    THE EUROPEAN COMMISSION,

    Having regard to the Treaty on the Functioning of the European Union,

    Having regard to Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market (1), and in particular Article 9(4) thereof,

    Having regard to Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market (2), and in particular Article 10(4) thereof,

    Having regard to Council Directive 2002/99/EC of 16 December 2002 laying down animal health rules governing the pro-duction, processing, distribution and introduction of products of animal origin for human consumption (3), and in particular Article 4(3) thereof,

    Whereas:

    2014/709/EU (1) Council Directive 2002/60/EC (4) lays down the minimum measures to be applied within the Union for the control of African

    swine fever, including the measures to be taken in the event of an outbreak of African swine fever on a pig holding and in cases where African swine fever is suspected or confirmed in feral pigs. Those measures include plans to be developed and implement-ed by Member States, and approved by the Commission, for the eradication of African swine fever from a feral pig population.

    (2) African swine fever is present in Sardinia, Italy since 1978, and has since 2014 been introduced in other Member States situated in Eastern Europe including Estonia, Latvia, Lithuania and Poland from neighbouring third countries where that disease is widely present.

    (3) In order to focus the control measures and to prevent disease spread as well as any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the concerned Member States urgently established infected areas and areas at risk for infection that were defined at Union level in collaboration with the Member States concerned by means of Commission Implementing Decisions that were consolidated by Commission Implementing Decision 2014/178/EU (5). That Decision also lays down animal health control measures on the movement, dispatch of pigs and certain pig products and marking of pigmeat from the areas set out in the Annex to that Decision in order to prevent the spread of that disease to other ar-eas of the Union.

    (4) Commission Decision 2005/362/EC (6) approved a plan submitted by Italy to the Commission for the eradication of African swine fever in feral pigs in Sardinia and Commission Implementing Decision 2014/442/EU (7) approved the plans for the eradi-cation of African swine fever in feral pigs in certain areas of Lithuania and Poland.

    (5) African swine fever can be considered an endemic disease in the domestic and feral pig populations of certain third countries bordering the Union and represents a permanent threat for the Union.

    (6) The disease situation is liable to endanger the pig herds in unaffected areas of the Member States currently concerned by the disease namely Estonia, Italy, Latvia, Lithuania and Poland well as pig herds in other Member States, notably in view of trade in commodities from porcine animals.4

    (7) Estonia, Italy, Latvia, Lithuania and Poland have taken measures to combat African swine fever within the framework of Di-rective 2002/60/EC and Estonia and Latvia are due to submit their plans for the eradication of African swine fever in feral pigs to the Commission for approval in accordance with Article 16 of that Directive.

    (8) It is appropriate that the Member States and areas concerned are listed in an Annex differentiated by the level of risk. The differ-ent parts of the Annex should consider the epidemiological situation of African swine fever including whether it concerns both pigs holdings and the feral pig population (Part III and IV), only the feral pig population (Part II) or the risk is due to certain proximity to the infection in the feral population (Part I). In particular it should be differentiated whether the epidemiological situation has been stabilised and the disease has become endemic (Part IV) or the situation is still dynamic with uncertain evolu-tion (Part III). However, the classification of Member States' territories or parts thereof as Parts I, II, III and IV according to the swine population concerned may need to be adapted by taking into account additional risk factors due to the local epidemiologi-cal situation and its evolution, especially in newly infected areas where less experience on the disease epidemiology under differ-ent ecological systems is available.

    (9) In terms of risk of spread of African swine fever, movements of different porcine commodities pose different levels of risk. As a general rule the movement of live pigs, their semen, ova and embryos and animal by-products of porcine origin from infected ar-eas pose higher risks in terms of exposure and consequences than the movement of meat, meat preparations and meat products as indicated in the Scientific Opinion of the European Food Safety Authority of 2010 (8). Therefore, the dispatch of live pigs and their semen, ova and embryos, animal by-products of porcine origin as well as the dispatch of certain meat, meat preparations and meat products from certain areas in Member States listed in Parts I, II, III and IV of the Annex to this Decision should be prohibited. This prohibition includes all Suidae as referred to in Council Directive 92/65/EEC (9).

    (10) In order to take account of the different risk levels depending on the type of porcine commodities and the epidemiological situa-tion in the Member States and areas concerned, it is appropriate to provide for certain derogations for each type of porcine commodity from the territories listed in the different parts of the Annex hereto. Those derogations are also in line with the risk mitigation measures for importation as regards African swine fever indicated in the Terrestrial Animal Health Code of the World Organization for Animal Health. The additional safeguard measures and animal health requirements or treatments of the respec-tive commodities applicable in case such derogations are granted should also be provided for in this Decision.

    (11) Due to the current epidemiological situation and for precautionary reasons the concerned Member States, Estonia, Latvia, Lith-uania and Poland, have established new areas of a sufficient and appropriate size as described as Parts I, II and III of the Annex to this Decision that are adapted to the current epidemiological situation and where adequate restrictions for movements of live pigs, semen, ova and embryos and fresh pig meat and certain pig products apply. The situation as regards African swine fever in Sardinia, Italy, differs from that in other Member States due to the long lasting endemicity of the disease in this part of the Italian

    territory and the insular geographic location; it is therefore deemed necessary to have Part IV in the Annex to this Decision to continue covering the whole territory of Sardinia in Italy.

    (12) The veterinary restrictions currently applicable are particularly stringent for the areas listed in Part III of the Annex to this Decision and which therefore may lead to logistic and animal welfare problems in case the slaughtering of pigs in the respective areas is not possible, in particular due to the absence of an appropriate slaughterhouse or limitations in slaughtering capacity within the relevant areas listed in Part III.

    (13) The movement of live pigs for immediate slaughter poses less risk than other types of movements of live pigs provided that risk mitigation measures are in place. It is therefore appropriate that when the above described circumstances concur the Member States concerned may exceptionally grant derogations for the dispatch of live pigs from the areas listed in Part III of the Annex for immediate slaughter to a slaughterhouse located outside that area in the same Member State provided that rigorous condi-tions are met in order not to jeopardise disease control.

