Chernus, Friday, May 10, 2013 granted the Construction Industry Force Account Council’s (CIFAC’s) Petition for Writ of Mandate against the Ross Valley Sanitary District (RVSD) to bring them into compliance with California’s public bidding laws. The decision in favor of the CIFAC’s action requires that RVSD competitively bid their sewer pipe replacement projects for all projects valued at $15,000 and above. “That’s the law but they ignored it,” said CIFAC President Dave McCosker. “The Court’s decision means a minimum of 139 miles of pipeline replacement and related work will go out to bid creating scores of new job opportunities and allowing the public to see the real costs which will be much lower. We recognize this work is extremely important to prevent further spills and we are willing to be a resource to the District to get it done. It’s clear from the court documents that the district engineer is not clear on construction protocols and procedures,” said Cathryn Hilliard, CIFAC’s Executive Director and Tam Valley resident. First led astray by former General Manager Brett Richards, former members of the RVSD Board were persuaded to hire from 7 to 11 new staff to perform all the work in-house. Richards convinced the Board that they should use a method called pipe-bursting and claimed they could do it all in-house for $847,000 per mile and claimed that contractors would charge $1.4 million per mile. Marin Builders Association’s Legislative Analyst Casey Mazzoni appeared at the same District Board meetings as Hilliard to argue that if RVSD put the work out to competitive bid, contractors could do it for $660,000 per mile or less and take less time to complete it. “The economic downturn resulted in high construction industry unemployment and at a time when local government has less funding; it only makes sense for local agencies to look first to their local contractors,” Mazzoni said. But Richards told the Board that there were no local contractors to do the job and it would cost the District $45,000 to do a study to find contractors that could do the work. Bolstered by their attorneys who originally provided no advice or wrong advice, the Board ignored warnings that pipe replacement projects, with a value of more than $15,000, must be put out to

competitive bid as specified in the section of the California Public Contract Code that relates to Sanitary Districts. Despite the warnings from CIFAC, MBA and the public works construction industry, the Board adopted the budget as presented and approved a very large rate increase at the same meeting. Hilliard noted that every effort was made to avoid legal action but the District’s legal counsel was clearly not interested and did not reply to numerous letters or phone calls for more than a year. “We had no choice but to go to the court in June of 2012, and even then District Counsel would not accept service for the Board, so CIFAC was forced to serve each Board member in public between its Finance Committee and the Board meeting. That’s something we would have liked to avoid,” said CIFAC President McCosker. The General Manager, who proposed the idea of increasing staff size and training them to do the pipe-bursting work, has since disappeared and the composition of the Board has changed. In the recent past, the District has been involved in a number of other legal battles and three Grand Jury investigations. President David A. McCosker said “while some of the newer Board members seemed to understand the law, a majority of the Board members at the time appeared to be far less concerned and were willing to risk legal action. I’m amazed that CIFAC’s offers to hold off legal action if the District simply agreed to follow the law and bid the pipeline work was first ignored and then refused. It appeared that the General Manager and some members of the Board were willing to treat the ratepayers like a ‘deep pocket’ to absorb the cost of all sorts of legal expenses – and then they turn around and raise the rates on them to pay for their mistakes.” The ruling means that Ross Valley Sanitary District must immediately bid all new public works construction projects.

The City of Mill Valley is pleased to announce a street maintenance and sewer rehabilitation project that will take place this summer on East Blithedale Avenue. The project will involve improvements to the road surface to promote a smooth and quiet ride, new traffic markings, sewer pipe repair, and new manholes. While the project will cause short-term delays and traffic congestion over a period of two months, the benefits of this project will be significant, including the repair of sewer infrastructure and improved pavement conditions.

Construction on East Blithedale from Elm/Alta Vista Avenue to Camino Alto will take place from June 24th through August 23rd, while schools are not in session, Monday through Friday, from 8:00 am to 5:00 pm. While East Blithedale will not be entirely closed to through traffic at any point, traffic will often be limited to one lane, and therefore delays and traffic congestion can be expected.

If possible, we encourage you to plan alternate routes to avoid travel on East Blithedale. If you must drive on East Blithedale, add time to your travel estimates and anticipate delays.

Work includes the rehabilitation of the roadway and culverts along Sir Francis Drake Boulevard for approximately 3.8 miles, between Platform Bridge Road (PM 20.39) and Irving Bridge (PM 16.50) in Northern Marin County. Culvert rehabilitation

includes slip lining, headwall construction, pipe replacement, outfall extensions and installation of rock slope protection.

Roadway rehabilitation includes full depth roadway failure repair, crack sealings as directed by the engineer, two lifts of asphalt separated by an engineered paving mat, a top layer of asphalt known as the ‘bonded wearing course,’ slurry seal. To support

the project improvements, storm water pollution prevention and temporary dewatering will be necessary.

The Engineer’s estimate for this project is $3,127,500.

