3 loss of love and companionship of her son. Defend ants seek to depose lnm ate M asters in order to

4 obtain infonnation on the deceased's upbringing a nd relationship with his m other.

5 On June 20, 201 1, Defendants obtained a cornmiss ion which rm uests this court to issue the

6 necessary docum ents to allow . lnmate M asters' deposition to be videotaped. (n e co rnmission is.

7 attached hereto as Exhibït 'eB.'') Defendant.s re quem tllat this court honor this colnmission and is sur

8 an order which will allow Inm ate M asters' deposit ion to be videotaped. Inm ate M u ter's deposition

9 is scheduled for July 29a 201 1 , therefore it is imptrative that this oourt issue an order in short .

1 1 lI. SHA NE M ASTERS' W DEOTAPED DEPOSITION IS'CRU C IAL TO TH E

12 DEFENSE13 M r. M msters is currently incarcerated in E1y Sta te Prison in'Ely, Nevada. n e defense wishes

1 4 to deX se M r. M astm's to inquire as to his Son's upbringing and relationship with his m oiher. .

1 5 X though tbe prison will allow his deposition to be taken, they will not allow it to be vidx taped

l 6 without a court order. n e trial in this m atter is August 26, 201 1 and, considering that M r. M mste rs

1 7 has years to go on his prison sentence, there i s no possible way for him to attend trial. n erefore ,

l 8 the only way his testimony can be presented is either via a written dtw sition trnnqcript or

19 videotaped deposition. However, there are severe limitations to te-stimony presented via deposition

20 tranqcript. For instance, tone of voice, body la nguage and intonation are all lost in a deposition

21 tanscript. For this reason the Defendants believ e that presenting video instead bf just a written

22 deposition transcript will be a m ore accurate de piction of lnm ate M ïstel's' testim ony. '

23 111. CONCLUSIO N

24 For the reuons given abov'e, Defendants request that the court order E)y State Prison to

25 allow the videotaped deposition of Shane M asters to take place. To'this end, Defendants also

26 request that the prison allow al1 non-attorney p ersolm el essential to the videotaped deposition. .
