the rule of law in our sector or else the competitiveness of our industry will continue to suffer.

We have asked that the elected government maintain a strong code of practice for our industry and require government agencies to act swiftly against those who act without regard for the law.

Building Legislation Amendment BillMaster Builders strongly believes the proposed Building Legislation Amendment Bill (BLAB) would have significant impacts on our members without delivering outcomes that would boost consumer protection.

Reforms would adversely impact builders when it comes to the builder registration process, handling of domestic building insurance, issuing of building permits and resolving consumer disputes.

The Victorian Building Authority (VBA) – which is still in its infancy after replacing the much maligned Building Commission – would be empowered to be judge, jury and executioner of builders without any independence.

In light of this, Master Builders has sought commitment to not reintroduce this toxic legislation into Parliament. Instead, we ask that government work with industry to identify reasonable, proportional measures that will deliver a stronger building industry and certainty for consumers.

Overall, we believe that the issues we are prioritising this election will have an impact on all of our members, and the industry as a whole.

Households in Melbourne are now earning $18,700 more a year than they were just a decade ago, but over the same time the average house price has grown by $217,500.

The rapid rise of house prices compared to income growth isn’t just an issue in Melbourne. Many communities in regional Victoria are experiencing the same problem, including in Geelong, Ballarat, Bendigo and Gippsland.

As Victorians prepare to head to the polls, our politicians should make no mistake that housing affordability is a critical issue for our community.

Generations of Victorians have used the property market to help build their financial nest eggs and set themselves up for life after work.

But it is becoming harder and harder for today’s generation to follow in these footsteps. It’s harder to save for a deposit and it’s harder to pay off a mortgage. The great Australian dream of owning a home is fast becoming a nightmare for many people.

What can we do to help make it a little bit easier?

Master Builders has developed a comprehensive suite of policies that our politicians should look at to help address housing affordability.

Our top priority is to have a full, independent review into this issue. While industry has produced report after report showing the escalating impacts government charges, taxes, levies and policies have on housing affordability, they have been dismissed on the basis we have a vested interest.

So let’s lay it all out on the table of someone independent like the Victorian Competition and Efficiency Commission (VCEC). Let’s hear from builders and home owners and renters about their needs. Let’s see if we can find new solutions to our growing housing affordability crisis.

While this work is being carried out, action can be taken to continue the aggressive stamp duty discounts the current Coalition Government has offered first home buyers. Jobs in our industry can also be secured by strengthening first home buyer grants that target home building activity.

We also need to look at ways we can cut red tape in the planning and building space. In particular, we need our policymakers to look at initiatives that will target red tape cuts where they are needed most – at the local council level.

Strong plans have been put forward by the government in its Plan Melbourne strategy, released earlier this year, but the best laid plans simply won’t work if councils don’t play their part in helping address housing affordability.

Far too often, council delays and obfuscation cause chaos and confusion in the building industry. These delays don’t cost councils a cent, but they add significant costs onto home building and renovating projects.

When it last looked at this issue, VCEC found the costs to business of complying with land-use planning and building regulations were up to $875 million each year.

In alarming news, around $180 million of these costs were found to be a result of unexpected delays in land-use planning decisions.

These are costs that are ultimately being paid for by home owners and clients of the building and construction industry.

New and innovative plans are required to reduce these costs. One solution Master Builders supports is the introduction of privatised planning certification, which would reduce the reliance on councils to get planning permits for sensible, logical proposals.

The South Australian Government has recently introduced such a system, allowing private planners to assess

proposals for single-storey and two-storey homes, additions and alterations to existing homes and works like sheds, carports and verandas. If it can work there, we can certainly make it work here.

Whoever wins office at this election has an important role to play in helping to address council actions that drive up building costs, but Master Builders also recognises that our industry needs to play its part too.

That’s why we want to see our politicians commit to mandating the registration of tradespeople, like what already happens with builders, electricians and plumbers, to make building projects more efficient and productive.

Builders operating in states like New South Wales and Queensland, where tradespeople have to be registered, report that home building projects in Victoria take more time and cost more money to build. This is because tradespeople here don’t have to be registered and therefore don’t have the accountability that exists elsewhere.

There are tens of thousands of tradespeople registered north of our state’s borders, but we only have around 2000 in Victoria.

In addition to making our industry more productive, registering tradespeople will help boost skills and standards as well as beefing up protection for consumers too.

Together, these policies will help tackle housing affordability and support Victorian families to fulfil the great Australian dream. All we need now is for our politicians to get behind these initiatives.

Armadillo Homes named Master Builder of the YearA lovingly renovated 1920s home in Elwood has won Armadillo Homes the title of 2014 Master Builder of the Year (residential).

More than 580 guests were at the Master Builders Excellence in Housing Awards at Crown Palladium on Friday, 17 October to see Armadillo Homes receive the top prize from Planning Minister Matthew Guy.

The winning home, is a beautifully renovated two-level, solid brick, 1920s residence that had been unsympathetically and destructively amended over the years.

“What was once a signature property in a prime location had lost its character and purpose but Armadillo Homes used their expertise to change that,” Master Builders CEO Radley de Silva said.

“Their vision was to restore the spirit of the home in a way that honoured its past through a modern and innovative interpretation of a family home and they achieved this brilliantly,” he said.

“Armadillo Homes’ attention to detail was impeccable in restoring this home beyond its original glory.”

Armadillo Homes will now go on to compete at the 2014 National Excellence in Building and Construction Awards on Friday, 21 November.

Mr de Silva said that the winners exemplified the spirit of the annual awards that are now in their 36th year.

