pursuanttotitle23,CaliforniaCodeofRegulations,section3858onNovember23,2015,andpostedinformationdescribingtheProjectontheRegionalWaterBoard’swebsite.Nocommentswerereceived.
4. ProjectDescription:ThepurposeoftheProjectistocontrolandstabilizetwoactive
slideareasup‐gradientofStateRoute101(SR101).TheProjectlocationsareapproximatelyfivemilessouthofHopland,adjacenttheRussianRiverinMendocinoCountyatpost‐miles(PM)3.75and5.30,andattheKoreanWarVeteran’sViaduct.
Projectactivitiesincludethefollowing:
FormoliSlide—PM3.75Atthislocation,Caltransintendstobuilda20‐foot‐high,353‐foot‐longsoldierpilegroundanchorwallapproximately35feettotheeastofnorthboundSR101.Additionalactivitiesatthislocationwouldinclude:
Constructionofaten‐foot‐deepunderdrainatthefronttoeofthewall.Aneight‐
inch‐diameterperforatedplasticpipewouldbeplacedsixinchesabovethebaseofpermeablematerialtocollectandconveyseepagewatertothedrainageinletatPM3.72;
Gradingofslopesbehindtheanchorwalltominimizesurfacepondingandslopesaturation;
Excavationofaninward‐sloped,aggregatebase‐surfacedbenchinfrontoftheanchorwalltofacilitatedrainage,toprovidemaintenanceaccess,andtoprovideaspacetocapturepotentialslidedebris;and
Constructionofanewstructuralsectionwheretheroadwaypavementhasbeendamagedbytheslidemovement.Theupliftedsectionswouldberemovedandtheroadwaysurfacereturnedtonearitsoriginalelevation.
ThehillsidesurfaceflowabovetheanchorwallwouldbedirectedalongthesidesofthewalltoaswaleandconveyedtothedrainageinletatPM3.72.TheexistingpipeculvertatPM3.72wouldbereplacedandinstalledatalowerelevationtomatchtheelevationoftheproposedunderdrain.
PeregrineSlides—PM5.3Atthislocation,Caltransproposestobuilda50‐foot‐high,419‐foot‐longsoldierpilegroundanchorwallapproximately100feettotheeastofnorthboundSR101.Additionalactivitiesatthislocationwouldinclude:

Excavationofaninward‐sloped,aggregatebase‐surfacedbenchinfrontoftheanchorwalltofacilitatedrainage,toprovidemaintenanceaccess,andtoprovideaspacetocapturepotentialslidedebris;
Constructionofunderdrainsatthefronttoeofthewalland50feetbehindthewall; ReplacementofculvertatPM5.17withnewculvertplacedatalowerelevation; Replacementofthelast40feetoftheexistingculvertatPM5.07with24‐inch
corrugatedsteelpipe; Installationofhorizontaldrainsintheslopeabovetheanchorwall.Thehorizontal
drainsandfrontunderdrainwoulddischargeviaacollectorsystemtothedrainagesystematPM5.17.DischargefromtheunderdrainbehindthewallwouldbeconveyedtothedrainagesystematPM5.11viaahillsidechannel;
Gradingofslopesbehindtheanchorwalltominimizesurfacepondingandslopesaturation;
Constructionofastormwatertreatmentbiofiltrationswale;and Constructionofanewstructuralsectionwheretheroadwaypavementhasbeen
damagedbytheslidemovement.Theupliftedsectionswouldberemovedandtheroadwaysurfacereturnedtonearitsoriginalelevation.
SurfacerunofffromPeregrineSlidecurrentlyflowsintoacrossculvertatPM5.22.ProjectconstructionwillresultintheredirectionofsurfacerunofftotheexistingculvertatPM5.11.
KoreanWarVeteran’sViaduct–PM4.95Thedamagedcross‐drainageculvertatPM4.95shallberemovedandreplacedwithanapproximately196‐foot‐longopenchannel.Caltransshallinstalltwosedimenttrapslocatedattwoweirswithintheopenchannel.
5. ConstructionTiming:TheProjectisexpectedtorequire190daysofconstruction.
TheProjectisproposedtobegininthespringof2017,andbecompletedinthefallof2018.Constructionshalloccurduringthedryseason(June15toOctober15)tominimizeimpactstosurfacewater.
6. ProjectImpacts:TheProjectwillresultinapproximately546linearfeet(0.037acres)
ofpermanentimpactstoephemeraltributariesoftheRussianRiverasaresultofdrainagesystemmodifications.TheProjectwillresultinapproximately56linearfeet(0.001acres)oftemporaryimpactstoephemeraltributariesoftheRussianRiverasaresultofculvertmodifications.ThisProjectwillalsoresultinapproximately0.023acresofpermanentimpactstoriparianvegetation.
7. MitigationforProjectImpacts:Tocompensatefor546linearfeet(0.037acres)of
permanentimpactstojurisdictionalwaters,Caltransshallconvertaculverteddrainagetoarock‐linedditchwhichwouldresultinapproximately192feet(0.11acres)ofopenchannel.

