Summary: This measure increases the fee to $50 for smoking in restricted areas. Additionally, the measure establishes that a civil complaint under this measure cannot be more than $500.

Outlook:  This measure is scheduled be heard publicly January 22 and January 24. Hearings are only required to be posted within a reasonable timeframe and may be posted within 24 hours if the content of the hearing is urgent in nature. Traditionally, the first hearing of a bill in committee is reserved for testimony from the sponsor as well as invited testimony, however, the Chair Representative Matt Claman (D) may open up the hearing for public testimony at any time, even if not indicated prior to the hearing. ARIZONA

H.B.  2109  -  Self-Service Display,  Tobacco Age Restrictions 

Sponsor: Representative Paul Boyer (R)

Summary: This measure states that any person who sells, gives, or furnishes a tobacco product to a person who is 21 years of age or younger is guilty of a petty offense.

This measure states that a person shall not sell tobacco products through a vending machine unless the vending machine is located in an employee lounge area that is not open to the public and the business in which the lounge area is located does not employ minors any individual who is under 21 years of age.

This measure also states that a retail tobacco vendor may not sell or permit that sale of tobacco products unless a sign is posted at the location where the tobacco products are available for purchase, which states that a person under 21 may not purchase tobacco products.

State Outlook:  In Arizona, the Republican Party controls the House of Representatives, the Senate, and the Governor’s Office. A legislative session lasts 100 days, beginning the second Monday in January and adjourning in mid to late April. A session may be extended for seven days, but would require a simple majority vote in both house. Legislation is not eligible for carry over from one session to the next. A bill is formally introduced when it is first read in a chamber, however not all bills will receive a first reader and is considered dead without one. The Speaker of the House and the Senate President assign their respective bills to a committee for consideration. Once referred, a committee is not required to hear every bill referred to them but can act on any measure with unanimous consent from the members. During the committee process, committees can offer a

“strike-all” amendment, which will take a bill and turn it into something different than what was introduced. A bill can be referred to one or multiple committees and must be voted on by at least one committee in addition to the Rules Committee before being considered by the full chamber. While in the Rules Committee, a bill is reviewed to ensure that the measure is constitutional and in proper form, if not, the measure is killed. Once a bill has made it through the process thus far, leadership can place the bill on the consent calendar, meaning that there will be no floor debate on a bill, rather just a floor vote. For all other bills that are not on the consent calendar, the whole chamber will meet in what is known as the Committee of the Whole. During the meeting of the Committee of the Whole, members can offer amendments, discuss the bill, and vote on the measure by voice. Once a measure has passed both House and Senate, the final engrossed version is sent to the Governor for action. The Arizona budget process is completed on a biennial process, with the process beginning a full year before the budget goes into effect.  After State Agencies submit their requests, the Governor and Legislature come up with separate budget recommendations.  A.B.  1097  -  Smoking Bans 

Sponsor: Assemblymember Marc Levine (D)

Summary: Current version (1/3/2018): This bill would make it an infraction punishable by a fine of up to $25 for a person to smoke, as defined, on a state coastal beach or to dispose of used cigar or cigarette waste on a state coastal beach. The bill would establish a state-mandated local program by creating a new crime. This bill would require the Department of Parks and Recreation to develop and post signs at entrances or strategic locations, as determined by the Director of Parks and Recreation, of state coastal beaches to provide notice of the smoking prohibition. The bill would require the smoking prohibition to be enforced only after signs have been posted. The bill would authorize the Director of Parks and Recreation to designate, by posted order, areas within state coastal beaches as exempt from the smoking prohibition, as specified.

Outlook:  The measure passed in the Assembly Appropriations Committee 12-5. The measure now awaits further consideration in the Assembly.

The measure was heard in the in the Assembly Water, Parks, and Wildlife Committee and passed committee with a 10-4 vote. According to the author "Californians are fortunate to have a world class state parks system. Each year, millions of visitors from California and around the world visit our state parks to appreciate their natural beauty and enjoy the outdoors. When individuals smoke at state parks, they bother other patrons, litter at higher rates than other garbage, and poison the environment through runoff and consumption by animals. Limiting smoking at state parks will allow the state to honor our commitment to keeping our open spaces clean and healthy, and be more inclusive to those that want to visit parks without having to subject themselves to secondhand smoke"

This measure was amended into scope. This measure now creates a smoking ban on all public beaches. A similar measure was vetoed by Governor Brown (D) in the 2015, 2016, and 2017, due to fundamental differences. Last years vetoes stated "If people can't smoke even on a deserted beach, where can they? There must be some limit to the coercive power of government."