    (14) Council Directive 64/432/EEC (10) and Commission Decision 93/444/EEC (11) provide that health certificates are to accompany the movements of animals. Where derogations from the prohibition on the dispatch of live pigs from the areas listed in the Annex to this Decision are applied to live pigs intended for intra-Union trade or for export to a third country, those health certificates should include a reference to this Decision so to ensure that adequate and accurate health information is provided in the relevant certificates.

    (15) Commission Regulation (EC) No 599/2004 (12) provides that health certificates are to accompany the movements of certain products of animal origin. In order to prevent the spread of African swine fever to other areas of the Union, where a Member State is subject to a prohibition on the dispatch of fresh pigmeat, meat preparations and meat products consisting of, or contain-ing pigmeat from certain parts of its territory, certain requirements should be laid down, in particular as regards certification, for the dispatch of such meat, meat preparations and meat products from other areas of the territory of that Member State not subject to that prohibition and those health certificates should include a reference to this Decision.

    (16) In addition, it is appropriate, in order to prevent the spread of African swine fever to other areas of the Union and to third coun-tries, to provide that the dispatch of fresh pigmeat, meat preparations and meat products consisting of, or containing meat of pigs from Member States with the areas listed in the Annex, is subject to certain more stringent conditions. In particular, such fresh pigmeat, meat preparations and pigmeat products should be marked with special marks which cannot be confused with the identification mark provided for in Regulation (EC) No 853/2004 of the European Parliament and of the Council (13)and with the health marks for pigmeat provided for in Regulation (EC) No 854/2004 of the European Parliament and of the Council (14).

    (17) The period of application of the measures provided for in this Decision should take account of the epidemiology of African swine fever and the conditions to regain the African swine fever free status according to the Terrestrial Animal Health Code of the World Organization for Animal Health and therefore this period should last at least until 31 December 2018.

    (18) For reasons of clarity Implementing Decision 2014/178/EU should therefore be repealed and replaced by this Decision. (19) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,

    Food and Feed, HAS ADOPTED THIS DECISION: (EU) 2015/251 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever in

    certain Member States. The Annex to that Decision demarcates and lists certain areas of those Members States differentiated by the level of risk based on the epidemiological situation. That list includes certain areas of Estonia, Italy, Latvia, Lithuania and Poland.

    (2) Article 11 of Implementing Decision 2014/709/EU, providing for a prohibition on the dispatch to other Member States and third countries of fresh pig meat and of certain pig meat preparations and pig meat products from areas listed in the Annex, should be reviewed in order to improve its consistency as regards derogations applicable to exports to third countries.

    (3) Since October 2014, a few cases of African swine fever in wild boar were reported at the border between Estonia and Latvia, in both Member States in an area included in Part I of the Annex to Implementing Decision 2014/709/EU. Two cases were reported in Lithuania in Kaunas and Kupiškis.

    (4) The evolution of the current epidemiological situation should be considered in the assessment of the risk represented by the animal health situation in Estonia, Latvia and Lithuania. In order to focus animal health control measures and to prevent the spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjusti-fied barriers to trade by third countries, the Union list of areas subject to the animal health control measures provided for in Im-plementing Decision 2014/709/EU should be amended to take into account the current animal health situation as regards that disease situation in Estonia, Latvia and Lithuania.

    (5) It is therefore necessary to amend the Annex to Implementing Decision 2014/709/EU to include in Part II of that Annex the rele-vant areas of Estonia, Latvia and Lithuania.

    (6) Implementing Decision 2014/709/EU should therefore be amended accordingly. (7) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,

    Food and Feed, HAS ADOPTED THIS DECISION: (EU) 2015/558 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever

    in certain Member States. The Annex to that Decision demarcates and lists certain areas of those Members States differentiated by the level of risk based on the epidemiological situation. That list includes certain areas of Estonia, Italy, Latvia, Lithuania and Poland.

    (2) Article 7 of Implementing Decision 2014/709/EU, providing for a derogation from the prohibition on the dispatch of consign-ments of animal by-products from porcine animals from the areas listed in Parts III and IV of the Annex to that Implementing Decision, should be reviewed in order to allow for a safe disposal of animal by-products of porcine origin other than feral pigs, including unprocessed bodies of dead animals, from holdings located in the areas listed in Part III of the Annex in a manner that is in line with the risk represented by these animal by-products.

    (3) In the period from January to February 2015, an outbreak of African swine fever in domestic pigs was reported in Poland and several cases in wild boar were reported in Lithuania and Poland in the restricted area listed in Part II of the Annex to Imple-

    menting Decision 2014/709/EU. In February and March 2015 few cases were reported in Latvia in the restricted areas listed in Part I and Part III of the Annex to Implementing Decision 2014/709/EU.

    (4) The evolution of the current epidemiological situation should be considered in the assessment of the risk represented by the animal health situation in Latvia, Lithuania and Poland. In order to focus animal health control measures and to prevent the spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjusti-fied barriers to trade by third countries, the Union list of areas subject to the animal health control measures provided for in the Annex to Implementing Decision 2014/709/EU should be amended to take into account the current animal health situation as re-gards that disease in Latvia, Lithuania and Poland.

    (5) Implementing Decision 2014/709/EU should therefore be amended accordingly. (6) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,

    Food and Feed, HAS ADOPTED THIS DECISION: (EU) 2015/820 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever in

    (2) Between March and May 2015, three notification of cases of African swine fever in wild boar were reported by Poland (in the gmina of Narewka) and Estonia (in the vald of Rannu and in the vald of Viljandi) in the restricted area listed in Part I of the An-nex to Implementing Decision 2014/709/EU.

    (3) The evolution of the current epidemiological situation should be considered in the assessment of the risk represented by the animal health situation in Poland and Estonia. In order to focus animal health control measures and to prevent the spread of Af-rican swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures provided for in the Annex to Im-plementing Decision 2014/709/EU should be amended to take into account the current animal health situation as regards that disease in Poland and Estonia.

