Governor Tim PawlentyWith a real state budget deficit of $6.4 billiondollars, Governor Pawlenty faced a huge challenge from the start of the legislative session. The DFL-controlled state legislaturewas intent on raising taxes to continue their out-of-control government spending. In January,Governor Pawlenty submitted his budget solution, but even after four months, DFL leadership in the House and Senate failed to

come up with a budget solution that didn’t include a billion dollar tax increase.With the Governor committed to not raising taxes he explained to the DFL lead-ership that if they failed to produce a balanced budget, he would line item vetospending bills and cancel appropriations in order to balance the state budget. In the end, Democrats failed to produce a balanced budget, so the Governor willhave to resolve the 2010-2011 budget without them. All Minnesota taxpayersowe Governor Pawlenty a thank you for his “no tax increases” stand.

Senate Majority Leader Larry PogemillerDFL-Minneapolis (59)

The “architect” of the failed DFL leadershipstrategy of balancing the state budget with billions of dollars in new taxes was SenateMajority Leader Larry Pogemiller. He led hisParty to waste months of time by refusing to

work with Governor Pawlenty towards a budget solution that had achance of being signed into law. Under Sen. Pogemiller, the Senate passedan across-the-board income tax increase that even the House DFLers wouldn’t accept. In the final minutes of the 2009 session, Sen. Pogemiller’s“solution” was yet another desperate attempt to pass a billion dollar taxincrease. But like the previous tax bill, this one was dead on arrival andwas promptly vetoed by Governor Pawlenty. Sen. Pogemiller needs tobrush up on his negotiating skills by reading “Getting to Yes.”

House MinorityLeaderMarty SeifertR-Marshall (21A)

With just 47 Republicans and 45votes needed to sustain a veto,Rep. Seifert faced a dauntingtask at the outset of the 2009session. The pressure from theDFL majority to divide the GOP

caucus was relentless. During endless debates and bill after billRep. Seifert held his caucus together. When the Democrats triedin the closing hours of the session to override GovernorPawlenty’s veto of a billion dollar tax bill, every RepublicanHouse member voted to uphold the Governor’s veto. On behalfof Minnesota’s taxpayers, thank you Rep. Seifert and all 47Republican House members!

Speaker of the House Margaret AndersonKelliherDFL-Minneapolis (60A)

Speaker Kelliher presided over a “do-nothing” legislature that spent four-and-a-half months complaining about GovernorPawlenty’s budget proposal but couldn’t

produce a balanced budget proposal of their own. In the end, theHouse passed $34 billion in spending but only $31 billion in estimated revenue. Leaving a $3 billion budget gap, Speaker Kelliherhad to twist arms in her own caucus to pass tax bill after tax bill,only to have their $1 billion tax increase vetoed by the Governor. But even with their billion dollar tax increase there would have beena $2 billion budget hole. Remedial math should be on SpeakerKelliher’s summer agenda.

Senate Tax Committee Chair Tom Bakk DFL-Cook (6)

Instead of tax reform to promote Minnesotajob growth, Sen. Bakk, Chair of the Senate TaxCommittee, worked to bring forth a $2 billiontax increase. The bill included an across-the-board income tax increase as well as a new top

tier tax rate of 9.25%. Sen. Bakk proved in his third year as the SenateTax Chair that he is determined to stunt Minnesota’s economic growthwith billions in new taxes. Look out! This big time tax-and-spender isrunning for Governor in 2010.

House Tax Committee Chair Ann LenczewskiDFL-Bloomington (40B)

While she has tried to build a reputationas a tax reformer, Rep. Lenczewski castthat role aside this legislative session andjoined the big tax-and-spend crowd with

her $1.5 billion House tax increase proposal. Rep. Lenczewski con-sistently did the bidding of her liberal tax-and-spend colleagues bypassing billion dollar tax increase after billion dollar tax increase.

Taxpayers Win in 2009 SessionTaxpayers Win in 2009 SessionTaxpayers Win in 2009 Sessionhe 2009 legislative session was destined to be agrudge match between the Governor and theDemocrat controlled legislature from the outset.