“Armadillo Homes defeated some tough competition to take out this sought after award. They typify the quality craftsmanship, dedication and passion of Victorian Master Builders,” he said.

Among the other major winners were Albury builder Scott James who was named Regional Master Builder of the Year, Doreen builder Brent Henry who was crowned Young Builder of the Year and Positive Footprints who won the title for Best Sustainable Energy Home for a Seaholme property.

Holly McSweeney interviewed guests and winners on the red carpet while comedian and actor, Stephen Curry was MC for the night and The Chloe Maggs

band entertained the crowd with a stellar performance.

The concept for this project was to undertake an innovative renovation that would take full advantage of the beachside location and reinstate the beachside atmosphere of the original building. The original interior was small and dark. The internal living spaces

were disjointed and the outlook had no regard for the unique environment. The contemporary renovation is a design with a timeless classic façade and a new interior that is open and inviting, offering a seamless flow of space and welcoming in ample natural light. The long-ignored

views of the bay can now be enjoyed from the existing levels with a third floor also added to capture even more stunning beach views and provide additional floor space to the fixed footprint.

THE 2014 REGIONAL RESIDENTIAL BUILDER OF THE YEAR WAS AWARDED TO SCOTT JAMES BUILDER FOR THEIR PROJECT IN ALBURY

This contemporary rural home with “T-shaped” floorplan, has a vast number of double-glazed, aluminium-framed commercial windows that take in the surrounding Australian bushland. The entry to the home is a custom-made pivot-hinged cedar door. The home,

which features four bedrooms plus a study, has a resourceful use of space and stunning modern finishes and fixtures throughout. The main open-plan living zone has a raked ceiling projecting four metres beyond the building. A double-sided wood combustion fireplace acts

as a subtle divider in the room. The many features in the bathroom include frameless shower screen, floor to ceiling tiles, freestanding bath and floating timber vanities with stone benches.

This year and 2015 mark the anniversary of the start of World War I. It’s a timely reminder of the sacrifices made by our forefathers in the theatre of war.

At the Master Builders East Melbourne office, we have an honour board donated by Bowen and Pomeroy that recognises the 61 known Master Builders members, who served and fell in the various conflicts of the Great War.

Andrew Fisher, who became Prime Minister one month after Australia

entered the war, vowed that Australia would "stand beside our own to help and defend Britain to the last man and the last shilling." In 1914, the Australian war effort was dominated by recruiting and equipping a force to fight overseas. King George IV, Queen Elizabeth’s father, was reigning monarch.

For Australia, as for many nations, the First World War remains the most costly conflict in terms of deaths and casualties. From a population of fewer than five million, 416,809 men enlisted, of which more than 60,000 were killed and 156,000 were wounded, gassed, or taken prisoner.

It seems 1915 was the year most of our members joined the armed services. For the purposes of this article, I have selected one name from the honour board for each year of the war and will detail their service history. The numbers of members who fought in each year of the conflict are as follows:• 1914: Eight members• 1915: 23 members • 1916: 18 enlisted• 1917: Seven enlisted • 1918: Five enlisted • Out of the 61 known members who

served, seven were killed in action.

George enlisted in 1915 and held the rank of Sapper. He served with the 1st Australian Signals Division. In March 1916, the first AIF Signals Division moved to France, after serving in the Gallipoli campaign, taking over part of the line in the ‘nursery sector’ around Armentieres. In 1917, it was involved in the pursuit of the Germans to the Hindenburg Line. While maintaining outposts close to that line around Lagnicourt, the division was struck by a powerful German counterattack on 15 April 1917, but managed to hold it off. In May 1917, it relieved the Second Division in the Second Battle of Bullecourt. 

George Kemp was killed in action on the 23 May 1917, in the second Battle of Bullecourt. This battle was renowned as the battle that caused the most distrust of British officers by Australian troops during the entire course of WWI. He was

23 years old and is buried in the Queant Cemetry in Nord De Pas Calais.

1915: Robert Crow Robert Crow enlisted on 8 July 1915, and was part of The 23rd Battalion. He was 28 years old at the time of enlisting. The 23rd Battalion was raised in Victoria in March 1915 as the third battalion of the 6th Brigade. After initial training, it left Australia in May and arrived in Egypt, where it would complete its advanced training, in June. The 23rd Battalion was responsible for the manning of Lone Pine in the Gallipoli campaign. The fighting at Lone Pine was so dangerous and exhausting that battalions were relieved every day. The 23rd battalion alternated with the 24th Battalion at Lone Pine until they left Gallipoli in December 1915. The battalion was next ‘in the line’ on 10 April 1916, when it occupied forward trenches

1914: George A Kemp (Killed In Action) George Kemp was born in Collingwood to Adam and Christina Kemp in 1894. He lived in the Malvern area and enlisted in Collingwood. He became a builder in the early 1900s.

of the Armentières sector in northern France. In July 1916, the 23rd Battalion served in the horrific battles of Pozières and Mouquet Farm.

It is estimated that the battalion lost almost 90 per cent of its original members; this battle is where Robert Crow was awarded the Military Medal; records of his recommendation quote:

“For distinguished conduct in command of an entrenchment party on the 4/5 of August 1914, when R Crow, succeeded in crushing the line under machine gun fire.”

In April 1918, the 23rd helped to turn back the German spring offensive, and then took part in the battles that would mark the beginning of Germany’s defeat; Hamel, Amiens and Mont St Quentin.

Former Member Murray Crow wrote this about his father, Robert, the Crow family and their involvement in WWI:

“In the First World War ,three of Archibald Rae Paterson Crow’s sons went overseas, and one, my father Robert, was awarded the Military Medal for bravery in the field at Pozieres.”