    (4) Implementing Decision 2014/709/EU should therefore be amended accordingly. (5) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,

    Food and Feed, HAS ADOPTED THIS DECISION: (EU) 2015/1169 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever

    (2) In May 2015, a number of cases of African swine fever in wild boar were notified by Poland (in the gmina of Michalowo), fol-lowed by Lithuania (in rajono savivaldybė of Prienai and Kėdainiai) and Estonia (in the vald of Türi) within the areas listed in the Annex to Implementing Decision 2014/709/EU. Those cases occurred either in the areas listed in Part I of that Annex or in areas listed in Parts II and III that were in proximity to Part I.

    (3) The evolution of the current epidemiological situation in the Union as regards African swine fever should be considered in the assessment of the risk represented by the animal health situation as regards that disease in Estonia, Lithuania and Poland. In or-der to focus animal health control measures and to prevent the further spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to Implementing Decision 2014/709/EU should be amended to take into account the current animal health situation as regards that disease in those three Member States.

    (4) Implementing Decision 2014/709/EU should therefore be amended to modify the areas listed in Parts I and II of Estonia, Lithua-nia and Poland.

    (5) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

    (EU) 2015/1318 (1) Commission Implementing Decision 2014/709/EU (4) lays down animal health control measures in relation to African swine

    (2) In July 2015, one case of African swine fever in wild boar and three outbreaks in domestic pigs were notified by Estonia within the areas listed in the Annex to Implementing Decision 2014/709/EU. The case in wild boar occurred in the area listed in Part I of that Annex while the three outbreaks in domestic pigs occurred in Part II of that same Annex.

    (3) In July 2015, cases of African swine fever in wild boar were notified by Latvia within the areas listed in the Annex to Implement-ing Decision 2014/709/EU. Those cases occurred in areas listed in Parts II and III that were in proximity to Part I.

    (3) In August 2015, two outbreaks of African swine fever in domestic pigs were notified by Latvia within the areas listed in the Annex to Implementing Decision 2014/709/EU. These outbreaks occurred in areas listed in Part II of that Annex.

    (4) In August 2015, several outbreaks of African swine fever in domestic pigs were notified by Lithuania within the areas listed in the Annex to Implementing Decision 2014/709/EU. Six of these outbreaks occurred in the areas listed in Part II of that Annex.

    (5) The evolution of the current epidemiological situation in the Union as regards African swine fever should be consid-ered in the assessment of the risk represented by the animal health situation as regards that disease in Estonia, Lat-via and Lithuania. In or-der to focus animal health control measures and to prevent the further spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to Implementing Decision 2014/709/EU should be amended to take into account the current animal health situation as regards that disease in those Member States.

    (4) Implementing Decision 2014/709/EU should therefore be amended accordingly. (5) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,

    Food and Feed, HAS ADOPTED THIS DECISION: (EU) 2015/2433 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever in

    the Member States or areas thereof listed in the Annex thereto (‘the concerned Member States’). Those measures include prohibi-tions on the dispatch of live pigs, porcine semen, ova and embryo, pig meat, pig meat preparations, pig meat products and any other products containing pig meat, as well as consignments of animal by-products from porcine animals, from certain areas of the concerned Member States (‘the commodities’). That Annex demarcates and lists those areas to take account of the level of risk based on the epidemiological situation in the concerned Member States.

    (2) In order to adapt the animal health control measures laid down in Implementing Decision 2014/709/EU to the evolution of the epidemiological situation in the different areas of the Member States concerned, and to take account of the different risk levels depending on the type of commodities, it is appropriate to provide for certain derogations for certain types of commodities origi-nating from the areas listed in the different Parts of the Annex to that Implementing Decision. Those derogations should also be in line with the risk mitigation measures for importation as regards African swine fever indicated in the Terrestrial Animal Health Code of the World Organisation for Animal Health. The additional safeguard measures and animal health requirements applicable, in case such derogations are granted, should also be described in that Implementing Decision.

    (3) The prohibition on the dispatch of live pigs from the areas listed in Part III of the Annex to Implementing Decision 2014/709/EU is particularly stringent and may therefore lead to logistic and animal welfare problems where the slaughtering of pigs in the re-spective areas is not possible, in particular due to the absence of an appropriate slaughterhouse or limitations in slaughtering capacity within the relevant areas listed in Part III of that Annex either within the same Member State or in the territory of an-other Member State listed in the Annex.

    (4) The movement of live pigs for immediate slaughter poses less risk than other types of movements of live pigs provided that risk mitigation measures are in place. It is therefore appropriate that when the circumstances described in recital 3 occur, the Mem-ber States concerned may exceptionally grant derogations for the dispatch of live pigs from the areas listed in Part III of the An-nex for immediate slaughter to a slaughterhouse located outside that area in the same Member State or in the territory of another Member State listed in the Annex provided that risk mitigating measures are met in order not to jeopardise disease control.

    (5) In terms of the risk of the spread of African swine fever, movements of different porcine commodities pose different levels of risk. As a general rule, the movement of porcine semen from restricted areas poses significant risks in terms of exposure and conse-quences. However, the application of additional risk mitigating measures, such as testing and increased biosecurity, can allow for derogations for semen collected in the areas listed in Parts II and III of the Annex to Implementing Decision 2014/709/EU. Article 9 of that Implementing Decision should therefore be amended.

    (6) The derogations for the dispatch of certain live pigs from the areas listed in Parts II and III of the Annex to Implementing Deci-sion 2014/709/EU to other areas listed in Part II or III of that Annex of another Member State with a similar disease status are justified provided that specific risk mitigating measures are applied. The flexibility provided by these new measures is important in order to ensure proper implementation of the measures in a medium and long term perspective. This requires the establish-ment of a safe channelling procedure under the strict control of the competent authorities of the Member State of transit and des-tination. Articles 3 and 4 of that Implementing Decision should therefore be amended.

