1. INTRODUCTION Terms of Instruction

1.1. This report has been commissioned by Storefield Aggregates Ltd in connection with land at Princewood Road, Corby.

1.2. It provides an update on the ecological mitigation proposals and ecological mitigation completed following the production of an Ecological Mitigation Plan dated August 2008 (Lockhart Garratt ref: 3183/C02/Ref 00-0009) (“the Original EMP”).

1.3. This updated Ecological Mitigation Plan (EMP) summarises the Original EMP and provides comments, communications and updates prepared since 2008.

1.4. The purpose of this EMP is to concisely describe the ecological surveys and mitigation already completed in connection with this site and the mitigation and management still to be implemented. This document is designed to satisfy the requirements of the outstanding planning condition 28 and revisions to planning condition 22 in connection with planning decision notice reference issued by Northamptonshire County Council, ref: 08/00067/WAS. Report Limitations

1.5. This is an ecological report and as such no reliance should be given to comments relating to buildings, engineering, soils or other unrelated matters. Qualifications

1.7. The land to the north of Princewood Road, Corby includes a redundant ironstone gullet consisting of grassland, scrub, bare ground and tall ruderal habitats (“the Site”). The Site is located at National Grid Reference SP 881 913 on the northern edge of Corby, adjacent to the Earlstrees industrial area.

1.8. The eastern portion of the Site abuts a designated Potential Wildlife Site (PWS) which supports areas of calcareous grassland currently undergoing encroachment by scrub.

1.9. The Site was cleared following planning approval in 2008 for restoration of the ironstone gullet with inert waste, to provide improved contours for the establishment of calcareous grassland and woodland (“the Proposed Works”). However, the pre-commencement works ceased in 2009 and the Site has not been worked since. As a result of the original Site clearance and subsequent non-intervention all habitats within the Site can be classified as colonisers, with only occasional scrub and trees retained from the Site in its original condition prior to the 2008/9 activity.

1.10. The Site location plan is presented at Appendix 1 with the red line boundary indicated as per the phase 1 habitat plan at Appendix 2.

2. ECOLOGICAL SURVEY SUMMARY 2007/2008 2.1. A series of ecological surveys of the Site have been completed. The surveys were undertaken to

support the original planning application 08/00441/COC relating to the restoration of the gullet with inert waste.

2.2. A list of the type of surveys completed and the dates of their completion are shown below;

June 2008 – Extended Phase 1 Habitat Survey / Desk Study October 2007 – March 2008 – Badger Survey (including bait marking) June 2015 – Bat Activity Survey March – June 2008 – Great Crested Newt Survey April – June 2008 – Reptile Survey

2.3. A more detailed summary of each assessment is provided in the sections which follow.

Extended Phase 1 Survey 2.4. The initial Phase 1 survey was carried out in June 2008. All habitats within the Site and adjoining the

same were mapped (see Appendix 2 for phase 1 plan). Although 11 different habitat types were identified over the course of the survey, the Site largely consists of two broad habitats; unimproved calcareous grassland and dense scrub. Further details of these habitats are set out below;

2.5. Unimproved calcareous grassland The area of unimproved calcareous grassland was extensive but varied widely in composition

between different areas. Grazing pressure by rabbit, and ground disturbance caused by illegal use of the Site by motor vehicles had created species rich areas of short grassland. Notable examples of these areas were found close to Pond 3 in the west of the Site (see TN 4 on plan at Appendix 2) and in several places along the gulley which runs through the centre of the proposed development area (TN 5 and 6 on plan at Appendix 2).

Species characteristic of a CG7d (Festuca ovina-Hieracium pilosella-Thymus praecox) community were abundant in these small areas. Notable examples include wild strawberry Fragaria vesca, autumn hawkbit Leontodon autumnalis, black knapweed Centuarea nigra, ploughman’s spikenard Inula conyza, glaucous sedge Carex flacca, fairy flax Linum carthaticum, eyebright Euphrasia sp., common valerian Valeriana officinalis, common birds foot trefoil Lotus corniculatus, yellow wort Blackstonia perfoliata and common century Centaurium erythraea.

These areas of short grassland represent a small proportion of the Site (approximately 6-7% by area). The largest area (TN4) is already intermingled with scrub and without direct management would eventually be lost, similarly the patches along the centre of the gully were suffering from illegal motorcycle access, frequent inundation by both scrub (particularly hawthorn Crateagus

monogyna) and dewberry Rubus caesius. The remaining areas of grassland were dominated by a mosaic of rough grasses, with occasional

scattered scrub and as a consequence were much less species rich. Wood small reed Calamagrostis epigeios was the most common grass species, with others including cocks foot Dactylis glomerata and tufted hair grass Deschampsia cespitosa distributed in small tufts towards the western boundary of the Site. Herbaceous species frequently recorded in these areas included white clover Trifolium repens, ribwort plantain Plantago lanceolata, creeping buttercup Ranunculus

repens, common nettle Urtica diocia and bristly ox-tongue Picris echioides. The areas of short, species rich grassland (TN4, 5 and 6) were of intermediate to high ecological

value. The rougher grassland characterised was of significantly less ecological value.

2.6. Dense scrub Two dense belts of scrub lined the banks of the Site to the north and south. Both belts contained a

mix of native species including hazel Corylus avellana, field maple Acer campestre, blackthorn Prunus spinosa, goat willow Salix caprea and dogwood Cornus sanguinea. Hawthorn was the most dominant species recorded.

