President’s LetterTransitions at NITA honor the fabric of our network. Last year’s 2011 Annual Report focused on the 40th Anniversary events, transitioning to our next 40 years. What a network we have built through the contributions of many! We stand on the shoulders of visionary giants.

On December 1, 2012, we passed the baton between two Executive Directors, both long-time members of the NITA network. We are proud to report that it was a smooth hand-off, running at equal stride, and thinking as team-mates throughout a purposeful transition period.

This 2012 Annual Report is the result of John Baker’s leadership, turning in another wonderful NITA year. John served as ED through November 30, perceptively, with talent, and with great loyalty. Under John’s supervision, and with the work of our creative staff and our network of faculty and authors, NITA emerged from 2012 with a terrific set of accomplishments,

We hope that you enjoy this report in each of NITA’s core endeavors – bespoke learn-by-doing programs, innovative publications, and invention of distance learning products. A few points, from the facts reported in these pages:

• NITA’s acclaimed teaching results are the proven combination of its great materials, NITA-created teaching points, and methods, mixed and applied in the classroom in just the right way by highly accomplished, NITA-trained lawyer-faculty members.

• NITA’s broad faculty so enjoy their team teaching, and the immediate improvement in the class’s advocacy skills, that they donate their time and talent to the cause of improving justice through public programs.

• NITA’s ability to customize program subjects, objectives, and rigor to the needs of particular practices in an office, agency, or firm, accelerates the advancement of ethical, effective, efficient advocacy skills exhibited in courts and in pre-trial proceedings.

• NITA’s focus on the public interest is central to its effectiveness – a focus not only to elevate the teaching and level of trial advocacy, but also to bring the training to lawyers who practice in public-service agencies, and to engage internationally. Our NITA Foundation is central to our capacity. You will enjoy its Foundation Annual Report as well.

• NITA’s focus on experiential learning was 40 years ahead of current movements. In on-line learning too, NITA strives to extend this unique experiential learning through hybrid and on-demand programs.

As I grasp the baton from John, my view forward is one of unbounded, well-founded, optimism. Our network is strong. Our strategy is set. We envision new creative ways to teach lawyers to advocate skillfully, ethically, efficiently, and with truth. We will always serve the public interest, putting a counterweight on the unsolved issues of justice by skillfully instilling masterful advocacy through our individualized teaching, published content, and on-line reach.

Mission StatementNITA’s team of practicing lawyers, professors and judges from around the nation dedicates its efforts to the training and development of skilled and ethical legal advocates to improve the adversarial justice system.

About NITAThe National Institute for Trial Advocacy (NITA ) is the nation’s leading provider of legal advocacy skills training. A 501(c)(3) not-for-profit organization based in Boulder, Colorado, NITA pioneered the advocacy skills learning-by-doing methodology forty years ago and has remained the ultimate standard in professional development for trial lawyers and other advocates. While the legal profession has changed significantly during that time, the method of learning created by NITA and mastered by its stellar faculty remains the most effective way for lawyers to advance their advocacy skills.

The HistoryThree professional organizations funded the creation of the National Institute for Trial Advocacy (NITA) in 1971: the Section of Judicial Administration of the ABA; the American College of Trial Lawyers; and the Association of Trial Lawyers of America. Originally named the National Trial Lawyers Institute in the 1971 articles of incorporation as a not-for-profit organization, the directors at the organizational meeting quickly settled on NITA as the name of the organization. The core of NITA programs was then, and still is today, learning-by-doing.

Learning-by-DoingWith an average student:faculty ratio of 4:1 to maximize individualized feedback, NITA programs deliver unparalleled professional development for every attorney in attendance. By observing the expert NITA faculty perform a skill then performing each skill multiple times, program participants are able to grasp that skill, retain it and determine how to best fit it into their unique style. Higher repetition equals higher (and quicker) retention and NITA programs are constantly looking at new ways to maximize the benefits of the amount of performance time and the faculty feedback in each program.

Public Service ProgramsNITA is committed to providing all lawyers with access to legal skills training. To help us reach that goal we devote resources to programs designed to improve the skills of those who represent underserved communities. While many legal organizations approach NITA about coordinating training for their attorneys, our Public Service funding is limited, and programs applying in this category are not assured of training. The programs expand on areas in which NITA is active:

Domestic Violence Trial Skills ProgramNITA recognizes the urgent need to combat violence against women. We offer training to lawyers who assist victims of domestic violence, sexual assault, stalking, and dating violence. Our program is uniquely designed to assist these advocates, many of whom are working under the most difficult of circumstances in shelters and safe houses, to effectively represent these victims in the legal system. This program is supported by a grant, awarded by the Office on Violence Against Women, U.S. Department of Justice.