Tocompensateforapproximately0.023acresofpermanentimpactstoriparianvegetation,Caltransshallplantapproximately0.069acresofwillowcuttingsandvalleyoaktreesalongtheephemeraldrainagesbehindtheFormoliWall(~PM5.22),andattheculvertoutletofthedrainagesystemlocatedatPM5.11.
8. Post‐ConstructionStormWaterTreatment:Projectimplementationwouldresultinapproximately0.79acresofnewimpervioussurface.Tocontrolroadwaypollutants,post‐construction,Caltransshallinstalltwobioswalesinserieswith8to12inchesofengineeredsoilmediatotreatnolessthan0.79acresofimpervioussurface.CaltransshallinstallasedimenttrapwithintheProjectlimits.ThetrapshallbemadeupoftwoweirslocatedontherocklinedditchatPM4.95,beneaththeKoreanWarVeteransViaduct.
9. DisturbedSoilArea:Projectimplementationwillresultingreaterthanoneacreof
disturbedsoilarea.CaltransshallapplyforcoverageundertheNationalPollutantDischargeEliminationSystemGeneralPermitforStormWaterDischargesAssociatedwithConstructionandLandDisturbanceActivities(OrderNo.2009‐0009‐DWQ)andprepareaStormwaterPollutionPreventionPlandetailingbestmanagementpractices(BMPs)tocontrolpollutionfromtheProjectareaduringconstruction.AlltemporarilydisturbedareaswithintheProjectareashallbeappropriatelystabilizedand/orreplantedwithappropriatenativevegetation.
10. UtilityRelocations:Utilityrelocationsaffectingjurisdictionalwatersarenotproposed
forthisProject.
11. OtherAgencyActions:Caltranshasappliedforcoverageunderanon‐reportingU.S.ArmyCorpsofEngineersNationwidePermitNo.14,LinearTransportationProjects,pursuanttosection404oftheCleanWaterAct.CaltranshasappliedforaSection1600StreambedAlterationAgreementfromtheCaliforniaDepartmentofFishandWildlife.
12. CEQACompliance:OnApril2,2015,CaltranssignedaNoticeofDeterminationapprovingaMitigatedNegativeDeclarationfortheProject(StateClearinghouseNo.2015021063)inordertocomplywiththeCaliforniaEnvironmentalQualityAct.
13. TotalMaximumDailyLoad:TheRussianRiverisidentifiedasimpairedforsediment
andtemperatureunderCleanWaterActSection303(d).Atpresent,TotalMaximumDailyLoads(TMDLs)havenotbeenestablishedforthiswaterbody.Bankerosionisidentifiedasasourcecontributingtothesedimentimpairment.Removalofriparianvegetationisidentifiedasasourcecontributingtotemperatureimpairment.Activitiesthatwouldbeauthorizedbythecertificationwouldbedesignedtoreduceremovalofriparianvegetationandreducesedimentdischargesfrombankerosion.
14. AntidegradationPolicy:ThefederalantidegradationpolicyrequiresthatStatewater
qualitystandardsincludeanantidegradationpolicyconsistentwiththefederalpolicy.