A small number of mature trees were distributed across both belts of dense scrub. Species included, turkey oak Quercus cerris, grey willow Salix cinerea and ash Fraxinus excelsior.

Due to the density of the canopy and maturity of the belts of dense scrub the understory included several species commonly found in woodland. Dog’s mercury Mercuralis perennis, ground ivy Glechoma hederacea and wood false brome Brachypodium sylvaticum were common with small areas along the northern belt of scrub supporting a dense carpet of pleurocarpus moss overlaid by both common dog violet Viola riviniana and sweet violet Viola odorata. Overall the diversity of the ground flora under the majority of the scrub was relatively low.

Badger Survey 2.7. Two setts, A and B (see plan at Appendix 3) were identified by the initial walkover survey in October

2007. A bait marking survey using green and yellow markers was completed to establish whether the two setts were occupied by the same, or two different groups of badgers.

2.8. Yellow markers which were left at feeding stations around Sett A were found in all the latrines checked, including those in very close proximity to Sett B.

2.9. Green markers left at sites around Sett B appeared less frequently, but was noted in several latrines often mixed with yellow markers and in one latrine very close to Sett A.

2.10. The results of the bait marking survey suggested that both setts occur within a single badger clan’s territory as individual faeces containing a mix of yellow and green marker were found. Furthermore latrines located close to the entrances of both badger setts contained both yellow and green markers.

2.11. The presence of a large bedding ‘ball’ at Sett B with accompanying trails of fresh bedding leading to and down the entrances to the sett would suggest that Sett B is the main sett.

2.12. Sett A appeared to be the more active of the two judging by the frequency of yellow markers in all the latrines and levels of disturbance/usage noted around the various entrances each day. As the main sett (Sett B) is some distance from the Sett A and there does not appear to a connecting path between the two, Sett A is likely to be a ‘subsidiary’ sett. Bat Activity Survey

2.13. A single transect was completed in June 2008. 2.14. The majority of the bat passes recorded along the transect were located within the area of rough

grassland in the centre of the PWS. Several pipistrelle species Pipistrelle sp. were recorded foraging in this area.

2.15. At least two Daubenton Myotis daubentonii were recorded feeding for more than 20 minutes over the surface of ponds 1 and 2.

2.16. Towards the western boundary of the Site bat activity appeared to be less. 2.17. The survey did not detect any signs of roosting bats.

Great Crested Newt Survey 2.18. The three ponds selected for survey were visited six times between 24th April and 11th June 2008. 2.19. The presence of great crested newt Triturus cristatus smooth newt Triturus vulgaris was confirmed in

all three of the ponds surveyed. 2.20. The population size for great crested newts was classed as small (peak count of 10). 2.21. Ponds 1 and 2 also support a medium population of common toad Bufo bufo and common frog Rana

temporaria.

Reptile Survey 2.22. All 37 refugia were visited on seven separate occasions between 9th April and 5th June 2008. The

refugia were distributed across the entire footprint of the Site and encompassed all of the different habitats available (rough grassland with calcareous features and scrub).

2.23. The surveys confirmed a small population of common lizard Zootoca vivipara (with a peak count of 4) and a small population of grass snake Natrix natrix (with a peak count of 2).

3. LEGISLATION Badger

3.1. Badgers are protected specifically by the Protection of Badgers Act 1992. Although aimed primarily to protect badgers against baiting, of relevance to development matters is that under the Act it is an offence to wilfully kill, injure or take a badger, or attempt to do so.

3.2. Furthermore, it is an offence to damage, destroy or obstruct a badger sett, or disturb an animal whilst it is occupying a sett.

3.3. An offence is committed if such damage, destruction or significant disturbance arises from either a reckless or deliberate act. Bats

3.4. All species of Bat and their roosts are protected under the Wildlife and Countryside Act 1981 (as amended by the Countryside and Rights of Way Act 2000) and The Conservation (Natural Habitats, & c.) Regulations 1994. This legislation makes it illegal to kill, injure and disturb bats and also destroy active bat roosts (even if bats are not present).

3.5. Any works prescribed for the mature trees on site will need to consider potential roosting bats within suitable features of the trees. Breeding Birds

3.6. The Primary legislation affecting wild birds in England, Scotland and Wales is the Wildlife and Countryside Act 1981 (as amended). In January 2001 the Countryside and Rights of Way Act 2000 (CRoW) included amendments, which strengthened the law in England and Wales.

3.7. All birds, their nests and eggs, are protected by law and it is therefore an offence, with certain exemptions, to; Intentionally kill, injure or take any wild bird Intentionally take, damage or destroy the nest of any wild bird whilst in use or being built Intentionally take or destroy the egg of any wild bird Have in one’s possession or control an egg or part of an egg which has been taken in

contravention of the Act 3.8. In addition to the general protection afforded to birds, some rare breeding birds are further protected

by special penalties. These birds are listed in Schedule 1 of the Act and are usually referred to generically as Schedule 1 species.

3.9. It is an offence to; Intentionally (or recklessly (CRoW Act 2000)) disturb any Schedule 1 species while it is nest

building or is at, or near, a nest with eggs or young; or To intentionally disturb the dependent young of such a bird. Great Crested Newts

3.10. The legislation relating to the protection of great crested newts in Britain is contained within the Wildlife and Countryside Act (1981) and the Habitats and Species Directive (92/43/EC), enacted in the UK through the Conservation (Natural Habitats, &c.) Regulations (1994).

