I, JOSEPH ZERNIK, hereby declare as follows:This declaration was written as a memorandum of my January 7, 2010 visit to the Superior Court ofCalifornia, County of Los Angeles, West District, Santa Monica Courthouse. I have personal knowledge

of the facts set forth herein, which I know to be true and correct, except as to those matters therein stated

as based upon information and belief, and as to those matters, I believe them to be true and correct aswell. If called as a witness, I could and would competently testify with respect thereto.

1. On January 7, 2009 in the afternoon I appeared in the public department of the Clerks Office inthe Santa Monica Courthouse.

2. The Deputy Clerk who assisted me was Bryan. We knew each other for some two years, frommy previous attempts to gain access to my court file.

3. My request to access to paper court file was denied. I was told that the court file would be undersubmission until January 19, 2010.

4. In response to my request for a copy of the Register of Actions of Samaan v Zernik (SC087400)I received the enclosed 275 page record titled: Case History Report, attached to a separatedeclaration.

5. My request to certify the record, which I received in response to my request for the Register ofActions was denied. Bryan stated that the Deputy Clerks were instructed not to certify any of theRegisters of Actions.

6. I also requested printouts from Sustain of all minute orders from January 1, 2008 to that date January 7, 2010. In response Bryan stated that the printouts would terminate on January 6, 2010, and

I received printouts, attached, a total of55 pages.7. Attached to this declaration is:

which I received in response to my request for a printout of the Minute Orders in Samaan v
