PREFACE

This is the fourteenth report from the Office of Crime Statistics on proceedings in Courts of Summary Jurisdiction in South Australia. These reports complement the Office's regular summaries of juveni Ie and Higher Cr i m ina I Court appearances and 0 f fences repor ted or becom i ng known to South Austral ian Pol ice, and its statistics on the operations of the Correctional Services system (see even-numbered reports in the Crime and Justice series).

The Courts of Summary Jurisdiction collection was implemented on 1 January 1979. For the first six months coverage was limited to the Adelaide Magistrate's Court, but from 1 July 1979 scope was extended to cases heard throughout the State. A I ist of contributor courts is in Appendix C.

In 19B2, the system was comprehens i ve I y rev i sed. These changes related to cases heard from 1 July 19B2 onward. Among the most important were adoption of an Act and Section system of offence-codes, inclusion of restraint orders under Section 99 of the Justices Act (and breaches of these orders), refinement of case-outcome codes and collection of data on previous simi lar offences by persons charged with drink-driving or drug offences.

To complement the information in these six-monthly reports, tile Office of Crime Statistics also provides a special ised information serv i ce f or members 0 f t he I ega I pro f ess i on and researchers. Users generally are charged a fee covering computing costs and labour. Details are available from the Office (10th floor, S.G.I.C. Building, 211 Victoria Square, Adelaide - telephone 237 0110).

It would not be possible to provide statistics from Courts of Summary Jurisdiction without the assistance of numerous individuals. Clerks of Court throughout the State have contr i buted time and ef fort to collecting data on cases heard in their courts. Within the Office of Crime Statistics, David Burton was responsible for day-to-day management of the system and Valija Kalnins assisted in monitoring the quality of input forms received. The Office's Statistician Adrian Barnett, and Project Officer Jul ie Gardner undertook the computer analysis of data. Lesley Gi les typed the report and the Word Processing section of the Attorney-General's Department provided assistance with the tables. Clerical officers from the South Austral ian Pol ice Department coded all information on the backgrounds of defendants.

SUfNAARY

During the final six months of 1985, Criminal Courts of Summary Jurisdiction dealt with 13,101 appearances by deiendants facing charges which fel I within the scope of the Office of Crime Statistics' collection. This was 5.7% lower than the preceding six months, and 10.6% fewer than the same period in 1984.

Main trends in appearances compared to the prior six months were a f a I I by 27% in the number of drug of fences heard and an increase by 45.6% in cases involving larceny (other than shop theft).

Young males aged between 18 and 24 years accounted for 42.3% of all defendants appearing before Courts of Surnmar~' Jurisdiction. Defendants charged wi th shop thef t, sexua I of fences or issued wi th restraint orders were older than other groups of defendants.

The rate of appearances per 1,000 unemployed people was 110.2 during the six months July - December 1985, whereas the rate for employed people was 10.9. COJntry regions had higher rates of appearances (15.5 per 1,000 adult population) than metropolitan rElgions f13.5 per 1,000 adult population).

Although the majority of defendants (65.1%) had some legal represen­tation, two thirds of those whose cases required only one hearing were not represented.

PART 1 - OVERVIEW

Introduction

This report provides a statistical overview of criminal matters dealt with in South Australian Criminal Courts of Summary Jurisdiction dur i ng the f ina lsi x months of 1985. Each year, these Summary Courts hear more than 100,000 cases. Because of resource constraints, the Office of Crime Statistics' collection is limited only to a selected range. Relatively minor cases involving such charges as breaches of local authority by-laws and lesser traffic offences have been excluded. Append i x 8 lists the more sign if i cant Acts not inc I uded in stat i st i cs.

The report also does not extend to matters involving persons under eighteen years of age, whose charges generally are heard and disposed of before Chi Idren's Courts or Chi Idren's Aid Panels. Statistics on these cases are contained in other Crime and Justice reports (the 'blue' series).

The following pages contain a brief overview of the main trends to emerge in the six months 1 July - 31 December 1985. Detai led tables on these cases are in Part 2. Before ana I ys i ng these figures it is important to be aware of some background points about court statistics.

