No7. 1 Beforeeach general election of the membersof Seanad Eireann to be electedfrom panels of candidates, five panels of candidates shall be formed in the manner provided bylaw containingrespectively the names of persons having knowledgeand practical experience ofthe following atingBeinterests and services, namely: |",Tfi(

FrolThe professional interestsreferred to in Article18.7.1 have been defined by section3(2) of theSeanad bynomin

(b) medicine, including surgery, dentistry,veterinary medicine,and pharmaceutical chemistry.

B. ELECTION FOR PANEL MEMBERS

Provisionis made bythe Act of1947 for the formationofthe following panelsof candidates inaccordancewithArticle18.7.1 ofthe Constitution:

(1) Culturaland Educational, l

(2) Agricultural,(3) Labour,

(4) Industrialand Commercial,and

(5) Administrative.

The Act also providesfor the division of each panel intotwosub-panels (i) the nominating bodies sub- panel and (ii)the Oireachtassub-panel; and forthe electionof Members from the panels and sub-panels Nnatas follows: t

Nominations to Provisional Nominating Bodies Sub-PanelCandidates may be nominated by the nominating bodies whosenamesappear on the Register of Nomin-

ating Bodies prepared under the Acts, revisedinJanuary-Marcheach yearand published in the "Iris Oifigi-il".The register applicableto the 1997GeneralElectionis reproducedon pages 45 and 48.

A completelist of the electorateis publishedinthe "IrisOifigiil"shortlyafterthe re-assemblyof Dilireann. The electorateconsistsof the members of the new Dil, the outgoing Seanadand everycouncilof a county or of a county borough.Eachnamecan be enteredonly once onthe electoralroll.

Nominations by the Taoiseach to Provisional Sub-Panels of CandidatesIf the number of persons onany provisional sub-panel does not exceed by at least two the maximum

number of members permitted to be elected therefrom, the Taoiseach is required tonominate additionalcandidates so that the numberof candidates willexceed the number of vacancies by two.This occurred inthe AgriculturalOireachtas Sub-Panel, the LabourOireachtas Sub-Paneland the Industrial and CommercialOireachtas Sub-Panel, in the 1997election (see Panels of Candidates pages 53, 55 and 58.)

Voting

Each voter receives5 ballot papers by registered post, i.e., one in respect of each of thefive panels. All ballot papers, whether all of themare marked or not, must be returned by registered post in theenvelope provided, togetherwith the formof declaration ofidentitywhich is furnished to the voter by the authorised person.

The ballot papers must be marked in the presence of an authorised person, namely, one of thefollowing:

(a) the Seanad Returning Officer;

(b) the ClerkofDilireann;

(c) the Clerk-Assistantof Seanad ireann;

(d) the Clerk-Assistantof Dilireann;

(e) the county registrar for the county or county borough in which is situate the premises the address of which is stated on the outer envelope;

(/) the sheriff(ifany) for the said county or county borough;

(g) in case the said premises is situate in a county, the managerunder the County Management Acts,1940 to 1955, for the county, and the secretaryto the council ofthe county;

(h) incase the said premises issituate in a county borough,the managerunder the Acts relating to themanagement of the county borough;

(/) the Superintendentof the Garda Sochna in whosedistrict is situate the said premises, or suchInspector of the Garda Sochna performingduties in that district as the Superintendent maynominate.

Counting of Votes

Therulesfor the countingofvotes are contained in theSecondScheduletothe Act of 1947, as amended,and are reproducedon pages 63 to 66.

Nomination of CandidatesEvery candidate must be nominated in writingona nomination paper subscribed by tworegisteredelec-

tors as proposer and seconder and by eightother registeredelectorsas assenting to thenomination.

ElectorateThe registerof electors in the case of eachUniversityis requiredto be revisedannuallyin accordance

withthe Seanad Electoral(UniversityMembers)Acts,1937to 1973.Everycitizenof Ireland being18yearsof age or over who has received a degree (otherthanan honorarydegree) intheUniversityconcerned,or in the case of the Universityof Dublin,hasobtaineda foundationscholarshipor (beinga woman)a non-foundation

scholarshipis entitledto be registeredas an elector.

VotingA ballot paper is sent by post by the returningofficerconcernedto each personon the register of electors.

The electormarksthe ballot paper and returnsit by post togetherwitha formof declarationofidentitydulymade and completed by him.

Five of these vacancies related to the members nominated by the Taoiseach and were filledsubsequently by the Taoiseach nominating

Tom Berkery, NiamhBhreathnach, NiamhCosgrave, Michael Enright, Aidan O'Connor.

In additionto the nett 11 vacancies ofthe elected Senators eightdid not stand for re-election

Michael Calnan, John Dardis, Ann Gallagher, Cathy Honan, Mary Kelly,Joe Lee, Sam McAughtry, Jan O'Sullivan.

John Dardis was returnedsubsequentlyas a nominated Senator.

General Election 1997 turnoverin membershipIn the Seanad General Election 10 outgoingSenators failed to bere-elected (four wereoutgoing nomi-

nated Senators).Tom Fitzgeraldwas returnedsubsequentlyas a nominated Senator.

In the Seanad constituted after the General Election,29 outgoingSenators retained their seats i.e. through

election or nomination. There were 32new membersof whom18 were members of the Houses of theOireachtas for the first time, 8 had beenmembersofthe 27thDail and 6 had been members of former Seanads.
