    Moving into your first off-campus residence can be a dauntingexperience. I know it is for me.

    Ive never really thought abouteverything that living on my ownentails until this year. Most of mystruggle is that Ive never had to thinkabout being a tenant and having torelate to a landlord.

    But the more I learn about rentingan apartment or house, the more Iwish someone had told me everythingI should be thinking about whilesearching for somewhere to live nextyear.

    Things like leases and fees nevercrossed my mind before I startedthinking about living off campus. Iwant to make sure I get a good dealand have a good relationship with my

    landlord.

    Many of us who are just starting oursearch for housing next year seem tobe confused about what we shouldlook out for regarding how to act asa tenant. Thats why we decided tomake our second apartment guide forSpring 2009 all about being a tenant.

    Whether youre a first-time tenantor a veteran, I hope this apartmentguide will offer advice and helpful,new information that will make it

    easier to transition to life as a tenant.

    Knowing about what it means to be a tenant is an important frst step in a housing search or next year. Thinking about

    such things as responsibilties, ees and leases will help students transition into tenant lie.

    At the beginning of the school year,Isaac Young and his girlfriend, Jenny Erice,were desperately searching for apartments.They didnt have many requirements: just alow price and good location. After looking

    at various options, the couple decided onan apartment featuring inexpensive roomsand a stop on the KU bus route.

    Young and Erice were aware thatapartment living meant responsibility,from cleaning to paying bills. They soonrealized, however, that responsibility alsomeant knowing their rights and standingup for themselves.

    Before signing the lease, Young, Wichitafreshman, and Erice did a walk-throughof their apartment and said everything

    seemed satisfactory. The couple said itwas not until after they moved in thatproblems with management, maintenanceand the apartment became apparent.

    Young said a thick layer of grime coveredthe bathroom and a six-inch hole underthe bathroom sink led into the bathroomnext door.

    Additionally, the couple said they hadtrouble getting the management to upgradetheir front door, which they thought didnot seem solid enough.

    The door was the same quality as theclosets, Erice described.

    When a maintenance man came, Youngsaid, he fixed only a broken lock. Ericesaid she asked about a new door, but themaintenance man told her she was no lesssafe than anyone else.

    Following the incidents, Young and

    Erice considered other living options, butultimately decided to stay.

    I figured you get what you pay for,Young said.

    Young said that, given his circumstances,there was little he could have donedifferently in searching for apartments.Both Young and Erice, however,encouraged prospective tenants not tohesitate in asking questions and makingdemands they feel are necessary for anoptimal living situation.

    Potential apartment renters should beaware of common problems, they shouldknow what their priorities are, and theyshould definitely pay close attention tofine print, Young said.

    Young and Erice are not alone in theirtroubles with apartment renting.

    Bill Schulteis, owner of The Oaks,Campus Courts, and Eddingham Place,said he strived to end lessee suffering.

    Schulteis explained that a successful

    apartment complex focused on the detailsand valued good service.

    We work on bringing in new tenants,but also on retaining, Schulteis said.

    Young said he thought it was importantto be treated as a person and not as anumber But, he said, the best way toensure a good experience was to defendones rights.

    Living somewhere for a short periodof time is no excuse, Erice said. It is stillyour home.

    Both Young and Erice said it wasimportant to go into apartment searchingknowing exactly what you want and whatyou are not willing to compromise on.

    Know what youre looking for beforegoing in or youll catch yourself saying,Well, I guess this is good a lot morethan you should, Erice said.

    Living in an apartment or house forthe first time can involve

    many changes. Its anew environment, withnew people to get alongwith, and a new set ofresponsibilities to handle.

    When students rent aliving space, they mustabide by a landlordsrules. Sometimes therelationship between thetenant and the landlordcan become confusing, and the division

    of responsibility can be unclear.

    To get along as well as possible, tenantsand landlords must understand theirroles in the housing agreement.

    The Kansas Tenants Handbook definesa tenant as, a person entitled

    under a rental agreement tooccupy a dwelling unit to theexclusion of others.

    Because tenants do not ownthe places they live in, theymust treat it with respect.Tenant Responsibilities arealso outlined in the KansasTenants Handbook. The firstis to pay rent on time.

    Emily Soener, Omaha, Neb., senior, saidthat was her biggest flaw as a tenant.

    I am a terrible procrastinator, and soI still have a hard time getting my rent inon time, Soener said.

    Another responsibility for tenants ismaking sure their living space remains asclean as possible.