In the fall of 2008, the bottom dropped out of the nationaleconomy and the November state budget forecast showed$4.8 billion in the red for the 2010-11 Minnesota statebudget, or roughly a 12% shortfall.

The funding problem continued to grow worse and theMarch budget forecast showed a whopping $6.4 billionshortfall. With the inclusion of federal money, Minnesota’sbudget problem was now calculated to be $4.6 billion.

At the outset, Gov. Pawlenty stated he was committed to balancing Minnesota's state budget without raising taxes and pre-sented a proposed budget in late January with no tax increases.

The stage was set from that point on for a showdownbetween the Governor and the Democrat-controlled legislature, with Gov. Pawlenty holding firm to his “no taxincreases” proposal and the DFL-controlled legislatureunwilling to make the necessary spending reductions to produce a balanced budget.

The Taxpayers League focus was to make sure the taxpayers voice was heard at the Capitol. Working withother conservative non-profit organizations we produced“Real State Spending Reform” a budget proposal that solvedthe state deficit by reducing government spending withoutraising taxes. This document can be found at www. taxpayersleague.org. We also kept the pressure on the biggovernment spenders at the State Capitol by organizing the2009 Tax Cut Rally on May 2nd that attracted over 5,000people to the State Capitol to speak out against increased government spending and higher taxes.

True to his word, Gov. Pawlenty vetoed every major taxbill that reached his desk. He also executed dozens of lineitem vetoes in order to trim the Democrats’ bloated spending bills.

Success for Minnesota's taxpayers would not have beenpossible without commitment and courage of Gov. Pawlentyand the 47 Republican members of the Minnesota Housewho stood together to sustain Gov. Pawlenty’s veto of theDemocrats’ billion dollar tax increase.

2009 VOTE DESCRIPTIONS (SJ = Senate Journal Page Number)

1) A BLOATED SENATE BONDING BILL (SJ 1746) The Senate bonding bill left the Senatewith $330 million in pork barrel projects. This bill spent $130 million more than theHouse version. With a $6 billion budget shortfall, it was not the time to increase statedebt. The taxpayer friendly vote was to oppose this bill. (Bill passed 57-9)2) THEY SAID THEY WERE ONLY GOING TO TAX THE RICH (SJ 3430) While there wasmuch talk of only increasing taxes on the “rich,” this tax bill passed the Senate with anacross the board income tax increase on all taxpayers. In total, this bill would haveraised taxes by $2 billion. (Bill passed 35-30)3) TRANSPORTATION BILL, BAD POLICY AND SPENDING PRIORITIES (SJ 3743) This votewas on the $4.3 billion transportation bill that included funding for various light railand commuter rail projects which continued the trend for rail funding over highways.It also shifted money away from road maintenance. (Bill passed 63-4)4) GIVING ST. PAUL A STATE BAILOUT (SJ 3895) This vote was on the economic devel-opment bill and included a loan forgiveness for the city of St. Paul RiverCentre Arenatotaling $32.75 million. The city of St. Paul had originally received a loan to pay for thearena and was now asking for the loan to be forgiven, in other words a taxpayerbailout. (Bill passed 38-28, vetoed by the Governor)5) AN ENVIRONMENT FINANCE BILL THAT SHIFTED FUNDING TO PET PROJECTS (SJ 4018)This environment finance bill shifted dedicated funds to spending on pet projects andincreased fees for a total of about $20 million, increasing spending for a variety of pro-grams. (Bill passed 52-15)6) ANOTHER TAX INCREASE (SJ 4466) This $1 billion tax increase included the fourthtier tax increase, liquor tax increases, and cigarette tax increases. (Bill passed 44-20,vetoed by the Governor)7) ANOTHER STEP CLOSER TO GOVERNMENT RUN HEALTH CARE (SJ 4940) This vote wason the Health and Human Services finance bill. It expanded eligibility for numerousstate funded health care programs while cutting hospital, doctor, and provider reim-bursements. Under this legislation, the taxpayer would eventually be forced to paymore in taxes as we head toward a state run health care system. (Bill passed 47-18)