Another family still involved in the construction industry and who had family members serve and be recorded on the honours board is the Cockram family. Three of the Cockrams served in WWI; Thomas, Maurice and Louis.

1916: Maurice George CockramMaurice enlisted on 6 March 1916, and was sent to the 1st Divisional Ammunition Column 12 to 24 Reinforcements, as a driver. Maurice was a student at the time of enlisting and was aged 18 years 9 months, possibly the youngest Cockram to enlist. During WWI he drove the supplies to the fronts by horse or vehicle.

The Australian Submarine Corporation (ASC) numbered an incredible 10,547 officers and 315,334 men. In addition were tens of thousands of Indian, Egyptian, Chinese and other native labourers, carriers and stores men, under

orders of the ASC. Yet this vast, sprawling organisation - so vital to enabling the army to fight - merits just four mentions in the Official History of the War (Australian War Memorial website).

1917: John A Ellis Alfred John Ellis enlisted on 6 June 1915 in Melbourne at the age of 18 years and eight months. A carpenter by trade, he was sent to 3rd reinforcements of the 27th battalion. His next of kin was listed as his mother who resided in South Australia. He held the rank of Private. On 8 July 1916, the 7th Battalion was ordered to march to the Somme to protect the 1st Australian Division at Pozieres. On 27 July the 7th Brigade stormed the German line but the attack proved unsuccessful and they retreated.The 27th was then called for a second attack on 4 August, this time in the area of Bapaume. Starting at positions around La Boiselle, the 27th, under artillery fire, took the first line of German trenches. Under extreme conditions they then proceeded to consolidate the line. On 5 August a German counter attack proved costly to both sides, with the Germans losing 100 men and 60 prisoners of war. On the same day, the 27th dug in and suffered severe shelling from positions around Thiepval.They succeeded to take the second line in ‘no man’s land’ after patrols found this area. The 27th, although successful, suffered heavy casualties with 40 killed, 289 wounded and 67 missing. They were relieved by the 48th Battalion.

The 27th Battalion also served in many campaigns including: Lemnos Islands, the Western Front (including the Battle of Menin Road). The battalion captured a section of the German line known as the ‘Blue Line’ between Polygon Wood and a position known as the ‘Iron Cross Redoubt’. During the entirety of World War I, the battalion suffered 762 men killed or on active service, as well as a further 2155 wounded.

Although on the honour board it clearly states ‘J A Ellis’, after my extensive research of the 660 records of known Ellis’, I believe that we may have the

wrong name on the board, which coincidently lists his enlistment year as 1916, the same as his service number.

1918: Leith Clyde CrowYarraville carpenter Leith Clyde Crow enlisted on 8 April 1918. He was the brother of Robert Crow and was sent to the 1-17 Reinforcements who mainly consisted of Victorian troops. Not a lot of information can be found about the 1-17 Reinforcements as its name suggests; it was a unit that relieved larger battalions. Research suggests that they could have served at the Battle of Hammel under General Monash. As a result of losing ground on the Russian front, the Germans concentrated on capturing the Western Front. Located south of the River Somme, about three kilometres north-west of Villers-Bretonneux on a spur between two hills, Hamel was strategically important to both the Allies and Germans. The high ground offered the Germans good observation of the sector, which they had been using to fire artillery barrages on Villers-Bretonneux. This battle was the model that was used for the rest of WWI. 112,399 Victorians enlisted for service in WWI and 89,000 Victorians served abroad. Victorians represented 27 per cent of the total First Australian Imperial Force (AIF) which numbered 416,809 in total.• 7.9 per cent of the Victorian

population enlisted• 38.6 per cent of Victorian males aged

18 to 44 enlisted• 19,000 Victorians died during the war

as a result of their service

Victorians won 17 of the 63 Victoria Crosses awarded to members of the First AIF.

It is interesting to note that the members I chose for this article all served on or around areas of the Western Front.

Experiential learning: how simulation learning is supporting the building and construction industry

With more than 1500 participants coming through the Building Leadership Simulation Centre (BLSC), it was exciting to have Monash University recently conduct a study on the next generation of supervisors and managers participating in training and development at the BLSC, and to assess the impact of experiential and simulation based learning in the Australian building and construction Industry.

Through the use of qualitative and quantitative data, including surveys and interviews with the staff and management at the BLSC, Monash University found simulation learning a positive experience for students, and research indicates an increased transfer of knowledge and skills to the workplace. Such examples include, communication, conflict resolution, ability to prioritise issues and generally the overall effective management of workplace situations as they arise.

What can we learn from these results? Leadership skills can be finetuned. We have found that the most common five key areas that require practise, self awareness and development are:

StandardsUse fresh eyes. It can be easier to accept lower standards on site in order to steer clear of a difficult conversation. An example is leaving the site in a mess. Why? That’s how they always leave it. Demand more!

Difficult conversationsFocus on the issue. Participants tend to dance their way around a specific issue or avoid it altogether when they feel that a conversation becomes awkward, uncomfortable or confrontational.

EvaluationIt is okay to take a step back, consider all available options and then evaluate. Don’t get caught rapid firing solutions.

Active listeningSuspend assumptions, refrain from making judgements and silence your inner chatter long enough to listen. Use both your eyes and ears and if someone shows they don’t like what you are saying, discuss with them that it looks like they don’t agree with what has just been said.

Productive meetingsMeetings don’t have to be a waste of time. Ensure that your next meeting has structure, involves all parties and arrives at production actions and outcomes.