TheStateWaterBoardestablishedCalifornia’santidegradationpolicyinStateWaterBoardResolutionNo.68‐16.ResolutionNo.68‐16incorporatesthefederalantidegradationpolicywherethefederalpolicyappliesunderfederallaw.ResolutionNo.68‐16requiresthatexistingqualityofwatersbemaintainedunlessdegradationisjustifiedbasedonspecificfindings.TheRegionalWaterBoard’sBasinPlanimplements,andincorporatesbyreference,boththeStateandfederalantidegradationpolicies.Thiscertificationisconsistentwithapplicablefederalandstateantidegradationpolicies,asitdoesnotauthorizethedischargeofincreasedconcentrationsofpollutantsorincreasedvolumesoftreatedwastewater,anddoesnototherwiseauthorizedegradationofthewatersaffectedbythisProject.
15. ThisdischargeisalsoregulatedunderStateWaterResourcesControlBoardOrderNo.
2003‐0017‐DWQ,"GeneralWasteDischargeRequirementsforDredgeandFillDischargesThatHaveReceivedStateWaterQualityCertification,"whichrequirescompliancewithallconditionsofthiscertification.AweblinktothisOrderisincludedattheendofthiscertification.
Accordingly,basedonitsindependentreviewoftherecord,theRegionalWaterBoardcertifiesthattheStateRoute101PeregrineSlidesRepairProject(WDIDNo.1B15029WNME),asdescribedintheapplicationwillcomplywithsections301,302,303,306and307oftheCleanWaterAct,andwithapplicableprovisionsofstatelaw,providedthatCaltranscomplieswiththefollowingtermsandconditions:AllconditionsofthiscertificationapplytoCaltrans(andallitsemployees)andallcontractors(andtheiremployees),sub‐contractors(andtheiremployees),andanyotherentityoragencythatperformsactivitiesorworkontheProjectasrelatedtothisWaterQualityCertification.Project‐SpecificConditionsRequiringReports(continued)

Tocompensatefortheremovalof0.023acresofwillowthicketalongtheephemeraldrainageatPM5.22,Caltransshallplantnolessthan0.069acresofwillowandvalleyoaktreesasdescribedintheRevegetationPlan,datedOctober,2015.MonitoringwillbeperformedonceeachyearbetweenMay1andSeptember30,foraperiodoffiveyearsbytheProjectBiologist,orRevegetationSpecialist.Qualitativemonitoringwillincludephotopoints.Quantitativemonitoringwillmeasuretheareaofwillowandoakestablishmentandincludesurvivalcountsofindividualoakplantings.Resultswillbedocumentedonaerialphotosorprojectplans.Permanentphotopointswillbesetup

todocumentthemitigationeffort.MonitoringreportsshallbesubmittedannuallytotheRegionalWaterBoardforfiveyears.ThefirstmonitoringreportshallbesubmittednolaterthanJanuary31,2019.Thereportshallincludeyearlyperformancecriteria,progresstowardsfinalsuccesscriteriaandincludeanyadaptivemanagementmeasures.
a. PerformancecriteriaforYear1throughYear4willbeachievedifthefollowingconditionsaremet:
i. Anannualincreaseofvegetativecoverofwillowsandoaksin1st–4thyearsafterwillowsareinstalled.OR
ii. Aminimumof40survivingoaktrees,includingvolunteers,attheendofyear1andaminimumof30survivingoaktrees,includingvolunteers,attheendofyear4.
b. SuccesscriteriaforYear5willbeachievedifthefollowingconditionsaremet:i. Aminimumof50%ofvegetativecoverofwillowsandoaksby5thyearofmonitoring.OR
ii. Atleast25survivingoaktrees,includingvolunteers,by5thyearofmonitoring.
2. Caltransshallinstalltwobioswalestotreatnolessthan0.73acresofimpervious
surfacerunoff.Thebioswalesshallbeamendedwith4inchesofcompostincorporatedtoadepthof12inches.Thebioswalesshallbevegetatedusingnativegrassseed.CaltransshallsubmitphotographsofcompletedandfullyvegetatedbioswalesnolaterthanJune1,2018.
3. CaltransshallprovideasedimenttrapmaintenanceplantotheRegionalWaterBoardforreviewandstaffacceptancenolaterthanOctober15,2018.Themaintenanceplanshalldetailtheinspectionschedule,andcriteriaandtimingforsedimentremoval.TwosedimenttrapmonitoringreportsshallbeprovidednolaterthanJanuary15,2019,andJuly15,2019,todocumentthetrap’sperformanceandmaintenance.Themonitoringreportsshallincludephotos,maintenancedates,approximatevolumeofsedimentremovedfromthebasinandsedimentdisposallocation.