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

The interaction with contractors and the feedback from readers is why this is written. Knowing you read every word is both gratifying and always of concern in getting it exactly right. We welcome your input positive or negative in serving to provide the assistance you need. We get started with a question that may have no answer, or a different one in another situation…

Q: My Company wants me to be the Responsible Managing Employee (RME) on their contractor’s license. What kind of liabilities do I take on as the RME? If the company is sued or has a judgment filed against the license, am I held responsible?

A: This is always a difficult topic because there is no cut and dry an-swer. The CSLB regulations typically refer to “responsibilities” of an RME rather than “liabilities”. The responsibilities include being actively involved in the construction activities as a bona fide employee and working at least 32 hours per week, or 80% of the time the company is in business, whichever is less.

As an employee and not an Officer of the company, an RME would not typically be held financially responsible if the company were sued or if there was a judgment filed against the license. However it would depend on the situation and it would ultimately be up to the courts or the CSLB to decide. Checking with your legal advisor is also always a good idea when making important business decisions.

Q: We are a company that does specialized repair work and I’m curious whether we need to have a contractor’s license. We do repair work on Commercial Utility Scale Solar Inverters. Basically it’s an electrical unit that is the bridge between the solar panels and the grid. All the work we do is in relation to the inverter. It consists of replacing failed electrical com-ponents, transformers, fuses, controller board, and on occasion we replace some of the wiring inside of the Inverter. Any information you can provide would be helpful.

A: Yes, you do need a contractor’s license to perform that type of work. A “C-10” Electrical license would be the appropriate classification in order to repair solar inverters.

Q: I have been working for a contractor for several years but now want to get my own license. The company handles a number of trades, but I’m looking at getting a license to apply caulking, sealants and epoxy. I want to

refinish bathtubs; do caulking around windows and anything else allowed by this license around homes and businesses. What do you suggest I apply for at the Contractors Board?

A: The “C-61”/”D-12” (Synthetic products) classification is what you need. Among other things, this classification allows you to install vinyl and epoxy products, handle bathtub and enamel refinishing, and apply synthetic caulking and sealants -- including resin -- to a wide variety of surfaces. These can be in and around homes, commercial businesses, as well as pub-lic buildings. If qualified, you can also install synthetic turf, rodent guards, and subsurface irrigation drip systems.

You will need to show the CSLB that you have at least 4 years experience within the past ten years in this trade. You will also be required to pass a business/law exam (there is no trade test). Thank you for your question and if you need any help in dealing with the CSLB, please contact us.

Contractor’s Note: One of our loyal readers got in touch to ask for clari-fication of a recent question. The question was regarding a “B” contrac-tor who wanted to know if they could self-perform plumbing and HVAC work. In my answer I stated that a “B Contractor must perform at least 2 unrelated trades”. The answer should have been that a “B” contractor must contract for at least 2 unrelated trades. “B” contractors can either perform the trades, or subcontract the work out. Good catch, we always welcome and appreciate feedback!

“There is more than one way to skin a bureaucrat!” Phil Vermeulen, circa 1981

When I first began actively lobbying in the Capitol after 8 years of working “the building” as an intern and staffer (and bureaucrat for the Energy Commission!), I learned that when dealing with government, if one approach didn’t work, then try it again a different way until you were successful. This “wisdom” obtained through trial and error has truly allowed me to “thrive in my craft” over the years. Indeed, it worked “beautifully” as recently as this past Monday!

To wit, you may recall my previous discussion about the genesis of our SB 399 (Wright) this year (or maybe not)? John Malloy of John T. Malloy, Inc. was called out on an emergency basis to the state’s Ronald Regan Office Building in downtown LA last October to repair a “plugged up” sewer line. After John discovered that the problem was a broken sewer lateral line that went into the street, the project became more involved and took several days to repair.

Upon “providing relief” by successfully replacing the lateral, John sent the state a bill for his services. After repeated non-return phone calls, emails and other attempts at inquiries as to the status of his payment to the Department of General Services (DGS), John contacted me in early January asking for assistance to help obtain his payment. Since new Year’s week is nOT the week to try and contact anyone in Sacramento, and since I happened to have a meeting the following Monday in DGS’ executive offices, I postponed any inquiries until then.

Long story short, even after ascertaining the direct involvement of the top echelons of DGS, it took 6 more weeks to finally get John his payment! Even the bureaucrats were embarrassed and pledged to work with me this legislative session to help change the problems in

existing law that caused the delays.Right! And so began my journey to work

with DGS to make changes within existing law to ensure that the problems that befuddled John would never happen again! Senator Rod Wright, Chairman of the Senate Governmental Organization Committee agreed immediately upon my explanation of the issue, to author legislation to “fix” the problems. Then, SB 399 was introduced in spot bill form (vague language in the code that we were planning to amend which was our vehicle) to serve as our “blank canvas” to work with DGS to ensure we corrected the problem.

And wait I did! Turns out (shock of all shocks!) that DGS was merely giving me “lip service!” Days turned into weeks with no phone calls nor emails form the “wonks” at DGS. It seems that these folks figured that my bill would die and they could continue on with life in the “slow lane!” Little did they know!

The first thing I did, prior to the bill’s hearing in its policy committee, the Senate Governmental Organization Committee (remember, I got the chair of the committee to author the bill!, was to amend substance into it. So, the amended language stated that all contracts rendered on an emergency basis must be paid within 30 days from time of successful completion of the job.