    McGuire said.When renting a space, its also importantto remember that other residents livenearby.

    Noise can travel easily, especially inapartment complexes.

    Keep the place clean,keep it nice and respectyour neighbors, saidGraci DAmore, Antioch,Calif., sophomore.

    Although tenants

    have their own set ofresponsibilities whenrenting an apartment,landlords have to keep uptheir end of the deal, aswell.

    A landlord is defined as, the owner,leaser, or subleaser of the dwelling unit, orthe building of which it is a part, accordingto the Kansas Tenants Handbook.

    Landlords do not necessarily own thespace, but they do manage and take care

    of it.

    Their job is to maintain the area theyare leasing to a tenant.

    They need to provide services,DAmore said. They also need to makethe place feel safe and hold up to whatthey say they are going to do.

    The upkeep of the heat, electricity andplumbing is the landlords responsibility

    as well.They maintain all the

    utilities and repair them ifthey break. If tenants thinksomething is going wrong,they can contact their landlord

    so the problem can be solved.The tenant-landlordrelationship does not have tobe difficult.

    When both take care of theirresponsibilities, the living arrangementcan work out much better.

    Soener said she thought landlordswerent as bad as some people assumed.

    I dont see why landlords have to beenemies, Soener said.

    Getting ones rst apartment is a riteo passage or many college students.

    Receiving that rst months bill is thesame, but one that many students arentlooking orward to. Some students donttake the time to understand what theyare responsible or, but knowing can savethem money in the long run, or even rightup ront.

    Students hunting or their rstapartment usually look or the best rentavailable, but many dontrealize theyll need to payother ees. A ew o these

    ees include gas, electricity,patio ees and pet rent.

    I have lots o rst-timerenters who dont knowthey are responsible orutilities like water, gasand electricity, said MaryGage, manager o SunriseApartments. We oen haveto explain that to them.

    Its important that students nd outexactly how an apartment handles utilities.

    Some charge per usage, by at rate, orby including the ees in the rent. Someapartments may charge more or utilities.

    In older apartments, the utilities canbe higher, said Crystal Farris, Olathesophomore. Newer apartments have

    central heating.Students can avoid a monthly gas bill

    by looking or apartmentswith electric appliances.

    Students should also

    consider whose name is onthe bill.

    Jamie West, OverlandPark sophomore, saidstudents needed to makesure that utilities were intheir name. Otherwise, theyrisk getting overchargedby their landlord. West originally had his

    bills in his landlords name.Ten he ound out that hislandlord had charged him

    extra because the title wasntin Wests name.

    Animal lovers may beexcited to hear their apart-ment allows them to keep acat or dog, but it isnt alwaysaordable. A pet deposit isalmost always required, andsome apartments will also

    charge a pet rent every month or aslong as the pet is living in the apartment.

    Unlike in the residence halls, cable,

    telephone and Internet arent included inthe rent at most apartments. Gage has toinorm many tenants that they will needto purchase these perks outside theirapartment contracts.

    Students shopping or an apartment

    should be on the lookout or howapartments handle these extras.

    Emily Kessinger, anapartment leasing agent, saidinsuring an apartment was

    another step students oenorgot about. She recommendsrenters insurance as anafordable means to protectan apartment.

    According to the Kansasenants Handbook, mostleasing companies dont cover

    stolen items or re damage. Its best tocheck with multiple insurers to get thebest price and to nd out whether itemskept in cars or on patios are also covered.

    First-time renters should also take thetime to understand how important theircontract is.

    Many rst time students ail to readtheir contract, which is a legal contract

    that states they are obligated to pay, Gagesaid.

    Students not mindul o these obligationscan end up losing their security deposit.

    Matt Albright, Hutchinson senior,discovered that the hard way.

    Security deposits are an inescapable partof signing a lease. The property ownercollects money hoping the place will lookthe same as it did at move-in. If tenantsdamage the space or fail to follow therental agreement, the landlord can use thedeposit to pay for repairs.

    To receive the full security depositback, tenants must make sure they knowexactly what the landlord expects in theiragreement. Problems arise when move-out day comes and the security depositisnt returned.

    Casey Roberts, Momence, Ill., senior,

    learned that the hard way when he movedout of his apartment complex.

    We cleaned everything really well, butwe knew that the carpet was way pastsalvation, Roberts said. The thing wewere angry at was that we did roommateswaps and paid the people we moved infor the full $200, which was dumb by us.We were responsible for everything thatthe kids moving out did.

