Hebridean Princess Chief PursersCHARLES CARROLL Charles is well known to many as Chief Purser on board Hebridean Princess.

He has had a long career at sea with P&O among others and managing a

country house hotel ashore, but was lured back to sea when he was invited

to join Hebridean Princess in 1999. Charles looks forward to the change of

scenery when he once again joins Royal Crown on secondment from

Hebridean Princess.

Charles will be joining the cruises departing 4th June and 22nd July.

MusicianWILL MARSHALL Will re-joins Hebridean’s river cruises for a fifth season. Previously the

musician on board Hebridean Spirit, the former sister vessel to Hebridean

Princess, he is now a full-time professional musician playing piano and

accordion. He is looking forward to be working with Hebridean once more,

bringing his eclectic mix of music and light-hearted entertainment to the

rivers of Europe.

DAVID INDGEDavid, who works opposite Charles as Chief Purser on Hebridean Princess,

had a long career with P&O, both in cruise ships and ferries, before joining

Hebridean Princess in 2005. A familiar face to many, David is once again

looking forward to bringing his own style and flair to the rivers of Europe.

David will be joining the cruises departing 20th and 28th May and 15th July.

Cruise DirectorSHEILA SALMON Sheila is multi-lingual, speaking Flemish, French and German, and has

worked worldwide as a tour guide. Her main passion remains the European

waterways, where she has extensive knowledge of the Rhine and the

Danube. Sheila is once again delighted to be working with Hebridean and

has been closely involved in the planning of the cruises.

Royal Crown’s restaurantdelivers a mix of British andEuropean cuisine and theHead Chef, together with histeam, has worked closelywith Hebridean River Cruisesto produce the higheststandard of menu choices,utilising some of the finestand freshest ingredientsavailable.

Buffet breakfasts offer a large

selection of continental and cooked

items, including eggs of your choice

DARREN REES Voyage from the Danube Delta - 20th to 28th May 2016

Darren Rees has been painting and showing people wildlife for over 30

years and is one of the UK's most respected nature artists, as well as an

experienced naturalist guide. His work has attracted many awards including

BirdWatch Artist of the Year, Natural World Fine Art Award, RSPB Fine Art

Award and a winner in the BBC Wildlife Artist of the Year. His first solo

book, Bird Impressions, was also short-listed in the Natural History Book of

the Year Award. He has been a contributing artist to the Artists for Nature

Foundation/WWF projects in Holland, Poland, Peru and Ecuador and has

lead wildlife tours throughout Europe, America and the Arctic.

NICHOLAS MERCHANT Treasures of the Rhine and the Moselle - 22nd to 30th July

Nicholas has had a life-long interest in antiques, and during his career has

been a valuer for the auctioneers, Sotheby’s and Phillips, and a cataloguer

of furniture, silver, plate, books and porcelain. He is a member

of the Furniture History Society and runs his own book business devoted to

the Decorative and Fine Arts. Nicholas joined the panel of NADFAS

lecturers in 2004 and is the West Yorkshire representative of the Art Fund.

MARTIN BELL OBEHistoric Cities of the Danube - 28th May to 4th June 2016

Martin is an author, journalist, politician and was appointed UNICEF

Ambassador for Humanitarian Emergencies in 2001. He joined the BBC in

Norwich in 1962 and eventually became diplomatic correspondent, chief

Washington correspondent and Berlin correspondent. BBC and UNICEF

assignments have included 102 countries and 18 wars. He was wounded by

mortar fire in Sarajevo in 1992. Martin left the BBC in April 1997 and was

elected as an Independent MP for Tatton, the first elected Independent

since 1951.

LYNNE PLUMMER Classical Danube and Cities of Music - 4th to 11th June 2016

Lynne Plummer has been in and around music all her life, coming from a

very musical household. She started formal studies of the piano and double

bass at the Junior Royal College of Music and then used her “good ear” to

work as a studio manager for the BBC World Service. After that she went

on to be a broadcaster for the BBC, Radio France and the British Forces

Broadcasting Service for many years, specialising in compiling and

presenting programmes to do with music of all kinds.

During this cruise she will talk about the music and musicians connected

with the cities we shall be visiting.

FRANCES BISSELLFlavours of the Rhine, Moselle and Saar - 15th to 22nd July 2016

A Fellow of the Royal Academy of Culinary Arts, Frances Bissell has been

guest chef in some of the world’s leading hotels, as well as at British

Embassies in Europe and the Middle East. She also lectures on a wide

variety of food-related topics, having cooked in places as diverse as the

Falkland Islands and Sri Lanka, Colombia and the Philippines. Frances has

written numerous books and was The Times food writer for many years.

Frances has been a guest lecturer on both Hebridean Spirit and Hebridean

Princess and is delighted to be joining this cruise where she will talk about

the culinary delights of the Rhine valley.

Saturday 21st MayBucharest/Cernavodă

Whilst soaking up the atmosphere ofBucharest, a panoramic tour allows usto discover this vibrant city, includingthe Arch of Triumph and Palace ofParliament, ahead of lunch with amusical performance. Afterwards ascenic drive takes us through theRomanian countryside to Cernavodăwhere Royal Crown awaits our arrival.

Sunday 22nd MayTulcea

Tulcea is the gateway to the DanubeDelta and from here we embark on aboat tour of this UNESCO protectedaquatic wilderness, made up of 2,200square miles of rivers, canals, lakesand marshes and hosting over 300species of birds and 45 species offreshwater fish. Our visit to the DeltaMuseum of Natural Science offers theopportunity to learn more about themany species of flora and fauna to befound in this naturalist’s paradise.

Monday 23rd MaySt George

Arriving in St George this mosteasterly point of our journey is wherethe River Danube meets the BlackSea. The Danube stretches for2,845km and kilometre markings canbe seen along the length of the river;today we celebrate the end of itsjourney at ‘Km 0’.

Tuesday 24th MayRuse/Svishtov

From Ruse we venture to VelikoTŭrnovo, the evocative capital of themedieval Bulgarian Tsars anddramatically set amidst forested hills,divided by the Yantra river.Commanding pride of place is theimpressive Tsarevets fortress, citadelof the second Bulgarian empire, whichis complemented by scores ofchurches and other ruins, many ofwhich are still being unearthed.

Wednesday 25th MayVidin

With its thick walls and four imposingtowers the Baba Vida Fortress standsguard over the River Danube in theBulgarian frontier town of Vidin. It isthe only preserved, medieval castle inthe country and is a stark contrast tothe peaceful park in which it stands.We end the day with a visit to theopera house to enjoy a privatesymphony concert.

Thursday 26th MayThe Iron Gates and Kazan Gorge

A haven for wildlife and birds, the IronGates and Kazan Gorge is one ofEurope’s most dramatic naturalwonders and areas of outstandingbeauty. As the Danube narrows itwinds through a series of magnificentgorges between Serbia and Romaniaand the spectacular fjord-like sceneryis to be enjoyed as Royal Crown sailsbetween the Carpathian and Balkanmountains.

Friday 27th MayBelgrade

Our tour of Serbia’s ancient capitalreveals the story of this remarkablecity and Hebridean highlights includethe Orthodox Cathedral of St Sava,the Square of the Republic and themighty Kalemegdan Fortress. Thefascinating village of Kovačica,famous for its naïve paintings, playshost to our second visit of the day.

Saturday 28th MayBelgrade/UK

We disembark Royal Crown inBelgrade before being transferred tothe airport for our flight home.

Saturday 28th MayUK/Belgrade

After enjoying pre-flight refreshmentsat London Heathrow airport, relax inthe company of other guests on ouraccompanied flight to Belgrade.