3.11. It is illegal to deliberately kill, injure, capture or disturb them or to obstruct their access to areas where they live and breed. These areas are also protected against damage or destruction. The law applies to all life stages of the species.

Reptiles 3.12. The legislation relating to the protection of the commoner reptiles (adder, grass snake, common lizard

and slowworm) in Britain is contained mainly within the Wildlife and Countryside Act (1981) as amended by the Countryside and Rights of Way Act (2000). Under the act it is an offence to; Intentionally (or recklessly) kill or injure commoner reptile species.

5. MITIGATION REVIEW 5.1. Based on the results of the ecological surveys undertaken in 2007 and 2008, the Original EMP set

out a range of mitigation measures to be implemented, brief details of which, are set out in Table 1.

5.2. As a result of the length of time that has lapsed since the original mitigation and commencement of the Proposed Works, the mitigation for the Site must be updated.

5.3. Further surveys, where applicable, and assessment of the condition of the habitats within the Site have been undertaken to provide recommendations for both short term and long term mitigation. Brief details of these are set out in Table 1.

5.4. The short term mitigation proposals should be read in conjunction with the Short Term Mitigation Plan 2015, which is presented at Appendix 4. As part of the Short Term Mitigation Plan, a habitat compensation area (a “HCA”) will be provided within the north-western section of the Site. The HCA includes grassland translocated in 2007 and 2008 (see Table 1 further details). The HCA also includes the establishment and maintenance of an agricultural grassland habitat and woodland along the north-eastern edge of the HCA. Further details on the short term mitigation are set out at section 6.

5.5. The long term habitat creation, restoration and enhancement recommendations are briefly set out in Table 1. These recommendations should be read in conjunction with the information provided at section 7 and also with reference to the Habitat Creation, Restoration and Enhancement Plan (“the Habitat Creation Plan”) at Appendix 7.

Amphibians

An EPS mitigation licence application from Natural England to trap and translocate amphibians from the construction area within the Site was obtained in 2009 Following receipt of the licence, amphibian fencing was constructed around the boundary of the Site. Pitfall traps and refugia were installed and the traps within the Site were checked for 30 days between 31st March 2009 and 30th April 2009 (see plan at Appendix 4 for location of fencing). One great crested newt (GCN) and 18 smooth newts were recovered during the 30 days. A number of common frogs and common toads were also recovered. All amphibians were relocated to the receptor site to the west of the Site (shown on plan at Appendix 4). The amphibian fencing was retained once the trapping period was completed to prevent amphibians repopulating the Site. As part of the terms of the EPS mitigation licence, hibernacula were constructed within the receptor site to increase sheltering an hibernation opportunities.

An updated GCN survey was completed on all ponds within 500m of the Site in 2015. See the pond survey plan at Appendix 5 for further details. Small populations of GCN were found to be present in Ponds 1, 3 and 4, (with peak counts of 4, 1 and 3 respectively). Smooth newts were also found to be present within these 3 ponds.

Pre-Construction The amphibian fencing has been retained following the 2009 trapping works, however, has fallen into disrepair. Any repairs and maintenance required must be completed prior to the commencement of construction work. A GCN method statement is to be implemented to ensure no harm comes to any amphibians that may be within the Site. The proposed method statement is set out at Appendix 6. During Construction The existing amphibian fencing must remain in place throughout the duration of the construction works. Post Construction The woodland creation and grassland management forming part of the HCA will provide additional foraging habitat for this species. Pond creation and restoration of grassland as per the Habitat Creation Plan at Appendix 7. Removal of the amphibian fencing should only take place once all construction and habitat creation works have been completed. The fence removal will need to be supervised by a suitably qualified ecologist.

Badgers Sett A, a subsidiary sett, was subject to a badger mitigation licence (Ref: WLM/2010/1313), which was granted by Natural England on 6th July 2010. The sett exclusion commenced in July 2010. Upon completion of the exclusion monitoring, Sett A was destroyed on 9th August 2010 using a 360 excavator under ecological supervision

Walk over surveys conducted in February 2016 by James Hildreth included an assessment of the Site and a 30m buffer of the Site (where access was possible) for current badger activity. There were no setts within the Site recorded during these surveys.

Pre-Construction Precautionary badger survey 6 weeks ahead of works commencing. Installation of boundary fencing to avoid construction creep in to woodland habitats which may be used by badgers during the construction phase. A buffer of 10m should be provided between the construction area and the woodland edge.

Reptiles Reptiles were trapped and translocated from the Site as part of the GCN trapping works. During the 30 day trapping period 9 common lizards were trapped and translocated to the north of the Site outside of the amphibian fencing.

No further surveys have been conducted since 2008.

Pre-Construction The amphibian fencing has been retained following the 2009 trapping works, however, has fallen into disrepair. Any repairs and maintenance required must be completed prior to the commencement of construction work. The phased vegetation removal as set out in the GCN

method statement (at Appendix 6) will also benefit reptiles and should be implemented to ensure no harm comes to any amphibians that may be within the Site. During Construction The existing amphibian fencing must remain in place throughout the duration of the construction works. Post Construction The woodland creation and grassland management forming part of the HCA will provide additional foraging habitat for this species. The woodland and pond creation as per the Habitat Creation Plan at Appendix 7 will provide additional foraging habitat for this species.

Unimproved grassland

During 2007 and 2008 several areas of species rich short grassland within the Site was translocated to the HCA (see plan at Appendix 4) to fulfil Condition 5 of the Planning Permission. The donor site and receptor site are shown on the short term mitigation plan at Appendix 4.