This language was like “motherhood and apple pie” to the committee (of course having the chair as author certainly helped our cause, too!) and the bill “sailed” on consent out of the committee.

As expected, DGS was nowhere to be heard from. Why? Simply, they were going to play (as I fully anticipated) the “bureaucrat game” of whining that the bill would cause them great expense to have to process emergency contracts in such a fast track action (current law states they have 45 days). “They” planned to make this their reply when the bill came before the Senate Appropriations Committee, a committee where

any bill that “costs” the state over $50,000 is held in suspense and typically dies.

Remember, “There’s more than one way to skin a bureaucrat!”

This is why I love what I do! I fully recognized that this would be the response from the “wonks.” So, we simply amended the bill to take existing law and expand it to include emergency contracts. This language now states (for a very narrow group stated in existing law):

State agencies are required to pay undisputed invoices for goods or services provided under a contract within 45 calendar days. Thereafter, State agencies are required to pay a penalty at a rate of 1% above the Pooled Money Investment Account (PMIA) rate, up to a maximum of 15%, for payments not issued within 45 days of receipt of an undisputed invoice. If the claimant is a certified small business or nonprofit organization, the state agency must pay a higher penalty at a rate of 10% above the U.S. Prime Rate.

Simply, if the agency doesn’t do its job, then they should pay an additional 10% interest to these contractors! And, if they do their job, there should be no added costs to the state, period! And, if an agency is paying large amounts in penalties, there should be a beacon shining down on them to show the Legislature that “Houston, we have a problem!”

SB 399 was “up” in Senate Appropriations Committee this past Monday. Interestingly (or not!), DGS was nowhere to be found. Senator Wright and I both gave “eloquent” testimony stating the aforementioned, that if these agencies do their jobs, there will be nO added costs to the state. The vote was unanimous in support and our bill moves on to the Senate Floor where it will “sail” into the Assembly.

Tips for Teens in Construction The construction industry ranks third in the number of work-related youth fatalities, but you can help lessen or even eliminate this statistic by paying attention to all safety guidelines. The Basics

• If you are younger than15, you cannot work on construction sites by law.

• Make sure you have clear instructions on each and every task. If you do not understand, ask someone before beginning.

• Never perform a task you have not previously been trained to do.

• Trust your instincts about dangerous situations.

• Never work alone. • Make sure your personal protective

equipment (PPE) is properly sized. • Always work under proper supervision. • Stay sober and drug-free. • Try to familiarize yourself with the

federal and state youth employment laws; a good resource is the Department of Labor (www.dol.gov).

Prohibited Jobs Certain jobs are declared hazardous by the Fair Labor Standards Act (FLSA) and are therefore prohibited for youth under age 18. Specifically relevant for construction workers are:

• Driving a motor vehicle • Operating power-driven woodworking

machines (including drills and nail guns) • Operating forklifts, cranes, hoists or

elevators • Operating power-driven circular saws,

band saws and guillotine shears • Wrecking, demolition and shipbreaking

operations • Roofing operations • Excavation operations

Know the Hazards There are six main hazards you need to be aware of in the construction industry:

• Machines and tools – Moving machine parts have the potential to cause severe injuries. Any machine part, function or process that may cause injury must be safeguarded. Teens under age 18 should not be using this equipment, but it is important to be aware of the dangers regardless.

• Confined spaces – There are many instances in which workers must squeeze in and out of narrow openings and perform tasks while cramped or contorted. Suffocation is a main concern when doing these jobs.

• Electrocution – Overhead power lines are a main concern when working in construction. They carry tens of thousands of volts of electricity. Certain equipment (such as aluminum paint rollers or metal ladders) conducts electricity and can be fatal.

• Falls – Falling is the most common cause of death for construction workers. Fall protection is vital when working at heights above six feet.

• “Struck-by” – The second most common cause of death is being struck by an object or vehicle. It is important to pay close attention to alarms and horns when on the job.

• “Caught-between” – Be sure to stay alert when working around any large objects that might move. Being crushed is a scary but very real hazard on a construction site.

Before beginning any job, make sure that you understand the proper safety procedures and policies on the job site. Your supervisor can answer any questions you may have. Safety should always be your top concern.

You may work to earn spending money, buy a car, save for college or gain work experience. Whatever the reason, plans for your job and for your future don’t include you getting hurt.

Consejos para los adolescentes en la construcción La industria de la construcción se ubica en el tercer lugar en cuanto a la cantidad de fatalidades que ocurren entre los jóvenes en relación con el trabajo, pero puedes ayudar a reducir o incluso eliminar esta estadística al prestar atención a todas las pautas de seguridad. Los conceptos básicos

• Si tienes menos de 15 años, por ley no puedes trabajar en los sitios de construcción.

• “Atrapamiento” – Asegúrate de estar alerta al trabajar en torno a objetos de gran tamaño que podrían moverse. Ser aplastado es un peligro atemorizante pero muy verdadero en las obras de construcción.