Custom ProgramsForty years ago, NITA did not offer custom programs. This is a sharp contrast to 2012, when thousands of participants were trained in over 120 programs throughout the country. Drawing from 40 years of training experience and an impressive faculty of the nation’s leading practitioners, judges and law professors, these programs are unmatched in quality and relevancy.

We not only offer programs tailored to the exact trial skills sought by the office’s litigation lawyers, but we now offer lawyering skills programs to broader practice groups as well. Continuing in the learning-by-doing tradition, these new lawyering programs teach the skills necessary in client relations, legal strategy, firm management and more.

We continue our Deposition to Trial program at the University of Pennsylvania, putting law students through the same rigors that practicing attorneys go through at NITA programs, and culminating in a jury trial.

Custom Programs increase the competence, confidence and communication impact needed by trial and other advocacy lawyers—right in the setting where they practice. Most importantly, the program objectives are tailored to the professional development goals of your firm, agency, or office.

studio71NITA’s studio71 launched in 2011. It really took off in 2012. Several novel distance learning opportunities now are routinely offered.

Six online deposition programs were all filled to capacity. These programs allow participants to take part in the learning-by-doing method via webcam from their home or office. By learning the case file and watching approximately three hours of recorded lectures and demonstrations prior to the program, they come prepared to perform. Their time for performances and faculty feedback begins once they connect live to the “virtual classroom,” joining other attorney participants, one faculty member and a witness from the case. They perform and receive critiques that teach from each performance. By using the on-demand learning before the program, they gain nine total hours—three per day for three consecutive days—to go through learning-by-doing exercises like those that NITA provides in its in-person deposition programs. The programs are ideally suited for attorneys in remote areas, public service and solo attorneys who cannot take time to attend a central program, and others.

2012 marked studio71’s very first live webcasts. Noted NITA faculty member Christina Habas (Denver) led a four-part webcast series called The Story of Your Case, From Start to Finish. With Habas and her colleagues on camera from Boulder, attorneys logged in from across the country for an hour each month in September through December, 2012.

studio71 also presented its first stand-alone webcast in November 2012. NITA Program Director Bill Elward (Chicago) provided an hour of compelling content on making and meeting objections, again broadcast to a nationwide live audience.

On-demand learning is featured by studio71, too. All live webcasts are recorded and added to NITA’s growing library of on-demand content. Available within 24 hours of being broadcast live, the on-demand content allows those in attendance at the live broadcast to review the content, and those who missed it to purchase it and watch at their leisure. This content is not only available to the public, but can also be used as special material in online and in-person programs.

For the year 2012, NITA’s studio71 added 200 products to the online library.

NITA FoundationIn 2012 as before, the NITA Foundation, a 501(c)(3) entity, has provided public service and need-based scholarships for those who represent the disenfranchised and indigent. The NITA Foundation awards scholarships to worthy applicants who have demonstrated financial need and/or a commitment to public service. Scholarships are awarded for all Public Trial Skills, Deposition Skills and Teacher Training Programs (excluding Deposition Skills: Online). Criteria for public service scholarship awards do not require demonstrated financial need, but is are based upon the following:

• Advocates who serve indigent or disadvantaged populations including (but not limited to): legal aid, child advocacy, tribal court, criminal law, and domestic violence.

• Public agency lawyers who work in these areas would be eligible automatically.

• Private practice lawyers who work in these areas are eligible if at least 50% of their practice is devoted to providing legal services for clients who are indigent and unable to secure fee-based legal representation. Court-appointed work in these subject areas would be included in the 50% qualification.

In addition, the NITA Foundation funds public service programs in areas such as child advocacy, domestic violence, death penalty defense, legal services practices, and tribal justice; and promotes rule of law programs in developing nations.

When you make a gift to the Foundation, your act of generosity is magnified by the work of each recipient in his or her community.

To date, the NITA Foundation has provided more than $2.6 million in financial support to scholarship recipients and public service programs. For 2012 the Foundation awarded 161 scholarships in the total amount of $184,601.
