On July 31, 1951, the Confederated Tribes o i the Colville Reser- : .- vation (hereinafter sometimes called "Confederated Tribes") filed a petition in Docket No. 177 alleging various claims. On the same day the Confederated Tribes as well as individual representative petitioners, on behalf of certain constituent tribal groups of the Confederated Tribes, filed a petition in Docket No. 181 alleging various other claims. Sub- sequently, pursuant to order of the commission dated January 3, 1956, the petitioners in Docket No. 181 filed an amended petition in Said Docket No. 181, and also filed separate amended petitions in Docket Nos, 181-A, .-- 181-B and 181-C alleging certain claim which were severed from the original petition in Docket No. 181. 2. The Confederated Tribes of the Co1ville Reservation is an organization recognized by the Secretary of the Interior as having the authority to represent the Indians enrolled on the Colville Reservation in the State of Washington.

2 . The Confederated Tr ibes of the Co1vi l le Reserva t ion is an

o r g a n i z a t i o n recognized by the S e c r e t a r y of the I n t e r i o r a s having the

a u t h o r i t y to r ep re sen t the Indians en ro l l ed on the C o l v i l l e Reserva t ion

i n t he S t a t e of Washington.

Among the Indians enrolled on the C o l v i l l e Reservation a r e descendants

of members of the abor ig inal Lake, C o l v i l l e , San P o i l , Nespelem, Okanogan,

and Methow t r i b e s a s w e l l a s c e r t a i n o t h e r t r i b e s .

3. I n the aforesa id amended p e t i t i o n i n Docket No. 181, claims were

presented f o r compensation f o r the taking by defendant of those port ions

of the Indian t i t l e lands of the Lake, C o l v i l l e , San P o i l , Nespelem,

Okanogan and Methow t r i b e s which l a y o u t s i d e of the boundaries of the

Co lv i l l e Reservation a s es tabl i shed by Executive Order o f J u l y 2, 1872.

The prosecution of these claims resu l t ed i n a f i n a l judgment entered by

the Commission on March 1, 1960, making awards t o s a i d t r i b e s i n the

aggregate amount of $1,000,000 a f t e r deduction of o f f s e t s . (8 Ind. C l .

Corn. 420). No claims were made i n sa id amended p e t i t i o n i n Docket No.

181 with respect to t r i b a l lands ly ing wi th in the C o l v i l l e Reservation.

4. I n Docket Nos. 181-A, 181-B and 177 a s well a s i n severa l o the r

proceedings pending before the Commission, claims a r e presented on behal f

of the Confederated Tr ibes a l l eg ing var ious wrongs on the p a r t o f the

defendant which pe r t a in general ly to the lands which were encompassed

wi th in the Co lv i l l e Reservation a s es tabl i shed on J u l y 2, 1872. As a l leged

i n the p e t i t i o n i n Docket No. 177 a n d ' i n the amended p e t i t i o n s i n Docket - - Nos. 181-A and 181-B, a number of events gave r i s e t o the so-cal led

" rese rva t ion land claims" asser ted there in .

5. I n Docket No. 181-A, p e t i t i o n e r s claim as fol lows: There was a

group o f t r i b e s under the leadership of Chief Moses t h a t res ided dur ing

the e a r l y 1880's on the Columbia Reservation i n the S t a t e of Washington.

Th i s group of t r i b e s included (1) the Columbia, ( 2 ) Chelan, (3) E n t i a t and

(4) Wenatchee. The Colu2bia Reservat ion was establLshed by Execat ive

Order of Apri l i 9 , 1879, a s amended by E x ~ c u t i - ~ e Orders or' March 6 ,

1880, and Febraary 23 , 1883, f o r the perrranent use and occupancy of Chief

Moses and h i s people, and such o t h e r f r i e c d i y Ind ians a s may e l e c t t o

s e t t l e thereon with h i s consent and t h a t of t he S e c r e t a r y of t he I n t e r i o r .

On Ju ly 7 , 1883, an Agreement was made iri Washingtcn, D . C . , s igned by t h e

Sec re t a ry of the I n t e r i o r and the Coimiasioner of I r d i a n A f f a i r s , which con-

ta ined a provis ion t h a t , i f the Chief M x e s group of t r i b e s and o t h e r

Ind ians who were then r e s id ing on the Colunbia Reserva t ion moved t o t h e

C o l v i l l e Reservat ion, the United S t a t e s would secu re t o Chief Moses and

h i s people e q ~ a l r i g h t s alLke wi th a l l o t h e r Ind ians now on t h e C o l v i l l e

Reserva t ion . This agreement was r a t i f i e d by the Act of Cangress of J n l y 4 ,

1884 ( 2 3 S t a t . 76, 7 9 - 3 0 ) . Subsequently, s t a r t i n g i n o r about 1886, members

of t h e Chief Moses t r i b a l groups were mved t o t h e C o l v i l l e Reserva t ion .

Also, dur ing the same period a f yea r s , the Government mved t o t h e C o l v i l l e

Reserva t ion , members of the Joseph aand of Nez Perce Ind ians and mernbers of

t h e Pa lus Tr ibe . Except f o r c e r t a i n a l l o t t e d t r a c t s , t h e Columbia Reser -

v a t i o n w a s r e s to red to the publ ic Zomain by Execut ive Order of May 1, 1886.