Understanding Court Statistics

A key to understanding court statistics is the distincl'ion between court and police figures, and of the phenomenon of unreported crime. Court figures such as those in this report count numbers of appear ances by a I I eged 0 f f enders who have been arres ted or summonsed to answer some charge. Po lice figures, on t he other hand, coun t the actual number of offences reported or Which pol ice themselves have detected. Police figures do not always accurately reflect the incidence of cr ime. For a var i ety of reasons - for examp I e the fact that offender and victim were close relatives or friends, or the crime itself was considered trivial, or there was no obvious victim - many crimes do not come to the attention of pol ice. Court figures are even less likely to reflect crime rates because not all offences result in an arrest, or if a person is charged he or she may be dealt with simul­taneously for several offences. In addition, times elapsed between the commission of an offence and the final court appearance by a defendant are not always consistent, so it is not possible to argue that court appearances relate to crimes committed during a specific period. Rather than being used as evidence of crime rates, court statistics should be seen as indicators of the way the criminal justice system functions, the characteristics of persons being arrested and the penalties being imposed for various types of ' offences.

Accuracy and Completeness of the Collection

Every effort is made to ensure that the Courts of Summary Jur i s­diction collection is accurate and complete, but caution should be exercised in interpreting some data items - in particular those relating to the backgrounds of individuals appearing. These are based on items in the Police Department's apprehension reports and criminal history files. It is possible that on occasions, persons arrested may give misleading Information. Moreover, where the South Austral ian Pol ice Department did not lay the initial complaint, or where there was no finding of guilty, data on the characteristics of the defendant could not always be recorded. As mentioned earl ier, not all criminal offences result in court appearances. Some segments of society, because of their I ifestyle and lack of resources, are more vulnerable to prosecution for their offences.

Trends in Appearances

Between 1 July and 31 December 1985, there were 13,101 appearances by defendants facing charges which fel I within the scope of the Office's Courts of Summary Jurisdiction statistical collection. This figure represents a decl ioe of 5.7% from the previous six months and a 10.6% decrease in appearances when compared wi th the same per i od in 1984.

The main contributor to this decl ine was a fall by 27% in the number of drug offences heard during the last half of 1985 (see Table 1, oppos i te page). It is like I y that the number of drug cases wi II further dec line when I on-t he-spot I fines for t he possess i on or use 0 f sma I I amounts of cannab i s are introduced in Apr i I 1987. Dur i ng the current reporting period the majority (78.8%) of drug cases involved either possession of Indian Hemp or instruments for its use, with only a few defendants being charged with possession of heroin or other drugs. If current trends are maintained, approximately four out o~ every five people currently charged with a drug offence will be diverted from Courts of Summary Jurisdiction.

Although there was an overal I appearances in the six months July cases f ina I i sed re I at i ng to larceny and restraint orders increased (by

downturn in the number of court to December 1985, the number of offences (other than shop theft)

45.6% and 23.3% respectively).

Driving offences comprised the largest single category of cases heard in Courts of Summary Jurisdiction. Nearly one in every four cases heard during the current reporting period related to either drink/driving, driving in a manner dangerous or driving whi Ie disqual i­fied. Serious offences such as robbery or sexual offences comprised only a small proportion of total cases heard (,5% and .6% of total cases respectively).

Case Outcomes and Penalties

Tables 2.1 through to 2.35 contain statistics on case outcomes and pena It i es for each type of major charge. Deta i I s on the methods used in compi I ing these tables are in the appendix to this report. The majority (81.5%) of people appearing before a Court of Summary Jurisdiction were found gui Ity of either the major offence charged or a lesser offence. The remainder were either committed to a higher criminal court for trial or sentence (2.7%) or the case was dismissed or withdrawn (15.5%)*. Less than one percent of defendants were acquitted of their major charge (.1%). Fines comprised just over half (52.0%) the penalties imposed for all offences during the six mon t hs J u I Y to December 1985. These ranged in va I ue from $5 to $4,300 (the later was for a customs offence). The average (mean) fine of $141 was $25 more than the preced i ng six mon t hs. A suspens i on 0 f a driver's I icence was the next most commonly imposed sanction (26.7%): a pattern consistent with the high proportion of driving offences among total offences. Type of penalty varied, however, according to the offence convicted. For example, 31.1% of people convicted with break and enter offences were imprisoned, six times the average rate of imprisonment (5.5%). Nearly all drug offenders (94.6%) received a fine.

