SUPPLEMENT TO MOTION TO STRIKE PORTIONS OF DOE'S BRIEF
In accordance with 10 c.F.R. § 2.323, the undersigned certifies that he has tried to
contact counsel for DOE (Donald P. Irwin, Esq., Hunton & Williams) beginning the afternoon of
September 20,2004 and continuing through 4:30 PM on the afternoon of September 21,2004 to
determine if DOE would agreed to the deletions requested by the State of Nevada in its Motion
to Strike Portions of DOE's Brief. The State of Nevada was unable to contact DOE counsel
during this period. This Supplement is timely filed under 10 C.F.R. §§ 2.1015 (b) and 2.1017
(adding one additional day for filing whenever the triggering event is service, here service of the
DOE brief).