    (7) As an additional risk mitigating measure, a channelling procedure should be in place in order to isolate animals coming from areas with a higher risk for African swine fever. It is therefore necessary to clarify and specify the procedures for the dispatch, transit and delivery of live pigs.

    (8) The derogations provided for in Implementing Decision 2014/709/EU for the dispatch of live pigs and semen between areas with a comparable risk for African swine fever should only be applied when approved by the competent authorities of the Member States of transit and destination, prior to such movement.

    (9) Council Directive 64/432/EEC provides that health certificates are to accompany the movements of live animals. Where deroga-tions from the prohibition on the dispatch of live pigs from the areas listed in the Annex to Implementing Decision 2014/709/EU are applied to live pigs intended for intra-Union trade, those health certificates should include a reference to that Implementing Decision so as to ensure that adequate and accurate health information is provided in the relevant certificates.

    (10) The period of application of the animal health control measures provided for in Implementing Decision 2014/709/EU should take account of the epidemiology of African swine fever and the conditions required to regain disease-free status for African swine fe-ver in accordance with the Terrestrial Animal Health Code of the World Organisation for Animal Health. Therefore, the period of application of Implementing Decision 2014/709/EU should be extended until 31 December 2019.

    (11) Several cases of African swine fever in wild boar in Estonia and Latvia are located in the areas listed in Parts II and III of the Annex to Implementing Decision 2014/709/EU. These cases are located in close proximity to the areas listed in Part I of that An-nex.

    (12) African swine fever has never been reported in the most Northern areas in Poland currently listed in Part II of the Annex to Implementing Decision 2014/709/EU.

    (14) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

    HAS ADOPTED THIS DECISION: (EU) 2016/180 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever

    in certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Member States in Parts I, II, III and IV of that Annex differentiated by the level of risk based on the epidemiological situation. That list includes certain areas of Estonia, Italy, Latvia, Lithuania and Poland.

    (2) Since September 2014, no outbreaks of African swine fever in domestic pigs have been notified in the rajono savivaldybė of Ig-nalina, Molėtai, Rokiškis, Švenčionys, Utena, Zarasai and the savivaldybė of Visaginas in Lithuania. In addition, supervision of biosecurity measures has been implemented in holdings in a satisfactory manner and results of surveillance show the absence of African swine fever virus in holdings in those areas of Lithuania. This indicates an improvement in the epidemiological situation. Accordingly, those areas of that Member State should now be listed in Part II, instead of Part III, of the Annex to Implementing Decision 2014/709/EU.

    (3) In December 2015, few cases of African swine fever in wild boar occurred in Estonia, Lithuania and Poland, in the areas listed in Part II of the Annex to Implementing Decision 2014/709/EU, in close proximity to the areas listed in Part I of that Annex. In the same period, one case of African swine fever in wild boar in Estonia occurred in the area listed in Part I of that Annex.

    (4) The evolution of the current epidemiological situation in the Union as regards African swine fever should be considered in the assessment of the risk represented by the animal health situation as regards that disease in Estonia, Lithuania and Poland. In or-der to focus animal health control measures and to prevent the further spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to Implementing Decision 2014/709/EU should be amended to take into account the changes in the current epidemiological situation as regards that disease in Estonia, Lithuania and in Poland.

    (5) Implementing Decision 2014/709/EU should therefore be amended to modify the areas listed in Parts I and II of Estonia and Poland and in Parts I, II and III of Lithuania.

    (6) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

    HAS ADOPTED THIS DECISION: (EU) 2016/464 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever

    in certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Members States in Parts I, II, III and IV of that Annex differentiated by the level of risk based on the epidemiological situation. That list includes certain areas of Estonia, Italy, Latvia, Lithuania and Poland.

    (2) Since February 2015, no outbreaks of African swine fever in domestic pigs have been notified in the areas of Poland that are listed in Part III of the Annex to Implementing Decision 2014/709/EU. In addition, supervision of biosecurity measures has been implemented in a satisfactory manner in holdings in those areas based on the national programme for biosecurity aimed at the prevention of the spread of African swine fever. These facts indicate an improvement in the epidemiological situation. According-ly, those areas of that Member State should now be listed in Part II, instead of Part III, of the Annex to Implementing Decision 2014/709/EU.

    (3) In February 2016, one case of African swine fever in wild boar occurred in Estonia in the areas listed in Part II of the Annex to Implementing Decision 2014/709/EU, in close proximity to the areas listed in Part I of that Annex. Accordingly, certain areas listed in Part I should be listed in Part II of the Annex to Implementing Decision 2014/709/EU.

    (4) The evolution of the current epidemiological situation in the Union as regards African swine fever should be considered in the assessment of the risk represented by the animal health situation as regards that disease in Estonia and Poland. In order to focus animal health control measures and to prevent the further spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to Implementing Decision 2014/709/EU should be amended to take in-to account the changes in the current epidemiological situation as regards that disease in Estonia and in Poland.

    (5) Implementing Decision 2014/709/EU should therefore be amended to modify the areas listed in Parts I and II of Estonia and in Parts II and III of Poland.

    (6) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

    HAS ADOPTED THIS DECISION: (EU) 2016/857 (1) Commission Implementing Decision 2014/709/EU (4) lays down animal health control measures in relation to African swine

    fever in certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Members States in Parts I, II, III and IV of that Annex differentiated by the level of risk based on the epidemiological situation. That list in-cludes certain areas of Latvia.

    (2) In March and April 2016, three cases of African swine fever in the areas of Cesis and Ogre in wild boar occurred in Latvia in the areas listed in Part II of the Annex to Implementing Decision 2014/709/EU, in close proximity to the areas listed in Part I of that Annex. Accordingly, certain areas listed in Part I should be listed in Part II of the Annex to Implementing Decision 2014/709/EU. For ensuring territorial continuity of Part III in Latvia, the pilseta of Ainazi and the pilseta of Salacgnva should be included in Part III of the Annex thereto.