Background of Defendants

Tables 2.36 to 2.43 contain detai Is on the backgrounds of defendants. The aver age I mean) age 0 f a I I de f endan t s was 28.9 year s. The average age for males was 28.2 years whi Ie female defendants were sl ightly older wi th an average age of 31.6 years. Young ma I es aged between eighteen and twenty-four years had by far the highest rate of appearances before Courts of Summary Jurisdiction. This group alone accounted for 42.3% of all defendants. Males were also far more I ikely to appear than a female. While the rate of appearances per 1,000 adult males was 18.9, for females the rate per 1,000 was only 3.9. Over a third (37.8%) of the ma I es charged wi th break and enter of fences were aged nineteen years or less, even though only 20.2% of all male defendants were in this age group. Whi Ie 12.8% of male defendants were aged over forty years, 41. 7% of ma I es charged wi th shop thef t were in th i s older age bracket. Males charged with sexual offences or issued with restraint orders also tended to be older than other defendants. The aver age age of these defendan t s was t hi r t y-two years, and near I y a quarter of the males in these offence groups were aged forty or more. It should be noted however, that the age of the recipient was unknown for a high percentage of restraint orders. Female shopl ifters, I ike their male counterparts, also tended to be older than other Summary Court de f endan t s. The average age 0 f f ema I es charged with shop the ft was 38.3 years, and 25.7% were aged over fifty. Females charged with drug offences have an average age of twenty-five years with 57.2% being aged between eighteen and twenty-four. Wh i I e a high percentage of defendants (45.7%) were employed, the unemployed were overrepresented.

The rate of appearances per 1,000 for employed people was 10.9, whereas the rate for per 1,000 for unemployed people as 110.2. Other background detai Is on defendants include marital status (62.8% never married), birthplace (53.1% born in South Austral ia), and normal place of residence. The metropolitan areas of Hindmarsh and Elizabetr. had the highest rate per 1,000 of defendants [29.6 and 27.3 respectively), while Brighton and Mitcham had the lowest rates (6.2 and 6.5 per 1,000 respectively). Country regions generally had higher rates of appearances than metro­pol itan regions (15.5 compared with 13.5).

Previous Convictions

Table 2.44 contains figures on the defendant's number of previous conv i c t ions (if any) and whe t her t hey had served a pr i son sen tence prior to their current court appearance. Although a high proportion of defendants (43.6%) had no prior convictions, 17.9% had previously been imprisoned. Defendants charged wi th break and enter were most I ikely to have been imprisoned [40.2%), whi Ie those issued with restraint orders or charged with shop theft had the lowest proportions (2.5% and 9% respectively).

The Court Process

Tables 2.45 to 2.47 examine detai Is of the court process, such as bai I, legal r'epresentation and plea entered. Very few defendants appearing between July and December 1985 had been in custody (5.5%) prior to their final hearing in the Court of Summary JuriSdiction. Although 65.1% of defendants had some legal representation at their f ina I cour t appear ance, two t hi r ds 0 f t hose whose cases requ i red on I y one hearing were not legally represented. Most defendants (72.6%) pleaded guilty at their final court appearance and only 3.5% entered not gui Ity pleas.

APPENDIX A - EXPLANATORY NOTES ON TABLES

(1) The Courts of Summary Jurisdiction Data Collectio~

A form for each defendant involved in a case finalised in a Criminal Court of Summary Jurisdiction and which involved at least one charge falling within the Office's collections (see Appendix B) is coded by Court Services Department staff onto a data collection form, (see Appendix D). This form is then sent to the Office of crime statistics. The first 23 questions contain information derived from court files, which is punched and added to a data base.

The second half of the form relates to the defendant's social background and previous convictions, and is sent on to the Police Department for completion. After being returned from the police Department and punched, this information also is merged with the data base.

(2) Definitions

(i) Offence categories: Offence categories are based on the Act and section under which the defendant was charged (contact Office of Crime Statistics for a detailed list of offences under each code).

(ii) Major charge: The 'major charge' in tables 2.1 to 2.18 is the major offence for which a defendant was cha ~ged or convicted. This is determined by the following procedures.

(a) out of the charges, if any, for which the defendant was convicted, select the one which received the highest penalty. If two charges received the same (highest) penalty, select the one for which the highest maximum penalty is prescribed in the statutes. If all statutory penalties are the same, select the first charge listed on the coded form. The charge selected by this method is the 'major charge convicted'.