A near sell out crowd of 128 people gathered at the Building Leadership Simulation Centre (BLSC) for the 2014 Master Builders Green Living Conference to hear about the latest developments in sustainable construction and design. The aim of the conference was to help builders deliver better quality houses and improved outcomes for clients. Attendees heard from a range of speakers and were able to receive real hands on demonstrations of a range of products.

Continuing on our theme from last year, ‘Leaky Buildings’, Thomas van Raamsdonk the General Manager of Pro Clima Australia, spoke about the problem of leaky buildings in Australia. He talked about how this silent problem had appeared in other countries and how it is beginning to manifest itself in Australia despite the industry’s best efforts to ensure buildings comply with the Building Code. Thomas illustrated his presentation with a number of photos of problems and the reasons for them. He then spoke about how these problems can be addressed with a better understanding of how moisture moves through a building, together with a better understanding of wall systems, the materials used and their ability to let the water vapour out but stop moisture getting in.

Prefabrication is becoming an increasing part of the construction industry, and Nick Cui from Pryda Australia came along to tell us about their engineered timber floor cassette systems and Surefoot Footings, the concrete-free foundation system. He showed how panelised floor cassettes can be used for sub-floor construction as an alternative to concrete slabs as well as first floor applications where speed and efficiency results in significantly quicker construction times.

Renovations often provide the perfect opportunity to improve the energy efficiency and general liveability of existing houses. Sarah Fiess from Sustainability Victoria discussed the results of a recently completed project in her presentation, ‘Building Smarter Renovations’, and provided an insight into how potential clients think. Victorians spend more than $2 billion annually renovating their homes and nearly 90 per cent of the people Sustainability Victoria spoke to during surveys said that energy efficiency was ‘extremely’, ‘very’ or ‘fairly’ important to them. Sarah also presented information on a variety of options to improve the energy efficiency of existing homes, and their ‘payback periods’. The carbon tax debate continues to get airplay with large gas price increases forecast over the next few years. Subsequently, there is a lot of interest in making homes carbon neutral. This means that they are able to produce more power than they consume. Dr Stephen Bygrave, the CEO of Beyond Zero Emissions, showed how this was a possibility using current technologies

and that it was also economically viable by presenting the findings of their Zero Carbon Australia Buildings Plan. The first step involves the upgrade of the house by reducing drafts, adding high performance windows and increasing the insulation. Gas appliances are then replaced with highly efficient electrical appliances and then a photovoltaic system is fitted to produce the houses energy needs. Sound impossible? Tosh Szatow, the Director and Co-Founder of Energy for the People spoke about the rapidly changing cost of solar and battery storage systems and how this has created the potential to align financial, social and environmental objectives in housing projects by providing local communities with their own source of power.

Cecille Weldon from liveability.com.au told us about a new training program for real estate agents so that they can better recognise sustainable features of houses. This will allow them to be better valued and also to be an integral part of the real estate listing.

accredited Passive House tradesmen.Passive House is an international concept and involves a very well-insulated, virtually air-tight building that is primarily heated by passive solar gain and by internal gains from people and electrical equipment. Energy losses are minimised. Any remaining heat demand is provided by an extremely small source. Avoidance of heat gain through shading and window orientation also helps to limit any cooling load, which is similarly minimised. An energy recovery ventilator provides a constant, balanced fresh air supply. The result is an impressive system

that not only saves up to 90 per cent of space heating costs, but also provides a uniquely terrific indoor air quality. 

The final session provided an opportunity for those attending to ask questions and participate in a discussion with a panel involving the speakers. This lively session proved to be a great interactive session with the time passing very quickly.

In the afternoon, a number of products were on display and small groups of attendees were able to hear from the product suppliers about the product

benefits, ask questions and get a real hands on feel for each product. In this way the builders were able to allay any qualms they had with using or switching to a new product.

RYLOCK When discussing aluminium windows, the terms thermally improved and thermally broken often arise. In Australia a thermally improved frame was originally defined as having design features resulting in a lower U-value than ‘generic’ framing. This means that it conducts less heat in and out of the house than a standard aluminium frame.

A thermally broken frame however has a low conductivity material at least 5.3mm wide between the internal and external extrusions. This is commonly achieved by inserting extruded polyamide (often seen as a ‘black strip’ in the middle of the frame). It thus reduces heat transfer through the frame even more.

Ultimately the complete product U-value (including frame and glass) is the most important factor for winter time energy efficiency. This is one of the values used in calculating the houses Star Rating by NatHERS.

As of October 2014, terms such as generic and thermally improved will officially become obsolete. Per the AFRC (Australian Fenestration Rating Council) media release of September 2014, “…default windows will supersede the currently available “Generic” window systems which were developed as an interim measure almost eight years ago. These algorithmically converted performances are technically incorrect and their replacement will allow much more flexibility for designers, architects, energy raters and window manufacturers in selecting accurate and scientifically valid window performances.”

These significant changes will be discussed in more detail in the next Green Living Tip.

LEGAL

On 8 October 2014 the High Court reversed

a NSW Court of Appeal decision that found a builder owes a duty of care to the Owners Corporation of a strata-titled and apartment complex to prevent latent defects in the common property.

Brookfield built the complex pursuant to a design and construct contract with the developer who owned the land. Upon registration of a strata plan in relation to part of the complex which was used as private serviced apartments, the Owners Corporation was created. Shortly after completion, the Owners Corporation manager discovered defects in the common property. The Owners Corporation soon after commenced an action in the Supreme Court of NSW against the builder, Brookfield.