Walk over surveys conducted in February 2016 by James Hildreth included an assessment of the grassland within the Site. No unimproved grassland remains on site (within the amphibian / reptile fenced area) and reflects that translocation moved the grassland to the HCA in 2008 The grassland has been grazed by sheep since the relocation as a form of management.

Pre-Construction Retain maximum available area of existing grassland and protect from construction area using protective fencing. During Construction Maintain the existing area of translocated grassland within the HCA using suitable rotational cutting to encourage species diversity. Pernicious weeds should be removed. Post Construction The grassland creation as per the Habitat Creation Plan at Appendix 7 will provide an increase in grassland species diversity. Rotational cutting and maintenance of the grassland should be completed to maintain this species diversity.

6. SHORT TERM MITIGATION PROPOSALS 6.1. The following proposals should be considered in conjunction with the Short Term Mitigation Plan at

Appendix 4.

Habitat 6.2. Grassland – The HCA comprises the unimproved grassland community translocated in 2009 and an

agricultural grassland pasture. 6.3. The agricultural grassland has historically been managed with the use of sheep grazing. It is

recommended that this continues to provide structural diversity to the sward. 6.4. Woodland – A woodland buffer to the adjacent semi-natural woodland will be created and provide a

structured edge of woody shrubs. The planting pattern will aim to produce scalloped edges which will create sheltered glades for invertebrates (e.g. common blue butterfly) and a range of scrub structures for locally known breeding bird species (e.g. willow warbler and whitethroat).

6.5. This buffer will provide connectivity to the woodland to the north of the Site. 6.6. Waterbodies – The existing waterbodies should be protected with the use of habitat buffers, which will

be less intensively managed. The retained sections of grassland around Pond1 (see plan at Appendix 5) will be subject to a less intensive management scheme. These areas will fall outside of the grazing area within the HCA and will be left to develop naturally. These areas of retained rough grassland to the west of the Site will encourage establishment of wood small-reed and will link to the existing areas continuing to provide shelter and foraging opportunities for many species. Amphibians

6.7. Although the impact to great crested newts (GCN) is considered to be low, it is recommended that the GCN method statement is implemented to ensure no harm comes to any amphibians that may be within the Site (The proposed method statement is set out at Appendix 6). The method statement prescribes a schedule of phased vegetation clearance to minimise the risk of injury to GCN and common amphibians.

6.8. The amphibian fencing must remain in place throughout the entire construction period and during the restoration works that follow.

6.9. Site workers are to remain vigilant in sticking to the working area and avoiding damaging and monitoring / repairing the fence throughout the construction period and a toolbox talk should be provided prior to the commencement of the Proposed Works.

6.10. The toolbox talk should be based upon the Site Induction / Construction Management Plan at Appendix 8. This document should also be displayed within any site office.

6.11. The toolbox talk will explain and re-inforce the importance of maintaining the amphibian fencing. Any tears or breaches in the fence should be reported immediately to the ecologist and repaired by construction staff, where possible,

6.12. The amphibian fencing should be checked on a regular basis (e.g. fortnightly) by a suitably qualified ecologist. Badgers

6.13. A precautionary badger survey should be undertaken by a suitably qualified ecologist, 4 weeks ahead of the Proposed Works commencing. In the event that there is evidence of badger activity either within the construction area, or within 30m of it, the ecologist will make relevant recommendations as to protection measures for the Site.

6.14. Boundary fencing should be installed around the construction area to avoid construction creep. A buffer of 10m should be provided between the construction area and the woodland edge to the north of the Site to provide a Wildlife Corridor. The Wildlife Corridor will minimise any disturbance to animals using this habitat including badgers.

6.15. Construction staff are to remain vigilant regarding all wildlife throughout the period of the Proposed Works and a toolbox talk should be provided prior to the commencement of construction detailing potential signs of badger use within the Site, e.g. holes dug within mounds of spoil.

6.16. The toolbox talk should be based upon the Site Induction / Construction Management Plan at Appendix 8. This document should also be displayed within any site office.

6.17. Throughout the Site, excavations should be closed overnight. If excavations must be left open overnight they should have one sloping side, or be fitted with a suitable ramp, to allow foraging badgers and other fauna that might enter the works to escape safely. Bats

6.18. No bat roosts have been confirmed within the Site and suitable roosting features are limited, however, bats have been confirmed as using the ponds to the east of the Site for foraging and are likely to be using the linear feature of the cutting for foraging and commuting.

6.19. Therefore during the Proposed Works any use of lighting will be installed to avoid light spill into the adjacent woodland to the north and the ponds to the east. In addition, there should be an avoidance of night working and no lighting of the site after restoration is complete.

6.20. Any essential lighting will incorporate directional and baffled lighting and motion sensors and other methods of reducing disruptive light spill. The requirement for lighting should be minimal as there will be no night working.

6.21. The HCA will provide additional foraging habitat through the improvement of Pond 1 (see plan at Appendix 5), linear scrub and tree planting and enhancement of the grassland swards. Breeding Birds

6.22. To reduce the likelihood of breeding bird conflicts arising during the Proposed Works all significant vegetation clearance works (e.g. removal of trees and scrub) should be scheduled outside of the bird breeding season (March to August inclusive).