If two or more charges not ,convicted have the same maximum statutory penalty, select the first listed on the coded form. The coarge selected by this method is the 'major charge not convicted I •

(c) From the 'major charge conv'icted' and the 'major charge not convicted', select the cberge which has the highest maximum statutory penalty. If the 'major charge convicted' and the 'major charge not convicted' have the same maximum statutory penalty select the major charge convicted. The charge selected by these rules becomes the major charge.

Offence Type: To enable broad comparisons, ~ffences have been grouped into seventeen major type-§> (see Table 2.1). Tables 2.2 to 2.18 show which specific offence-codes are contained in each of these br.oad categories. ' The category 'Restraint Orders and Breaches' refer to restraint orders laid under section 99 of the Justices Act which came into effect on 3 June 19.82, and to breaches of these orders. Note that details of breaches refer to the nature of the original order, rather than the circumstances of the breach (eg. 'Breach, Assault Female' refers to breach of an order originally imposed after an all.eged assault on a female).

outcomes: In Tables 2.1 to 2.18 the case outcome is defined as follows.

Committed for trial or sentence: The defendant was committed for trial or sentence in the Supreme or District Criminal Court (see Crime and Justice 'Blue' reports for details of penalties, ~tc. in these cases).

convicted with penalty/without penalty: The defendant was found guilty and a criminal conviction recorded. In most of ·these cases a penalty is awarded, but in some no penalty is imposed but the defendant pays court costs.

Guilty without conviction: The defendant was found guilty but no conviction was recorded. In these circumstances the defendant can be given a penalty, such as a bond, but not a monetary fine (see Section 4 of the Offenders probat.ion Act).

Guilty of lesser offence: The defendant was found not guilty of the major charge but guilty of a lesser offence and a sentence was handed down.

Acquitted on major charge: The defendant pleaded not guilty to the major charge and was acquitted.

Major charge withdrawn: The major charge was withdrawn by the complainant.

Major charge dismissed: The magistrate decided, after hearing the evidence, that there was no case to answer and dismissed the charge.

other (eg. 'defendant died'): The case was finalised when the defendant died or was found to be unfit to plead.

(v) Plea: A defendant can enter:

a guilty plea: in these cases a defendant may be found guilty (with or without a conviction recorded) in the Court of Summary Jurisdiction, or may be committed for sentence in the Supreme or District Criminal Court.

a guilty 4A plea: in these cases the defendant sends the court a 'Guilty 4A' form which admits guilt, and sentence is passed without the defendant being required to appear in court (see section 57A of the Justices Act for details of this procedure).

a not guilty plea: in these cases a trial takes place before a magistrate who determines both outcome and sentence, or if the defendant wishes to be tried before a judge he or she can be committed for trial in the Supreme or District criminal Court.

no plea: in these cases the complainant has withdrawn the charge, or a magistrate finds no case to answer, or the defendant has 'reserved' his or her defence and been committed to the Supreme or District criminal Court.

(vi) Penalty: Once a defendant has been found guilty, the following penalties - listed in order of severity -may be imposed:

immediate imprisonment suspended imprisonment bond with supervision bond without supervision community service order (as part of a bond) suspension of driver's licence monetary fine other order (eg. restitution, conf iscation of drugs) sentenced to the rising of the court no penalty

(vii) Major penalty: The major penalty is the most severe penalty handed down (see above for order of severity) •

(3) Offence categories

Offence categories are based on the acts, sections and sub-sections where offences are defined and penalties prescribed. please contact the Office of crime statistics (Tel. (08) 237 0110), for acts and sections included in each offence code.

(4) Tables

Tables 2.1 - 2.18 Case Outcome and Major Charge

For each court appearance which was finalised during the six month period covered in this report, only the outcome for the major charge is recorded (see earlier definition of major charge).

Each table refers to appearances by individual defendants. For example, if four co-defendants were tried and convicted jointly for an offence which they committed together, each would be recorded separately in the case outcome and sentencing tables. An individual tried or sentenced on two separate occasions within the same reporting period would be recorded twice. It also is possible that in some instances (namely committals) the Crown may have formulated charges against an individual, wi thdrawn them, but then subsequently re-charged the same person for the same or additional offences. These cases also would appear more than once in the tables.

Table 2.1 is a summary and tables 2.2 to 2.18 give a breakdown for each offence type.