4. HerbicidesandotherpesticidesshallnotbeusedwithintheProjectlimits.IfCaltranshasacompellingcaseastowhypesticidesshouldbeused,thenarequestforpesticideuseandaBMPplanmaybesubmittedtotheRegionalWaterBoardstaffforreviewandacceptance.

5. AllProjectactivitiesandBMPsshallbeimplementedaccordingtothesubmittedapplicationpackageandthefindingsandconditionsofthiscertification.SubsequentchangestotheProjectthatcouldsignificantlyimpactwaterqualityshallfirstbesubmittedtoRegionalWaterBoardstaffforpriorreview,consideration,andwrittenconcurrence.IftheRegionalWaterBoardisnotnotifiedofanalterationtotheProjectthatresultsinanimpacttowaterquality,itwillbeconsideredaviolationofthiscertification,andCaltransmaybesubjecttoRegionalWaterBoardenforcementactions.
6. AllconditionsrequiredbythiscertificationshallbeincludedintheContractDocumentspreparedbyCaltransforthecontractor.Inaddition,CaltransshallrequirecompliancewithallconditionsincludedinthiscertificationinthebidcontractforthisProject.
7. Caltransisprohibitedfromdischargingwastetowatersofthestate,unlessexplicitlyauthorizedbythiscertification.Forexample,nodebris,soil,silt,sand,bark,slash,sawdust,rubbish,cementorconcreteorconcretewashings,weldingslag,oilorpetroleumproducts,orotherorganicorearthenmaterialfromanyconstructionorassociatedactivityofwhatevernature,shallbeallowedtoenterintostatewaters.
8. Exceptfortemporarystockpilingofwastegeneratedduringdemolitionoperations(“temporary”inthisinstancemeansgeneratedandremovedduringthesameworkingday),wastematerialsshallnotbeplacedinamannerwherethematerialsmaybetransportedintowatersofthestate.Wastematerialsshallnotbeplacedwithin100linearfeetofstatewaters.Exceptionstothe100‐footlimitmaybegrantedonacase‐by‐casebasisprovidedCaltransfirstsubmitsaproposalinwritingthatisfoundacceptablebyRegionalWaterBoardstaff.
9. Caltransisliableandresponsiblefortheproperdisposal,reuse,and/orrecyclingofallProject‐generatedwasteincompliancewithapplicablestateandfederallawsandregulations,andasdescribedinCaltrans2010StandardSpecifications13‐4.03D,WasteManagement.Additionally,whenhandling,transporting,disposing,reusing,and/orrecyclingProject‐generatedwaste,Caltransandtheircontractorsshall:
i) ProvidetheRegionalWaterBoardwithacopyoftheSolidWasteDisposalandRecyclingReportpreparedforCaltransbythecontractorperCaltrans2010StandardSpecification14‐10.02A(1),Submittals.ThesereportsshallbeprovidednotlaterthanJanuary31foreachyearworkisperformedduringthepreviouscalendaryear.AcopyofthefinalSolidWasteDisposalandRecyclingReportshallbesubmittedtotheRegionalWaterBoardwithin30daysafterbeingreceivedbyCaltransfromthecontractor.
ii) Forwasteotherthansolidwaste,obtainevidencethatwastehasbeenappropriatelydisposed,reused,and/orrecycled.Evidenceshallincludetype

