Firstly this event will present an overview of the National Judiciary Network Project (UYAP)

What is ‘UYAP’

UYAP’s expansion is “NATIONAL JUDICIARY INFORMATICS SYSTEM”

UYAP is a judicial central network project

which includes all of the courts, public prosecutors services, prisons and detention houses, and other judicial institutions in Turkey (Forensic medicine offices, probation offices etc.)

All judicial Institutes connect online each other via UYAP WAN

It’s purpose is providing vertical and horizontal integration across Turkish judicial system and other government departments and international organizations

In Turkey judicial power exercises mainly by different three high level courthouses Those are:1Constitutional Court, 2Court of Cassation,and 3Council of State Three seperated jurisdictions are used by those high courts1- puts in to effect the turkish constitution over turkish statute's law and supervises the compatibility of the turkish acts with the turkish constitution2-works as a court of appeal, it is upper (superior) court of criminal and civil courts3- reviews administrative court's judgements and makes for government consultancy (over sb/sth) | ~ (of sb/sth) (to do sth) the authority that an official organization has to make legal decisions about sb/sth:The Court of Appeal exercised (kullanmak) its jurisdiction to order a review of the case. * These matters do not fall within our jurisdiction.2[C] an area or a country in which a particular system of laws has authority:Practice varies between different European jurisdictions.

Average duration of assize in Turkey is very lengthy (excessive).Processes keep up around about one year in courts. administrative processes continue more then one year in Council of State Times of the Judgement (Decision making) elongates (uzatmak) incessant (sürekli) in Turkey. The Basic Requirements Of Turkish Judicial

System and what has been doing?

• Turkish government nowadays is fallowing a national programme for reinforcement and to accelerate the judicial system

• They are also implementing various measures on judicial modernisation and penal reform and want to improve the functioning and efficiency of the judiciary

• UYAP was prepared and established by MoJ within the context of to create an effective and less bureaucratic judicial system for each concerned institution and citizens as one and very important measure

A draft Product Breakdown Structure is shown with a note on critical products below;1. A business process model for TJS analysing the inputs, outputs, controls policies, procedures and resources, staff roles,for each level of process2. A verified functional requirements catalogue, derived (elde etmek) from and traceable to the business process model and the articles in the laws.3. Delivered software which is tested and meets the quality criteria determined by project board 5. Deployment of the delivered software on the UYAP infrastructure in a phased implementation across Turkey6. Training of our users in the effective use of the delivered and deployed software7. putting into operation NJNP first of all in 30 pilot units than plus 12 units The first studies concerning this project started in 1998. First, fixed idea infrasubtructure studies on the set up of the computer system were done. Also as a result of the reorganization study in the structure of Ministry of Justice, Personnel General Directorate, at the end of 1999 Data Processing Department Presidency was founded. Later on, by contacting the technology companies, by deciding which data technologies shall be used, it was believed that it will be better to carry out this work in one item. This work which was started as one part of e–State, as of year 2000, the name National Judicial Network Project (NJNP) was given.As parallel to the developments in computer technology, it appeared in the aim of meeting the need of reaching the information directly, in a secure and fast sort. The project was considered in two phases. 1. phase includes Minstry of Justice Center Organization automation. In this scope, establishment of a central system was finished for the all the units’ works such as personnel, budget, health, administrative and financial works in the Ministry Central, works which concern all the units and besides that for caryying out the tasks given to them by Law, for doing the processes in the electronic environment special to the units. Immediately beside this general system concerned with the task and administrative works, a Document Management System (DMS) was also established which includes all the units of Ministry, which gives the opportunity to make the correspondence in electronic environment in a central structure. It was provided to make the correspondence of DMS which was founded in the centre and units which were put into operation later on, their correspondence with Centre and each other, in the electronic environment. 1. Phase of the Project was put into operation in 2001 by completing entirely.II. phase of NJNP is the automation of the provinces units. In the II. phase, 30 pilots and test units were chosen, the necessary studies were done on these pilots and test units. NJNP implementation softwares has been started to be used on Pilot and test units since February, 2004. As of 10.10.2005, Wide Area Network (WAN) connection was made in 54 the provinces organization, it went into action, until the end of 2005 it will go into action by connecting to Wide Area Network in the scale of state in all the High Criminal Centre units. As it is shown above, as of 16.10.2005 16 High Criminal Centres, in 4 District Administrative Tribunals, 9 Penitentiaries were taken into operation. In these courthouses where NJNP is being used, 299.149 law cases, 234.418 criminal cases, 295.341 administrative cases and 656.912 legal medicine dossiers, 2.539.558 execution cases have started to be implmented as being registered to the system.

Thanks to the private passwords given to them, they can enter the system from their computer in the bureau. After the system is put into practice which will bring easiness to lawyers and citizens, it will not be necessary to go to courthouses to learn information about the phase of the case or to learn the date of the hearing.

RESULTSEffects and effectiveness of the Project:

From the beginning of 26.04.2004, UYAP was expanded to cover 41 units

4.701.373 files have been entered via UYAP and these units have carried out their all processes via UYAP from that date on.

In all of the units taken into operation, nearly 2.539.558 administrative files are operated by the means of UYAP system.

RESULTSEffects and effectiveness of the Project:

Some of the results obtained are stated below

• For example, in the courts taken into operation, delivery bureaus have been taken into operation and collection of charges and duty distributions which are carried out hand by hand before are now carried out by the system as to the objective criteria determined in an electronic environment.

• The most important hinder in this way is the resistance that the users show against a new way of life. In order to break this resistance the necessary laws support should be constituted, public opinion support should be provided by making conscious campaigns.
