Washington State Veterans' MemorialsMedal of Honor Memorial: The Medal of Honor Monument was dedicated on November 7, 1976, to honor those Washington citizens who have received the nation’s highest military decoration, the Congressional Medal of Honor. The 11½-foot tall granite obelisk is affixed with the Seal of the State of Washington and is inscribed with the names of those Washington citizens who were bestowed this supreme honor. The simple monument is located east of the Winged Victory memorial on the Capitol Campus. World War II Memorial: The World War II Memorial was authorized in 1995 by the Washington State Legislature. The memorial was dedicated on May 28, 1999, during a patriotic and emotional ceremony that drew a crowd of 5,000. The design features a star-like cluster of five, 14-foot high bronze blades engraved with the names of nearly 6,000 Washington residents who lost their lives in WWII. The engraved names form silhouette images of military person-nel and civilians. These blades are placed upon a granite world map.

Washington State Veterans' MemorialsLaw Enforcement Memorial: The Washington State Law Enforcement Memori-al is a lasting tribute to law enforcement officers who gave their lives in the line of duty, and a place of remembrance for families, friends and fellow officers.Dedicated on May 1, 2006 the memorial sits in the shadow of the Temple of Jus-tice overlooking Capitol Lake, Puget Sound and the Olympic Mountains beyond. The beautifully designed memorial bears the names of law enforcement officers killed in the line of duty in the state of Washington from territorial days to present. POW/MIA Memorial: A monument to American prisoners of war and those missing in action was dedicated in a solemn ceremony at the capitol campus on September 16, 1988. An all night vigil, followed by the release of commemorative balloons, followed the ceremony. Recognition was also given to the POW/MIA flag that is flown regularly on one of three flagpoles near the Legislative Building.

Washington State Veterans' MemorialsVietnam Veterans’ Memorial: The beautiful and symbolic Vietnam Veterans' Memorial was unveiled in a patriotic ceremony on Memorial Day, May 25, 1987. The memorial is located on a grassy knoll east of the state Insurance Building on the Capitol Campus and is near the Winged Victory Monument. The site provides visitors with a tranquil spot to reflect on the memories of those men and women who never returned from the Vietnam conflict. Since its dedication, the Vietnam Veterans Memorial has been the site of many private reflections and tributes. Items such as flags, flowers, letters and personal effects have been left to honor the memory of those who did not return. All items are collected and placed in the state archives.

Adding porphyria to the list of disabilities for specialparking privileges.

Background: Porphyria refers to a group of at leasteight inheritable metabolic disorders characterized bythe build up of porphyrins or porphyrin precursors in thebody due to the lack of enzymes necessary to metabolizethese chemicals. In many of these disorders, the accu-mulation of porphyrin in the skin can cause burning, blis-tering, swelling, and scarring of sun-exposed areas.

The Department of Licensing is required to grantspecial parking privileges to any person who has a dis-ability that limits or impairs the ability to walk and meetsone of the following criteria, as determined by a licensedphysician or an advanced nurse practitioner: • cannot walk further than 200 feet without stopping to

rest; • is severely limited in the ability to walk due to

arthritic, neurological, or orthopedic condition; • is so severely disabled that the person cannot walk

without an assistive device; • uses portable oxygen; • is restricted by lung disease to a particular extent; • is impaired by cardiovascular disease or cardiac con-

dition to a particular extent; or • has a disability resulting from acute sensitivity to

automobile emissions that impairs the ability towalk.

Summary: The description of individuals to whom theDepartment of Licensing is required to grant specialparking privileges is expanded to include any personwho has a disability that involves acute sensitivity tolight and meets one of the additional criteria, as deter-mined by a licensed physician or advanced registerednurse practitioner. The list of additional criteria isexpanded to include an individual who is restricted by aform of porphyria to the extent that the applicant wouldsignificantly benefit from a decrease in exposure to light.

To the Honorable Speaker and Members,The House of Representatives of the State of Washington

Ladies and Gentlemen:I am returning, without my approval as to Section 2, House

Bill No. 1000 entitled:

“AN ACT Relating to adding porphyria to the list of dis-

abilities for special parking privileges.”

Section 2, the emergency clause, was retained from a previousversion of the bill. The bill sponsor, stakeholders and theDepartment of Licensing do not feel it is a necessary componentof the bill. An emergency clause is used when immediate enact-ment of a bill is necessary to preserve the public peace, health,or safety or when it is necessary for the support of state govern-ment. It should be used sparingly because its application has theeffect of limiting citizens’ right to referendum. If retained, theemergency clause would move forward implementation of HouseBill No. 1000 by approximately 15 days. Delaying the bill’simplementation by 15 days does not rise to the level of publichealth risk necessitating an emergency clause.

For these reasons, I have vetoed Section 2 of House Bill No.1000.

With the exception of Section 2, House Bill No. 1000 isapproved.