Sunday 29th MayBelgrade

Out first port of call is Serbia’s vibrantcapital, Belgrade. Set at theconfluence of the Danube and Savarivers, the city’s diverse and oftenturbulent past is clearly visible on ourcity tour which includes St Sava, theworld’s largest Orthodox Church andthe Square of the Republic. A performance of local folk musicand dancing is also to be enjoyedbefore returning to Royal Crown.

Monday 30th MayVukovar

Arriving in Vukovar, Croatia’s largestriver port, we explore the 1991 sceneof an 87 day siege, known as theBattle of Vukovar. This and otherdramatic events in the recent pasthave shaped the present and futureof this region. We will visit theOvčara Memorial, the monumentalcross that serves to remember thosewho lost their lives during theirstruggle for independence.

Tuesday 31st MayKalocsa

On arrival in Kalocsa, we take a tourof this beautiful town and embark ona fascinating excursion into thePuszta, the hinterland of Hungaryrenowned for its paprika productionand where we enjoy an impressivedisplay that showcases theexceptional riding skills of the Pusztahorsemen.

Wednesday 1st JuneBudapest

Spending the day exploringHungary’s elegant capital our tour willinclude the old quarter, St Matthiaschurch and the Fisherman’s Bastionwith its spectacular views across theDanube to Pest, dominated by its fineparliament building and Heroes’Square.

Ahead of returning to Royal Crownwe experience the market hall andstate opera house, before beingentertained by a gypsy orchestra.Setting sail late evening we witnessthe spectacular bridges andlandmarks of Budapest’s illuminatedriverfront.

Thursday 2nd JuneBratislava

Bratislava, capital of the Republic ofSlovakia, affords a sightseeing tour ofthe historic Old Town with highlightssuch as the neoclassical Primate’sPalace, St Martin’s Cathedral and theancient Michael’s Gate.

Friday 3rd JuneVienna

Sailing further west, the romantic cityof Vienna and former capital of theHabsburg Empire, beckons. Amorning tour of this elegant citytakes us around the famousRingstrasse and the Old Quarter,including St Stephen’s Cathedralstanding in the ruins of two earlierchurches.

Following lunch on board we take anafternoon tour of Schönbrunn Palaceand its gardens, the favourite summerresidence of Maria Theresa, beforeexploring at leisure ahead of our finalnight on board.

Saturday 4th JuneVienna/UK

After breakfast we must say farewellas we disembark for our transfer tothe airport and our onward flighthome.

Constructed at the confluence ofthree rivers, the Inn, Ilz and Danube,Passau boasts many impressivebuildings. We take a guided walkthrough the 2,000 year old city whichculminates in a visit to thebreathtaking Cathedral of St Stephen,where we listen to a recital played onone of the world’s largest pipeorgans.

Wednesday 8th JuneRegensburg/Weltenburg

This morning we arrive inRegensburg, widely regarded as themedieval wonder of Germany withred roofed churches, turrets andtownhouses dating back to the 12thcentury. Following a walking tour ofthis historic town we travel toKelheim where we embark on a smallboat tour through the narrow Danubegorge to Weltenburg. WeltenburgAbbey, founded in 620, is thought tobe the oldest monastery in Bavariaand here we sample the monk’s beer.

Returning to Regensburg a concert ofcappella music will be performed bythe Regensburg CathedralDomspatzen.

Thursday 9th June Cruising Upper Austria

Relaxing on board is the order of theday as we appreciate the stunningscenery of the Upper AustrianDanube Valley. Perhaps attend alecture by our renowned guestspeaker, or simply watch the ever-changing landscape glide gently byfrom the comfort of the Lido Deck.

Friday 10th June Vienna

During our morning tour of thehistoric city centre of romanticVienna, a UNESCO World HeritageSite, you will see many highlightsincluding the Ringstrasse and the artmuseum at Belvedere Palace.

Affording breathtaking views of theMoselle and the town of Alken, BurgThurant Castle was built at the end ofthe 12th Century and is a rustic,original and beautiful reminder of lifeover 800 years ago. Alken is best

known for its brewery, but also for itsmany castles, churches, chapels andwater mills.

The first ever Belgian pilsner beer,‘Cristal Alken’, has been brewed heresince 1928 and is still produced today.

Tuesday 19th JulyCochem

The town of Cochem, surrounded byRiesling vineyards in the Mosellevalley, plays host to our next port ofcall as we stroll through its windingmedieval streets, narrow alleywaysand half timbered houses.

Experiencing the town’s almost 200year old mustard mill, we discoverhow gourmet mustards are createdusing self-created recipes that havebeen handed down through thegenerations. Afterwards, we exciteour palate by tasting differentmustards including Riesling,honeycomb and exotic Indian curry.Alternatively, there will be theopportunity to taste the regionalwines.

Wednesday 20th JulyTrier/Bernkastel

After breakfast we travel to Trier,Germany’s oldest city, where awalking tour will introduce us to itsrich Roman past. Highlights willinclude the cathedral, the Basilica ofConstantine and the Porta Nigra Gatedating to 179 AD.

Bernkastel is strategically located in the centre of the Mosel wine-producing region, an area thathas been cultivating wine for over500 years. Exploring the town onfoot will reveal many medieval andRenaissance buildings, ahead ofenjoying a winery visit with samplesof regional vintages and a dinner ofspeciality dishes.

Thursday 21st JulySaarburg

This morning we cruise the Saar Loop,a remarkable bend in the river and oneof the most famous sights of Saarland.

Nestled among vineyards and forestsis the romantic city of Saarburg, withmany noteworthy monuments,including the Saarburg fortress builtin 964 by Count Siegfried ofLuxembourg. One of the mainattractions on our walking tour is thewaterfall, a unique and natural displayin the middle of the city, which falls20 metres over rock cascades andnow home to a mill museum.

Our next port of call is Königswinter,overlooked by two mountains; theromantic Drachenfels rises behind thetown and from its summit, which weaccess by the Drachenfels Railway,there is a magnificent view,celebrated by Lord Byron in ‘ChildeHarold's Pilgrimage’.

Schloss Drachenburg wasconstructed in the late 19th centuryand completed in only two years byBaron Stephan von Sarter, a brokerand banker who planned to live there,but never did.

Beautiful Arnhem plays host to ourexcursion to one of the most stunningroyal residences in Holland, the 300year old Het Loo Palace. Pregnancy: regulations vary from airline toairline, but some will refuse to carry womenwho will be 28 weeks pregnant on the dateof return travel. If you are in any doubt,please check with the airline concernedand we would recommend that you alsoconsult your doctor prior to travel.

Special diets: we can usually makeprovisions for special diets provided thatsufficient notice is given. A vegetarianchoice is available on board and vegetarianmeals are also available on flights whereserved. Please indicate any requests at thetime of booking. We will make every effortto satisfy your request, although thiscannot be guaranteed.

SHORE EXCURSIONSShore excursions are included in your cruisefare in every port of call, where available.Please note that the company reserves theright to amend, cancel or substitute anincluded shore excursion and in thesecircumstances is under no obligation tomake a refund.

TRANSPORTParking/Accommodation: approximately20 weeks before departure we will sendyou details of long-term parking andaccommodation at your departure airportshould this be required.

Flights: we use scheduled flights, however,we are not always in a position to confirmfull flight details at the time of booking andany information that may be provided atthat time is subject to change. Returntransfers and baggage handling betweenthe airport and the vessel are included.Baggage allowance is 20kg on mostscheduled flights, although it may varyslightly according to the carrier. All flightsare non-smoking. In some countries, localairport departure taxes cannot be includedas part of your air ticket and must be paidlocally by the passenger on departure. Toavoid queues at the airport, if our localagents are able to obtain these on yourbehalf in advance, they will do so and thecost will be added to your final invoice oron-board account. You must check in atairports at least 2½ hours before your flightis due to take off. If you do not check in ontime, the airline may not allow you to boardthe flight. We cannot accept responsibilityif such situations arise and, whilst we willdo our best to arrange alternativetransport, any resulting costs will be yourresponsibility.

