Before acting as legal advisor to this Grand Jury, I consulted with outside counsel to determine if there was a conflict of interest. I was confident and was advised that there was no conflict. I remain satisfied that no actual conflict has since arisen. Based upon my review of evidence received by the Grand Jury, I believe the best practice at this time is to appoint a special prosecutor. Given the nature and potential scope of this investigation, I believe having a special prosecutor who can independently review the evidence is now prudent.
