*Clarification on Copyright

*Original excerpted from Festival Features, March 1995, a newsletter of The Frederick Harris Music Co., Limited. Revised November 2004. Reprinted with permission.

The term “copyright” refers to the rights of a creator of intellectual property, such as a work of music. Although the rights may not be easily tangible, a creative work is a valuable property.

The Canadian Copyright Act protects the rights of creators to retain control over, and be compensated for, the use of their intellectual property. Many people do not realize that the unauthorized reproduction of copyrighted materials, such as print music, is in essence, theft. As music educators, we all recognize the value of creativity. Music teachers can play an important role in encouraging their students to respect composers' efforts by ensuring that students are made aware of the intent of the Canadian Copyright Act.

Misconception 1: A teacher may copy music for educational purposes. False. Many teachers may be under the impression that photocopying for educational use is legal. Although public school boards, colleges, and universities may have negotiated licenses to enjoy special copying privileges in defined situations, print music is excluded from this arrangement. This means that teachers – including independent studio music teachers – are not authorized to photocopy print music. The publisher, often acting as the representative of the composer, should be contacted directly to obtain permission to make copies of print music for any purpose.

Misconception 2: It is permissible to photocopy music in order to facilitate page turns. False. Permission must be granted by the holder of the copyright (the publisher) on the composer's behalf in order for a copy to be made for any purpose, including the facilitation of page turns.*

To understand the rationale underpinning this aspect of the Copyright Act, imagine that you wish to borrow your neighbour's shovel. Your neighbour will probably not say “no” or charge you a fee to use the shovel, but you would never borrow it without first seeking permission. As with your neighbour, a publisher's permission is required before you “borrow” an extra copy of print music on which the publisher holds the copyright.

Misconception 3: It is legal to photocopy music from out-of-print publications. False. A creator's right to be compensated for the use of their creation continues after a book is no longer for sale. Copying out-of-print music still requires the permission of the copyright holder in order to avoid violation of the Copyright Act. On occasion, a teacher may wish his or her student to study a particular piece of music that is no longer available from music retailers. Contact the publisher of the music for permission to make a copy.

Misconception 4: Permission is not required to copy the works of long-dead composers. False. Copyright exists both in a musical composition and in the physical notation of a musical score. This means that even if a composer's works themselves are in the public domain (for example, as Bach's are), a particular publisher's edition of those works may not be in the public domain. Therefore, if you wish to write out one of Bach's Inventions by hand, you may do so, but you may not photocopy it from a printed book without the publisher's permission. (Note: the compositions of living composers or of composers who have been dead for fewer than seventy years should not be copied, either by hand or otherwise, without permission).

*With this public notice, The Frederick Harris Music Co., Limited is pleased to grant permission to festival, recital, and examination participants to use one photocopy of one page of their original score published by The Frederick Harris Music Co., Limited for the purpose of facilitating a page turn. This permission is granted for a one-time use only, with the understanding that the photocopy will be destroyed immediately following the performance.

1. All participants, competitors, families, and teachers must follow Festival Etiquette. 2. Volunteer Fees: All families of LOCAL (within the boundaries of S.D.#28) competitors performing at the

dance festival will be required to provide a Volunteer Fee of either $25, $50 or $75, depending on number of family entries. This should be a cheque post-dated to March 1, 2015. This will not be cashed, as long as you volunteer for the required session(s). Volunteer Fees for members of the Gold Pan City Dance Studio will be collected at the Studio, and are due by January 9, 2015. All other LOCAL entrants must include their Volunteer Fee with their entry. Please see Entry Forms section for more information on required number of Volunteer sessions.

A competitor may double up only once in one group category. 8. Competitors must ensure music is submitted and checked in 30 minutes before the session starts.

FAILURE to COMPLY (CDs handed in late) will result in disqualification and competitor will dance for adjudication only. The clock on the CD table will be used as the official time. CDs will be accepted for only two sessions at a time, ie. the Session about to commence and/or the one following. There will be an attendant at the music check-in table 1 hour before the commencement of each session. CDs may be picked up at the conclusion of each session.

Each dancer is responsible for instruction of placement and removal of their own props onto and from the stage. All props must be removed from backstage immediately after performance. The use of live flame or animals is strictly forbidden. If another person is used as a prop during a solo piece, that person cannot move, otherwise the solo may be re-classified as a duo. MODERN CLASSES: Note for 2015: In order to increase the performance opportunities for dancers in the Modern/Contemporary category, QFPA has increased the number of possible solos to four. To qualify for Provincial competition, dancer must perform at least two Modern and/or Contemporary(Modern) solos.