In 2012, the Supreme Court of NSW first heard this matter which was commenced by the Owners Corporation to recover damages including the cost of repairing latent defects in the common property of the complex. The Owners Corporation claimed that Brookfield was liable in negligence for breach of a duty to take reasonable care to avoid a reasonably foreseeable economic loss to the Owners Corporation in having to make good the consequences of latent defects caused by the building’s defective design and/

or construction. At first instance, Justice McDougall held that Brookfield did not owe a duty of care to the Owners Corporation, reasoning that it was not open to a trial judge to impose an additional or extend the common law duty of care.

On appeal to the NSW Court of Appeal, Brookfield argued that although it accepted that there can be concurrent contractual and tortious duties, it argued that the contract entered into with the developer was of such complexity and detail that it precluded a concurrent tortuous duty from ever arising.

The Court of Appeal unanimously held that Brookfield did owe the Owners Corporation a duty of care, albeit a narrower duty to avoid causing loss resulting from latent defects which were structural and dangerous or which made the serviced apartments uninhabitable. Central to this decision was that the Court of Appeal found that both the developer and subsequently the Owners Corporation were in a sufficiently vulnerable position so as to warrant a duty of care.

Brookfield sought and was granted leave to appeal this decision to the High Court. Central to the argument put forward by Brookfield was that the parties (Brookfield and the developer) had negotiated sophisticated and detailed provisions in their D&C contract dealing with defects and limiting liability and further the contract of sale for the apartments conferred specific rights

against the developer only in relation to defects for a specified time.

The High Court in a unanimous decision agreed that in these circumstances, the seminal case of Bryan v Maloney (1995) 182 CLR 609, which recognised the concept of the vulnerability of owners for defects in a domestic home, which had held that a builder did owe a duty of care to subsequent owners, did not apply here.

The High Court drew a distinction between sophisticated parties which had the opportunity to protect their own interests contractually and from that of the original and subsequent owners in Bryan v Maloney and said that the duty did not extend in these circumstance to purchasers of commercial properties.

This distinction was sufficient for the High Court to allow the appeal by Brookfield and hold that although a duty of care may continue to arise to the original owners (ie the developer) to avoid economic loss, this duty did not extend to subsequent owners (in this case the Owners Corporation).

The message here is that builders will continue to owe a Bryan v Maloney duty of care to subsequent purchasers of domestic properties for economic loss due to defective work, but the High Court has in this decision reaffirmed that it will not extend this duty to purchasers of commercial properties, especially in circumstances where the parties have had the ability to contractually protect their interests against defective work.

It was the year Matthew not only received his $1200 Master Builders Foundation Scholarship but was also named the State Apprentice of the Year.

Four years on, Careers Manager Jarrod Flanigan spoke to Matthew about how things are in the building industry and how he has benefited from receiving the scholarship.

Hi Matt, how are things going in Cobram?Things are going great, I have set up my own company and I have a lot of work both in Victoria and New South Wales. MSConstructions has been up and running now for three years and we are doing two new homes each year, a couple of renovations and about 30 small bathroom renovations a year and a heap of small jobs, decks, fences and maintenance work; so I can’t complain.

You received your scholarship in 2010, how did you use it?It seems such a long time ago; I used the $700 for training to get my Cert IV in Building at GOTAFE in Benalla. This was probably the best thing I’ve done next to marrying my wife. It meant I was able to apply for Builders Registration in both Victoria and NSW. Also in doing

the course at GOTAFE, it put me in touch with Master Builders Wodonga Regional Manager, Steve Donaghey who was a fantastic help in regards to applying for registration in both states. As I look back, the scholarship was the kick start I needed to get where I am today.

As for the tools, you show me any apprentice who wouldn’t appreciate $500 worth of tools. The wage back then was hard enough to live on, I suppose a little harder when you have a partner, child and a mortgage. So getting a new drill and some other small bits and pieces was absolutely fantastic.

Would you recommend applying for the scholarships?Bloody oath, and now that I’ve heard the scholarships are worth $2200, it makes it even better. Being able to save on TAFE fees and getting tools that you don’t have to pay for is great. Plus the links into Master Builders are priceless for the assistance you can get. Yes, it takes a bit of time to fill in the paperwork and it takes a little bit of time to get approved but for me it was worth it and I can’t see how it can’t be a benefit.

“My advice is go for it you will not regret it.“

Chris gets recognised in QueenslandChris from Case Study Construction was approached by a former client, a property developer, to build a five- story apartment building on the Gold Coast.

The developer could have gone with a locally based builder but he chose Chris because of the successful partnership that the two had formed on their Victorian based projects.

Apart from finding the idea of some time away on the Gold Coast appealing, Chris knew that he was capable of doing the project and that he could manage it effectively. Chris also knew that in order to undertake the project he could not rely upon his Victorian commercial or domestic registration and that he would need to become registered with the Queensland Building and Construction Commission.

When Chris started his career as a domestic builder he sought assistance from Master Builders and a few years later, when he decided to obtain a commercial builders license, he again sought assistance from Master Builders. Chris again picked up the phone to Master Builders and spoke to Peter Katsambanis, Builder Registration Advisor.

“I am currently registered as a builder in Victoria but I want to undertake a project in Queensland, can you please tell me what I need to do?” Chris asked.

“Registration is not the same in Victoria as it is in Queensland,” Peter explained.

“In Victoria we have domestic and commercial registration but in Queensland there is low rise, medium rise and open license.

“We have knowledge of the licensing requirements for Queensland and we can assist you to prepare your application for the Commission,” Peter advised.

Peter sent Chris the Mutual Recognition application form for the Queensland Building and Construction Commission and asked Chris to give him a call once he received the paperwork so that he could talk him through it and answer any questions that he might have.