FLIGHT DELAYSUnfortunately, it is impossible to guaranteethat all flights will take off exactly on time,as travel delays can occur for any numberof reasons. In the event of a delay indeparture from an airport, for reasons otherthan those which are the responsibility ofthe airline, the company policy is to arrangefor our passengers to be provided,whenever practical, with the followingwelfare arrangements: 3-5 hours delay –light refreshments; over 5 hours delay – amain meal.

INDEPENDENT TRAVELARRANGEMENTSHebridean Island Cruises will have noresponsibility, financial or otherwise, inregard to air or rail travel arrangementsmade by others, including those related tothe use of frequent flyer, non-refundableand other restricted travel tickets. Thisexclusion of liability by the companyincludes the consequences toindependently arranged air or rail travelthat may result from last-minute changes inthe embarkation and disembarkation ports,cancellation of tours and delays in arrival atthe departure airport (see the Conditions ofCarriage in the Fair Trading Conditions formore details of these exclusions fromliability). No airport transfers can beprovided for passengers usingindependently arranged air or rail traveland/or choosing to take air credit options.The travel insurance policy should bechecked in regard to its coverage of suchindependent air arrangements.

ON BOARD

CURRENCY AND PAYMENTSOn board all prices are in Euros € .

As there are no foreign exchange facilitieson board, we would recommend that youpurchase any currency requirements youexpect to need before you travel. There islittle opportunity to visit banks whilst onexcursions. For purchases ashore, manyshops accept most travellers’ cheques andmajor credit cards. A cashless systemoperates on board with passengers settlingaccounts at the end of the cruise. Visa,MasterCard and American Express creditcards, cash and travellers’ cheques areaccepted for payment of on-boardaccounts. Maestro cards, debit cards andpersonal cheques are not accepted..

MEDICAL FACILITIESPlease note that there are no medicalfacilities on board. In addition to a validinsurance policy, you are advised to bringa valid E111 (European Health InsuranceCard) with you. There will, of course, beaccess to shore side medical facilities atour frequent ports of call. All passengersmust complete a Public Healthquestionnaire prior to embarkation.

DINING ARRANGEMENTSBreakfast will be buffet style with lunchbeing a combination of buffet styles mealsand waiter service. Dinner will be waiterservice. Meal times will vary according tothe daily programme.

TELEPHONESThere is a telephone in your cabin whichcan be used to contact Reception. In anemergency only, the telephone atReception may be used, the cost of whichwill be added to your shipboard account.

ELECTRICAL APPLIANCESCabins feature 220 volt current. The use ofhair dryers, electric rollers, curling irons,electric shavers and other small appliancesshould be checked with Reception but, forsafety reasons, the use of travel irons andany tea/coffee making equipment is strictlyprohibited. Each cabin is equipped with ahair dryer. There is a limited number of plugadapters on board and we thereforerecommend bringing your own adapter ifpossible.

LAUNDRYValet service is available for laundry andironing. A laundry bag and order form areprovided in your cabin wardrobe. Chargesare applicable.

DRESSAs a general rule, for days on board andashore, casual wear is the order of the day.It should be light, comfortable and easy tocare for. A sweater and jacket for coolerevenings and a light raincoat are alsoadvisable.

On warmer days the weather will usually besuitable for sunbathing, so try not to forgetyour wrap, bathing suit, sunglasses, sunhatand sunscreen. For trips ashore and forwalking on cobbled streets, comfortable,sturdy walking shoes are a must. You mayalso want to bring with you a camera,binoculars, umbrella and insect repellent.

In certain countries, shorts, short skirts,bare arms and shoulders will not beappreciated locally and you may beprohibited entry to certain sites. Advice willbe given on board.

SMOKINGPassengers are only permitted to smoke onthe open decks. Smoking is not permittedon excursion coaches.

SAFETY INFORMATIONSafety information, in the event of anemergency, will be given early in the cruise.Please see your Daily Programme for moreinformation.

RIVER CONDITIONSPlease note that river cruise itineraries andports of call may have to be changedwithout prior notice if affected by naturalconditions such as high or low water levelsor changes to local mooring restrictions orlock closures.

River vessels may at times moor alongsideeach other. This may result in reducedvisibility from your cabin window.

GENERAL

SPECIAL REQUESTSWe are unable to accept ‘conditionalbookings’. Please note any special requestsclearly on your Pre-Cruise Questionnaireand we will do our best to comply withyour wishes. We must point out that failureto fulfil a special request cannot beconsidered a breach of contract on the partof the company.

CHANGE OF ADDRESSWe particularly ask you to tell us in writingof any alterations to your address beforedeparture, and in any communication,please state the cruise on which you aretravelling.

DATA PROTECTION ACT 1998Please be assured that we have methods inplace to protect the personal bookinginformation held by us. This information willbe passed on to the principal and to therelevant suppliers of your travelarrangements. The information may also beprovided to public authorities such ascustoms or immigration if required bythem, or as required by law. Certaininformation may also be passed on tosecurity or credit checking companies. Ifyou travel outside the EU, controls on dataprotection may not be as strong as the

legal requirements in this country. We willonly pass your information on to personsresponsible for your travel arrangements.This applies to any sensitive informationthat you give to us such as details of anydisabilities or dietary/religiousrequirements. (In making your booking, youconsent to this information being passedon to the relevant persons. If we cannotpass this information to the relevantsuppliers, whether in the EU or not, we willbe unable to accept your booking). Fulldetails of our data protection policy areavailable upon request.

CHANGES TO YOUR CRUISEThe information in this brochure outlinesdetails of our carefully planned programme.Should any subsequent events cause us tochange our plans or affect the publisheditinerary in any way, we shall let passengersknow. However, in the event of war orthreat of war, political unrest, terroristactivity, nuclear disaster or other similarevents, we maintain the unreserved right tocancel, postpone or alter without priorconsultation, any itinerary in whole or inpart, in order to safeguard passengers, shipand employees. See Fair TradingConditions.

GUESTSPEAKERS/ENTERTAINMENTIf any of our confirmed guest speakers areunable to travel on their allotted cruise,Hebridean Island Cruises reserves the rightto engage alternative guest speakers andentertainers.

OVERSEAS STANDARDSIt is a fact of life that when we travel todifferent countries, we often find that thecustoms, traditions and general pace atwhich things are done can be very differentfrom what we are used to in the UK. As faras standards of safety are concerned, thesuppliers of services must comply with therules and regulations of their own countryand these are not always as strict as theyare in the UK. Every care is taken tocontract the best available transport,however, standards can vary.

DANGEROUS GOODSWe direct your attention to the fact that itis an offence to carry on board aircraft orriver cruisers any goods of a dangerous ordamaging nature. Remember that petroland other lighter fluids, including fluids forhair curlers, come under the terms of theExplosives Act; their inclusion in heavybaggage is strictly prohibited.

Fair Trading Conditions issued June 2014Travel with Confidence

1 THE CONTRACT

1.1 The contract is between All LeisureHolidays Limited trading as ‘HebrideanIsland Cruises’ (‘The Company’) and eachperson booking with the Company(including the parents or guardian of anyperson under 18 years of age) (‘thePassengers’). Please note that informationcontained in the section headed ‘GeneralInformation’ in our brochure or in these orany other comparable sections, and anyother relevant information on our websitealso forms part of your contract with theCompany.

1.2 The Lead Passenger warrants as afundamental term of the contract thathe/she has read and agrees these terms andconditions and has the authority by eachPassenger named on the confirmationinvoice to be bound by them. Unlessotherwise indicated, the Lead Passengerwarrants that the Passenger informationgiven may be used by the Company or itspartners for future marketing purposes.