Background: Sentencing Reform Act and Scoring.Under the Sentencing Reform Act (SRA), an offenderconvicted of a felony receives a standard sentence rangethat is based on the seriousness of the offense and theoffender's felony convictions. The number of points an

offender receives for current and prior felonies variesaccording to certain rules.

Vehicle Prowling. A person is guilty of vehicleprowling in the second degree if, with intent to commit acrime against a person or property, he or she enters orremains unlawfully in a vehicle, other than a motorhome, or a vessel. Vehicle prowling in the second degreeis a gross misdemeanor offense. A gross misdemeanoroffense is punishable by imprisonment of not more thanone year in jail, or by a fine of not more than $5,000, orboth. Generally, gross misdemeanor offenses do notcount as part of an offender's score when calculating hisor her standard sentence range.

Motor Vehicle Theft. A person is guilty of theft (ofa motor vehicle) in the first degree, if such person com-mits theft of property or services that exceed $1,500 invalue other than a firearm. Theft in the first degree isranked as a seriousness level II, class B felony offenseunder the SRA, which for a first-time adult offender hasa standard sentence range of zero to 90 days in jail.Under the Juvenile Justice Act (JJA), the offense is a cat-egory B offense and a first-time juvenile offender wouldreceive a local sanction. Local sanctions consists of amaximum of 30 days in detention, 12 months of commu-nity supervision, 150 hours of community restitution,and a $500 fine.

A person is guilty of theft (of a motor vehicle) in thesecond degree, if the person commits theft of a motorvehicle valued at $1,500 or less. Theft in the seconddegree is ranked as a seriousness level I, class C felonyoffense under the SRA, which for a first-time adultoffender has a standard sentence range of zero to 60 daysin jail. Under the JJA, the offense is a category C offenseand a first-time juvenile offender would receive a localsanction.

Possession of a Stolen Vehicle. A person is guilty ofpossession of stolen property in the first degree if he orshe possesses stolen property (or a vehicle) that exceeds$1,500 in value. Possession of stolen property in the firstdegree is ranked as a seriousness level II, class B felonyoffense under the SRA, which for a first-time adultoffender has a standard sentence range of zero to 90 daysin jail. Under the JJA, the offense is a category B offenseand a first-time juvenile offender would receive a localsanction.

A person is guilty of possession of stolen property inthe second degree if he or she possesses stolen property(or a vehicle) valued at $1,500 or less. Possession of sto-len property in the second degree is ranked as a serious-ness level I, class C felony offense under the SRA, whichfor a first-time adult offender has a standard sentencerange of zero to 60 days in jail. Under the JJA, theoffense is a category C offense and a first-time juvenileoffender would receive a local sanction.

Taking A Motor Vehicle Without Permission. Aperson is guilty of taking a motor vehicle without per-mission in the first degree if the person intentionallytakes a motor vehicle without permission and he or she: • alters the vehicle to change its appearance or identi-

fication numbers; • removes parts from the vehicle with the intent to sell

the parts; • exports or attempts to export the vehicle out-of-state

or out of the country for profit; • intends to sell the vehicle; or • is engaged in a conspiracy that has as its objective

the theft of motor vehicles for sale to others forprofit.Taking a motor vehicle without permission in the

first degree is ranked as a seriousness level V, class B fel-ony offense under the SRA, which for a first-time adultoffender has a standard sentence range of six to 12months in jail. Under the JJA, the offense is a categoryC offense and a first-time juvenile offender wouldreceive a local sanction.

Taking a motor vehicle without permission in thesecond degree occurs when a person intentionally takesa motor vehicle without permission or voluntarily ridesin a vehicle knowing it was taken without permission.

Home Detention. Home detention is a program ofpartial confinement available to offenders where theoffender is confined in a private residence subject toelectronic surveillance. Generally it may not be imposedfor offenders convicted of such offenses as a violentoffense, drug offense, sex offense, or certain assaultoffenses.

Theft of Rental, Leased, or Loaned Property. Underthe Theft and Robbery Act, a person who, with intent todeprive the owner, wrongfully obtains, exerts, or gainsunauthorized control over personal property that isrented or leased to the person is guilty of theft of rental,leased, or lease-purchased property. It is a seriousnesslevel II, class B felony offense if the property is valued at$1,500 or more. It is a seriousness level I, class C felonyoffense if the property is valued between $250 and$1,500. It is a gross misdemeanor offense if the propertyis valued at less than $250.

The statute does not expressly include loaned prop-erty.

Traffic Infractions. Generally a traffic infraction is anon-criminal offense. The penalty for a traffic infractionmay include a financial penalty or sanctions against theperson's driver's license including suspension, revoca-tion, or denial. The base penalty for a traffic infraction,ranging from $37 to $500, is established by court rule.In addition, other statutory penalties and fees may apply.

Summary: The act known as the Elizabeth Nowak-Washington Auto Theft Prevention Act provides forincreased penalties and triple scoring of prior motorvehicle-related offenses (theft, possession of a stolen