6.23. Where small scale vegetation clearance is required during the bird breeding season, the vegetation should be checked by a suitably qualified person to assess the presence of bird nests and if present whether the nest is in current use. Particular attention should be paid to low lying vegetation, which could be used by ground nesting birds such as lapwing Vanellus vannellus and skylark Alauda

arvensis. This is likely to include bird surveys, direct searching and supervision of clearance works if permitted to proceed.

6.24. To mitigate for the temporary loss of foraging and breeding habitat within the construction area, the HCA will provide additional grassland habitat along with a woodland buffer. This should provide a variety of foraging and nesting opportunities for farmland and woodland bird species. Invertebrates

6.25. An invertebrate species of local importance has been identified as the Concolorous moth Chortodes

extrema. Local records of this species are limited with the nearest record being some 4.5 km to the east of the Site. The primary habitat for this species is woodland (with historic strong-holds in the county being Rockingham Forest woodlands, Nasborough, Salcey and Yardley).

6.26. The Site does not support the primary habitat for this species but does support small areas of the foodplant (in the western section of the Site), wood small-reed. However, wood small-reed dominated grasslands are widespread in the surrounding area with extensive grasslands extending to the west, south and east of the Site. The adjacent Rockingham Wood and Brookfield Plantation to the east also support wood small-reed within grassland rides and woodland compartments.

6.27. The grassland areas in the HCA will provide a refuge for this and other invertebrate species in order to minimise any potential impacts. The rough grassland around pond 1 (see plan at Appendix 5) will also provide suitable habitat for similar invertebrate species. Reptiles

6.28. The impact to reptiles is considered to be low, however, it is recommended that the GCN method statement is implemented as this will also ensure no harm comes to any reptiles that may be within the Site. (The proposed method statement is set out at Appendix 6). The method statement prescribes a succession of phased vegetation clearance, which will sensitively remove vegetation and minimise the risk of any injury to reptiles.

6.29. Any reptiles found as a result of the vegetation clearance should be relocated outside of the construction area and amphibian fencing.

6.30. The amphibian fencing should be maintained at all times during the construction period. 6.31. Site workers are to remain vigilant throughout the construction period and a toolbox talk should be

provided prior to the commencement of the Proposed Works. The toolbox talk should be based upon the Site Induction / Construction Management Plan at Appendix 8. This document should also be displayed within any site office.

6.32. The toolbox talk will explain and re-inforce the importance of maintaining the amphibian fencing. Any tears or breaches in the fence should be reported immediately to the ecologist and repaired by construction staff, where possible,

6.33. The amphibian fencing should be checked on a regular basis by a suitably qualified ecologist. 6.34. The translocated grassland and agricultural grassland within the HCA will provide suitable foraging

and sheltering habitat for reptiles along with basking opportunities in less dense areas of vegetation.

7. LONG TERM MITIGATION PROPOSALS 7.1. The following proposals should be considered in conjunction with the Habitat Creation Plan at

Appendix 7.

Habitats

Grassland 7.2. Overview - Once the Proposed Works have been completed the construction area is to be restored to

provide an area of grassland. 7.3. This large area of replacement grassland in the restored areas will link the HCA in the north west to

the PWS grasslands to the east. This should allow natural colonisation from the HCA including the translocated grassland areas.

7.4. The proposed new grassland areas would be achieved ideally through natural colonisation of a thin mineral soil surface of the infill material with supplementary seeding using similar seed mixes if required. Low level sheep grazing will be implemented to achieve a managed sward.

7.5. The steep southern slope of the restored land would be outside of the grazing area and it is considered that rabbit grazing will maintain the grasslands on the gradient (similar to the situation on the current PWS).

7.6. A further area of grassland will also be outside of the main grazing area (eastern portion of the Site) and this area would merge with the adjacent important grassland areas within the PWS.

7.7. Establishment - Soil sampling of the proposed grassland area will confirm the existing texture, nutrient and pH status of the soil. Sampling to be carried out as per Natural England guidance note (NE Technical Note TIN035, TIN036 and TIN066). Based on the findings of the sampling, the appropriate seed mix is to be chosen.

7.8. Following selection of the appropriate seed mix, the existing grassland sward is to be cultivated. To minimise potential conflicts with ground nesting birds or reptiles, self-established vegetation is to mown in three stages, over a period of two weeks (200mm down to 50mm) during early spring or late summer period (February – March, August to October inclusive). Prior to the first cut, a check for ground nesting birds should be made.

7.9. Once closely mown, the existing sward is to be cultivated. Cultivation is to include the use of a tractor mounted chain harrow to break up the existing ground and provide barer patches suitable for over seeding. The harrowing should be completed using a tractor (fitted with low pressure tyres) with the soil harrowed to no more than 50-75mm depth. Target will be to create a minimum 50% bare ground across the surface of the existing vegetation. Once harrowed the area is to be stone picked and prepared so as to create a seed bed comprising of a fine tilth.

7.10. Once cultivated the ground is to be over-seeded with the selected grass mix, likely at a rate of 8g/m2

(but determined by suppliers instructions). Seed is to be applied as per suppliers’ guidance during a suitable establishment period (March – May, Sept-Late Oct) and following the procedure detailed within Natural England’s Technical Note (TIN045). The grass should be sown with a tractor employing low pressure tyres fitted with suitable equipment (e.g. fertiliser spreader, grass seed box). Once sown the areas are to be lightly rolled.

