A Grand Jury convened to investigate the disclosure of confidential and protected personnel file information concerning several employees of the District Attorney’s Office. Before acting as legal advisor to this Grand Jury, I consulted with outside counsel to determine if there was a conflict of interest. I was confident and was advised that there was no conflict. I remain satisfied that no actual conflict has since arisen. Based upon my review of evidence received by the Grand Jury, I believe the best practice at this time is to appoint a special prosecutor. Given the nature and potential scope of this investigation, I believe having a special prosecutor who can independently review the evidence is now prudent.