1.3 A binding contract comes in to placewhen you pay the full deposit (or whereappropriate the full price) and aconfirmation invoice is issued even if theCompany is unable to confirm all holidaydetails (e.g. flights) at the time of booking.A confirmation invoice will be sent to theLead Passenger. There is no charge for anypayment made by debit or payment of adeposit by credit or charge but a 2% chargewill be made for any subsequent paymentsmade by credit or charge card to cover thecharges made by credit card companies.

1.4 All details on the confirmation invoice(and on any additional documentsproduced by the Company) will be deemedto have been accepted unless the Companyreceives notification to the contrary fromthe Lead Passenger immediately that theconfirmation invoice is received. If you havenot received your confirmation invoicewithin 7 days of booking your cruise pleasecontact us immediately. If any errors are notimmediately identified and reported, anycost of rectifying the same at a subsequentdate must be met by the Passenger. Pleasenote that Passengers not following theseinstructions will be fully liable for any coststhat may subsequently be incurred inrectifying errors at a later date. In the caseof flight tickets and e-tickets these must bechecked by Passengers and the Companymust be notified of any errors immediately.

1.5 It is expressly agreed that all Passengersand their luggage are carried subject to theConditions of Carriage of the airlines andshipping company used, some of whichlimit or exclude liability. Any compensationpayable by the Company for non-performance or improper performance ofland, sea and air carriage services shall belimited in accordance with the internationalconventions which govern such services bythe carrier.

1.6 For bookings made through anapproved ABTA Travel Agent, the Agentholds any monies paid on behalf of theCompany.

1.7 The Company reserves the right tocancel bookings and levy cancellationcharges on the scale in section 7 below ifbalance payments are not received in full atleast 16 weeks before departure or by returnpost/credit or debit card for bookings takenless than 17 weeks before departure.

1.8 Travel insurance (where purchasedthrough us or directly with a third party)does not form part of your contract withthe Company or of any ‘package’.

1.9 The contract and all other proceedingsarising out of or in connection with it shallbe governed by English law and thejurisdiction of the English courts.Passengers may, however, choose the lawand jurisdiction of Scotland or NorthernIreland if they so wish. If and in so far as aclaim against the Company is governed byThe Convention on Limitation of Liability forMaritime Claims 1996 (LLMC 96) asamended by SI 1998/1258 in respect of rivercruises or EU Regulation 392/2009 relatingto the Liability of carriers of passengers bysea in the event of accidents (EU392/2009) and the Athens Convention2002 for international carriage by sea or inrespect of non-international carriage by seaThe Merchant Shipping (ConventionRelating to the Carriage of Passengers andtheir Luggage by Sea) Order 2014 in theCourt competent to hear such claims.

2 THE BOOKING PROCESS

2.1 A deposit of 25% of the total fare due, orfull payment for bookings taken within 119days of departure, is due on booking. Ahigher amount may be payable if anysupplier(s) require additional payments fora service prior to the balance due date.Payment of a deposit means acceptance ofthese Booking Conditions. The Companytakes no responsibility for credit card orforeign currency transaction processingfees levied by issuing banks.

2.2 If the deposit and/or balance are notpaid on time, the Company reserves theright to cancel the contract and apply anycancellation charges set out in section 8.

2.3 Passengers must be fit to travel. Anypassengers with reduced mobility or withother physical or mental disabilities orconditions which may require specialtreatment or assistance (includingPassengers who may require the use of awheelchair) must advise the Company priorto the booking. They may be required tocomplete a questionnaire and upon receiptof which they may be asked to acceptadditional Booking Conditions before aconfirmation invoice is issued and acontract entered into. See section 10.

2.4 The Company may (at its discretion)offer Passengers at the time of booking aguaranteed cabin booking (a ‘GuaranteeCabin’). Under such offers a Passenger isguaranteed to receive a cabin of a specifiedtype although the precise location of thecabin is at the Company’s discretion. TheCompany may (at its discretion) upgrade aGuarantee Cabin to a higher category cabinat no additional cost to the Passenger. TheCompany may allocate specific cabinsunder guarantee offers at any time up untilthe Passenger arrives on the vessel at theport of embarkation. Once GuaranteeCabins have been allocated, the Company isunable to accept Passenger changerequests. If Passengers book one or moreback-to-back cruises and one or morecruise includes Guarantee Cabins, it ispossible that Passengers may be allocateddifferent cabins on each cruise and mayneed to move between cabins onchangeover day(s).

3 PRICES AND SURCHARGES

3.1 The Company reserves the right to alterthe published prices of any of the holidays.Passengers will be advised of the currentprice of the holiday that they wish to book

before any contract is confirmed. The priceof the travel arrangements may changeafter booking due to increase in costs. TheCompany undertakes that no changes tothe price will be made within 30 days ofdeparture.

3.2 The Company will absorb and thePassenger will not be charged for, anyincrease equivalent to up to 2% of the totalholiday cost (excluding insurance premiumsand/or any amendment charges). TheCompany may, at its discretion, and subjectto the approval of the relevantauthority(ies), charge the Passenger anyincrease above 2% in respect of (i) transportation costs, including the costof fuel, (ii) dues, taxes or fees chargeablefor services such as landing taxes orembarkation or disembarkation fees atports and airports, or (iii) the exchange rateapplied to the package. If the increase ismore than 10% of the price of their travelarrangements, Passengers will have theoption of accepting a change to anotherholiday or cancelling and receiving a fullrefund of all monies paid, except for anyinsurance premiums and amendmentcharges. If the Company is able to offeranother holiday and this alternative holidayis of equivalent or higher price to theoriginal holiday booked, then the Passengerwill not have to pay more. If the alternativeholiday is a lower price, the Passenger willbe refunded the difference. ShouldPassengers decide to cancel their holidayunder these circumstances, they must to doso within 14 days of the date of the invoicefor the additional charge or such otherperiod as may be specified.

3.3 Should the total cost to the Company ofa Passenger’s holiday fall by more than 2%due to any of the changes mentioned abovethen the Company will pass on toPassengers any refund due. Passengersshould note that travel arrangements arenot always purchased in local currency andsome changes in local currency costs mayhave no impact on the price of Passengers’travel due to contractual and otherprotection in place.

3.4 All outstanding balances on on-boardaccounts must be settled in full before thePassenger disembarks the vessel. If anyPassenger fails to settle their on-boardaccount then the Company shall be entitledto take whatever steps may be necessary torecover the monies due and shall be entitledto pass on any costs incurred in doing so.

4 OUR RESPONSIBILITY AND SHOREEXCURSIONS

4.1 Except where otherwise expressly statedin these booking conditions, we regret thatthe Company cannot accept liability or payany compensation where the performanceor prompt performance of our contractualobligations is prevented or affected by oryou otherwise suffer any damage or loss asa result of Force Majeure. In this Contract,“Force Majeure” includes any event whichthe Company or any supplier of theservice(s) in question could not even withall due care, foresee or avoid. Such eventsmay include (whether actual or threatened)war, riot, civil strife, terrorist activity,industrial dispute, natural or nucleardisaster, technical problems with transport,closure of airports, ports or airspace,changes of schedules by airlines, adverseweather conditions, epidemics, health risksand pandemics, fire, closed or congestedairports or ports and all similar eventsoutside the control of the Company and oursuppliers.