State Outlook:  The Democratic Party controls the Assembly, the Senate and the Governor’s Office. The Legislature convenes the first Monday of December of any even-numbered year and adjourns sine die November 30 of the following even-numbered year. The Legislature goes into recess at multiple times throughout session and may hold interim studies on certain measures. Bills left pending at the end of a session in an odd-numbered year may be carried over to the following session in subsequent even-numbered years. California will frequently introduce ‘spot bills’. These bills act as placeholders and will likely be amended later in session to contain the author’s true intent. When a bill is introduced, there is a 30-day cooling period before any action or votes can be taken on the measure. Measures can be referred to a policy committee and a fiscal committee. Measures are sent to a policy committee for a policy change, while measures that could have a fiscal impact are sent to a fiscal committee for review of the bill’s fiscal impact. Bills that require an appropriation or take effect immediately generally require 27 votes in the Senate and 54 votes in the Assembly for passage. Other bills generally require 21 votes in the Senate and 41 votes in the Assembly. Pursuant to recently adopted Proposition 54, the final version of bills must be online for 72 hours before a final vote in both chambers. The California budget occurs on an annual basis and contains policy and appropriations. The budget bill moves with other bills necessary to implement the budget, known as “budget trailer bills.” The Senate Budget and Fiscal Review Committee and the Assembly Budget Committee divide the budget into separate bills based on subject matter and refer the bills to relevant subcommittees. Summary: This measure would amend the state constitution to require a supermajority vote before:

1) Enacting any new state taxes and/or fees2) Raising any existing state taxes and/or fees

Also, this measure limits every future measure regarding tax to only 1 tax provision per measure.  This measure encompasses all forms a variances of taxes and/or fees and is not limited in it's scope.

Outlook:  This measure has passed the House Appropriations Committee by a vote of 20-8 on January 9. The measure now awaits consideration on the House Floor.  

This measure has been referred to the House Appropriations Committee where Representative Carlos Trujillo (R) serves as Chair. Representative Tom Leek (R), the member of the House Ways and Means Committee who is technically sponsoring the measure, does not serve on the committee of referral.

This measure is sponsored by the House Ways and Means Committee (specifically by Representative Tom Leek (R)) as a means to amend the state constitution regarding tax implementation and/or increases. Because this measure would directly amend the state constitution, it has been introduced in the form of a joint resolution. Generally, resolution type measures move faster through the legislative process than normal bills as they are (usually) only referred to a single committee, rather than multiple. This measure has been referred to the House Appropriations Committee, where Representative Carlos Trujillo (R) serves as Chair.

Representative Tom Leek (R) does not serves on the committee of referral.

Governor Rick Scott (R) provided personal input on the measure, stating that, "This legislature has shown that you are against raising taxes by cutting hundred of millions of tax dollars last year, but we need to work together to ensure this commitment will continue. I think it is important we don't raise taxes." The Governor also said he spoke with multiple businesses that were considering leaving due to harmful municipal and state taxes. Representatives from the National Federation of Independent Business and AFL-CIO were noted to be supportive of the measure, while a representative from Florida TaxWatch rendered support but would rather the margin of passage be 3/5 instead of the supermajority dictated in the current text. Currently, the constitution requires a 3/5 supermajority to increase the corporate income tax above 5%. If passed, Florida would join 11 other states that currently have a supermajority vote requirement for all tax increases.

This measure has been prefiled for the 2018 legislative session set to begin on January 9. In Florida, measures may receive consideration and be amended within committees of referral before session convenes.

The legislative session meets annually and lasts 60 days, convening in March and adjourning in May. Conforming bills amend the statutes to conform to an appropriations bill. These bills are generally drafted by each chamber’s respective appropriations committees and companions are often utilized to speed up the budget process. Once passed by the respective appropriations committees, each chamber will consider the measure on their respective chamber floors for further debate and deliberation. Summary: Current version (1/16/2018): This measure allows municipalities and counties to further restrict smoking within the boundaries of any public parks they own. The measure allows counties to further restrict smoking within any designated facility they own, which includes, but is not limited to, clinics, primary care centers, nursing homes, parking facilities, and the like.  

“Smoking” means inhaling, exhaling, burning, carrying, or possessing any lighted tobacco product, including cigarettes, cigars, pipe tobacco, and any other lighted tobacco product.

Summary: This measure would require that the license issued upon application and the payment fee of $500 shall be renewable annually on July 1 for the twelve months ending the succeeding June 30. Every wholesaler or dealer, in addition to any other taxes provided by law, will have to pay for the privilege of conducting business and other activities in the state. An excise tax equal to 22.50 cents for each cigarette or little cigar sold, used or possessed by a wholesaler or dealer on and after July 1, 2018, whether or not sold at wholesale or if not sold then at the same time upon the use by the wholesaler or dealer.

An excise tax to equal to 80 per cent of the wholesale price of each article or item of tobacco products, other than large cigars, sold by the wholesaler or dealer on and after July 1, 2018 if not sold at the same rate upon use by the wholesaler or dealer.