7.11. Aftercare - Slug activity is to be noted every 4 weeks after sowing. Where evidence of slug activity is noticeable the sown grassland should be Cambridge rolled. Towards the end of the first growing season (e.g. September-November) after sowing, the grass is to be mown to a height of 100mm with the arisings removed. A further cut, with arisings removed may be required the following spring, although this will dependent upon growth exceeding 80mm. Any pernicious weeds (e.g. ragwort, dock species) are either to be hand pulled, or spot sprayed using a suitable herbicide. Weed control should

ensure ground cover of weed species (e.g. common nettle Urtica dioica, ragwort and dock species) is below 5%.

7.12. Any gaps or areas of ground (above 5-10% threshold) where the grassland mix failed to establish are to be weeded, re-cultivated and over seeded with the same meadow mix.

7.13. Short to Medium term Management - A programme of annual mowing and removal of arisings supplemented by regularly mown paths is to be established. During years 1 and 2 additonal mowing may be beneficial to reduce weed establishment. If weed establishment is widespread then 2-4 cuts will be completed each year at a height of approximately 100m to reduce weed vigour while not adversely affecting grass and wildflower growth.

7.14. Annual ‘hay-cut’ mowing will be undertaken with removal of arisings (as hay using standard agricultural methods wherever possible) as the transition from establishment to established and stable habitat is completed. This will then transition to occasional cuts in conjunction with a sheep grazing regime.

7.15. Paths a maximum of 1.5m are to be mown on a monthly basis during the main growing season, with the sward to be maintained at approximately 50mm height. Arisings are to be removed as part of these works and used to form / supplement refugia piles adjacent to the swale in the north-western corner –

7.16. Long term Management – Sheep grazing will be used as the primary method to manage the grassland. Stocking levels are to be monitored and altered based on the sward height being achieved. To deliver meadow grassland it is likely that the best results will come from grazing September to March inclusive with no grazing or very low stock level grazing April to August. This will allow grasses and wildflowers to grow, flower and seed.

7.17. The sward is to be checked annually in late July/early August for pernicious weeds (e.g. ragwort, dock species). With these plants either hand pulled, or spot sprayed using a suitable herbicide. Weed control should ensure ground cover of weed species (e.g. common nettle, ragwort, dock species) is below 5%.

7.18. Supplementary mowing may be used to remove a hay crop and / or reduce grass height for re-introduction of sheep grazing. This cut should be completed from August onwards to maximise the flowering and seeding of wildflowers (and avoid adverse impacts on ground nesting birds)

Woodland 7.19. Overview - A woodland buffer to the adjacent semi-natural woodland will be created and provide a

structured edge of woody shrubs. The planting pattern will aim to produce scalloped edges which create sheltered glades for invertebrates (e.g. common blue butterfly) and a range of scrub structures for locally known breeding bird species (e.g. willow warbler and whitethroat).

7.20. This buffer will complement the existing woodland establishment within the HCA and provide connectivity to the woodland to the north of the Site.

7.21. Establishment - A series of nursery grown barerooted native tress whips are to be planted along the boundary of the existing woodland. Trees are to be supplied in accordance with the National Plant Specification and BS8545:2014. Species to be planted will include native species already present within the existing woodland such as English oak and field maple.

7.22. Trees are to be re to be planted every 3m in a staggered double row. All trees are to be supported by bamboo canes (1.2m tall) and fitted with protective spiral guards (Acorn (or agreed alternative) transparent Spiral Shelter, 0.75m x 50m diameter).

7.23. Aftercare – For years 1-5, all plants to be checked on an annual basis for evidence of damage and failure. Any stock that has failed should be replaced like for like and guards should be replaced / removed as required. Stock should be spot sprayed to remove tall grasses and weeds that will compete with the newly planted stock.

7.24. Long term management – Continued monitoring of stock for damage and failure. Removal and / or replacement of tree guards as appropriate. Appropriate pruning and weed suppression should continue. Waterbodies

7.25. Overview - The existing waterbodies will be protected with the use of habitat buffers, which will be less intensively managed than surrounding areas of grassland. Two new waterbodies will be created in accordance with the original EPS mitigation licence (further details in 7.31-7.35). These will provide connectivity (aquatic ‘stepping stones’) between the existing pond in the west and those to the east.

7.26. Establishment - The 2 new ponds will be created light machinery, no bigger than a mini-digger. The specification will comply with the Great Crested Newt Mitigation Guidelines 2001 (GCNMG 2001).

7.27. Ponds will be between 150m2 and 300m2 in area with varying depths to provide optimal displaying opportunities for male GCN.

7.28. Ponds will be planted with a variety of native aquatic plants, that provide suitable egg laying opportunities for GCN. These will include species such as water mint Mentha aquatica and fools watercress Apium nodiflorum.

7.29. Aftercare - There will be ongoing management for both existing and newly created waterbodies to include removal of rubbish and / or debris and any fish that may colonise the ponds.

7.30. Long term management - There will be ongoing management for both existing and newly created waterbodies to include removal of rubbish and / or debris and any fish that may colonise the ponds. New Hedgerow

7.31. Overview - This will be created along the southern boundary of the Site and comprise of native, fruit and nut bearing species, including hazel Avellana corylus, hawthorn Crataegus monogyna and blackthorn Prunus spinosa.

7.32. The stock should be an even mixture of native species is to be planted to be planted as 60-90cm / 1 year bare rooted forestry transplants, in two double staggered rows, with a minimum of 5 plants per linear metre. Rows are to be staggered 45cm apart.