    (3) The evolution of the current epidemiological situation in the Union as regards African swine fever should be considered in the assessment of the risk represented by the animal health situation as regards that disease in Latvia. In order to focus animal health control measures and to prevent the further spread of African swine fever, as well as to prevent any unnecessary disturb-ance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to Implementing Decision 2014/709/EU should be amended to take into ac-count the changes in the current epidemiological situation as regards that disease in Latvia.

    (4) Implementing Decision 2014/709/EU should therefore be amended to modify the areas listed in Parts I, II and III of Latvia. (5) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,

    Food and Feed, HAS ADOPTED THIS DECISION: (EU) 2016/1236 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever

    in certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Members States in Parts I, II, III and IV of that Annex differentiated by the level of risk based on the epidemiological situation. That list includes certain areas of Estonia, Latvia, Lithuania and Poland.

    (2) In June and July 2016, further cases of African swine fever in wild boar populations occurred in the areas of Jekabpils County, Baldones County and Riga County in Latvia, further cases in wild boar populations occurred in the areas of Pärnu County, Har-ju County and in Rapla County in Estonia and a case in wild boar populations occurred in the area of Czyże in Poland. Those areas are listed in Part I of the Annex to Implementing Decision 2014/709/EU, in close proximity to the areas listed in Part II of that Annex. Accordingly, certain areas of Estonia, Latvia and Poland listed in Part I should now be listed in Part II and some new areas of Latvia should be listed in Part I of the Annex to Implementing Decision 2014/709/EU.

    (3) In June and July 2016, further outbreaks of African swine fever in domestic pigs occurred in Jõgeva County and Lääne-Viru County in Estonia, certain areas of Estonia currently listed in Part II should now be listed in Part III of the Annex to Implement-ing Decision 2014/709/EU.

    (4) In June and July 2016, further outbreaks of African swine fever in domestic pigs occurred in the area of Elektrėnai, Anykšciu and Kruonio in Lithuania. Those areas are currently listed in Part II of the Annex to Implementing Decision 2014/709/EU. Accord-ingly, in Lithuania certain areas listed in Part II should be listed in Part III of that Annex.

    (5) In June and July 2016, further outbreaks of African swine fever in domestic pigs occurred in the area of Hajnówka in Poland, This area is currently listed in Part II of the Annex to Implementing Decision 2014/709/EU. Accordingly, in Poland, the existing list in Part I of the Annex to Implementing Decision 2014/709/EU should be expanded to the south and certain areas listed in Parts I and II should be listed in Part III of that Annex.

    (6) The evolution of the current epidemiological situation of African swine fever in the affected wild boar populations in the Union should be considered in the assessment of the animal health risk represented to the situation as regards that disease in Estonia, Latvia, Lithuania and Poland. In order to focus animal health control measures and to prevent the further spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to Implement-ing Decision 2014/709/EU should be amended to take into account the changes in the current epidemiological situation as re-gards that disease in Estonia, Latvia, Lithuania and Poland.

    (7) The Annex to Implementing Decision 2014/709/EU should therefore be amended accordingly. (8) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,

    Food and Feed, HAS ADOPTED THIS DECISION: (EU) 2016/1372 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever

    in certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Members States in Parts I, II, III and IV thereof differentiated by the level of risk based on the epidemiological situation. That list includes certain areas of Latvia and Poland.

    (2) In August 2016, cases of African swine fever in feral pig populations occurred in the area of Tukums in Latvia. This area is listed in Part I of the Annex to Implementing Decision 2014/709/EU and it is in close proximity to the unrestricted areas of Latvia. In August 2016, an outbreak of African swine fever in domestic pigs occurred in Gulbenes in Latvia in part II of the Annex thereto. The occurrence of this second outbreak constitutes an increase in the level of risk that needs to be taken into account. According-ly, certain areas of Latvia listed in Part I should now be listed in Part II, certain new areas of Latvia should be included in the list in Part I and certain areas of Latvia listed in Part II should be included in the list in Part III of the Annex to Implementing Decision 2014/709/EU.

    (3) In August 2016, one outbreak of African swine fever in domestic pigs occurred in Wysokomazowiecki in Poland in an area cur-rently listed in Part I of the Annex to Implementing Decision 2014/709/EU. The occurrence of this outbreak, together with the absence of viral circulation of this disease in the feral pig populations in proximity of the outbreak constitute an increase in the level of risk that needs to be taken into account. In August 2016, another outbreak of African swine fever in domestic pigs oc-curred in Siemiatycki in Poland in close proximity to the border with Belarus. The occurrence of this second outbreak, together with unknown situation in this neighbouring third country, constitutes an increase in the level of risk that needs to be taken into account. Accordingly, certain areas of Poland listed in Part I should now be listed in Part III and certain new areas of Poland should be included in the list in Part I of the Annex to Implementing Decision 2014/709/EU.

    (4) The evolution of the current epidemiological situation of African swine fever in the affected feral pig populations in the Union should be taken into account in the assessment of the animal health risk posed by to that situation as regards that disease in Lat-via and Poland. In order to focus the animal health control measures provided for in Implementing Decision 2014/709/ EU and to prevent the further spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to that Implementing Decision should be amended to take into account the changes in the current epidemio-logical situation as regards that disease in Latvia and Poland.

    (5) The Annex to Implementing Decision 2014/709/EU should therefore be amended accordingly.

    (6) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed

    (EU) 2016/1405 (1) Commission Implementing Decision 2014/709/EU (4) lays down animal health control measures in relation to African swine

    fever in certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Members States in Parts I, II, III and IV thereof differentiated by the level of risk based on the epidemiological situation. That list includes certain areas of Poland.

    (2) In August 2016, two outbreaks of African swine fever in domestic pigs occurred in the powiat bialski in Poland in an area cur-rently listed in Part I of the Annex to Implementing Decision 2014/709/EU. The occurrence of this outbreak, together with the re-cent change in the epidemiological situation constitutes an increase in the level of risk that needs to be taken into account. Ac-cordingly, certain areas of Poland listed in Part I of the Annex to Implementing Decision 2014/709/EU should now be listed in Part III of that Annex.