Chris was thrilled that someone from Master Builders could confidently talk him through the licensing process. As Chris hung up the phone his five-year- old son came charging into the room with Mrs Chris a few steps behind.

“We better think about buying some of those theme park tickets because it looks like we might be heading for the Gold Coast soon!” he happily informed them.

The day was a four person Ambrose event and provided a great opportunity for local Master Builders members and tradespeople to get together to enjoy a social day out.

SOAR Adventures is a local adventure based learning program aimed at assisting students’ transition into healthy adults, with quality leadership and relational skills. Their aim is to empower young people.

HALT aims to raise awareness of mental health in the building industry to reduce depression and suicide. HALT has had more than 600 tradies attend events in the past three months and hopes to expand further across Victoria and interstate next year.

The charities provided a barbecue lunch and afternoon tea for the golfers. It was a huge success thanks also to the generosity of major sponsor Origin Energy and many local businesses who donated cash, gift vouchers and prizes.

A huge thank you to everyone for their efforts in bringing the day together. Ballarat based Building Surveyor Jason Foote has just been approved by the Building Practitioners Board for his Building Surveyor Limited qualification. We congratulate Jason on this achievement and wish him all the best in this step in his career path.

With Jason now becoming a Limited Building Surveyor, there are now two Ballarat based building surveyors able to assess and issue permits, with Wayne Cooper continuing in his role as Building Surveyor Manager in Ballarat.

With Christmas fast approaching, the staff at Geelong office are gearing up to ensure all of your needs are met, as the industry heads towards its well-earned break.

The office has a staff of four: Tony Bugeja (Building Surveyor/Manager), Alex Ilioski (Building Inspector), Dylan de Silva (Cadet Building Inspector/Assistant), and Carolyn Smith (Building Services Coordinator). The team offers a great service to members and non members alike in the Geelong region, and are always keen to engage any new and prospective clients to assist them with their business needs.

The local Geelong Section has just held their Annual General Meeting. General Manger of Commercial Services, Viviana Hood, officiated and the committee was duly elected. Chairman Mark Little and the committee are very keen to encourage new members to come along and bring a friend to the meetings, to hear relevant updates and current information in an informal and relaxed atmosphere.

Master Builders staff including Area Manager, Lyn Lowndes, attended a forum held by the Greater Geelong Community Collective Effort on Substance Abuse (GGCCESA). GGCCESA Project Manager Tony Francis invited key staff to attend the forum with other relevant industry professionals to look into the best possible ways to address the current ice epidemic that is sweeping across many regional areas. This will be an ongoing commitment from Master Builders to work in conjunction with many other community based organisations in the Geelong region.

GIPPSLANDGippsland Area Manager Rod Ware has been making a huge effort to help bridge the gap among regions.

“We have members in small remote towns who can feel isolated at times, so I tried a new event during July and August; a Friday lunch meeting,” Rod said.

“It’s a tough job, but someone has to do it,” he joked.

By arranging to meet in small groups, Rod was able to touch base with some of the more remote members in Sale and Yarram in July and August.

“Both events went well; we did not get large numbers, but the members that attended were very appreciative of the opportunity to catch up and discuss current industry issues,” said Rod.

WARRNAMBOOLSpring is here, and building activity is on the rise in the South West. There has been consistent growth in building approvals over the past few months; the new sub-divisions are filling up, with the Wangoom Road Estate in particular having more finished homes than vacant blocks.

Master Builders Building Services has received its first permit application for the new Wollaston Road Estate Sommerville Boulevard from member company JG King Pty Ltd.

It’s farewell to Graeme Schultz from a full time role in our Warrnambool office. Graeme wants to reduce his work load, providing him with the opportunity to pursue other interests. He will however still provide inspection services from time to time. This leaves an opportunity for any registered building inspectors (or nearly registered) to fill the gap. Warrnambool Building Surveyor Manager, Ian Welch thanked Graeme for his efforts over the past two years and wished him well with his future endeavours.

How long have you been with Master Builders? This time, it will be three years in December.

What does your job entail? I am responsible for the Building Services Business Unit, the Membership and Business Development Departments, our registered training organisation and the OHS Unit.

What’s one thing members may not know about your departments? The diversity, complexity and geographical spread of the departments means there is always something new to learn.

How do you help Master Builders members? Our members are always the first consideration when we approach any matter, regardless of whether the request is for technical advice, educational advice, legal, IR and OHS advice or any general inquiry relating to building and construction.

What’s the most rewarding part of your job? Finding a solution to any problems or inquiries a member might have.

What’s the most challenging part of your job? There are no challenges, only opportunities.

What do you enjoy most about working for Master Builders? Always learning.

What do you enjoy doing in your free time? What free time? No, seriously, travelling to new places when I can. This year included Cuba, Jamaica, New York and Texas as well as England in October for a family wedding. I’ve had a very lucky year. Pretty sure there’ll be no travelling for the next couple of years.

Tell us one interesting or surprising fact about yourself? My majors at university included Psychology and Bahasa Indonesia honours (I used to be fluent – sadly, no longer) which included Arabic script.

How long have you been with Master Builders? One year.

What does your job entail? Servicing our members in the building permit area from job submission to the job completion.

What’s one thing members may not know about your department? We work closely with the Shepparton office and we share inspections if we need to.

How do you help Master Builders members? We guide them through the building permit process which can be confusing between two different states.

What’s the most rewarding part of your job? Dealing one-on-one with members and seeing jobs through right from the very beginning to completion.

What’s the most challenging part of your job? Dealing with builders and clients and sometimes their differing expectations, and keeping up-to-date with requirements for both Victoria and New South Wales.