8) FEDERAL TAX CONFORMITY BILL AND MORE (SJ 5203) While this bill included federaltax conformity language, it also allowed some local governments to increase the salestax and permitted unelected local government bodies to issue debt. The taxpayerfriendly vote was to oppose this. (Bill passed 54-12)9) STAY IN COLLEGE LONGER AND GET A GRANT (SJ 5277) This vote on the HigherEducation finance bill removed provisions to incentivize college students to graduateon time by allowing a ninth semester of state grant eligibility. The bill also cut fundingfor some programs while carving out money for the Power of You program that priori-tized grant money for students in Minneapolis or St. Paul. (Bill Passed 54-12)10) STATE GOVERNMENT FINANCE BILL (SJ 5352) Again, in a tough fiscal year for statespending priorities, no real spending reform was offered in this bill. The StateLegislature also protected themselves by reducing their spending at a smaller ratethan most other state agencies. (Bill passed 58-8)11) BONDING BILL ADDS MORE DEBT (SJ 5422) The conference committee onlyreduced the State Senate bonding bill request from $330 million to $300 million, $100million more than Gov. Pawlenty stated was the ceiling. The taxpayer friendly votewas to oppose this conference committee report. (Bill passed 59-8)12) NO REFORM IN K-12 EDUCATION SPENDING (SJ 5654) In a year of tough statespending decisions, there was no attempt made to reform K-12 education funding.This K-12 finance bill also had continued funding for the integration program thatreceived criticism in a state auditor’s report. (Bill passed 49-16)13) ARTS AND OUTDOOR ENTERTAINMENT PORK (SJ 6494) This vote was on the deliv-ery of the pork projects to the special interests who supported the constitutional salestax increase that was passed last year. It appropriated $87.5 million for numerous spe-cial interest projects of questionable value. (Bill passed 67-0)14) END OF SESSION TAX INCREASE SHENANIGANS (SJ 6730) This vote was on the taxincrease bill that didn’t return from conference committee until the last night of ses-sion and was voted on just before the midnight deadline ending the 2009 legislativesession. The taxpayer friendly vote was to oppose this bill or not vote because thePresident of the Senate called for the vote while debate was ongoing. (Bill passed35-1, vetoed by the Governor)

1) ADDING TO THE STATE DEFICIT (HJ 1952) This bill was to increase the state debt byselling another $200 million in state general operating (GO) bonds. The taxpayerfriendly vote was to oppose this unnecessary pork project bill. (Bill passed 93-40)

2) A $1.5 BILLION TAX INCREASE (HJ 4095) This tax bill created a fourth tier income tax,started collecting taxes on music downloads, increased liquor taxes, increased cigarettetaxes and removed deductions from some home mortgages. (Bill passed 68-65)

3) TRANSPORTATION BILL, BAD POLICY AND SPENDING PRIORITIES (HJ 4438) This votewas on the $4.3 billion transportation bill that included funding for various light railand commuter rail projects which continued the trend for rail funding over highways.It also shifted money away from road maintenance. (Bill passed 103-30)

6) ANOTHER TAX INCREASE (HJ 5053) This $1 billion tax increase included the fourth tiertax increase, liquor tax increases, and cigarette tax increases. (Bill passed 86-45, vetoedby the Governor)

7) ANOTHER STEP CLOSER TO GOVERNMENT RUN HEALTH CARE (HJ 5428) This vote wason the Health and Human Services finance bill. 10) STAY IN COLLEGE LONGER AND GET A GRANT (HJ 6018) This vote on the HigherEducation finance bill removed provisions to incentivize college students to graduateon time by allowing a ninth semester of state grant eligibility. 13) GOVERNOR’S VETO OF TAX INCREASES UPHELD (HJ 6563) This key vote was on theattempt by the House DFL to override the Governor’s veto of a $1 billion tax increaseincluding a new fourth tier income tax. The taxpayer friendly vote was to oppose theoverride attempt. (Override failed 85-49, 90 votes are required to override a veto)