    (3) The Commission notes that there are several further outbreaks in domestic pigs which could, based on preliminary evidence, be attributed to human activity instead of feral pigs and that are therefore being covered by a separate Commission Decision. Once confirmatory evidence from Poland has been obtained in relation to these outbreaks, the measures provided for in this Decision should be reviewed to exclude the risk of the spread of the disease in feral pigs.

    (4) The evolution of the current epidemiological situation of African swine fever in the affected feral pig populations in the Union should be taken into account in the assessment of the animal health risk posed by to that situation as regards that disease in Po-land. In order to focus the animal health control measures provided for in Implementing Decision 2014/709/EU and to prevent the further spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to that Implementing Decision should be amended to take into account the changes in the current epidemiological situation as regards that disease in Poland.

    (5) The Annex to Implementing Decision 2014/709/EU should therefore be amended accordingly. (6) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,

    Food and Feed, HAS ADOPTED THIS DECISION:

    (EU) 2016/1441 (1) Commission Implementing Decision 2014/709/EU (4) lays down animal health control measures in relation to African swine

    fever in certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Members States in Parts I, II, III and IV thereof differentiated by the level of risk based on the epidemiological situation. That list includes certain areas of Estonia.

    (2) In August 2016, one outbreak of African swine fever in domestic pigs and one case in a feral pig occurred in the Saare County in Estonia in an area currently not listed in the Annex to Implementing Decision 2014/709/EU. The occurrence of this outbreak and the case in feral pigs constitute an increase in the level of risk that needs to be taken into account. Accordingly, certain areas of Estonia should now be listed in Parts I, II and III of the Annex to Imple-menting Decision 2014/709/EU.

    (3) The evolution of the current epidemiological situation of African swine fever in the affected feral pig populations in the Union should be taken into account in the assessment of the animal health risk posed by to that situation as re-gards that disease in Estonia. In order to focus the animal health control measures provided for in Implementing Decision 2014/709/EU and to prevent the further spread of African swine fever, as well as to prevent any unneces-sary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to that Implementing Decision should be amended to take into account the changes in the current epidemiological situation as regards that disease in Es-tonia.

    (4) The Annex to Implementing Decision 2014/709/EU should therefore be amended accordingly. (5) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants,

    Animals, Food and Feed, HAS ADOPTED THIS DECISION: (EU) 2016/1771 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever in

    certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Members States in Parts I, II, III and IV thereof differentiated by the level of risk based on the epidemiological situation. That list includes certain areas of Poland.

    (2) African swine fever has never been reported in the most northern areas in Poland currently listed in Part II of the Annex to Im-plementing Decision 2014/709/EU.

    (3) The absence of any outbreak in the most northern areas in Poland needs to be taken into account and Part II of the Annex to Implementing Decision 2014/709/EU should be reviewed. Accordingly, certain areas of Poland currently listed in that Part II should now be listed in Part I of that Annex.

    (4) In September 2016, one outbreak of African swine fever in domestic pigs occurred in the rajono savivaldybė of Kėdainiai in Lithuania in an area currently listed in Part II of the Annex to Implementing Decision 2014/709/EU. The occurrence of this out-break, together with the recent change in the epidemiological situation constitutes an increase in the level of risk that needs to be taken into account. Accordingly, certain areas of Lithuania listed in Part II of the Annex to Implementing Decision 2014/709/EU should now be listed in Part III of that Annex.

    (5) The evolution of the current epidemiological situation of African swine fever in the affected feral pig populations in the Union should be taken into account in the assessment of the animal health risk posed by to that situation as regards that disease in

    Lithuania and Poland. In order to focus the animal health control measures provided for in Implementing Decision 2014/709/EU and to prevent the further spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to that Implementing Decision should be amended to take into account the changes in the current epidemiological situation as regards that disease in Lithuania and Poland.

    (6) The Annex to Implementing Decision 2014/709/EU should therefore be amended accordingly. (7) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,

    Food and Feed, HAS ADOPTED THIS DECISION: (EU) 2016/1900 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever

    in certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Members States in Parts I, II, III and IV thereof differentiated by the level of risk based on the epidemiological situation. That list includes certain areas of Estonia, Latvia and Poland.

    (2) In August 2016, a single outbreak of African swine fever in domestic pigs occurred in the powiat moniecki in Poland in an area currently listed in Part I of the Annex to Implementing Decision 2014/709/EU; in September 2016 another single case of African swine fever in wild boar occurred in that same area. In September 2016, a small number of outbreaks of African swine fever in domestic pigs occurred in powiat łosicki and in powiat siemiatycki in Poland in an area currently listed in Part III of the Annex to Implementing Decision 2014/709/EU, in close proximity to the areas listed in Parts I and II of that Annex. The occurrence this disease in these areas, together with the recent change in the epidemiological situation constitutes an increase in the level of risk that needs to be taken into account. Accordingly, certain areas of Poland listed in Part I of the Annex to Implementing Decision 2014/709/EU should now be listed in Part III of that Annex.

    (3) Since October 2015, there have been no outbreaks of African swine fever in domestic pigs notified in those areas of Estonia that are listed in Part III of the Annex to Implementing Decision 2014/709/EU located south to road number 92. In addition, supervi-sion of biosecurity measures, based on the national programme for biosecurity aimed at the prevention of the spread of African swine fever, has been implemented in those areas. These facts indicate an improvement in the epidemiological situation. Accord-ingly, those areas of that Member State should now be listed in Part II, instead of Part III, of the Annex to Implementing Decision 2014/709/EU.

    (4) In September 2016, a single outbreak of African swine fever in domestic pigs occurred in the novads of Gulbenes in Latvia in an area currently listed in Part II of the Annex to Implementing Decision 2014/709/EU. The occurrence of this outbreak, together with the recent change in the epidemiological situation constitutes an increase in the level of risk that needs to be taken into ac-count. Accordingly, certain areas of Latvia should now be listed in Part III, instead of Part II, of that Annex.