7.33. Establishment - Plants are to be notched planted using a ‘T’ notch with slots of sufficient size and depth to take the roots untrimmed and to allow full and unimpeded root spread. All shrubs are to be supported by bamboo canes (1.2m tall) and fitted with protective spiral guards (Acorn (or agreed alternative) transparent Spiral Shelter, 0.75m x 50m diameter). Species to be planted include common hawthorn (55%), hazel (15%), blackthorn (10%), field maple Acer campestre (10%), common dogwood Cornus

sanguinea (5%) and apple Malus sylvatica (%). 7.34. Aftercare – Towards the end of year 1 any pernicious weeds (e.g. ragwort Senecio jacobaea, dock

species Rumex sp. and thistle Cirsium sp.) are either to be hand pulled, or spot sprayed using a suitable herbicide at this time. Spiral guards to be monitored in years 2 - 5 after planting and removed, or adjusted as required.

7.35. Long term management –. In the fourth winter after planting (Jan-Feb inclusive), one side of the hedgerow is to be flailed with a tractor mounted flail. In the sixth winter after planting (Jan-Feb inclusive), the other side of the hedgerow is to be flailed. Thereafter the hedgerow is to be cut on rotation with 1/3rd of the hedgerow cut each year. Cutting to be completed outside of bird nesting season (Jan-Feb inclusive). Hedge cuttings are to be removed.

Species

Amphibians 7.36. Habitat creation - In line with the original EPS mitigation licence two new ponds will be created along

the northern boundary of the Site, to the south of the HCA, linked by a drainage ditch. 7.37. The ponds will be created light machinery, no bigger than a mini-digger. The specification will comply

with the Great Crested Newt Mitigation Guidelines 2001 (GCNMG 2001). Ponds will be between 150m2 and 300m2 in area with varying depths to provide optimal displaying opportunities for male GCN.

7.38. Once constructed, additional enhancement of the ponds will be required in the form of planting and creation of hibernacula. Ponds must be planted up with aquatic plants that can provide egg laying opportunities for GCN e.g. water mint Mentha aquatica and fools watercress Apium nodiflorum. A minimum of 2 hibernacula will be created along the southern boundaries of the new ponds to provide additional sheltering and hibernation opportunities. The hibernacula will be constructed in accordance with the GCNMG 2001.

7.39. Removal of protective fencing - Removal of the amphibian fencing can only take place once all construction and habitat creation works have been completed. The fence removal will need to be supervised by a suitably qualified ecologist and must be hand searched prior to removal.

7.40. The proposed grassland restoration and maintenance, as detailed at 7.2-7.5 will provide suitable terrestrial habitat for GCN and common amphibians.

7.41. The existing rubble pile will be retained and seeded with a commercial wildflower seed grass mix to provide coverage and improved aesthetics. This very large rubble pile will give extensive refuge and hibernation cover for amphibians (and other wildlife) Badgers

7.42. The establishment of new woodland along the northern edge of the HCA will extend the existing woodland edge and provide foraging areas for badgers.

7.43. The new hedgerow and restored grassland will provide potential food sources in the form of native fruits and increased worming areas. Bats

7.44. Restoration of the construction area will provide a grassland habitat suitable for bat prey items, increasing the foraging suitability for bats.

7.45. The creation of 2 new ponds will provide additional foraging for bat species such as Daubenton’s Myotis daubentonii. In addition the ponds and surrounding terrestrial habitat will provide connectivity with the woodland edge, which has already been found to be used by a variety of bat species.

7.46. The woodland buffer will continue to provide suitable commuting habitat for bats. Breeding Birds

7.47. The replacement woodland planting to the south of Rockingham Wood will provide nesting and foraging habitats for woodland birds.

7.48. The restored grassland will also provide potential for ground nesting birds such as skylark and lapwing, which may disperse into this area from the grassland within the HCA.

7.49. Management of the grassland will need to take into account the sensitivities of this habitat during bird nesting season (Mar-Aug) and there should be no mowing or cutting of the grass during this period. Invertebrates

7.50. Grassland management detailed above will provide a variety of sward heights throughout the year and will develop a species diverse meadow habitat that is valuable for invertebrates as it provides a variety of food and nectar sources at different times of year.

7.51. To further enhance the structural diversity of the grassland it is recommended that some edge areas, corners and hedge margins are left un-mown / un-grazed to provide. long grass and tussock type habitat which is important for species such as glow-worm

7.52. Updated ecological survey work after establishment of the habitat (Year 3) should include invertebrate assessment. The species identified during this assessment should be considered and management altered (if necessary) to better accommodate any notable or protected species. Such alteration may include rotational cutting / grazing pf the grassland (e.g. leaving 25% of the meadow un-mown / un-grazed each year and altering which 25% this is each year.)

7.53. Very light grazing by sheep can provide a varied sward and provide a continuous supply of food for dung feeding flies and beetles, which in turn, provide a resource for birds and bats. This type of grazing should be monitored to ensure that the grazing intensity is not detrimentally affecting the quality and composition of the grassland.

7.54. The provision of botanically diverse grassland with a structural diversity and the by-products of sheep grazing of this grassland typically support a rich invertebrate diversity (if there are species able to migrate in from the local area).

7.55. Other habitats are also valuable for invertebrates with ponds, hedges and trees all contributing to the mosaic effect of the Site and supporting a diversity of invertebrate species. Reptiles

7.56. The enhanced woodland buffer and restored grassland will provide suitable sheltering, basking and hibernation habitats for this species.