4.2 The Company is not responsible for anyimproper or non-performance of anyservices of the package holiday which arewholly attributable to the fault of thePassenger, the unforeseeable orunavoidable act or omission of a third partyunconnected with the provision of any ofthe services to be provided under theContract; unusual and unforeseeablecircumstances beyond the control of theCompany and/or the relevant supplier, theconsequences of which could not havebeen avoided even if all due care had beenexercised including (but not limited to) anevent of Force Majeure; or any event whichthe Company and / or relevant supplierscould not even with all due care haveforeseen or forestalled. In the event that theCompany is responsible for any death,injury or illness caused by the negligent actsand / or omissions of its suppliers ofservices which form part of the Packagethen the Company limits its liability, whereapplicable, by the InternationalConventions.

4.3 Where death and or personal injury andor loss of or damage to property occursduring carriage by air or by sea then theliability and the extent of damagesrecoverable will be dealt with by theirconditions of carriage and the InternationalConventions set out in sections 11 and 12and not otherwise.

4.4 Where there is any loss of or damage toproperty including luggage which is notcovered by any International Conventionand where liability is not limited byreference to any enactment, terms orconditions, then any legal liability that theCompany may have for any such losses ordamage will not exceed £500 perPassenger.

4.5 Notwithstanding anything to thecontrary elsewhere in this Contract, theCompany shall not in any circumstances beliable to the Passenger for any loss oranticipated loss of profit, loss of revenue,loss of use loss of contract or otheropportunity nor for any other consequentialor indirect loss or damage of a similarnature.

4.6 Where the Company provides or sells ashore excursion to the Passenger thePassenger shall be bound by the terms andconditions of the supplier of the shoreexcursion supplier.

4.7 The Company does not perform shoreexcursions which it sells to Passengers.These are performed by local operatorswho may themselves engage the services ofthird party suppliers. The Company will atall times endeavour to appoint reputableand competent operators who comply withall prevailing local rules, regulations andstandards. It should be noted that, outsidethe UK, standards of hygiene,accommodation and transport might differfrom comparable standards in the UK.

4.8 Local laws and regulations of therelevant country will be applied to assessthe performance of suppliers and theCompany. The Company’s legal obligationswill have been performed if the supplier hascomplied with local laws and regulationseven if the laws of England have not beenmet.

4.9 In the event of an excursion beingcancelled, the Company will take allreasonable steps to ensure that Passengersare offered a choice of an alternativeexcursion and/or a full refund in the case ofsupplementary excursions.

4.10 The Company is not responsible for theperformance of and has no liability forshore excursions which are not sold by theCompany. Passengers are advised to takegreat care in purchasing shore excursionsfrom third parties in the ports to ensurethey are safe and are covered by insurance.

5 INSURANCE

5.1 Where Passengers purchase insurancethrough the Company, the Company isacting as an agent for the named insuranceprovider and that the purchase will besubject to that insurance provider’s termsand conditions which will be sent to themwith their policy documents or provided inadvance of purchase upon request.

5.2 It is a condition of booking that eachpassenger has adequate travel insurance inforce for the entire duration of the holiday. IfPassengers do not purchase the insuranceoffered by the Company, then details of thealternative insurance policy (which must ata minimum cover medical charges,cancellation, curtailment, evacuation (fromthe vessel) and repatriation costs for notless than £5 million) must be provided atthe time of booking if possible, but no laterthan six months prior to the scheduled dateof departure or at the time of booking ifbookings are made within six months of thedate of departure.

6 PASSPORTS & VISAS

6.1 It is the responsibility of all Passengersto check and fulfil the passport, visa, andimmigration requirements applicable totheir itinerary. The Company can onlyprovide general information and Passengersmust check requirements for their ownspecific circumstances with the relevantEmbassies and/or Consulates as applicable.Our Consular Services Department canobtain visas for British Citizens for thecountries that require them prior todeparture. Other nationalities should checkpassport and visa requirements for theirown specific circumstances with therelevant Embassies or Consulates asapplicable.

6.2 Passengers must understand thatpassport, visa and immigrationrequirements do change. Passengers areresponsible for checking the up to dateposition in good time before departure.

6.3 For Passengers leaving the UK, theCompany requires a full 10 year Britishpassport valid for at least six months afterthe date of return for all UK citizens.Passengers who are not British citizens orwho hold a non British passport, mustcheck passport and visa requirements withthe Embassy or Consulate of thecountry(ies) to or through which theyintend to travel.

6.4 All Passengers must ensure that theyhave the correct travel documents in theirpossession before departure. Passengersmay incur fines if they fail to comply withdocumentation or visa requirements. TheCompany will re-charge to the Passengerany such fines that have been paid by theCompany on the Passenger’s behalf.

6.5 The Company does not accept anyresponsibility for Passengers who are denieddisembarkation or are unable to travel, orwho incur any other loss because they fail tocomply with any passport, visa, orimmigration requirements. Cancellation ofany part of the holiday that arises due toproblems with visa/passport, or immigrationrequirements will be subject to cancellationcharges set out in section 8.

7 CHANGES TO BOOKING DETAILS BYPASSENGERS

7.1 The Company will do its utmost toensure that amendments requested byPassengers are accommodated, but theCompany makes no guarantee that theserequests will be met. Any change requestmust be made in writing by the LeadPassenger and the Company reserves theright to pass on the costs of making anysuch changes. Passengers must be awarethat charges associated with amendmentsare likely to increase nearer to the date ofdeparture.

7.2 Additional Passengers or cruises may beadded to a booking at any time subject toavailability. In each case a deposit (or fullpayment, as relevant) per additionalPassenger will be required by the Companyand all other booking conditions must bemet before the new contract exists.

7.3 Requests for significant amendments tobooking details (e.g. change of ship or saildate) received before the balance due datewill be treated as a new booking. At theCompany’s sole discretion, the originalbooking will either be deemed cancelled(and be subject to the cancellation chargesset out in section 8), or will be deemedamended (and be subject to an amendmentfee of £75 per Passenger). Any depositpaid, discount applied or promotionapplicable to a booking that is cancelled oramended will only be transferred to a newbooking at the Company’s discretion.

7.4 For minor amendments to bookingdetails received before the balance duedate (e.g. Passenger name changes) anadministration charge of £50 per Passengeraffected will be charged. If name changesare required to scheduled flight details, thecharge may be significantly more than £50per Passenger and will be quoted onrequest. Passengers should also be awarethat airlines may not allow transfer ofPassenger names and in such cases a flightbooking might need to be cancelled andrebooked, subject to availability, and at thePassenger’s expense.

7.5 After an amendment is applied a newconfirmation invoice will be issued at whichpoint the contract will be deemed to beamended accordingly.

8 CANCELLATION BY A PASSENGER

8.1 A Passenger may cancel a booking atany time. Cancellation will take effect whenthe Company has received written notice ofcancellation signed by the Lead Passenger.Cancellation charges payable to theCompany are:

8.2 A Passenger will not have a right toexclusive occupancy of a cabin with two ormore berths unless any applicable singleoccupancy premium has been paid. In the event of a Passengerbecoming a single occupant of such a cabindue to a cancellation, he/she will becomeliable to pay any applicable singleoccupancy premium. Passengers areadvised that certain reasons for cancellationare covered by their travel insurance.

9 CANCELLATION OR ALTERATION BYTHE COMPANY

9.1 The Company reserves the right at itssole and absolute discretion at any time tocancel, postpone or alter without priornotice or consultation any cruise in whole orin part in order to safeguard its Passengers,its crew, its employees or the vessel in theevent of war or threat of war, politicalunrest, terrorist activity or threat of terroristactivity, nuclear disaster, riots, civil strife,adverse weather conditions or other similarevents (‘Force Majeure’) or for any othervalid operational reason. If the majority ofports that the Company aims to visit duringany one cruise have to be changed onForeign Office advice before the cruisecommences, the Company undertakes tooffer Passengers an alternative cruise orrefund of the cost of their cruise in full.

9.2 If under clause 9.1 the Company cancelsa cruise before the scheduled departuredate it will offer, when possible, asubsequent alternative departure of similarstandard (which must be accepted inwriting within 14 days of the offer beingmade), or the choice of a full refund of allmonies paid.