The p e t i t i o n e r s ' claims i n Docket No, 181-8 a r e based on t h e c o n t e n t i o n

that t he defendant ino~ed the t r i b a l group and o t h e r groups t o t h e

C o l v i l l e Res2ruat ion t o serve i t s own purposes and i n t e r e s t s , and t h a t s i n c e

no compensation was paid by the defendact t o t he p e t i t i o n e r t r i b e s t h a t h e l d

a . With r e s p e c t t o the f i r s t of sa-d claims i n Docket No. i81-B, the

p e t i t i o n e r s p re sen t t he following: The C o l v i l l e Reservat ion, a s e s t a b l i s h e d

i n Ju ly 1872, coxprised about 2,900,000 ac re s . Except f o r c e r t a i n 80 a c r e

a l l o tmen t s t o i nd iv idue l I n d i a n . ~ , the so-ca l led "North Half" of t h e Reser-

va t ion was ceded t o t h e United S t a t e s by ar, Agreement which was made wi th

t h e Ind ians of t h e Reservat ion on May 9 , 1891. The United S t a t e s agreed

t o Pay $1,5OO,000 f o r the Lands of the North Half . The Agreement provided

t h a t i t was t o go i n t o e f f e c t a f t e r i t s r a t i f i c a t i o n by Congress. However,

by t h e Act of J u l y 1, 1892 (27 S t a t . b2) , Congress opened t h e North Half t o

s e t t l e m e n t w i thou t r a t i f y i n g the Agreeinent and withouc provid ing f o r t he

payment of t h e $1,500,000. Subsequently, by the Act of June 21, 1906

(34 S t a t . 525, 377-378), f o r t he purpose of car ry ing i n t o e f f e c t t h e 1891

Agreement, Congress d i r ec t ed t h a t $1,500,000 be s e t a s i d e i n t h e Treasury

f o r t h e u s e and b e n e f i t of th.e Indians of the C o l v i l l e Rese rva t ion i n f u l l

payment f o r t h e ceded North Half . The rea f t e r , pursuant t o t h e Act of June

21, 1906, and by way of r a t i f y i n g the 1891 Agreement, Congress app ropr i a t ed

$1,500,000 i n f i v e successive in s t a l lmen t s of $3C0,000 each under each of

f i v e Acts of Congress, na.mely Act of March 1 , 1907 (34 S t a t , 1015, lO5O),

Act of A p r i l 30, 1908 (35 S t a t . 70, 9 6 ) , Act of March 3 , 1909 (39 S t a t . 781,

8131, Act of A p r i l 4 , 1910 (36 S t a t . 269, 286), Act of March 3 , 1911 (36 S t a t

a l s o a r i s e ou t of the Act of 1"lrch 22 , 1906 (34 S t a t . 801, a c t h c r i z i n g t h e

s a l e of su rp lus lands of the South Half of t h e Reservat ion. P e t i t i o n e r s

a l l e g e a c t s whereby the defendant reduced the p r i c e s t o be pa id f o r t h e

s u r p l u s lands below the appraised p r i c e s and p c s t p o ~ e d t h e t i x e f o r payment

f o r t he surp lus lands, and p e r n i t t e d e n t r y ~ e n to use and have the b e n e f i t

of s u r p l u s lands withoxt ndcing paymeat t he re fo r . The C o l v i l l e Confederated

T r i b e s r e l y on the p r c v i s i o ~ of Secti-on 9 of t he Act of March 22, 1906,

On August 7 , 1967, a copy of the n o t i c e was mailed t o a l l e n r o l l e d a d u l t

members of t h e Confederated Tr ibes t o t h e i r l a s t known addresses . Also, a

copy of t he n o t i c e was published i n the i s s u e of t he T r i b a l Tr ibune da ted

August 7 , 1967, which was mailed t o most t r i b a l f a m i l i e s . F u r t h e r , t h e

12. The proposed o f f e r of s e t t l emen t was presented t o t h e members of

t he Confederated Tr ibes a t the scheduled meeting. he ld on August 19 , 1967,

i n the Nespelem School a t Nespelem, Washington. A t t h e meeting a copy of

a d e t a i l e d w r i t t e n r e p o r t of t he a t t o rneys concerning t h e proposed s e t t l e -

ment was d i s t r i b u t e d . t o each person. Claims a t t o r n e y s Abe W . ~ e i s s b r o d t

and Lyle Kei th were present a t the meeting and gave a d e t a i l e d o r a l r e p o r t

on t h e proposed se t t lement , expla in ing i t s terms and recommending t h a t i t

be accepted by the Confederated Tr ibes . The t r i b a l members were g iven f u l l

oppor tun i ty t o a sk questions and the re was a f u l l and f r e e d i s c u s s i o n of

t he proposed se t t lement . A vo te was taken and t h e r e s u l t o f t h e v o t e was

242 i n f avo r of acceptance of the se t t l emen t and 10 opposed.

13 . Also, on August 19, 1967, pursuant t o n o t i c e s duly g iven , a

meeting of the C o l v i l l e Business Council , t h e governing body of t h e C o l v i l l e

Confederated Tr ibes , was held. A l l f ou r t een members of t h e Business Counci l

a t t ended t h e meeting. By appropr ia te r e s o l u t i o n , t h e Business Counci l vo ted

i n open meeting t o accept the proposed s e t t l e m e n t , t h i r t e e n i n f avo r , and

none opposed. The Resolution of t he Business Council (Se t t lement E x h i b i t E)