Summary: This measure would impose a $0.10 tax per fluid milliliter of consumable product on e-liquids that contain nicotine. This measure specifies that the tax is imposed on the distributor of the vapor product. The tax would be imposed at the time the distributor brings or causes vapor products to be brought into Indiana for distribution, manufactures or transports these products for resale by retail dealers. The measure also states that all invoices for vapor products must state the amount of consumable product in milliliters. 50% of the revenue from this tax will be deposited into the state general fund and the other 50% will be put into the addiction services fund.

INDIANA  H.B.  1281  -  Retail Licensing

Summary: This measure makes various changes to tobacco certification.  A person may not sell or distribute a tobacco product or e-cigarette at retail without a valid tobacco sales certificate issued by the commission. A separate certificate is required for each location where these products are sold or distributed. These certificates would be valid for three years. If a tobacco sales certificate has been revoked, the commission may not reinstate or renew the certificate for at least 180 days after the date of revocation.

The commission may reinstate or renew the certificate only upon a reasonable showing by the applicant that the applicant shall exercise due diligence in the sale of tobacco products or electronic cigarettes on the applicant's premises where the tobacco products or electronic cigarettes are sold or distributed and properly supervise and train the applicant's employees or agents in the handling and sale of tobacco products or electronic cigarette (pg. 8-9).

From January 1, 2020 to December 31, 2021, the state sales tax shall be imposed on all sales and services, other than those exempted by the amendment, at a rate not to exceed 5%. Beginning January 1, 2022, the total of the state sales tax, conservation sales tax, and the parks and soils sales tax shall not exceed 8%.

Summary: This measure increases, from 30% to 68%, the general tax rate imposed on tobacco products under the tobacco products wholesale sales and use tax, increases, from $0.75 per ounce to $2.25 per ounce, the current weight-based tax on moist snuff and establishes specific per unit rates of tax for certain other tobacco products, as follows: $2.70 for each cigar, $0.54 for each cigarillo, $0.135 for each little cigar, $0.135 for each single-dose smokeless tobacco product, and $4.15 per ounce for cigar and pipe tobacco.

The measure changes the base of the tobacco products wholesale sales and use tax by reestablishing the wholesaler's price charged by the wholesaler upon their sale of any tobacco product to a retail dealer as the base upon which the tax is determined.

The measure requires licensure by the Division of Taxation in the Department of the Treasury in order to operate as a manufacturer, distributor, wholesaler or retailer of tobacco products.

This measure amends P.L.2000, c.87 (C.2A:170-51.4), which prohibits sale or distribution of tobacco products to persons under 19 years of age and provides that a cigarette retail dealer license may be suspended or revoked for a violation of this prohibition, to provide that a retail license issued under the bill for other tobacco retailers may similarly be suspended or revoked

It states, the owner of a pharmacy that violates this prohibition will be subject to a civil penalty of not less than $250 for a first violation, not less than $500 for a second violation, and $1,000 for a third or subsequent violation, and the pharmacy may be subject to disciplinary action by the Board of Pharmacy. Nothing in the measure is to be construed to prohibit the sale of smoking cessation products approved by the federal Food and Drug Administration.

Defines "e-cigarette" as any electronic oral device that can be used to provide a vapor or aerosol of nicotine or any other substance to the person inhaling from the device; and includes any such device, or any part thereof, whether manufactured, distributed, marketed or sold as an e-cigarette, e-cigar, e-pipe or any other product, name or descriptor.

Sets percentages of distribution for general school fund from revenue garnered from the cigarette tax.

To simplify record keeping requirements, distributors will provide customers with an invoice of total product sold in milliliters. (page 20)

The recommendations also change the definition of “wholesale price” to the invoiced price for which a manufacturer or distributor sells tobacco products to a New York State registered tobacco distributor. The current definition of “wholesale price” is the result of litigation and has resulted in revenue losses as it relies on the industry to determine the tax on its own products through a pricing survey. This measure defines "Vapor product" as any noncombustible liquid or gel, regardless of the presence of nicotine therein, that is manufactured into a finished  product for use in an electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, vaping pen, hookah pen or other similar device. However, "Vapor product" shall not include any product approved by the United States food and drug administration as a drug or medical device, or approved for use pursuant to section three thirty-three hundred sixty-two of the public health law. While electronic cigarettes do not contain tobacco, they contain nicotine which has been proven to be addictive, have negative effects on working memory, cause attention issues, and create cognitive and behavioral impairments on youth."