9.3 If under clause 9.1 the Company cancelsa cruise after the scheduled departure date,it will return all Passengers as soon aspracticable to the UK and make aproportional refund for any unused servicesand any nonrecoverable expenses incurred.

9.4 In any of the circumstances mentionedabove the Company shall not be liable topay any compensation, nor shall Passengershave any further claim against theCompany.

9.5 The Company and the Master of the shipare unable to guarantee that the ship will callat every advertised port or follow every partof the advertised route. They will at all timesendeavour to maintain the advertisedprogramme but reserve the right at their solediscretion to make any alternations theydeem necessary.

9.6 The company also reserves the right tocancel any cruise by giving written notice atleast eight weeks before departure if sales ofthat departure have not reached 70% ofcapacity. Under such circumstances clause9.2 will apply and the Company shall not beliable to pay compensation, nor shallPassengers have any further claim againstthe Company.

9.7 The Company reserves the right at itssole and absolute discretion to use asubstitute ship of similar standard to theoriginal ship should it prove necessary to doso.

9.8 In addition to the rights of the Company,aircraft and ship’s Captains always have theright at their absolute discretion to vary anyplanned routing without prior notice orconsultation if they deem it necessary to doso in the interests of safety.

9.9 If for any reason details of a cruise haveto be altered before departure (and subjectto Clause 9.1) the Company will notify theLead Passenger as soon as possible.

9.10 The Company will not be heldresponsible for, nor have liability in respect of,delays caused by third parties duringpassage through sea areas controlled byvessel traffic schemes, canals, rivers or anyother navigable waterways.

10 FITNESS TO TRAVEL ON THE CRUISESHIP, PREGNANCY, BEHAVIOUR,DISABILITY OR REDUCED MOBILITY,MEDICAL AND MOBILITY EQUIPMENT

10.1 The Company’s priority is the comfortand safety of its Passengers who are askedto provide prior to booking as much

information as possible regarding anyassistance that may be required in the port,during embarkation and on board the vessel.This information is required in order to ensurethat Passengers are carried safely and inaccordance with applicable safetyrequirements established by competentauthorities including flag state.

10.2 Every Passenger warrants that he/she isfit to travel by sea and inland waterways andthat his conduct or condition will not impairthe safety of the ship or inconvenience otherpassengers. The Company reserves the rightto require any Passenger to produce medicalevidence of fitness to travel in order to assesswhether that Passenger can be carried safelyin accordance with applicable international,EU or national laws.

10.3 The Company and the carrier areentitled to administer a health questionnaireprior to boarding. All Passengers must followthe vessels instructions and proceduresrelating to all matters including health, safety,hygiene and security. Any Passengerboarding a ship at initial embarkation whohas not filled in the required pre-boardinghealth declaration must inform the Companyof any sickness and/or diarrhoea experiencedless than 72 hours prior to embarkation. Inthe interest of Passenger’s safety theCompany reserves the right at its discretion,to refuse boarding. In such circumstances theCompany shall not be liable to pay anycompensation, nor shall Passengers have anyfurther claim against the Company. TheCompany and the carrier are entitled torequest Passengers to remain in their cabinsin the event of illness which is or may beinfectious. Pregnant women are highlyrecommended to seek medical advice priorto travel at any stage of their pregnancy.Women who are up to 23 weeks pregnant atthe end of the cruise are required to producea medical certificate of fitness to travel. TheCompany Ships cannot for safety reasonscarry pregnant Passengers of 24 weeks ormore by the end of the cruise. The Companyand the Carrier reserves the right to requesta medical certificate at any stage ofpregnancy and to refuse passage if theCompany and/or the Master are not satisfiedthat the Passenger will be safe during thepassage.

10.4 In the event of illness or accident,Passengers may have to be landed ashore bythe Company and/or Master for medicaltreatment. The Company makes norepresentations regarding the quality ofmedical treatment at any port of call or atthe place at which the Passenger is landed.Medical facilities and standards vary fromport to port and the Company makes norepresentations or warranties in relation tosuch standards.

10.5 Passengers should be aware of thefollowing important information:

• The ship does not have disabled cabins orcabins that accommodate wheelchairs

• Cabin door widths are too small forwheelchairs and only collapsiblewheelchairs can be stored in cabins

• Only collapsible wheelchairs can be carriedon board the ship

• There is no lift on board • Each external door has a lip and therefore

wheelchairs cannot be used freely aroundthe vessel therefore access around thevessel is restricted and limited

• The ship is not suitable for full timewheelchair users

• Passengers can only board the ship by footand there is no alternative access

• The vessel may be moored alongsideanother ship which may be the only meansof access to the ship

• There is no doctor on board the ship

• There are qualified first aiders who can givelimited assistance

• For reasons of health and safety mobilityscooters may not be brought on board theship

• Passengers who need assistance at the portmust notify the Company at the time ofbooking and in no case less than 48 hoursprior to boarding and present forembarkation at the designated place at thespecified time.

10.6 For the purposes of EU 1177/2010 whichapplies to cruises where the first port ofembarkation is in the EU Disabled Person’ or‘Person with Reduced Mobility’ includes anyperson whose mobility when using transportis reduced as a result of any physicaldisability (sensory or locomotor, permanentor temporary) intellectual or psychosocialdisability or impairment, or any other causeof disability, as a result of age, and whosesituation needs appropriate attention andadaption to his particular needs for theservice made available to all passengers.Passengers with Reduced Mobility and orDisabilities must advise at the time ofbooking of their specific needs with regard toaccommodation, seating or services requiredfrom the carrier or terminal operator, or theirneed to bring medical equipment, or to bringa recognised assistance dog on board thevessel or of any other known disabilities orwho in the Carrier’s and or Master’s opinion isunfit or unable to travel or anyone whosecondition may constitute a danger tothemselves or others on board on thegrounds of safety.

10.7 The requirement to notify the Companyat the time of booking of any medicalequipment required on board is to ensurethat the medical equipment can be lawfullycarried and/or carried safely. It is thepassenger’s responsibility to ensure that allmedical equipment is in good working orderand for arranging enough equipment andsupplies to last the entire voyage. The shipdoes not carry any replacement and accessto shore side care and equipment may bedifficult and expensive. Passengers must beable to operate all equipment.

10.8 If there are any particular conditions,Disabled or Reduced Mobility which requirepersonal care or supervision then suchpersonal care or supervision must beorganised by the Passenger and at thepassenger’s expense. The vessel is unable toprovide respite services, one to one personalcare or supervision or any other form of carerfor physical, psychiatric or other conditions.

10.9 In accordance with EU 1177/2010 where itis strictly necessary for the safety of thePassenger, the Company and or the carriercan require a Disabled passenger or Personwith Reduced Mobility before it accepts thebooking that a Passenger is assisted by anaccompanying person who is fit and able toprovide the assistance required.

10.10 Assistance dogs are subject to nationaland EU Regulations regarding travel. It is thepassenger’s responsibility to check theposition prior to the cruise and to be satisfiedthat the assistance dog can be carried to theports of embarkation and disembarkationand that the dog is not prohibited from goingashore at the various ports of call. Assistancedogs must have all necessary papers andcomply with national Regulations regardinghealth, inoculations, training and travel.

10.11 Whilst the Company makes every effortto accommodate all Passengers’ needs,Passengers using wheelchairs may haverestricted access in certain areas of the shipand may be unable to go ashore in certainports, particularly those that require the useof tenders.

10.12 The Company does not accept anyresponsibility for Passengers unable to travel,or who incur any other loss because they failto comply with any health formalities. TheCompany takes no responsibility forPassengers denied embarkation and/ ordisembarkation on medical grounds.Cancellation of any part of the holiday thatarises due to health requirements will besubject to cancellation charges as set out insection 8.