MODERN A - A stylized dance form with its foundation on a technically based discipline such as Graham, Limon, Cunningham, Humphrey, Horton, and Ailey etc. Dance that rejects the limitations of Classical Ballet, was formulated from natural rhythms, and which favours movement derived from the expression of inner feeling, contraction and release, suspension, fall and recovery, and dynamism. Lyrics/vocals are permitted in the Modern category and the following options are also acceptable: spoken text, absence of music, vocalization without music, solo instrumentation and natural sounds/intonations. If musical accompaniment is chosen for this discipline it is strongly recommended that every effort be made to ensure that the piece selected is both musically and stylistically appropriate. Ballet shoes (soft or pointe) and jazz shoes (full or half-sole) are NOT permitted in the Modern Discipline. MODERN B - Description as above. If performing two Modern solos, please ensure that the pieces are contrasting in style/technique.

CONTEMPORARY (MODERN) A - Free Movement of Dance encompassing various dance disciplines; a constantly evolving style of movement that explores and gives physicality to human ideologies, behaviours, and emotions, with the emphasis on engaging the whole body. Lyrics/vocals are permitted in the Contemporary (Modern) category and the following options are also acceptable: spoken text, absence of music, vocalization without music, solo instrumentation and natural sounds/intonations. If musical accompaniment is chosen for this discipline it is strongly recommended that every effort be made to ensure that the piece selected is both musically and stylistically appropriate. Ballet shoes (soft or pointe) and jazz shoes (full or half-sole) are NOT permitted in the Contemporary (Modern) Discipline. CONTEMPORARY (MODERN) B - Description as above. If performing two Contemporary (Modern) solos, please ensure that the pieces are contrasting in style/technique.

STAGE CLASSES:

The competitor must previously have qualified for Provincials in one of the other Stage categories: Jazz, Lyrical Jazz, Tap, Variety, or Song & Dance. (See PABC 2013-14 Official Syllabus, page 23.)

MUSICAL INTERPRETATION (Quick Study) – JAZZ – A suitable selection of music will be chosen by the Adjudicator for each age group and competitors will enter the hall separately, hear the music once, then dance to it on the second playing. Not to be confused with novelty or musical comedy, disco, aerobics, gymnastics, break dancing or soft shoe. Aim is to demonstrate versatility. Jazz footwear, or bare feet, including foot protectors. LYRICAL JAZZ: Dance that is generally performed to music in slower tempos, and which interprets the lyrics or intent of that piece of music. Please give Time in Minutes. This is for the purpose of planning the program. Teachers

are asked to comply with this rule.

Participants must enter all classes at the same grade or performance level according to

guidelines laid out by the following syllabi or books, unless otherwise stated in this syllabus:

Royal Conservatory of Music (Toronto) The Western Board of Music

Victoria Conservatory Trinity College of London

Associated Board Harris Festival Series

Note: Adjudicator-graded pieces are also acceptable

Selections from a higher grade or performance level must be entered in the appropriate

Repertoire Class.

Beginning at the Grade 1 level, competitors may enter that grade and any higher grade for

two successive calendar years, regardless of their exam results.

A new workshop opportunity is being offered to students Grade 2 and up. No fee will

be charged. On the entry form, please select workshop choices, & attendance as

either participant or observer.

3. MUSIC

It is strongly recommended that solo participants perform from memory, as this is a

consideration when marks are awarded. If you have not memorized your music, you must

have an original piece of music to play from (as well as the one you provide for the

adjudicator).

Participants may not enter the same selection in successive years.

All participants must bring to the performance an original copy of each piece of music for

the adjudicator's use. THIS APPLIES TO DUETS AND ENSEMBLES AS WELL; be

certain you can obtain sufficient original copies for use by performers and adjudicator.

Competitors presenting themselves without music will be allowed to play for adjudication

only.

No photocopies permitted. Original music must be handed to the secretary at the

check in. Music downloaded from the internet must be accompanied by a receipt

(separate receipt for each copy) and the music must be presented to the secretary for

approval at least 15 minutes prior to the beginning of the class.

Competitors presenting at a class with photocopied music will be disqualified for that class.

Music is to be marked with the participant's name.

Bar numbers at beginnings of lines must be indicated on the music.

4. PERFORMANCE and CONDUCT

In the interest of fair competition, Festival piano or facility may not be used (either by students or teachers) for rehearsal or practice purposes during the Festival.

Competitors must report to the Check-in desk at the performance venue at least 15 minutes prior to the scheduled class commencement time.

Participants who fail to appear for their classes forfeit their right to perform.

Each competitor is requested to announce the titles and composers of their pieces before performing.

No admittance will be allowed once a performance has commenced and absolute silence must prevail during each performance.

No preschoolers will be allowed in the performance hall unless they are performing.

