Pursuant to K.S.A. 40-246i, the Commissioner of Insur-ance is publishing notice that the thresholds for exempt-ed commercial purchasers are updated as follows:

• K.S.A. 40-246i(a) “Exempt commercial purchaser” means any person purchasing commercial insur-ance that, at the time of placement, meets the fol-lowing requirements:1. [updated] Possesses a net worth in excess of

$22,661,900, except that this amount shall be adjusted every five years by publication in the Kansas register by the commissioner of insur-ance to account for the percentage change in the consumer price index;

2. [updated] generates annual revenues in excess of $62,308,917, except that this amount shall be adjusted every five years by publication in the Kansas register by the commissioner of insur-ance to account for the percentage change in the consumer price index;

Request for CommentsThe City of Chanute, Kansas is in the process of updat-

ing their Industrial Pretreatment Program, Enforcement Response Plan (ERP). A copy of the proposed modifica-tions may be obtained from the City Manager’s Office, 101 S. Lincoln, Chanute, Kansas, during regular working hours. The city can also be contacted by calling 620-431-5200 for more information.

Public NoticeThe Kansas Department of Health and Environment

(KDHE) has reviewed an application from Waste Con-nections of Kansas, Inc., for a permit to establish and operate a waste tire collection center. Waste tires will be collected on-site, as a part of the existing transfer station operations, then separated by being on rims or not. Tires will be placed in two separate roll-off containers, which will be taken to a waste tire processor approximately every thirty days. A maximum of 800 Passenger Tire Equivalents (PTEs) will be allowed on-site, according to their proposed Facility Operating Plan (1 PTE = 20 lbs. of whole or processed tires).

The Collection Center will be located in the SE ¼ of Section 26, Township 26S, Range 1W, in Sedgwick Coun-ty, at the address of 4300 W, 37th St. North, Wichita, Kan-sas. KDHE has reviewed the application and found it to be in conformance with state solid waste statutes and regulations.

KDHE is providing public notice of its intent to issue a permit to Waste Connections of Kansas, Inc, for the proposed waste tire collection center described herein. A copy of the administrative record, which includes the draft permit and all information regarding this permit

action, is available for public review until March 18, 2022, during normal business hours, Monday through Friday, at the following location:

Notice Concerning Kansas/Federal Water Pollution Control Permits and Applications

In accordance with Kansas Administrative Regula-tions 28-16-57a through 63, 28-18-1 through 17, 28-18a-1 through 31 and 33, 28-16-150 through 154, 28-46-7, and the authority vested with the state by the administrator of the U.S. Environmental Protection Agency, various draft water pollution control documents (permits, notic-es to revoke and reissue, notices to terminate) have been prepared and/or permit applications have been received for discharges to waters of the United States and the state of Kansas for the class of discharges described below.

The proposed action is to reissue an existing State/NPDES permit for an existing facility. This facility is a three-cell wastewater stabili-zation lagoon system. This NPDES discharging lagoon wastewater treatment facility has been reviewed for eligibility for the MDV for ammonia and has been determined to be eligible. Eligibility was de-termined through analysis of the facility’s highest attainable crite-ria (HAC) for ammonia and an Economic Eligibility Determination (EED) that assessed the impact of the cost of a new mechanical facil-ity to the community’s rate payers. The ammonia effluent limit was determined on 8/12/2021 by calculating the 99th percentile ammonia value from the facility’s discharge monitoring reports resulting in an ammonia limit of 4.3 mg/L for this facility. The EED was completed on 11/18/2021. The proposed permit contains limits for biochemical oxygen demand, total suspended solids, pH, and ammonia, as well as monitoring for E. coli and total phosphorus.

Minimum RequirementsMSA and Roadway Worker Protection

• Contractors must complete, and have on file, a cur-rent Master Services Agreement with the K&O Rail-road prior to any work commencing.

• Prior to beginning any work, contractors shall com-ply with all parts of 49 CFR Part 214 and 219 regard-ing FRA Roadway Worker Safety at all times. Men and equipment shall remain clear of the track unless they have gained Roadway Worker Protection from a qualified person.

• Contractor, contractor employees, agents and/or subcontractors must be enrolled and comply with the FRA 219 approved drug testing program.

• Any subcontracted work will need to be approved by the K&O Railroad prior to any work starting.

• As of January 1, 2021, all contractors will be re-quired to complete WATCO Contractor Orientation at https://watcocontractor.com. Any contractor who was previously enrolled in e-SHORTLINE with Watco in the past, will be required to complete the WATCO Contractor Orientation.

Work WindowsImpact to current railroad operations must be kept to

a minimum. When work must take place that causes an active track to be taken out of service for the purposes of performing work that pertains to the project, the contrac-tor must pre-arrange a defined work window with the railroad. Contractor can anticipate a work window of no more than a two-day rail closure/crossing. No more than four-day road closure is allowed as this will greatly affect the local area. Allow time for city to apply HMAC for the approaches and time to harden before road is re-opened to the public. This topic will be further discussed during the pre-proposal meeting.Standards

All standards referenced by the project plans and spec-ifications, as well as all applicable AREMA standards must be upheld during all phases of the project work, unless certain standards are excluded from the project with written approval by the K&O Railroad.Submittals

Material storage is granted on rail-road right of way to the contractor. However, no materials shall be stored closer than 15’ from the centerline of any ac-tive track, at any time. Material and equipment laydown areas and reclaimed materials stockpiling locations shall be discussed and further clarified at the pre-proposal meeting. Contractor is to haul all materials off property and properly dispose of. Contractor may use the K&O Orient yard and/or Santa Fe/Gilbert area for material lay-downs if need be.Non-Project Areas

The K&O Railroad has secured access to the project through the railroad right of way. Other access may be obtained by the contractor if he/she so chooses. All ar-eas (public, private, and railroad right of way) that are used for access to the project, including parts of the rail-road right of way which have no proposed work, shall be maintained and/or remediated, incidental to the project, by the contractor to the satisfaction of the property own-er if any damage to these areas occurs.Pre-Proposal Meeting

The K&O Railroad shall hold a pre-proposal meeting at 10:00 a.m. (CST) Friday, February 25th, 2022, at the Harry Street/K-42 crossing (DOT # 445172N) in Wichita, Kansas.