10.13 Any cost or expense reasonablyincurred by the Company for or on behalf ofthe Passenger in respect of any form ofmedical, dental or similar treatment, hotel,transportation, repatriation or any otherexpense shall be repayable by the Passengerto the Company irrespective of whether thesum is covered by the Passenger’s travelinsurance arrangements.

10.14 Unless approved by the Company inwriting prior to departure, Passengers maynot bring on board any controlledsubstances.

10.15 Passengers may not bring on board anyprohibited substances, any animals (otherthan previously arranged assistance dogs) orany goods of a flammable or dangerousnature. Doing so will render the passengerstrictly liable to the Company for any injury,loss, damage or expense suffered by theCompany as a result. The Passenger will alsobe personally liable for any statutorypenalties.

10.16 Passengers are required at all times tofollow the instructions of employees andcrew regarding the use of ship’s equipment(including hand sanitisers) and generalbehaviour whilst on board and the Companywill not be responsible for any consequentialinjury, illness, financial or other loss incurredby Passengers if they fail to comply with theinstructions they are given.

10.17 The Master (or any employee ormember of the crew authorised by theMaster) will be entitled to search the cabinand/or personal luggage of any Passengersuspected of being in breach of theseclauses. In addition, any employee or crewmember will be entitled to enter aPassenger’s cabin in order to carry out aninspection, or to undertake cleaning,maintenance or repair work.

10.18 The Company has the right to refuse orrevoke passage to anyone who, in itsjudgment, is in a physical or mental conditionunfit for travel, or who may require carebeyond that which the vessel can provideand under such circumstances the Companywill offer the Passenger no refund of any partof the cost of their unused cruise package.

10.19 If it appears that a Passenger’s conduct,behaviour or health has or is likely toendanger the Passenger’s own health or thehealth, safety or enjoyment of any otherPassenger or crew or employee, or makes theCompany liable for any significant unforeseencosts including medical treatment orrepatriation, the Company and/or the Masterreserve the right to take appropriate actionand make appropriate charges. Actions mayinclude disembarkation, confinement to aparticular cabin or confinement to a hospitalor similar institution at any port. If, under theterms of this clause, the Passenger’s cruise isterminated the Company will offer thePassenger no refund for any unused part oftheir cruise package nor will the Company beliable for the cost of repatriating thePassenger.

10.20 The Company may invite variousaffinity groups of people with sharedinterests who choose to travel together ontoa cruise. The Company does not envisagethat this will materially affect the normal dayto day operation of the ship but Passengers

must accept that there may be occasionswhen certain facilities are unavailable whilstthese groups are on board.

10.21 Should any Passenger have themisfortune to suffer illness, injury or deathduring the period of the cruise arising out ofan activity that does not form part of thearrangement made by the Company, theCompany will, where appropriate, provideany assistance it can to the affectedPassenger, such assistance being limited to amaximum cost incurred by the Company of£5,000 per cabin.

11 COMPLAINTS

11.1 Any Passenger who encounters aproblem during a cruise must immediatelyreport it to the Chief Purser or a seniormember of the crew on the ship and ensurethat the issue is recorded in the ship’s logtogether with any action taken to resolve it. Ifthe matter cannot be resolved during thecruise, and the Passenger wishes to pursue acomplaint, the Passenger must write to theCompany within 28 days of finaldisembarkation.

11.2 As a Member of ABTA, membershipnumber W0302, the Company maintains ahigh standard of service to you by ABTA’sCode of Conduct. We can also offer you anarbitration scheme for the resolution ofdisputes arising out of, or in connection withthis contract. The arbitration scheme isarranged by ABTA and administeredindependently. It provides for a simple andinexpensive method of arbitration ondocuments alone with restricted liability onyou in respect of costs. The scheme does notapply to claims for an amount greater than£5,000 per person. There is also a limit of£25,000 per booking. Neither does it applyto claims which are solely in respect ofphysical injury or illness or theirconsequences. The scheme can however dealwith compensation claims which include anelement of minor injury or illness subject to alimit of £1,500 on the amount the arbitratorcan award per person in respect of thiselement. Your request for arbitration must bereceived by ABTA within eighteen months ofthe date of return from holiday. Outside thistime limit arbitration under the Scheme maystill be available if we agree, but the ABTACode does not require such agreement. Forinjury and illness claims, you can request theABTA Mediation Procedure and we have theoption to agree to mediation.

11.3 Passengers are required to make anycomplaints relating to EU 1177/2010 whilst onboard the ship. If the complaint is notresolved on the ship then any formalcomplaint must be made to the Companywithin 2 months from the date of thecircumstances giving rise to the complaint.Within 1 month of receipt of the complaintthe Company will respond informing thePassenger whether the complaint has beensubstantiated, rejected or is still beingconsidered. The Company will provide a finalresponse to the Passenger no later than 2months after receipt of the complaint. 12 CONDITIONS OF CARRIAGE BY SEA OR INLAND WATERWAYS AND LIMITATION OF LIABILITY

12.1 Travel on board the ship is subject to theshipping company’s Conditions of Carriagesome of which limit or exclude liability in

accordance with international laws andconventions. Copies of these conditions willbe sent to Passengers with their traveldocumentation but they can be provided inadvance upon request. They are alsoavailable on board the ship. It is importantthat you read these documents as the set outyour rights and obligations. They also containlimitations of liability.

12.2 The liability of the Company and allcarriers is as follows:

• In respect of river cruises where carriage ison inland water ways, the Convention onLimitation of Liability for Maritime Claims1996 (LLMC 96) as amended by SI1998/1258 applies. The StrasbourgConvention on the Limitation of Liability ofOwners of Inland Navigation Vesselsreferred to as the ‘Strasbourg Convention’with protocols and amendments may applyto vessels sailing on waterways located inthe territory of a state party subject to (i) the ‘Revised Convention relating to theNavigation of the Rhine of 17 October 1868’and (ii) the ‘Convention of 27 October 1956concerning the canalization of the Moselle’(Article 15(1) of the Strasbourg Convention:http://www.ivr.nl/downloads/forms/B2.pdf).

• International carriage by sea is governed byEU Regulation 392/2009 relating to theLiability of carriers of passengers by sea inthe event of accidents (EU 392/2009) andthe Athens Convention 2002 which may beviewed at http://www.admiraltylawguide.com/ conven/passengers1974.html

• Non international carriage by sea/domesticcarriage and or where the vessel is beingused as a floating hotel The MerchantShipping (Convention Relating to theCarriage of Passengers and their Luggageby Sea) Order 2014 (2014 Order) whichmay be viewed athttp://www.legislation.gov.uk/ukdsi/2014/9780111112502 applies.

12.3 In so far as a cruise may be performedon a ship not owned by the Company,Passengers agree that the Company shall atall times nevertheless be deemed a shipowner for the purposes of any relevant lawsin force in any relevant jurisdiction andtherefore be entitled to any limit to itsliability.

