With r e f e rence t o t h e M r . Joseph Oliver discharge appeal as presented by M r . Gary H. WcKible, t h e Personnel Cmmission's decision and f i nd ings are as follows:

The Commission f i n d s t h a t on February 3, 1979, appellant Joseph Oliver struck a New ffampshire Hospi ta l p a t i e n t i n t h e neck o r head area while t h e p a t i e n t was p a r t i a l l y r a a t r a i n e d i n a c h a i r t h a t was bolted t o t h e f l o o r . A t the tima of t h e s t r i l c ing , t h e p a t i e n t ' s l e f t and r i g h t w r i s t s were bound t o the arms of t h e c h a i r and h i s r i g h t ankle and foot were bound t o the l e f t l e g of the c h a i r , Mental Health Uurker Robinson had c o n t r o l of and w a s attmpting to strap t h e p a t i e n t ' s l e f t ankle t o the l eg of the cha i r .

The Commission finds that i t was no t necessary f o r appellant: t o s t r i k e the patient e i t h e r in self-defense o r in deienae of h i s co-workers. The a c t i o n of t h e appoin t ing a u t h o r i t y is sustained.