Knowledge of stage decorum, suitable dress and courtesy to fellow performers are all part of the festival experience. Teachers and parents are urged to encourage contestants to become acquainted with this. The Festival Committee strongly suggests that students DO NOT wear blue jeans, and/or runners, and that hair be tied back from the face, as this is taken into consideration in the overall performance.

Competitors are expected to be present for the entire class and are requested to wait for the Adjudicator's signal before beginning.

After performing, competitors shall sit in the first row of the performance hall in readiness for the class adjudication.

Participants should be prepared to perform at the Finale concert if requested.

5. BURSARIES, AWARDS and SCHOLARSHIPS

A number of bursaries, awards and scholarships are made available each year to encourage and assist worthy entrants. To be eligible for any of these, the competitor must have been recommended for the award by the adjudicator, and have entered the festival competitively.

All competitive entrants of the Quesnel Festival of the Performing Arts are eligible for the festival trophies, certificates and awards.

A number of trophies are awarded for Solo & Ensemble performances and should be awarded to performers with silver or gold standing. It is recommended that a performer receive one trophy only – in order to encourage a larger number of participants, rather than a limited few. When there isn’t a qualified trophy recipient, trophies do not have to be awarded.

All awards are not automatically awarded. These are at the discretion of the adjudicator and are not solely dependent on marks and/or entry in any particular class, but are based on overall performance.

Piano marks will be made available to teachers upon request to the Piano Director.

Competitors must perform a minimum of 2 SOLOS, which may be chosen from any class except: Sight Reading, Quick Study, Diverse Styles, or Ensembles. Concert Group entries will be eligible for the Concert Group Trophy only. Senior grades (4 and up) are encouraged to enter more than 2 pieces. Provincial Regulations are as follows: Grade 7 to ARTC, two contrasting selections FOR A MAXIMUM TIME LIMIT OF 15 MINUTES (age 14 and under), 20 MINUTES (age 17 and under), 25 MINUTES (age 28 and under). Time limits are given as an aid to the competitor to understand the amount of material expected at this level.

Concerto marks may be used as one of the qualifying marks provided it meets the standard of difficulty for the grade level as outlined by the Syllabus.

THE DECISION OF THE ADJUDICATOR IS FINAL.

6. VOLUNTEERS

All parents' names will be put on a volunteer list and each may be asked to donate two or

more hours of time helping with the Festival. Please plan to have some free time set aside

during the piano festival days that you may be available for volunteering.

36

Local Class Descriptions

Novice Poetry – For first time Festival participants only

Selection may be any form of poetry

Lyric Poetry – A short unified poem, expressing the poet’s own experience, thoughts and feelings.

Does not tell a story or contain dialogue but describes a scene or emotion in a subjective manner, and

is rarely, if ever, humorous. It is usually performed in a relaxed sitting or standing position with no

movement or gestures. E.g. “The Swing” by Robert Louis Steven son or “Daffodils” by William

Wordsworth

Narrative Poetry – Tells a story and usually contains dialogue. The telling of the story is the primary

concern of the speaker. A portion of a longer poem may be chosen rather than the complete work.

These poems are written objectively and may be humorous. Gestures may be included to enhance the

telling of the story. E.g. “Hiding” by Dorothy Aldis or “The Raven” by Edgar Allen Poe

Sonnet Poetry – A lyric poem of 14 lines with a specific rhythm scheme or structure.

Canadian Poetry – Written by a Canadian author. May be lyric or narrative.

Humorous Poetry – Any form of light or humorous verse. Poems that are conversations, contain

dialogue or have distinctly different moods work well. Limited gestures are permitted.

Group Poetry – Any type of poem may be chosen and performed by 2 to 8 participants. Some of the

best poems include dialogue. The best performances include places where each voice speaks alone and

in combination. Gestures and limited staging may be used. Groups will enter class of the oldest

participant.

Prose - Suitable selections will come from novels or short stories. Selections may be edited to fit time

preferences and also for flow. In prose the speaker is the narrative. The focus should be on the voice.

Participants may stand or be seated. No acting. The selection should include narration, description and

dialogue. It should be spoken in the story-telling style with minimum gestures. Vocal characterization

is encouraged but the quality of the prose must be maintained.

Traditional Drama – In drama the speaker is the character. Stand alone monologues (not from longer

plays) are unacceptable as drama. The selection should be taken from a published play written for two or

more characters, intended to be presented on stage by an actor assuming language, movement and

dress of the character portrayed. The selection should be the words of one character only, with words

of other characters omitted. Use of props permitted. Stand alone monologues (not from longer plays)

are unacceptable as drama.

and minimum props. Enter in class of highest school grade.

Readers’ Theatre – A group of not more than 12 readers are required to present a play or story

through voice, facial expression and a minimum of movements/gestures. Simple costumes are

the story. Simple costume and props may be used. Maximum time limit: 5 min.