12.4 A Special Drawing Right (SDR) is aninternational monetary unit. The exact valueof an SDR fluctuates with the daily exchangerate, The daily exchange rate can be viewedat the International Monetary Fund websitehttp://www.imf.org/external/np/fin/data/rms_sdrv.aspx and an SDR converter isavailable athttp://coinmill.com/GBP_SDR.html#SDR=46666, The values in the booking conditions arethose of 8 May 2014 and may fluctuateupwards or downwards

Liability for river cruises

12.5 The Company’s liability for death and orpersonal injury for river cruises pursuant to SI 1998/1258, a copy of which will beprovided by on request or can be found at:(http://www.legislation.gov.uk/uksi/1998/1258/article/4/made), is SDR175,000 per passenger limit (approx.$272,437.15 or £160,570.99). If the StrasbourgConvention applies the limits for passengerclaims are SDR 60,000 (approx. £55,065.01)per passenger subject to a minimum of SDR6,000,000 (approx. £5,506,500.72)(seeArticle 7). Liability for carriage by sea

12.6 EU Regulation 392/2009, The AthensConvention 2002 and the 2014 Order limitthe Company’s and the Carriers’ liability forloss or damage to luggage and make specialprovision for valuables. It is presumed thatluggage has been delivered undamagedunless written notice is given to the Companyand/or the performing Carrier a) in the caseof apparent damage, before or at the time ofdisembarkation or redelivery; or b) in thecase of damage which is not apparent or ofloss, within 15 days from the date ofdisembarkation or redelivery or from the timewhen such redelivery should have takenplace. Damages for cabin luggage payable bythe Carrier are limited up to SDR 2,250(approx. £2,064.51) or where the 2014 Orderapplies SDR 833 (approx. £764.32).

12.7 Limits shall be reduced in proportion toany contributory negligence by thePassenger and by the maximum deductiblespecified in Article 8 by the passenger inaccordance with Article 8 (4) of the AthensConvention 2002 and EU Regulation392/2009. All Claims must be brought inaccordance with EU Regulation 392/2009,the Athens Convention 2002 or the 2014Order within 2 years of the date ofdisembarkation from the ship.

12.8 In respect of domestic carriage in theUK, the 2014 Order will apply and the limitsfor death/personal injury are SDR 46,666(approx. £42,818.53). These limits may alsoapply to domestic cruises in the EU. Wherethe carrier has a principal place of business inthe UK the limits of liability per passengermay be SDR 300,000 (approx. £275,265.91)per carriage.

12.9 In respect of international carriage EURegulation 392/2009 and the AthensConvention 2002 apply the following limitsfor death/personal injury caused by ashipping incident, with the exception ofcircumstances beyond the Carrier’s control(ie act of war, natural disaster, act of a thirdparty) to no more than 250,000 SDRs(approx. £229,421.59) per passenger percarriage. Shipping incidents are defined as ashipwreck, capsizing, collision or stranding ofthe ship, explosion or fire in the ship, ordefect in the ship.

Except for cases involving war and terrorismdamages up to a further 150,000 SDRs(approx. £137,656.76) may be payable inrespect of a shipping incident unless theCompany or the Carrier proves that thedeath or personal injury occurred without theCarrier’s fault or neglect. Where death/personal injury is caused by a non-shippingincident it is for the passenger to prove thatthe death or personal injury was caused bythe fault or neglect of the carrier. Themaximum sum payable to any passengerunder EU Regulation 392/2009 is limited toSDR 400,000 per passenger per carriagewhich is approx. £367,084.70. The maximumsum payable in cases involving war andterrorism where the carrier is liable is SDR250,000 (approx. £229,421.59) per passengerper carriage or 340,000,000 SDRs per shipper carriage.

12.10 The Company and the Carrier are notliable for valuables, monies or other securitiesincluding jewellery and watches. If they havebeen deposited with the reception desk onthe ship for safe keeping and a receipt issuedthen in those limited circumstances theCompany’s and the Carriers liability will be asset out in EU Regulation 392/2009, theAthens Convention 2002 and whereapplicable the 2014 Order. The use of safeson board a Vessel is not a deposit with theship or with the Company. The limits are SDR3,375 (approx. £3,097.36) pursuant to EURegulation 392/2009 and the AthensConvention 2002 or SDR 1,200 (approx.£1,101.28) pursuant to the 2014 Order.

13 CONDITIONS OF CARRIAGE BY AIR ANDLIMITATION OF LIABILITY

Travel on board aircraft used in travelling toand from the ship is subject to the airline’sstandard ticket conditions, some of whichlimit or exclude liability in accordance withinternational conventions. These conditionscan be found on the airline’s website or canbe provided by the Company upon request.

13.1 If your air journey involves a destinationor stop in a country other than the one fromwhich you depart, the Montreal Conventionmay govern the liability of all airlines involvedin your journey, including any portion thereofin a single country. This Convention limits theliability of airlines involved in your journey,including any portion thereof in a singlecountry. This Convention limits the liability ofairlines for death or bodily injury and forbaggage loss, delay or damage. For many aircarriers, the Montreal Convention limits forbodily injury or death and the defence thatthey have taken all necessary measures toavoid the damage for the first SDR 113,100(approx. £103,748.85) of any such claim donot apply. In addition, in cases of death orbodily injury, many air carriers will makeadvance payments to the person entitled tocompensation, if required to meet immediateeconomic needs, in proportion to thehardship suffered. European Communitylegislation requires carriers to provide aminimum advance equal to not less than SDR16,000 approx. £14,672.76 in the event ofdeath. Other air carriers may apply alternateprovisions.

Denied Boarding, Cancellation and Delay

13.2 Under EU law (EC Regulation 261/2004)you have rights in some circumstances to arefund and/or compensation from your airlinein cases of denied boarding, cancellation ordelay to flights. Full details of these rights willbe publicised at EU airports and will also beavailable from airlines. However,reimbursement in such cases is theresponsibility of the airline and will notautomatically entitle you to a refund of yourholiday cost from us. Your right to a refundand/or compensation from us is set out inClause 7. If any payments to you are duefrom us, any payment made to you by theairline will be deducted from this amount.

Airline Carrier Identity

13.3 In accordance with EU Regulation2111/2005 we are required to advise you ofthe actual carrier operating yourflight/connecting flight/transfer. We do thisby advising you of the carriers to be used orlikely to be used at the time of booking. Anychanges to the actual airline after you havereceived your tickets will be notified to youas soon as possible and in all cases at check-in or at the boarding gate. Such a change isdeemed to be a minor change.

14 GUIDES AND GUEST SPEAKERS

14.1 Independent contractors retained by theCompany, including but not limited tolecturers, guides, guest personalities, cruisehosts and entertainers are subject to changeand/or cancellation without notice. TheCompany also retains the right to change anymember of ship’s crew previously advertisedor disclosed (e.g. the ship’s Master) withoutnotice.

15 FINANCIAL PROTECTION

15.1 The Package Travel, Package Holidaysand Package Tours Regulations 1992 requirethe Company to provide security for themonies that each Passenger pays for thepackage holidays booked with the Companyand for your repatriation in the event of theCompany’s insolvency.

15.2 For flight-based holidays this is throughour Air Travel Organiser’s Licence number3897. When you buy an ATOL protectedflight or flight inclusive holiday from us youwill receive an ATOL Certificate. This listswhat is financially protected, where you canget information on what this means for youand who to contact if things go wrong. Wewill provide you with the services listed onthe ATOL Certificate (or a suitablealternative). In some cases, where we aren’table to do so for reasons of insolvency, analternative ATOL holder may provide youwith the services you have bought or asuitable alternative (at no extra cost to you).You agree to accept that in thosecircumstances the alternative ATOL holderwill perform those obligations and you agreeto pay any money outstanding to be paid byyou under your contract to that alternativeATOL holder. However, you also agree that insome cases it will not be possible to appointan alternative ATOL holder, in which case youwill be entitled to make a claim under theATOL scheme (or your credit card issuerwhere applicable).

15.3 If we are unable to provide the serviceslisted (or a suitable alternative), through analternative ATOL holder or otherwise) forreasons of insolvency, the Trustees of the AirTravel Trust may make a payment to (orconfer a benefit on) you under the ATOLscheme. You agree that in return for such apayment or benefit you assign absolutely tothose Trustees any claims which you have ormay have arising out of or relating to thenon-provision of the services, including anyclaim against us, the travel agent (or yourcredit card issuer where applicable).