According to the sponsor:  E-cigarette use is often touted as a safer alternative to using traditional tobacco products or as a method to quit smoking. The truth is that e-cigarettes are harmful to health and not a proven method of cigarette cessation. E-cigarette vapor can contain a variety of dangerous chemicals including cadmium, formaldehyde, diacetyl and benzene. Heavy metals like lead, tin and nickel can be present. It is the nicotine in e-cigarettes that makes using them highly addictive, the same as for traditional cigarettes. E-cigarettes are most commonly used among teenagers and young adults. New York's young people are at serious risk for becoming addicted to these products. In fact, a recent study showed that teens who use e-ci- garettes are much more likely to pick up smoking. E-cigarette use among teens doubled between 2014 and 2016. It is time to treat e-cigarettes and other vape products like the addictive tobacco products they mimic so well. That includes taxing them like cigarettes. E-cigarettes are a threat to public health and without action will trap a new generation of New Yorker's in the grips of addiction.

At the beginning of session, the House frequently uses shell bill. "Electronic cigarette" means an electronic device used to deliver or capable of delivering vapor containing nicotine to an individual's respiratory system, a component of the device, or an accessory sold in the same package as the device.

"Smoking" means the possession of any lighted or heated tobacco product in any form, inhaling, exhaling, burning, or heating a substance containing tobacco or nicotine intended for inhalation through a cigar, cigarette, pipe, or hookah, and using an oral smoking device intended to circumvent the prohibition of smoking. 

"Tobacco" does not include a cessation product specifically approved by the United States Food and Drug Administration for the cessation of tobacco use.

Summary: This measure prohibits the sale in Virginia of any item known to be made with the parts of any of 16 listed endangered, threatened, or extinct animals. The bill provides exceptions for certain documented antiques, musical instruments, knives, firearms, and other items. The bill provides that a violation of the prohibition is punishable as a Class 1 misdemeanor and requires that the violator pay a civil penalty of as much as $6,500 or an amount equal to four times the fair market value of the item that is the subject of the violation, whichever is greater. Civil penalties will be deposited in the Game Protection Fund.

More specifically, this measure states that no person in Virginia shall purchase from, sell to, offer for sale to, or possess with intent to sell to another person in Virginia any item that the person knows or should know contains or is made of, wholly or partially, an animal part or by-product that is derived from any species of elephant, rhinoceros, whale, tiger, lion, leopard, cheetah, jaguar, pangolin, sea turtle, shark, ray, mammoth, narwhal, walrus, or hippopotamus that is extinct or appears on any list of threatened or endangered species published by the U.S. Secretary of the Interior pursuant to the provisions of the federal Endangered Species Act of 1973.

The Governor and the Legislature can call for a special session, which may last up to 30 days and during which any bill can be considered.

Upon introduction, a bill may be referred to a committee, though committees are not required to hear every bill referred to them. There are three types of committee meetings: work sessions, public hearings, and executive sessions. Committees discuss bills during work sessions, receive public testimony during public hearings, and typically vote on a measure during an executive session. A measure may have a work session, public hearing, and executive session during the same meeting. If passed, a bill is referred to the Rules committee, which then determines if the bill is placed on the calendar. After certain cut-off dates, the Senate Rules Committee may place bills no longer eligible for consideration in the “X” File. Measures on the X-File usually remain in the X-File until the end of the biennium.

Amendments can be made in committee or on the floor, but they must be germane to the original bill. Budget bills functionally are exempt from this rule, however, due to the broad nature of the bills. When all amendments have been considered and debate is over, the bill is engrossed and moves to third reading, at which point they cannot be amended. If there are differences between the House and Senate versions of the bill, a conference committee is appointed to resolve differences. If a report is passed by the committee, it goes back to the House and Senate for final approval. After the report passes both chambers, the final bill is sent to the Governor for action.

Summary: The measure provides that forms for cigarette and tobacco products retailer licenses are not required to be notarized. Under this measure, the municipality, and any form used as an application for a cigarette and tobacco products retailer license, may not require the applicant's signature to be notarized. Under the measure, a person who knowingly provides materially false information in an application may be subject to a forfeiture of up to $1,000.

State Outlook:  The Republican Party controls both chambers of the Legislature and the Governor’s Office. The Legislature operates in a biennium. Sessions begin in January of odd-numbered years, then reconvene the following January for the second year. The odd-numbered year of a regular session lasts the entire year, while the even-numbered year's length varies, as session lengths are not mandated. Bills left pending at the end of a session in an odd-numbered year may be carried over to the following session in subsequent even-numbered year.

The Wisconsin budget process occurs on an annual basis and contains policy and appropriations. A budget bill is drafted by the Governor and presented to the Joint Finance Committee. Multiple hearings in the Joint Finance Committee occur to amend the measure. Once passed by the Joint Finance Committee, each chamber considers the measure on their respective chamber floors for further debate and deliberation. After passage, the final budget is sent to the Governor for approval.