andquantityofwasteandmayinclude,butnotbelimitedto,propertyowneragreements,permits,licenses,andenvironmentalclearances.EvidenceshallbeprovidedtotheRegionalWaterBoarduponrequest;and
iii) Forwasteotherthansolidwaste,ensuretheResidentEngineerhasgivenwrittenpermissionfordisposal,reuse,and/orrecycling,priortotheactualdisposal,reuse,and/orrecycling.
10. Asphalt‐concretegrindingsshallnotbeplacedinanylocationwheretheymay,atany
time,bedirectlyexposedtosurfacewatersorseasonallyhighgroundwater,exceptasphalt‐concretegrindingsmaybere‐usedandincorporatedintohotmixasphaltproductsorencapsulatedwithintheroadwaystructuralsection.
11. CaltransandtheircontractorsshallcomplywiththeactivityrestrictionsdetailedinCaltrans2010StandardSpecifications13‐4.03C(1).Inaddition,fueling,maintenance,storageandstagingofvehiclesandequipmentshallbeprohibitedwithinwatersofthestate(e.g.,gravelbars,seeps,ephemeralstreams)andriparianareas.
12. Fueling,maintenance,and/orstagingofindividualequipmenttypeswithinwatersofthestateorriparianareasmaybeauthorizedifCaltransfirstpreparesaplanforreviewandapprovalbyRegionalWaterBoardstaffthat:
i) Identifiesthespecificpieceofmachinerythatmayrequirefueling,maintenance,and/orstagingwithinwatersofthestateorriparianareas;
ii) Providesjustificationfortheneedtorefuel,maintain,orstagewithinstatewatersorriparianareas.Thejustificationshalldescribewhyconductingtheactivityoutsideofjurisdictionalwatersisinfeasible;and
iii) IncludesanarrativeofspecificBMPsthatshallbeemployedtopreventdischargestostatewatersandriparianareas;
13. Caltransshallnotuseleakingvehiclesorequipmentwithinstatewatersorriparian
areas.14. Only100‐percentbiodegradableerosionandsedimentcontrolproductsthatwillnot
entraporharmwildlifeshallbeused.Photodegradablesyntheticproductsarenotconsideredbiodegradable.IfCaltransfindsthaterosioncontrolnettingorproductshaveentrappedorharmedwildlife,personnelshallremovethenettingorproductandreplaceitwithwildlife‐friendlybiodegradableproducts.Thisconditiondoesnotprohibittheuseofplasticsheetingusedinwaterdiversionordewateringactivities.CaltransshallrequestapprovalfromtheRegionalWaterBoardifanexceptiontothisrequirementisneededforaspecificlocation.

15. Workinflowingorstandingsurfacewaters,unlessotherwiseproposedintheprojectdescriptionandapprovedbytheRegionalWaterBoard,isprohibited.
16. Non‐stormwaterdischargesareprohibitedunlessthedischargeisfirstapprovedbytheRegionalWaterBoardandincompliancewiththeBasinPlan.Ifdewateringofgroundwaterisnecessary,thenCaltransshalluseamethodofwaterdisposalotherthandisposaltogroundorsurfacewaters,suchaslanddisposal.Groundwaterdisposedoftolandshallnotenterstatewaters.Alternatively,CaltransmayapplyforcoverageundertheLowThreatDischargePermitoranindividualNationalPollutantDischargeEliminationSystem(NPDES)Permit.IfCaltransappliesforcoverageundereitherofthesepermits,thendischargeisprohibiteduntilCaltranshasreceivednotificationofcoverageundertherespectivepermit.
17. Gravelbagsusedwithinstatewatersshall:
i) ComplywithCaltrans2010StandardSpecificationssections13‐5.02Gand88‐1.02F;
ii) Beimmediatelyremovedandreplacedifthebagshavedevelopedoraredevelopingholesortears;and
iii) Befilledonlywithcleanwashedgravel.ExceptionstothesecriteriaaresubjecttothereviewandacceptanceofRegionalWaterBoardstaff.
18. Thiscertificationdoesnotauthorizedraftingofsurfacewaters.
19. CaltransshallprovideaccesstotheProjectconstructionsiteuponrequestbyRegional
WaterBoardstaff.
20. InitialwaterpollutioncontroltrainingdescribedinCaltrans2010StandardSpecifications13‐1.01D(2),Training,shallapplytoallCaltransemployees,contractors,andsub‐contractors.InitialwaterpollutioncontroltrainingtopicsshallincludeRegionalWaterBoard401certificationandconstructiongeneralpermitrequirements,identificationofstatewatersandriparianareas,andviolationavoidanceanddischargereportingprocedures.
21. CaltransshallmaintainlogsofallCaltransstaff,contractors,andsub‐contractorstrainedpursuanttotheCaltrans2010StandardSpecifications13‐1.01D(2).Thelogsshallincludethenamesoftrainees,trainingdates,andsummaryofthescopeoftraining.CaltransshallprovideevidenceofthisdocumentationupontherequestoftheRegionalWaterBoard.
22. Ifanunauthorizeddischargetosurfacewaters(includingwetlands,riversorstreams)occurs,oranyotherthreattowaterqualityarisesasaresultofProject