    (5) The evolution of the current epidemiological situation of African swine fever in the affected domestic and feral pig populations in the Union should be taken into account in the assessment of the animal health risk posed by to that situation as regards that dis-ease in Estonia, Latvia and Poland. In order to focus the animal health control measures provided for in Implementing Decision 2014/709/EU and to prevent the further spread of African swine fever, while preventing any unnecessary disturbance to trade within the Union and avoiding unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to that Implementing Decision should be amended to take into account the changes in the current epidemiological situation as regards that disease in Estonia, Latvia and Poland.

    certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Members States in Parts I, II, III and IV thereof differentiated by the level of risk based on the epidemiological situation. That list includes, amongst others, certain areas of Latvia, Lithuania and Poland.

    (2) In October 2016, few cases of African swine fever in wild boar occurred in the republikas pilsēta of Jūrmala and in the novads of Dundagas in Latvia in two areas currently listed in Part I of the Annex to Implementing Decision 2014/709/EU. The occurrence of these cases constitutes an increase in the level of risk that needs to be taken into account. Accordingly, the relevant areas of Latvia should now be listed in Part II, instead of Part I, of that Annex and new areas should be included in Parts I and II of the Annex thereto.

    (3) In October 2016, two cases of African swine fever in wild boar occurred in the powiat bialski and in the powiat białostocki in Poland in areas currently listed in Part III (for the former) and in Part II (for the latter) of the Annex to Implementing Decision 2014/709/EU in close proximity to the areas listed in Parts I of that Annex. Accordingly, the relevant areas of Poland listed in Part I of the Annex to Implementing Decision 2014/709/EU should now be listed in Part II of that Annex and new areas should be includ-ed in Part I of the Annex thereto.

    (4) Since September 2015, no outbreaks of African swine fever in domestic pigs have been notified in certain areas of Latvia and Lithuania which are listed in Part III of the Annex to Implementing Decision 2014/709/EU. In addition, supervision of biosecuri-ty measures has been implemented in a satisfactory manner in holdings in those areas based on the national programme for bi-osecurity aimed at the prevention of the spread of African swine fever. These facts indicate an improvement in the epidemiologi-cal situation.     (5) The evolution of the current epidemiological situation of African swine fever in the affected domestic and feral pig populations in the Union should be taken into account in the assessment of the animal health risk posed by to that situation as regards that dis-ease in Latvia, Lithuania and Poland. That list includes, amongst others, certain areas of Latvia.

    (2) In January 2017, one outbreak of African swine fever in domestic pigs occurred in the in the novads of Krimuldas in Latvia in an area currently listed in Part II of the Annex to Implementing Decision 2014/709/EU. The occurrence of this outbreak constitutes an increase in the level of risk that needs to be taken into account. Accordingly, the relevant areas of Latvia should now be listed in Part III, instead of Part II, of that Annex.

    (3) The evolution of the current epidemiological situation of African swine fever in the affected domestic and feral pig populations in the Union should be taken into account in the assessment of the animal health risk posed by that situation as regards that disease in Latvia. In order to focus the animal health control measures provided for in Implementing Decision 2014/709/EU and to pre-vent the further spread of African swine fever, while preventing any unnecessary disturbance to trade within the Union and avoiding unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to that Implementing Decision should be amended to take into account the changes in the current epidemiologi-cal situation as regards that disease in Latvia.

    (4) The Annex to Implementing Decision 2014/709/EU should therefore be amended accordingly. (5) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,

    Food and Feed, HAS ADOPTED THIS DECISION: (EU) 2017/351 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever in

    certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Member States in Parts I, II, III and IV thereof differentiated by the level of risk based on the epidemiological situation. That list includes, amongst others, certain areas of Latvia and Lithuania.

    (2) In February 2017, two outbreaks of African swine fever in domestic pigs occurred in the novads of Salaspils in Latvia and in the rajono savivaldybė of Biržai in Lithuania in areas which are currently listed in Part II of the Annex to Implementing Decision 2014/709/EU. The occurrence of these outbreaks constitutes an increase in the level of risk that needs to be taken into account. Accordingly, the relevant areas of Latvia and Lithuania listed in Parts I and II should now be listed in Part III of that Annex.

    (3) In January 2017, few cases of African swine fever in wild boar occurred in the novads of Talsu and Tukuma in Latvia in two areas currently listed in Part II of the Annex to Implementing Decision 2014/709/EU but in close proximity to the areas listed in Part I of that Implementing Decision. The occurrence of these cases constitutes an increase in the level of risk that needs to be taken into account. Accordingly, the relevant areas of Latvia should now be listed in Part II, instead of Part I, of that Annex and new areas should be included in Part I of the Annex thereto.

    (4) The evolution of the current epidemiological situation of African swine fever in the affected domestic and feral pig populations in the Union should be taken into account in the assessment of the animal health risk posed by that situation as regards that disease in Latvia and Lithuania. That list includes, amongst others, certain areas of Lithuania.

    (2) Since November 2016, no outbreaks of African swine fever in domestic pigs have been notified in certain areas of Lithuania which are listed in Part III of the Annex to Implementing Decision 2014/709/EU.     (4) The Annex to Implementing Decision 2014/709/EU should therefore be amended accordingly. (5) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,

    Food and Feed, HAS ADOPTED THIS DECISION: (EU) 2017/767 (1) Commission Implementing Decision 2014/709/EU lays down animal health control measures in relation to African swine fever in

    certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Members States in Parts I, II, III and IV thereof differentiated by the level of risk based on the epidemiological situation. That list includes, amongst others, certain areas of Poland.

    (2) Since November 2015, no cases of African swine fever in wild boar have been notified in the most Northern areas of Poland which are listed in Part II of the Annex to Implementing Decision 2014/709/EU. In addition, surveillance and wild boar man-agement practices have been applied in these areas. These facts indicate an improvement in the epidemiological situation in these areas. Accordingly, those areas of Poland should now be listed in Part I, instead of Part II, of that Annex.