7.57. The long-term management of the Site will include a south facing grassland which should include management options to enhance the habitat for reptiles (e.g. south-facing slopes, grass heaps, exposed rocks, hibernacula etc).

8. TIMINGS 8.1. The timings for the Proposed Works are co-ordinated with those of the construction phases. If in the

event the construction works are paused, the timings for the habitat creation works relating to Phase 2 will necessarily alter proportionately (e.g. a pause for 6 months in construction activities will require a 6 month delay in dates for restoration / habitat creation). Landscaping works will be delayed until the next optimal planting, or sowing window to ensure the mitigation has the best possible likelihood of success.

9. MONITORING Construction Phase

9.1. A monthly record is to be kept by the appointed contractor detailing instances where the measures detailed within Appendix 8 have been complied with.

9.2. The record should include photographs of actions undertaken (e.g. phased vegetation clearance, checks of trees to be removed) as well as a date for the works and the individuals responsible.

9.3. This record should be made available within the Site office.

9.5. As the scheme includes habitat creation / restoration measures to minimise impacts upon these receptors, extensive ongoing monitoring is not considered necessary. A proposed programme of monitoring is detailed in Table 2.

9.6. The findings of the annual ecological monitoring visits are to be summarised in a report circulated to the site owners and relevant officers at Northamptonshire County Council by 31st October each year following the completion of the monitoring visits.

Appendix 6: Great Crested Newt Method Statement

Great Crested Newt Method Statement

As the area of grassland to be soil stripped is within a 500m radius of the GCN breeding pond all vegetation to be disturbed and removed should be hand-searched by an ecologist prior to any form of digging, excavation or vegetation clearance works being started.

The Method Statement guidance should then be followed. If disturbance or destruction works are scheduled to continue over an extended timeframe in one place, than repeated hand-searching may be required, at the discretion of the ecologist. All hand-searching is to be carried out within 24 hours of the start of the works. All other areas of the Site which constitute unfavourable habitat for great crested newts do not require hand searching, but it is advised to following steps;

Machinery movements are to be kept to a minimum, with access and egress routes clearly marked to reduce ground disturbance and the possibility of killing or injuring great crested newts. These routes are to be delineated by hazard warning tape and a steel road pins. Existing roadways and areas of hard-standing are exempt from this requirement, but where machinery will be travelling onto grassland, the most suitable corridor should be allocated and used for the duration of the works.

If there is a delay in works commencing and the existing bare ground becomes colonised, it should be cut to ground level prior to any disturbance work (this should be carried out a minimum of three days before clearance or excavation work begins). This will encourage animals to vacate the area. This should be completed with a hand held strimmer (cut material should be removed immediately from the working area).

Should any trenches and excavations be required, an escape route for animals that enter the trench must be provided, especially if left open overnight. Ramps should be no greater than of 45 degrees in angle. Ideally, any holes should be securely covered.

All excavations left open overnight or longer should be checked for animals prior to the continuation of works or infilling.

Any excavated material should be spread evenly onto areas that have previously been hand searched. If left overnight this material should be searched prior to being used as infill or being removed from site.

Back filling should be completed immediately after any excavations, ideally back filling as the works progress.

Appendix 8: Site Induction / Construction Management Plan

Site Induction / Construction Management Plan The following statements are designed to provide a set of instructions applicable to all the proposed construction phases. A copy of this page is to be incorporated in to the Site Induction Pack for the Site, with each new inductee made aware of the information below.

Habitats

A series of mitigation measures are to be applied as part of the construction phase:

Installation of construction exclusion fencing (e.g. heras fencing) ahead of works commencing as part of each phase. The fence should be installed at least 10m from the woodland edge to the north.

No construction works are to take place within the fenced off wildlife corridor All lighting is to be directed away from the existing woodland edge. This includes lighting installed

on site cabins, and associated with storage areas. No night working is permitted. All chemicals and storage are to be stored on areas of hardstanding or bareground and as far as

possible away from the proposed the Wildlife Corridor and woodland edge. Spill kits and other standard construction measures are to be in place.

All excavations should be left with at least one ramped side (max. 30° slope), or are to be covered overnight.

All reasonable steps to control noise and dust, as per the Environment Agency’s Pollution Prevention Guidance (PPG) is to be followed.

Species

Amphibians – Site perimeter fencing (amphibian exclusion fencing) is to remain in place throughout the construction (infilling and restoration) period. This must be monitored and repaired as required. All of the suitable habitats on site (e.g. grassland) site must be hand searched and cleared of vegetation under supervision of an ecologist prior to work with heavy plant / equipment.

Bats – No bats roost on the site but they do use they are present in the local area and may fly past the site. To avoid disturbance to bats all lighting is to be directed away from the existing woodland edge. This includes lighting installed on site cabins, and associated with storage areas. No night working is permitted.

Birds - Removal of trees, or small patches of scrub is to be completed outside of the nesting period (March-Aug inclusive). If this is not possible – Lockhart Garratt (01536 408840) are to be contacted immediately for advice.

Reptiles – Reptiles will be suitably protected by the implementation of the amphibian (GCN) method statement.

Badgers – A pre-works check for badgers by a suitable qualified ecologist must be undertaken at least 6 weeks prior to the commencement of works.

The appointed construction team is to remain vigilant for protected species. If in the event any protected species are encountered, or are suspected (e.g. badgers, great crested newts, nesting birds). Works must stop, with Lockhart Garratt contacted immediately for advice – 01536 408840