implementation,theassociatedProjectactivitiesshallceaseimmediatelyuntilthethreattowaterqualityisotherwiseabated.Ifthereisadischargetostatewaters,theRegionalWaterBoardshallbenotifiednomorethan24hoursafterthedischargeoccurs.
23. Uncuredconcreteshallnotbeexposedtostatewatersorsurfacewatersthatmaydischargetostatewaters.Concretesealantsmaybeappliedtotheconcretesurfacewheredifficultyinexcludingflowforalongperiodmayoccur.Ifconcretesealantisused,watershallbeexcludedfromthesiteuntilthesealantiscured.Ifgroundwatercomesintocontactwithfreshconcrete,itshallbepreventedfromflowingtowardssurfacewater.
24. Groundandsurfacewaterthathascomeintocontactwithfreshconcrete,andallotherwastewater,shallnotbedischargedtostatewatersortoalocationwhereitmaydischargetostatewaters;thewastewatershallbecollectedandre‐usedordisposedofinamannerapprovedbytheRegionalWaterBoard.
25. 26. CaltransshallprovideacopyofthiscertificationandStateWaterResourcesControlBoard(SWRCB)OrderNo.2003‐0017‐DWQtothecontractorandallsubcontractorsconductingthework,andrequirethatcopiesremainintheirpossessionattheworksite.Caltransshallberesponsibleforworkconductedbyitscontractorandsubcontractors.
27. Thevalidityofthiscertificationisconditionedupontotalpaymentofanyfeerequiredundertitle23,CaliforniaCodeofRegulations,section3833.Thetotalapplicationfeeis$8,127.TheRegionalWaterBoardreceived$8,127fromCaltransonSeptember24,2015.
28. 30. ThiscertificationactionisnotintendedandshallnotbeconstruedtoapplytoanydischargefromanyactivityinvolvingahydroelectricfacilityrequiringaFederalEnergyRegulatoryCommission(FERC)licenseoranamendmenttoaFERClicenseunlessthepertinentcertificationapplicationwasfiledpursuanttotitle23,CaliforniaCodeofRegulations,section3855,subdivision(b)andtheapplicationspecificallyidentifiedthataFERClicenseoramendmenttoaFERClicenseforahydroelectricfacilitywasbeingsought.
31. Intheeventofanyviolationorthreatenedviolationoftheconditionsofthiscertification,theviolationorthreatenedviolationshallbesubjecttoanyremedies,penalties,processorsanctionsasprovidedforunderapplicablestateorfederallaw.Forthepurposesofsection401(d)oftheCleanWaterAct,theapplicabilityofanystatelawauthorizingremedies,penalties,processorsanctionsfortheviolationorthreatenedviolationconstitutesalimitationnecessarytoassurecompliancewiththewaterqualitystandardsandotherpertinentrequirementsincorporatedintothiscertification.Inresponsetoasuspectedviolationofanyconditionofthiscertification,theStateWaterBoardmayrequiretheholderofanyfederalpermitorlicensesubjecttothiscertificationtofurnish,underpenaltyofperjury,anytechnicalormonitoringreportstheStateWaterBoarddeemsappropriate,providedthattheburden,includingcosts,ofthereportsshallbearareasonablerelationshiptotheneedforthereportsandthebenefitstobeobtainedfromthereports.Inresponsetoanyviolationoftheconditionsofthiscertification,theRegionalWaterBoardmayaddtoormodifytheconditionsofthiscertificationasappropriatetoensurecompliance.
32. Thiscertificationactionissubjecttomodificationorrevocationuponadministrativeorjudicialreview,includingreviewandamendmentpursuanttoWaterCodesection13330andtitle23,CaliforniaCodeofRegulations,section3867.

AnychangeinthedesignorimplementationoftheProjectthatwouldhaveasignificantormaterialeffectonthefindings,conclusions,orconditionsofthiscertificationmustbesubmittedtotheExecutiveOfficeroftheRegionalWaterBoardforpriorreview,consideration,andwrittenconcurrence.IftheRegionalWaterBoardisnotnotifiedofasignificantalterationtotheproject,itwillbeconsideredaviolationofthiscertification,andCaltransmaybesubjecttoRegionalWaterBoardenforcementactions.