Where defendants have not been convicted on the major charge but were convicted on another less serious charge, the number of cases involving lesser charges is shown in brackets. Some of those 'lesser' charges may be for offences in groups other than the major charge - ego a person charged with assault (an offence against the person) may eventually be found guilty only of offensive language. In such instances cases are shown in the penalty tables for the offence group which they were convicted. Thus in the example given the case would appear in the outcome tables for offences against the person, but in the penalty tables for minor street offences. This is a change from reports prior to July December 1985, in which cases always appeared in the same offence group for both outcome and penalty tables. This means that it is no longer possible to compare totals in corresponding outcome and penalty tables except for overall totals in the two summary tables (Tables 2.1 and 2.19).

Tables 2.19 - 2.35 Major Penalty for Major Charge Convicted E'or each defendant convicted, the most serious

penalty is recorded (order of severity given in Section 2, (vi) ) • The numbers receiving each type of penalty are recorded, as well as the minimum, average (mean), and maximum for direct imprisonment (weeks) and monetary fines ($'s).

Table 2.19 is a summary table for each offence type and tables 2.20 to 2.35 give a breakdown for offences within each offence type. There are no penalty tables for the Sexual Offences group since these cases were preliminary committal hearings.

Tables 2.36 - 2.37 Penalties for defendants convicted of Driving with more than the Prescribed Content of Alcohol (PCA)

These two tables summarise the penalties imposed, and blood alcohol content, of persons convicted of PCA offences. Blood alcohol content (BAC) is broken down into: 0.08 up to 0.10; 0.10 up to 0.15; 0.15 up to 0.20; 0.20 up to 0.25; 0.25 and over, and Unknown BAC.

Table 2.36 gives the penalties for all defendants and table 2.37 for those who have had no prior convictions for drink drive offences.

As pointed out in discussion of the case outcome tables (2.1 2.18), penal ties for persons convicted of 'lesser' offences are included under the offence group for the major charge, even if the offence group for the major charge is different from the lesser offence (eg. major charge assault police; but found guilty of .lesser offence of resisting arrest). All the lesser offences which are of a different offence type are included as 'other offence' entries in the penalty tables. This ensures that for each major offence group, the numbers in the penalty tables are equal to the total number of convictions for the major charges in this group plus the total convictions for lesser offences.

Tables 2.38 to 2.43 Sex, Age, Occupation, Marital Status, Country of Birth and Residence of the Defendant

One entry appears in each of these tables for each appearance by a defendant. These background items refer to the status of the defendant at the time of arrest (as recorded by the police Department). The country of birth table distinguishes defendants with aboriginal backgrounds from all other persons born in Australia. The group 'Australia Unspecified' denotes that the defendant was born in Australia, but that the particular State was not recorded. Residences of defendants are grouped into Local Government Areas in Metropolitan Adelaide (Table 2.42) and non Metropolitan Adelaide (Table 2.43).

Table 2.44 prior Convictions of defendant For each appearance by a defendant, a summary is

given of previous convictions and previous imprisonment. Only for defendants with less than 10 previous convictions is the actual number of convictions recorded. For those wi th 10 or more, the numbers are rounded upward to the nearest 10 (ie. 10 = 10, 11 = 20). Defendants with 90 or more previous convictions are recorded as 90.

Table 2.45 - 2.46 Bail Status and Legal Representation of Defendant.

'Bail Status' is at the final court appearance. For defendants with only one court hearing, therefore, this refers to police bail. For those with two or more hearings the bail status has been accorded by the court. 'Legal Representation' refers to whether the defendant was legally represented at the final court appearance. The term 'Duty Solicitor' refers to solicitors rostered to service courts under the Law Society's Duty Sol ic i tor Scheme. ' Other' legal representation refers to solicitors from legal aid organisations and private solicitors. Tables 2.45 and 2.46 distinguish between cases which required only one court hearing, those needing two or more court appearances, and defendants committed for trial or sentence.

Table 2.47 Offence Type and Final plea The 'Final Plea' refers to the plea entered to the

major charge at the final court appearance. This can be either 'Guilty', 'Guilty 4A', 'Not Guilty' or 'No Plea'. Table 2.47 distinguishes pleas given by defendants committed for trial or sentence.

Australian Bureau of statistics Population Statistics Tables 2.38 - 2.43 give a rate of appearances per

1,000 in the relevant South Australian population (eg. Aboriginals, unemployed people, etc.). The popUlation figures used in calculating these rates are derived from the 1981 Census.