What do you enjoy most about working for Master Builders? Great colleagues and grateful members.

What do you enjoy doing in your free time? Spending time with friends and wakeboarding at the weir.

2014 has been one of Leighton Contractors’ busiest years in Melbourne. Across transport, commercial, cultural, health and government building projects, Leighton has been proud to work with clients and communities to strengthen Melbourne.

Award-winning projects Leighton’s Olivia Newton-John Cancer and Wellness Centre won 2014 award for Excellence in Construction of Commercial Buildings over $80 million – the second time the project has been recognised by Master Builders, following a Special Commendation for Safety in 2012.

Other recently completed projects include the Victorian Emergency Management Centre, a state-of-the-art training facility that provides the Metropolitan Fire Brigade with a learning environment that simulates realistic urban emergency scenarios. In Thornbury, meanwhile, Leighton recently completed the Islamic Museum of Australia, a community initiative that showcases Islamic history and culture, and the first museum of its kind in the country.

Melbourne Airport expansion Leighton Contractors projects underway include two key packages at Melbourne Airport; a new Terminal 4 and a new multi-level car park and access roads. The 25,000m2 Terminal 4 will be completed mid-2015 and will be vital in integrating the airport’s main terminal and the existing Terminal 4. The seven-level car park and access road project will provide a new transport hub for the airport and much-needed extra capacity, with 2650 additional car spaces, as well as duplication of Melrose Drive.

Nearby in Mickleham, another building project underway is the Commonwealth’s Post Entry Quarantine Facility, replacing five quarantine facilities across Australia

into a single consolidated facility and ensuring the integrity of the country’s long-term biosecurity is strengthened.

Delivering in the city In the heart of Melbourne’s CBD, Leighton Contractors is building 567 Collins Street, a 26-level office tower (55,000m2 NLA) designed to provide a vibrant ‘town square’ atmosphere with a dramatic three-level high foyer. The largest premium grade commercial tower constructed in Melbourne for 25 years,

567 Collins Street is designed to meet a 5-Star Green Star as-built rating and a 5-Star NABERS energy rating.

Its next challenge is the redevelopment of the Northern Hospital in Epping. Stage 1 of the redevelopment will provide new acute services including 32 new beds. Leighton Contractors is proud to be delivering the project, which will be the first step to meeting the increasing demand for clinical services in Northern Metropolitan Melbourne.

Gippsland Section Deputy Chairman Ken Horstman has spent more than 43 years in the building industry, and been a registered builder for 33 years. He has extensive experience in both domestic extension/renovation work, as well as vast experience site managing large commercial construction projects valued up to $8 million.

Ken has given many years service on the Master Builders Gippsland Executive Committee with five years as the Gippsland Section Chairman from 2008. He has always been prepared to help Master Builders whenever asked. The support that Ken has given to Master Builders has played a large part in the establishment of a strong and vibrant membership base throughout Gippsland.

When asked about the project he is most proud of, Ken says there are two.

“As far as commercial projects go, I’m most proud of working on the Loch Sport Pub in 1988,” he said.

“In the domestic area, I worked on an extension that had a curved roof and ceiling that was both challenging and rewarding. I still get comments from the client; she says she is still amazed at how wonderful she feels every time she opens the front door.”

Ken even recalls the cost of the first home he built.

“It was 1982 and the house cost $90,000,” he said.

Over the years, Ken has seen many changes in the industry.

“I would say the biggest changes would be the tools, trusses and the move from OB hard wood to Pine,” he said.

The one piece of advice Ken offers new builders is the following.

“Ensure that you spend the time to get your paperwork right. Everything from contracts to estimating, if you have a good paper trail you can manage your projects and continuously improve your builds,” said Ken.

“My favourite thing about being a builder is the satisfaction of working with lots of different woods.”

This interest is illustrated by an impressive collection of timber in his man shed.

“I also enjoy building a quality project the client loves, and is happy to pay for.”

How long have you been in the industry? In China, I have been working in the building industry 18 years, and started the Australian business two years ago.

Are any of your family members in the building Industry? When I first arrived in Australia, I was on my own. I found that people here are kind and friendly and this helped me to develop my career and open up opportunities here.

How did you first get started in the building industry? Capitalising on the opportunities of Chinese economic development was very important for me. After gaining success in the manufacturing industry, I saw that the building industry had huge potential for development in China. I decided to position and develop my company into a diversified enterprise.

What made you decide to take the career path of the building industry? I enjoy creating and building brand new homes for my clients.

What is it about your job that you enjoy most? The pride and have self satisfaction from seeing my clients trusting me and being satisfied with my work.

Is there anything you would change about the building industry? I hope to develop modular architecture, so that people can design and build their dream house just like playing LEGO. It will make the building industry much more convenient, efficient and simple.

Why did you decide to become a member of the Master Builders? Master Builders has a respected reputation within the industry and shapes the general public’s awareness of the building profession. I wanted to be a part of that.

What would you say are the most important key points to the success of a building business? Quality, innovation, integrity and cost-effectiveness. We aim to provide and uphold all of these values.

Based on your own experience, would you be encouraging the youth of today to pursue a career in the building industry? I would encourage young people to learn and acquire more knowledge and skills in different areas and levels. This will help you to gain success in future careers.

What interests do you have outside of the building industry? The building industry is pivotal to the economic development of the country. I always take an interest in other industries such as construction and development, the derivative products of building industry, the trade promotion of architectural design and emerging materials. These would be my personal development direction for the future.

PROTECT YOUR BUSINESS AND KNOW YOUR RESPONSIBILITIES UNDER CURRENT ROAD

TRANSPORT LAWS.