    (3) Between January and March 2017, few cases of African swine fever in wild boar were observed in the powiecie łosickim in Po-land in an area currently listed in Part III of the Annex to Implementing Decision 2014/709/EU and in proximity to areas cur-rently listed in Part I of that Annex. The occurrence of these cases constitutes an increase in the level of risk that needs to be tak-en into account. Accordingly, the relevant areas of Poland should now be listed in Part II, instead of Part I, of that Annex.

    (4) The evolution of the current epidemiological situation of African swine fever in the affected domestic and feral pig populations in the Union should be taken into account in the assessment of the animal health risk posed by that situation as regards that disease in Poland. In order to focus the animal health control measures provided for in Implementing Decision 2014/709/EU and to pre-vent the further spread of African swine fever, while preventing any unnecessary disturbance to trade within the Union and avoiding unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to that Implementing Decision should be amended to take into account the changes in the current epidemiologi-cal situation as regards that disease in Poland.

    (5) The Annex to Implementing Decision 2014/709/EU should therefore be amended accordingly. (6) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,

    Food and Feed, HAS ADOPTED THIS DECISION:

    (EU) 2017/1196 (1) Commission Implementing Decision 2014/709/EU (4) lays down animal health control measures in relation to African swine

    fever in certain Member States. Those measures include prohibitions on the dispatch of live pigs, pig meat, pig meat prepara-tions, pig meat products and any other products consisting of or containing pig meat from certain areas of the Member States concerned.

    (2) Article 6 of Council Directive 2002/60/EC (5) recognises the existence of holdings consisting of different production units and allows the application of derogations related to different levels of risks that can be recognised by the competent authority. This should be reflected in the derogations provided for in Article 3 of Implementing Decision 2014/709/EU.

    (3) The movement of live pigs for immediate slaughter poses less risk than other types of movements of live pigs provided that risk mitigation measures are in place. Slaughtering pigs from the areas listed in Part III of the Annex to Implementing Implementing Decision 2014/709/EU only at the end of a slaughter day during which no other pigs are slaughtered thereafter may be included in the risk mitigation measures. This should be reflected in the derogations from the prohibition on the dispatch of consignments of live pigs for immediate slaughter provided for in Article 4 of that Implementing Decision.

    (4) Article 3 of Directive 2002/99/EC provides that products of animal origin are to be obtained from animals which do not come from a holding, establishment, territory or part of a territory subject to animal health restrictions under the rules set out in An-nex I to that Directive, including control measures for African swine fever as laid down in Directive 2002/60/EC. As a conse-quence, slaughterhouses, cutting plants and meat processing establishments located in protection and surveillance zones defined according to Directive 2002/60/EC are restricted in the production, processing and distribution of pig meat, pig meat prepara-tions, pig meat products and any other products consisting of or containing pig meat. Given the negligible risk it represents, a derogation should be foreseen for the slaughterhouses, cutting plants and meat processing establishments located in protection and surveillance zones provided that the products have been produced, stored and processed in establishments located in areas listed in Parts I, II or III of the Annex to Implementing Decision 2014/709/EU under specific conditions.

    (5) The measures in place for the dispatch to other Member States and third countries of live pigs from the areas listed in the Annex to Implementing Decision 2014/709/EU need to be reviewed in order to take into account the absence of the disease in the areas listed in Part I of that Annex. In order to ensure the sustainability of the measures, a proportionate relaxation should be foreseen only in case of pigs being moved from an area in Part I of that Annex to other holdings in located in an area in Part I thereof provided that the other risk mitigation measures remain in place.

    (6) The need to mitigate the risks presented by the transport of live feral pigs from the Member States listed in the Annex to Imple-menting Decision 2014/709/EU needs to be addressed. This practice involves a particularly high risk commodity and should be prevented by reinforcing and extending the measures already in place for feral pigs.

    (7) To ensure that information about the requirements concerning the restrictions in force under Implementing Decision 2014/709/EU for products of pig origin, including feral pigs products, is effectively conveyed to travellers, passenger transport operators and postal services should bring those requirements to the attention of travellers moving from the areas listed in the Annex to that Implementing Decision.

    (8) In May 2017, few cases of African swine fever in wild boar were observed in the Tukuma novads and in certain areas of Ventspils novads in Latvia in an area currently listed in Part II of the Annex to Implementing Decision 2014/709/EU and in prox-imity to areas currently listed in Part I of that Annex. The occurrence of these cases constitutes an increase in the level of risk that needs to be taken into account. Accordingly, the relevant areas of Latvia should now be listed in Part II, instead of Part I, of that Annex.

    (9) The risk of spreading African swine fever in wildlife is linked to the natural slow spread among the wild boar populations and also the man-related actions as documented by the scientific reports produced by the European Food Safety Authority (6). In or-der to account for the epidemiological events in the Union which occurred since 2014 in relation to this disease and in order to address the risks presented by African swine fever as well as the need to act in a proactive manner when defining the areas to be included into the Annex to Implementing Decision 2014/709/EU, higher risk areas of a sufficient size surrounding the areas listed in Parts II and III of that Annex should be included under Part I thereto for the entries of Latvia, Lithuania and Poland. These newly included areas should take into account the seasonality of the disease in the region and it should be reviewed by the Commission in October 2017 when the risk of spread will be reassessed according to the evolution of the epidemiological situa-tion.

    (10) The evolution of the current epidemiological situation in the Union as regards African swine fever should be considered in the assessment of the risk represented by the animal health situation as regards that disease in Latvia, Lithuania and Poland. In or-der to focus animal health control measures and to prevent the further spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in Part I of the Annex to Implementing Decision 2014/709/EU should be amended to take into account the animal health situation as regards that disease in those three Member States.

    (11) Implementing Decision 2014/709/EU should therefore be amended accordingly. (12) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals,