    The Kansas Tenants Handbook states

    that a security deposit cant equal morethan one months rent. If the unit camefurnished, however, landlords can chargeone and a half months rent, and if thetenants have pets, an additional one-halfmonths rent can be included.

    The handbook also advises tenants tonot plan to apply their security deposittoward the last months rent. Tenantscould lose the security deposit and maystill be responsible for the rent they weretrying to pay.

    One key element is making sure to

    fill out a thorough checklist during thewalk-through within five days of movingin.

    Allison Ho, Topeka senior, received herfull deposit back, thanks in large part tochecking the living space carefully.

    When I moved into all three of theplaces I have lived in Lawrence, I wasalmost obsessive with regard to notingpre-existing spots and scratches anywhereI could, Ho said. I did not want to be

    charged for some sort of damage that I didnot cause.

    Although noting detailed damages istime-consuming, putting in the extraeffort can be rewarding. Some studentstake extra steps to ensure that they dontpay for the damage a previous tenant leftbehind.

    Brad Werner, Spearville senior, cameup with a clever way to document thedamages at the time of a walk-through sohe wouldnt be charged for pre-existing

    damages.I think pictures are a great way to

    cover yourself, Werner said. Make a CDof any damage at check-in and see if yourlandlord will take it; if not, keep it untilcheck-out, just in case.

    To avoid occurrences that would cause

    damage, Werner suggested not hostingparties. Small daily tasks and paperworkcan save time and effort on move-out day,as well.

    The easiest thing to do is to be smartabout it, Werner said. Throughout theyear, just try to respect the unit as if youactually own it.

    To keep the place in good shape, othermeasures could help ensure the safety ofthe security deposit.

    Before checking out, Werner said,tenants can usually acquire a list of finesfrom their landlord about charges theywill receive at check-out day. Go downthe list, and check them off one-by-one to prevent being surprised by anyquestionable items.

    Id say the majority of people get theirsecurity deposit back, but if people dontget the carpets professionally cleaned, itsan automatic $110, said Julie Heironimus,leasing agent at First Management.

    Tenants can check the managementspolicies about move-out procedures sothey are aware of these ahead of time.Having an awareness of the landlordsexpectations could help save money inthe end.

    Kansas law states that a security deposit can be no more than one

    months rent, unless there is a pet deposit or the apartment comesfurnished.

    Most landlords collect security deposits, but its not required.

    Ask for a receipt for the security deposit.

    Be thorough and make sure all previous damages have been accountedfor on the walk-through checklist upon moving in.

    Dont ever apply a security deposit toward rent or other expenses. Youmay end up losing your deposit and still having to pay the rent you owed.

    Landlords can keep security deposits for three reasons:

    1. Physical damage caused by the renter2. Rent that is past due3. Costs incurred from not complying with the rental agreement

    Landlords must give renters a list of itemized deductions if they withholdany portion of the deposit for any reason.

    A fire, theft, flood or any number ofother incidents could prove devastatingfor students living away from home ifthey havent taken the time to protecttheir possessions.

    Several times a year we have studentscome in who have had personal propertydestroyed, said Bill Larzalere, chieflitigation attorney with Legal Services

    for Students. The first question we askthem is Do you have renters insurance?and, unfortunately, most of the time theanswer is No.

    Renters insurance primarily covers thetenants personal propertyin case it is damaged orstolen. Any damage fromfire, tornado or burglaryis covered under mostrenters insurance plans.

    It covers anything

    that can be picked upand moved, said KaylaFurden, who works at alocal insurance company.

    It can also coveradditional living expenses in case atenant is forced from their home, liabilityif a tenants negligence causes injury tosomeone else, and medical payments foranyone injured on the rental property.

    If anyone comes into your apartmentand slips and injures themselves, you can

    be liable, Larzalere said.Many students dont consider rentersinsurance essential, Larzalere said.

    But for about $8 to 15 a month, rentersinsurance can save students from a worldof hurt if anything ever happened totheir personal possessions.

    Although landlords have theirown insurance that covers a house orapartment, any items renters bring in aretheir responsibility.

    The University housing does not cover

    students for their possessions, either. Sothey could be at risk without insurance,as well.

    Nearly every insurance provider sellsrental policies, and different amounts ofcoverage are available.

    Matt Walker, community manager atThe Reserve, said the complex didntrequire tenants to have insurance, but itdid strongly encourage it.

    We bring in a vendor every year on

    move-in day to offer insurance to thestudents, Walker said.