Does your business consign, pack, load or receive goods via truck?

If the answer is yes, then you can be held legally liable for breaches of road transport laws – even if you have never stepped foot inside the cab of a heavy vehicle.

This is due to the chain of responsibility (CoR), which is a legal concept that can hold all parties in the supply chain legally responsible for their actions or inactions.

The CoR provisions in the Heavy Vehicle National Law apply to Victoria, New South Wales, Queensland, South Australia, Tasmania and the ACT. Western Australia is also introducing a similar concept in its state laws.

Under CoR, parties in the supply chain are obliged to take all reasonable steps to prevent fatigue, speed, and mass, dimension and load restraint breaches when completing a transport task.These parties include anyone with some

level of control over transport operations, including consignors, consignees, schedulers, operators, managers, loading managers and drivers.

For example, a customer can be held accountable for a driver failing to meet their work/rest requirements if they use their influence to impose a delivery deadline that could not be met under normal circumstances.

Contracts that require a driver to break the law are illegal.

What is reasonable?The steps considered ‘reasonable’ will also vary depending on the role you hold in the chain of responsibility and the task at hand.

According to the National Heavy Vehicle Regulator (NHVR), the national agency responsible for administering the national transport law, a consignor or consignee’s duties under CoR include making sure that:

• Loads do not exceed vehicle mass or dimension limits.

• Goods carried on your behalf are able to be appropriately secured.

• Operators carrying freight containers have a valid Container Weight Declaration.

Your job requirements do not require or encourage drivers to: • exceed the speed limits.• exceed regulated driving hours.• fail to meet the minimum

rest requirements.• drive while impaired by fatigue.

A consignor or consignee can potentially demonstrate reasonable steps by:Having processes in place to accurately weigh and measure all goods to be transported by road.

Set realistic delivery timelines, which make allowances for unexpected delays such as traffic or road works.

Requesting information from transport operators and/or drivers about what systems they have in place to prevent breaches of road transport laws when transporting your goods.

Using a sub-contractor that is accredited under a safety accreditation scheme can be an important part of a reasonable steps defence. Undertaking CoR training and implementing the results can also be listed as part of a reasonable steps defence.

Keeping abreast of lawsHowever, customers should be aware

that the Chain of Responsibility is not a static piece of legislation.

Following the fatal Mona Vale crash last year, the Australian Trucking Association has called for ministers to extend the chain of responsibility concept to cover vehicle maintenance, as well as the current fatigue, speed and mass, dimension and load restraint requirements.

This extension would require parties in the chain to take all reasonable steps ensure workshop staff can do their jobs properly – for example, by delivering adequate budgets, equipment, resources and training.

NAILING THE NAIL GUN

The convenience, long battery life and safety features offered by cordless nail guns have seen a shift away from traditional models.

Invented in the 1950s, nail guns have definitely earnt their place on the work site as a tradie’s tool-belt necessity.

Protective wearIan says it’s important that users wear Personal Protective Equipment (PPE) during operation. While many models have safety mechanisms built into them, the skills and knowledge of the user, coupled with PPE, is still the key to workplace safety.

“Preventing injuries is always a priority, however accidents happen, so wearing protective equipment such as hard hats, safety goggles and ear plugs is highly recommended for anyone using a nail gun,” says Ian.

“These basic items will help protect you from any ricochets and the loud ‘impulse’ noise peaks made by the nail gun.

Worksite safety remains a paramount consideration in the construction industry, which is why it’s important to make informed decisions, as well as match the correct PPE and the needs of a certain worksite or job to the features of the correct nail gun.  

When working with powerful tools like the nail gun, Ian says common sense should prevail. Personal protective gear should always be worn and a clearly defined, isolated area should be used.

Thanks to the introduction of Li-ion batteries, cordless nail guns also have an impressive runtime, making them ideal for use on the worksite, with a single battery charge usually enough to last all day.

The advantages offered by cordless nail gun means consumers are likely to continue moving away from pneumatic and gas systems.

As well as having a reliable runtime, cordless nail guns are also far more portable than pneumatic nail guns, making them well-suited and much safer for use in tight or obstructed areas.

Staying safe on siteNail guns, however, are not without their own safety issues. While worksite safety might be second nature to business owners, research shows that nail guns are still among the leading causes of workplace accidents.

According to Home Timber & Hardware Power tools buyer, Ian Male, while nail guns boost productivity and have evolved significantly over time, they also cause a high number of injuries each year and implementing training and safety measures is paramount to ensuring work site safety.

“Be it pneumatic, gas or cordless nail guns, there are a myriad of ways tradies can injure themselves or others on a work site. Operators carrying the gun, with the trigger depressed, could accidentally bump the contact tip or nails could simply ricochet, which is why safety training is essential for both new and experienced workers,” says Ian.  

Closely supervising first-time users will help build their confidence and eliminate harm to themselves or others on site. Caution should be taken when using new materials and users are advised to seek advice if unsure how to use the tool or reload it.  

It’s recommended that hard-surfaced products be tested in controlled environments to eliminate inadvertent ricochet. Particular caution should be exercised when in ‘bump fire’ mode, often the preference for time-pressured

Australian home-building group G.J. Gardner Homes has been ranked 117 in the Top 200 franchises worldwide. The company improved on its 2013 ranking of 122nd.

The prestigious ranking by the Franchise Times, which ranks most franchises with operations in the US, including McDonalds, KFC and Remax, is based on group turnover.G.J. Gardner Homes CEO Darren Wallis said he was thrilled to be included in the Top 200 list.
