16 November 2020 Tēnā koe Your Official Information Act request, reference: GOV-007400 Thank you for your email of 18 October 2020, asking for the following information, which we are responding to under the Official Information Act 1982 (the Act): I'm interested in data on the number and cost of claims to ACC for adventure tourism in the last five years. I'd be interested to know: how many claims have been made each month if possible with a break down of industries or activities (hang gliding, skiing etc) the countries of residence of the claimants (NZ v overseas) the costs of the claims, totals and broken into bands if possible please the top five most expensive for each year and any detail that can be provided with these Our response Unfortunately, ACC does not record claims under the designation ‘Adventure Tourism’. To provide you information relevant to your request, we have retrieved data for sport activities that we identify as ‘adventure-related’. This is because the data set available to ACC is reliant on the information provided on an ACC45 injury claim form, which is completed when a person seeks treatment for their injury. There is a free-text field ‘accident description’ on the form where a person can provide a brief description of how their accident happened. This field is not mandatory to complete and not every client does so. Also, when the field is completed there is considerable variation in the way accidents are described. The data in the attached spreadsheet was extracted for claims where the key words used in the field were adventure sport related. ACC identifies claims as adventure sport related when flagged as one of the following sports: Cycling, Mountain Biking, Tramping, Trail Biking, Motocross, Waterskiing, Skiing- snow, Snowboarding, Luge Riding, Rock Climbing, Kayaking, Mountaineering, Parachute Jumping, Windsurfing, or Bungee Jumping. Similarly, there is no specific industry classification for adventure tourism. Therefore, we cannot identify work-related claims. To provide you the most relevant information ACC holds, we have used the industry classifications of ‘Amusement and other recreation activities (not elsewhere classified)’ and ‘Alpine and White-Water recreation activities’. You can find out more about what these classifications contain here on page 125-126. Due to the limitations above, while largely representative of the claims received by ACC, the data should not be considered a complete, definitive measure of the claims related to adventure related accidents that ACC received during the period covered by this response. Please find the information you requested in the attached excel spreadsheet.

Tēnā koe Your Official Information Act request, reference: GOV-007400 Thank you for your email of 18 October 2020, asking for the following information, which we are responding to under the Official Information Act 1982 (the Act): I'm interested in data on the number and cost of claims to ACC for adventure tourism in the last five years. I'd be interested to know:

• how many claims have been made each month if possible • with a break down of industries or activities (hang gliding, skiing etc) • the countries of residence of the claimants (NZ v overseas) • the costs of the claims, totals and broken into bands if possible please • the top five most expensive for each year and any detail that can be provided with these

Our response Unfortunately, ACC does not record claims under the designation ‘Adventure Tourism’. ACC identifies claims as adventure sport related when flagged as one of the following sports: Cycling, Mountain Biking, Tramping, Trail Biking, Motocross, Waterskiing, Skiing-snow, Snowboarding, Luge Riding, Rock Climbing, Kayaking, Mountaineering, Parachute Jumping, Windsurfing, or Bungee Jumping.

Overseas residents cannot be accurately identified ACC only collects sufficient information to make a cover decision on a claim. We do not require a person to state their citizenship status, their immigration status, or their nationality. These limitations mean that, while largely representative of the claims received by ACC, the data provided in Table 4 should not be considered a definitive measure of the claims ACC received from overseas tourists, or visitors, in the relevant periods. The table only captures details for people who entered ‘overseas tourist’ in the ‘occupation’ field of the ACC45 claim lodgement form. ACC takes privacy seriously The top five most expensive claims for each year have not been provided, as this would be providing details about individual clients. Rather, the yearly average of the five most expensive claims have been included on Tab 2 of the attached spreadsheet. Also, ACC does not generally disclose data on claims where the number is fewer than four. Accordingly, we have used <4 where the claim count is between one and three. This limits the potential for particular individuals or matters specific to certain individuals being identified. These decisions are made under section 9(2)(a) of the Act. In doing so, we have considered the public interest in making the information available and have determined that it does not outweigh the need to protect the privacy of these individuals. Notes about the data • The data is for claims registered between 1 January 2019 and 30 September 2020, and that are

accepted for cover • Claims managed by an accredited employer are not included • This data was extracted on 29 October 2020 and may differ if re-run at a later point. Who to contact If you have any questions, please email them to [email protected]. If you are not happy with this response, you have the right to make a complaint to the Ombudsman. Information about how to do this is available at www.ombudsman.parliament.nz or by phoning 0800 802 602. Nāku iti noa, nā