    Most complexes dont require insurance,because their own facilities are covered,and only the occupants possessions areat risk. Any damage that results from thecomplexs negligence would be paid forby the owner, but Larzalere said this canoften be very complicated.

    If you do ask a landlord to pay forpersonal property damage, most ofthe time theyll say no, he said. Then

    you have to go to court and you mustprove that the damage was the landlordsfault.

    This, he said, can be a very costly andtime-consuming process, which can be

    easily avoided with a rentersinsurance policy.

    Larzalere and Walkeragreed renters insurance wasa necessary investment.

    Its something everystudent should have on

    their checklists when theydecide to move off campus,Larzalere said. We alwayshave students come in whowish they had bought renters

    insurance.Sometimes students can even be

    covered by their parents homeownersinsurance if they still qualify as adependent.

    For students who need to purchasetheir own insurance, its important to

    make sure to get the right coverage,Larzalere said.When you get insurance, be sure to

    include every one of your possessions onyour inventory, he said.

    Walker emphasized the importanceof being thorough when purchasing apolicy.

    When I was a student, I was told tolist everything from my toothbrush tomy stereo and calculate how much itwould cost to replace every single thing I

    owned, Walker said .Some policies include only coverage forthe actual cash value of the possessions,which would be less than the cost toreplace them new, which is covered inother policies. Replacement coveragemay cost a little extra, but Larzalere andWalker agreed that was worth it.

    Put yourself in a scenario whereyouve lost everything. What check doyou want written to you? Walker said.

    Walker also suggested shoppingaround and checking different rates.The Kansas Insurance CommissionersWeb site, www.ksinsurance.org, providesmany resources to help first-time renters

    choose the right policy. Here, studentscan access guides and publications aboutrenters insurance before they purchasea policy.

    More than 11,000 students in Lawrenceare under the legal drinking age. Weekendafter weekend, Lawrence police officersare finding out that many of these studentsdont seem to care.

    There is a higher density of individualswho are under the drinking age that aredrinking, said Sgt. Steve Lewis of the

    Douglas County Sheriffs Office.Now the sheriffs office is taking further

    action.The sheriff s office will hire three more

    school resource officers to fight underagedrinking, Captain Dan Ward said. Theseofficers plan to confront the source of theunderage drinking: the alcohol vendors.

    Lawrence has 68 drinking establishments,23 liquor stores and 36 off-premisescereal malt beverage retailers (not forconsumption on the licensed premise), suchas supermarkets and convenience stores.

    Many of these sites will soon endure heavydoses of compliance checks in an effort tofilter underage drinkers.

    People dont always consider theconsequences of their actions, Sgt. Lewissaid. There are consequences for breakingthe law.

    Some students, however,find the repercussions tonot be so bad.

    They basically just give

    the owner and whoeveris causing a ruckus ahard time, Sarah Cascio,Leawood freshman, said.

    But a hard time couldtranslate to hefty fines and,in extreme cases of standardhouse parties, arrests

    Other than in extreme cases, manyunderage drinkers seem to get by withouta scratch. But police officers are bustingparties regularly, and many students view itas just a buzz-kill.

    It definitely puts a damper on things,said Jamie West, Overland Park sophomore.A few kegs, a bunch of people, and all of asudden the cops showed. Everybody chilled,and the owner of the house talked to them.No one else got in trouble.

    Others have made the officersvisi ts into a weekl y routine.

    If they werent bustingparties, they wouldnt be asmuch fun. Its kind of that

    element of danger, said ClintWiseman, Ottawa senior said.Theres safety in numbers.

    With house parties, I thinktheyre kind of soft, said StevenDickherber, St. Louis freshman.You dont have much to worryabout. Its a college town.

    So while underage drinkers breathe easy,police struggle to find answers. Withoutvisible proof of alco hol consumption , pol icecant make arrests.

    Ive never had a problem with a cop

    outside of a car, Dickherber said. Theironly rule is dont drive and youre cool.

    Some students dont take the police solightly.

    Everyone kind of bolts when they come,Cascio said. I get scared of them. I dontwant to get in trouble.

    I would be terrified and try to come upwith an excuse or a lie, Chelsea Currence,Leawood sophomore, said.

    The sheriff s proposal to combat underage

    drinking is in effect for 2009. But CityManager Dave Corliss has indicated that themoney used for the proposal may need to bereturned to the citys general funds.

    Whether the proposal sticks or not,students can be sure that police will stay onthe hunt.

    The laws are there for a reason, Sgt.Lewis said. Bottom line, you know whatsright, so do it.
